Scott Renne, Washington County Assessor Subject: Tentative Schedule for 1989 Local Boards of Review Enclosed is the tentative schedule for the 1989 Local Boards of Review in Washington County. As described in my October 10, 1988 Memo, there are two meetings scheduled for most jurisdictions. The first meeting will have individuals make their appeals to the Local Boards. The second meeting will be when the Local Boards act upon the recommendations of the County Assessor's Office or Local Assessor. Changes that will be implemented 'with the 1989 Boards of Review will include: - standardized sign-in sheets for individuals appealing their values or classification . - standardized follow-up sheets for use by County Assessor's Staff or Local Assessors - standardized report to the Local Board of Review In 1988 there were instances where a quorum did not exist for the Local Board. This is contrary to State Law and in 1989 a Local Board of Review will not be held without a quorum. Please ensure that a majority of the members of the City Councilor Township Board acting as the Local Board of Review will be present for both meetings. The enclosed dates are those requested by the jurisdiction or if we did not hear from an area they were assigned by our office. They are still tentative at this time, however if we do not hear from you by January 6, 1989 they will become the officially scheduled Local Board of Review date and we will be ordering valuation notices based upon those dates. Please get back to me with any changes that you may desire. On October 1, 1985, the City Council approved a' variance for construction of a garage and storage building with a three foot setback from the rear and side property lines. On November 11, 1985, abuilding' permit was issued fora fifteen foot by thirty five foot garage and two story . pet ached storage building. There was no mention in the City. Council action regarding height of the structure. City Zoning Code has a maximt.m twenty foot height limit. A recent visit to the site indicates that the storage part of the building is. approximately nineteen feet tall, within the twenty foot height limit. I have written to Ms. liberty informing her that the storage building cannot be used for human habitation or commercial purposes. A copy of that letter is attached. (Permit No. l071) On No vember 11, 1985 the City of St i l1water 'approved a building permit for a garage and storage building at 210 North Martha Street. According,to approved project plans, the structures are setback three feet from the side and rear property lines and the structures height is less than twenty 'feet. A recent visit to the site revealed that the garage is nearing completion and the storage structure-is under co~struction. The height of the storage structure is nineteen feet, within the twenty foot height limit. As indicated on the permit plans and required by City Zoning Code, the storage structure can be used for storage only and not for human habitation or commercial purposes. DISCUSSION: The request is for a minor subdivision of th~ two lots. The lots were originally subdivided as two lots but have recently been combined in one lot with one legal description and one parcel number. A home has been constructed on each lot. The RB District regulations require 7,500 square feet for a single family residence and 10,000 square feet for a duplex. The request is for a modification to the minimum lot area requirement of 7,500 square feet. A 24 square foot modification is needed. All the other building and zoning requirements have been met for each lot and home. RECOMMENDATION: Approval of minor subdivison. FINDINGS: The proposed land division is consistent with tne use requirements of the Zoning Ordinance and Comprehensive Plan. Zoning District: Industrial Park Industrial Comprehensive Plan District: IP-I Applicant's Name: Happy Thomsen Type of Application: Special Use Permit PROJECT DESCRIPTION Auto and truck repair use. DISCUSS ION: A repair garage requires a Special Use Permit in the Industrial Park - Industrial District. P~rmitted uses in the district include limited manufacturing, office, research facility, warehousing and wholesale business. The truck/auto repair is different from the manufacturi~g and office uses on Industrial Boulevard and Northwestern Avenue. The site on theccrner of Curve Crest and Industrial is located at an entrance to the Stillwa:er Business Park. PROJECT ANALYSIS The proposed 7,200 square foot building meets the setbac< and height requirements for the district. A landscape plan shows street trees, bermed and sodded areas. Signage is shown on the Curve Crest Boulevarc side of the building in two sixty square foot signage areas. Building compat:ole with the area as well as use compatibility is a permit consideration. The proposed building would be of a similar design to the buildings under cons:ruction east of the site on the north side of Curve Crest with exception of no mansard band around the top of the building. The proposed twenty foot building would be constructed of vert;cal rib metal siding with brick accent siding on the Curve Crest and Industrial 3lvd. sides. The repair areas of the building would be one story while the :=ntral office section two stories. No mechanical equipment or refuse stor~ge areas are shown on the site plan. It is recommended that a mansard be added around the entire top of the building. This would increase the interest of the building and make it more compatible with other buildings in the area. Other recommend:tions include removal of the farthest west security light (toward residences) r:aligning the dri veway entrance to a regul ar entrance. screening any mechan:cal equipment and trash area, and removing signs over ,garage doors. Before bui-ding permits can be issued, a final grading/drainage plan must be submi:ted for City Engineer review. RECOMMENDATION Approval with conditions. , . . . FINDINGS: The proposed use will not be injurious to the neighborhood or otherwise detrimental to the public and will be in harmony with the general purpose of this ordinance. CONDITIONS: 1. The building design shall be modified to include an overhanging mansard around the entire building or other design improvement to achieve design compatibility. 2. The security light on the west side of the Curve Crest building elevation shall be removed. 3. The trash receptacle shall be stored in the screened security area. 4. The signs over the garage doors shall be removed. (may be numbered) 5. Any mechanical equipment shall be located within the building, to the rear of the building or screened from public view. 6. The electrical service shall be undergrounded from the street. 7. A final grading, drainage plan shall be submitted for City Engineer review and approval before building permit is issued. 8. All landscaping shall be in before building occupancy. 9. The building shall be marked with a street number according to City requirements. 10. Curbs and paving shall meet the standards for the Industrial Park District. 11. The driveway access shall run perpendicular to the street until ten foot in from the property line. 12. Sign permit shall be required for all signs (maximum height of wall sign, twelve feet). 13. There shall be no long term truck or auto storage parking on site. ATTACHMENT: Plans. APPROVAL OF MINUTES Motion by Mark Ehlenz, seconded by Jean Jacobson to approve the minutes of November 11, 1988 as submitted. All in favor. PUBLIC HEARINGS Case No. SUP/88-73 - Special Use permit to construct a 7,200 square foot auto and- truck repair building on the Southwest corner of Curve Crest and Industrial Boulevards in the IP-I Industrial park Industrial District. The applicant, Happy Thomsen, presented the request, and discussed the recommended 13 conditions of approval. His concern was with CJndition No. 1 requiring the building be modified to include an ove::hanging mansard around the entire building. He has discussed this condition with the building designer, who informed Mr. Thomsen that a mansard would not be practical on a building of this size because of problems with snow, etc. The Commission also discussed Condition No. 8 which states that landscaping shall be in before building occupancy. The applicant plans to occupy the building before spring. The Co~ission agreed to change the Condition to require an escrow account of 125% of the estimated landscape costs. Ned Windmiller, an occupant of the Medical Arts building on Curve Crest, expressed his concern with the plans for a metal building and the nature of the business. Steve Russell explained that there are no restrictive guidelines in the Industrial Park at this time. Chairman Fontaine said the Commission should only consider usage, as they cannot restrict the building materials. In addition, I want to give you an update on legislation affecting Minnesota businesses. We've had some real success this year! But" first 'let "me "share some .very exciting news~ When the 101st Congress convenes in January, I will take on a new role as the senior Republican on the Senate Small Business Committee. In that position, I plan to continue showing my support for small business development which brought me here in the first place. I'll be placing special emphasis on rural development issues. Your input now will be more important than ever. . As you know, the 30 Small Business Development Centers throughout Minnesota provide training and counseling to aid small business growth. The SBDC's authority to provide employee training programs was questioned earlier this year. Initially, the SBA took the view that SBDCs could not provide training for employees of a small business. When I became aware of the SBA position, I contacted my good friend Jim Abnor, Administrator of the SBA, for clarification. I was very concerned about the precedent this might set for determining allowable small business training and counseling activities at SBDCs. . I told Jim that, in my Judgment, employees should be allowed to attend SBA and SBDC training programs. Programs in accounting, finance, marketing, advertising, and customer relations provide necessary background for all small businesses and their employees. Frankly, employees frequently have a greater impact on customers than do owners and managers. My experience in a business where service is essential to survival has demonstrated to me the value of well-trained employees. And I have good news! With some coaxing, the SBA finally agreed to review its position, and concluded that SBDCs may provide training to small business employees so long as there is a need for that training and the businesses themselves will benefit through the training. The ruling specifically clarifies that training in customer relations is considered a legitimate SBDC activity. This could have a great impact on the kind of training offered by SBDCs in Minnesota and across the country." As a member of the ee, I added three important amendments to n bill which was signed into law this fall. One amendment exp nds the SBA Administrator's authority to approve economic assi tance disaster loans by giving him powers similar to those of t e Secretary of Agriculture. My amendment was spurred by the in quities I observed arising from last summer's drought. Be ause these disasters affect businesses as well as farmers, I wa ted the SBA Administrator to have maximum authority to respond. In addition, I au hored an amendment which lowers the interest rate under t e SBA's economic injury disaster loan program for "non-prof t" organizations, such as cooperative farm elevators. With this change, an elevator unable to get credit elsewhere now is eligible for a direct loan at the same low rate as other farm-depende t businesses. My final amendment to the SBA Reauth situation I have long felt was a failin of the SB program. The bill allows a 40 percent exclusion for assets held at least one year and a 60 percent exclusion for assets held three years or more. * Organized the Capital Gains Coalition in Congress to generate bipartisan support for restoring the capital gains exclusion. * Introduced the "Rural Development Enhancement Act" to spur economic development and assistance to rural communities. * Sponsored a successful statewide Rural Development Conference in St. Cloud, Minnesota to foster dialogue on the needs of rural communities. * Authored an amendment to the Small Business Act, which was signed into law this fall, to encourage lenders to participate in the Small Business Administration's (SBA) guaranteed loan program. It reduces the amount of paperwork that qualified lenders have to complete for smaller loans (up to $50,000). Authored an amendment to the Small Business Act to expand the SBA Administrator's authority to approve economic assistance disaster loans for businesses. As a result, the SBA Administrator now has authority in this' area similar to that the Secretary"of Agriculture has for farmers. * * Authored an amendment to the Small Business Act to make direc: disaster loans available to non-profit firms on the same terms as for-profit firms when no credit is available from a private lender. With this change, farm dependant non-profits unable to get credit elsewhere now will be eligible for a direct loan at the same low interest rate available to other farm-dependent businesses. * Introduced the Senate version of the "Job Enhancement for Families Act" to expand the existing earned income tax credit and vary it by family size. During Senate debate on the minimum wage, the bill was proposed as a targeted alternative to a substantial minimum wage increase. * Convinced the SBA to reconsider its position on employee training programs offered through local Small Business Development Centers. The SBA has now concluded that these centers can provide training to small business employees. * Will be the ranking Republican on the Senate Small Business Committee when the 101st Congress convenes in January. In his new role, Rudy will continue to work vigorously on behalf of small business.
