PRESENT: Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and Mayor Junxer Absent: Also Present: Press: Citizens August 28, 1978 8:00 P. M. None Acting City Clerk, Schnell City Attorney, Magnuson Kevin Regan - Free Press Fred E. Petter, Thomas V. Bender (Attorney for Mr. Petter), Gerald Cook, Gary Kriesel, The purpose of this meeting was a hearing for the Contractor's License for Fred Petter, St. Paul, Minnesota which was suspended on July 25, 1978 by the City Council based upon a complaint from Mrs. Joanne Schmit, 224 North Fourth Street. MR. BENDER Presented the case of his client, Mr. Fred E. Petter and Mr. Petter was put under Oath and examined by Mr. Bender. An affidavit statment from Mrs. Joanne Schmitt was presented to the Council stating her position in this matter. MR GERALD COOK was put under Oath and questioned by Mr. Bender and the City Council members. Questions were raised as to whether Mr. Cook was employed by Mr. Petter and would supply the materials for the work to be done at the Schmt residence. MR. MAGNUSON, City Attorney, stated that the Council would have to determine if both parties were responsible or not. COUNCILMAN POWELL moved that the investigation be continued under the direction of the City Attorney and that final action be taken on the matter at such a time as Mr. Magnuson completes the investigation. (There was no second to this motion) On motion of Councilman Mahoney, seconeed by Councilman Peterson, the Council issuedcontractor's licenses to both Mr. Fred Petter and Gerald Cook and the Building Inspector was instructed to keep a close watch on both of these contractors for their roofing jobs, and if it is determined at a later date that their work is not satisfactory that the licenses should be suspended. (Councilwoman Bodlovick was opposed) (Motion carried) MISCELLANEOUS On motion of Councilman Mahoney, seconded by Councilman Peterson, the City Attorney was directed to get an Attorney General's opinion for Mary A. Miller to substantiate the ruling that she is not eligible to run for a City Council seat as made by the Assistant City Attorney, Robert Turrentine. (all in favor) The meeting adjourned at 9:10 P. M.
