MINOR SUBDIVISION
NOTICE IS HEREBY GIVEN that the City Council of the City of
Stillwater, Minnesota, will meet on Tuesday, July 18, 1989
at 7:00 P.M. in the Council Chambers of City Hall to
consider a request from James Blichfeldt for final approval
of a minor subdivision at 514 and 518 West Maple Street. The
subdivision is for one lot of 14,952 square feet into two
lots of 7,476 square feet each in the RB, Duplex Residential
Distriet.

As Fire Chief it is mv duty to oreolan flrefiontlng ooera'tlons for
the Citv of Stillwater. An essential oart of tnis preolannlnq
orocess is to determIne water suoolies In conlunction wltn tne
nydrant svstem ana other alternative wa'ter sources avallaole to our
fire deoartment. Last year we tested all hvdran'ts in tne downtown
area and have recorded gallons oer minu'te oer each hYdrant. This
year, on tne evenlno o~ June 28 we tested a 12 inCh water Main on
~yrtle Street between Fourtn and Main S'treets. lhis test was a malor
undertaking and we were aSSls~eo bv tne water deoartmen't. collce
deoartment and three out~ide fIre deoartmen'ts. These tests orovlaed
us with much needed informatIon concernlno our nvdrant area water
system in downtown Stillwater. Uo to tnis tIme estimates were based.
on MaKino not very educated guesses concernino tne amount of water
tnat the fire deoartmen't would have availaole in a fire sItuation
During the Brines-Country Tailor fire we were ooeratina WIth
approximately 2,400 gallons of water oer minute (2 engines oumaino).
When more fire engInes were called in tnere was no water avallaole
for them. We know now that tnis is all the water an Binch main in
this area will deliver. We can now deliver aooroximately 4,500
gallons per minute to this same area. This can be accomplisned bv
stealing the additional gallons oer mInute from tne 12 inCh main
ahead of the 8 incn main. We can do this wltn the 4 inch supoly nose
we carryon eacn engIne. These increased amount fIgures also taKe
into consideration safe residual amounts of water to be left in tne
maIn to prevent collaose and WIll comoly wltn state nealtn laws.

The downtown area is the most hazardous area for firefignting in our
city. ~any of tne ouildings were QUIlt before codes and have common
walls or nave violated seoara'tinq walls. This was proven at tne
Brines-Country Tailor inclden't wnen tne fire movea from one building
to the other throuoh a small violation in the seoaratina wall.
Because tnese buildinas are Joined or to close together tney become
an exposure to one anotner. This sItuation reauires a larger water
supply than the west side of tnis city where the auildings are of
modern construction, adequate soacing and are mostly sorinkled.

The City of Stillwater has the good fortune of having the St. Croix
River flow near ~he downtown area. This is a very important factor
as it can increase our water supply potential to Whatever we want i~
to be. This can be accomolished two ways. Number one is to install
draft hydrants (dry hydrants) at strateqic sItes alonq the levee,
Nelson Street. Chestnut Street and Myrtle Street would take care of
much of the downtown area. Eacn of these sItes would provide an
additional 1,000 gallons per minute in a fire situation. They also
eliminate tne need to cut holes in the ice during the wInter monthS
which we wcould have to:) do if we wet~e drafti1'"J1:j with hat~d suctio1'"1 a1'"ld
strainer. The cost of the dry nydrant itself (parts) is not high
(under $500.00) but they require extensive excavation to be
positioned correctly, which would raise the price dramatically. This
would have to be turned over to the City Engineer to see What it
wCII.lld take t.:) do tn is.

Number two would be to purChase adequate sections of 6 inch nard
suction and strainers for orafting purposes, aeain this would mean
maintaining accessiole areas along the levee. Steve Russell has
assured me that if the Levee Road closes Ot~ not draft sites or dry
nydrants wlll be maintained. One of the advantaaes of usina hard
suction and strainer is its mobility, this means we can draft any
where we have drivina access and can reach the water. The cost WOUld
be approximately $ 5,000 to equip two engines. One of our engInes is
equipped at this time to draft at Nelson Street. We could purChase
this equipment this year WIth money we already have in the budget.
This would increase our water supply (2.000 g.p.m.) WIth the least
amount of time lost.
In summary, we can now deliver 4,500 gallons of water per minute to
most of the downtown area off the hydrant system. We can increase
the water supply by utilizinq the river with dry nydrants or hard
suction strainer apolication (3,000 g.p.m.) which would total 7,500

maximum gallons per minute mentioned to enhance the odds in favor of
extinguishing a tIre in one of these old buildincs. I believe that
when the Levee Road issue is resolved (closing or not closing) one c.f
these options should be considered.

Pursuant to your request, we have estimated the engineering time
required to provide the City of Stillwater with a Comprehensive
Pavement Management Study.

We are including a schematic which depicts the steps required to
complete the study and the services which will be provided. We
feel these services will fit the needs of the City of Stillwater
for a pavement management system. In summary, the study would be
compiled in the following steps:
1. All of the streets would be catalogued and the
inventory list established on the computer.
2. The Director of Public Works and maintenance personnel
at his direction would be interviewed to establish a
maintenance history for all the pavements and the
annual maintenance cost.
3. An inventory would be established on the computer
providing a listing of the streets in either alpha-
betical or numerical order complete with history data
compiled from existing records.
4.
A field rating survey would be conducted by our
personnel accompanied by City personnel if desired to
visually rate all the pavements which are classified as
Ci ty streets. This does not include county roads,
state trunk highways or private streets. The field
rating survey will also include rating of the various
types of curbs within the City.

5. An engineering review will be conducted to determine
the composite field rating for each street segment and
priori tization. A structural analysis will be
conducted as well as traffic analysis and required
pavement section for a projected timetable.

and capital improvements.

As stated earlier, the study will comprise all the City streets
but will not include the Central Business District which is
primarily bounded by Water street, Second Street, Mulberry Street
and Nelson Street. Since a feasibility study in the Central
Business District area will be completed in September, we do not
feel that inclusion of these streets in a Pavement Management
Study at this time would be cost effective.
We have included a computer printout of the basic steps in the
study and an estimate of the hours for each discipline of
personnel involved in the study. We have also included the cost
of the study. We estimate that the cost would be approximately
$29,400. - We are submitting this information to you for your
review and study as requested.
As we discussed earlier with you, we feel that a Pavement
Management Study will enhance the infrastructure maintenance for
the City of Stillwater and provide a budgeting tool. A pavement
management system will also save money for the Ci ty in their
street maintenance program by readily providing the information
required to make more intelligent and timely decisions about
pavements and their maintenance requirements.

1. Washington Co. Assessor - Follow-up recommendations on Board of Review.
A representative of the Washington Co. Assessor's Office was present and
the changes requested during the Board of Review on April 25 were
discussed.
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to adopt
the appropriate resolution accepting the ehanges presented by the Board of
Review. (Resolution No. 8077)

2. Rate increase complaints for sewer & garbage bills.
Fred Kreutzeldt, 2544 Bayberry Ave., asked what can be done regarding the
high rates and stated he will not be able to live here if nothing is done.

Dale Henderson, 422 No. Greeley St. stated he is shocked at the high
prices.
Mike Biedrzycki, 641 Hi den Valley Ct., stated he had a 60% inerease in
his rates.
Council explained the r tes for refuse haulers have gone up dramatically
and Metro Waste Control Comm. charges have also increased. These costs
have been passed on to fhe consumer. Staff also advised residents to
check water leaks, etc.
A man asked, if sewer r~tes have not been raised since 1985, will this big
increase happen again. . He also questioned policies regarding rates for
garbage pick-up.
Stella Casanova, 223 W. Pine St., asked why Oak Park Heights residents
only pay $2.00 per mont for garbage pick-up. It was explained they are
subsidized by the NSP pant.
Staff stated they do no expect large inereases next year. Discussion
followed regarding MwCClrates and reducing the Infiltration/Inflow
problems. Also discuss'd was the recycling issue and reduction of volume
of garbage. Council an Staff explained the tax system -- Federal, State,
and City levels.
UNFINISHED BUSINESS
1. Wayne Vasilis, Washingt n Co. HRA - Continuation of request for City
approval to purchase up to ten units of housing under the HUD Low Rent
Public Housing Program.
Mr. Vasilis explained f rther regarding the request. He stated HRA would
maintain the houses whi h would be scattered throughout neighborhoods and
a screening process WOUld be used. A payment will be made to the City in

Richard Kilty, 118 W. 0 k St., expressed disapproval of the plan and loss
of revenue.
Motion by Councilmember Kim le, seconded by Councilmember Farrell to adopt the
appropriate resolution appr ving the eoncept of Washington Co. HRA's purchase
of up to ten units of housi g under the HUD Low Rent Publie Housing Program
and directing the Mayor and Clerk to sign the Cooperative Agreement relating

Comm. Dev. ~irector Russell recommended several conditions -- that there
be no off-site signage and the area will be picked up when the carnival is

the request of Starbrite Amusements to operate a carnival at the River Heights
Plaza on May 18, 19, 20 and 21, 1989 with eonditions recommended by Comm. Dev.

review of the permit fo the 1990 season.

confusing place for the to be situated, there is too much congestion.

Richard Kilty, owner of the property at 424 So. 4th St., stated this
ordinance exempted this blo K from the odd/even parking regulations for
snowplowing and was initiat d by a letter from the School Dist. who
objected to the regulation nd tieketing of cars, many of whom were from
out of town. He stated hom owners in the area were not eontacted
regarding the ehange.

Discussion between Counqil, Staff and residents followed regarding the
parking problem in the ~rea of the Jr. High Sehool. It was stated the
School Dist. could prov~de parking below on the west side.

Jim Huntsman, 416 So. 4~h St., inquired whether the City is enforcing the
code regarding parking ~nd suggested the parking lot should be brought up
to code. Mr. Magnuson ~tated the City Code does not address how parking
lots should be regulate.
Further diseussion foll wed regarding useable parking for the Jr. High
School and Mr. Kilty st ted the neighbors have contacted the School Dist.
regarding this to no avail. Mayor Abrahamson closed the publie hearing.
Motion by Councilmember Oph~im, seconded by Councilmember Kimble to continue
the public hearing on consideration of amending Ord. No. 699 relating to
parking regulations for Fourth St. north of Pine St. & south of Oak St. to the
July 11, 1989 meeting in order to review the issue with the School Board.

making of an improvement consisting of street reconstruction, sidewalk,
curb and gutter, storm s wer, water and sewer service located on So. Sixth
St. between the south li e of W. Olive St. and the north line ofW. Pine
St.
Notice of the heari g was published in the Stillwater Gazette on June
9 and 16, 1989 and maile to affected property owners.
Consulting Engineer Moor explained the proposed project for the existing
catch basins and storm s wercrossing So. 6th St. between Olive & Pine S~.
and also included the co t of eonstructing the storm sewer, catch basins,
conerete eurb and gutter concrete sidewalk, water service replacement,
and bituminous surfaeing with a total estimated eost of $102,915.
Merlin Dowdall, 411 So. th St., thinks this is one of the better streets
in the City and disputes this action. There are some drainage problems,
but he is opposed to the cost.
Dean Hansen, 402 So. 6th St., asked the term for payment of the
assessments and the fina cost to the homeowner. Mr. Moore explained the
preliminary assessment r 11. Mr. Hansen stated he does not want this
improvement and can't af ord it.

Dan Fabian, 326 So. 6th St. asked if the City participates in replaeement
of utilities and Mayor Abra amson stated there eurrently are no funds
available for this. Mr. F bian inquired what benefit they will be
receiving from a five-inch ipe and Mr. Moore replied this will handle a
ten-year storm. He Fabian .s against the improvement.
Judd Orff, representing the owner of 310 So. 6th St. and 323 So. 6th St.,
inquired regarding replacem nt of water services. Mr. Moore stated an
easement may have to be acq ired for 323 So. 6th St.
Jeff Peterson inqui red how hi s project fits in with the Comprehensive
Plan to im,rove the streets of Stillwater and is alarmed that this was
initiated by a complaint fr m a resident.
Jim Huntsllan inquired about the policy on assessments and the benefit to
the property.
Mr. Dowdall asked if the co tractor would use the same stone curbs in
place now. Mr. Junker expl ined the poliey regarding this.
Mr. Orff stated that 25% of the income from the two properties he
mentioned earlier goes to r al estate taxes.
David Marsh, 432 So. 6th St., stated sidewalks on both sides of the street
were replaced by the reside ts and the present curbs will outlast new ones.
He does not think the proje t is worth doing.
Mayor Abrahamson closed the public hearing and discussion followed. Mr.
Moore stated that if the pr ject is not done, the catch basins will
probably collapse soon and he Public Works Dept. would have to replace
them. The dirainage pipe is crushed and does not drain properly.
Motion by Councilmember Kimble, seeonded by Councilmember Opheim to continue
the public hearing on L.I. 258, street reconstruetion, sidewalk, eurb &
gutter, storm sewer, water & se er service for So. 6th St. between the south
line of W. Oli~e. St. & the nort line of W. Pine St. to July 11, 1989.' (Ayes

Mr. Russell presented t~e program, including extension of hours of
operation to 9 P.M., se en days a week, increase rates for several
downtown lots, increase rates for Main St., institute 15 min. free time
for Main St. spaces, au~horize purchase of 220 new meters, increase eost
of parking violations tq $10.00, authorize additional long-term employee
parking and direct Staff to prepare specific budget for staffing and
support costs for enforqement program. He also stated Consulting Engineer
Van Wormer was present ~o answer questions regarding the plan.

expressed dissatisfactior regarding the present policy.
Lloyd Mellen, owner of F~ncy Nancy's, stated the business owners are
abusing the parking mete~s and said the business owners should have a
sticker to keep them out of these places. .
Jerry Brown, St. Croix K"ts, inquired where employee parking will be. Mr.
Van Wormer replied there are some spaces on Olive and 2nd St. and the
Auditorium Lot, also som private lots in the area.
Fred Brass, Vi 11 age Shop[, stated nothi ng is bei ng done about vi 01 ators on
Water and Nelson Streets.

Jerry Brown stated it is premature to implement 25t meters for four hours
in length when there is 0 long term parking -- the plan is not complete.
Ethel Larson, Gallery St llwater in Grand Garage, thinks we are making it
extremely difficult for ployees to park.
Monty Brine, Brines, 205 So. Main St., suggested employees;)'could move
their cars after unloadi g packages. Also, places are being taken away
for employees in the Riv r parking lot -- they won't go to Olive & 2nd St.
He suggested metering Wa er St. with two-hr. meters and enforcing
consistently.
Dan Woodbury, J. Hunter' , stated the biggest problem is enforcement and
asked why meter hours ar bei ng extended. The customers don't 1 i ke it and
will go elsewhere to ShO~.
Tom O'Brien, Simonet Fur~iture, asked if the parking lots are currently
being maintained out of the general fund and suggested building a parking
ramp with the $150, 000 f~O m meter. s. Council stated the funds wi 11 be used
to increase enforcement, build a ramp and acquire other parking -- there
is no full-time enforcem nt at present. Diseussion included where new
meters will be placed.

Ellen Anderson, Briek Alley Books, asked about the parking situation south
of the Dock Cafe and if thi area will be metered. Staff replied that
this is railroad property. Ms. Anderson stated people don't want to keep
plugging meters.
Bob Weiser, former owner of the Stillwater Bakery, who served on the
Downtown Plan Committee, st ted revenue is needed to improve the parking
situation.
Blanche Jensen, Patchworks Primitives, said the plan takes away her
winter parking spot on Oliv St.
Clayton Patterson, Box 207, Stillwater, stated enforcement is important
and feels we should enforce what we now have.
Mayor Abrahamson closed the publie hearing. Mr. Van Wormer addressed the
questions and comments that were made. Council discussion followed.
Motion by Councilmember Bodlovick, seconded by Mayor Abrahamson to deny the
First Phase of the Downtown Parking Management Program in an area bounded by
Chestnut St., Main St., Lowell Pk. and So. Main St. parking lot. (Ayes - 2;
Nays - 3, Councilmembers Farrell, Kimble, and Opheim).
Motion by Couneilmember Opheim directing Staff to incorporate comments
received this evening into a ne plan for the First Phase of the Downtown
Parking Management Program. The motion died for lack of a second.

Harriet Dr., regarding t e 30 ft. strip, with a berm, at the end of

including a pedestrian b idge, providing access from the end of Harriet
across to 61st St. and which would also provide a path to the park area
for residents on the norfh side of the ponding area. Mr. Moore explained
the different options fo design of the ponding area and bridge design
with an approximate cost of $70,500. Discussion followed regarding the
options and preservation of Mrs. Tomaszek's berm.

a design change in the plans previously accepted for the ponding area located
in L.I. 251, Forest Hills/Gr eley project, by changing slightly the location
of the drainage pond and pro iding a walkway through it without a bridge at

COUNTY FACILITIES EXPANSION
The Stillwater City Couneil et at the Washington County Government Center
with the County Board of Com issioners and Councilmembers of
other Washington County muni ipalities to diseuss mutual concerns.
County Staff presented plans for expansion of county facilities, including
jail facility expansion. Th plans were based on a study of county needs
from the present to the year 2,010. The plans ineluded a restrained
scenario (potential of 465,0 0 total sq. footage) and an expanded scenario
(potential of 533,000 total q. footage). The restrained scenario would
include a 192 bed jail facil'ty expandable to a 240 bed facility. The
discussion also included ide s for decentralized faeilties and the need
for expanded parking facilit'es.
SET PUBLIC HEARING FOR HIGH SCHO L ADDITION
Motion by Councilmember Kimble, econded by councilmember Opheim to set a
Public Hearing date of July 18, :00 P.M., to consider a Special Use Permit
request from Independent School ist. No. 834 for the placement of two new

I checked with licensing in five cities as follows;
Mpls.-valid license for 3 vehicles-cited in 6-88 for operating an
unlicensed vehicle. A letter of compl. in 6-88 for operating too
early in the morning(8a.m.). No furthur complaints.
St. Paul-valid license-no complaints.
Cottage Frove-valid permit-No complaints.
Brooklyn Center-valid permit-cited on 8-28-88 for vending wlo a permit
and for only having one adult in the vehicle-2 required. 5-89 the city
received a report from the Health Dept. citing numerous repairs which
were needed on the vehicle. No furthur complaints.
Eden Prarie-valid license. Complaint from group of citizens about their
soliciting at dinner time. Ctiy contacted them and they ceased this
practice. No furthur complaints.
I would recommend that if a permit is granted, that hours of operation
be clearly stipulated and that an inspection of the vehicle to be used
be done prior to the license being granted.

for the Minnesota Pollution Control Agency's (MPCA) Clean Water
Partnership Program for Lily Lake. We welcome the opportunity to
discuss with the City Council the City's interest in this
program.

Little information has been gathered_dover__the.years. on the,
overall quali ty or physical and biolc;gical--d1.aiacterIstic~d Q'f -.. '
Lily Lake. As you indicated, however, the City has received
complaints in the past about the lake's quality. The popularity
of the swimming beach and other park facilities underscore the
benefits to the City in maintaining and/or improving the lake's
water quality.
We recommend the City Council consider authorizing preparation of
the grant appl~cation for a Phase I Diagno~tic Study of Lily
Lake. The study should include a detailed an~lysis of the lake's
water quality, biology and pollution sources . Resul ts from a
Phase I study would include recommendations for management
strategies that could be implemented to control drainage area
pollution sources, if feasible, and possible in-lake measures to
improve water quality. These recommendations would provide the
Ci ty with better long-term management of the lake.'
The MPCA Clean Water Partnership Program was established in 1987
to identify water quali ty problems' and their sources and to
implement protection projects. Grants are awarded on a 50-50
state and local cost share basis for Phase I study and Phase II
implementation projects. The MPCA is accepting applications from
June 30, 1989 to August 30, 1989.

Location: Public areas of town near river and downtown
locations.
Purpose: We have a client, in town who owns a restaurant
(Estebans) and would like to attract some of
the visitors to Stillwater into his restaurant.
His location is somewhat remote and since the
restaurant is not along the river, he feels he
is missing out on potential business. In

Variance to the side yard and rear yard setback requirements for the
construction of a bedroom addition.
Discussion:
.
The request is to construct a bedroom on the second story of an existing home.
No expansion of the first story is proposed. The home faces at a Northeast
angle to the corner of a lot which creates confusion in considering what are
the side and rear yard. The lot is also a corner lot. The home presently does
not meet any side and rear yard setback requirements for the RB district nor
does it meet lot area or lot depth requirements. The four foot and five foot
setbacks are the rear yard setbacks considering the home faces Fourth
Street. The rear yard setback requirement is twenty five feet. Therefore, a
twenty one foot and twenty foot variance is being sought. The ten foot six
inch setback is considered a side yard setback. On the corner lot, a thirty
foot side yard setback is required. Therefore, a nineteen foot six inch
variance is being sought.
* Now that you are completely confused.......
The neighbor's garage to the rear of the property is approximately thirty nine
feet from the home. The neighbor's home to the South is approximately twenty
two feet six inches. There won't be any conflict in distance from other
structures after the addition is completed. Also, the addition is not a safety
problem to traffic on the corner of Fourth and Wilkin Streets.
CONDITIONS OF APPROVAL:
1. Run-off from the roof shall remain on site or flow to the street.
2. The home shall be sided or painted in one color within six months of
issuance of the building permit.
3. The yard shall be cleaned up.
4. Site shall be inspected for gas tanks, and if located removed according
to PCA standards.
RECOMMENDATION: Approval for the twenty one foot and twenty foot side yard
variance. Approval for a nineteen foot six inch side yard variance.
FINDINGS:
The granting of the variance is necessary for the reasonable use of the land
and building and that the same is the minimum variance that will accomplish
such purpose.

Street Vacation request for the remaining portion of Oak Street between Grove

DISCUSSION:
The request is to vacate the remaining portion of Oak Street between Grove and
Hemlock Streets. On October 19, 1982, the Southwest quarter portion of this
section of Oak Street was vacated. The adjacent property owners would like
the remaining portions vacated so the whole section of the street between
Grove and Hemlock will be vacated. Gerald Cadwell would like to build a garage
and driveway and the extra property from the street vacation would allow him
the extra property to build.
CONDITIONS OF APPROVAL:
1. A 20 foot utility easement be maintained over the water and sewer main
line and for pedestrian traffic.
RECOMMENDATION: Approval.
ATTACHMENTS: Location of Street Vacation.

Dear City Council,
This letter is regarding easement of the Oak Street uacation
between Groue and Henlock. When I met with the planning
commission on June 12, 1989, I was informed that they want a
twenty foot utility easement instead of a twelue foot easement,
and that they want this utility easement to double as a
pedestrian easement. The main purpose of this pedestrian
easement is for neighbor kids to walk through yards as they go
to school. I do not haue a problem with the neighbor kids
cutting through my yard to go to school, but I do haue concerns
with just anybody going through my yard. The following are
three reasons I would like the city council to remoue the
pedestrian easement from the uacation.

1. Priuacy: With easement, there will be no priuacy in any
part of my yard. My family will not be able to enjoy
supper in the backyard without people walking or
biking through it. We won't be able to enjoy any family
actiuities in priuate.
2. Liability: Who is responsible when a child riding a bike
down the hill loses control and crashes into a tree and
suffers seuere injuries? Is the home owner or the city
or both? I don't belieue it to be fair for me to haue
that responsibility because of pedestrians' easement
on my lot. There are many ways people can get injured l
on this easement that would be my responsibility.
3. Destruction of priuate property: On Monday, June 26,
1989, three bicycles rode through my garden on their
way through. I will bring pictures to the council
meeting showing this. I am uery concerned about my
property being used, stolen, and/or ruined. The eHtra
traffic through that easement will surely inuite more
of this kind of behauior.

In closing, my daughter is friends with all of the kids in the
neighborhood, and they play and use all the yards. I don't feel
we need to haue a pedestrian easement where the neighborhood
children are already welcome.

RESTAURANT/NIGHT CLUB, POPEYE'S, LOCATED AT 422 EAST MULBERRY STREET
(MULBERRY POINT) LOCATED IN THE BLUFFLAND/SHORELAND DISTRICT.
BACKGROUND:
The application is to cover the existing 1,600 square foot deck with an awning
during the summer months (see plans attached). The awning would be supported
by a metal frame. The awning would be put up in the Spring and taken down in
the Fall. The awning would allow the deck to be used during inclement weather
conditions.
From previous discussion with the applicant, City Staff and the Department of
Natural Resources thought the awning would be a retractable awning only used
for rain days. The applicant clarified at the PlanningCommissionineeting that
it was their intention to install the awning in the Spring and leave it up
u nt i 1 Fall.
The original permit for the deck, Case No. 603, stipulated "that the deck not
be roofed or enclosed". Because the restaurant does not meet the one hundred
foot setback requirement for the BlufflandlShoreland District it is considered
a substandard structure.
Any expansi on of a substandard structure would have to be determined by the
City Council that the structure "will be inconspicuous in Summer months".
Pictures showing the existing deck as viewed from the Stillwater Yacht Club
docks and river are provided for Council determination.
The Planning Commission reviewed the permit request on June 12, 1989 and
recommended approval of the request, provided that the awning be retractable
and only used during rainy periods and the following conditions are met:
1. The awning shall be of a color that blends with the marina environment.
2. The awning shall be removed at the end of the Summer season.

recommended approval by a. 5-3 vote. Since the Planning Commission meeting a
petition has been received by the City from North Hill property owners
regarding noise generated by Popeye's at night. The awning would probably
increase use of the deck at night when noise is a problem to the neighborhood.
DNR AND MWBAC COMMENTS:
The Department of Natural Resources and the Minnesota Wisconsin Boundary Area
Commission commented on the request (letters attached). DNR's comments are on
a retractable awning used only for periods of rain. They recommend the awning
to be earth tone to blend with the building and used only during rainy
periods.

We have reviewed the City's recommendation ,to the Planning
Commission on the Yacht Club's request to install a retractable
awning to protect restaurant patrons during periods of rain. We
agree with the conditions set forth in the Planning Application
review for Case No. Vj89-33. Additionally we would require, if
the variance is granted, that the awning be earthtone in color.
I had originally recommended that it blend with the marina setting
(ie, blue and white) but, in talking with others involved in the
decision making process about the proposal, we decided that the
ordinance spepifies earthtone colors for structures and
appurtenances c!ind that the awning would blend better with the
building if it:were a similar (cedar) type of color.

Our understanding of the proposal is to install a retractable
awning to be u~ed when rain is threatening. The supports will be
mounted flush with the railings and will not protrude when the
awning is retrapted. The maj ori ty of the time, the awning will not
be used except: when there is no space for the patrons to move
indoors.
Any approval would also be conditioned on adequate monitoring, by
the City, to assure the awning is used only for the specified
purpose. We would not consider certification of a proposal for a
seasonally installed awning that is left in place during the

Discussion:
The request is to place a retractable awning over a deck located on the
North side of t~ restaurant, Poyeye's on the River. This is a modification
of a variance gr~nted for the construction of the deck on the North side of
the building. The awning, which will be constructed of a durable cloth
material, will ~tend completely over the whole deck. It will not be screened,
therefore, not ~ fully enclosed.
A variance was ~anted to the Stillwater Yacht Club by the City Council on
June 5, 1986 to ~onstruct the present deck. The deck is constructed on an
existing building that has a substandard setback. A Findings of Fact
hearing was held"previous to the variance on November 1, 1985. It was
determined that ~he North side of the building was the only functional place
for the deck and1that it would create exceptional hardship to the property if
the variance sought would be denied. The Findings of Fact is on file in Case
No. 603. This request does not affect that case except for the temporary
awning.

proposed awning being used to support audio/ spea~cer systems ~
At present the audio sounds from Pop Eye's has been most
unpleasant for those who unwillingly have been forced to
have the sounds/ racket until 1.00 a.m.

Repeated telephone requests from Stillwater residences to the
managers to please turn down the volume have been met with
no response.
Also, poli~e contact to the bar haven't registered changes for
any length of time.
As you are aware the Federal ruling gives jurisdiction to city
authorities on tolerant noise level allowed.
We are interested to seeing Pop Eye's succeed and consider
awning petition acceptable but not if they violate the
neiRhborhomd and noise restrictions.

Ruling allows cities to control volume at rock concerts

WASHINGTON - Cities may
turn down the volume of rock mu-
sic at public concerts without vio-
lating constitutional guarantees of
free expression, the Supreme Court
declared Thursday.
And when local governments
regulate the time, place or manner
of concerts or other constitutional-
ly protected expression, they need
not choose the least restrictive
method, the justices said.
"Now, each municipality in the
country will be able to turn rock 'n'
roll into easy listening music," pre-
dicted Dana Beal, political coordi-
nator of Rock Against Racism,
which lost the case,
By a 6-3 vote, the court ap-
proved New York City's use of its
own sound equipment and engineer
to control the noise and balance of
concerts, in particular the ear-
splitting volume at rock events at
a bandshell in Central Park.
But the three dissenters - Jus-
tices Thurgood Marshall, William
Brennan and John Paul Stevens -
charged that the ruling had "signif-
icance far bey{\nd the world of
rock music."
They accused the court majority
of retreating from strong free-
speech guarantees by declining to
require governments to adopt the
least intrusive regulations and by
permitting "government control of
speech in advance of its dissemina-
tion."
Quoting a music critic, Marshall,
who will be 81 on July 2, wrote:
"New music always sounds loud to
, old ears. Beethoven seemed to
make more noise than Mozart;
Liszt was noisier than Beethoven;
Schpenberg and Stravinsky noisier
than any of their predecessors."
Rock musician Frank Zappa
agreed that the rights of people liv-
ing near the site of outdoor con-
certs should be protected from ex-
cessive noise.
"But there are scientific means
of measuring sound output and
limiting it. What I object to is hav-
ing somebody from the city with
his hand on the knob and cranking
down the sound whenever he
wants," Zappa said. "They've sin-
gled out rock music as the culprit.
If Julio Iglesias or Barry Manilow
came in and wanted his own sound
system, they would probably let
them set up their own P A, don't
you think?"
New York City decided to regu-
late Naumberg Acoustic Bandshell
performances in response to nu-
merous complaints. about exces-
sive noise. The complaints came
from people living in fashionable
Central Park West and from peo-
ple reading, reclining and walking
in the nearby Sheep Meadow, a
grassy open area designated as a
quiet zone.
Rock' Against Racism, which
sponsored programs of anti-racist
speeches and rock music at the
Bandshell, filed suit in 1985, argu-
ing the city regulations violated its
First Amendment rights of free ex-
pression.
A federal judge upheld the regu-
lation after 'finding that perform-
ers at the Bandshell were pleased
with the city's sound system and
technician. Although the technician
controlled both the volume and the
mix (balance) of sound, the city's
practice was to defer to the con-
cert sponsors' wishes on sound mix
and to confer with them before
turning the volume down.
But a federal appeals court
struck down the regulation, saying
the city should have used a less in-
trusive method to reduce excessive
noise without interfering with the
sound mix.
In upholding the regulation
Thursday, Justice Anthony Kenne-
dy wrote for the court majority
that the government's regulatory
method "need not be the least-re-
strictive or least-intrusive means."
New York City's method "has no
material impact on any perform-
er's ability to exercise complete
artistic control over sound quali-
ty," Kennedy declared.

Sanford has a clear c iminal record. Locally, he had issued a worthless
check to Cub Foods on 4-28-86 and later made restitution without charging.
There are no monetary transactions being made regarding this transfer
other than the conditions of the lease.

SUBJECT: PUBLIC HEARING ON CLOSURE OF LEVEE ROAD BETWEEN MYRTLE STREtT ON
THE NORTH AND NELSON STREET ON THE SOUTH.
During preparation of the Downtown Plan, Levee Road was 'conSidered fo closure
at several meetings. The plans for Lowell Park show the road converteb from a
trafficway to a walkway. Closure of the road was approved' because of the
traffic hazard to pedestrians and the distraction of vehicles for thel use and
::~o~::: ::rL::::r:a::"Levee Road was r~viewed by the Police and Fife
Departments. The Fire Department was concerned about the closing beca se the
St. Croix River is used as a water source in fighting downtown fires. With the
proposed closing, water could be drawn from the end of Nelson and MYr~le.
Provisions would have to be made to provide pumper access at Chestnut Street.
When Lowell Park is improved, standpipes will be installed that can bused -
by the Fire Department to draw water from the river.
DOWNTOWN PLAN ACTION COMMITTEE RECOMMENDATION:
The Downtown Pl an Acti on Committee recommend the closure at thi s time to make
the park more enjoyable to the pedestrian. The road could be closed using
temporary barricades until a permanent design for improvements to Lowell Park
area is prepared by Short, Elliott and Hendrickson for next year construction.
All Downtown property owners and business owners have been notified of the
meeting.
RECOMMENDATION:
Direct Staff to close Levee Road using temporary barricades and signage as
shown on attached map.

AN ORDINANCE-AMENDING THE STILLWATER CITY CODE BY
ADDING ~ iS1. 02, SUBDIVISION 1, (3), PROHIBITING
PARKING ON L~DSCAPED AREAS IN THE CITY OF STILLWATER
The City Council of the City of Stillwater does ordain:
1. Amendin~. Chapter 51.02 of the Stillwater City Code
entitled Parking Riegulations is hereby amended by adding Section
51.02, Subdivisiod 1, (3), which shall hereafter read as follows:
"(3) No pers~n shall park or permit any vehicle to stand
upon any pub~ic or private property that is sodded or
landscaped anid is maintained as a boulevard or open yard
space adjaceqt to a street, highway or parking lot, except
with the permiission of the owner of the property."

2. In all o~her ways, the St~llwater City Code shall remain
in full force and ~ffect.
3. This Ord~nance shall be in full force and effect from
and after its pas~age and publication according to law.

BACKGROUND:
This lot was originally approved for subdivision in 1986. At
that time, percolation information was presented that
showed the lot was developable. The new owner has had
additional soil test and plans drawn that show the specifi c
locaticn of the septic system and well. The plans have been
reviewed by the City Building Official with the State
Standards and find the site capable of handling the system
and meeting State Standards.
RECOMMENDATION: Approval.
The final plans shall be reviewed and approved by the
Building Inspector before construction.

20, 1988.

I have reviewed the soil boring reports submitted for this
site and they clearly indicated good soils fot'an on-site
system.
I have also reviewed a percdiation test sheet that was
submitted for the site in 1986 by a different party than did
the soil borings. There is a discrepancy in the type of
soil encountered in the two reports and the percolation test
data sheet is not techni cally accurate.
The infnrmation submitted is adequate and consistent with my
findings of an on-site inspection of the soil conditions and
topography to approve the site for the installation of an
on-site septic system that can accommodate the proposed
dwe 11 i ng.

Dear Mr. Kriesel,
! am writing to you in regards to a rental property'that
I own at 706 W. Laurel Street, Stillwater, Mn. -d55082.
The water Dills have been unusually high the 1st and
2nd quarter's. I have called down to the Water Department
and had someone sent to the house to investigate. I have
received a call trom them, ~etting me know that they have been
reading the meter lncorrectly. The 2nd quarter billing was
at 39,000 gallons and when they went and read it, it was only
4,000 gallons.
I would greatly appreciate it you can make.an adjustment
on the City billing.

Municipalities (AMM), has several purposes:

to help establish the yearly AMM agenda and work program
with respect to city issues and concerns
(local-regional-state). Issues raised at this meeting
will be forwarded to the appropriate policy..commi ttees.
2. To provide the AMM Board and Staff the opportunity to
appraise you of major program and issue priorities as
seen by the Board and Staff.
3. To discuss the AMM Legislative Contact Program to
determine its effectiveness and how to make it work
better and to get your input on the AMM Mission and
Services Study which will get underway shortly.
