M. 1. MARY EMANUELSON, 1017 South Second Street, presented to the Mayor and City Council a petition opposed to the present Nelson School building being con- verted into multi -unit apartments and they would prefer the property be used for recreational purposes and they would not object to having a lighted recreational area on this site. MAYOR JUNKER stated that the School District has given the school property to the City of Stillwater with no strings attached and the Council will make no decision until the Council has made a determination as to what they will do with this property. MR. BOB HAGSTROM, president of River Town Restoration, presented a memo to the Mayor and City Council regarding this property and their proposal for same. PUBLIC HEARING This was the day and time for the public hearing on a petition to vacate a portion of Forward Street. The notice cf the hearing was published on November 19 and 26 and December 3, and 10, 1976 and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing. No one appeared in favor or opposed to said vacation although Councilman Mahoney indicated that David Magnuson had contacted him stating that they are still interested in said vexation but he was unable to attend this hearing. The Mayor closed the hearing. On motion of Councilman Thompson, seconded by Councilman Mahoney, a resolution was introduced "VACATING A PORTION OF FORWARD STREET ". AYES -- Councilwoman Bodlovick, Councilman Mahoney, Feterson, Thompson and President Junker NAYS - -None (see resolutions) UNFINISHED BUSINESS 1. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Clerk was directed to open the one bid received for the Official Advertising for the City of Stillwater for the year 1977. (all in favor) On motion of Councilman Thompson, seconded by Councilman Mahoney, the Council accepted the apparent low bid for the Official Advertising for the City of Stillwater for the year 1977 as submitted by the Stillwater Gazette (all in favor) • 1 • `. 462 (December 21, 1976 - continued) 2. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council approved the following appointments to the Recreation Commission as recommended by the Mayor: (all for three year terms) David Eckberg Linda Kluy Dennis Sullivan (all in favor) On motion of Councilman Mahoney, seconded by Councilman Thompson, the Council approved the following appointments to the Planning Commission for three year terms as recommended by the Mayor: Charles Swanson - re- appointment Dale Kress (all in favor) On motion of Councilman Mahoney, seconded by Councilman Thompson, the Council approved the re- appointment of Roger Peterson to the Dutch Elm Commission for a three year term as recommended by the Mayor. (all in favor - Councilman Peterson abstained) On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council approved the following appointments to the Library Board as recommended by the Mayor: (all for thee year terms) Mrs. Henry Van Meier - re- appointment Mrs. Donald Granquist Mrs. James Dinzeo (all in favor) On motion of Councilman Peterson ,seconded by Councilman Mahoney the Acting City Clerk was directed to send letters to the members of the various boards who were not re- appointed or who have elected to retire thanking them for their services. (all in favor) Mrs. A. J. Kraemer - retired - Library Board Garry Jones - Recreation Commission Martin Hansen - Planning Commission 3. MR. KIMMEEL reported on the insurance proposals which were received by the City on December 7, 1976, explaining that there are several alternatives which could be considered. He presented the following three ways in which the Council could consider this matter: 1. They can award the bid to McGarry- Kearney Agency as low bidder with the specific understanding that it will negotiate changes in the policies affecting a reduction in premium: 2. IT CAN REJECT ALL BIDS AND NEGOTIATE WITH BOTH OF THE LOW BIDDERS ASKING FOR EACH OF THEIR RECOMMENDATIONS AS TO CHANGES IN THE SPECS WHICH THEY FEEL WOULD EFFECT THE GREATEST SAVINGS AT THE LEAST RISK TO THE CITY OF STILLWATER AND AWARD A CONTRACT ON NEGOTIATIONS WITH THE TWO BIDDERS: OR 3. They can reject all bids, change the specifications and re -bid. The City had also received a letter from the Krog Insurance Agency indicating some proposed changes which could be made in these proposals. On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the Council awarded the bid for the Package Insurance for the City of Stillwater for a three year term effective January 1, 1977 to the McGarry -Keaney Insurance Agency. (all in favor) NEW BUSINESS 1. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced 'DIRECTING THE PAYMENT OF THE BILLS ". AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junker NAYS- -None (see resolutions) INDIVIDUALS - DELEGATIONS - continued 1. CHARLES HOOLEY, 920 South Greeley Street, read a lengthy memo to the City Council regarding the 135 acres which the Hooleys' have owned on Highway 212 since 1965 and on which they are experiencing problems in developing. This property was annexed to the City of Stillwater in 1973 and then in August, 1975 they agreed to become a part of the Joint Powers Agreement. Since that time they have experienced numerous delays and he was requesting a release from the Joint Powers Agreement in an effort to expedite the construction of their Cub Store and the Bank, • • • las • December 21, 1976 - continued COUNCILMAN PETERSON asked if he had made this presentation to Stillwater Township and Mr. Hooley had indicated that he had not. MR. KIMMEL stated that the Council could pass a motion to have this property removed and it would also have to have the approval of the other communities. COUNCILMAN PETERSON felt that action should be taken now on this matter to expedite the matter and it would have to come back to them. COUNCILMAN MAHONEY moved that action be deferred on this until the second meeting in January in order to have some time to look at it and get all the facts on both sides. MR. HOOLEY indicated that this would delay their construction and the City would lose out on the tax base. He felt that ht had met all the requirements necessary and further that he had not experienced such delays and problems in the other communities where they had developed property. COUNCILMAN PETERSON felt that there was no reason why they could not indicate their feelings now to the Township and the Joint Powers Commission. COUNCILMAN MAHONEY stated that when Mr. Hooley found out that they needed an Environmental Impact Study he had changed their plans. COUNCILMAN PETERSON stated that the Joint Powers came to the City for the deletion of some property in November and the Council approved that request and the same should be done in this instance. COUNCILWOMAN BODLOVICK seconded Councilman Mahoney's motion to defer action. AYES -- Councilmen Mahoney and Councilwoman Bodlovick NAYS -- Councilmen Peterson and Thompson and President Junker (motion defeated) On motion of Councilman Peterson, seconded by Councilman Thompson, that the Council recommend to the Joint Powers Commission and to Stillwater Township the deletion of this 135 acres in question. AYES -- Councilmen Peterson and Thompson and President Junker NAYS -- Councilman Mahoney and Councilwoman Bodlovick- (motion carried) MR. HOOLEY further requested that the Council discontinue the use of the Washintton County Planner and go to a consulting service for any planning and the Council chose to take action on this matter at a later date and also refer same to the Planning Commission. MR. HOOLEY was also requested to make this presentation to the Stillwater Township Board which he agreed to do. 2. JAMES JUNKER, appeared before the City Council indicating that he had purchased the Stillwater Sanitation, Inc. and requested that the present contact that the City has with Stillwater Sanitation, Inc. be assigned to him. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, a resolution was introduced "ACCEPTING THE ASSIGNMENT OF STILLWATER SANITATION, INC. TO JUNKER SANITATION, SUBJECT TO RECEIPT OF A WRITTEN ASSIGNMENT FROM STILLWATTER SANITATION, INC." On motion of Councilman Peterson, seconded by Councilman Thompson, the letter from the Internaional Union of Operating Engineers regarding the compensation for Martin Lemon was referred to the Public Works Committee for their study and recommendation. (all in favor) 2. On motion of Councilman Peterson, seconded by Councilman Mahoney, the request for bond reduction by Orrin Thompson Homes was referred to the Consulting Engineer and Jack Shelton for their study and recommendation. On motion of Councilman Mahoney, seconded by Councilman Peterson, a 3.2 On sale Beer License was granted to the Military Order of the Cooties for the four days of Lumberjack Days in Lowell Park commencing July 14, 1977 and there will be no charge for said license. (all in favor) l-• CONSULTING ENGINEER'S REPORT 1. Mr. Elliott distributed to the member of the Council the study made for the Oasis Avenue Drainage Facilities as ordered by the City Council at the request of John Ogren. 2. Mr. Elliott reported that he had met with Mr. Charles Hooley with respect to ttemeans in which his property on the north side of Highway 212 could be served by sewer and water. The new approach is the possibility of a city water supply well on that property and he will meet with the Board of Water Commissioners on this matter. „.4 COMMITTEE REPORTS PUBLIC WORKS 1. Mr. Shelton distributed to the City Council members, the proposed contract for Local 49 and their study and action possibly could be taken at the clean-up meeting scheduled to be held Wednesday, December 29th. 2. Mr. Shelton asked the Mayor about what should be done with the windows at the old Nelson School which the City has acquired from the School District and he was directed to board same up with plywood. 3. Mr. Shelton reported that Oak Park Heights has agreed to supply sewer service to a residence on Fifth Avenue South and he and Mr. Elliott will negotiate with a contractor to bring it up the street from the manhole to the house and this can be accomplished this spring. (For the residence of Roger Fischer) PUBLIC SAFETY 1. On motion of Councilman Thompson, seconded by Councilman Mahoney, a resolution was introduced "EMPLOYING CATHERINE MOORE AS A POLICE RESERVE OFFICER EFFECTI DECEMBER 16, 1976 FOR A SIX MONTHS' PROBATIONERY PERIOD ". On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council approved the use of Lowell Park by the Jaycees for their Ice Cream Social to be held on January 20, 1977. On motion of Councilman Mahoney, seconded by Councilman Thompson, a resolution was introduced "EMPLOYING STEVFN MORSE AS A RELIEF MAN FOR THE WARMING HOUSE FOR THE SKATING RINK AT STAPLES FIELD AT $4.00 PER HOUR ". On motion of Councilman Peterson, seconded by Councilman Mahoney, the City Attorney made the second reading of an ordinance entitled "AN ORDINANCE AMENDING ORDINANCE NO. 515 ESTABLISHING ELECTION WARDS AND PRECINCTS FOR THE CITY OF STILLWATER ". The ordinance was read section by section followed by roll call after each section and all members of the Council voted in the affirma- tive. The chair then put the question, "Shall this ordinance pass?" and on roll call the ordinance was unanimously adopted. 3. On motion of Councilman Thompson, seconded by Councilman Mahoney, the Clerk made the first reading by title of an ordinance. entitled "AN ORDINANCE DETERMINING THE ANNEXATION OF CERTAIN LAND TO BE IN THE BEST INTEREST OF THE CITY OF STILLWATER AND OF THE TERRITORY AFFECTED AND DECLARING THE SAME TO BE ANNEXED TO THE CITY ".
