BUtTE su COON RAPID>i, MN bb488 (f f 81780.6/01 ' As your Sub-Committee works on the Water Resources Development Act of 1992, I would like to ask your assistance for what I hope you will see as a modest request toward slapping the erosion of a retaining wall system m Stillwater, Minnesota. My office has been working closely with the Army Corps of Engineers - St. Paul District Office and the City of Stillwater to obtain technical assistance through 19~b Flood Control Act, .Section 14 Emergency streambank and shoreline protection (a Continuing Authorities Program). Currently, we are anxiously awaiting the announcement of a feasibility study by the North Central Division US. Army Corps of Engineers. Mr. Chairman,' I am writing you today because the gmblem we are facing is serious enough to warrant action above and beyond the Section 14 program. First of all, Section 14 has a $500,000 statutory Federal cost limitation. Engineers have estunated that it will cost $1.2 million. to repair the existing retaining wall system and another $800,000 to extend the wall system which would protect the City of Stillwater's trunk sewer line and lift stations. Under this funding Ievei the City of Stillwater would be left to finance 75% of the project, a prico tag the Ciry can not afford to pick-up. Furthermore, the aver wall, the lift bridge connecting Minnesota and Wisconsin, Lowell Park, and the. busy commercial section of downtown Stillwater arc all listed on the National Register of Historic Places. Erosion of the wall system threatens each of these hisiatiC markers. _w The wall system and bridge hold up more than }ust history, mare specifically, the Army Corps of Engineers concluded in a preliminary report that, "failure of the wall could lead to temporary loss of the only bridge across the St. Croix River between Hudson and 4sceoia, Wisconsin a distance of 28 miles." Action must be taken now on this retaining wall system, built 55 year ago as a WPP~project. In light of the econ'~omic and historic importance of the wall system, I request that this year's Water Resources Development Act include authorization for Stillwater's retaining wall system. Providing and maintaining jacking pits with minimum dimensions of 8 feet in width, 34 feet long, to a depth of 18 inches below the bottom of the pipe, including sheeting the face and sheeting other sides as may be required. (Said jacking pits shall be provided by the owner or general contractor in a dry condition. Owner and/or general contractor shall be responsible for back-filling, restoration and removal of excavated material piled beside the working pit.) 2. Providing all pumping including dewatering to 6 inches below the flowline of the pipe. 3. Providing access for rubber-tired vehicles within 10 feet of the centerline of the working .pits. 4. Furnishing and maintaining any barricades, signs, flares and/or other required safety devices. 5. Your attention is directed to the CONDITIONS attached hereto. By accepting this PROPOSAL, you will be accepting said CONDITIONS and acknowledging that you have received, read and understand same. TERMS: 1. Where rock or shale is encountered, we reserve the right to increase the above price based upon time and material required to remove said obstructions. 2. Construction estimates will be invoiced monthly unless other satisfactory arrangements are made prior to beginning work on the project. Materials delivered to the job site in excess of $500 may be billed upon delivery. 3. Our terms are net 30 days from date of invoice (no retentions). The party to whom the within bid proposal is made is hereinafter called the "Purchaser". The proposal together with these conditions shall constitute a short form of . contract, which will be binding on both parties, after being signed by legally authorized officials representing the Purchaser and the Company, provided that the Company has delivered its acceptance of this proposal within five (5) days of the expiration date shown on the face of this bid proposal. 2. INSURANCE. Insurance to be furnished by the company to cover work on this proposal shall consist of comprehensive general liability and automobile liability insurance as well'~,as worker's compensation insurance as required by state law. Insurance costs other than the forgoing are not included in this proposal. If other types of coverage are required, They will be charged for at the prevailing rates applicable to the coverage required. Premiums for payment and performance bonds, state or municipal taxes have not been included in the prices on this proposal unless oth',erwise stated on the face thereof. 3. UNIT PRICING. if the prices quoted herein are unit prices, it is understood that any quantities or dimensions appearing in this proposal are approximate. Final quantities and dimensions shall be agreed to by both parties, when the work is completed, and the unit prices quoted herein shall be applicable for computing the total amount payable to the Company. 4. DRAWINGS AND SPECIFICATIONS. Purchaser'~shall supply himself with the latest issue of all drawings and specifications and shall keep a copy thereof at the work site at all times snd in good order so as to be available for inspection by Company. 5. CHANGE IN CREDIT CONDITION OF PURCHASER. Terms of payment are subject to the approval of the Company's Credit Department. If in the Company's sole opinion, the credit condition of the Purchaser has changed between the date hereof and the commencement and/or completion of the work to' be performed hereunder, the Company reserves the right to change the terms of payment as a condition to the performance of its obligations. 6. DELAY. The Company shall not be liable for failure or delay in delivery or performance due to Acts of God, subsurface rock or shale, differences with workmen, local labor shortages, I,fire, flood or other casualty, governmental regulations or requirements, shortages or failure of raw materials, supplies, fuel, power or transportation, breakdown of equipment, or any other causes beyond Company's reasonable control whether of similar or dissimalar nature than those enumerated. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES OR CLAIMS FOR LABOR RESULTING FROM FAILURE OR DELAY IN DELIVERY OR PERFORMANCE 7. WARRANTIES. The Company warrants title to,'and freedom from encumberance on, the products sold hereunder. The parties acknowledge and agree that there are no other understandings, terms, conditions or warranties, either expressed or implied. 8. PURCHASER'S REMEDIES. The Company's liability hereunder shall be limited to its obligation to perform according to the terms of the proposal ', 9. TECHNICAL ADVICE. The Company shall not the responsible for the results of any technical advice in connection with the design, installation and use of the products sold hereunder. 10. BACK CHARGES. All back charges are subject to negotiation and must be presented to the Company in writing within thirty (30) days after the Company completes its work. ', 11. REMOVAL OF OBSTRUCTIONS. All utility links, sewers, water mains, conduits or other obstructions which may retard the progress of the work, herein described, shall be promptly telocated or removed by others at no expense to the Company unless otherwise specified on the face of this proposal. 12. COMMENCEMENT AND COMPLETION OF WORK. Upon acceptance of this proposal as a contract, the Company agrees to start the described work at such time as may be agreed to by both parties, provided the site is made available to the Company free of obstructions as indicated in condition 11 above.'~Upon completion, the Company will clean up the premises in the immediate area of the work unless other arrangements are requested ir`t writing by the Purchaser. Purchaser shall have an authorized representative at the site of work for inspection and acceptance at the time of completion of work. 13. WATCHMEN. The Company shall not be responsible for charges for watchmen or for inspection of work or materials, unless otherwise agreed to in writing. I, 14. RIGHTS-OF•WAY, PERMITS, ETC. Unless otherwise expressly agreed to in writing, all agreements for right-of-way, permits and other authorizations to permit the work to be done and payment therefor to be made shall be obtained by the Purchaser at the Purchaser's expense and satisfactory evidence thereof furnished to the Company before the Company shall become obligated to furnish materials or perform the work. The setting of line and grade stakes shall be an obligation of the Purchaser, unless otherwise expressly agreed in writing. 15. WAIVER.
