Present: Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junker Absent: None January 6, 1976 7:30 P. M. Also Present: City Coordinator, Marshall; Assistant City Attorney, Holsten; Superintendent of Public Works, Shelton; Public Safety Director, Abrahamson; Director of Parks & Recreation, Blekum; Consulting Engineer, Elliott; Planning Commission Chairman, Hansen. COUNCILMAN PETERSON presented to the City Council the warranty deed for the property located on North Second Street (former location of the Paul Glaser Service Station) which the Margaret Rivers Foundation has purchased and donated to the City of Stillwater. On motion of Councilman Peterson, seconeed by Councilman Mahoney, the Council accepted the property on North Second Street in behalf of City of Stillwater from the Margaret Rivers Foundation. 2. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "THANKING THE MARGARET RIVERS FOUNDATION FOR THEIR CIVIC ENTHUSIASM AND GENEROSITY NOT ONLY FOR THIS PIECE OF PROPERTY BUT OTHER PROPERTY TO THE CITY OF STILLWATER AND ALSO MAYOR JUNKER WAS DIRECTED TO PRESENT SAID RESOLUTION TO THE DIRECTORS OF THE MARGARET RIVERS FOUNDATION." (see resolutions) AYES -- Councilwoman Bodlovick, Councilmen Mahoney, Peterson, Thompson and President Junker NAYS - -None UNFINISHED BUSINESS 1. No permit has been received from the DNR which would permit the issuance of building permits ;in the Croixwood 7th Addition and when the permit is ready it will be submitted to Stillwater Township for their approval since the drainage ditch area would be located in Stillwater Township. 2. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "AUTHORIZING THE INSTALLATION OF A LOADING ZONE SIGN FOR THE TWO METERS ON THE WEST SIDE OF MAIN STREET SOUTH OF COMMERCIAL AVENUE, 8 TO NOON WHICH IS PRESENTLY MARKED FOR NO PARKING ". (see resolutions) AYES -- Councilmen Mahoney, Peterson, and Thompson and President Junker NAYS -- Councilwoman Bodlovick 3. Discussion was held regarding the issuance of Wine Licenses and Mr. Holsten, Assistant City Attorney, stated that the statutes allow such licenses and the fee maybe half the cost of a regular On Sale Liquor license up a maxim of $2,000 per annum. Mr. Marshall was directed to check out if there are any communities that have issued such licenses and the fee they have set for same. 4. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, Russell Meister and Ron Kiel, Jr. were re- appointed as members of the Planning Commission for a term of three years. (all in favor). 4 • 1 • 486 On motion of Councilwoman Bodlovick, Seconded by Councilman Mahoney the Council confirmed the appointment of Chris Madsden to fill the unexpired term of David Eckberg on the Planning Commission (Mr. Eckberg resigned due to business conflicts. (all in favor). On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council confirmed the following re- appointments made by the Mayor to the Park Board: (3 year terms) Lyle Anderson and Chester Wilson (all in favor) On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council confirmed the Mayor's re- appointments of Jack Shelton and Paul Glaser to the Dutch Elm Commission for a three year term for each. (all in favor) On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council confirmed the Mayor's re- appointments to the Library Board each for a term of three years of the following members: Mrs. Douglas Webster Mrs. Harold Krog Mrs. Roderick Lawson (all in favor) On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council confirmed the Mayor's appointments to the Recreation Commission for the following citizens who will serve for one (1) year: Dennis Sullivan Dave Eckberg Garry Jones NEW BUSINESS Jamuary 6, 1976 - continued (all in favor) On motion of Councilman Mahoney, seconded by Councilwoman Bodlovick, the Council confirmed the Mayor's appointments to the Recreation Commission for the following citizens who will serve for two (2) years: William Herzog Jeannine Hoffbeck (all in favor) On motion of Councilman Mahoney, seconded by Councilman Peterson, the Council confirmed the Mayor's appointments to the Recreation Commission for the following citizens who will serve for three (3) years: Don Jahnke Ron Anderson (all in favor) 5. On motion of Councilman Peterson, seconded by Councilman Mahoney, the City Clerk - Coordinator was directed to advertise for bids for Official Advertising for the City of Stillwater for 1976, said bids to be returned on January 20, 1976. (all in favor) 1. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Council set the date of January 20, 1976 at 7:30 P. M. for the Public Hearing for Case No. 214 for the Planned Unit Development for the Hooley Property (N. H. & T.). (all in favor) 2. On motion of Councilman Mahoney, seconded by Councilman Thompson, a resolution was introduced "ORDERING A FEASIBILITY STUDY FOR THE IMPROVEMENTS FOR WEST MYRTLE STREET FROM OWENS TO BRICK" (see resolutions - all in favor) 3. On motion of Councilman Peterson, seconded by Councilwoman Bodlovick, the Official Bond for Dorothy R. Schnell, Deputy City Clerk and Deputy Treasurer for the City of Stillwater was approved. (all in favor) 4. On motion of Councilman Peterson, seconded by Councilman Mahoney, a resolution was introduced "DIRECTING THE PAYMENT OF THE BILLS ". (see resolutions - all in favor) INDIVIDUALS- DELEGATIONS- PETITIONS (continued) 1. MAYOR LOREN L. LAW of the City of Richfield presented to President Junker a proclamation commending the Stillwater Ponies for their achievement as 1975 State Football Class AA Champions winning over Richfield and also presented him with a key to the City of Richfield. MARTIN HANSEN, 402 North Second Street, questioned whether he is representing the City or just himself as a member of the Metro Transit Commission and it was agreed that he repesents himself as a bus patron. (renewal - second reading - all in favor) COMMUNICATIONS From Jack L. Turner, Marine Volunteer Fire Department, thanking the Stillwater Fire Department for their assistance on a mutual aid at a fire at the Croixside area on December 18, 1975. From the Honorable William T. Johnson, Judge of the District Court, Washington County, Minnesota "REPORT AND RECOMMENDATIONS FOR TRAINING OF LAW ENFORCEMENT OFFICERS IN WASHINGTON COUNTY'. CITY COORDINATOR'S REPORT 1. Mr. Marshall informed the Council that he had received a list of tax forfeit lands from Washington County and that he will prepare a map showing the locations of such property and refer it to the Recreation Commission for their study and recommendation. 2. Mr. Marshall informed the Council that he had a call from Mr. Briggs, attorney for Anna and Dennis Hooley indicating that the Hooley's are willing to accept the $2,834.00 for the crop damage as offered by the City Council and Mr. Kimmel stated that it is possible that the insurance company will pay half of this amount. 3. Mr. Marshall informed the Council that Engine No. 5 was sold for $4,000 to the City of Cyrus, Minnesota, and that also the City of Climes had made an offer on this piece of equipment. 4. Mr. Marshall will make an appearance before the Washington County Board regarding the Joint Planning Agreement with Stillwater Township. Also on the 22nd he will be at the Annexation Hearing which has now been combined with the Oak Park Heights hearing. • 487 1 r • Y • 1 F • • 488 January 6, 1976 - continued 5. On motion of Councilman Mahoney, seconded by Councilman Peterson, the City Attorney was directed to obtain appraisals on three parcels in the downtown are which could possibly be used for parking purposes. (Milwaukee Road Freight Depot, Bloom Motor Bldg., UBC property on South Second Street south of the Telephone Co. Building). (all in favor) Mr. Marshall will inform these parties that appraisals are going to be made. 6. Mr. Marshall asked the Council about setting up a depository at the St. Croix Drug for the payment of the Sewer and Refuse bills for the City of Stillwater and he will check into the cost of such a service and report back to the Council. 7. Mr. Marshall suggested that there be a joint meeting with Stillwater Township and Washington County about getting some money for parks which could be used for Park acquisition in the City of Stillwater and possibly something in the Brown's Creek area. On notion of Councilman Mahoney, seconded by Councilman Peterson, the City Coordinator was instructed to communicate with Washington County and Stillwater Township regarding poperty along Brown's Creek. (all in favor). 8. Mr. Marshall stated that Art Palmer is interested in using the Paul Glaser Service Station property for parking and he will meet with him regarding this matter. CONSULTING ENGINEER'S REPORT 1. Mr. Elliott distributed to the City Council copies of the feasibility study for the Hooley /Hauge Property for their study and a discussion will follow at a later date. COMMITTEE REPORTS PUBLIC WORKS 1. On motion of Councilman Peterson, seconded by Councilman Mahoney, the Council authorized the purchase of a No. 2 pump for the Nelson Lift Station at a price of $4,100. (all in favor) 2. On motion of Councilman Mahoney, seconded by Councilman Thompson, the Council authorized the purchase of the three - quarter ton pickup from White Bear Dodge, 1974 Model at a price of $2,900.00. (all in favor). PUBLIC SAFETY 1. Chief Abrahamson reported that the new police secretary will be attending a school starting January 19th. He also reported that the State officers were over checking the records and about 60% of them will have to be revamped and there will be a lot more paper work - no names to appear on the tickets - they are to be coded by numbers with a complete index file. PARES AND RECREATION 1. Mr. Blekum gave all of the details for the Hockey Clinic which will be con- ducted by Mr. Orn which will be held from June 14th to July 3rd, Mondays thru Saturdays with four hours per day. The fee will be $50.00 per participant. On motion of Councilman Mahoney, seconded by Councilman Thompson, the Council authroized the signing of a contract for a Hockey Clinic with Mr. Orn. (all in favor) 2. Mr. Blekum reported that there are 940 orders under the free tree program. CITY ATTORNEY'S REPORT 1. Mr. Roy Holsten turned over to the City the keys for the Paul Glaser filling station and informed the Council that the underground gas tanks have to be removed according to law and this will be taken care of. 2. On motion of Councilman Mahoney, seconded by Councilman Peterson, the Council authorized the City Attorney to negotiate with the insurance company regarding a settlement from them on the Hooley Crop Damage Claim. INDIVIDUALS - continued_ ALLEN DAVIDSON appeared before the City Council as a member of the Isaac Walton Chapter which is interested in the water problems which havekbeennd created by ve the Orrin Thompson Development in the Long Lake, Mw Creek area. He cited the laws regarding the taking out of water and adding water to lakes and rivers in the State of Minnesota and that they can be sued for such acts, as these laws are very strict. He felt that an environmental study should be done on this area and that it should be paid for by Orrin Thompson because he is the the area. in favo of organization would like to help same. ORDINANCES None RESOLUTIONS The following resolutions were read and on roll call were adopted: 1. Directing the Payment of the Bills. 2. Thanking Margaret Rivers Foundation for Donations. 3.
