The attached Washington County Request for Board Action will
appear on the Boards agenda for the April 9, 1991 meeting at 9:00
AM. As can be seen from the time requested, I plan to provide a
very brief overview and ask the Board to consider the attached
resolution which I believe reflects the recommendations of the
Planning Advisory Commission.

On October 30, 1990, the Board received a petition and listened to
testimony from citizens concerned about impacts from the Minnesota
Transportation Museum exertion train and Zephyr dinner train. The
Board passed a resolution referring this matter to the Planning
Advisory Commission.
These trains operate on a six mile section of privately owned track
in Stillwater and Grant Townships and the City of Stillwater. The
trackage in the townships is on property zoned residential and
conservancy, which does not allow this type of railroad operations.
A series of meetings were held between staff and the parties
involved. One product of those meetings is the attached issue
comparison, which outlines the position of residents and train
operators. The Planning Advisory Commission met with both groups at
their regular meeting in March. After listening to testimony about
the impacts of the train and the historic, cultural and economic
value of the train operation, the Commission moved to recommend that
the County regulate the train operations through an amendment to the
Zoning Ordinance.

RESOLUTION
WHEREAS, the Washington County Board of Commissioners was
presented with a petition signed by 167 citizens of 'Grant Township,
Stillwater Township a~d the City of Stillwater requesting that the
Washington County Boand of Commissioners initiate action to prevent
the Minnesota Transpo~tation Museum and the Minnesota Zephyr. from
operating trains betw~en Duluth Junction and the City of Stillwater;
and !
WHEREAS, this iss~e was referred to the Washington County
Planning Advisory Com~ission for study, review and recommendation
back to the Washington County Board of Commissioners; and
WHEREAS, the waShilngton County Planning Advisory Commission has
met with the parties involved and heard testimony that residents
along the track have ~xperienced impacts from train operations
relating to noise, lighting, smoke, parking and high numbers of trips
made by the railroad. ' Additional testimony pointed out that,
historic, cultural an: economic benefits occur because of the
operation of the rail oad; and
WHEREAS, the Washington County Attorney's Office has determined
that railroad operations along the track are subject to the provision
of the Washington County Zoning Ordinance; and

WHEREAS, the WaShi~gton County Planning Advisory Commission has
recommended that steps! be taken to revise the Zoning Ordinance to
include standards thatl' would allow railroad operations based on .
compliance with appropriate standards.

NOW, THEREFORE, BEl IT RESOLVED that in accordance with Section
508.01 of the WaShingt~" n County Zoning Ordinance, an amendment to the
ordinance be initiated, together with all appropriate avenues for
public comment and review, to regulate the use of railroads on lands
in the unincorporated portion of the County.
