Present: Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and Mayor Junker (Mr. Mahoney arrived at 3:15 P. M.) ABSENT: None ALSO PRESENT: July 13, 1977 3:00 P. M. Acting City Clerk, Schnell; City Attorney, Kimmel; Director of Public Safety, Abrahamson; Superintendent of Public Works, Shelton; Director of Parks & Recreation, Blekum PUBLIC HEARINGS REVENUE SHARING On motion of Councilman Powell, seconded by Councilman Peterson, the Revenue Sharing hearing was continued until the next regular meeting on July 26, 1977 - because the Council was unable to hear same on the evening of July 12, 1977. (all in favor) UNFINISHED BUSINESS 1. On motion of Councilman Peterson, seconded by Councilman Powell, the request for the stop signs at the intersection of South Holcombe and West Willard Street was referred to the Public Safety Committee for their study and recommendation. (all in favor) 2. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council followed the recommendations of the Planning Commission and granted the extension of the Special Use Permit to Robert Lifton at 2121 South Sixth Street subject to the original conditions and the addition of the following two requests to be allowed on a one -year trial basis after which they will be reviewed by the Planning Commission: (1) Hours of operation of the power tools will be lengthened to 8:00 A. M. until 9:00 P. M. (2) the owner will be allowed to conduct classes in the building twice a week. (all in favor) 3. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Clerk made the second reading of an ordinance entitled "AN ORDINANCE ESTABLISHING AN INDUSTRIAL USER STRENGTH CHARGE IN ADDITION TO THE CHARGE BASED UPON THE VOLUME OF DISCHARGE BY AN INDUSTRIAL USER AND ESTABLISHING AN INDUSTRIAL USER STRENGTH CHARGE FORMULA FOR THE COMPUTATION THEREOF TO RECOVER OPERATION AND MAINTENANCE COST OF WASTE TREATMENT SERVICES ATTRI- BUTABLE TO THE STRENGTH OF THE DISCHARGE OF INDUSTRIAL WASTE INTO THE SEWER SYSTEM AND ESTABLISHING TAX LIEN AGAINST PROPERTY SERVED IN CONNECTION WITH SUCH STRENGTH CHARGE FOR THE CITY OF STILLWATER ". The ordinance was read section by section followed by roll call after each section and all members of the Council voted in the affirmative. The chair then put the questions, "Shall this ordinance pass ?" and on roll call the ordinance was unanimously adopted. (see ordinances) 4. On motion of Councilwoman Bodlovick, seconded by Councilman Peterson, the clerk made the second reading of an ordinance entitled "AN ORDINANCE AMENDING ORDINANCE NO. 448, RELATING TO CONTRACTOR'S LICENSES" The ordinance was read section by section followed by roll call after ,each section and all members of the Council voted in the affirmative. The chair then put the question, "Shall this ordinance pass ?" and on roll call the ordinance was unanimously adopted. (see ordinances) NEW BUSINESS 1. On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the Council granted permission to the Stillwater Firefighters to discharge the fireworks for the Stillwater Lumberjack Day Celebration on Thursday, July 14, 1977. (all in favor) 265\ • • • 666 • f • 2. On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the Council granted a beer permit for Pioneer Park for the Lumberjack Parade participants. (all in favor) 3. On motion of Councilman Powell, seconded by Councilwoman Bodlovick, the claim from Tom Argetsinger, 810 West Anderson Street for damages for a sewer backup was referred to the McGarry- Kearney Insurance Agency. (all in favor) 4. The resolution "Amending the Rules of Procedure for Joint Planning Committee of the City of Stillwater, Town of Stillwater and County of Washington was delayed to a future meeting due to the opinion received from the Attorney General regarding this Committee. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Acting City Clerk was directed to setup a meeting with Stillwater Town- ship on the Joint Powers Agreement. (all in favor) 5. July 13, 1977 Councilman Peterson, seconded by Councilman Powell, Mr. Blekum to have Pinky's Croixland pump the four satellites which will Park through Saturday and then these satellites are to be moved along the parade route for Sunday. (all in favor) Councilman Peterson, seconded by Councilwoman Bodlovick, the 26, 1977 at 7:30 P. Lamont Brine, 219 South Main Street, Stillwater. (renewal - all in favor) COMMUNICATIONS Notice of hearing for Authority for NSP to change its schedule of Electric Rates for Retail Customers. (no action) From G. P. Kaske regarding parking conditions on West Lake Street immediately west of South Greeley Street. On motion of Councilman Powell, seconded by Councilman Mahoney, a resolution was introduced "AUTHORIZING NO PARKING ON THE SOUTH SIDE OF WEST LAKE STREET" . AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and Mayor Junker NAYS - -None (see resolutions) • • • • • July 13, 1977 On motion of Councilman Peterson, seconded by Councilman Powell, the City Attorney was instructed to write a letter to the County Board telling them that the City of Stillwater is sick and tired of the way the employees of the Welfare Department have been acting toward the Police officers and others and if this is not stopped the City of Stillwater will curtail the use of our facilities for the sale of food stamps. (all in favor) From Washington County Auditor regarding the due date for all tax levies. (no action) From the Stillwater Fire Department regardin,, wage negotiations. Discussion followed about setting up meetings for negotiations with all of the departments, but no definite date was set for same. CITY COORDINATOR'S REPORT 1. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council granted the beer permit for the Eagles Womens Softball Tournament at Lily Lake Park for July 15, 16 and 17, 1977 with the understanding that they employ a Police Reserve Officer during the time of this tournament as recommended by the Police Chief. (all in favor) 2. On motion of Councilman Poweli, seconded by Councilman Peterson, the Acting City Clerk was directed to obtain quotes for the 1977 Financial Audit for the City of Stillwater. (all in favor) 3 On motion of Councilman Powell, seconded by Councilman Peterson, the Council authorized the Acting City Clerk and one other staff member to attend the Tax Levy meeting to be held in St. Paul on August 1, 1977. (all in favor) COMMITTEE REPORTS PUBLIC SAFETY 1. On motion of Councilman Powell, seconded by Councilman Mahoney, the Council authorized the purchase of a tone monitor for the Fire Department in the amount of $210.00. (all in favor) 2. On motion of Councilman Powell, seconded by Councilwoman Bodlovick, the Council authorized the Police Chief to use the Animal Control Officer, to serve as a Police Reserve, but he will receive his regular pay and would be used primarily on regular duty time for this work. (all in favor) 3. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Police Chief was authorized to find out what the number of dollars that would be required for the installation of emergency alert system for the Croixwood Area or would it mean an entirely new system (all in favor) 4. Mr. Blekum was directed problems with the alarm 5. Mr. Abrahamson informed the ownership of a boat having same towed away. to check with the Telephone Company regarding the system at the Lily Lake Arena. the Council that they have been unable to determine that has been parked under the bridge and he is PUBLIC WORKS 1. On motion of Councilman Powell, seconded by Councilman Mahoney, the City Attorney was instructed to send a letter to the St. Joseph Town Board requesting that they remove the barricade on the road into Kolliner Park. (all in favor) 2. Mr. Shelton reported that David Johnson had taken out the trees which he had stored across from Happy's, but Councilman Mahoney informed him that they are still there and Mr. Shelton will call MR. Johnson about this. 3. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Acting City Clerk was directed to write a letter to Mr. Wendorff at The Harbor informing him that if the rent is not paid for the City property which has been on lease for parking for his business by August 1, 1977 the lease will be cancelled. On motion of Councilman Peterson, secondel by Councilwoman Bodlovick, the Acting City Clerk was directed to send a letter to David Johnson that we are continuing to receive complaints about his operation of his business from his home and if we continue to receive complaints we will have to have him get a Special Use Permit. (all in favor) 5. On motion of Councilman Peterson, seconded by Councilman Mahoney, Mr. Shelton was directed to paint yellow "no parking" on the westerly end of the Auditorium parking lot. (all in favor) 6. Mr. Shelton reported that they had received 36 applications for the Heavy Equipment Operator for the Public Works Street Department and that the committee has selected seven applicants for the Council to personally inter- view. The date for the interviews was set for 6:30 P. M., 7. On motion of Councilman Powell, seconded by Councilman Peterson, a resolution was introduced " "AUTHORIZING THE EXECUTION OF A CONTRACT FOR THE PURCHASE OF A 1974 USED CHEVROLET TRUCK AT A PRICE OF $2,350 FROM WHITE BEAR DODGE ". AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and President Junker NAYS - -None (see resolutions) PARKS AND RECREATION 1. Mr. Blekum reported that the lights at the Lily Lake Tennis Courts have been repaired and the ballpark lights will be done shortly. 2. Mr. Blekum reported that the bangboard at the North Hill Tennis Courts has been removed because of complaints from the neighbors of parties using same at 5:00 A. M., and he will not put it up again until he is directed to do so. 3. Mr. Blekum reported that there are seven elm trees on the south side of Washington Park that he would like to treat and the total cost would be about $375.00. He is going to check with the School District about using their equipment and process these trees. CITY ATTORNEY'S REPORT 1. Mr. Kimmel clarified with the City Council what is required for the sub -lease on the Barge Terminal which is an Environmental Impact Statement which will give the uses of the property, the nature of the grading and the tree removal, storage facilities, type of products that will be stored there, protection for flooding and water runoff. The general conditions are that we do not want the river polluted and also the approximate number of trucks that will come into the area and the fees are to be 50 per ton across the board. COUNCIL REQUEST ITEMS 1. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Mayor was directed to contact the Margaret Rivers Foundation asking them to transfer the $25,000 for the tennis courts from the Nelson School property to the Croixwood Parks.
