PARK DIRECTOR'S POSITION

Council met with Parks Director Blekum to discuss his pending
retirement in January, City Coordinator Kriesel recommended
that the Parks Department be merged with the Public Works
Department and a new position of Senior Parkkeeper be created
to oversee the parks. Mr, Blekum agreed with the merger

BUDGET WORKSHOP
Council met w~th Finance Director Deblon to discuss the 1991
Budget in p1eparation for the Truth in Taxation public
hearing SChediled for Tuesday, December 18, After reviewing
the figures f r 1991, Council discussed the possibilities for
making furth r reductions in the budget, It was determined
that no act'on should be taken until after the Council
receives inp t from the public at next Tuesday's meeting.
Council will I have its regular meeting at 7:00 p.m. on
December 18, with the Truth in Taxation hearing following at 4It
approximately 8:00 p,m,

RE: DOWNTOWN PLAN
Background
The City Council has requested an updated Financing Plan for the Downtown Plan,
Attached to this memo is a revised schedule of sources and uses of funds for the
Downtown Plan as of January 4, 1991 labeled "Schedule A",
Analysis
An explanation of the changes to sources of funds on "Schedule A" from previous
schedules is as follows:
1, Special assessments reflect adjustments to the large dollar
assessments that were questionable when the mock assessment roll was
created on a square footage basis,
2,
MSA contribution was increased based on SEH projections.
3, MnDOT contribution was increased based on project changes,
4, Water Board contribution is a new item.
5, No change,
6, TIF Bond based on previous revenue estimate of $350,000jyear,
Also, in order to be more accurate with the TIF revenue forecast, I would like
to review all the properties again at the end of 1990, The information needed
to do this is not available from the county yet. Therefore, I would like to
advise the City Council that the TIF revenue could and probably will change.
Factors affecting the TIF revenue that have not been accounted for in the
previous estimate include but are not limited to: reductions in market value
of TIF properties and changes in the delinquency rate (up or down),
Also noted is that project costs have increased 2.3 million from previous
estimates and therefore total uses of funds is now $7,581,437 with unfunded
project costs of $824,237,
Conclusion
In addition to the downtown plan funding for the City of Stillwater, it is my
understanding that there are also other projects that may require TIF financing
in the near or immediate future, These being the armory site purchase and the
Glacier Park land purchase that could amount to 1.3 million (300,000 for armory
and 1 million for railroad land). With the possibility of TIF financing for

these uses, it further warrants a comprehensive review of TIF revenue
projections,
Recommendation
At this point in time, I can recommend the following to the City Council:
1, Establish the downtown plan project as you would like to proceed
(plus or minus revisions to the project as presented by the Downtown
Plan Action Committee).
2. Request plans and specifications with changes as directed by the City
Council.
3. Proceed with requests for bids.
4, When bids have been received, the TIF revenue projections should be
available and definite project costs will be known.
At this point, City Council can evaluate the costs for the downtown
proj ect and any other TIF proj ect costs ( armory, railroad land)
versus the projected TIF revenue,
5.
If City Council wants to proceed with the downtown project, an
assessment roll should be adopted before the bids are awarded to
determine the status of objections to the mock special assessment
roll.

STATEMENT OF SUPPORT FOR PHASE I IMPROVEMENTS OF THE STILLWATER IJC:>WNTOWN
PLAN
On October 24, 1988, the Stillwater City Council approved, by a unanimous vote,
Resolution No. 7986 adopting the Stillwater Downtown Plan as an amendment to the
city's Comprehensive Plan. This plan, as stated in the resolution, furthers the
public interest of the City of Stillwater by providing a guide for development
and future public and private redevelopment, The major goal of the Downtown
Plan, as outlined, is to enhance and retain the historic rivertown image of
Stillwater through a conscientious and gradual process of change and economic
growth so that Stillwater "The Birthplace of Minnesota" continues to be a special
place to live, to work and to visit. \
The Downtown Plan Action Committee prepared a feasibility study from the
direction of the original Downtown Plan. The Heritage Preservation Commission
reviewed these plans as they related to the visual and aesthetic character of
the historic integrity of Downtown Stillwater, Since this feasibility study was
approved in July of 1990, the Heritage Preservat.ion Commission has been actively
involved in the specific elements of the improvement project such as choosing
the pedestrian light fixtures, commenting on the pavers and assisting in the
development of the Entrance Corridor Plan,
The plans and specs as prepared have the endorsement of the Heritage Preservation'
Commission for the following reasons:
1, The improvement is reflective and recalls the early developemnt of
Stillwater.
2. The plans and specs as prepared, are sensitive to the historic
integrity area and complements historic Downtown Stillwater as the
original plan stated. The plans don I t intrude on the existing
historic buildings but complement the whole environment of the area.
3. The plans as prepared have the cohesiveness and continuity to enhance
the pedestrian environment of Downtown Stillwater thereby adding to
the economic viability of Downtown Stillwater.
In conclusion, the Heritage Preservation wholeheartily backs the Resolution
adopted by the Stillwater City Council adopting the Stillwater Downtown Plan in
December 1988 and supports the plans and specs as prepared today as following
the original intent of the Plan to improve Historic Downtown Stillwater.

Please consider this letter a follow-up and verification of the
direction from the Council for final preparation of plans,
specifioations and bid documents for the downtown improvements.
It is our understanding that we shall prepare a base bid
consisting of infrastructure items, namely:

Repair and/or replacement of sanitary sewer
o
Storm sewer
o Wa1:Grmain replacement on Main Street, the full length
of the project and the addition of watermain looping on
North Main between Mulberry and Elm Street
o Concrete sidewalk replacement, curb and gutter and
street section, either reconstruction overlay or patch
and seal coat
e
o Street lighting for Option 1, as described in our
letter dated January 8, 1991; which consists of
replacing all wiring, conduit, bases, pOles and
existing lights for the existing system only with cobra
head fixtures. We will add the necessary lighting on
North Main between Mulberry Street and Elm Street to
increase the intensity levels to the same as the rest
of on Main Street. This also inCludes replacing
existing lights on the side streets that are now
inplace without any additional lighting to increase the
intensity.
We will include alternate bids with shoebox fixtures on an
extended system providing the same intensity of lighting on the
side streets as you now have on Main Street. A final alternate
for lighting which WOuld inClude the low level lights as
recommended by the Downtown Action Committee throughout the
project.

downtown improvements, we have estimated the cost for options on
lighting replacement as you directed as follows:
OPTION 1
Replace all wiring and conduit and only the existing lights.
This includes new poles and new bases, as well as cobra head
fixtures which are the same as existing in the downtown
area.
ESTIMATED COST:
$464,470.00
OPTION 2
Replace all the wiring and conduit and replace existing
lights and add roadway lights as necessary to extend the
same lumination levels to the side streets as now exist on
Main Street using shoebox-style luminaires. The
illumination will decrease slightly from the existing
because the shoeboxes cut off the light cone of influence
shorter than the cobra head.

Concerns about the bid policy,
Thank you for hearing my concerns over the bid procedures on the meeting of
Dec, 18, 1990,

At the meeting, I mentioned the fact that the bids, as presented, were not comparing
apples with apples because of invalid information,
On Line No, 3 of the Courier News bid, the bid information said the "length of the
lower case 8 point alphabet was 90 points," However, it is clear, from the type samples
presented by the Courier News, that the eight point type is at least 105 points or more,
It is clear, from the type samples presented, that the Courier News USED THE "LENGTH
OF THE 7 POINT LOWER CASE ALPHABET, INSTEAD OF THE 8 POINT,"
IT WAS A SIMPLE MISTAKE, HOWEVER IT HAD A SERIOUS EFFECT ON THE
INDEX NUMBER ON LINE 4, WHICH THE COUNCIL SAYS IT IS USING TO MAKE
THE FINAL DECISION, Changing the length of the lower case to its proper amount
INCREASES the Courier index number by at least 12% or higher,
My only concern, as stated, is that both parties in the bidding process be judged by the
same standards, It should either be seven point, or eight point, or whatever you request.

Attached is the sample notice of public hearing printed according to your
specifications. Based on those specifications, 7 point Helvetica, 8 leading, the
cost to the city to publish the notice in the Courier News would be $4.50 ($3 per
column inch). Also attached is the issue containing the Courier's published
statement of ownership and circulation verification.
While we can understand that the city desires to obtain the most beneficial
rate possible in light of the current fiscal uncertainty, we believe there are other
important factors to consider when awarding the bid.
We believe that readership is important if the real intent is to inform residents
of the city's proceedings. And, we think we have the advantage in readership.
We also believe that quality of service and accuracy are extremely important
factors to consider. We think we have provided the city with quality and
accuracy in serving as the legal paper in 1990, and will continue to strive to
meet those standards of excellence in 1991.
We have enjoyed working with the city staff this year and look forward to

Dear Mayor Abrahamson and Council Members:

This letter is to reaffirm the Courier News' commitment to adhere to its
distribution figure as indicated in our bid for publication of Washington County
legal notices in 1991, The Courier News will be distributed to 7,200 homes in
Washington County, of which 4,200 are located in the city of Stillwater. And, we
will have our publication and circulation figures available for periodic review by
city officials if so desired.
The notice which has appeared in our paper indicating there will be no more
free distribution of the Courier News is an effort to more clearly define our
readership and guarantee delivery of the paper to our paid subscribers. It
certainly does not mean that the Courier is going to cut its circulation figures.
We have also attached a copy of the state of Minnesota requirements for
legal newspapers. There are two methods for filing for legal newspaper status -
publishing the sworn United States Post Office Second Class statement of
ownership and circulation Q.[ publishing the statement of ownership and
circulation verified by a recognized independent auditing agency.
The Courier News uses the second method and has received its 1991 legal
newspaper designation from the Secretary of State's office. The statement of
ownership and circulation for the Gazette Extra does not meet statutory
requirements for legal status; it is neither a Post Office statement nor an
independent auditing agency verification.
We are sorry that again this year the bidding process for legal notices has
become unnecessarily complicated. Thank you for allowing us to express our
concerns. We look forward to working with you again in 1991.

Dear Mayor and Council Members:
At the November - 1990 Parks and Recreation Board meeting, a
proposal was made by Duane Elliott to consider creating a natural
path walkway around McKusick Lake before development precludes
these options, It was the consensus of the Board that this idea
be supported and pursued, It is the recommendation of the Parks
and Recreation Board that the City Council work with Washington
County as plans are developed for McKusick Lake Road and with any
future developer on securing necessary easements to accomplish
this goal.
We would encourage the City Council to ask Mr, Elliott or members
of the Board to make a presentation should you have any
questions.

In 1964, upon construction of our home and the water being
connected, the water shut-off valve was placed in the boulevard at
127 Birchwood Drive North. In 1968 Birchwood Drive North,
previously called Brick street, a new paved street was put in to
replace the dirt road. The new road was made wider and moved to
the east toward our home which took the boulevard out completely
and the shut-off valve consequently ended up in the street. We had
no reason to turn the water off in the following 22 years (from
1968-1990) so upon requesting the water department to shut off our
water for several months this winter, they found the pipe to be
bent. They then had to dig 4' down to put in a new pipe so they
could work the shut-off valve.
We feel the bent pipe was caused by the 1968 road construction crew
and their equipment. We feel this was NO CAUSE OF OURS and
therefore should be NO COST OF OURS. See attached bill.
Also, please see attached letter. We had to replace the original
sewer sump pump on November 28, 1990, at a cost of $486.25. We
have learned to live with this error of the citys but have not been
happy about it.
We would appreciate your consideration in this matter.

After a careful review of the facts surrounding the claim
that you have brought against the City of stillwater
relating to the damage that occurred to your automobile on
10-06-90 I must respectfully deny any liability on their
behalf. Although we do not dispute the facts surrounding
your claim our investigation has determined that the City
cannot be held liable for your damages. The City would
only be responsible for damage which occurred in this way
if they had been negligent in either maintaining or
inspecting the manhole that your vehicle drove over. If
as an example someone had previously complained about the
problem with the manhole and the City had neglected to
repair it. The City had recently inspected the manholes
in this area and had found no trouble with them and
therefore could not have been expected to anticipate the
problem that you encounter. Had the City been in a
position to prevent your damage and failed to do so then
we would be able to consider paying your claim, however
that is not the situation here. The City and its insurer
are not unsympathetic to your problem however once I again
I must respectfully deny your claim.

SUBJECT: U.S. CENSUS BUREAU RESPONSE TO THE CITY OF
STILLWATER1S POST CENSUS REVIEW COMMENTS.

The City of Stillwater commented to the Census Bureau
regarding the preliminary census figures. City figures
estimated a sixty housing unit undercount. Based on their
review of the City's comments, 27 additional housing units
were added to the City's total.
In addition, the Washington County Jail population that
was counted in Oak Park Heights should be in Stillwater.
This will result in a total population increase of one
hundred and twenty two (122) people or a total 1990 City
of Stillwater population of 13,839.

The Department is in the process of conducting community evaluations of the eleven
St. Croix River local units of government in conjunction with the St. Croix Rules
revision process. These community evaluations will be very helpful for the rule
revisions in assessing ordinance administration, identifying problems, and evaluating
the effectiveness of the St. Croix rules and program among the various communities.
Area Hydrologist Molly Shodeen and I would like to meet with you and any elected
officials who would be interested in attending the evaluation sometime during the
month of November. I will be calling you around the latter part of October to set up
a convenient time. We encourage elected community officials to attend these
reviews in addition to staff involved in planning and. zoning.
Community audits for the Wild and Scenic River Program have been conducted over
the last ten years for the Cannon River, Kettle River, and Rum River. The S1. Croix
Rules revision process provides an appropriate occasion to select the St. Croix as the.
fourth Wild and Scenic River to be reviewed. The enclosed questionnaire form
which we will use as a springboard for discussion is very similar to those used for the
other communities. It has been updated to reflect particular St. Croix rule
provisions. This form focuses on specific ordinance requirements, permit issuance,
ordinance interpretation, interaction with DNR, variances, violations, staff time, and
evaluation of the program's impact on the community. We appreciate whatever
groundwork you can do in answering the questionnaire questions, especially those
concerning number of permits and variances, prior to our meeting.
These discussions also provide an opportunity for an educational and informational
exchange. Since I have only been in this position for less than 2 years, I appreciate
the chance to meet with you and any community leaders in person and hear directly
your experience in managing your ordinance as it relates to the Wild and Scenic
River Program. At the same time, I hope that you will look favorably on this time as
an opportunity to ask questions and learn more about procedures and
interpretations. .

This winter we will be p';epa~g fact sheets about St. Croix Riverway ordinance
requirements for each comn:!mnity, which will be mailed to landowners in the district.
It would be very helpful to u~ if you were able to provide us with the names and
addresses of all landowners jn the riverway district at our evaluation meeting. DNR
will handle the preparation, pailing, and costs of these infonnation sheets, but we
would appreciate your coop~ration in obtaining a mailing list. We see this as an
opportunity to infonn as mapy affected landowners as possible about procedures and
alleviate some of the time yqu spend on general information calls and violations.
I look forward to seeing y01and any other elected officials during November. I will
