Present: Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junket. Absent: Also Present: Press: Citizens: None June 22, 1976 7:30 P. M. ARTHUR PALMER OF THE LOWELL INN appeared before the City Council to inform them that he has an option on the former Northwestern Hotel property (Bliss Property) on North Second Street. He was requesting of the Council the possibility of making an exchange of this property for the 65 feet of the City property adjacent the Oil Station. The square feet. He is concerned he wishea ernedwiththe parking 0 tuationon Second Street with all of the businesses located there MAYOR JUNKER felt that this could be developed into a p area for the City and that the City should be looking for some parking for this area. MR. PALMER said the he intends to make the problem available to the Planning Commission. COUNCILMAN PETERSON stated that this is just a verbal request and he felt that the Planning Commission should have some input on this as W as the Public Works Department and that the logical step for Mr. Palmer would be to make a formal request on his behalf and this would be referred to the Planning Commission and the Public Works Department. COUNCILMAN BODLOVICK asked that they have the City Attorney check the feasibility of exchanging property and come back to the Council with a report. OWEN THOMAS questioned that is to be done with the City property on North Second and Mulberry Street and he was informed that Dominium Corporation has an option on this to build housing for the elderly on this site. On motion of Councilman Peterson, seconded by councilwoman Bodlovick, Mr. Palmer's requat for a land exchange was referred to the Planning Commission and the Public Woks Committee for their study and recommendation. He has met with the Retail council regarding parking for this area. His complex would be a weekend shopping c enter and would bring a lot of people into Stillwater. He asked about the status of the "On Sale" Liquor License for his restaurant which he will own and control, but it will be managed by someone else. He was informed that the letter from the Senate Counsel has been forwarded to the Liquor Control Commission by the City Attorney and h is awaiting their reply to this matter. • • • • 1 • 0 • 1 d WPM June 22, 1976 On motion of Councilman Peterson, seconded by councilman Mahoney, A. the Council granted an "On Sale "Regular and Sunday Liquor License to Gerald Perkl for the Grand Garage and Gallery subject to the approval of the Liquor Control Commission and payment of the fee for this application. (all in favor) 3. This was the day and time for the public hearing on the request of Durward Minks, 1105 South Fourth Street for a variance, Case No. 232. The notice of the hearing was published in the Stillwater Gazette, on June 11, 1976 and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing. No one appeared in favor or opposed to this request - Mr. & Mrs. Minks were in the audience, but made no comment. The Mayor closed the hearing. On motion of Councilwoman Bodlovick, seconded by Councilman O Peterson, the Council granted the variance to Durward Minks as recommended by the Planning Commission. (all in favor) 4. This was the day and time for the public hearing on the request of Norris Danielson, 511 West Aspen Street for a variance, Case No. 233. Notice of the hearing was published in the Stillwater Gazette, the official newspaper of the City on June 11, 1976 and copies were mailed to all property owners within 300 feet. 1 The Mayor opened the hearing. No one appeared in favor or opposed to this request, - Mr. & Mrs. Danielson were in the audience, but made no comments. The Mayor closed the hearing. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council followed the recommendation of the Planning Commission and granted the necessary variance to Norris Danielson for a garage. (all in favor) 5. This was the day and time for the public hearing on the request of Randall Boyle, 314 North Fourth Street for a Special Use Permit to operate an interior design business from his home, Case No. 234. Notice of the hearing was published in the Stillwater Gazette, the official newspaper of the City on June 11, 1976 and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing. No one appeared in favor or opposed to this request. COUNCILMAN PETERSON asked Mr. Boyle if he was aware of the restrictions placed on this request by the Planning Commission and he was in agreement with same. On motion of Councilman Person, seconded by Councilwoman Bodlovick, a resolution was introduced "GRANTING A SpECIAL USE PERMIT TO RANDALL BOYLE FOR AN INTERIOR DESIGN BUSINESS FROM HIS HOME AT 314 NORTH FOURTH STREET, SUBJECT TO THE RESTRICTIONS OUTLINED BY THE PLANNING COMMISSION ". AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junker NAYS- -None (see resolutions) UNFINISHED BUSINESS 1. MR. KIMMEL reported on the bids that were received at the last meeting for the sale of the Ritzer Property in Stillwater Township. He stated that the price was not very high and that other land in the area is selling for five hundred to eight hundred dollars per acre and some higher. The pro?ert does have some prob ]ems but he felt that the $416 per acre was not a parti- cularly good bid. On motion of Councilman Mahoney, seconded by Councilman Peterson, the Council rejected all the bids received for the sale of the Ritzer Property. (all in favor) June 22, 1976 • • • • 2. The Council was in receipt of notice from the State Mediation Services that the Mediation hearing for the Stillwater Firefighters would be held at the Washington County Court House, Stillwater on Monday, June 28, 1976 at 10:00 A. M. MR. KIMMEL explained the usual procedure for the medication hearings and also the arb itration hearings and also he talked to the League about the new state law governing these situations and there is a question as to whether this law is constitutional. HE SAID THAT AT THESE FIRST SESSIONS THE MEDIATOR GOES OVER THE ISSUES TO SEE WHAT HAS BEEN GOING ON BETWEEN THE TWO PARTIES. The Council discussed what direction they should give to the members of the Public Safety Committee who will be attending this mediation hearing, and it was agreed that they will have no authority to accept an offer but will be willing to make a recommendation to the full Council. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council authorized the members of the Public Safety Committee (Mayor Junker and Councilwoman Bodlovick) and the City Attorney to attend these Mediation Hearings and they were directed to stand firm on the last offer made to the Firefighters. (all in favor) 3. COUNCILMAN MAHONEY reported that the Lease for Engine 328 was submitted to the commission and they wish to make some changes and they hope to have it back to the City of Stillwater by the next regular meeting. 4. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council followed the recommendation of the Public Works Committee to authorize the installation of a street light at Oakridge Road and Oakridge Court when the Orrin Thompson sales office is closed at this location. (all in favor) 5. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council accepted the feasibility report for the construction of the south half of Interlachen Drive abutting certain lots in the Fairmeadows No. 3 Addition at an estimated cost of $4,370.00, and construction of South Oakes for $21,647.00. (all in favor) 6. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council accepted the recommendation of the Public Works Committee to submit a counter- proposal to Stillwater Sanitation, Inc. for the following rates to be effective July 1, 1976 and the Acting City Clerk was directed to send a letter to them giving them this information. Also she is to inform them that they are to discontinue charging residents for moving -in and moving out charges: Single Dwelling $3.75 per month Duplex $2.75 per month Multiple $2.15 per month (all in favor) On motion of Councilman Peterson, seconded by Councilman Mahoney, the Clerk made the first reading by title of an ordinance entitled "AN ORDINANCE AMENDING ORDINANCE N0. 426 ". (see ordinances) 7. On motion of Councilman Peterson, seconded by Councilman Mahoney, the City Attorney was directed to write a letter to Swager Bros. requesting that they fulfill their promise to install a drainage pipe on Pine Tree Trail and that such work be done within 30 days. (all in favor) MAYOR JUNKER DECLARED A RECESS FROM 8:25 TO 8:40 P. M. 8. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "Awarding the Contract for the T. V. of the Sewer Lines in Downtown Stillwater to E. J. M. Pipe Services, Inc. of Osseo at a cost not to exceed $4,950.00 and the work to be done only when the water level is above the pipe. AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junker NAYS - -None (see resolutions) • 4 1 • June 22, 1976 NEW BUSINESS 1. Discussion was held regarding the request from John Lawson, City Building Inspector, to employ Ron Niska as assistant Building Inspector on a perman- ent basis. Some members of the Council felt that the job would have to be advertised and also nothing had been put into this year's budget for an additional employee in this department. Comments were made about the fees under the new schedule had been doubled and that there would be ample money for this additional employee. On motion of Councilman Mahoney, seconded by Councilmen Peterson action on this item was deferred until July 6th and at that time they would have available to them figures on the budgeted income and expenses and the income and expenses for 1976 for this department to date. (all in favor) 2. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Acting City Clerk was directed to send a letter to the Washington County Historical Society advising them that it is not feasible to take the hump out of Fourth Street just north of Olive Street as reported by Mr. Shelton; also they are to be advised that the Police Department will assist them in taking their busses from Fifth Street to Olive Street. (Mr. Shelton reported that if the hump was taken out of this street it would create problems for Mr. Raymond Peltier as he would be unable to get to his driveway and garage and also Mr. Peltier would be assessed for the full cost and it would be prohivitive) 3. On Motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the request from the Stillwater MOTOR Co. to relocate their sign on the Jack Hooley property was referred to the Joint Planning Commission. (all in favor) 4. On motion of Councilman Mahoney, seconded by Councilman Peterson, a resolution was introduced "AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE STATE OF MINNESOTA TO PROVIDE PAYMENT FOR THE MATTING OF MAIN AND CHESTNUT STREETS, LOCAL, IMPROVEMENT NO. 145 ". AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junket NAYS - -None (see resolutions) 5. Discussion was held on the possible changing of the Ordinance on Garbage and Refuse Pickup reducing the age requirement for males to 62 rather than as 65, but felt made on dependents 6. On motion of Councilwoman Bodlovick, seconded by Councilman Thonpson, a resolution was introduced "DIRECTING THE PAYMENT OF THE BILLS ". On motion of Councilman Peterson, seconded by Councilman Thompson, the Council accepted the petition for a vacation of a portion of John Street as recommended by the City Attorney and set the date of August 10, 1976 at 7:30 P. COMMITTEE REPORTS Excavators General General General Chief Abrahamson asked permission to hold off advertising for patrolman until after the next Public Safety Committee meeting and Council was agreeable to this request. PUBLIC WORKS 1. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Engineer was directed to prepare a feasibility study for a sewer improve- ment on South Fifth Street,(north of Olive Street) and for an extension of sewer on North Center Street (north of Myrtle Street). (all in favor) 2. Mr. Shelton reported on the progress of the Dutch Elm program - 157 trees marked to date as compared to 164 marked through August 31st of last year. The contractor has already removed ten trees and he stated that it will probably be impossible to get them all removed before the expiration of the contract to the large number that are being marked. PARKS & RECREATION 1. Mr. Blekum reported that sodding has been completed at Schulenberg Park. 2. Mr. Oren is happy with the Hockey School and it is possible that it will be a continuing project. Mr. Shelton reported that he has received the permit to spray Lily Lake and the cost would be about $900.00 for a 200 foot area. On motion of Councilman Peterson, seconded by Councilman Thompson the Acting City Clerk was directed to write a letter to Mr. Leonard McGuire informing him that the City had received the permit for the spraying of Lily Lake and asking the residents of that area to pay the full cost of the project. (all in favor) CITY ATTORNEY'S REPORT No report June 22, 1976 COUNCIL REQUEST ITEMS 1. On motion of Councilwoman Bodlovick, seconded by Councilman Thompson, a resolution was introduced "COMMENDING DAVID KNEFELKAMP FOR HIS YEARS OF SERVICE IN THE STILLWATER POLICE DEPARTMENT." AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Paterson, Thompson and President Junker NAYS - -None (see resolutions) 2. On motion of Councilwoman Bodlovick, seconded by Councilman Thompson, Councilwoman Bodlovick was authorized to pay for David Knefelkamp's badge and present same to him. (all in favor) 3. COUNCILMAN PETERSON asked about the payment to be made to McGrand and Forvarp and Mr. Kimmel explained the manner in which these checks were issued to the suppliers and the contractor. 4. COUNCILMAN THOMPSON complained about the lights at the North Hill Tennis Courts in that the center court is not properly illuminated and Mr. Blekum was directed to check into the cost of getting additional lights or changing the lighrs already installed at these courts.
