SPECIAL COUNCIL MEETING - TUESDAY, JULY 18, 1989, 4:30 P.M.
1. This memo is a reminder to Council that a Special Meeting is scheduled for
Tuesday afternoon, 4:30 P.M., July 18, 1989 at 1218 So. Second Street, to
view the house in order to continue the discussion of whether the hous~ ~t-
this address should be razed, removed and demolished.
2. This is also a reminder to ~ouncil that a second Special Meeting is
scheduled for Tuesday afternoon, 5:00 P.M., July 18, 1989 at the end of
So. Harriet Dr. (near the Forest Hills Development) to meet with the
neighbors to discuss concerns regarding the size of the pond, the green
belt, park, etc. in connection with L.I. 251. In the event of inclement
weather, the meeting will be held at the City Council Chambers, 216 No.

SUBJECT: FINAL PLAT APPROVAL FOR TWO lOT SUBDIVISION.
BACKGROUND:
This application was before the City Council January 3, 1989 and continued
for six months to give the applicant time to make the necessary improvements. '
(The Staff Report and minutes of the January 3, 1989 meeting is attached.) The
applicant has indicated the additional work regarding drainage, curbing and
sewer line has been completed as indicated in the letter of June 20, 1989.
With these improvements, the Conditions of Approval recommended by the
Planning Commission in the December 12, 1988 Staff Report have been met.

RECOMMENDATION: Approval.

Dear Steve;
The Planning Commission and the City Council reviewed our request for
a lot split January 3, 1989. There were three conditions to be met
before the lot split could be made.
1. A drainage plan for 514 Maple was to be made.
2. Replace the curb along Maple St.
3. The sewer line to the house behind 518 Maple, 716 N. Williams
St. that runs along the west side of Lot 8 be tested & re-
placed by the builder as necessary and an easement be recorded.
These conditions have been met as follows:
1. Drainage - Re-excavated the rear of lot at 514 Maple.
2. Replaced the curb.
3. Sewer line was repaired and tested. There is already a
10 ft easement recorded on this property for the sewer.

1. This is the day and time for the Public Hearing on a request for a
subdivision of one lot into two lots at 514 and 518 West Maple Street in
the RB, Two-Family Residential Dist., James Blichfeldt, Applicant. Case
No. SUB/88-n.
Notice of the hearing was published in the Stillwater Gazette on
December 23, 1988 and copies were mailed to affected property owners.
Mr. Russell explained the lot was originally subdivided into two lots, and
had been combined in one lot with one legal description. A home has been
constructed on each lot, based on the original subdivision. Also,
regulations require a larger lot size for a single-family residence,
therefore, a variance is required.
Discussion followed regarding concerns of the neighbors about drainage and
damage to the curb in front of one of the homes during construction; and
possible damage to a sewer line. Also a sewer service easement is
required for 715 No. Will i am St.
Jim Blichfeldt, builder of the homes, stated it was an oversight on his
part when they went onto the easement and agreed to fix the curb, take

care of fixing the sewer line and is willing to bear all costs in order to
get these problems straightened out. Mr. Russell stated the sewer
easement should be restored to ten feet.
Mike Madsen, 510 W. Maple St., was present to express concerns regarding
drainage onto his property from the newly constructed homes. He stated he
has had some water problems in his basement, but does not want more.
Mary Wahlkirch, 518 Maple St., asked what happens if that sewer line is
running under her basement and ten years from now, she has problems.
Council answered this should be corrected when Mr. Blichfeldt fixes the
sewer line.
Motion by Councilmember Kimble, seconded by Councilmember Farrell that Case
No. SUB/88-72, a request for subdivision of one lot into two lots at 514 & 518
W. Maple St., James Blichfeldt, Applicant, be continued for up to six months
until Mr. Blichfeldt can settle the drainage problems, the question of a
possible broken sewer line and the easement for sewer. (All in favor).
2. This is the day and time for the Public Hearing on a Special Use Permit to
construct a 7,200 sq. ft. auto and truck repair building on the southwest
corner of Curvecrest and Industrial Blvds., Happy Thomsen, Applicant.
Case No. SUP/88-71.
Notice of the hearing was published inthe stillwater-Gazette on
December 23, 1988 and copies were mailed to affected property owners.
Mr. Russell explained Mr. Thomsen plans to build a truck and auto repair
garage in the Industrial Park, which requires a Special Use Permit. He
further explained Mr. Thomsen will have a mansard around the entire top of
the building and it will be compatible with other buildings in the area.
There is also a landscape plan in place. Mr. Fontaine stated the Planning
Commission approved the former plan with conditions and said the revised
plan is an improvement.
Council expressed concern that auto wrecks not be stored on the property
and Mr. Thomsen said this would not be allowed. Long term parking would
not exceed thirty days.
Ned Windmiller, representing the Stillwater Medical Arts Building,
expressed a concern about the look of the building and was pleased to see
the changes. He also is concerned about outside storage and screening.
He also stated some design standards should be developed for the
Industrial Park.

PROJECT DESCRIPTION:
A minor subdivision of two lots with one legal description and parcel number
into two lots with a 24 foot modification to the minimum lot area requirement
for both lots (each lot is 7,476 square feet, 7,500 square feet is the minimum
lot area requirement).

DISCUSS ION:
The request is for a minor subdivision of the two lots. The lots were
originally subdivided as two lots but have recently been combined in one lot
with one legal description and one parcel number. A home has been constructed
on each lot. The RB District regulations require 7,500 square feet for a
single family residence and 10,000 square feet for a duplex.
The request is for a modification to the minimum lot area requirement of 7,500
square feet. A 24 square foot modification is needed. All the other building
and zoning requirements have been met for each lot and home.
RECOMMENDATION: Approval of minor subdivison.
FINDINGS:
The proposed land division is consistent with the use requirements of the
Zoning Ordinance and Comprehensive Plan.

PROJECT DESCRIPTION:
A Special Use Permit for the placement of two portable classrooms at the
Stillwater Senior High School.
DISCUSSION:
The request is to place two additional portable classroom buildings on the
South side of Stillwater Senior High School. The classroom buildings will be
approximately 24 ft. by 36 ft. 8 inches, framed with lap siding. They will be
accessed from the outside of the High School.
Additional classrooms are in great demand at the Senior High School. The
school is at capacity and is operating with the Washington School site as a
spl i t campus. The new cl assrooms wi 11 be staffed by current staff and wi 11 not
intensify the present use of the school or the parking facilities. The design
of these buildings is such that they can be moved when the demand for
additional classrooms at the High School diminishes.
RECOMMENDATION: Approval.
FINDINGS:
The proposed use will not be injurious to the surrounding neighborhood or
otherwise detrimental to the public welfare and will be in harmony with the
general purpose of the Zoning Ordinance.

Enclosed is the completed application and two copies of the
Stillwater Sr. High School site plan as requested. District staff
will be present at the July 11, 1989 Planning Commission Meeting
and the July 18, 1989 Public Hearing to answer specific questions
or concerns that you may wish to address.

Specifically, you have requested the following data:
1)
The proposed buildings will be 24' x 36'8" framed
buildings. The exterior will be lap siding, vinyl clad
windows on one side, two doors and a pitched roof. The
basic design of these buildings has been used by xhe
Rosemount and South Washington County School Districts for
several years. The plans have been revised to meet
current building codes and have received State of
Minnesota approval.
2) The School Board has recently completed a facility and
enrollment study. One portion of this study centered on
the High School being at capacity and operating with the
Washington site as a split campus. The use of these two
structures will allow some flexibility and provide two
additional classrooms.
The district is cooperating with Northeast Metro Tech and
South Washington County Schools in a project that will
utilize interactive TV in classroom instruction. The
temporary buildings will allow administration to free-up
two rooms in the main campus buildings for interactive TV
instruction.

APPROVAL OF MINUTES
Motion l;>y Don Valsvik, seconded by Judy Curtis to approve the
minutes of May 8, 1989 as submitted. All in favor.
PUBLIC HEARINGS
Case No. V/89-32 - Variance to the side yard and rear yard
setback requirements for the construction of a bedroom addition
at 1010 North Fourth Street in the RB, Two family Residential
District. Billy Jo Elliott, Applicant.
Ernie Feil, the contractor representing Mr. Elliott presented the
application. The request is to construct a bedroom on the second
story of an existing home. No expansion of the first story is
proposed. '.
The Commission found no problem with the application, but a
concern was expressed that the home was formerly a gas station,
and it is not known whether the gas tanks were ever removed. It
was determined that a fourth condition of approval be added:
Testing be done to determine if gas tanks are present, and that
they be removed if present.
Motion by Rob Hamlin to approve the variance request with four
conditions. Mark Ehlenz seconded. Motion carried 8-0.
Case No.V/89-33 - Variance request for the placement of an awning
over a deck at Popeye's on the River (Stillwater Yacht Club), 422
East Mulberry Street. Greg Lindow and Bob Marois presented the
application.
The application submitted to the Planning Commission for its
consideration was for a temporary retractable awning over the
deck. The applicants stated their intent was an application for a
seasonal, removab~e awning. The awning would be used throughout

BY CHANGING SECTION 43.01, SUBDIVISION 7,
"HOURS OF OPERATION"
The City Council of the City of Stillwater does ordain:
1. Amending. Subdivision 7 and Subdivision 7a of Chapter
43.01 of the Stillwater City Code is deleted and Subdivision
7(a), (b), (c), and (d) are enacted to read as hereafter set
forth.
"Subd. 7(a) ON SALE. No sale of intoxicating liquor for
consumption on the licensed premises may be made:
(1) between 1:00 a.m. and 8:00 a.m. on the days of
Monday through Saturday;
(2) after 1 a.m. on Sundays, except as provided in
Subd. 7 ( b) ;
(3) between 8 p.m. on December 24 and 8 a.m. on
December 25, except as provided in Subd. 7(b).
Subd. 7(b). SUNDAY SALES. A restaurant, club, bowling
center, or hotel with a a seating capacity for at lesat 30
persons and which holds an on-sale intoxicating liquor
license may sell intoxicating liquor for consumption on the
premises in conjunction with the sale of food between the
hours of 12:00 noon on Sundays and 1:00 a.m. on Mondays,
provided that the licensee is in conformance with the
Minnesota Clean Air Act.

SUBJECT: MYRTLE AND SECOND STREET PARKING IMPROVEMENTS
BACKGROUND:

Mulberry, to review the parking situation in that area. As a result of the
meeting, Staff was directed to report back with parking lot design, cost and
financing information for three parking lot locations; between the Lowell Inn
and RivertuwiI Cc:nmons, North Second Street lot, on the corner of Mulberry and
Second Streets, and a'c'ross from Staples Mill north of the old lumber yard,_
North Main Street lot.

DESCRIPTION OF PARKING LOT:
The North Second Street lot is located between the Lowell Inn and Rivertown
Commons. The site is currently used for parking. The south portion of the
site is paved and the north has a paved and gravel surface. Parking spaces are
not marked so that, depending on parking configuration, 60-70 cars can be
parked in the area.
Two parking lot designs have been developed for the 120x230 foot site. (See
map #1.) The first configuration provides for two-way through traffic
movement. 73 improved spaces are provided. A second alternative does not
provide for circulation from isle to isle. Using this parking pattern, 81
spaces are provided. If the existing garage remains, six parking spaces are
lost.
The south 94 foot end of the lot is owned by the Lowell Inn and the north 141
feet is owned by the City. It is suggested the City purchase approximately 31
feet of Lowell Inn property. By purchasing the 31 feet, this would clearly
define what is Lowell Inn, what is public and allow the existing businessess
to control the loading area and 20-24 parking spaces immediately adjacent to
the Inn. The net increase in parking spaces would be 10 to 20 spaces for the
entire area.
A rough estimate of cost for improving the lot (curbs, gutters, parking, and
minimum landscaping) is $42,000. This does not include land purchase estimated
at $15,000. Several funding sources are available, including Tax Increment
Financing, Parking Improvement District proceeds, or parking revenues from the
installation of parking meters.
The Mulberry-Second Street site currently contains an unimproved parking area
on'the eastern portion of the lot and sloped area up to Second Street on the
west side. A single family residence is located on the northwest corner of the
site. The residence would need to be removed and a retaining wall constructed

to make use of the back portion of the .lot. The Downtown Plan calls for
combining the parking areas behind the Main Stnleet building with this area to
maximize the use of ~he site. The dotted,line on map #2 shows the land
ownership pattern. Lots A and Bare vacanti lots. D and C have existing
businesses on them. The parking lot design s~ows 62 spaces. This number could
be increased by 5 to 10 spaces by developimlg the area shown as existing
building. '

The estimated cost for improving the park~ng lot is $37,000. Again this
includes paving, curb and gutter, drainage andlminimum landscaping. Lighting
would be an additional cost. Total landlcosts for the project are not
available at this time. The owner of site IIAII Mas indicated a willingness to
sell or 1 eas e the 1 and to the City. The owner of site IIBII has offered to se 11
the property to the City. An agreement would have to be entered into with the
owners of lots C and D to coordinate construction and provide access from
Mulberry Street. .
The North Main Street site is currently owned by the developer of the Arrow
Building site. The plans for the recently approved three level office building
included an optional parking plan for the north portion of the lot. Map #3,
shows the optional plan for the lot. 87 spaces can be accommodated in the
area. The cost of paving would be $51,000. Additional cost for lighting and
landscaping would be required to be consistent with the Main Street
Streetscape Plan.
The owner of the site indicated he would be willing to consider selling the
property to the City or leasing the property to the City or adjacent property
owners for a parking lot. The availability of this lot will depend on the
timing for construction of the office building.
All three parking lot sites were identified in the Downtown Plan. The Myrtle
and Second Street lot and the Mulberry Street lot are designated for parking
lots or structures. Purchasing the sites will be a big step in solving parking
problems in the North Main Street area and North Second Street area. As time
passes, the parking situation will become worse and land for parking will be
more difficult to acquire.
RECOMMENDATION
Direct Staff to:
1. Negotiate purchase of land for North Second Street lot and Mulberry
Street lot.
2. Make neceessary modification to TIF Development District to include
purchase of sites using TIF funds and other changes.
3. Direct Staff to meet with adjacent property owners to discuss
cooperative arrangement for improving Mulberry Street lot.
4. Revi ew specifi c funding sources and come back to the City Council with
funding recommendation.
5. Follow development of Main Street lot and encourage property owners to
work together to provide parking for the area.

Dear Mr. Kriesel, Mayor Abrahamson and members of the Stillwater City
Council, -
This letter and the enclosed EXHIBIT "A" constitute an answer to your
request that the Lowell Inn furnish the Council additional informa-
tion, as a follow-up to public comments offered at the public hearing
May 23rd 1989 (Hearing).
First, I want to thank the Stillwater City Council (Council) for its
recent action approving a single, handicapped-parking space in front
of the Lowell Inn at the corner of Second and Myrtle streets. The
preparatory review and comments submitted by Mr. Steve Russell were
helpful, appreciated and are considered in this response.
The Hearing was the result of the Lowell Inn's request for action by
the Council to mitigate the consistently deteriorating traffic con-
gestion and traffic-safety conditions (Conditions) aggravated by
loading/unloading of people and supplies in the southbound traffic
lane of N. Second Street (Traffic Lane). The Conditions result from
the, (i) increased traffic, in the four-block area around the inter-
section of Second and Myrtle Streets (Area), (ii) increased Second
Street traffic off-loaded from Main Street (Traffic), and (iii) di-
version of westbound traffic from Chestnut to Myrtle Street (Diver-
sion) .
For these reasons, it seems a proper time to reemphasize the need for
action to alleviate the Conditions. We are therefore providing
documentation to help justify the need for remedial action.

The Conditions are the basis for the suggestion to transfer, as soon
as possible, the handicapped visitors, lodging patron, dining patron,
charter-bus group visi~s, tourists, limousines, vendor delivery and
now TROLLEY-CAR loading/unloading (Activity) to the,low-demand,
5-meter, on-street parking spaces under discussion (Parking Area).
EXHIBIT "A," includes points-of-fact and data pertaining to sources
of Activity and an assessment of Activity in the Area resulting from
the full-service, transient, hotel functions of the Lowell Inn.
In reviewing EXHIBIT "A" we hope the Council and City staff give con-
sideration to the, (i) unique aspects of the full-service hotel func-
tion Activity and Traffic in the Area, (ii) non-comparable aspects of
the Activity and Parking Area (in respect to other restaurant or com-
mercial business establishments located in downtown Stillwater), and
(iii) inherent public nature of full-service hotel operations,
SUHHARY
o The objectives of the Lowell Inn request are, (i) to re-
lieve Traffic Lane congestion and (ii) improve Traffic
safety in the Area being compromised by the unique demands
for access from large vehicles and Trolley-Car and diffi-
culty in crossing Myrtle Street due to the Diversion.
First-class hotel facilities, such as those furnished-by
the Lowell Inn, involve essential, traditional, public ser-
vice support functions such as transient accommodations for
visitors to the community and the general public.
o
o Activity access to Lowell Inn will be enhanced by transfer-
ring access from the Traffic Lane to the Parking Area.
Because of the foregoing, we hope the Council will conclude it may be
inappropriate to base its response to the Lowell Inn request on pre-
cedence considerations (in respect to the perceived needs or demands
for on-street loading/unloading of other restaurant/business op-
erations in downtown Stillwater) and will take immediate remedial ac-
tion so that we can all benefit from the Change during the summer.

The concept behind the suggestions offered April 1st 1989 to the
Council by the Lowell Inn is as follows:
"To manage North Second Street traffic/parking in a way
which, (i) gives priority to southbound Second street Traf-
fic as well as the related street crossings occuring at the
intersection of Second and Myrtle Streets, and (ii) re-
lieves Traffic congestion."
The Lowell Inn is therefore ready to cooperate with the City by giv-
ing up five, convenient, on-street, metered, parking spaces in front
of the inn so long as the objectives of the City are to:
1. Remove/relocate the loading/unloading Activi ty and
consequent congestion from \the active, southbound,
Traffic lane of North Second Street.
2.
Increase entrance/departure accessibility for pa-
trons/vendors arriving/departing the Lowell Inn,
.
. 3.
Transfer/relocate Lowell Inn parking demand,from.the ..-
on-street spaces in front of the inn on west Second
Street, to the off-street, parking area North of the
inn (i.e., lots 7, 8, 9 and 10; Block 19).
The Coun il may achieve the foregoing objectives by, (i) removing
five par. ing meters,>.(ii) resigning the spaces, and (iii) yellow-
lining t e curbing of the vaca ted parking spaces in the Parking Area
as reque ted (i. e., in front of the Lowell Inn on west side of North
Second S reet).
These th ee actions create the necessary on-street, off-Traffic-Lane
area and reshuffling of the handicapped parking. The Lowell Inn Ac-
tivity i thereby off-loaded from Traffic Lane to Parking Area.
The Coun i1 needs facts and data as a part of its decision-making
process. It is assumed this information is needed to supplement the
observed, experiential data furnished by the Lowell Inn business op-
erations and survey data from the City consultants. Lowell Inn data
confirms that Lowell Inn operations are the primary parking demand
genera to s for the area as well as the primary users and beneficia-
ries of he parking spaces in question. It is not our purpose to
create c nflict with, or haggle over, issues with your parking/engi-
neering onsultant, However, any Traffic counts and meter income
furnished by the consultants should be helpful and confirm our daily
observations of the public's low-demand use of the Parking Area.

Had the suggestion to remove the meters originated with the City en-
gineers or the Council and the Lowell Inn objected to such removal as
a loss of convenient patron parking, this matter might then be a case
of public vs. private interest. However, our interest is to reduce
congestion and increase safety for the general public and patrons
both of which are sound reasons for giving up five convenient spaces.
As the taxpaying entity and primary user of the parking spaces in
question, it seems reasonable to expect the City parking consultants
to pay closer attention to and heed, rather than ignore, solutions
offered by the affected business or be viewed as a professional in-
sult. There is no intent on our part to usurp the City's planning
function or do anything more than disagree when it is believed the
City parking consultant does not appear to understand the objectives
or is making impractical suggestions. However, for four years the
Council has been aware, and reminded a number of times, of our desire
to remove the five meters,
The views, comments, needs and problems offered to' the Council on
this subject by the Lowell Inn are intended to relate to the practi-
cal and public interest merits of removing five parking meters in
front of the Lowell Inn rather than the parking concerns of
noncontiguous business areas, as has been suggested by the City park-
ing consultant.
.
Rather it seems, any meter removal issues - which might be raised in
the future by other restaurants or businesses-.inthed downtown area -
may be addressed specifically if and when issues arise from, or any
traffic circumstance, problems and needs are generated by or created
in, other areas. For this reason, and because of the significant
walking distance to/from the restaurant district, it might be fair to
say that, "Council consideration of Lowell Inn Traffic adjustment
needs should not involve or concern other restaurants in other down-
town areas (i.e., Vittorio's) nor should their problems involve the
Lowell Inn."
EXHIBIT "A" seeks to point out the practical implications of the, (i)
relatively minor impact of this five-meter, removal request upon the
public, the area and/or the downtown, on-street, metered, parking in-
ventory, (ii) public nature of our business, and (iii) public inter-
est aspect of street usage, parking management and public related
safety. Considering the potential merits of the foregoing, it would
be unfortunate if this particular request were allowed to drift into,
an issue of public vs. private and/or precedence interests in respect
to concern for the North Second street Traffic and public safety
which is dependent upon the City for far-sighted parking management.
, The Council is rightly vigilant about alternative solutions. On the
other hand, .the Hearing pointed out that an unreasonable amount of
study time, expense, energy and engineering-consulting effort could
be expended by the Council if the evaluation process were extended or
more was being made of the meter removal proposal than necessary.

For the above reasons the "trial period" suggested by one of the
Council members seems to make good sense,
It is anticipated the Council will concur that:
o Enhancements to public safety and Traffic decongestion are
the primary and overriding public interest issues involved
in this matter.
o The 3-step meter removal proposal is simple and reasonable,
o The minimal public demand for the 5 spaces for non-patron
parking, in relation to total, on-street/off-street parking
availability in the area, would have negligible impact upon
overall demand for the present on-street parking inventory
in the immediate area.
o Acceding to our request, while studies or other information
are being obtained, does not prevent the Council from rein-
stalling meters removed at some future time. '
\
o Burdening the issue now with excessive Traffic and parking
impact studies adds significantly to City costs (costs
which might be wisely applied to a provisional removal of
the meters in question) is unnecessary.
o
Bearing the risk/cost of a possible reinstallation makes
sense in the event the matters of public concern the Lowell
Inn has observed, do not prove out in practice.
o Delaying action, beyond a reasonable thirty-day period, may
not be in the public interest.
o The Council would be wise to act provisionally upon the re-
quest for the 5-meter removal proposal for a one-year,
trial period no later than the last Council meeting in June
of 1989.
o The addition of the Trolley-Car tour service will be adding
additional parking and loading/unloading stops to the Park-
ing Area.
The following five points provide documentation for the, {i} Lowell
Inn position that it is a full-service hotel with integrated food,
beverage, lodging, meeting and banquet facilities unique in downtown
Stillwater, (ii) Council's request for statistics on the additional
activity and loading/unloading information. The latter is gleaned
from Lowell Inn and Lowell Inn patron records and experience:

lowest in June/August and November. The following informa-
tion is obtained from Lowell Inn and Andersen Corporation
records to produce estimates of merged activity.

The following information is taken from daily/weekly observations and
demand estimates accumulated by the Lowell Inn since 1984. This in-
formation is supplemented with a precise count furnished by the
Andersen Corporation traffic department for their motor coacn activ-
ity for the calendar year 1988,
The following assumptions are key considerations in respect to calcu-
lating the practical aspects of parking availability, demand,
type-of-use, and functionality applied to the Parking Area:
1. Available hours = 24 hours per meter per day 8 a.m. to
8 a.m. daily (Available Hours).
2. Chargeable meter hours = 9 hours per meter per day 8
a.m. to 5 p.m. daily enforcement period (Meter Hours).

Dear Mayor Abrahamson:
At 7:30 p.m. Monday, July 24, I am inviting a variety of people to
the school district office at 1875 South Greeley Street to discuss'
the status of lighting one of the\softball fields at the school
district property on Myrtle Street. I am inviting you or another
city council representative to attend the meeting.

Also invited will be School Board Members Bud Buchman and Lyman
Geary, Tom Junker, a resident of the area, a member of the City
Recreation Board and Mike polehna from-the Stillwater Jaycees.
Howard Jiran and I will represent school district staff and I hope
Dave Magnuson and Nile Kriesel will also be able to attend from
the city.
For an agenda I propose we:
1. Review the original agreement setting forth the plans
for the softball field complex.
2. Discuss the current use and projected needs for
recreational fields in the greater Stillwater
Area.
3. Review some proposed guidelines regulating the use of
the field with installed lights.
4. Discuss the nature of the proposed lights and identify
fields that can be visited where they are already in-
stalled. '
5. Consider the joint city/school district sponsorship of
a public hearing on the matter.

Minnesota Pollution Control Agency's Clean Water Partnership Program for Lily

Dear Mayor Abrahamson and City Council Members:
I am very disappointed with the time that has elapsed and the inability of the
City of Sti 11 water to secure the title for the property now being occupied by
the Minnesota Zephyr. (601 North Main) According to the contract (City of
Stillwater and the Minnesota Zephyr) the surveys, abstract, appraisals and title
was to be cleared, the property purchased and available for construction of the
Depot/Museum by April 1988.
The Minnesota Zephyr comIrenced operations inStillwater on July 10, 1987. Since
that time we incurred many serious and costly obsticles.
1. An unattractive area and facilities contradictive to our products image
and style and certainly reflecting a negative and embarrassing
impression to the Zephyr's guests, as well as passers by.
2. Loss of projected revenue exceeding $150,000.00 annually from the
gift/merchanaising shops within the Depot/Museum.
3. The costly relocation of prep kitchens on two separate occasions,
expense of over $10,000.00
4. Prematurely spending nearly $16,000.00 on equipment, labor and operating
costs to use a separate temporary facility. (These costs, of course,
will all occur again once the new depot is complete)
5. Excessive additional operating expense such as:
a. Labor (two facilities in separate locations).
b. Vehicle expense (time).
c. Separate utilities, water, sewer, electrical, telephones, etc.
d. Inconvenience - transit costs of equipment, breakage of dishes,
gl assware, etc. (Replacement costs mostly due to breakage on
transit $6,000.00).
6. A very unpleasant and undignified office facilities (trailer) for the
Zephyr's staff ... and visiting guests.

Recent Changes
Minnesota Link-Up America Program
Low income households without telephone service may now more
easily obtain telephone service under program changes recently,
made by the Minnesota Public Utilities Commission.
The Commission deleted the following two requirements:
The applicant must have lived at an address where there
has been no telephone service for at least three months
prior to the date assistance is requested, and
The applicant must not have received this assistance
within the last two years.
Persons eligible for Link-Up benefits receive one-half off the
telephone service connection and installation charges, up to
$30. The local telephone companies may also defer payments on
the balance of installation charges and reduce or waive deposit
requirements for new telephone service. These benefits are
provided through each local telephone company.
Revised Link-Up America applications are available through the
local telephone companies serving your area.
The enclosed General Information Sheet may answer your
questions about Link-Up America. If you have further concerns,

A.
Link-Up America Benefits
The Minnesota Link-Up America plan as approved by the Minnesota
Public Utilities Commission is designed to provide eligible
individuals with an off-set of one-half of the local telephone
service connection and installation charges, up to $30. Other
benefits, such a deferred payments on remaining service
connection fees and reductions or waivers of the deposit
requirements may be available under the Link-Up plan at the
option of each local telephone company.
B. Link-Up America Eligibility Criteria
To be eligible for benefits under the Link-Up America plan, an
applicant must meet the following eligibility requirements:
1. Applicant has not been claimed as a dependent for
Federal Income Tax purposes, unless he or she is
more than sixty years old; and,
.
2.
Applicant meets income requirements under criteria
"3" or "4" below.
3. Applicant can show current participation in
one of the following assistance programs to
his or her local exchange company:

Two sites currently owned by the Burlington Northern Railroad.
Survey (s) and legal descriptions to follow,
Site "A" is the present Stillwater Yacht Club parking lot as
well as the City boat launch parking lot.
A survey and legal description shall be required. Also any
and all lease documents pertaining to that part of the land that
is presently utilized by the Yacht Club a,nd its tenent "Popeyes"
restuarant, Every effort will be made to get these items from the
railroad, The appraisal will address the "Highest and best use of
the property, viable alternatives, etc. Is the site buildable?,
from ,a physical and legal standpoint?
The fee to appraiSe the parcel: $2000,00
Site "B" is the land at the rear of the restaurant now known
as the "Freight House" and running on/along the west side of Lowell
Park. Again a legal description and survey, if possible shall be
required.
The fee of this parcel: $800.00

RESOLUTION
MAKING FINDINGS FOR DETERMINATION OF REQUEST FOR SEASONAL AWNING AT POPEYE'S
RESTAURANT IN THE RIVERWAY BLUFFLAND/SHORELAND DISTRICT. (CASE NO. V/89-33)
WHEREAS, the Stillwater City Council reviewed the plans for a proposed awning
at Popeye's, 422 East Mulberry Street, on July lIt 1989;
WHEREAS, the City Council viewed the proposed awning as seen from the river
depicted in photographs and slides;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA,
that it has been determined the blue awning for Popeye1s, with the following
conditions stipulated by the City Council, will be inconspicuous in the summer
months as viewed from the river
1. The awning shall be a blue color to blend with the "marina environment.
2. The awning shall be installed after Memorial Day and removed by Labor
Day. \

3. The area covered by the awning shall not be screened.
4. The permit is not valid until the Department of Natural Resources has
reviewed and certified the request.
BE IT FURTHER RESOLVED that the seasonal awning does not constitute enclosure
of the deck.
