This memo is a reminder to Council that a Workshop Meeting has been scheduled
with the Charter Commission on Tuesday, September 1, 1992 at 4:30 P.M. in the
City Hall Council Chambers, 216 No. Fourth St., Stillwater, Minnesota to
discuss the following:
1. Regulation of City Owned Land.
2. Any other business Council may wish to discuss.

Subject: Update on the "Retaining Wall Project"
During the last two days of the Congressional session prior to the
August recess, the U.S. House of Representatives had 16 items on their
agenda. They got through five of them that the Leadership considered the
most critical. The Water Resources Act was not one of them. They have
rescheduled action on the bill for Thursday, September 10. There are no
problems with the Stillwater provision, and the bill should be passed with
• a rather substantial bipartisan majority.
The U.S. Senate has not made their post-recess agenda public, but they
expect to take up the Senate version of the Act soon after the House takes
action. The Stillwater Amendment will be offered by the Chairman,
Senator Moynihan of New York at Senator Durenberger's request. As part
of the Chairman's package, passage will not be a problem.
I have begun work with the House Committee on Appropriations for
the $3.2 million request for the project. It is extremely important to work
with the Appropriations Committee Members and the staff early in the
process. There are a number of key actions that must be taken
sequentially to reduce the chances of a slip-up that would result in the
omission if the Stillwater provision in the mark-up of the Appropriations
bill. I will begin a parallel effort with the Senate Appropriations
Committee in September and October.
The House bill also directs the Army Corps of Engineers to conduct the
study that was requested by you almost a year ago. This action by
Congress will certainly have an immediate impact on the delay in the
Chicago Regional Office. The St. Paul Corps officials will be as pleased as
. the rest of us, to get a decision out of the Chicago Office.

An approximate timetable for action is as follows:

* September 10; House passage of the authorization of the Stillwater
Project.
*By September 30; Senate passage of the authorization of the
Stillwater Project.
*Work with the Army Corps of Engineers to move on the study just
as soon as the authorization bill is signed into law.
*September-November; Preliminary meetings with the
Appropriations Committees Members and staff of both Houses.
September-February 1993; Work to get witnesses on the agenda for
Appropriations Committee Hearings.
*February-April, 1993; Work on language to assure Stillwater
provision is included in the first mark-ups of the bills.
• *Votes on the appropriations will occur sometime between July 1993
and October, 1993.
It is difficult to predict a timetable for Congressional and governmental
action. But you do need to know in a general sense when certain actions
are likely to take place. Our progress is right on target so far. If any
difficulties or delays arise, you can be sure I will be in contact with you.

Army Corps of Engineers civil works program to con-
struct various projects for improvements to the Nation's

4 (a) SHORT TITLE.-This Act may be cited as the
5 "`'Pater Resources Development Act of 1992".

2 The Secretary may construct such bulkheads along
3 the Outer Harbor, Buffalo, New York, as may be nec-
4 essary to protect the shoreline and reduce the flow of pol-
y lutants into Lake Erie.
6 SEC. 111. SMALL STREAMBANH CONTROL PROJECT, ST.
7 CROIX RIVER, MINNESOTA.
8 (a) STUDY AND PROJECT AUTHORIZATION.-The
9 Secretary shall conduct a study for a streambank and
10 shoreline protection project for St. Croix River, Stillwater,
11 Minnesota, consisting of repair and extension of a retain-
12 ing wall and shall carry out such project under section
13 14 of the Flood Control Act of 1946 (33 U.S.C. 701r).
14 (b) MAXIMUM ALLOTMENT.-The maximum amount
15 which may be allotted under section 14 of the Flood Con-
16 trol Act of 1946 for the project referred to in subsection
17 (a) shall be $2,000,000 instead of $500,000.
18 (c) COST SHARING.-Nothing in this section shall be
19 construed as affecting any cost sharing requirements ap-
20 plicable to the project referred to in subsection (a) under
21 the Water Resources Development Act of 1986.
22 SEC. 112. MONTGOMERY POINT LOCH AND DAM, ARKANSAS.
23 The Secretary shall proceed expeditiously with de-
24 sign, land acquisition, and construction of the Montgom-
• 25 cry Point Lock and Dam on the White River, Arkansas,
26 authorized as part of the McClellan-Kerr Waterway by

The Committee on Public Works and Transportation, to whom
was referred the bill (H.R. 5754) to provide for the conservation and
development of water and related resources, to authorize the
United States Army Corps of Engineers civil works program to con-
struct various projects for improvements to the Nation's infrastruc-
ture, and for other purposes, having considered the same, report fa-
vorably thereon with an amendment and recommend that the bill
as amended do pass.
The amendment strikes out all after the enacting clause of the
bill and inserts a new text which appears in italic type in the re-
ported bill.
INTRODUCTION
The Water Resources Development Act of 1992 demonstrates the
continuing commitment of the Committee on Public Works and
Transportation to a regular authorization schedule for the Water
Resources Program of the Department of the Army.
The Committee conducted hearings on possible authorizations for
the U.S. Army Corps Engineers of Water Resources Program on
March 4, 1992, March 11, 1992, March 19, 1992, and March 25, 1992
receiving testimony from the Department of the Army and the

the enhancement will benefit species which are threatened or en-
dangered, or the activities are located on national wildlife refuge
lands. Operation and maintenance will be the responsibility of the
agency responsible for the lands.
SEC. 108: QUARANTINE FACILITY
This section authorizes the Secretary, in consultation with the
Governor of Florida, to construct a research and quarantine facility
in Broward Country, Florida to be used in connection with the con-
trol of Melaleuca and other exotic plant species that threaten
native ecosystems in the State of Florida. After construction, the
Secretary is to transfer the facility to the Secretary of Agriculture.
The facility is to be jointly maintained and operated by the Depart-
ment of Agriculture and an appropriate agency or agencies of the
State of Florida. $3,000,000 is authorized for the construction of the
facility.
SEC. 109: COLUMBIA, SNAKE, AND CLEARWATER RIVERS
This. section authorizes the Secretary to maintain navigation
access to and berthing areas at all currently operating public and
private commercial dock facilities associated with or having access
to the Federal navigation project on the Columbia, Snake, and
Clearwater Rivers from Bonneville Dam to and including Lewiston,
Idaho at a depth commensurate with the Federal navigation
project. The reservoir levels at the projects in this area are being
drawn down to lower levels in connection with the development of
a salmon recovery plan following the decision of the National
Marine Fisheries Service to list the Sockeye Salmon as an endan-
gered species. This drawdown results in inadequate depths at dock
facilities which rely on the Federal navigation project.
SEC. 110: OUTER HARBOR, BUFFALO, NY

Section 110 authorizes the Secretary to construct bulkheads
along the Outer Harbor, Buffalo, New York, as may be necessary
to protect the shoreline and reduce the flow of pollutants into Lake
Erie.

SEC. 111: SMALL STREAMBANK CONTROL PROJECTS
Section 111 authorizes the Secretary to conduct a study and
carry out two projects for streambank and shoreline protection
under section 14 of the Flood Control Act of 1946. That section au-
thorizes Federal participation of up to $500,000 in such projects.
This section authorizes a project at Stillwater, Minnesota on the St.
Croix River. The limit on Federal participation is raised to $2 mil-
lion, but the cost-sharing rules established in the Water Resources
Development Act of 1986 are specifically preserved. This section
also authorizes a project for Walnut Canyon Creek, Anaheim, Cali-
fornia.
SEC. 112: MONTGOMERY POINT LOCK AND DAM, ARKANSAS
This section directs the Secretary to proceed expeditiously with
the design, land acquisition, and construction of the Montgomery
Point Lock and Dam on the White River, Arkansas, which was au-
