APPROVAL OF MINUTES Motion by Mark Ehlenz, seconded by Don Valsvik to approve the minutes of January 9, 1989 as submitted. All in favor. PUBLIC HEARINGS • Case No. V/89-1 - Variance for the side yard and rear yard setback requirements for a garage located at 1225 South Second Street. James Weber, owner, presented the application. The garage has already been constructed with a four foot rear yard setback (five is required) and a three foot side yard setback (five is required). No building permit had been applied for because the owner originally planned an addition to the garage. After construction began, he realized that the original structure would have to be removed and a new structure built. The commission agreed that the new structure was an improvement to the property, but that there should be some penalty imposed for failure to apply for a building permit. Motion by Don Valsvik to approve the variance request with the condition that the applicant pay double building permit fee, and to make note to the City Council that there should be a substantial increase in after-the-fact permit fees in the future.
