The Invocation was given by Acting City Clerk, Schnell

INDIVIDUALS- DELEGATIONS - PETITIONS
1. ROGER WINGES OF JURAN AND MOODY appeared before the City Council regarding a
resolution for Insutrial Revenue Bonds for the Greeley Street Clinic. These
bonds are authorized to encourage commercial and indugrial businesses in the
City - there is no cost or obligation to the City.
On motion of Councilman Thompson, seconded by Councilman Mahoney,
a resolution was introduced "AUTHORIZING THE ISSUANCE OF COM ERCIAL
DEVELOPMENT REVENUE BONDS, REQUESTING APPROVAL BY THE DEPARTiENT OF
ECONOMIC DEVELOPMENT, AND AUTHORIZING THE PREPARATION OF NECESSARY
DOCUMENTS PURSUANT TO THE MUNICIPAL INDUSTRIAL DEVELOPMENT ACT'.
AYES -- Councilwoman Bodlovick, CouncilmenMahoney, Peterson, Thompson and
President Junker
NAYS - -None (see resolutions)
2. MR. ALAN GERBER appeared before the City Council requesting a sewer line or
hookup for his property at Fourth and Oak Streets. The current line is about
half way up the block between Third and Fourth Street.
Mr. Elliott stated that the estimated cost was about $12.00 per foot
and there would be about 165 to 170 feet to get to the intersection. It is a
gravel street and there would be a street replacment cost following the install-
ation.
On motion of Councilman Peterson, seconded by Councilman Mahoney, the
City Engineer was authorized to determine the cost of that improvement
and that Mr. Gerber put his request in writing as to why he required
said sewer extension on Oak Street. (all in favor)
3. BETH SCHWINTEK, 2327 Hidden Valley Lane, presented to the City Council a petition
in opposition to the proposed shopping center at the intersection of County Road
5 and Croixwood Boulevard. (See Case No. 253 for this petition)
4. MR. ROBERT RYGG presented to the City Council a petition to waive the hearing
for Case No. 236 for a Special Use Permit to construct an apartment on the second
floor at 118 North Main Street.
On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the
Council waived the public hearing on Case No. 236 in accordance with the
petition submitted by Mr. Rygg. (all in favor)
On motion of Councilmw Peterson, seconded by Councilman Mahoney,
the Council followed the recommendation of the Planning Commission and
granted the Special Use Permit to Robert Rygg to construct an apartment
on the second floor of his building at 118 North Main Street in down-
' town Stillwater. (all in favor)

5. (m motion of Councilman Peterson, seconded by Councilman Mahoney, the petition
for the vacation of a portion of Forward Street was accepted and the date of
December 21, 1976 at 7:30 P. M. was set for the public hearing on this request.

6. A petition was received from citizens in the Fairmeadows area requesting that
the City Council reconsider the installation of a sidewalk on the west side
of County Road No. 5, between Dundee Place and Oakridge Road. They feel the
sidewalk is necessary for the safety and safety and welfare of the children
going to and from school.
On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the
Council ordered the sinatllation of the sidewalk on the west side of
County Road No. 5 between Croixwood Blvd. and Dundee Place at the City's
cost and would not be assessed.

PUBLIC HEARING
1. This was the day and time for the public hearing on Case No. 246, Michael Gear-
hart, 1001 South Holcombe Street for a variance for a garage.
The notice of the hearing was published in the Stillwater Gazette, the
official newspaper of the City on October 29, 1976 and copies were mailed to all
property owners within 300 feet.
The Mayor opened the hearing
No one appeared opposed to the request - Mr. Gearhart was in attendance.
The Mayor closed the hearing.
On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council
granted the variance to Michael Gearhart, 1001 South Holcombe Street to build a
garage in his sideyard as recommended by the Planning Commission. (all in favor)

The Mayor opened the hearing.
MR. MAYNARD MAHLER, 428 South Sixth Street, asked if he was going to provide off -
street parking, but he thought this request for his property at Sixth and Pine -
(Mr. Nyberg's property)
MR. NYBERG stated that there six apartments in the main hose on this property
and there are only five units at this time and he will make another apartment in
the carriage house.
There was some discussion about the fact that this was a non - conforming
use in a two - family district and it is possible that it would require rezoning
to comply with the ordinance.
(Upon checking the ordunance it was found that he will need a special use
permit and some rear and sideyard variances)
The Mayor closed the hearing.
On motion of Councilman Mahoney, seconded by Councilman Thompson,
the Council set the date of December 7, 1976 at 7:30 P. M. for the public
hearing on the Special Use Permit and the necessary variances for Case
No. 259. (all in favor)
3. This was the day and time for the public hearing on Case No. 257, Trinity
Lutheran Church for a Special Use Permit for 216 West Myrtle Street.
The notice of the hearing was published in the Stillwater Gazette, the
official newspaper of the City, on October 29, 1976 and copies were mailed to
all property owners within 300 feet.
The Mayor opened the hearing.
DONALD VALSIC represented the church as a member of the building committee -
they propose to rmeove the Peaslee building on the corner and most of the vacant
property will be graded and made into a parking lot and there will be entrances
and exits on Myrtle Street for the parking areas. They will use the Kroy Indus -
tires building for their educational programs and possible non - profit Community
Service United Way Agencies.

Mr. Kimmel stated that it was his recommendation that they apply for a Special
Use Permit rather than for rezoning.
The Mayor closed the hearing.
On motion of Councilman Mahoney, seconded by Councilman Thompson, the
Council granted the Special Use Permit to the Trinity Lutheran Church
to use the building at 216 West Myrtle Street for their educational
cenger and other uses as proposed in their request as recommended by
the Planning Commission. (all in favor)
4. This was the day and time for the public hearing on Case No. 253, Scottland,
Inc., Shakopee for a Special Use Permit for a convenience shopping center in
Croixwood.
The notice of the hearing was published in the Stillwater Gazette, the
official newspaper of the City on October 29, 1976 and copies were mailed to
all property owners within 300 feet.
The Mayor opened the hearing.
Mr. Gary Eastlund, stated that he asked for clarification from the City Attorney
as to the zoning on this piece of property and the ordinance covering same.
MR. KItMEEL stated that the text of the ordinance is set forth in the Planning
Commission minutes and in the minutes of the City Council there was no discussion
defining just what a neighborhood shopping center should contain. The language
in the ordinance is that there be one convenient type business located on that
property.
COUNCILMAN PETERSON stated that the indication from Mr. Thompson at that time was
that it would be a corner store variety shopping location.
MR. KIMMEL stated that before the Council could approve same they would have to
amend the zoning ordinance, Ordinance No. 479, to change this matter.
JEFF PETERSON, 320 West Pine, stated that there is a responsibility to support
our local business enterprises and that the City should watch the area on
County Road No. 5 and make sure that this be care be given careful consideration.
MRS. CHARLES SOLEM, 873 Knollwood Court, said that Orrin Thompson stated there
would be one retail store in that area and the residents would be very dis-
satisfied with a project like what is being proposed.
The Mayor closed the hearing.
On motion of Councilmen Peterson, seconded by Councilman Thompson
the Council denied the Special Use Permit for a convenience shopping
center at the intersection of County Road No. 5 and Croixwood Boulevard.

UNFINISHED BUSINESS
1. On motion of Councilman Thompson, seconded by Councilman Mahoney, the Council
rejected all of the bids received for Police Cars as recommended by the Public
Safety Director and further directed the Public Safety Director to receive
quotations for one squad to replace Squad No. 103. (all in favor)
2. On motion of Councilman Peterson, seconded by Councilman Mahoney, the City
Council directed that a letter be written to St. Croix Mold advising them that
it is the Council's opinion not to change the ordinance at this time to change
the fee to be charged to him for a sewer connection charge for his new addition
on Oasis Avenue. (Fee according to Ordinance No. 377 would be $300.00).

NEW BUSINESS
1. No action was taken on the request from the Washington County Highway Depart-
ment for a different location for the ponding of water In connection with the
re- routing of Oasis Avenue by the Country Kitchen Restaurant.
2. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council
granted a permit for a septic tank at 2012 North Third Street to David C.
May, subject to a satisfactory percolation test. (all in favor)

ordered the installation of a street light on Oasis Avenue by the St. Croix

CONSULTING ENGINEER'S REPORT.
1. Mr. Elliott reported that pipe has been put in at Mid Oaks and the build up
in Pizinger's Pond and the Edgewood Ditch has been taken care of and the
service has been installed for the park in Croixwood. The time ran out on the
permit for the drainage and he requested an extension from the DNR and he did
get verbal permission for same.
2. The matter of the assessments for the Croixwood Seventh Addition will be taken
up with the Assessment Clerk prior to the next meeting.
COMMITTEE REPCRTS
PUBLIC SAFETY
1. On motion of Councilman Mahoney, seconded by Councilman Thompson a resolution
was introduced "APPROVING DAVID C. CHIAL AS A PERMANENT MEMBER OF THE VOLUNTEER
FIRE DEPARTMENT."

2. Mr. Abrahamson requested that Mr. Shelton make a survey of the property on the
east side of Main Street, south of Nelson Street as they are having parking
problems in this area and need to know where the City's property line is
located.
3. The Fire Department has requested that if possible that the City Attorney
check out the possibility of passing an ordinance which would require
smoke detectors for all apartments.

k PARKS AND RECREATION
1. Mr. Blekum reported on the quotations that he received for the security
system for the Ice Arena.
On motion of Councilman Thompson, secinded by Councilman Mahoney,
the Council authorized the purchase of a security system for the Ice
Arena at a price of $800 with the monthly charge of $8.50 for the hookup
at the Sheriff's Department and the $6 00 charge for the telephone system
(all in favor)
