SPECIAL MEETING
September 6, 1978 11:15 A. M.
The meeting was called to order by President Junker.
PRESENT: Councilwoman Bodlovick, Councilman Powell and Mayor Junker
ABSENT: Councilmen Mahoney and Peterson
ALSO PRESENT: Acting City Clerk, Schnell
City Attorney, Magnuson
Mary A. Miller
CITY ATTORNEY MAGNUSON had received information from the Attorney General's
Office that Mary A. Miller could be a candidate for the City Council and there
would have to be a factual determination at the time of the negotiations on the
Police Contract by the Council as to whether or not, if she were a member of
the Council, that she could be involved in such voting.
The Attorney General advised that Mrs. Miller could not be prohibited from
being a candidate because the conflict is only potential; that is by the
time the vote on the labor contract must be voted upon in three years, Mr.
Miller might not be a policeman or the Miller's might no longer married -
a candidate cannot be deprived of her constitutional right to be a candidate
because of a potential conflict.
Based on this information the City Attorney recommended that Mrs. Miller's
name be placed on the ballot for the primary election on September 12, 1978
and he contacted the Ramaley Printing Company to prepare the necessary decals
and print outs to effect this change.
(The Council members present concurred).
The meeting adjourned at 11:45 P. M.
