Tre two individuals are; Linda Matthais, Volunteer Coordinator at the Stillwater Good Samaritan Center and Mary Oswald, Director, i^?arm 4~orld Day Care Center at Trinity Lutheran Church. I am having a plaque made up for each individual which states the Youth Service Bureau and City of Stillwater recognize their efforts in supporting the young people of our community. Both of these individuals have provided work for young people .required to perform community work service by the courts anal police as a consequence for minor delinquent behavior.Each woman has made extra efforts for many years to help provide meaningful work experiences for kids. Their work has given many kids the opportunity to not only pay for their mistakes but, to learn that they have abilities that can be useful to other people in the community. These experiences can be invaluable, especially to young people who are experiencing a variety of stresses in their life. I firmly believe that we need the efforts of people like Mary and Linda if, we are to provide an environment where young people are to grow and learn. T would like to clarify-two points. First, I believe We said that time would be 7:00 pm. secondly, did I understand correctly that the mayor will present them with a proclamation and that I would give them the plaques. I'll get in touch with you next week to clarify these .two points. Stillwater Minnesota 55082 439-2505 December 9, 1992 Mayor Wally Abrahamson and City Council Members City Of Stillwater 216 North Fourth Street Stillwater, Minnesota 55082 RE: Safety issues regarding the intersections of Highway 96, CSAH 5 (North Owens Street), County Road 55 (Norell Avenue), County Road 82 (Stonebridge Tg.ail North) in Stillwater Township. Dear Mayor Abrahamson and City Council Members: The above referenced intersections are located within Stillwater Township approximately 500 feet northerly of the City's current northerly corporate boundry. The intersections are within the long range planning area as described in the City`'r> of Stillwater's Comprehensive Plan. I live on the southwest cornor of Highway 96 and Stonebridge trail and use these intersections daily. My concern for safety at these intersections are shared by our immediate neighbors, other daily users living in northern Stillwater Township., our townboard supervisors, and residents of the City of Stillwater. Recently both the Washington County Public Works Department and School District 834 have voiced their concern regarding safety at these intersections. Enclosed are some recent correspondence between governmental agencies regarding safety concerns at these intersections. It seems to me that as many residents of the city use these intersections it would be appropriate that the city express and voice their concerns relating these intersections. This could possible be~::_: done through the city's fire rescue and police departments as they are the first and primary responders to emergencies at these intersections. I also see the issue of safety at these intersections as being a vehicle for improved communication and dialog between the City of Stillwater and Stillwater Township in regards to other general planning issues which affect the community as a whole. Rd.'s 55 & 5 (Norell Ave.) Stop Sign Request Dear Pat Bantli: Thank you for your letter of September 16, 1991, regarding the safety at the intersection of T.H. 96 at County Roads 55 ~& 5 (Norell Ave.). We have studied this intersection using the .data gathered prior to when the detour was put in place.. This study included the review of many factors, including traffic volumes, geometrics, accident data, motorist delay, and sight distance. We have determined that this intersection does not meet the warrant requirements for retaining the stop signs on T.H. 96 when the detour for T.H. 95 is removed. This detour is scheduled for removal by the middle of November. We appreciate the township's concerns, and have been working on some preliminary layouts, trying to combine this intersection (Norell Ave.) with County Road 82. After these layouts are finished, we will review them with the county and township. Thank you for bringing this to our attention... We will continue to monitor this intersection and make any changes as necessary. Please feel free to contact us, if you have further questions about this intersection. Our vehicles pass through this area many times as~County Road 55 leads to our Public Works building. There has also been two recent accidents at this intersection involving Public Works vehicles and one accident involving a school bus. It is likely that there have been several others. We ask that this area be reviewed for .possible safety improvements. Because of the poor geometries at the present. intersections, the best long-term answer may involve some realignment of the roads. We would also be willing to assist in your review or meet with you to discuss possible .options. I appreciate your attention to this involvement with your department on extremely busy. We have recently received a request from the Washington County Highway Department to cooperate in a study of the possibility of some geometric improvements of the T.H. 96 and C.S.A.H. 5, Co. Rd. 82 and Co. Rd. 55 intersection. We are very willing. to work with them and Stillwater Township to improve this intersection. Mr Robert S. Brown: It is my understanding that the Stillwater T ownship Board and residents in the vicinity of T.H.96 and C.S.A.H.5, Co. Rd. 52 and Co. Rd. 55 intersection are raising concerns about safety and traffic. control at this location. Independent School District iVo. 834 would like to add our name to the list of those expressing: concern. f ~. Approximately SO school buses roll through that intersection area on a daily basis .going one way or the other. Over the past 5-6 years there have been two accidents involving buses and a number of .close calls. It is a particular problem in winter months as drivers are having to look over their shoulders through frosty windows to see approaching vehicles. We understand that \QN/DOT is considering reconstruction of the intersection to square off the angles. We encourage your consideration of this reconstruction at an early convenience. !Je also wonder if placing a four-way stop at the intersection on a short-term basis doesn't make sense. The project includes approximately 1 mile of road in Stillwater Township and approximately 1.6 miles within the city of Stillwater. The presentation included slides of the project area .and the existing condition of the road. The project would include an eight-foot bituminous walkway along McKusick Lake within the City limits. Joel Schilling, Senior Scientist with SEH, presented a report on the impact of the project on the. wetlands, and the mitigation plan to lessen the impact. An approximately 3.6 acre wetland will be created on the north end of McKusick Lake to mitigate the loss of approximately 2.4 acres of lake and wetland as a result of the project. The construction will be staged so that there will be minimal disruption to residences and businesses. Mayor Abrahamson. opened the meeting to comments from the public. Dave Vesall, 709 W. Linden Street, stated that trees should be replanted along the shoreline. Dan Farr, 1628 McKusick Lane, asked if the excavation would have an impact on the level of the lake. Mr. Schilling stated that it would only be a temporary impact. Consulting Engineer Moore stated that the City controls the level of the lake. Gary Lidgerding, 1291 Amundson Dr., stated that he feels the walking path is important. Ed Conrad 1124 McKusick Road Lane N., asked about beaver damage to the trees. Pete Black, 835 Towne Circle, stated that it is hazardous walking along the road and the walking path is important. Jim Huntsman, 416 S. 4th St., asked ',,about the property which the County is condemning. Curt Peterson, 1106 N. 2nd St., stated he is concerned about the environmental impact. There was discussion by McKusick Lake area residents regarding the current condition of the lake.. Gary Voss, 830 Towne Circle, asked how close the new road will be to the existing townhomes. Nancy Graham, 512 Park Place, asked about the effect on wildlife during construction. Liz Kelly, a resident of Marine, stated her concern. about the effect on the nature area. Richard Shubert, Stillwater Township, stated that he is concerned for the upper Brown's Creek watershed district. He also asked about alternative types of trails for the walking path. Motion by Councilmember Farrell, seconded by Councilmember Bodlovick, to adopt the appropriate Resolution approving the plans and specifications and ordering the improvement for McKusick Lake Road Project, L.I. 261, authorizing the Mayor, City Clerk and Consulting Engineer to sign the agreement with the County, and enacting the proper Resolution to qualify for. (Resolution No. 92-241) Ayes - Councilmembers Bodlovick, Farrell, Funke, Opheim, and Mayor Abrahamson Nays - None Contract with Ed Cain Motion by Councilmember Farrell, seconded by Councilmember Opheim to adopt the appropriate resolution authorizing .the .Mayor and City Clerk to sign an addendum to the existing consulting con- . tract with Ed Cain for obtaining Federal and State .funds for the levee wall reconstruction. The addendum would provide for reimbursement not to exceed $7,500 for obtaining Federal funds and not to exceed $7,500 for State funds. UNFINISHED BUSINESS 1. Discussion of the Greens Townhomes request for transfer of Private Street to Public Street designation. City Coordinator Kriesel explained the request presented by the Greens Townhomes to convert a private street to a public street. Discussion. included whether the homeowners knew it was a private street when the units were purchased, and the accommodation of emergency vehicles and snowplowing on substandard streets. Chuck Buehler, a resident of the Greens, stated the Council should not be accepting substandard streets when townhomes are built because of the problems which develop later. He also said it was not clear to .the homeowners that this was a private street. He said that at the last meeting on this issue, they were told they would meet with Staff to discuss the issues further and were never called. The Homeowners' association would like to set up criteria for accommodating emergency vehicles and restrictions against on-street parking.. Further discussion followed regarding the contents of the covenants issued to the Homeowners' Association. John Grundtner, a member of the Greens Town homes, asked what the cost to the City would be to maintain a public street, such as filling cracks, etc. He stated they pay taxes as other citizens do and do not get the benefit of City services. Analysis Recycling services have been provided and the City of Stillwater has not charged for these services as projected and budgeted. • Conclusions The expenses in the Solid Waste Fund for recycling costs of the city is approximately $90,000 per year. A portion of these costs are covered by the Washington County recycling grant. It is estimated that this fund will have a deficit position of approximately $35,000 at December 31, 1992 after increasing the transfer from the recycling fund by $11,000. BACKGROUND: Bayport, Oak Park Heights and Stillwater, a sub-Watershed of the Middle St. Croix Watershed Management Organization, has been studying the Perro Pond and Perro Creek issue as identified in the Watershed Plan. This broad study has outlined several options for solving the pump problems in Perro Pond and the flooding of Perro Creek in Bayport. Since each community contributes water run-off to Perro Pond, it has been the responsibility of these communities to implement the study. The study has identified various • options for further intensive study as previously identified in the Watershed Plan. A meeting has been scheduled for January 27, 1993 at Stillwater City Hall to review the study with the City Council's from Bayport, Oak Park Heights, Baytown Township and Stillwater. The intensive study will also be reviewed at meeting time along with reasons for choosing various options. A budget will be distributed at that time along with a u possible State grant. Luckily for Stillwater, we do not contribute. as much to the Watershed as the other communities. Over the past two - three months, Oak Glen Development Corp has been negotiating a loan with Eastern Heights State Bank. An agreement with Eastern Heights State Bank appears to be imminent. The agreement includes a repurchase agreement with the .City of Stillwater. The agreement would require the City to purchase the golf course if there is a default and foreclosure by Oak Glen Development Corp. It was anticipated that the agreement and related documents would be available for your review and consideration at Tuesday`s meeting. However, It now appears that the items mentioned will not be in final draft form until Monday or Tuesday. The City Council of the City of .Stillwater does ordain; 1. Section 1. Addin Section 31.01, Subd. 30, Forest Protection that shall hereafter re A. Forest Protection Regulations. 1. Findings and Purpose. a. The City of Stillwater finds that the preservation of trees and wood lands within the City is critical to the health, safety and welfare of the citizens of Stillwater; that existing and potential development. within Stillwater has the effect of reducing and in some cases. eliminating wooded area, which, if preserved and maintained, serve important ecological, recreational and aesthetic functions to the benefit. of existing and future residents of Stillwater. Therefore, the the purposes of this ordinance are the following: b. To preserve woodlands and trees on individual sites; protect the safety of said residents by preventing wind and water erosion, slope instability and rapid runoff; promote the health of said residents by absorption of air pollutants, contaminants and noise; and protect .the welfare of said residents by increasing. rainfall infiltration_to the water table, provide a diversified environment for many kinds of animals and plants necessary for wildlife maintenance and important to the aesthetic values and recreational requirements of the area and promote energy conservation by shading buildings in .the summer and breaking winds in the winter. 2. DISTRICT BOUNDARIES This ordinance shall apply to all zoning districts with the City of Stillwater. 3. .DEFINITIONS a. Crown Cover - the ratio between the amount of land shaded by the vertical projection of the branches and foliage area of standing trees to the total area of land, usually expressed as a percentage. b. Development - the construction, addition, installation or alteration of any structure, the extraction, clearing or other alteration of terrestrial or aquatic vegetation, land or the course, current or cross section. of any water body or water course or the division of land into two or more parcels. c. Development Permit - any building permit, zoning permit, plat approval, rezoning, special use permit or variance. d. Dimensional Requirement - minimum and maximum setbacks, yard requirements and/or structure height or size restriction established in zoning ordinance. e. Structure - anything manufactured, constructed or erected which is normally attached to or positioned on land, including portable or temporary structures.. f. Tree - any woody plant that has at least one trunk whose diameter is six inches or greater four feet above the ground. g. Person - any individual, firm, corporation, partnership, association, or other private or governmental entity. h. Woodland - a group of trees at least one half acre in area and with a crown cover of fifty percent or greater. 4. RESTRICTIONS a. N o development permit as defined shall be issued for any development by the City of Stillwater until the City finds and determines that the development will comply with the following: 1. Development shall be conducted so that the maximum number of trees are preserved by the clustering of structures in existing cleared areas and natural clearings, and the utilization of other site design techniques. . 2. Grading, contouring and paving shall not detrimentally affect the root zone aeration and stability of existing trees and existing trees shall be provided with a watering area equal to at least one half the crown cover. 3. When the trees are removed, the permitee will restore the density of trees utilizing nursery stocks of a size generally accepted as suitable for the purpose to that which existed before-the development, .provided that in no case need the industry exceed ten trees per acre. 4. Development shall not reduce the existing crown cover greater than 50% and shall be conducted in such a manner as to preserve the understory. 5. Trees used in reforestation or landscaping must be compatible with the local landscape and conditions and not presently under disease epidemic. b. Not withstanding the above, the removal of trees seriously damaged by storms or other acts of God, or diseased trees, shall not be prohibited. 2. In all other ways, the Stillwater City Code shall remain in full force and effect. 3. This Ordinance shall be in full force and effect from and after its ~- passage and publication according to law. Provide you with a tentative schedule for the 1993 Local Boards of Review. 2. Make councils/boards aware of a training session to be held March 18, 1993, for members of Local Boards of Review. 3. Make you aware of a presentation that is available upon request to all cities and townships regarding property taxes and assessment procedures both in general and for their specific jurisdiction. 4. Make you aware of issues that our offices is dealing with in taxation of the possessory interest of cable television operations. The tentative schedule enclosed for Local Boards of Review is enclosed. The procedures that we are following this year for establishing Local Boards of Review date is similar to last year. It is: 1. Establish and distribute tentative schedules; December 9, 1992 2. Allow thirty days for feedback from local jurisdictions to confirm or change tentative dates. • 3. In mid January, contact all city/township clerks who have not called back to "double check" the tentative dates that have been assigned and ensure that they will have a quorum at their Local Boards of Review. Establish and distribute the final Board of Review schedule; January 29, 1993. During the month of February our office will again be developing a Board of Review information booklet. The purpose is to provide general information about the property tax process including the appeal process and the 1993 assessment in Washington County. 1""here will be presentations of a suggested Board of Review format and responsibilities of the Local Boards of Review. The meeting will be on Thursday, March 18, 1993, at the Washington County Government Center at 6:30 P.M. The meeting room will be announced and a specific agenda provided in a subsequent meeting reminder. In addition to that meeting which will specifically deal with Local Boards of Review, our office has had information sessions in the past presented to cities or townships at either a regularly scheduled meeting or at a work session. The .purpose of these meetings has been to enhance communication between our offices and give the .local • officials additional information about the property tax system and process. The agenda can be anything that the council/board deems appropriate but in the past it has generally covered: 1. Historical information and detailed current information about the ..assessment. 2. We will be working through the cable comm'ssions in Washington County to get information about franchise agreements, esp cially franchise fees. The portable stopsign was, in fact, secured as best as possible with sandbags and was checked at least three to four times per day by City employees. we do not feel, therefore, that the City did anything that would constitute negligence in this matter and, in fact, did as much or more as to be reasonably expected of them during the time of construction in that they did physically inspect this area at least three to four times per day.
