The Invocation was given by the Acting City Cldrk. Absent: None PUBLIC HEARINGS February 22, 1977 7:30 P. M. DEAN CHARLSEN, appeared before the City Council in reference to the petition regarding parking for the businesses on North Second Street. The petition was signed by 14 business people in that area. There are currently eight parking places on the East side of Second Street and he assumed that the west side would be used for the construction workers on the high rise. He asked that the Council start plann- ing so that there will be parking available for this area when construction begins. FRED BLISS requested that a study be done for the parking - he would like the City Fathers and others to be aware of the problem. MAYOR JUNKER indicated that as soon as the papers are signed, the Council could instruct Banister Engineering to see what could be done about parking for this area. COUNCILMAN MAHONEY indicated that it would be taken into consideration when the Council is working on the proposed building. COUNCILMAN POWELL said that what the people on North Second Street want is that when construction does take place that parking will be provided while the work is being done and that can be arranged when the City signs the contract with Dominium- the filling station could be removed and parking could be provided there. MR. BLISS asked about the parking that will be provided at the high -rise and COUNCILMAN POWELL stated the Council is aware there are only 23 parking areas provided, but there will be many people who will not have cars, but adequate parking will be provided. Case No. 255, a Special Use 115 South Martha Street into 1. This was the day and time for the public hearing on Permit for Jerry T. Witschen to convert a duplex at a three -plex. The notice of the hearing was published in the official newspaper of the City on February 11, 1977 property owners within 300 feet. The Mayor opened the hearing. The Planning Commission recommended that Mr. Witchen consult with the Building Inspector as to the ceiling height code for his proposed conversion of a duplex to a three -plex at 115 South Martha. They further recommended that they delay their decision until Mr. Witschen has consulted with the Building Inspector. HAROLD BROWN, 114 South Martha Street, spoke in behalf of he and his wife and for Mr. & Mrs. Ray Stefanski as to the parking problems involved. This building was purchased about a year ago from Mrs. June Smith and they have already done some remodeling to the first two stories into separate units and the basement also since a gentleman has been living there. Since that time there has been a parking problem as there are to young ladies living upstairs and two people in the downstairs. Stillwater Evening Gazette, the and copies were mailed to all • 187 i 1 • • • 1188 February 22, 1977 • According to the City Ordinance which provisions were given to Mr. Morse when he purchased the house on Martha and Myrtle he was gold he would have to have off - street parking for six cars for a three -plex at that location. There is no place for parking and there is a problem with these people parking in his drive- way and also Stefanski's driveway. THE MAYOR CLOSED THE HEARING. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council delayed action on Case No. 255 for a Special Use Permit until the next regular Council meeting. (all in favor) On motion of Councilman Powell, seconded by Councilman Peterson, the motion was amended requesting that the Building Inspector report back to the Council as to the number of units existing in this building at the present time. (all in favor) (Accordung to information given by Mr. Brown and the Police Chief there are already three units in this building) 2. This was the day and time for the public hearing on Case No. 263, a Special Use Permit for Harold Kimmel and Leighton Johnson to remodel and reoccupy a second floor apartment in a Commercial Zane. The notice of the hearing was publsihed in the Stillwater Evening Gazette, the official newspapdr of the City on February 11, 1977 and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing. FRED BLISS, 225 North Second Street, spoke in favor of this request since it has been apartments and that it should be allowed to return to such a sue so that it becomes income property for the owner and allows him to maintain this type of property. The Mayor closed the hearing. On motion of Councilman Mahoney, seconded by Councilman Powell the Council granted the Special Use Permit to Harold Kimmel and Leighton Johnson to remodel and reoccupy a second floor apartment in a Commercial Zone at 212 North Main Street as recommended by the Planning Commission. (all in favor) 3. CONTINUATION OF THE HEARING ON THE PROPOSED VACATION OF A PORTION OF WEST ANDERSON STREET FROM SOUTH GREELEY STREET TO SOUTH EVERETT STREET. COUNCILMAN PETERSON asked that the Director of Public Works indicate to the Council and the interested parties what the traffic count was on the various streets since Anderson Street has been barricaded. MR. SHELTON cited the various counts that he had made on South Everett Street, South Greeley and West Churchill Street during different intervals. (see reports in the files) JAMES FINNEGAN, 819 West Anderson Street, felt that the biggest confusion and problem was getting onto Greeley Street from Churchill to the south. There is a lot of traffic on that corner and also on the corner of Churchill and Everett during the day it is quite heavy. He felt that part of Anderson Street was too important to close. MAYOR JUNKER asked ab out the parking situation in the area and MR. FINNEGAN indicated that there are possibly three or four cars in that block close to Everett Street. MYRON SCULLEN, 904 West Churchill Street, stated that the traffic at Everett and Churchill is quite heavy and the biggest problem is getting off Churchill going south on Greeley Street and is especially bad due to the parking cars in thaw area. DALE MATTISON, representing the Hospital Board, stated that when they talked to the Planning Commission there were different traffic figures given and Mr. Shelton clarified same. Re stated that there is also a problem of getting from Anderson Street onto Greeley Street and there have been numberous accidents at this corner. He said there is a definite parking problem created by the Welfare Department and by vacating this portion of Anderson Street they will be losing only 12 parking places. He added that in all of this discussion consideration has not been given to the eight or nine thousand patients that will benefit by having this walkway to get them to the hospital. This type of facility is being done all over the country and the closing of streets is one way to do this. The benefit to the patients that they will be serving will far outweigh the other problems. This is of no benefit to him or to the hospital personnel or the board - it will be for the benefit of the people they serve. • • • • • r tam Immo February 22, 1977 COUNCILWOMAN BODLOVICK agreed with Mr. Mattison and she indicated that this was never considered at the Planning Commission. She commented further that if the street is not vacated the hospital will not lease the property to the Welfare Department for parking for their employees. MAYOR JUNKER indicated that this is going to make Greeley and Church one bad intersection. DALE MATTISON indicated that a couple of the people who signed the petition against the vacation have since changed their minds and he respected the rights of the others that wanted to be heard ROY MOELTER of the Hospital Board asked about the volume of traffic that Churchill and Greeley were designed for per day and MR. SHELTON said the volume of trafic has a lot of facets that have to be considered - speed along with volume. ROY MOELTER stated that a great part of the traffic congestion at Churchill and Greeley is due to the school traffic and is the greatest at the times when the bus traffic is present. There are a lot of alternates and he felt by vacating the street and leasing the property to the County for the Welfare Department should eliminate the parking on Greeley Street. The County has to provide parking and they have to resolve it and the cost is theirs. MYRON SCULLEN asked what is going to happen when the kids go to the beach and to the tennis courts and the ballfields at Lily Lake Park to get across Greeley Street, and also what about the patients from the other clinics. GEORGE KUTZ asked why can't they build an overpass or underpass and he was informed that the cost would be excessive. ROGER HARRIS, 905 West Churchill Street „went on record as being opposed to this vacation as it is a public street and it should remain that way. DALE MATTISON stated that this is only one block of a three or four lock street and he thought that this was the first time in the history of Stillwater that a street was vacated for health purposes. JEFF ZOLLER of the Planning Commission felt that the traffic on Pine and Olive was probably as great as that on Greeley and Churchill and the questions was whether we want to continue to have to bad intersections or one bad intersection. COUNCILMAN PETERSON asked when they are planning to start construction and MR. MATTISON stated about the 15th of Mi cch. COUNCILMAN PETERSON felt that the Council should make a decision this evening on this matter so that the clinic can revise their plans as the City has made all the studies necessary as regards traffic counts and bad intersections and he felt most of these can be resolved. The inconvenience to the neighbors,that may not be resolved, but the benefits derived from the improved clinic - hospital with the walkway is not an inconvenience to the neighbors. COUNCILWOMAN BODLOVICK, indicated that we are still going to have that element of traffic out on Greeley Street from Anderson with the employees from the hospital. COUNCILMAN PETERSON stated that it will be considerably reduced from what it is now and the parking for the hospital will be resolved. The Mayar closed the hearing. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "VACATING A PORTION OF WEST ANDERSON STREET FROM SOUTH GREELEY TO SOUTH EVERETT sub±ect to the required easements as recommended by the Planning Commission and the City Council ". AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and President Junker NAYS - -None (see resolutions) THE MAYOR DECLARED A RECESS FROM 8:30 to 8:45 P. M. 189 UNFINISHED BUSINESS 1. MR. LARRY BASTIAN representing Local 320 for the Police Department appeared before the City Council regarding the effective date for the payment of education credits to Officer Bruce J. Klosowsky. He presented the full de- tailed report of events leading up to the decision on this matter, and that Officer Klosowsky was entitled to the retro- active pay for his education credits. • • /190 t t February 22, 1977 On motion of Councilman Mahoney, seconded by Councilman Peterson, a resolution was introduced authorizing payment of education credits to Bruce Klosowsky retro- active to January 1, 1975. AYES -- Councilmen Mahoney, Peterson, Powell and President Junker. NAYS -- Councilwoman Bodlovick, (see resolutions) 2. On motion of Councilman Powell, seconded by Councilman Peterson, the compensation for Officer Douglas Swanson (School Laision Officer) was in- creased to $1,475.25 per month effective March 1, 1977, and that such a classification be included in said contract in the future. AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and President Junker NAYS- -None (see resolutions) 3. On motion of Councilwoman Bodlovick, seconded by Councilman Mahoney, the second reading of an "Ordinance Amending Ordinance No. 487" was delayed until the City Attorney has had time to study same and present his recommendations. (all in favor) 4. The RTR presented their proposed use of the Nelson School property in writ- ing and asked that the Council study same and the Planning Commission will make a recommendation in the near future. 5. On motion of Councilman Mahoney, seconded by Councilman Peterson, the Council followed the recommendation of the Planning Commission to grant indefinite Special Use Permits for the following cases which had previously been issued for one year: Case No. 213 - Arnold 1 Jirik for a Special Use Permit at his home at 2107 Dundee Place Case No. 181 - Eugene Olesen, 615 County Road No. 5 to do carpet sales from his home (all in favor) NEW BUSINESS 1. On motion of Councilman Powell, seconded by Councilman Mahoney, a resolution was introduced "CHANGING THE CLASSIFICATION AND COMPENSATION FOR AL ROEPKE EFFECTIVE FEBRUARY 16, 1977 ". AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and President Junket NAYS - -None (see resolutions) 2. On motion of Councilman Peterson, seconded by Councilman Mahoney, the hearing date for Case No. 262, Reliance Development Co. PUD for Townhouses and single family dwellings for March 22, 1977 at 7:30 P. M. (all in favor) 3. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "AUTHORIZING THE MAYOR AND THE ACTING CITY CLERK TO EXECUTE AN AGREEMENT WITH BANISTER - SHORT- SLLIOTT- HENDRICKSON AND ASSOCIATES, INC. for engineering services for the City of Stillwater ". AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and President Junker NAYS - -None (see resolutions) 4. Discussion was held regarding the skating rink on Long Lake which had been instructed to be put there by the Recreation Commission and a resident on the lake had filed a complaint with the Stillwater Township Board on the matter. Mayor Junker stated that he had contacted Al Borsheim and it was agreeable with him to use the roadway into this skating area. 5. On motion of Councilman Mahoney, seconded by Councilman Powell, the adoption of the Washington County Development Code (Chapter 4) as recommended by the Planning Commission was sent back to the Planning Commission aid John Lawson for study and further recommendation. (all in favor) 6. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council granted a Special Use Permit to Steven Peulen for a retail antique store at 113 North Third Street on a temporary basis until October 1, 1977 when it will be reviewed again. (all in favor) 7. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "DIRECTING THE PAYMENT OF THE BILLS ". AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Powell and President Junker NAYS- -None (see resolutions) - -On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the Communications from the Metro Council relating to Regional Special Use Policy Plan and the Regional Trails Policy Plan were referred to the Planning Commission for their study and recommendations. (all in favor) - -On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the communication and ordinance regarding the licensing of Tree Removal and Treatment Contractors was referred to the City Attorney and the Public Works Committee for their study and recommendation. (all in favor) - -On motion of Councilman Powell, seconded by Councilman Peterson, the communi- cation from Orrin Thompson Homes regarding payment claims against McGrand and Frovarp was referred to the City Attorney. (all in favor) 191 • CITY COORDINATOR'S REPORT 1. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Mayor was instructed to attend the Metro Council hearing on the matter of the proposed adoption of rules of the Metropolitan Council governing the review of proposed matters of metropolitan significance. (all in favor) (Hearing date March 16, 1977 at 1:30 and 7:30 P. M.) 2. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council confirmed the date of May 9, 1977 from 9:30 A. M. to 3:00 P. M. for the Board of Review for the City of Stillwater. (all in favor) 3. On motion of Councilman Peterson, seconded by Councilman Powell the letter from Orrin Thompson regarding bond reductions was referred to the Consulting Engineer for his study and recommendations. (all in favor) 4. On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the Council set the date of March 8, 1977 at 7:30 P. M. for the informational hearing on Revenue Sharing Funds. (all in favor) CONSULTING ENGINEER'S REPORT 1. DICK MOORE distributedto the Council members and Mr. Swager copies of the feasibility study for the utilities for their proposed new development in Cooper's Addition to the City of Stillwater. On motion of Councilman Peterson, seconded by Councilman Mahoney, °— the Council and the developer will study these reports and discuss same at the next regular Council meeting. (all in favor) • • ( 192 t • 2. MR. MOORE reported that the feasibility report for the additional dressing rooms and restrooms at the Lily Lake Arena will be ready for the next meeting. PUBLIC WORKS No report PUBLIC SAFETY 1. On motion of Councilman Powell, seconded by Councilwoman Bodlovick, a resolution was introduced authorizing the placement of "NO PARKING BETWEEN 8:00 A. M. TO 4:00 P. M. AT THE FOLLOWING LOCATIONS: (Both sides - effective March 1, 1977) Greeley Street from West Abbott to the entrance to Lily Lake Park Churchill Street from South Greeley to South Martha Street South Everett Street from West Churchill to West Hancock Street West Anderson Street from South Everett to South Martha Street (all in favor) 2. Chief Abrahamson advised the Council that the color books and the booklets on safety are being distributed by all the advertisers that are in the booklets, at his office and in the City Clerk's Office. PARKS AND RECREATION No report FEBRUARY 22, 1977 COMMITTEE REPORTS CITY ATTORNEY'S REPORT 1. Mr. Kimmel informed the City Council that the First National Bank will pay the asking price of $16,500 for the small piece of property to the south of the Auditorium Theater site and he recommended execution of the deed for same. On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the Council delayed action on the execution of the deed for this property until the next Council meeting since the Downtown Retail Council would like to talk to the First National Bank about this piece of property. (all in favor) ADMINISTRATIVE COMMITTEE 1. COUNCILMAN MAHONEY recommended that the City hire Bob Rygg on a six month probationery period as a Finance Director with his primary duties being in the area of finance and grant applications. COUNCILMAN PETERSON stated that the committee had authorization to draw up a job descrption for such a position and the Council has not received same and he felt that this action would be premature without some discussion. He asked that the committee present this informationfirst - the duties of such an officer and look around for perhaps other people who are interested and that this be done prior to the next meeting. COUNCIL REOUEST ITEMS 1. COUNCILMAN PETERSON asked what progress the Planning Commission had made on their study for additional parking in the downtown area and JEFF ZOLLER stated that they are going to contact the Downtown Retail Council regarding their report that they were going to do last year. COUNCILMAN PETERSON asked that the Planning Commission made a concerted effort to get something done on this and also include the petition from North Second Street. COUNCILMAN MAHONEY asked Mr. Zoller to contact Mr. McGuire on this matter since he has some map layouts of vacant land that might be available for parking purposes. 2. (all in favor) 3. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council took an option of $100.00 for forty -five days on the property at the corner of Third and Olive Streets (southwest corner of block - northeast corner of Intersection of Olive and Third Streets).
