Mayor Junker reconvened the meeting at 7:30 P. M.
The Invocation was given by the City Clerk.

UNFINISHED BUSINESS ( out of order)
1. MR. RON LANGNESS presented the seven bids that were received for the $350,000
Bond Sale.
The City Clerk presented to the Council affidavits showing publication in the
official newspaper and the Commercial West of a notice of sale of $350,000 General
Obligation Bonds of 1931 of the City, for which sealed bids were to be received
and considered at this meeting in accordance with the resolution adopted by the
City Council on November 18. Said affidavits were examined and found satisfactory
and directed to be placed on file in the office of the Clerk.
The Clerk then announced that six sealed bids has been received pursuant to said
notice.' of call for bids. The bids were then opened, read and tabulated, and the
highest and best bid of each bidder was found to be as follows:

On motion of Councilman Roger Peterson, seconded by Councilman Harry
.., Peterson, a resolution was introduced AUTHORIZING ISSUANCE, AWARDING SALE,
PRESCRIBING THE FORM. AND DETAILS AND PROVIDING FOR THE PAYMENT OF $350,000
GENERAL OBLIGATION BONDS OF 1981 ".

INDIVIDUALS AND DELEGATIONS
1. BRIAN NELSON AND W. ROBERT SMITH, I1 appeared before the Council requesting the
transfer of the liquor license for the Grand Garage and Gallery for 1981 from
Gerry Perkl. They hope to be open in June and they plan to finish the restora-
tion of this building and they plan to open the restaurant which will be managed
by some experienced restaurant operators.
On motion of Councilman Harry Peterson, seconded by Councilman Roger
Peterson, the Council authorized the transfer of the existing liquor license
held by Gerry Perkl under whatever terms are normal procedure. (a.l in favor)
2. MARY HAUSER, candidate for the Metro Council from this district explained her
qualifications for this position and her community involvement through various
organizations. She is a resident of Birchwood.
PUBLIC HEARINGS
1. This was the day and time for the public hearing on Case No. 398 for a Special
Use Permit for Sue Dahlin, 2316 Oakridge Road for a Consignment Shop in her
home.
Notice of the hearing was published in the Stillwater Evening Gazette, the
official newspaper of the City on December 5, 1980 and copies were mailed to
all property owners within 300 feet.
The Mayor opened the hearing.
SUE DAHLIN distributed to the Council support statements and signatures from her
neighbors for this shop - she wanted to be treated as an individual and asked for
their approval of this request. This would be consignment of craft items.
No one appeared as being opposed or in favor of this request.
The Planning Commission requested that there be a review after six months,
but they did approve the Special Use Permit.
The Mayor closed the hearing.
On motion of Councilman Roger Peterson, seconded by Councilwoman Bodlovick,
the Council followed the recommendation of the Planning Commission and granted
the Special Use Permit with a review in six months from the opening date.

w 2 This was the say and time for the public hearing on Case No. 396 for Preliminary
Plat approval of the Deerpath Addition.
Notice of the hearing was publlished in the Stillwater Evening Gazette, the
official newspaper of the City on December 4, 1980 and copies were mailed to
all property owners within 300 feet.
The Mayor opened the hearing.
MR. BRUCE FOLZ spoke in behalf of the applicant - there is 19.2 acres which will
be platted into 30 single family residential plans - all oots have more than
75 feet frontage and all lots are over 10,000 sqaure feet - they propose that
the City will do a feasibility on the sewer and water utilities and the developer
is also proposing that the City would install the improvements and then assess
the property - there is sufficient ponding for storm water ponding on this site -
there are no lands within the property that they feel that are adequate for
parkland dedication - they propose to make this in a cash payment. The owner
has not put together any covenants or restirctions up to this time and this will
be done in the near future.
MR. ELLIOTT stated that he had not had the opportunity to study this matter -
Reliance would also have a hearing on what is happening and also on which is
happening in the Oak Glenn Development and he would be able to give Mr. Folz
the cost of the feasibility study sometime tomorrow.
MR. MAGNUSON stated that the Council should talk about whether the City is going
to install the improvements and what kind of assessment policy - there maybe
... some oversizing, etc.

MR. ELLIOTT stated there is no oversizing necessary; however, the manner in which
that property be best sewered is somewhat of a question whether it goes into the
existing system to the east or through a Reliance lift station -there would be no
oversizing, but there could be a sharing in a lift station cost.
MR. MAGNUSON stated that they give preliminary approval if the developer is
agreeable to paying the cost of the feasibility study.
COUNCILMAN ROGER PETERSON asked what OUTLOT A was intended to be and MR. FOLZ
stated that it was to be a storm water ponding area.
COUNCILMAN ROGER PETERSON asked if it would be possible to have it dedicated as
a storm ponding area rather than call it OUTLOT A and MR. MAGNUSON stated that it
would help the City and establish the level and responsibility for controlling
the level also.
COUNCILMAN HARRY PETERSON questioned the cul -de -sac size for fire trucks and MR.
FOLZ stated that this is the standard design as used in all other streets in the
City.
TOM FARRELL, 205 Crestwood Terrace, spoke as a resident and citizen in the area
representing the people who live on Interlachen Drive - asking for the vacation
of this street from its intersection with Crestwood Terrace to its termination
at Olive Street - there are three reasons for this - the primary reason is the
street is undevelopable anyway because of its existence on the aide of the hill
and because of its intersection with Olive it will never be developed; (2) over
the past 12 years they have been annoyed with certain minor nuisances - hunters,
trappers, etc. going through the woods and if the property is controlled privately
it would end that nuisance factor; (3) the property as it exists along Crestwood
and along Interlachen that the property value is based on the wooded area and if
they could assume this property they could miatain the vegetation and improve the
value of their property. He presented a petition to the Council for this vacation
which was all of the property owners on the south side of this street.
MR. FOLZ stated thatspeaking for the developer he did not see any off -hand strong
objection to vacating that - his concern is there are extremely steep slopes and
there is storm water that comes down there now and he felt that Mr. Elliott should
look at it and see how the storm water would be handled and also resolve the power
line that is back there today. He felt that Mr. Magnuson should look at the drainage
easemen..s which are currently in the street - whatever is vacated will have to be
covered by a drainage easement - if that can be accomplished and those things can
be handled, he did not see any problem with it.
MR. MAGNUSON AND MR. ELLIOTT were directed to look at this and report
back at the next meeting.
MR. ELLIOTT stated that he and Mr. Moore had collaborated on the feasibility report
and felt that the cost would be somewhere between $2,000 and $2,500.
The Mayor closed the hearing.
On motion of Councilman Roger Peterson, seconded by Councilman Powell, the
Council accepted the preliminary plat with the dedication of Outlot "A" as a ponding
area subject to the preliminary cost not exceeding $2,500 which the developers
will agree to pay. (all in favor)
3. This was the day and time for the public hearing on Case No. 397 for a Conditional
Use Permit for Tim Gogerty for an upholstery shop at 416 West Pine Street.
Notice of the hearing was published in the Stillwater Evening Gazette, the
official newspaper of the City on December 5, 1980 and copies were mailed to all
property owners within 300 feet.
The Mayor opened the hearing.
TIM GOGERTY stated that this will be a temporary shop while he and his partner
are attending school - they have a 100 foot driveway - they will pick up and deliver
the finished items
MR. LILLIAN BANCROFT, 409 South Holcombe Street, was opposed to the granting of this
permit that be setting a precident - they have had problems with someone on Olive
Street that was working on cars - the property has changed hands many times and it
is up for sale again.
MR. GOGERTY stated that they keep getting compared to machine shops, auto mechanic
shops - upholstery is a sewing machine and a cutting cable and there is no noise
involved at all, except for possibly a tack hammer and that type of thing. They took
a survey of the Chatterton Shop and the neighbors and the fact that there is no
noise from this shop.

DAVID WARG, 428 South Sixth Street, stated that his property adjoins the
carriage house that is proposed to be used for this shop - he lives in a
very quiet residential area and it is very important to him that the area remain
that way. This is a concern to him and his family.
ED Y'EDER, 417 South Holcombe Street, felt that working with young people he
did lot feel that having a upholstery shop that he was strongly in favor of
giving the boys a chance to go ahead providing that everything goes along
smoothly on a six month or one year trial and then review it after that.
VI RAEDER, 417 South Holcombe Street was in favor of giving these boys a chance-
she did not feel that it would disturb anybody - give them a dhance to get
started - there will be n o traffic since they have a van and they will not
bother anybody.
COUNCILWOMAN BODLOVICK stated that the Planning Commission denied it - there
was quite a congregation of people from the neighborhood at the Planning
Commission and they complained of the present noise and felt that the upholstery
shop would add more - she did not know if they were referring to the house that
is in front of it and it is possible that is where the problem is, and she has
observed this herself.
MIKE JANSEN stated that it is just the garage that they are trying to rent -
they will not live there - they ar,, not planning on staying- they are just trying
to setup a shop to get them through school and they would be more than happy to
have a six month or year lease on that property for this permit.
The Mayor closed the hearing.
On motion of Councilman Harry Peterson, seconded by Councilman Powell,
the Council granted a Conditional Use Permit for six months subject to review
at July 1, 1981.

COUNCILMAN ROGER PETERSON felt that the neighbors who live in the area which is
strictly residential neighborhood they too have their rights.
4 This was the day and time for the public hearing on the proposed watermain
extension on North Second Street to the north.
Notice of the hearing was published in the Stillwater Evening Gazette, the
official newspaper of the City on December 4 and 11, 1980 and copies were mailed
to all property owners proposed to be benefited from the improvement.

The Mayor opened the hearing.
MR. WILEMER MUELLER, 1912 North Fifth Street, felt that we should forget the
watermain - can't afford it.
LEONA KINKER, North Fifth Street, also was opposed to it - they cannot afford it.
ART MUELLER, 312 West Willow Street, stated ht can't afford it and was opposed
to it.
DON ENGEBRETSON, who owns property in the area, stated that he just put in a new
well and this will not benefit his property.
MAYOR JUNKER stated that there is no way that the City can get deferred payments
for those who cannot afford it and we could not pay the bonds.
GERHARDT WICHELMAN, 110 E. Hazel Street, stated that he has his own well and
they cannot afford the water to come up there.
GORDON 'MUELLER, 101 East Hazel Street, stated he put in a new well ten years
ago and he cannot afford the water anyway.
ERVIN I. BRUCE, JR., 2012 North Second Street, felt that they should put water,
sewer and gas and the whole thing at the same time.
MARIE BRUCE, 2013 North 'gird Street stated that she was against it since she just
had two wells put in.
DAVID MAY, 2012 North Third Street - he had a well put in several years ago and
has no desire for the watermain.
ED FRYE, 1721 North Second Street, - he has already paid for city water into his
place and has no need for same.
DONALD CARLSON, 1723 North Second Street - already on City water and he was
against the improvement.

ESTABLISHING OF SEWER SERVICE CHARGES AND PROVIDING COLLECTION THEREOF"

4. On motion of Councilman Powell, seconded by Councilman Roger Peterson, the
Council gave a vote of confidence to Wally Abrahamson and insisted that he continue
on as Police Chief and Public Safety Director.

After some discussion Councilman Harry Peterson moved to table the matter,

The discussion continued - Councilman Harry Peterson withdrew his second and
Councilman Powell withdrew his motion.
MAYOR JUNKER stated that it is over and done with.

CITY ATTORNEY'S REPORT
1. MR. MAGNUSON explained to the City Council how the Charter can be amended - the
quickest way is by ordinance - the Charter Commission would suggest that the
Council adopt the ordinance and it would become effective in sixty days - first
step would be to reactivate the Charter Commission - this cannot be done in a
hurry.
2. MAYOR JUNKER requested that it would be proper if all of the people would stand
up and and give COUNCILMEN ROGER PETERSON AND WILLIAM POWELL a vote of thanks -
which was done at this time.
On motion of Councilman Harry Peterson, seconded by Councilwoman Bodlovick,
a resolution was introduced "EXPRESSING THE CITY'S APPRECIATION FOR THE MANY YEARS
OF SERVICE COUNCILMEN ROGER PETERSON AND WILLIAM POWELL HAVE GIVEN THE CITY" and
that a copy be presented to each of them.
AYES -- Councilwoman Bodlovick, Councilman Harry Peterson and Mayor Junker
NAYS - -None
