We request that Part-Time Police fficer TIMOTHY PARKOS be appointed to the Uniform Patrol
Drug Task Force.
Division to fill the opening crea ed by Officer David Roettger being transfered to the
Four Stillwater Part-Time Officer applied for this position. Of those tested, Officer
parkos was the unanimous choice 0 the 3 Sergeants, Patrol Captain and myself and had
scored first in the testing proce s. He also was recommended by several of the full-
time officers he has worked with n this department.
We ask that he be appointed to th full-time position with a starting date of January 11,
1990. Officer Parkos has been wi h this department since March 1, 1989.

LEGAL PUBLICATIONS
At the last meeting, Council received bids for legal publication of City
business. A bid from the St. Croix Valley Press was rejected because it was
late. The following week I received a call from Eugene Johnson, Publisher of
Press Publications, who stated his communication was not a bid and he wanted
the Council to read the contents. Therefore, I have attached his letter to
this memo.
Mr. Johnson asks that the St. Croix Valley Press be chosen as an additional
newspaper for other publication requirements. We do use the Press at times
for advertising for employment purposes and other advertising.
As for publishing the minutes, we are required by City Charter to publish a
summary of the minutes within fifteen working days of each Council meeting and
this, therefore, is a legal publication.
A copy of the agenda is sent to the St. Croix Valley Press before each
meeting, but we would be unable to get it to them early enough to be published
because the agenda is not finalized until the Friday before the Tuesday
meetings.

Because under state statutes you are required to choose the
Stillwater Gazette, would you have the council consider the St.
Croix Valley Press in some alternate ways.
1.
Publishing o~ the minutes, which are in no way required by
law but ar~ very help~ul in keeping the public in~ormed
and enhancing creditability o~ the elected o~~icials.
2. Name the St. Croix Valley Press as an additional newspaper
~or your present publication requirements. We would do
this at a rate hal~ o~ what the Gazette would charge you.
A~ter all you are not required to do it and we want to
~ind ways to help you in~orm more people.
3. Publish a summary o~ what takes place at the council
meetings and publish that in a manner like the Washington
County Board does. They have named the St. Croix Valley
Press as a newspaper ~or their condensation report.

4. Publish the agenda be~ore each meeting to let the public
know the major issues o~ a particular meeting so they may
attend or call the respective counsel members with their
opinion. We have several governments doing this and they
~ind this meets the need o~ the public who o~ten wonder
what's taking place.

Chairman Fontaine called the meeting to order.
APPROVAL OF MINUTES
Motion by Judy Curtis, seconded by Mark Ehlenz to approve the
minutes of the meeting of November l3, 1989 as submitted. All in
favor.
PUBLIC HEARINGS
e
Case No. V/89-74 - A variance to the Sign Ordinance setback
requirements (fifteen feet required, zero feet provided) to place
a l4'x8' ten foot tall monument type building identification and
office directory sign at 1905-1983 South Greeley Street (Greeley
Square) in the IP-C Industrial Park Commercial District. Richard
C. Ernst, Applicant. This case was continued from the November
13, 1989 Planning Commission meeting.
The applicant was not present. Steve Russell informed the
Commission that he received a request from Mr. Ernst to continue
the case to the January meeting.
Motion by Mark Ehlenz, seconded by Judy Curtis to continue Case
NO. V/89-74 to the January meeting. Motion carried 5-0.
Case No. SUP/89-76 - A Special Use Permit to convert an existing
first floor meat market into a bar and conversion of a third
floor bar into banquet facilities at Brine's Meat Market, 219
South Main Street in the CBD, Central Business District. Lamont
Brine, Applicant.
Monty Brine explained to the Commission that Brine's Meat Market
is considering relocating to a newt larger location.

Steve Russell explained that the change in use results in a
parking requirement of 71 spaces which is not practical for the
site, but it is an indicator of the parking need. There is a
recommended condition of approval that all employees shall park
in employee designated lots. The Commission discussed the future
parking situation downtown including possible parking ramps/ etc.

There is no road at the location now and it may have been
previously vacated, but there is nothing of City record that tt

to move their meat market facility to the site. The new facility
will be USDA inspected which will allow selling of products
interstate. The downtown location does not meet USDA requirements
becasue of age of the building etc. Brines will sell their meat
by mail order catalogs, etc., and the retail portion will be a
small percentage of the building.
There are eight recommended conditions of approval. Condition No.
G allows a maximum of 1,850 square feet of building to be used
for retail sales incidental to products manufactured on site.
Chairman Fontaine questioned what products will be sold and how
the determination is made of what is "incidental to products
manufactured on site."
Mr. Brine stated that the amount of square footage will limit the
number of items sold and emphasized that the main purpose is not
retail, but manufacturing of items to be sold off site. The
catering business will also be conducted out of the new facility.

Mr. Reithmeyer and Mr. Brine stated that the floor plan at this
time reflects an l,850 sq. foot retail space, but requested that
the condition be changed to 2,000 sq. foot in the event that the
floor plan is altered in the future.
Judy Curtis moved to approve the Special Use Permit with eight
conditions of approval and amending Condo No. G to a maximum of
2,000 square f~et. Mark Ehlenz seconded. Motion carried 5-0.

The Commisison reviewed and discussed the draft Noise Ordinance.
Don Valsvik stated that he has a background in this area and
pointed out several items in the proposed ordinance that he would
like to see expanded upon or clarified.
Judy Curtis made a motion that further consideration should be
given to the proposed Noise Ordinance and that Don Valsvik act as
spokesman for the Planning Commission in making a recommendation
to the City Council. Seconded by Mark Ehlenz. Motion carried 5-0.
The Commission also discussed the two vacancies on the
Commission created by the resignations of Nancy Putz
Ehlenz. Several names were suggested to recommend to
Council: Kay Tomaszek, Angela Anderson, Jack Lux, Carl
and Duane Elliott.

PROJECT DESCRIPTION:
A Special Use Permit to convert a first floor meat market into a bar and
conversion of a third floor bar into banquet facilities.

DISCUSSION:
The request is to relocate Brinels Bar, located on the third floor, to a first
floor location in the same building. The existing bar will then be used as a
banquet facility. This request requires a Special Use Permit for this type of
use in Downtown Stillwater due to the limited space for parking. The block
that Brine's is located has the highest demand for parking in Downtown
Stillwater.
The proposal for the new bar on the first floor consists of seating for 110
customers along with areas for darts and a pool table. The bar will offer
quick, over-the-counter foods served by the bartender.
The banquet facilities on the third floor will be used for special functions
such as meetings, large group gatherings, and small weddings. The seating for
this facility is 125 patrons. The present lunch room on the second floor seats
110 customers. The total customers for the three floors is 345. 15-20
employees may be working if all uses are functioning to capacity. Parking
required for the whole Brinels complex is 71 according to the Parking
Ordinance. If course, this requirement cannot be met due to their location in
Downtown Stillwater.
CONDITIONS OF APPROVAL:
1. All employees shall park in employee designated lots.
RECOMMENDATION: Approval.
FINDINGS:
The proposed use is compatible with existing uses in Downtown Stillwater. The
parking requirement for this use cannot be met.

shown on the present map of Stillwater and may have been vacated sometime
during the past one hundred and forty five years. However, the Myron Shepardls
Perfected Plat of Stillwater, as shown, does have this street platted. There
is nothing of City record that states a street vacation was ever granted on
this section of Linden Street. In order to clear the title on the property,
the Desch's are requesting this street vacation.
RECOMMENDATION: Approval for the street vacation.
FINDINGS:
The proposed street vacation is consistent with the Land Use Plan.

sketch have petitioned for this vacation. Also, in order to

PROJECT DESCRIPTION:
Special Use Permit request and use determination for office/warehouse building
with 1,850 square feet of retail space in the IP-I District.
DISCUSSION:
The application is to construct a 12,720 square foot commercial building with
3,350 square feet of office use, 4,020 square feet of meat processing
(manufacturing use), 3,500 square feet of warehouse use and 1,850 square feet
of retail use.
The building as proposed would have three leaseholders. Leasehold "A" is for a
meat processing and sales use with 1,850 square feet of retail sales space.
Leasehold IIB" is for 2,500 square feet of office/warehouse and Leasehold "CII
for 4,000 square feet of office/warehouse. The parking requirement for the
building is 37 spaces. Forty spaces are provided.
A use determination must be made to allow the retail use in the IP-I District.
The proposed 1,850 square feet of retail space represents 15% of the leaseable
building floor use and 30% of leaseholder "A" floor space. The majority of the
building use is a permitted use and the 15% retail use is incidental to the
manufacturing use. The product sold will be manufactured on site.
The site plan for Phase I construction includes a landscape and drainage plan.
The landscape plans show street trees along Curve Crest and Washington Avenue
with a bermed planted area in the boulevard to screen the parking area.
A trash enclosure is shown to the rear of the building.
The East elevation of the building show the building materials as rockface
concrete block with accent trim and aluminum windows. The project meets the
setback, height and lot coverage requirements.
RECOMMENDATION: Approval.

CONDITIONS OF APPROVAL:
1. A coordinated sign program for the building shall be submitted and
approved before any sign permits are issued.
2. The trash enclosure shall be constructed of a sturdy masonary material
similar to the materials and colors of the building.
3. The driveway access off of Curve Crest Blvd. shall be closed and moved
to the West as shown on the plan when Curve Crest is improved.
4. All mechanical equipment shall be located to the rear or located on the
roof of the structure and screened.
5. Landscaping improvements shall be in or security provided before
building occupancy.
6. A maximum of 2,000 square feet of building may be used for retail sales
incidental to products manufactured on sites.
7. Comments from the City Engineer shall be incorporated into final
construction plans.
8. Drainage and access easements shall be provided between the two most
Southerly lots.

distribution).
We feel adequ2.te parking has been provided on the proposed site plar. P A-1.

shifted west as Curve Crest Boulevard is extended.
Considering the amount of retail existing on Washington Avenue and the proposed
retail tu the west on Curve Crest, we feel this corner is a natural for low impact retail as

it is also our understanding that in the future, Curve Crest Boulevard could become a
fairly heavily traveled thoroughfare. We feel it is important to develop this corner
properly with qn attractive inviting building design. The introduction of Brine's at this
corner would provide this opportunity.

We have completed our review of the revised site plan for the
Con-Spec Corporation proposal located at the northwest corner of
Washington Avenue and Curve Crest Boulevard in Stillwater. The
proposed project consists of two phases made up of a combination
of office and warehouse land uses. Phase 1 consists of a total
of 12, 720 square feet and is located at the south end of the
site, while phase 2 consists of 40,320 square feet and occupies
the northerly portion of the site. We have reviewed the revised
si te plan in terms of access, on-site cj :r::cl.1lation and truck
traffic.
According to the site plan, three driveways are proposed. Two of
these driveways are located along Washington Avenue and a third
along Curve Crest Boulevard. The northerly driveway begins
approximately 575 feet north of Curve Crest Boulevard. It is 45
feet in width with 25 foot curb radii. Due to the angle of the
loading docks at the rear of the site, this driveway will serve
as the entrance for most trucks .It is designed adequately to
accommodate 55 foot semi-trucks.
The southerly d~iveway on Washington Avenue is approximately 32
feet in width at the property line with 25 foot curb radii. The
driveway is located approximately 345 feet north of Curve Crest
Boulevard. One difficulty associated with this driveway is the
turning radius from the inbound lane to the parking area to the
north. Vehicles will have a tendency to swing into the opposing
lane of travel in the parking area due to the tight turning

At its present location on the sight plan, the ex'isting median
would need to be cut back approximately 40 feet in order to
accommodate truck turns into the site. However, there is some
question as to whether or not the driveway should be shifted
further to the south to align with a future driveway across the
street. At this point, we are uncertain about the status of site
pL?-n approval along the e~st side of Washington Avenue. If the
Ci ty has approved a driveway along' the property line across the
street on the Prime Site subdivision, we would suggest shifting
the proposed Con-Spec access further to the south to align with
the Prime driveway. Under this scenario, the median on Curve
Crest Boulevard would need to be cut back a greater distance.

As with the previous site plan, the developer is proposing an
access to Curve Crest Boulevard. This driveway would be located
approximately 50 feet from Washington Avenue. The driveway is
adequately designed to accommodate truck entrances and exits from
the site. As stated in our previous site plan review for this
project, we recommend that the driveway be relocated to the rear
of the site once. Curve Crest Boulevard is extended. At this
location, the driveway would be approximately 260 feet from
Washington Avenue and would line up with the rear loading and
delivery aisle.
On-si te circulation on the site appears adequate except at the
northwest corner where trucks will be making a left turn from the
drive aisle to the loading area. At this corner, we recommend
increasing the radius of the landscaped island to 45 feet. This
will allow trucks to round the corner without driving over the
curbs.
The loading docks on the site appear adequate in terms of truck
maneuverability with the exception of the most southerly loading
dock. Here trucks do not have enough distance between the dock
and the edge of the site to successfully turn and exit the site.
In the future, if the driveway along Curve Crest is moved to the
rear of the site, this loading dock will not be a problem.
Trucks will be able to drive almost straight ahead to exit the
site.
e
Of greater concern is the drive-in docks. It appears that these
docks are intended to serve small delivery trucks and/or trash
trucks. However, the width and depth of the docks are not
adequate to provide maneuverability for trash trucks and it
appears that the only types of vehicles which could successfully
use these docks are large vans or very small delivery vehicles.
To address this concern, the City may wish to have the location
of the trash enclosures shown on the site plan.

METROPOLITAN SYSTEMS STATEMENT
Background:
The 1976 Metropolitan Land Planning Act requires that cities make their
Comprehensive Plan consistent with the Regional Plan within nine months of
receiving notice of changes in regional plan policy. Last April the City
received notice of the changes. A review of the regional policy changes
indicates that the City Comprehensive Plan is consistent with the new policies.
(In some areas the City Comprehensive plan does not discuss Met Council policy).
A major amendment of the Stillwater Comprehensive Plan is scheduled for 1990 -
1991 at that time regional policies can be considered in more detail,
Recommendation:
Send attached letter to Met Council indicating consistency' with Met Council
regional system statement.

The City of Stillwater has reviewed in detail the 1988 systems information
statement containing changes to the Metropolitan System Policy Statements.
Based on that review, the City does not feel a Comprehensive Plan Amendment is
necessary at this time. The following are statements which support that finding:
The City of Stillwater agrees with the Metropolitan Council's
revised population, household and employment forecasts for
1990, 2000 and 2010. (See attached).
The City of Stillwater is in agreement with the Council's
forecasts for sewered population, housing, employment and
wastewater flows.
No increase beyond those contained is our Comprehensive Sewer
Plan are planned in the community's wastewater flows.
The current Stillwater Comprehensive Plan is consistent with
the Metropolitan Council's policies for rural area densities
and sewer on-site systems.
No changes in the MUSA which would expand the exterior
perimeters of City boundaries is expected at this time that
would conflict with system statements.
The Stillwater Sewage Treatment Facility is currently being
expanded in order to provide service to Bayport, Oak Park
Heights and Stillwater through the year 2010.
Based on County and Regional plans no light transit rail
facilities planned for the City of Stillwater for the planning
period.

The City of Stillwater along with other local, regional and
state agencies are working with MnDOT on a new Highway 36
river crossing location. The City of Stillwater has stated
their support of a southern bridge alternative. Once a bridge
location is determined, the City will then identify policies
for roadway improvements consistent with the Transportation
Development Guide/Policy Plan. /
The existing road system in the City of Stillwater met the needs of
local traffic.
The city of Stillwater's Comprehensive Plan contains policies consistent with
the Metropolitan System Statements. After the 1990 census results are
available, a major amendment to the City's Comprehensive Plan is scheduled.
This amendment can more fully address the policies in the Regional Systems
Statements.

The City of Stillwater has reviewed the Waste Water Policy Plan and offer the
following comments for Metropolitan Council ~eview. The C~ty of Stillwater is
supportive of the regional concept for sewer service but'want to ensure that
Stillwater's specific concerns are addressed in that regional approach.

Concerns idli:ntified in reviewing the Waste Water Policy Plan are in the
following areas; growth projections and service capacity, infiltration and
inflow (III), interceptor extensions and use of SAC charges.
e The ~~aste ~~ater Policy Plan, on page 31, discusses development and delivery of
sewer service issues. The section describes the close relationship between the
Development and Investment Framework and Waste Water Policy Plan. The
framework provides the guiding direction and the Waste Water Policy plan
implements the framework. Here is where Stillwater's concern lies. The
Development and Investment Framework forecasts a Stillwater population of
13,200 in 1990 and 13,300 in 2000. The Waste Water Policy Plan extends the
forecasts to 2010, 14,500. These fi gures are very 1 ow..The 1988 Stillwater
population estimate of 13,800 is equivalent to the Metropolitan Council
forecast ,for Stillwater population in 2005. This is of particular;concern at
" this time because plans are being drawn .for the early 1990ls expansion of the
Stillwater Waste Water Treatment Facility~ It is very possible that if.

_I' Th'e reduct"ion of excessive 1/1 as stated in Policy 5 is an important policy
for the efficient use of the Waste Water Treatment System. The City agrees
with Metropolitan Waste Control Commission (MWCC) comments supporting the
reduction but oppose withholding imorovements to communities not in compljance
with the pol icy. The lower cost of III reduction is sufficient incentive for a
community to reduce excessive I/I.
Pol icy 7 addresses the location and extension of new interceptor sewers to
adjoining communities. Insofar as the City of Stillwater has already
con structed a se'lIer overs i zed ror future interceptor use to serve Stillwater
Township west of the City to County Road 15, the City snou1d be assured by the
1"letropolitan Council that this se'lIer 'o'/il1 indeed be classified as an
interceptor in the future. The 36" diameter sewer was constructed as a part of
the Oak Glen Project along McKusick Road and terminating near 8rown's Creek at
the west City limits. This interceptor provides one connection point for
future use by the Township for an extended area approximately between County
Road 5 and County Road 15 and Trunk Highway 36 and Trunk Highway 96.
Pol icy lOA addresses the sewer service area. This poi.icyalso states that
sizing of 'the Metropolitan sewer services will be based' on 'population, housing
and employment forecast prepared by the Metropolitan Council. The City should
be assured that the Metropolitan Waste Control Commission will base the design
of the Stillwater Waste Water Treatment Plant at least on the population
projection as indicated in a letter from the Metropolitan Council dated
February 29, 1988. (attached)
e If there is a surp 1 us in the SAC-charge fund, the. City of Stillwater would be
int~rested in a red~ction in SAC-charges that could be provided by t~e
Metropolitan Waste Control Commission to lower the cost of construction.

The 1986 Metropolitan Development and Investment Framework indicates (p. 49)
that as specific projects come up, the forecasts need to be reviewed in light
of the most current trends. In the Stillwater area, recent growth levels have
been above forecasted (or historic) trends and indicate that 1990 household
forecasts are low. Although another cyclical drop in housing construction is
probably imminent, the current levels have already exceeded 1990 forecasts.
Some adjustments are obviou'Sly called for. We have assumed growth in the
ra~aining two years of the decade to be at about the average for the previous
eight years. We consider this a very optimistic assumption, but not
unreasonable, especially since the magnitude of growth in the area is small
enough that a single project can significantly affect growth. We have then
extrapolated this revised growth assumption to the year 2010 in proportion to
our previous forecasts (shown below).
The slowdown ingrowth in the 1990s is consistent with the Council's projected
regional slowdown in growth resulting from demographic shifts (the aging of the
baby-boom population and entry of the much smaller "baby-bust" group into the
housing market and work force. The growth forecasted is greater after 2000.
This is done to provide "safer" forecasts for making sizing deCisions, even
though demographically even less growth is likely if past trends continue.
The revised forecasts shown below are intended for use in current planning for
the Stillwater wastewater treatment plant. They will not be reflected in a new
set of adopted Council forecasts. As the MDIF indicates, this will occur about
every five years, with the next revision scheduled for 1991 when 1990 Census
figures are available.

Dear Mayor Abrahamson:
The Joint Cable Commission continues to administer and, enforce the
requirements set forth in the Cable Communications Franchise
Ordinance Number Two.
Section 8.12B of the ordinance reads of follows:
"Grantor may require, at its sole discretion, System performance
evaluation sessions at any time during the term of this Franchise
or as required by federal or state law. At a minimum, such
evaluation sessions shall be conducted by Grantor within thirty
(30) days of the third, fifth and tenth anniversary dates of the
effective date of acceptance of this Franchise by Grantee.
However, in no event shall there be more than one (1) evaluation
session "1i thin any two (2) year period."
The Joint Cable Commission held a public meeting on November 8,
1989, to evaluate cable company performance. I am enclosing a copy
of the resultant report, "Periodic Review and Evaluation and
Upgrading for Year Five of the Franchise."

PERIODIC REVIEW AND EVALUATION AND UPGRADING
YEAR FIVE OF THE FRANCHISE
INTRODUCTION
The Cable Communications Franchise Ordinance No. Two, Section 8.12,
requires the Joint Cable Commission to conduct Periodic Reviews and
Evaluation and Upgrading of the cable system in Years Three, Five
and Ten of the franchise.
"The field of cable communications is a relatively new and
rapidly changing one which may see many regulatory, technical,
financial, marketing and legal changes during the term of this
Franchise. Therefore, in order to provide for a maximum
degree of flexibility in this Franchise, and to help achieve
a continued advances and modern system..."
"At a minimum, such evaluation sessions shall be conducted by
Grantor within thirty (30) days of the third, fifth and tenth
anniversary dates of the effective date of acceptance of this
Franchise by Grantee." (Ordinance No. Two, Section 8.12)
The Joint Cable Commission, at its July 19, 1989, meeting moved to
hold an evaluation session on September 6, 1989; however, at the
August 16, 1989, Joint Cable Commission meeting, the Commission
moved to postpone the evaluation session until November 1989 in
order to use more current information provided in the cable
company's annual reports due September 30, 1989.
The Joint Cable Commission, at its September 20, 1989, meeting moved
to hold an evaluation session on November 8, 1989, at 7:30 p.m. in
Bayport City Hall, 294 Third Street North, Bayport, Minnesota.
The Joint Cable Commission, at its October 18, 1989, meeting
selected the following topics to be addressed at the evaluation
session: 1) Applications of New Technologies; 2) System
Performance Analysis; 3) Programming Mix, Quality and Level;
4) Civil Emergency System Alert Update; 5) Customer Complaints;
6) Access Channels and Support; 7) Marketing.
The Joint Cable Commission, at this same meeting (October 18, 1989),
ordered notices of the established meeting date to be published in
its official newspaper, and cablecast on Channels 10, 12 and 15, as
required by the ordinance; and, official notification to the Cable
Company of topics, procedures and schedule.
Agenda and minutes of the session are included as Appendices to this
report.

PERIODIC REVIEW AND EVALUATION AND UPGRADING

YEAR FIVE OF THE FRANCHISE
A public meeting for the periodic Review and Evaluation and
Upgrading for Year Five of the Franchise was conducted on November
8, 1989, at 7:30 p.m. in Bayport city Hall, 294 North Third Street,
Bayport, Minnesota.
READING OF THE PUBLIC NOTICE
The administrative secretary read the public notice, published in
the Commission's official newspaper, the St. Croix Valley Press, on
October 25, 1989, and reported that a similar news release was
published in the Stillwater Gazette on October 27, 1989; in
addition, meeting notices were published in the stillwater Gazette
on November 7 and 8, 1989. The meeting notice was also cablecast on
Channels 10, 12, 15 and 50 in accordance with ordinance
requirements.
PUBLIC COMMENT
e
The Commission office received no written response and only one
phone call, requesting that more non-fiction movies be aired.
Chairperson Knutson called for public comment and announced that
an additional Public Comment should be added as Item X on the
agenda. There was no public comment at this time.
APPLICATIONS OF NEW TECHNOLOGIES
Jim Commers, Vice President and General Manager of King Videocable
Company - Minnesota,reported that there have not been many changes
since the last Periodic Revie,r in 1987. The company is still
looking at improvements in their billing system, address system,
Pay-Per-View delivery methods. Feed Forward technology, which makes
it possible to deliver cable television services into areas that
were not previously economically feasible is a newer technology
available but not yet widespread. Data and text services, which
would allow a subscriber to connect a home computer to the cable
television system to receive various types of information, are new
and emerging, but are not yet commercially viable.
Piracy - The best way to deal with piracy would be to descramble the
Basic channels, but this has not been done because it is least
friendly to cable-ready VCRs and TVs. The company is currently
working with dealerships in connection with false promises made to
prospective buyers about "cable-ready" VCRs and TVs.
SYSTEM PERFORMANCE ANALYSIS

The Commission has on file the company's annual reports and
certifications for their fiscal year ending June 30, 1989, including
detailed system performance reports. Commers stated there were no
specific problems, although there are always improvements that can
be made in connection with quality, signal enhancement, etc. He
continued that everything was operating within the specifications of
the FCC standards, franchise requirements and company standards.

company does check audio levels, but problems still occur because of
programming, atmospheric conditions, etc.

Turner Network Television (TNT) and American Movie Classics were
recently added as Basic services. Due to numerous requests the
company has replaced Home Shopping Club with Cable Value NetworJ(
(CVN) on Channel 18. Quality Value Convenience (QVC) remains on
Channel 25. Both CVN and QVC promote the sale of merchandise.
The Commission expressed their dissatisfaction with the Movietime
Channel 26, stating that they would like to see it replaced.
The company's recent subscriber survey indicated high interest in
American Movie Classics and the Midwest Sports Channel (MSC.) A
recent agreement between WCCO and another cable company for MSC was
encouraging to the Commission, who felt that this agreement might
possibly set a precedent for other cable companies wishing to obtain
MSC, including King Videocable Company - Minnesota, which serves our
area.
American Movie Classics will be brought back as a Basic service
instead of a Premium service, and will run free of commercials until
~ January 1991, at which time it will commence with advertising.

CIVIL EMERGENCY ALERT SYSTEM UPDATE
The company reported that this system is in place and operating
routinely. It is tested on a regular basis by local civil
emergency officials and any problems which are encountered are
resolved in a timely manner.
CUSTOMER COMPLAINTS
The company reported that customer complaints receivep in their
office are logged in a customer complaint book and routed to the
appropriate supervisory personnel for action. Resolutions of such
complaints are noted in the log. If the complaint is not resolved
it is routed to the next level of system management for action.
Ultimately, the system general manager may become involved to assure
that complaints are resolved to the customer's satisfaction. The
company representative said he felt the number of complaints in our
area was surprisingly low, taJcing into consideration the amount of
construction that has been done. He explained that the weather
sometimes prohibits the company from immediate response to a call.

Complaints received at the Commission office were minimal and
apparently resolved, as complainants were requested to call back if
not satisfied with cable company response to their complaint, and no
secondary calls were received.

agreement with the company, and is currently working with a
pro~essional in order to arrive at a long-range marketing plan. If
flow-through becomes a reality, the Commission, through the Access
Corporation, would then assume the responsibility for public access.
MARKETING

King Videocable Company conducts various promotions to generate new
customers. Bill inserts and phone contacts are two means of
marketing used by the company. In addition, King videocable
Company is a member of the Twin Cities Cable Communications
Consortium, which Commera reported has proven to be effective. He
also stated that he foresees increased penetration and improvements
in customer service and operations.

Commers continued that since King Videocable Company purchased the
system from Coaxial, office hours have been extended, bills
itemized, late fees delayed. A rate increase was put into effect in
September 1989. The current rate for Basic is $16.95 plus $1.35 for
public access for a total of $18.30 in the central St. Croix Valley
area.
LINE EXTENSION - LONG RANGE PLANS
The company's construction manager monitors all housing development
in the central St. Croix Valley area and cable service is extended
into the developments in accordance with the line extension policy
established several years ago. Long range plans are to provide
cable service to as many people as possible.
Underground cable has been installed recently in the Staples Ridge
area of the Oak Glen Development in Stillwater, and that portion of
the system is scheduled to be activated by mid-December 1989.
A request was also received from an individual residing in Houlton,
Wisconsin. Again, because of distance from existing plant in
Hudson, Wisconsin and lack of density this is not feasible at this
time. The alternative of running cable across the river may be an
item for consideration when the new bridge becomes a reality.
CONVERTERS - REPLACEMENT, ELIMINATION
The company's general manager said that the industry has not been
able to provide a converter that is compatible in all areas. It
would be more cost-effective and customer-friendly if the company
could move the technology from the converter to the pole, which
would enable the use of an inexpensive converter or no converter at
all, but he does not anticipate that this will be viable for another
five to ten years.

Chairman Knutson requested that the appointment of Becky Woods to
the Community Access Corporation Board of Directors be added to the

COMMUNITY ACCESS CORPORATION BOARD OF DIRECTORS APPOINTMENT
The Commission reviewed and discussed the application of Becky
Woods, noting that she has been very active in both production and
editing for public access. MOTION was made by Bodlovick, seconded
by Ulrich, to approve the appointment of Rebecca Wood to serve a
two-year term on the Community Access Corporation Board of
Directors. Motion CARRIED.
READING OF THE PUBLISHED NOTICE

PROGRAMMING OFFERED
Ann Bodlovick said she felt that the mix is pretty well-balanced,
and that she is satisfied with the programming offered. Knutson
mentioned that two of the companies that are selling merchandise,
QVC (Channel 25) and CVN (Channel 18) are merging, which would
create a vacant channel.
ACCESS CHANNELS AND SUPPORT
The Commission reviewed a comparison of the first, second and third
quarter franchise fee reports, in connection with expenditures for
public access. Knutson said the form used may have to be revised to
give more specific information relative to salaries per employee,
benefits per employee, etc. The following line items were
questioned: Salaries, Benefits, Maintenance, Promotion, Telephone,
Travel, Entertainment, Vacation Accrual and Seminars/Training.
Roy Lalime said they had purchased (hand-held) fans last summer as a
promotion item.
Jim Commers arrived at approximately 7:45 p.m.
Knutson briefed Commers on the foregoing conversation, and Commers
replied that Benefits were probably included in Salaries prior to
3rd Quarter. The administrative secretary reported that, according
to receipts, 2nd Quarter Telephone had included the cost of a new
answering machine purchased for the access coordinator and a company
bill for a phone located in Cottage Grove, explaining why that line
item was that high; however, 3rd Quarter telephone is also
excessive. A receipt for a panasonic cable, belonging to South
Washington had been included in 2nd Quarter receipts.
Jim Francis arrived at 7:55 p.m.
Knutson questioned if the company was adding the vacation accrual on
top of the salary and if it ~houldn't be included in salary.
Commers replied that it is additional, because it has to be set up
as a liability so it can be carried over from one fiscal year to
another, if necessary.
Commers said that prior to the beginning of the company's new fiscal
year on July 1, 1989, the central St. Croix area was in the same
department as South Washington, which may account for some of these
discrepancies. A letter will be mailed to the company by the
Commission, requesting more information on line items in question.
APPLICATIONS OF NEW TECHNOLOGY
Commers distributed a letter dated November 8, 1989, with regard to
the Commission's requests for written information for the evaluation
session. He said that there have not been a lot of changes since
the last review in 1987. The company is still looking at
improvements in their billing system, address system, pay-per-View
delivery methods; and, feed forward is a newer technology available
but not widespread. He continued that data and text services are
new and emerging, but are not yet commercially viable. He said that
VCR's remain the cable industries biggest challenger.

CONVERTERS - REPLACEMENT, ELIMINATION
Commers said the industry has not yet been able to provide a
converter that is compatible in all areas. It would be necessary to
move the intelligence from the converter to the pole, thus enabling
the use of an inexpensive converter or no converter at all. The
company would like to move in this direction, but this will probably
not be viable for another five to ten years.
Chairman Knutson asked what the company has done in our area to keep
piracy at a minimum. Commers said the best way to manage this
problem is to descramble the Basic services; however, this is least
friendly method to cable-ready VCRs and TVs. For this reason, they
have left the Basic channels scrambled. In response to Ed Lawson's
question regarding sales of "cable-ready" televisions, Commers
replied that the company is working with dealerships so they arenot
making false promises to prospective buyers. Chairman Knutson
requested the company resolve Bill Hooley's problem in receiving a
clean signal, maJcing it difficult for him to promote cable.
Ulrich questioned how many subscribers had purchased the nev remote
controls recently offered. Commers replied that 3 or 4 percent
were using the new compared to 90 percent that have the regular
control.
Commers said the FCC has dropped many of its testing requirements,
because of new replacing old, eliminating previous problems, and
that he felt most of the testing procedures in the franchise are now
outmoded.
SYSTEM PERFORMANCE ANALYSIS
Chairman Knutson reported that the Commission had just recently
received the company's system performance reports and asked Commers
if they had noted any problems while performing the tests. Commers
replied there were no specific problems, although there are always
improvements that can be made, i.e: quality, signal enhancement,
etc. He continued that everything was operating within the
specifications of the FCC standards, franchise requirements and
company standards.
Discussion followed in connection with volume inconsistencies on the
channels. Commers said the company. does check audio levels, but
problems will still exist becarise of programming, atmospheric
conditions, etc.
PROGRAMMING OFFERED - QUALITY, MIX, LEVEL
Commers said the company has wanted to add CVN for sometime, because
of many requests and the large volume of CVN employees in the
BrooJclyn Park system, and will be dropping the other channel (QVC)
when CVN added.

Commers said the company is at the level originally proposed, and is
currently supplying the follo'ving number of channels: 8 broadcast,
7 premium, 24 satellite (non-premium), 6 access and 2 other, for a
total of 47. They are planning to replace an existing service
(probably PTL) with HBO Comedy Channel sometime between November IS,
1989, and January 1990. They would also lilce to reallign channels.
Knutson said there should be no problem with this, as long as the 6
access channels are left as they are. Commissioners expressed their
dissatisfaction with the Movietime Channel. The subscriber survey
indicated that people were also interested in American Movie
Classics and Midwest Sports Channel. Schultz said Midwest Sports
Channel had been piCked up by another cable company, which will
offer it on a $4.95 pay-per-View basis according to an article in
the St. Paul Pioneer Press. MSC will charge the cable company 45~
per month for each of the cable company's subscriber households.
Commers said there is a very vocal minority that want it and are
willing to pay for it.
Commers said American Movie Classics would be brought back as a
Basic service, instead of a Premium service. Until January 1991 it
runs free of commercials; however, advertising will begin at that
time.
The Commission would like to see Movietime on Channel 26 replaced.
CIVIL EMERGENCY SYSTEM ALERT UPDATE
Chairman Knutson asked Commers if he had any information regarding
breakdowns, how frequent and what problems have occurred. Commers
said they had not been keeping a log until a few months ago. He
said he is of the impression that'breakdowns are infrequent and that
the system is operating routinely. BodlovicJc said if Washington
County's system was inoperable, then Cottage Grove would take over
for the county. Question was raised if Cottage Grove has the
Stillwater phone number. Knutson suggested that this be checked
with Tom Green.
CUSTOMER COMPLAINTS
Commers said he had reviewed the procedure for dealing with
complaints and found it satisfactory. The weather sometimes
prohibited the company from immediate response to a call. He
reported that the number of complaints in our area were surprisingly
low, considering the amount of construction done this year. The
administrative secretary reviewed a minimal number of complaints
received at the Commission office and reported that the company had
apparently resolved all of them, as none of the complainants called
back as requested if they were not satisfied with outcome. Commers
said there are occasions where response to a call takes longer than
it should to resolve, but there is real incentive to meet the
requests of the customers, as unhappy customers do not promote the
industry.

Discussion followed in connection with Gopher State 1 calls,
a non-profit referral agency, set up to receive calls from persons
or industries, digging or excavating in areas. They, in turn, relay
information to all companies in order to clear the request or to
send someone out to locate buried services to prevent damage to
existing services. Commers said it is mandatory to participate,
and at a rate of $2.50 per locate, can prove to be costly. Knutson
said Byron Wertz had said at one time that he thought there was a
possibility of ultimately establishing one locate service for all
companies. Commers replied that Northwestern Bell had attempted to
do this, but companies were not interested. The fee would have been
approximately $15.00 per locate. He continued that he does not
foresee this happening at this time.
ACCESS CHANNELS AND SUPPORT
Quarterly reports were discussed previously in the meeting.
Lawson questioned if there could be a program issued for the access
channels. It was felt this would be too costly. Lalime said
programming is submitted to the Stillwater Gazette for publishing.
Bev Schultz stated that persons can call the Access Center, which is
open until 9:00 p.m., for programming.

Knutson said attempts to achieve flow-through are still ongoing.
He has talked to Mark Ayotte, who is in contact with Anita Benda
Stech, for the purpose of developing a long-range marketing plan for
the remaining nine years of the franchise. She will be submitting a
proposal to the Commission. Her fees are $35.00 per hour plus
travel expense. Ayotte felt much could be done via telephone.
There is also need for retaining the services of a finance director
for decision-maJcing on investments after long-term plan and
projections are completed.
MARKETING
Discussion followed regarding promotion of the cable industry
through bill inserts and phone contacts. Commers said in the past
year or two, the company has moved much of their promotional
activity through the Twin City Cable Consortium, which has proved to
be effective. Knutson said that most of this was being done when
Coaxial sold to King. King either had to increase penetration or
rates to offset the cost of purchasing the system. A rate increase
was realized in September, 1989. Commers replied that it would take
longer than a six to nine month period to see penetration; and, that
he thinks there will be an increase in penetration, also
improvements in customer service and operating. Knutson said he has
not seen much difference from Coaxial to King. Commers replied that
office hours have been extended, service extended, bills itemized,
late fees delayed during the past nine months. The current rate for
Basic is $16.95 plus $1.35 for public access for a total of $18.30.

LINE EXTENSION - LONG RANGE PLANS
Commers said the company's long-range plans are to get cable to as
many people as possible. The company's construction manager
monitors all developments and they extend new service into the
developments in accordance with the line extension policy
established several years ago.
Staples Ridge Commers said that cable is underground, but that
there was a delay in getting electronics.
Marine-on-St. Croix - Commers said that service would have to be
microwaved to the area, and that there is not enough density at this
time.
Houlton - Commers said to do this at the present time cable would
have to go under river. This may change with the building of the
new bridge proposed for this area.
Stillwater Township - The area requested does not meet the density
requirement of the line extension policy.
CONVERTERS - REPLACEMENT, ELIMINATION
Commers said it would be more cost-effective and customer-friendly
if the company could move the technology from the converter to the
pole, but he does not anticipate any change in technology at this
time.
PUBLIC COMMENT - None

to close the public hearing for the Periodic Review and Evaluation

On November 2, 1989, Northern States Power Company (NSP) filed notice of
an increase in its electric rates with the Minnesota Public Utilities Commission
pursuant to Minnesota Statutes 216B.16. The Company proposed a ~chedule of
new rates to take effect on January 1, 1990.
If the Commission suspends the proposed rates 80 they do not go into
effect, it must permit the Company to put interim rates into effect on January
1, 1990, until a final rate level is determined. NSP has filed a schedule of
interim rates based on the Commission Order in the precedblg NSP electric rate
case.
The Commission will determine the amount of increase in rates it will
allow on or before September 4, 1990, and final rates reflecting that
determination will be implemented thereafter. If the final rates level is lesB
than the interim rate level, the ~ount collected during the interim period
attributable to that difference will be refunded to customers with intere3t.

Company) filed a petition seeking a general rate increase of
$120,782,000, or 10.2%, effective January I, 1990. On November
29, 1989 the Commission issued its Order Accepting Filing and
Suspending Rates in the matter.

FINDINGS AND CONCLUSIONS
I.
Jurisdiction and Referral for Contested Case Proceedings
The Commission has jurisdiction over proposed rate changes under
Minn. Stat. ~ 216B.16 (1988). If the Commission is unable to
resolve all significant issues regarding the reasonableness of
the proposed rates on the basis of the filing itself, the
Commission is to refer the matter to the Office of Administrative
Hearings for contested case proceedings, Minn. Stat. ~ 216B.16,
subd.2 (1988).
The Commission finds that it cannot satisfactorily resolve all
questions regarding the reasonableness of the proposed rates on
the basis of the Company's filing. The Commission will therefore
refer the matter to the Office of Administrative Hearings for
contested case proceedings.
II. Proposed Rates
The Company proposes that any final rate increase be allocated by
customer class as follows:

Overall
The Commission has suspended the Company's proposed rates by
separate Order. By further Order, the Commission will direct the
Company to place an interim rate schedule into effect. Interim
rates are subject to refund if the Commission ultimately orders a
lower overall revenue increase than is recovered through interim
rates. Minn. Stat. ~ 216B.16, subd. 3 (1988).
III. Issues to be Addressed
Parties shall address the following issues in the course of the
contested case proceedings ordered herein:

(1) Is the test year revenue increase sought by the'
Company reasonable or will it result in unreasonable
and excessive earnings by the Company?
(2) Is the rate design proposed by the Company
reasonable?
(3) Is the amount built into the Company's base rates
for its test year conservation program reasonable,
given actual and projected levels of spending?,
(4) Are the Company's proposed capital structure and
return on equity reasonable?
The parties may also raise and address other issues relevant to
the Company's proposed rate increase.

14.57-14.62 (1988); the rules of the Office of Administrative

extent that they are not superseded by those rules, the
Commission's Rules of Practice and Procedure, Minn. Rules, parts

Under these rules parties may be represented by counsel, may
appear on their own behalf, or may be represented by another
person of their choice, unless otherwise prohibited as the

evidence, conduct cross-examination, and make written and oral
argument. Under Minn. Rules, part 1400.7000, they may obtain
subpoenas to compel the attendance of witnesses and the
production of documents.

of appearance (Attachment A) with the Administrative Law Judge
within 20 days of the date of this Notice and Order for Hearing,
Failure to appear at the hearing may result in facts and issues
being resolved against the party who fails to appear.

witnesses necessary to support their positions. They should take
note that any material introduced into evidence may become public
data unless a party objects and requests relief under Minn. Stat.

Time Constraints -- The Commission is required to act on the
Company's filing within ten months, or the proposed rates are
deemed approved. Minn. Stat. ~ 216B.16, subd. 2 (1988). This
ten-month period can be extended for two months, if the parties
submit a settlement which is rejected by the Commission. Minn.
Stat. ~ 216B.16, subd. 2 (1988).

The Commission asks the Office of Administrative Hearings to
conduct contested case proceedings in light of these time
constraints and requests that the Administrative Law Judge submit
his final report by July 5, 1990, to allow the Commission
adequate opportunity for thorough consideration of the case.
Application of Lobbying Provisions -- The lobbying provisions of
the Ethics in Government Act, Minn. Stat. 55 10A.01 et ~'1
apply to general rate cases. Persons appearing in this
proceeding may be subject to registration, reporting, and other

requirements set forth in that Act. All persons appearing in
this case are urged to refer to the Act and to contact the
Minnesota Ethical Practices Board, telephone number (612) 296-
1720, with any questions.
Ex Parte Communications -- Restrictions on ex parte
communications with Commissioners and reporting requirements
regarding such communications with Commission staff apply to this
proceeding from the date of this Order. Those restrictions and
reporting requirements are set forth at Minn. Rules, parts
7845.7300-7845.7400, which all parties are urged to,consult.
ORDER
1. A contested case proceeding shall be held on the Company's
proposed rate increase. The proceeding shall begin with a
Prehearing Conference on Thursday, December 21, 1989 at 9:30
a.m. in the Small Hearing Room at the Commission offices,
715 American Center Building, 150 East Kellogg Boulevard,
St, Paul, Minnesota 55101.

This Order will be served on the Company, which shall mail
copies of the Order to all municipalities and counties in
its service area and to such other persons as the Department
of Public Service may request.
3. Public hearings shall be held in this matter at locations
within the service area of the Company.
4. In addition to the notices of the proposed change in rates
required by the Order Accepting Filing and Suspending Rates,
the Company shall give the following notices of the
evidentiary and public hearings:
a) Individual written notice to each customer, which may be
in the form of a bill insert, and shall be served at least
ten days before the first day of hearings.
b) Written notice to the governing bodies of all
municipalities and counties in the area affected and to all
parties in the Company's last two rate cases. These notices
shall be mailed at least ten days before the first day of
hearings.

c) Display advertisements in legal newspapers of affected
counties and other newspapers of general circulation within
the Company's service area. These advertisements shall
appear at least ten days before the first day of hearings.
They shall include the heading RATE INCREASE NOTICE, which

points.
d) The above notices shall contain the information required
in Minn. Rules, part 7830.3200, subp. 2. The Company shall
submit proposed notices for Commission approval prior to
publication or service.
5. This Order shall become effective immediately.

TO COUNTY BOARDS, CITY COUNCILS, AND SOLID WASTE DISTRICTS:
since 1984, the state of Minnesota -- through its Waste Management
Board and now the Office of Waste Management (OWM) -- has made
grants and loans available to counties, cities and solid waste
management districts to help fund the capital costs of local solid
waste management facilities that serve as alternatives to sanitary
landfills.
Initially, few local governments applied for capital assistance
grants as many projects were still in the planning stage. However,
within the past two years, many projects have come to fruition and
the OWM has now awarded 29 grants to assist local solid waste
management projects.

Currently, for the first time in the program's history, the OWM is
reviewing capital assistance (CAP) and environmental testing (TEST)
grant applications that request more total funding than is
available. For this reason, the OWM will not accept new
applications for CAP and TEST program grants until further notice.
The OWM has submitted a request for $33.2 million in additional
bonding authority to continue the CAP and TEST grant programs for
the next two years. If the 1990 Legislature allocates additional
bond funds for these programs, CAP and TEST program grants will
again be available in mid-1990.
The OWM is planning to revise the administrative rules that govern
the CAP and TEST programs in early-1990 so that it can renew the
grant programs in mid-1990 if the Legislature provides additional
flJnding for. them.
The continuing efforts of Minnesota's local governments to improve
sol id waste management are to be commended. I will keep you
informed of our progess in securing funding for continuation of
the OWM's capital assistance programs.
