Present: Councilwomen Avise and Bodlovick, Councilmen MacDonald and Peterson and Mayor Junker Absent: None Also Present: Finance Director /Coordinator, Kriesel; City Clerk, Schnell; City Attorney, Magnuson; Public Safety Director, Abrahamson; Superintendent of Public Works, Shelton; Fire Chief, Chial; Building Official, Zepper; Director of Parks & Recreation, Blekum; Consulting Engineers, Elliott and Moore Press: St. Croix Valley Free Press - Jeanne Landkammer Citizens: Red Swager, Reuben Granquist INDIVIDUALS AND DELEGATIONS MR. NORVIN SWAGER, appeared before the Council in behalf of Reuben Granquist, regarding the development of his property abutting McKusick Lake. He explained the proposed Townshouse concept as opposed to the condominium type and they would come back with a complete plan as to how it will appear, but did not want to spend the money until they have Council approval of the concept, and work with the Planning Commission. In the discussion it was brought out that it is possible that they will need some variances to accomplish this as when you do a PUD the ordinances are thrown out in a sense - this is a variation of a rezoning. On motion of Councilman Peterson, seconded by Councilwoman Avise, the Council was in favor of the concept of townhouses on this property, subject to the controls of the PUD. AYES -- Councilwoman Avise, Councilmen MacDonald and Peterson and Mayor Junker NAYS -- Councilwoman Bodlovick. (motion carried) COMMITTEE REPORTS PUBLIC WORKS 1. MR. SHELTON reported on the condition of the railings on the Main Street stairs and also the Willard Street stairs and requested permission to get quotations for the repair of same. On motion of Councilman Peterson, seconded by Councilwoman Avise, the Council authorized Jack Shelton to obtain quotes for the repair of the railings on the Main Street and Willard Street stairs. (all in favor) 2. MR. SHELTON informed the Council that Mr. Don Hansen is contemplating the building of a home below his current property on South Broadway and if it works out he will start construction, and it is possible that the City may receive inquiries about what is going on in the area. PUBLIC SAFETY No report PARKS & RECREATION 1. On motion of Councilwoman Bodlovick, seconded by Councilwoman Avise, the Council approved the following Beer Permit- District No. 834 Women's Recreation League - O'Brien Field, July 31 and August 1 and 2, 1981 - all day (License to sell) FIRE CHIEF 1. CHIEF CHIAL inquired about the flushing out of the water system at Charter Oaks and MR. ELLIOTT stated that they will do the final inspection on same and will notify Mr. Chial when they are ready to flush same out. 2. CHIEF CHIAL is also concerned about the impassable streets within this complex and felt that something should be done about the condition of these streets since if there was a fire they would encounter problems. 451 • • • 1 452 • BUILDING OFFICIAL No report July 21, 1981 COUNCIL REQUEST ITEMS 1. COUNCILMAN HARRY PETERSON inquired about the signing of the streets in downtown Stillwater and the installation of the replacement meters especially on Water Street, and he was informed that they are experiencing problems setting the pipes for same. 2. COUNCILMAN HARRY PETERSON commented on the messy appearances of the boulevards and pin- pohted certain areas in town - fire hydrants that are covered with weeds and weeds growing out of sidewalks. The Council directed that Mr. Shelton send letters to these property owners asking them to correct the situation and that if they do not take care of it within the required number of days. that the City will have the work done and bill them for the cost of the work. CONSULTING ENGINEER'S REPORT 1. MR. ELLIOTT inquired about the meters along the roadway on South Main Street - there is sufficient width for parking but with no sidewalk it is impossible to put in the meters there and they would have to be 25c meters - Mr. Shelton stated that the curb was painted yellow and there will be no meters there. And there were questions about the meters on the East side of Main Street and this will be checked out with the State. 2. MR. MOORE reported on the progress of the various projects (1) the Lily Lake pumping project is complete and he has the final estimate in his office; (2) the Center Street and Pine Tree Trail overflow are both finished; (3) the Curve Crest project is ready for the waring course and the center islands were being done today and then the seeding and then that project will be completed; (4) Charter Oaks is under strike again and that should be finished by now. CITY ATTORNEY'S REPORT 1. MR. MAGNUSON reported on the assessment appeals - the Jay Kimble appeal on Local Improvement No. 152, the improvement went along his sideyard - he rwasea ess deforf assessed storm sewer and sideyard benefit from the street - the City's app y that the market value has been enhanced by $4,000 and the assessment was $2,700 and he just received a letter from Mr. Kimble's lawyer saying that they will offer $1,000 which would mean that the City would be giving up $1,700 if we accept that. It is a question forthe judge to decide - the City had agreed to offer him $500 as that would be the cost of the appraiser and he asked the Council if they just wanted to let it go to court - the Council concurred that it should go to court, and see if there is another offer. 2. There are nine appeals on the Parking Lot - Local Improvement No. 166 which trial has been set for August 31st - the Council offered the general reduction in the assessments of 25% based on the anticipated revenue from the meters - at the pre - trial Simonet Furniture and Carpet accepted the 25% and all the other people said that they are going to trial - last week he received a letter from Simonets stating that they have with- drawn their acceptance. All of these nine will be tried at once and that will save the City some expense. He said that our appraiser is going to say that the market value has been increased and they will have appraisers that will say that it has not - some of these are question - able - the still wouldn't % as was if before were better the offntoegoe to court on these. 3. The appeals on Local Improvement No. 171 are from John Ogren, Hooleys and Super Value for the storm sewer assessment which will be two weeks later and then two weeks later there will be the appeals on Local Improvement No. 173 for Brooks Hauser and Emerson and he anticipates being able to settle these - Mr. Emerson is going to approach the City for a little rezoning for some mixed used and if that is worked out then the assessment could possibly be resolved. They feel that the full property should be served off Croixwood Blvd. and the City feels that there should not be a line on private property to the portion on County 5. The total was $9,000 for the water and the City offered them $3 000 as that would be the cost of the installation to Brooks on the original improvement, and he is hopeful that one will be settled. 4. The Supreme Court sent him a letter last week stating that the pre- hearing judge had recommended that Judge Thoreen's order on the Riverside Crane case be summarily confirmed and has asked for a letter by the 31st of July - he has also sued the City for $42,000 in damages and that is a District Court case and some day it may come to trial - he will keep the City informed on the Supreme Court appeal. • • • • In P July 21, 1981 ^' 3. MR. MOORE reported on the Annexation Petition from Baytown Township to Oak Park Heights and he distributed to the Council his review of same. This matter will be considered at a future Council meeting. -1 CITY COORDINATOR'S REPORT 1. MR. KRIESEL informed the Council that he had two quotes on the new boiler unit for City Hall - $6,495 from Palen Kimball and one for $4,860 from Combustion Heat and Power which are for gas type burners - he had a quote of $2,000 to upgrade the present system which is a combined gas /oil burner and it is possible that there could be additional costs since the gas portion of this unit has never been fired. This new unit will save forty to fifty percent on fuel and this could be $5,000 to $6,000 per year. On motion of Councilwoman Bodlovick, seconded by Councilman Peterson, the Council authorized the purchase of the new furnace unit from Combustion Heat and Power at a cost figure of $4,860 for the unit installation and the removal of the old unit. (all in favor) 2. MR. KRIESEL brought up the matter of signing of the City's property by Mrs. Nutting - they will put a sign on the barricade "Private Property - Keep Out ". 3. MR KRIESEL explained to the Council that the Water Department's salaries are included in the computation for the premiums for Worken's Comp Insurance - Mr. McGarry does not feel that they should be figured into the City's computations - the savings that the City would have if the Water Department were a separate entity the City's premium would be $4,000 less - the Water Department would pay $800 and there would be a net savings of $3,200 - On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council directed that the City Coordinator send a letter to the McGarry- Kearney Agency requesting the Water Department's calculations not be included in the City's Workers Compensation premium. (all in favor) 4. MR. KRIESEL requested that those who plan to attend the Levy Limit Seminar would notify him by Friday of this week - this will be held on July 30th at the Civic Center in St. Paul. 5. MR. KRIESEL asked Council for permission to release the Escrow for Oak Glen Development down to the amount that would be remaining to the work on the project and he will check this figure out with Mr. On motion of Councilwoman Bodlovick, seconded by Councilwoman Council authorized the release of the David Johnson Escrow down to (all in favor) 6. On motion of Councilwoman Bodlovick, seconded by Councilwoman Avise, a resolution was introduced "APPROVING THE RE- APPORTIONMENT OF ASSESSMENTS FOR THE ERICKSON POST PROPERTY SPLIT ". AYES -- Councilwomen Avise and Bodlovick, Councilmen MacDonald and Peterson and Mayor Junker NAYS- -None (see resolutions) 7. On motion of Councilwoman Bodlovick, seconded by Councilman Peterson, the City Clerk was directed to execute the deed for the split of the Erickson Post property. (all in favor) CITY CLERK'S REPORT 1. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the summons from Velma Ratledge and Edwin Ratledge regarding an accident on the sidewalk by the Cosmopolitan State Bank, was directed to be sent to the McGarry - Kearney Insurance Agency. Present: Absent: Also Present: Press: Citizens: INDIVIDUALS & DELEGATIONS 1. MR. NORBERT RIEPE, 302 Edgewood Avenue, appeared before the Council again regarding the condition of the Edgewood Ditch and submitted his photos of the present condition of this ditch. MR. ELLIOTT explained the background of this problem for the benefit of the new Council members and others, and the various things that have been done to attempt to correct the situation. There was discussion about drawing up some specs to pipe it and then sod over the top - and an alternate one with the easterly half left with the swail. It was also mentioned that this is what was wanted at the time this was developed by some of the residents there. There will continue to be a ditch and there will be inlets into the pipe. MAYOR JUNKER asked that the engineer draw the specs and then get the bids and it is possible to do it as a Change Order under the Oak Glen Development. 2. GREG appeared before the Council requesting the use of Pioneer Park for public rehearsals for their Blues Band - there are six members and they would like to do this on weekend afternoons from 2 to 5 P. M. - this would be for three weekends. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council granted permission to the Blues Band to practice in Pioneer Park subject to reviewal after the first appearance so if there are problems they will have to cease same. On motion of Councilwoman Bodlovick, seconded by Councilwoman Avise, the Council authorized the ordering of the street lights for the Lux's Addition and the request for the Deerpath Addition will be considered later when it is ready for the utilities. Sixth Street - for a lot size variance and a Conditional Use Permit for a single family dwelling - William McDonough, 704 South First Street - variance for two residences on one piece of property by remodeling carriage house for living quarters - Walter Hagen, 519 West Pine - variance for a swimming pool on the west side of their home. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council agreed to use the 1980 runs for the calculations for the EMS Funds. (all infavor) 2. MR. SHELTON explained the problems with a storm sewer location between the Kiolbasaand Plain residences on Willard Street and that they do have the catch basins and piping available and Mr. Pete Miller could do the work at a cost of $1,930 - the tqtal length would be about 250 feet. i.y On motion of Councilwoman Bodlovick, seconded by Councilman Peterson, the Superintendent of Public Works was directed to have Mr. Peter Miller repair the 6144 storm sewer on Willard Street at a cost figure of $1,930.00. (all in favor) RESOLUTIONS The following resolutions were read and on roll call were unanimously adopted: 1. Directing the Payment of the Bills. 2. Swager Bros. Annexation. 3.
