Dear Council Members:
This study addresses the feasibility of providing for drainage
problems presently existing along North 5th street and the
increase of flow from a four lot minor subdivision along West
Poplar street. Attached Drawing No. 1 shows the project
location.

EXISTING CONDITIONS
The existing area is rolling terrain, generally sloping to the
north towards Browns Creek. A high point running north/ south
splits the area, including a portion of the golf course, into two
separate watersheds. The westerly area, Lots 1 and 2 and
approximately 3 acres of the golf course south of West Poplar,
drains to an existing low area between these proposed lots. The
runoff then flows northerly overland through Mr. Larry
Dauffebach's property to an existing 12 inch VCP culvert under
Willow Street. This culvert drains into an improved ditch then
northeasterly under East Hazel Street finally outletting into the
Browns Creek ravine. Mr. Dauffebach indicates that he has not
experienced flooding of the 12 inch VCP culvert.
The easterly area drains towards a ditch along the west side of
North 5th Street. A 24 inch RCP culvert drains approximately 5.8
acres of the golf course to this ditch. The runoff flows north
along a natural low area west of 5th Street through the property
north of the subdivision area owned by Janet Schell. A 12 inch
CMP culvert is inplace under East Willow Street, however it
appears that the majority of the water is directed west of the
culvert and overflows East Willow Street. The westerly portion
of this easterly subdivision property presently drains
northeasterly across the Schell property.

PROPOSED IMPROVEMEN

This area is in th Browns Creek Watershed. Based on telephone
conversations, the r only requirement is that the amount of
runoff after develo ment cannot exceed the predevelopment amount.
It appears from di cussions with the property owners that major
drainage problems a e presentlY occurring on the easterly half of
the project. The w sterly half of the subdivision, Lots 1 and 2,
will require a dr inage swa1e down the middle lot line and a
small holding area hat will pond the excess runoff caused by the
construction of two houses and driveways.

Three alternates a e available for the drainage concerns on the
easterly half of he area. One alternate is to maintain the
existing drainage attern. The developer would be required to
maintain the easte ly portion of Lot 4 (along North 5th Street)
in an undeveloped tate to protect the existing drainageway. A
swale would be con tructed along the easterly edge of the Schell
property to the ex' sting 12" CMP culvert. A CMP apron would be A
installed to bette direct the water into the culvert. This ,.,
swale would direct the runoff in a confined area instead of the
wide stream that p esently exists. Drainage easements would be
required for maint inenance of the swales. Drawing No. 2 shows
this alternate. I is estimated that this swale work will cost
approximately $900 and could be accomplished by the developer's
grading contractor.
A second alternate is the placement of a storm sewer pipe from
the 24 inch RCP out et at East Poplar Street to the north side of
East Willow street along the existing drainage area (through the
Schell property). Catch basins would be placed at East Poplar
Street, at the nor h edge of the subdivision, and at the north
edge of the Schell roperty. Drawing No. 3 shows this alternate.
Again, shallow swa es will be required to direct the surface
runoff to the catc basins. A drainage easement would also be
required to maintai the storm sewer pipe. The estimated project
cost for this alter ate, including contingencies, engineering and
administrative cost is $13,705. These costs could be assessed
to the three prope ties which direct runoff to this system and
receive benefit. A sessments are estimated at $1,760/Ac.
The third alternate is to place a storm sewer system within the
North 5th Street ri ht-of-way. A catch basin would be placed over
the 24 inch outlet under East Poplar Street, then extended east
to North 5th Street. The main would extend north, along the edge 4i'
of the bituminous urface to East Hazel street and outlet into
Browns Creek ravine. Catch basin leads would be extended to pick
up water on the ea t side of 5th Street. The total width of the

bituminous surface would be disturbed so it is recommended that
under this alternate, permanent street with concrete curb and
gutter be constructed. Drawing No. 4 shows this alternate. The
estimated proj ect cost for Alternate 3 is $49,150, including
contingencies, engineering and administrative costs. Additional
properties on the east side of 5th Street would contribute flows
to this system and would receive benefit from the storm sewer and
street construction. It is estimated that assessments would be
approximately $2,268/Ac for the storm sewer construction and
$29.45/front foot for the street construction.
Under all three alternates, a swale should be constructed along
the northerly subdivision line to direct the water towards North
5th street.
CONCLUSIONS
All three alternates are feasible and have their pros and cons.
From the cost standpoint alone, Alternate 1 would be the
recommended choice. Alternate 2 or 3 will require public
hearings. We will discuss this with the Council on June 19,
1990.

SUBJECT: ZONING TEXT AMENDMENT AND ZONING MAP AMENDMENT FOR THE STILLWATER
INDUSTRIAL PARK AREA.
BACKGROUND:
On February 6, 1990, the City Council amended the Comprehensive Plan by
adopting the West Stillwater Business Park Plan. This plan was complied after
seven months of study under the direction of the West Stillwater Business Park
Steering Committee. The major goal of the plan was to establish specific land
uses which would provide a compatible mix of industrial, office, service,
commercial and community uses in the Industrial Park area. After these land
use designations were established in the plan, Zoning Map and Zoning Text
Amendments were recommended in order to reflect these designations. Along with
the Zoning recommendations, general development regulations were established
for each Zoning District.
On May 14, 1990, the Planning Commission reviewed the Zoning Map and Zoning
Text Amendments, which were recommended in the plan. No changes were made. The
Commission then directed Staff to set a public hearing for the June 11, 1990
Planning Commission meeting. The Planning Commission held the public hearing
at that June 11, 1990 meeting.
DISCUSSION:
The six cases (ZAT/90-2, ZAM/90-2, ZAT/90-3, ZAM/90-3, ZAT/90-4 and ZAM/90-4)
before the City Council are the Zoning Amendments whicn reflect the
recommendations in the West Stillwater Business Park Plan. The lands east of
Oasis Avenue and north of the Frontage Road are also included as shown on the
attached maps (Case ZAM/90-2, Case ZAM/90-3 and Case No. ZAM/90-4).
RECOMMENDATION:
The Stillwater Planning Commission recommends the City Council approve each
Zoning Text Amendment and Zoning Map Amendment as stated.

ORDINANCE NO.
AN ORDINANCE RESCINDING
IP-I INDUSTRIAL PARK INDUSTRIAL ZONING DISTRICT
1. Chapter 31.01, Subdivision 22 entitled IP-I Industrial Park Industrial
District is rescinded and is hereafter enacted to read as follows:
Subdivision 22 entitled Business Park Industrial District.
(1) PURPOSE: To provide a district for light industrial and office uses.
(2) PERMITTED USES:
The following are permitted uses:
(a) Limited manufacturing conducting a process, fabrication, storage or
manufacturing light materials including electronic components and
accessories.
(b) Automotive painting, upholstering, tire recapping and major repair
when conducted completely in an enclosed building.
(c) Research laboratories.
(d) Business, professional and medical office services.
(e) Finance, insurance and real estate office services.
(3) SPECIAL PERMITTED USES:
The following uses are permitted by Special Use Permit:
(a) Radio and television facilities.
(b) Printing, publishing and allied industries.
(c) General warehousing and outside storage.
(d) Outside storage (must be screened).
(e) Mini-storage. .
(f) Wholesale trade.
(g) Commercial nurseries.
(h) Retail sales of products manufactured on site so long as no more than
twenty percent of building floor area is for retail purposes.
(i) Cultural or governmental facilities (movie theatres, libraries, fire
stations).
(4) USE DETERMINATION:
A Special Use Permit may be required when any other use or service
establishment determined by the Planning Commission to be the same
general character as the foregoing uses and which will not impair tne
present or potential use of adjacent properties may be permitted.

ORDAIN:
1. Chapter 31,01, Subdivision 18 entitled IP-C Industrial Park Commercial
District is rescinded and is hereafter enacted to read as follows:
Subdivision 18 entitled Business Park Commercial District.
(1) PURPOSE: To provide a district for general community commercial and
office uses.

The following are permitted uses:
(a) Wholesale trade.
(b) Retail - general merchandise.
(c) Specialty retail.
(d) Food - retail.
(e) Eating and drinking places and cafes.

As you directed, we have reviewed the Capital Facilities
Improvements Program dated June 21, 1990 to determine the items
and their cost for the infrastructure improvements and the non-
infrastructure improvements; and to further place these items in
the two above categories. We have combined Phase I and Phase II
of the June 21, 1990 report to correspond with the total amount
proposed for assessment in this report. The enclosed pages
include REVIEW I, REVIEW II and REVIEW III. These reviews are as

The lighting leve s in the downtown area are below today's
standards in vario s locations, such as North and South Main
Street. Also, ma y of the lights are on wooden poles and if
N.S.P. Co. places he electric distribution system underground,

We estimate that will require 106 new roadway lights to bring
the present sys em up to standard together with the
rehabilitation of 4 existing lights.
As part of our tigation of the existing system, we discussed
the condition of his system with Jim Greeder ( current City
lighting maintenance contractor) and George Deithert of the City
Public Works Depa tment. We needed to assess the existing
condition of the lighting system to provide a "ball park"
estimate to rehabil'tate.

Rehabilitating the existing lighting system is estimated at
$572,800. This includes sandblasting and painting existing
poles, removal and erecting existing poles, cut off and reweld
base, new GFI outlets, new concrete bases and new distribution
wiring. This estimate also includes new lights required to bring
entire system up to standard.

The original study estimate was prepared after reviewing several
lighting options with the Downtown Action Plan Committee. The
Committee reviewed various fixtures and poles, including the ones
supplied by N.S.P. The final selection of the Committee is shown
on Figure 2.10.1 of the study. The pedestrian lighting includes
an arcon globe fixture similar to original lights in Stillwater
in earlier years. We reviewed six different poles for these
lights with the Committee and a middle cost unit was selected.
The estimated cost ranges from $2,816 to $3,245. The unit
selected was estimated at $3,118. This estimated cost also
includes the luminaire, concrete base, cast aluminum pole with
wiring, flag bracket, GFI festoon outlet, distribution wiring,
handholes, controls, erection and all other installation cost and
miscellaneous parts. We estimated 243 pedestrian lights for the
system. It requires basically two pedestrian lights for each
roadway light to provide approximately the same illumination.
There are some other options to consider when final design is
prepared, which may reduce the cost of the lighting system. One
such option would be the possible elimination of 22 roadway
lights if the City wishes to keep the pedestrian lights on after
midnight.

The pedestrian lights add aesthetic value to the downtown area.
However, eliminating these lights does not reduce the cost by the
total amount estimated for pedestrian lights because, additional
lengths of conduit runs and wiring will be required for the
greater distance between roadway lights. These and many more
decisions have to be made during design which affect the cost of
the lighting portion of the project.

Another question wh'ch the Council asked is a breakdown of the 35
percent engineer in, administration and legal used for cost
estimates in fea ibility studies. Some time ago, during
preparation of asse sment rolls, staff determined that there were
certain costs asso iated with public works projects that should
be recovered as a art of the assessment. All projects seem to
vary, depending up n complexity, capitalized interest, bonding
cost, field represe tative and staking time etc. These cost seem
to range from abou 20 percent to 33 percent. Staff established
35 percent as a r asonable figure to be used for studies. We
have calculated so e of the items and percentages which might be
typically expected on this project. These items and percentages
are as follows:

Once final plans a d specifications are prepared a more precise
engineers estimate is presented to the Council for review. We
try to prepare con ervative cost estimates to protect the City
for capital improv ments. It has been our experience that our
estimates tend to e on the conservative side. Of course, the
amount assessed is ased on final total costs once the project is
completed.
It is our recommendation to the Council also to appoint a design
review committee t assist the Council in plan review while the
construction plans re being prepared. We further recommend that
this committee be c mprised of members of the business community,
various commissions such as the Heritage Preservation Commission
and if the Council wishes, one or two members of the Council.
This committee can assist in reviewing the plans and the actual
placement of items in the downtown as well as the extent of
infrastructure repl cement and rehabilitation.
The question of inf astructure rehabilitation has been raised by
the Minnesota Pollu ion Control Agency (MPCA) once again. As we
discussed at the 1 st Council meeting, the MPCA will not issue
permi ts for sani ta y sewer extensions to the City until this A
matter is addressed We have included a copy of the MPCA letter ..
dated July 10, 1990 to the Mayor for Council review.

We have also included a copy of a letter dated May 23, 1958;
covers for plans and specifications dated July 1, 1957 and a
portion of an old letter regarding the original lighting system.
The complete documents for this original specification is on file
in the public works office.
We hope this report will answer some of the questions facing the
Council for the downtown improvements and we will be happy to
discuss this with you in more detail if you wish at the Council
meeting on July 17.

The Minnesota Pollution Control Agency (MPCA) staff has had recent discussions
with representatives of the city of Stillwater regarding the current condition
of the city's sewers and possible impacts to the Metropolitan Vaste Control
Commission Stillwater Vastewater Treatment Facility. This situation was the
subject of a letter dated June 1, 1990, from the MPCA to the city of Stillwater.
The MPCA staff understands that the Stillwater City Council will soon consider
authorizing preparation of Plans and Specifications for infrastructure
construction in the downtown area. If the City Council votes to authorize
preparation of these Plans and Specifications, the MPCA would like to receive a
copy of the City Council resolution to this effect.
Ve also request that the city of Stillwater respond in writing with a proposed
schedule of milestone dates for this construction project. Finally, we request
that the city include in this response a projection of the inflow and
infiltration (III) which would be expected to be removed from the city
collection system upon completion of this construction project.
Upon receipt of the information requested above, and upon our evaluation of the
schedule of milestone dates, the MPCA will give further consideration to issuing
sanitary sewer extension permits for the Orleans Terrace and Cottages of
Stillwater (III) sites. If we judge the schedule of milestone dates to be
reasonable, the MPCA will issue these sanitary sewer extension permits.

The work on the street lighting was not done completely
according to specific&tions.. Follo~ing ~re deviations: Several of
the concrete bases for the st~ndards are not of the required depth
of 5' Sit. Reason for thi s is the holes where this occurred reach bed-
rock. In all such cases the diameter of the hole exceeds the re-
quirement by one foot or more. To my knowledge ~here are four such
bases,. One is at the corner of. Main & Nelson on Smead's corner, one
~ one Third & Myrtle at the Legion Club ~nd two on the north side of
Myrtle between second and Third st. These are located on plan in
Inspector's office.
The concrete replaced in breaker strips is of 2" tr..ickness..
Specifications call for replacement of approximately 4". In my
opinion 2" is a.mple considering the breaker strip is only 8" wide.
This has my approval as it will facilitate future maintenance.
The use of existing It" conduit under ramps was utilized.
Where extensions,of these conduits was required 21t ridgid conduit
sleeves with set screws were used. Specifications called for in-
stallation of all new 21t ridgid conduit. The exi sting It" conduit
was in good condition and was of sufficient capacity to contain the
wires without injury to same. These donduits will of course have to
e
be replaced sooner than if new 2" ridgid conduit was installed. Locatio":

On Second Street between ivIyrtle and Chestnut the required
depth of trench was not obtained. ~eason; Bedrock. The depth

The above ground installation meets all requirements
as to material and installation.
Standards and lighting fixtures are according to spec-
ifications.
All conduit installed at street crossing is new 2" R. C.
with the following exceptions; On Second Street East Side Alley
between Sutton and Simonet Building, South entrance to Post~EEE-
office on Myrtle st., and East-West crossing on Third at Chestnut.
On Third st. Between Chestnut and Myrtle ~!est Side condufut
was laid by Roberts & McFadden at time ramp was laid. Conduits
were not screwed together to make a continuous raceway. This nec-
essitated sleeves to be placed at these points as located o~ print
in Inspector's office.
The conduit crossing east to west on Tr~rd had a break
approximately at the center of the street. This had to be dug up
and spliced with a sleeve.
All old light standards have been removed, base botts cu~
off but concrete patch cannot be laid until weather permits.
Balance of breaker strip will be completed when weather
permits.

Re: Assessments for Downtown
Improvements

Subsequent to the Public Hearing held for the improvements related to
the Downtown Plan and pursuant to Council direction City staff met to
discuss the costs and assessment roll for the improvements. I was not
at the Hearing but it is my understanding that the Council requested
staff to separate the non-infrastructure costs from the total cost.
Dick Moore is preparing schedules that will show both infrastructure
costs and non-infrastructure costs and will present this information at
the meeting Tuesday night. Dick has also developed a number of assess-
e
ment rolls in an attempt to come up with an assessment roll that is fair
and equitable for all property Clwners. Unfortunately, every assessment
roll developed has its own type of inequity. For example, the original
assessment roll prepared by Mr. Moore (arid which is contained in the
back of the bound plan) contains some pretty hefty assessments for the
Maple Island and Yacht Club properties. However, every assessment roll
that Mr. Moore prepared which lowered the assessments for the aforement-
ioned properties raised the assessments for the other properties. Some
assessment increases were substantial and would undoubtably be consid-
ered inequitable by a property owner (especially if compared to the roll
that was presented at the Hearing).
In view of this I would strongly recommend that the Council consider
adopting the original assessment roll and base the assessments for the
4i' Maple Island and Yacht Club properties on an independent appraisal that
would establish market value increase or benefit for the two properties.
This should not only lead to a fair and equitable assessment but also to
an assessment that would be sustainable in court. I realize that this is

GARBAGE AND RUBBISH
CHAPTER 30, SUBDIVISION 8
THE CITY COUNCIL OF THE CITY OF STILLWATER DOES ORDAIN:
Section 1. Amenaing. Section 30.01, Sub. 8 of the Stillwater City Code is
amended to hereafter read as follows:
Subd. 8 FEES.

(3) Waiver of Fees.
(a) RELIEF FOR SENIOR CITIZENS. From and after the adoption of this
ordinance, the City Council of the City of Stillwater may, in
its discretion, waive the payment of any charges for garbage
collection when, in its discretion, it determines by a
three-fifths vote of the Council that a person qualifies under
Chapter 30.01, Subd. 8, Subsection 2 and that payment of the
charge would be a hardship.
(b) APPLICATION FOR RELIEF. Senior citizens seeking such relief
shall make application for the same on a form prescribed by the
City Clerk, setting forth applicant1s income and assets at the
time of the making of the application.
(c) TERMINATION OF RELIEF. Relief granted nereunder shall terminate
upon the occurrence of any of the following events: (a) the
death of the senior citizen provided that the spouse is
otherwise not eligible for the relief hereunder; or (b) if for
any reason the City Council shall determine that thete would be
no hardship to require payment.

I have reviewed the material that Jim Junker gave to you at the special
meeting of July 3,1'3'3121 pertaining to solid waste collection costs and
related fees. The data submitted by Jim wCluld take a lc.t c.f time al'ld
effort to verify so it is a matter of accepting the data as an accurate
representation of the solid waste collection experience of Junker San-
itation for the City of Stillwater. However,based on the recent increase
of tipping fees at the RDF plant and cost of living increases (as well
as fees charged by other Metro Area communities) the rate increase
requested by Jim appears to be reascmable.
~ Apparently the rate increase does not include fees for recycling and it
is my understanding that Jim will be coming back in September to discuss
a rate increase for recycling. Initially I was concerned about this and
felt that the City should combine the fees and especially avoid having
another fee increase in the Fall for recycling. However, I have analyzed
program costs and related Grant funds and it appears that there are
funds available to pay for any nominal increase in recycling costs with-
out having to pass on the costs to the homeowners/residents. For example
the City has received $71,337.121121 from the County for recycling and the
City will have spent $42,3'3'3.121121 on recycling thru '3/3121/'3121. This will
leave a balance of $28,'338.121121 for the remainder of the year to pay for
recycling (i.e. from 1121/1/'3121 thru 12/31/'3121). At the present rate the
City could fund the recycling program for an additional eight months,

and as I said could even fund a nominal increase in the fees for up to
about six months. Further, it appears that the City will be receiving
grant funds in 1991 at leas equal to what was received in 1990 (about
$50,000. 00). Therefore, I b lieve the City could increase the regular
collection fees, effective uly 1,1990 and address the recycling fees in
September as requested by unker Sanitation, Inc..

followed which included positive verification of the petition, how to
proceed and TIF funding. Should the petition not meet the 35%
requirement, Staff would be instructed to inform the Council.
Motion by Councilmember Opheim, seconded by Councilmember Farrell to adopt
Resolution No. 8320, ordering the improvement and directing the City Engineer
to prepare plans and specifications for the Downtown Facilities Improvement
Program, L.I. 257, contingent on verific',ation of the petition. (Ayes - 3;
Nays - 2, Councilmember Bodlovick and Mayor Abrahamson).
Ann Danielson, 1222 Pine St., stated she was born in Stillwater, grew up
here and was proud of the park and downtown, which is no longer the case.
She would like to be proud of her city again and supports the improvements
to downtown.
Council recessed for ten minutes and reconvened at 9:42 P.M.
2. Possible second reading of an ordinance amending Section 30.01, Subd. 8 of
the Stillwater City Code to increase solid waste collection fees.
Discussion followed regarding volume based fees to help reduce the costs
for the elderly or persons with less garbage to collect. Concern was
stated for the possible rise in clerical costs for volume based
collections and the ability to enact volume based collections by January
1.
Motion by Councilmember Bodlovick, seconded by Councilmember Kimble to have a
second reading and enactment of an ordinance to increase solid waste
collection fees. (Ordinance No. 727)
Ayes - Councilmembers Bodlovick, Farrell, Kimble, Opheim and Mayor Abrahamson.
Nays - None
Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to set
the date of Jan. 1, 1991 to begin volume based solid waste collections; and
that the Solid Waste Commission shall make a recommendation to Council by Oct.
1, 1990 regardi ng the above. (Ayes - 4; Nays - 1, Council ~mber K imb 1 e).

Final notification of Mulberry Point grant approval and request for
authorization to conduct land survey.
Mr. Russell stated final grant approval for the Mulberry Point purchase
has been received and we have also been informed that a land survey is
required. The fee for the survey would be paid out of TIF funds.

The State of ~innesota, by its delegated official, the Department of Trade and
Economic Development (hereinafter referred to as "State") and the city of Stillwater
(hereinafter referred to as "local unit") mutually agree to perform this agreement in
accordance with ~inn. Laws 1977, Chapter 421, and ~inn. Rules 4310.8100 - 4310.8170,
and the provisions contained therein. The grant application is hereby incorporated
into this agreement.

The following terms, as used erein, shall have the following definitions:
1. "Commissioner" means Comm'ssioner of the Department of Trade and Economic e
Development or any repres ntative lawfully delegated the authority to act for
said Commissioner.
2. "Guidelines" means the islative Commission on Minnesota Resources Grants in
Aid Guidelines.
3. "Funds" means those monie made available by the State under the State Outdoor
Recreation Grant Fund.
4. "Rules" means the rules ited as Minn. Rules 4310.8100 - 4310.8300.
5. "Local Unit" means the political subdivision of the State of Minnesota that is
the applicant-recipient of the grant, pursuant to this agreement.
6. "Project" means the planned undertaking for outdoor recreation that is the
subject of this agreement.
7. "State" means the State f Minnesota, Department of Trade and Economic
Development, which administers the State Outdoor Recreation Grant Fund program
for the State of Minnesota.
In consideration of the mutu 1 promises and covenants contained herein, the parties
hereby agree to perform this agreement as follows:
A. GENERAL PROVISIONS
e
1. Subject to availability f appropriated state funds, the State agrees to
distribute to the local nit the State's share of the costs of the above project,
as approved by the Commi sioner.
2. The local unit agrees to execute the project herein described in accordance with
the terms of this agreem nt. It is hereby understood that the local unit has
reviewed any attached St te forms and the attachments thereto and has found them
acceptable.
3. When the local unit fail to provide the maintenance required under this
agreement, the State may withhold current or future payments to the local unit on
any projects until the 1 cal unit complies with this provision.
4. In the event that the 10 al unit defaults on the project, the State may maintain
the project and shall be authorized to charge the local unit for the cost of
maintenance. Such costs of maintenance shall constitute a debt due and owing to
the State.
5. The local unit shall obt in the Commissioner's written approval before any change
is made on the project f om the original recreational purpose or Jurisdictional
control.

PROJECT ADMINISTRATION
2.
The local unit shall promptly submit any reports requested by the Commissioner.
Property and facilities acquired or developed pursuant to this agreement shall be
available for inspection by the Commissioner upon request.
Because one of the basic objectives of the State Outdoor Recreation Grant Fund
program is to enhance and increase the State outdoor recreation resources, the
local unit shall use the State funds granted hereunder consistent with those
objectives. These funds shall result in a net increase in a local unit's outdoor
recreation program, at least commensurate with the State cost share, and shall
not be used as a replacement or substitution of a local unit's outdoor recreation
funds.

PROJECT EXECUTION
1. The project shall be completed within the period identified on page 1 of this
agreement. In the event the project is extended or completed or terminated at an
earlier date, the projact period shall end on the date of completion or
termination.
2.
The local unit shall complete the project in acordance with the time schedule set
forth in the project proposal. Failure to render satisfactory progress or to
complete this or any other project under the State Outdoor Recreation Grant Fund
Program to the satisfaction of the Commissioner may be cause for the suspension
of all obligations of the State under this agreement.
Affirmative Action: A municipality that receives state money for any reason is
encouraged to prepare and implement an affirmative action plan for the employment
of minority persons, women, and the disabled and submit the plan to the
commissioner of human rights.
4.
Construction contracted for by the local unit for the purposes of this grant
shall meet the following requirements:
a. Written change orders to contracts for construction in excess of $10,000
shall be issued for all necessary changes in the facility. The orders shall
be made a part of the project file and shall be kept available for audits
for three years after completion of the project. One (1) copy of the order
shall be submitted to the Commissioner.
b. The contractor's bonds provisions of Minn. Stat. Sect. 574.26.
c. The human rights and affirmative action provisions of Minn. Stat. Chap.
363.
d. The antidiscrimination provisions of Minn. Stat. Sect. 181.59, as amended,
and other applicable laws and regulations.
e. The workers' compensation provisions of Minn Stat., See 176.181, Subd. 2.
~ f. The competitive bid provisions of Minn. Stat. Sect. 471.345 - 471.36.

maintained, the property r facilities acquired or developed pursuant to this
agreement, in accordance ith the requirements of the guidelines. Sanitation and _
sanitary facilities shall be maintained in accordance with the applicable public
health standards. Prope ties shall be kept reasonably safe for public use. Fire
prevention, lifeguards, and similar supervision shall be provided to the extent
possible. Buildings, ro ds, trails, and other structures and improvements shall
be kept in reasonable re air throughout their estimated lifetime to prevent undue
deterioration and to enc urage use of the project.
4. The local unit shall kee the facility open to the general public at reasonable
hours and at times of th year consistent with the type of the facility.
E. COMPLIANCE
The local unit shall be esponsible for compliance with this agreement by any
political subdivision or public agency to which funds are transferred pursuant to
this agreement. Failure by the political subdivision or public agency to comply
shall be deemed a failur by the local unit to comply with this agreement.
F. PROJECT TERMINATION
1. A project shall commence when the local unit makes any expenditure or incurs any
obligation with respect 0 the project. The local unit may unilaterally rescind
this agreement at any ti e prior to the commencement of the project. After
project commencement, th s agreement may be rescinded, modified, or amended only
by mutual agreement cons stent with law and regulations.

2. Failure by the local unit to comply with this agreement or any similar agreement
may be cause for the suspension of all obligations of the State hereunder.
However, such failure to comply with this agreement shall not be cause for the
suspension of all of these obligations when, in the judgment of the Commissioner,
the failure was not due to the fault of the local unit. In such case, the
minimum costs of any irrevocable obligations properly incurred shall be eligible
for funds under this agreement.
3. It shall be recognized that the benefit to be derived by the State from the full
compliance by the local unit with the terms of this agreement is the
preservation, protection, and the net increase in the quantity and quality of
public outdoor recreation facilities and resources which are available to the
people of the State. Because repayment by the local unit to the State of the
funds extended under this agreement would inadequately compensate the State for
any breach of this agreement by the local unit, the local unit agrees that the
appropriate remedy for a breach of this agreement by the local unit shall be the
specific performance of this agreement.
G. RETENTION AND CUSTODIAL REQUIREMENTS FOR RECORDS
1. Financial records, supporting documents, statistical records, and all other
records pertinent to this grant shall be retained for a period of three years,
commencing with the date of closure letter from the State of Minnesota with the
following qualifications:
a. The records shall be retained beyond the three-year period when audit
findings have not been resolved.
b. Records for nonexpendable property that was acquired with State grant funds
shall be retained for three years after its final disposition.
c. The Commissioner or Legislative Auditor or their duly-authorized
representatives, shall have access to any books, documents, papers, and
records of the State and local units and their subgrantees, which are
pertinent to a specific project for the purpose of making audit,
examination, excerpts, and transcripts.
d. The local unit may use any generally-accepted account system that meets
minimum requirements set forth in the guidelines.
H. STATE PAYMENT OF ELIGIBLE PROJECT COSTS
1. Project costs eligible for assistance shall be determined upon the basis of the
criteria set forth in the LCMR guidelines.
2. The local unit shall submit to the State all expenditure records pertinent to the
approved project.
3. The State shall perform a financial audit of all expenditure records submitted by
the local unit. This audit shall follow accepted audit principles and be
consistent with the LCMR guidelines.

4. Following completion of he audit, the State shall disburse to the local unit all
or a portion of the appr ved State Grant Amount. In no case, shall the local
unit receive disbursemen (s) in excess of the State Grant Amount.
5. In the event that actual eligible expenditures, as determined by reports and
audit, pursuant to H.2. and H.3. of this agreement, are less than the Total
Project Cost, the State ill adjust the Approved State Grant Amount by applying
the approved percentage of Total Project Cost to the amount of actual eligible
expenditures.
I. SPECIAL PROVISIONS
The following special project terms and conditions were added to this agreement
before it was signed by the parties hereto:
1. Prior to incurring any costs on this project, the local unit must complete any
required archeological surveys, obtain any required permits and obtain written
approval by the State t incur costs.

You are required by ~innesota Statutes, Section 270.66, to provide your ~innesota tax
identification number if you do business with the State of ~innesota. This
information may be used in the enforcement of federal and state tax laws. Supplying
these numbers could result in action to require you to file state tax returns and pay

I have been retained by the Minnesota Department of Trade
and Economic Development to review your recent appraisal on the
above referenced property. Prior to approving your report,
certain improvements to the appraisal will be required. Please
be aware that this review is being prepared in accordance with
"Uniform Standards of Professional ,6.,ppraisal Practice" \-'ihich was
adopted by the eight major appraisal societies in 1987.
Additionally, the report will have to meet the requirements of
"Uniform Appraisal Standards for Federal Land .A,cquisiticn".
Please consider the following recommendations as constructive
criticism, since these recommendations will enable your report to
be approved by the State of Min0esota and fac'ilitate the
acquisition of the property by the City of Stillwater.
Since Stillwater is a public agency acquiring private
land, a "Before and After" appraisal \AJill be required, It 1S
imperative that you address the total contiguous owner'ship which
is defined in appraisal literature as the "larger parcel". The
larger parcel constitutes the entire Burlington Northern
owne rshi p. Second 1 y, you must add ress the "\A/ho 1 e Parce 1" 'rlh i ch
essentially constitutes the Before parcel. The "Whole"
represents the property which will have a similar highest and
best use as the subject property. The question you must consider
is, will the taking affect the remaining ownership? If so, by
how much. It is imperative that you consider the subject
property as part of the total contiguous ownership.

Your report must address the situation and identify the
"Whole Parcel". As we discussed at our site inspection on the
morning of June 7, you must determine if Burlington Northern will
abandon the right-of-way, If the decision is made that
abandonment is not imminent, the subject parcel then becomes the
Whole for the purpose of this appraisal. Even if this is the
case, you must at least address the larger parcel, and the Whole
in your repor't.
After identifying the Whole, you must then estimate the
highest and best use.

controversy regarding the ownership of the subject property. The
plat map does not show a railroad right-of-way corridor. Once
you receive the survey, I wo~ld be more than happy to work with
you on this assignment regarding the appropriate appraisal

As a follow-up to our discussion concerning the property
the City of Stillwater is considering to purchase fom the
Burlington Northern Railroad Co., I submit the following:
1. Drawing from our experience with similar projects
westerly of the B N tracks, this is how lid propose to survey
the IIMuller's Pointll parcel.
a. If B N has a parcel description to work from we should get a
copy of that instrument. I have'nt had much luck in the past
with them coming up with viable descriptions.
b. Locate the existing B N tracks and improvements and provide
them with a drawing deliniating these items. What was done on the
wily side of the tracks was to have B N set off the dimensional
offsets to the existing tracks to indicate what r/w they intend to
retain.
c. I would then calculate a proposed boundary based on data
obtained from BN and stake that boundary in the field. When
the staking was completed we should review the proposed boundary
on site with B N and City of Stillwater officials. If all are
in agreement, the final mapping and parcel description work can
be completed.
2. As we discussed, railroad r/w is usually gut-shot with
title problems and will have to go thru an action to quiet title
or preferably a Torrens Title action. I strongly suggest the
latter as the course of action the City should undertake. This
particular parcel has the added dimension of being land created
above the natural, ordinary high water line, by both natural
deposits and artifical filling over the years. In cases such as
this, it is my opinion that once the title to the property has
been Registered, the boundaries should also be registered and
Judicial Landmarks placed to permanently fix those boundaries.
3. I estimate the costs to execute the above survey thru the
placement of Judicial Land Marks to be in the range of $2500t to
$3000t. the actual costs to be based on hourly rates and time
actually spent on the project.

Enclosed you will find the Blue Cross and Blue Shield of Minnesota
(BCBSM) September 1, 1990 renewal development summary for the
city. The renewal formula has calculated to a 10 percent
increase. Due to the low utilization, we will not be charging the
city any premiums the month of March 1991.
Renewal rates are as follows:
Single: $83.64
Family: $219.23
The above rates include charges of $.60 single, and $2.10
family for major organ transplant coverage.
If you would choose to convert to the Automated Cle~ing House~
(ACH) method of payment, renewal rates could be reduced by one
percent. I have enclosed information for your review.
If the city would like to changed the PCS drug copayment from
$5.50 to $7.00, the rates would be:
Single: $82.59
Family:
$216.38
If you are unable to make a renewal decision by July 15, 1990, it
will be necessary to renew the contract as stated in the renewal
proposal. Any changes being made to the contract after this date
will be assigned an effective date of October 1, 1990 or later.
If you are still not able to make a decision by August 15, 1990,
it will be necessary for you to complete the enclosed Special
Deposit Agreement and submit this form with one month's premium to
ensure coverage without interruption. The purpose of this
procedure is to ensure timely renewal processing, and to avoid
membership and claim problems caused by late renewals.

The hospital/medical insurance premium rates will increase by about 10~
effective September 1,1990. Based on this increase the rates would be as

These rates can be reduced if the City agrees to adjust the co-pay for
drug prescriptions to $7.00 (from $5.50) and if the City agrees to create
an Automatic Clearing House method of payment of the insurance premiums.
The latter is being investigated by the Finance Director and in any event
would not effect the employee. The change in co-pay for drugs would effect
effect you because the drugs would cost you $1.50 more per prescription.
On the other hand the rates would decrease by $1.05 and $2.85 per month
for single and family, respectively. The rates would then be as follows:

Before I make a recommendation to the City Council I would like to know
how the employees feel about the prospective change. In other words do you
want to continue with the present co-pay situation (i.e. $5.50 per prescrip-

each Department to determine what the consensus is. If you have any question

June 25th, 1990. Stopped at City Hall and saw Steve Russell and again asked
about letter. He told me that I might get better results by talking to Al Zepper
myself because he had asked Zepper to prepare and mail out the letter but that
Zepper hadn't done so. Went to see Al Zepper in person. He said that Russell
hadn't said anything to him about the letter until the preuious Wednesd?y (6-20-90)
and since he, Zepper,had been out of town on Thursday and Friday, he had not
had time to prepare the letter but that it was at the top of his list of things
to do.
June 27th, 1990. Stopped at City Hall to see Al Zepper. He was not in so explained
the purpose of my visit to Vern Rylander and requested that he tell ~l Zepper that
I had been in to find out when I could expect to get my copy of Zeppers letter to
the Windmillers re their pool fence.
June 29th, 1990. Stopped at City Hall and saw Al Zepper who informed me that letter
was written and should go out in that days mail.
July 2, 1990. Stopped at City Hall to see Al Zepper and inform him that I had not
received my copy of his letter re the pool fence. He told me the letter had gone
out and that if I hadn't received my copy yet, I should put the blame on the U. S.
Postal Service.

Jack Dielentheis Letter
In response to Mr. Dielentheis's letter, I would like to clarify
several items.
The Inspection Department has never had a policy that allows us to
send correspondence to neighboring properties when we send a letter
of complaint to a homeowner. I think .that would not only generate a
great deal more paperwork, but it would infringe upon the homeowners
privacy. If the neighboring owner has a vested interest, that is
different, but in this case, it is the Windmillers property, and the
only interest of the neighbors is personal. We also never have sent
a letter just because a person testify's at a public hearing.
I have sent the letter, Dr. Windmiller has been in contact with me,
and within a week (depending upon when the installer's schedule), a
fence is being installed with conifer trees installed 51 or so inside
the fence.
Both Dr. and Mrs. Windmiller have expressed to me that they do not
want me to send copies of the letters to their neighbors and I am
honol"~ing that l"~equest. I have explained to them that if IYlr.
Dielenthies comes in and requests a copy of the letter from the
fi 1 e, f01"~ the nOl"~mal 15 cent fee, I wi 11 make him a copy. The
Windmillers accept that. Mr. Dielentheis has never made that
request. All he has ever done is come in and demand a copy of the
letter be sent to him.
Mr. Dielentheis will be treated equally with every other citizen of
the City, and no special favors will be given.
I believe it was our staff meeting of June 12th that Steve told me to
get on the project, and by July 2nd it was resolved. I do not think
Mr. Dielentheis has any right to complaint on my response time,
although he does want me to drop every thing and take care of his
probl em.

The comment about my telling him to blame the U.S. Postal Service is
so far fetched, I could not help but mention it in this response,
just for a touch of humor.

Stillwater-Houlton Task Force Completes Review,
Recommends BUILD Decision in South Corridor
After more than five years of study, the Stillwater-Houlton River
Crossing Task Force voted to recommend that a new bridge be
constructed over the St. Croix River. The Task Force reiterated
its earlier support for the South Corridor as the best choice for
a new crossing. The group also ruled out further consideration of
the underwater tunnel options.
The Task Force met at the Stillwater Public Library on June 21 to
discuss and vote on its final recommendation to the Minnesota and
Wisconsin Departments of Transportation (DOTs), which have been
studying alternatives to relieve congestion in the Stillwater area.
In April, The DOTs released a draft environmental impact statement
(EIS) examining the various study alternatives.
Along with a South Corridor recommendation, Task Force Chair Sally
Evert emphasized that if a BUILD decision is made by the DOTs, a
number of issues should be of continuing importance in the on-going
study process. The key concern areas identified by the Task Force
were riverway/environment, aesthetics, relocation, and agricul ture.
The Task Force made a point of disagreeing with the assertion made
by some environmental groups that the DOTs' draft EIS was
inadequate in its coverage of the NO-BUILD option and
transportation system management (TSM) alternatives. (TSM includes
low-cost measures such as car pooling and traffic diversion which
would not require the construction of a new river crossing.)
According to the Task Force, NO-BUILD and TSM are covered in enough
detail in the draft EIS so that an informed BUILD/NO-BUILD decision
can be made.
Prior to making its recommendation, the Task Force discussed the
results of a questionnaire included with the DOTs' public comment
form. According to the final tabulation, approximately 64 percent
of the respondents favored a BUILD decision, while 32 percent
favored NO-BUILD and 4 percent were uncertain. Of the people who
favored a BUILD decision, 85 percent preferred the South Corridor,
11 percent the Central Corridor, and 4 percent the North Corridor.
The Sti 11 wa ter-Hou I ton Ri ver Crossing Task Force was formed in
1985, and is composed of appointed citizen representatives from the
eleven Minnesota and Wisconsin communi ties which would be most
affected by the various alternatives.
During the last few years, the Task Force has reviewed and
discussed eleven spec*al environmental studies, three Section 4 (f)
documents, and the fu I draft EIS. It recently completed a review
of citizen comments m de during the public comment period.
Task Force members were not required to express the formal views
of their communities. Most of the local communities have already
sent Mn/DOT their for al position statements. Mn/DOT has received
resolutions supportin a BUILD decision from the Minnesota cities
of Stillwater, Baypo t, and Oak Park Heights, and St. Joseph
Township and the Viii ge of Somerset in Wisconsin. Stillwater and
St. Joseph Township have specified that they favor the South
Corridor, whi Ie Oak ark Heights prefers the Central Corridor.
None of the study area communities support the NO-BUILD
alternative.
A BUILD/NO-BUILD decision on a new river crossing is expected to
be made later this summer by the Minnesota and Wisconsin
Departments of Transp rtation.

Task Force Chair Sally Evert called the meeting to order. The
minutes from the last Task Force meeting (April 19, 1990) were
approved. Evert asked if the DOT representatives had any
information they wanted to discuss.
Mike Louis provided an update on the comments received by the DOTs
since the hearing. Each Task Force member was given a copy of the
final questionnaire tabulations, which Louis summarized. He noted
that the results suggested people seemed satisfied with the
information presented in the environmental documents and at the
_ hearings.
According to responses on the questionnaire, Louis said that 63.9
percent of the respondents favored a BUILD decision, 32.5 percent
favored NO-BUILD, and 3.6 percent were uncertain. Of the people
who said they favored a BUILD decision, the corridor breakdown was
84.9 percent South, 11.3 percent Central, and 3.8 percent North.
Jeff Erickson distributed a map showing the approximate locations
of BUILD/NO-BUILD preferences in the study area. He explained that
some questionnaires did not come back with names and/or addresses
and were not mapped.
According to Erickson, the two things which stood out on the map
were the concentration of NO-BUILD votes in the Riverview Acres
area, and the relatively strong support for a BUILD decision in
Stillwater and Houlton. Erickson also said that the percentage of
respondents favoring BUILD/NO-BUILD inside and outside of the study
area was identical.

Howard LaVenture mentioned that the 1968-72 river crossing studies
did not include the Central Corridor as one of the study
alternatives, and questioned its status as a viable option in the
current studies. Evert indicated that the all of the current study
corridors should be considered viable options for the Task Force
to consider.

Lon Navis said he woul not feel comfortable voting BUILD/NO-BUILD

Wally Abrahamson indi ated that he felt the BUILD decision should
come first and made a motion to that effect; the motion carried.
The Task Force then v ted on its BUILD/NO-BUILD preference. Eight
out of nine Task Forc members voted for a BUILD decision.

three vote, the Task Force supported a South Corridor decision.

After some discussion, it was decided that riverway/environment,
aesthetics, relocation, and agriculture were issues that the Task
Force wished to stress as important, on-going concerns. The future
of the existing bridge was also mentioned. However, Wally
Abrahamson stated that he thought the fate of the existing bridge
was a separate issue which would require a process and hearing of
its own.
Sally Evert asked if the Task Force wanted to respond to criticisms
in some of the hearing comments that the draft EIS did not
sufficiently address NO-BUILD and transportation system management
(TSM). ,Howard LaVenture said he thought draft EIS coverage on NO-
BUILD and TSM was extensive, and listed a substantial number of
pages where the topics were mentioned.
The Task Force agreed that NO-BUILD and TSM were discussed in
sufficient detail in the draft EIS. Les Schwalen stated that
banning trucks in downtown Stillwater was not a realistic option.
He observed that many downtown businesses depend on trucks to get
their supplies; for enforcement purposes, it would be difficult to
determine which trucks had business in downtown Stillwater and
which were just passing through.
Mike Louis indicated that if a BUILD decision is made, Task Force
members will be asked if they wish to continue participating
through the design portion of the process. Louis also thanked the
Task Force for the excellent work they have done over the past few
years.
Les Schwalen asked Mike Louis about the current time frame. Louis
said that the prospect of litigation made it somewhat difficult to
predict, but that the DOTs were planning on holding design hearings
a year from this summer, with the final EIS being released
afterwards.
Sally Evert asked when litigation would be most likely to occur if
it were to happen. Bob Winter said that it would probably be after
the final EIS had been released.
It was decided that the Task Force would meet again following the
BUILD/NO-BUILD decision this summer. The meeting was adjourned.

The Minnesota Pollution Control Agency (MPCA) staff has had recent discussions
with representatives of the city of Stillwater regarding the current condition
of the city's sewers and possible impacts to the Metropolitan Vaste Control
Commission Stillwater Vastewater Treatment Facility. This situation was the
subject of a letter dated June 1, 1990, from the MPCA to the city of Stillwater.
The MPCA staff understands that the Stillwater City Council will soon consider
authorizing preparation of Plans and Specifications for infrastructure
construction in the downtown area. If the City Council votes to authorize
preparation of these Plans and Specifications, the MPCA would like to receive a
copy of the City Council resolution to this effect.
Ve also request that the city of Stillwater respond in writing with a proposed
schedule of milestone dates for this construction project. Finally, we request
that the city include in this response a projection of the inflow and
infiltration (III) which would be expected to be removed from the city
collection system upon completion of this construction project.
Upon receipt of the information requested above, and upon our evaluation of the
schedule of milestone dates, the MPCA will give further consideration to issuing
sanitary sewer extension permits for the Orleans Terrace and Cottages of
Stillwater (III) sites. If we judge the schedule of milestone dates to be
reasonable, the MPCA will issue these sanitary sewer extension permits.

WHEREAS, Washington County, a body politic and corporate, is the owner
of certain lands located within the city limits of the City of Oak Park Heights
and legally described on the attached Exhibit A; and
WHEREAS, Washington County desires to have their land concurrently
detached from the City of Oak Park Heights and annexed by the City of Stillwater
so as to have their land located within the corporate limits of the City of

AN ORDINANCE AMENDING THE STILLWATER CITY CODE
The City Council of the City of Stillwater does ordain:
1. The Stillwater City Code is hereby amended by adding
Section 33.01, Subd. 8, Subparagraph 1. that shall hereafter read
as follows:
"1 .
Delinquent or corrected sewer availability charge.

If the sewer availability charge required to be
collected by the City for the Metropolitan Waste
Control Commission or other sewer fees or charges
collected by the City in its own behalf are determined
to have been improperly calculated and that additional
or corrected charges are due from a property owner, or
if such charges are delinquent, the City Treasurer
shall prepare notice to the property owner of the
additional or delinquent charges and if after 30 days
from the notice, the funds remain unpaid, the City
Clerk may, without further notice to the property
owner, spread the charges as a service charge against
the property and certify the charges to the County
Auditor for collection with the real estate taxes."
2. In all other ways, the City Code shall remain in full
force and effect.
3. This Ordinance shall be in full force and effect from
and after its passage and publication according to law.

AGREEMENT

the Long Term Care Foundation (the "Foundation") and the City of
(the "City").
WHEREAS, the City has agreed to partldpate in the issuance of bonds for the benefit

taxes ("PILOT'. The PILOT shall be due and payable on the same dates in each year
as real estate taxes are due and payable Wlder laws of the State of Minnesota but
shall be paid by the Foundation directly to the CIty. kiy portion of the PILOT not
paid when due shall bear interest at the same rate, calculated in the same manner, as
delinquent property taxes under laws 01 the State of Minnesota.

3. RE~URSE~NT
The City acknowledges that the Foundation may seek reimbursement ham federal
and/ OJ' state agencies for part or all of the PnDT. The City agrees to cooperate fully _
with the Foundation, without expense to the City, in the efforts of the Foundation
to apply for and collect such reimbursement.
4. TERM
This Agreement shall continue in effect for II long al the FadUty is exempt from
payment of property taxes under appllcablelaws of the State of Minnesota.

basis, is n(I''I'I nearl ng ita 30th year and has also been very successful. Our proceeds support
education at ttle locel and colleglate levels, We feel that the banner ha, had a significant effect in
m~king people 8'w'sre of the sho'w'. In fact, last year .Yle invested in a ne''N'} very good Quality
banner and 31 ncerel y hope that we will be able to use it agai n this year.
