The meeting was called to order by President Junker The Invocation was given by Mr. Marshall. Present: Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junker Also Present: City Coordinator, Marshall; Superintendet of Public Works, Shelton; Public Safety Director, Abrhamson; Director of Parks and Recreation, Blekum; Consulting Engineer, Elliott; Planning and Zoning Commission Chairman, Martin Hansen Press: Stillwater Evening Gazette - Bob Liberty WAVN - John Hanvelt CITIZENS: Wayne Morris, Leonard McGuire, Peter Hall, Michael McGuire, James Lammers, INDIVIDUALS- DELEGATIONS - PETITIONS 1. This was the day and time set for the public hearing on Case No. 225, Special Use Permit for Wayne H. Morris to remodel basement of existing duplex into an efficiency type apartment at 517 West Myrtle Street. The notice of hearing was published in the Stillwater Gazette, the official newspaper of the City, on April 30, 1976, and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing No one appeared opposed to this request. Mr. Morris showed the Council draw- ings of his proposed plans The Mayor closed the hearing. The Planning Commission recommended the granting of this permit with the condition that the permit will expire at the end of one year, and all recommendations by the Building Inspector and Fire Chief are to be met. On motion of Councilmen Peterson, seconded by Councilman Mahoney, a resolution was introduced "GRANTING A SPECIAL USE PERMIT TO WAYNE H. MORRIS TO REMODEL THE BASEMENT OF AN EXISTING DUPLEX INTO AN EFFICIENCY APARTMENT AT 517 West Myrtle Street, with the following conditions: (1) The permit will expire at the end of one year, at which time it will be reviewed and considered for renewal, and (2) the permit is subject to the conditions set forth by the Building Inspector and Fire Chief. AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and PRESIDENT JUNKER NAYS- -None 2. This was the day and time set for the public hearing on the proposed vacation of a portion of Willard Street from Seeley to Pine Tree Trail. The notice of hearing was published in the Stillwater Gazette, the official newspaper of the City, on April 9, 16, 23, and 30, 1976, and copies were mailed to all property owners within 300 feet. The Mayor opened the hearing. The Planning Commission recommended the vacation of this portion of Willard Street. The Mayor closed the hearing. • • • May 11, 1976 On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "AUTHORIZING THE VACATION OF A PORTION OF WEST WILLARD STREET." AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junker NAYS - -None (see resolutions) UNFINISHED BUSINESS 1. CONTRACTOR'S INSURANCE ORDINANCE Mr. Marshall informed the Council that if the City increased its requirements for contractors insurance, only one contractor would be affected. He stated that all other contractors licensed by the City presently carry insurance sufficient to cover an increase to $50,000- $100,000- $25,000. Revising the ordinance would prevent any contractors from having less coverage than is required. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Clerk made the second reading of an ordiance entitled "AN ORDINANCE AMENDING ORDINANCE NO. 448, LICENSING CONTRACTORS AND ORDINANCE NO. 363 LICENSING MECHANICAL INSTALLERS, BY INCREASING INSURANCE REQUIREMENTS." The ordinance was read section by section follwed by roll call after each section, and all members of the Council voted in the affirmative. The char then put the questions, "Shall this ordinance pass ?" and on roll call the ordinance was unamimously adopted. (see ordinances) President Junker instructed Mr. Marshall to notify the one contractor who does not meet the insurance requirements that the ordinance has been amended. 2. COMMERCIAL SEWER RATES ORDINANCE Mr. Marshall distributed data to the Council as to which of the commercial lots have lawns. He stated that another alternative would be to require all commercial and industrial users to provide their own water meter. The amount of water which is used on their lawns is then subtracted. Mr. Elliott pointed out that Bayport recently changed its ordinance, and commercial users are billed on a monthly basis; if they want credit, they must meter their use in some fashion. On motion of Councilman Peterson, seconded by Councilman Mahoney, the City Coordinator was instructed to send letters to commercial businesses which have lawns, informing them at the Council is considering a change in the billing procedure and would like any objections or recommendations to be, submitted to the Council by July 1, 1976. (all in favor) 3. DATE FOR PUBLIC HEARING ON IMPROVEMENT OF MAIN STREET - LOCAL IMPROVEMENT NO. 145. MR. ELLIOTT stated that the matting will be done from Nelson Street to Laurel Street on Main Street and on Chestnut from Main to the west end of the bridge. The cost of the matting will be $2.65 per foot, costing about $8,000. COUNCILMAN PETERSON suggested the City recommend that the Highway Department work on Main Street in front of Stillwater Manufacturing. He stated that the matting will not last, because of frost heave. MAYOR JUNRER asked Mr. Elliott to consult with the Highway Department about the possibility of working on the section of Main Street abutting Stillwater Manufacturing, and what percentage the City would be required to pay for the improvement.. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "SETTING THE DATE FOR THE PUBLIC HEARING ON THE IMPROVEMENT OF MAY STREET FOR May 25, 1976, WITH THE FURTHER RECOMMENDATION THAT THE HIGHWAY DEPARTMENT REPAIR THE FROST HEAVE ON MAIN STREET AND EXTEND THE PROJECT TO PRISON HILL ". REQUEST FOR STREET LIGHT ON OAKRIDGE ROAD AND COURT Mr. Marshall stated that a representative of Orrin Thompson called requesting a street light on Oakridge Road and Oakridge Court. On motion of Councilman Peterson, seconded by Councilman Mahoney, the request for a street light on Oakridge Road and Oakridge Court was referred to the Director of Public Works for his study before action • 45 • • • 4 { . MC GUIRE pointed out that homeowners at the west end of the Lake had the Lake sprayed at their own cost in the past. On motion of Councilman Mahoney, seconded by Councilman Thompson, the Council authorized the City to apply to the Department of Natural Resources for a permit to conduct sprying of weeds on Lily Lake. Jack Shelton will take care of this. From John Ogren petitioning the City for some storm sewer work. The property involved is Croix Oil on Oasis Avenue. Mr. Marshall will give copies of the petition to Mr. Kimmel and Mr. Elliott, who will study the problem and make a recommendation. CITY COORDINATOR'S REPORT 1. Mr. Marshall stated that the Recreation Commission would like to meet with the Council Thursday evening, May 6, 1976. Since that meeting date will not be possible, Mayor Junker stated the meeting will be held at the next earliest possible date. 2. Mr. Marshall stated that he and Mr. Elliott had met with Mr. Harnack regard- ing the permit, and it will be signed in accordance with what had been discussed. 3. Mr. Marshall met with Mr. Benson, who wants to expand a little bit on the description of the land to be sold to the City. 4. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Consulting Engineer is authorized to do a feasibility study on the pre- paration of specifications for the conrete weir to be installed at the north end of Long Lake. (all in favor) 5. Mr. Marshall stated that Mr. Reynold Wert is thinking of taking disability retirement. The City pays for hospitalization and medical insurance when a person with 15 years of service retires because of age. Mr. Wert is wonder- ing if he would have the same coverage if he were to retire due to disability. Mr. Wert is about 62 years old. On motion of Councilman Mahoney, seconded by Councilman Thompson, the City will make an exception in its retirement policy and will grant Mr. Reynold Wert the regular retirement coverages if he should decide to retire due to disability. Mr. Elliott stated that the North Hill Tennis Courts are being completed this week. 2. Mr. Elliott stated that Art Holm has finished with his surveys for Lookout Lane. 3. COUNCILMAN PETERSON stated that the Belfry Antique Shop at Fourth Street and Pine was granted a six -month extension on their Special Use Permit over a year ago, with the requirement that the exterior of the building would be improved. Mr. Blekum stated that there is a problem as to access to the new tennis courts on the North Hill. The south side of the courrs abuts the property of Mr. Henke. There is 20 feet between the fence and his property. Since the courts have been in use, the children have been using his driveway and parking their bikes in his yard to get to the courts. (all in favor) 3. Mr. Blekum stated that Jim Fischer has requested some equipment to be put into the southeast corner of Lily Lake for his log rolling practicing. This is the same area where many children fish. It was decided that this would be tabled, as there may be some liability problems involved. 4. Mr. Blekum stated that in Croixwood off of Sunrise Avenue the Water Department has been graded. irt. and residents had complaints as to if that area dust created by will be seeded or sodded. Mr. Marshall will talk to the proper Orrin Thompson personnel about sodding the area around the pump house. PUBLIC SAFETY 1. Mr. of the squad. COUNCILMAN MAHONEY noted that the curb and gutter had not been completed on Interlachen Drive. He talked to Gordon Larson and Bob Steindorff, and they both refused to pay for the work to be done. Attorney Kimmel stated that an improvement hearing may have to be held and the work contracted. On motion of Councilman Peterson, seconded by Councilman Mahoney, the matter of the uncurbed portion of Interlachen Drive was referred to the City Attorney for his study and recommendation at the next Council meeting. (all in favor) QUESTIONS FROM THE PRESS None Mr. Shelton stated that trees had been planted on the County right -of- way, and all of the trees are dead now, so they can be removed. He stated that they have a request for sidewalks on Brichwood, and all of the sidewalk porjects will be done at the same time.
