This memo is a reminder to Council that a Special Meeting is scheduled for Tuesday evening, August 28, 1990 at 7:00 P.M. in the Council Chambers of City Hall, 216 North Fourth Street, Stillwater, Minnesota to discuss the following: 1. This is the day and time for the Public Hearing to consider a possible change to an Election Ward System for the election of Councilmembers in the City of Stillwater, (to be implemented in 1992). 2. Any other business Council may wish to discuss. Absent: Tom Lammers others: City Attorney David Magnuson The Charter Co~nission held an informational meeting for the public on the proposed change from an at-large to a ward system of city government. Chairman Jack Evert opened the meeting by giving background on the Charter Commission, its purpose and accomplishments, and introducing the current members of the Charter Commission. He explained the procedure for making Charter amendments - by unanimous vote of the City Council and Mayor, or by referendum. He also gave a history of the Charter. The Charter Commission's proposal is to split the City into four wards, with one Council person elected from each ward; the Mayor would be elected at-large. The proposal would allow incumbents to run one time at-large. Cherie Berett explained the Charter Commission's process in deciding to recommend the ward system. Jim McKinney explained the ward system's effects on the campaign and the effects on City government. The Charter Commission believes that campaigns will be smaller and easier to manage, and that the ward system will bring government closer to the people. Mr. Evert concluded with a summary and opened the meeting to questions from the audience. Issues discussed with the audience were the grandfathering-in of incumbents, determination of ward boundaries, and whether the issue should be decided by a referendum rather than the City Council. As you know, the Department of Natural Resources is proceeding with . the acquisition of interests in lands along the st. Croix Riverway upon which to develop a water access for approxi- mately 80 cars and trailers. From the beginning of this' effort, we have involved the City of stillwater. Mayor Abrahamson was involved in preliminary negotiations and a presentation of the preliminary proposal was made to the stillwater City Council. Currently, we are planning to hold a public information meeting on the proposed access once a few more details are "ironed out." If everything stays on schedule, we anticipate that the meeting will be held this fall. In your letter you inquired whether or not the Department would be obtaining permits from the local unit of govern- ment. It is our policy, based upon advice from the Attor- ney General's Off ice I that the state does not need to acquire permits from local units of government. It is our intent, however, to comply with the spirit and intent of existing regulations to the degree possible. As you know, we share your and other citizens' concerns for the protection and preservation of the Lower st. Croix Riverway. Paul, MN 55106 Dear Mr. Stine: Your letter of August 8, 1990 makes it apparent that you are ignoring local government concerns in your rule revision process. The letter is critical of local administration of your rules and rather than recognizing the flaws in the rules that should be changed ~n your revision process. 4It The rules should be made to fit with national policy. The National Wild and Scenic River Act declared that certain selected rivers in the nation had, among other things, remarkable, historic, cultural and other similar values that must be preserved. The Lower st. Croix River Act that followed named the st. Croix River as a component of the national system and mandated that a development plan or master plan be developed by the Secretary of the Interior, jointly with the appropriate agencies of Minnesota and Wisconsin that would be comprehensive and determinative of the interests in the land that would be acquired and developed and administered by the agencies of the United states Government and the political subdivisions of the affected states. The master plan that was adopted, known as the Lower st. Croix Final Master Plan, dated February 1976, is the basis upon which your rules are founded. Your rules should be consistent with the master plan. e The master plan provides setback, lot size and building height standards that are to be adopted in state rules and local ordinances with regard to both shoreline and preservation zones and bluff line preservation zones. This is recogni reflected in pattern as recognized with r in incorporated area ion that historical and cultural values as of development are remarkable and must be gard to the standards for preservation zones The st. Croix R'ver Rule Revision process that is now under way is a rare opport nity to make the state rules consistent with federal policy and 1 gislation by recognizing number one, that historical and cultu al aspects of incorporated cities within the Wild and Scenic Rive area are remarkable and must be preserved and two, that future growth in incorporated areas must be allowed to be undertaken to he extent and to the like degree that non- conforming structure have already been built and occupied in incorporated areas. If the new rule would recognize these important standards it would be no probl m for the local government to administer them and the DNR wou d enjoy broad public support.
