APPROVAL OF MINUTES Motion by Judy Curtis, seconded by Mark Ehlenz to approve the minutes of June 13, 1988 as submitted. All in favor. PUBLIC HEARINGS • Case No. SUP/88-39 - Special Use Permit to conduct a computer software and computer supplies business out of a residential home located at 2807 Woodridge Lane. Steven Palmer presented the application. • Mr. Palmer stated that the business would be run in a manner similar to that of an Avon representative. He will be ordering supplies for his customers and making deliveries. There will be no additional traffic or parking created at his residence except for the delivery of products by the regular mail, federal express, or UPS. Chairman Fontaine stated that traffic and safety are the major concerns in approving this type of request, and those issues do not appear to be a problem in this case. Mr. Palmer asked for clarification of Condition No. 2 which states: Any complaints about the business will cause revocation of the Special Use Permit. The Commission agreed to amend the condition to read: Any complaints about the business will cause review and possible revocation of the Special Use Permit. Judy Curtis made a motion to approve the Special Use Permit with three conditions as amended. Mark Ehlenz seconded. Motion carried 6-0. Case No. V/88-38 - Variance to the Sign ordinance for the placement of signs at 1750 South Greeley Street (new Minuteman convenience store). Mark Ogren, Croix Oil Company, presented the request for four illuminated signs: An ID (Ground Sign), Canopy Sign parallel to 1 • Stillwater Planning Commission Minutes July 11, 1988 Greeley Street, a Canopy Sign parallel to Curve Crest, and a building sign. Mr. Ogren has amended the original request in order to comply with staff recommendations. The ID (Ground Sign) will be reduced to 25 ft. in height rather than the requested 37 ft. 6 in. The existing base will be used. A variance will be required in order to have the sign remain at its present location. As illuminated canopy signs are not allowed, the request,has been amended by removing the name "FINA" from the canopy signs, leaving only the red and blue striping, and the lighting has been reduced by 1/3 on each side. The illuminated building sign is within the general purpose of the Sign Ordinance. Following discussion regarding the canopy, the Commission determined that it could not be considered a sign because only graphics would appear, not the name of the business. Motion by Don Valsvik, seconded by Rob Hamlin to approve the Variance request as presented, subject to conditions. Motion carried 5-0; Judy Curtis abstained. • Case No. V/88-40 - Variance request to construct a swimming pool in a side yard location (rear yard required) at 1504 West Pine Street. Thomas Doe, property owner, presented the request. Assistant Planner Pung-Terwedo explained to the Commission that a second variance would be required for the 6 ft. privacy fence requested (42 inches required for sideyard fence). Following discussion with the applicant, the Commission determined that the property line on the Hemlock Street side is in question. Staff has recommended a survey of the property, and the Commission agreed. Approval will be given based on the condition that evidence of the property line be submitted prior to the City Council public hearing. Don Valsvik made a motion to approve Case No. V/88-40 subject to two conditions: 1) A detailed survey describing the exact locations of the property lines must be submitted. The drawing attached to the application is not correct. 2) Variance for 6 ft. fence. Rob Hamlin seconded. Motion carried 6-0. OTHER BUSINESS Mr. Fontaine reported on action taken by the City Council at the • July 5 meeting. Sign Ordinance - The Commission reviewed and discussed the changes and additions to the new sign ordinance. Ms. Pung- Terwedo stated that a public hearing on the sign ordinance will be held next month. 2 • Stillwater Planning Commission Minutes July 11, 1988 Grading Permits - The Commission reviewed and discussed a new ordinance regarding grading permits and erosion control measures.
