APPROVAL OF MINUTES
Motion by Glenna Bealka, seconded by Don Valsvik to approve the minutes of May 9, 1994 as
submitted. All in favor.
PUBLIC HEARINGS
Case No. SUB/94-27 -
• A minor subdivision of a 51,844 sq.ft. (1.2 acres) into three lots of 13,475 sq. ft., 16,469 sq.ft.
and 21,900 sq. ft. The property is located on Gilbert Court in the RA, Single Family Residential
District. Steve Fiterman, applicant.
Steve Russell explained the request to combine parts of four lots, including Outlot A at the end
of the Gilbert Court cul de sac, and resubdivide them into three buildable lots.
Brian Benson, whose mother's property is included in the request, was also present.
The lots would be in compliance with the zoning requirements. There are three recommended
conditions of approval. Mr. Fiterman stated that there will be as little grading and tree removal
as possible.
Duane Elliott asked about sanitary sewer elevation.
Saleem Malek, 1050 Gilbert Court, stated that when he bought his lot he was told by the
builder's representative that nothing would be built on the outlot.
Mr. Russell stated that only zoning requirements and lot size are the concerns of the City.
Tom Harvieux, 1102 Gilbert Court, stated that he is concerned about the trees, and questioned
how the driveway will be put in without removing the trees.

Mr. Russell stated that one of the conditions of approval is that no more than 50 percent of the
trees can be removed.
Dwight Roehl, 1049 Gilbert Court, stated that he was unaware of Mr. Fiterman's plan, and he
was led to believe that his home was at the end of the cul de sac and there would be no more
construction. This is one of the main reasons he purchased his lot.
Tamara Malek, 1050 Gilbert, asked how two homes will be built between homes numbered 1049
and 1050. She stated that they paid more for their lot because it was at the end of the cul de sac.
Karen Neal, 1348 Benson Blvd., asked for clarification of the drainage issue discussed at the City
Council meeting, because the water runs across her property. Mr. Russell stated that a meeting
will be held with the developer tomorrow at 10:00 to discuss the drainage issue.
James Neal, 1348 Benson Blvd., asked for clarification of the conditions of approval.
Motion by Rob Hamlin, seconded by Kirk Roetman to approve the Subdivision request with three
conditions plus a fourth condition that the tree removal plan, grading plan and opinion of the City
Engineer be brought back to the Planning Commission before final approval. Motion failed.
Ayes - 3; Nays - 4.
• Motion by Duane Elliott, seconded by Glenna Bealka to approve the subdivision request with
three conditions: 1)A grading/drainage tree removal plan shall be submitted for review and
approval of the Public Works Director before council review of the preliminary plat. 2)A 20 foot
pedestrian easement from Gilbert Court to Lily Lake School property shall be provided along the
western side of Lot 1 and the pathway shall be improved before final plat approval. 3) No more
than 50 percent of tree cover shall be removed from Lots 1 or 2 to prepare the sites for
construction. Motion carried. Ayes - 5; Nays 2.
Case No. V/94-28 -
A variance to the rearyard setback requirement (25 feet required, 17 feet requested) for the
construction of a 13 x 12 ft. deck. The property is located at 1348 Benson Blvd. W. in the RA,
Single Family Residential District. James and Karen Neal, applicants.
Mr. Neal stated that he would prefer not to change the design and location of the proposed deck
because that would place the deck in front of windows on both the upper and lower levels of the
home.
Steve Russell stated that the School District called to express their concern about the proposed
deck because of the proximity to school district property and their future use.

Members of the Planning Commission felt that the deck could be reconfigured so that it did not
extend into the setback. They did not feel a hardship had been established because of the other
options.
Motion by Duane Elliott, seconded by Kirk Roetman to deny the Variance request. Motion
carried 7-0.
Case No. SUB/94-29 -
A minor subdivision of Lots 1, 4, and 5, Staples and May Addition (22,500 sq. ft.), into two lots
of 11,250 sq.ft. The property is located at 814 N. Everett Street in the RB, Two Family
Residential District.
William Conley presented the request for the owner, Elvera Conley.
Duane Elliott stated that there is substantial drainage from the West. Steve Russell suggested a
condition of approval requiring a 6 ft. drainage easement along the west and south property lines.
Ann Selleck, owner of the lot to the west, asked if there are plans for a new house and where the
driveway will be located. Steve responded that no plans other than the subdivision request have
been submitted.
Duane Elliott suggested that a condition of approval be added that when the lot is sold a drainage
plan will be required.
Motion by Rob Hamlin, seconded by Don Valsvik to approve the subdivision request with three
conditions as recommended. Carried 7-0.
Case No. V/94-30 -
A variance to the sideyard setback requirement for a corner lot (30 feet required, 18 feet
proposed) for the construction of a garage addition. The property is located at 1251 W. Orleans
in the RA, Single Family Residential District.
Richard Rodrigue, owner, presented the request. There is one recommended condition of
approval which the Commission amended : The garage shall be the same color and material as
the home.
Motion by Dorothy Foster, seconded by Rob Hamlin to approve the Variance request with one
condition. Carried 7-0.

Case No. V/94-31 - A variance to the rearyard setback requirement (2 ft. proposed, 5 ft. required)
for the construction of a garage at 416 S. 4th Street in the RB, Two Family Residential District.
James Huntsman, owner, presented the request. The garage will be located on an existing
foundation. There is one recommended condition of approval.
Motion by Dorothy Foster, seconded by Rob Hamlin to approve the variance request with one
condition. Carried 7-0.
Case No. V/94-32 - A variance to the rearyard setback requirement (5 ft. required, 0 ft. proposed)
for the construction of a garage addition at 504 N. 2nd Street in the RB, Two Family Residential
District.
Mike and Nance Anders, owners, presented the application. There is one recommended condition
of approval.
Motion by Kirk Roetman, seconded by Glenna Bealka to approve the variance request as
conditioned. Carried 7-0.
Case No. V/94-33 - A variance to the sideyard setback requirement (20 ft. required,
approximately 7 ft. proposed) for the construction of a storage garage at 1750 W. Frontage Road
in the BP-C, Business Park Commercial District.
Tim Balstad presented the request. There are three recommended conditions of approval. The
Commission amended condition No. 1: Evergreens or bush lilacs shall be planted along the south
and west side of the shed.
Motion by Rob Hamlin, seconded by Don Valsvik to approve the Variance request as
conditioned. Motion carried 7-0.
Case No. V/94-34 - A variance to the frontyard setback requirement (30 ft. required, 16 ft.
proposed) for the construction of a garage addition at 722 S. Martha Street in the RB, Two
Family Residential District.
Robert Clark, owner, presented the request.
A petition against the request was presented by neighboring residents. Sharon Parnell, 716 S.
Martha, next door to the applicant stated she is opposed because it would restrict her view.
Motion by Rob Hamlin, seconded by Duane Elliott to deny the variance request. Carried 6-1.

Case No. SUP/94-35 - A special use permit to conduct outside sales (food vending) on private
property at 229 S. Main Street (private vacant lot) in the CBD, Central Business District.
Thomas Loome, Stillwater Book Center, presented the application. The vendors will be located
so that they will not block any access.
The Planning Commission determined that "local" food service establishments cannot be required.
There are three recommended conditions of approval. The Commission added a fourth: The
permit shall be reviewed in one year.
Motion by Rob Hamlin, seconded by Kirk Roetman to approve the Special Use Permit with four
conditions. Carried 7-0.
OTHER BUSINESS
Review and discuss Park Dedication Policy
Ann Terwedo reviewed the Park Dedication Policy which was revised by the Parks and
Recreation Board. The City's Park Plan Standards have been redefined, and fees have been
increased based on fair market value and may be updated annually.
• Motion by Don Valsvik, seconded by Kirk Roetman to approve by resolution the revised Park
Dedication Policy. Carried 7-0.
Comprehensive Plan follow up to June 6, 1994 meeting.
Steve Russell reviewed the meeting of June 6. He reviewed the Comprehensive Plan process:
to receive input, to look at the goals and objectives and determine which of the four alternatives
meets the goals and objectives. There will be three more workshops held on the Comp. Plan,
tomorrow, Saturday, and next Wednesday.

Motion by Kirk Roetman, seconded by Duane Elliott to adjourn the meeting at 9:23 p.m.
