Chairman Fontaine called the meeting to order at 7 p.m.
Mr. Wald, seconded by Mr. Valsvik, moved approval of the minutes of Dec,
11, 1995; all in favor.
Case No. V/95-88 A variance to the sideyard setback (10' required, 5' 9-
1/2" requested) for the construction of an entry, master bedroom and deck
addition at 1109 W. Willard St. in the RA, One Family Residential District.

Stefan, architect, and Susan Clark, property owner, appeared
regarding the request. Ms. Clark explained the location of the house on the
lot, the shape of the lot and proximity of the house to neighboring property
owners. The addition will not obstruct anyone's view, she said. The
addition will be guttered for drainage. The entire structure, both the
existing house and the addition, will be re-sided and re-roofed.
Del Peterson, 1201 W. Willard St., spoke in favor of the proposal.
Mr. Stefan noted that another variance will be needed for the front
setback, as a small piece of the addition will extended into the required
setback. The requested front yard setback is 20 feet, the requested
sideyard setback, including overhang, is 2' 9-1/2".
Mr. Roetman suggested adding a condition of approval that all drainage
remain on site.
Mr. Valsvik, seconded by Mr. Wald, moved approval as conditioned; all in
favor.

Case No. SUB/95-91 A request to subdivide an existing parcel into two
lots at 911 County Road 5. Gary Howe, applicant.
Case No. BM/95/90 A request to move a house to 911 County Road 5. Gary
Mr. Howe explained that he has purchased the Bell house behind Target and
wants to move the house to his property on County Road 5. The house
would be placed directly behind the existing house on the lot; the lot is
100' x 410'. Only one tree will have to be removed. The only way to get the
house into the new location is to use a road in John Roettger's new
subdivision; Mr. Roettger has given permission to use the road. The moving
firm does not foresee any problems, he said.
Mr. Zoller asked about sewer and water hookup. Mr. Howe said the water
service will be brought up from County Road 5; the sewer hookup will be
from Roettger's addition.

Mr. Roettger said there was no problem with the sewer hookup. He said he
had given permission for use of the road. However, he said the move has to
be done when the ground is still frozen or the road might be damaged. Mr.

engineer has asked for a contour plan to be prepared.
Mr. Valsvik, seconded by Mr. Wald, moved approval of Cases 95-90 and 95-
91 as conditioned. Mr. Fontaine expressed a concern about the removal of
trees. It was suggested that conformance to the city's tree ordinance be
added to the conditions of approval for Case No. 95-90. Mr. Valsvik and Mr.
Wald agreed to the amendment to the motion of approval. Motion passed
unanimously.
10 Fitzgerald suggested that if the extension is granted, the Planning
Case No. SUP/V/95-92 A special use permit and variance for a restaurant
at 131 S. Main St. in the CBD, Central Business District. Sandra Hudson,
applicant.
Ms. Hudson explained the restaurant will include both sit-down and take-
out business. She said because the existing bakery portion of the building
may need extensive code updates, it may not be feasible to continue a
bakery use in that part of the building. However, that usage will not
impact her business proposal.
James Laskin, 308 E. Chestnut St., raised the general issue of the litter
problem created by the many take-out businesses in the downtown area.
Mr. Hamlin suggested that problem is related to the bigger issue of solid
waste disposal throughout the downtown area.

Mr. Roetman, seconded by Mr. Hamlin, moved approval as conditioned; all in
favor.
Other business
Request for extension of time for a special use Kermit for tem op rary
trailer at Trinity Lutheran Church parking lot. Case No. SUP/94-2.
Mr. Valsvik, representing Trinity Lutheran Church, and Jim Kroenig,
representing Family Service of St. Croix, presented the request. Mr.
Valsvik noted the trailer is well maintained, and there have been no
complaints regarding its usage. The trailer is needed due to space
constraints until Family Service finds another location. When the initial
permit was granted, it was thought the agency would have moved by the
end of the two years; that hasn't happened, thus the request for a two year
extension. Mr. Kroenig said the two year extension would be beneficial to
the agency, which is in the process of hiring a new executive director. Ms.
Commission should make sure it is the final extension.
Mr. Hamlin, seconded by Mr. Wald, moved extension of SUP 94-2, with the
permit to be terminated on or before March 1998. Motion passed 6-0, with
Mr. Valsvik abstaining.
Paul Schaefer of Schaefer Development, St. Cloud, developer of the Calibre
Ridge townhouse project appeared before the commission to "test the
waters" regarding the possibility of obtaining a special use permit to
develop an apartment building with underground parking on the 4.4 acres
he owns to the east of the Calibre Ridge project.
It was the consensus of commission members that such a request would
be an "up hill battle" considering Mr. Schaefer's earlier proposal for an
apartment building in that area had been turned down by the City Council
due to concerns about traffic.
Revised dark and trail dedication polLcX
Ms. Fitzgerald went through the revised dedication policy, which for the
first time includes a trail dedication fee, as well as land/fees for park
dedication. In addition to some technical changes, the primary change is an
increase in the required park dedication. Mr. Magnuson had not reviewed
the final draft of the revised policy.
Mr. Hamlin, seconded by Mr. Roetman, moved concept approval of the
revised policy; all in favor.
Mr. Hamlin, seconded by Mr. Roetman, moved to adjourn the meeting at 8:40
p.m.
