RESPONSE TO REQUEST FOR CONSIDERATION OF NORTH SECOND STREET
PARKING IMPROVEMENTS.
The City Council received a letter from Mr. Palmer requesting consideration of
the parking situation along North Second Street between Myrtle and Commercial
Streets. Several parts were mentioned in the letter as follows:
1. Termination of Lowell Inn lease of City land fora parking lot (See
Exhibit "A"). .

2. Lowell Inn to purchase a portion ,of lot 9 for Lowell Inn parking lot.
3. Improvement of City parking lot.
4. Removal of parking meters in front of Lowell Inn for handicapped,
loading or coach loading.
The City's Traffic Engineer has reviewed the request and expressed some
concerns regarding the recommendations for the permanent loss of parking
spaces and hazards for using on-street parking for handicapped spaces.
Regarding points 1, 2, and 3, it is suggested that the City Council consider
improving the City owned parking lot and making it available to the public. 35
to 40 spaces could be provided. The project could be ,paid for by adjacent
benefiting property owners and possibly TIF funds available from the TIF
District.
The Downtown Plan locates a City parking lot at the corner of Second and
Mulberry Streets (See Exhibit "BII). The owner of a portion of the site
recently contacted the City and indicated the lot may be available. It is
suggested that City Staff be directed to contact the owners of the North Main
parking lot site regarding purchase of the land for a City parking lot. The
existing City lot and South Main parking site could provide 80 to 100 spaces
and provide sites for possible future parking structures.
RE COMMENDATION:
Direct Staff to prepare improvement of plans for the existing City parking lot
and Staff to contact the owners of the future City parking lot site regarding
purchase of the land.

Washington Square
Maureen and I have been actively soliciting new business for the
M::>unt Vernon Wing. We are pleased to report significant progress in
our efforts to. obtain long-tenn cornnitments from multinational compa-
nies. A preliminary organization plan for the St. Croix Executive
Center has been completed.
We are now at approximately 20% of the goal established for the fi-
nancial plan. This plan will construct the extension to !J:lwell Inn
according to the final specifications required ,by the participating
companies.
Parking linprovement:s
This letter follows consultations with Mr, Russell regarding a number
of recommendations offered herein for improving parking for the
!J:lwell Inn patrons and the public in the area of North Second Street.
These suggestions are based upon daily observations as well as com-
ments from concerned patrons.
Problem
The year ar01.md, intennittent traffic congestion and certain parking
use conflicts occurring on North Second Street are w:>rthy of planning
and improvement attention. The diversion of a steadily increasing
amount of westbound'traffic from the corner of Main and Chestnut is
having a pervasive effect.

As the westbound. Myrtle Street traffic increases, there is a
significant Slowing of southbound Second Street traffic at the corner
of MYrtle and Second. The lineup in the southbound lane frequently
backs up in front of the Lowell 100 tv..o to four car lengths at a
time. In addition, LovJell 100 guest autarobile loading/unloading and
truck deliveries reduce the tv..o-lane Second Street traffic to
one-lane thereby aggravating the congestion,
Observations
I have asked Mr. Russell to apply his experience and expertise to a
comprehensive review of the functions and general quali ty of the
parking in this area with proper emphasis given to the,
(i) impact upon Second Street tv..o-way traffic as a result of
the Lowell Inn traffic and parking activity
(daytime/nighttime truck, coach, limousine and
handicapped loading and unloading) ,
{ ii } varying types of public and Lowell Inn uses being imposed
at varying, often conflicting, times,
.
(iii) benefits of balancing use and demand between the public
and the Lowell 100,
(iv) benefits of improving surfacing, striping and lighting I
(v) safety/security issues related to pedestrians and ve-
hicles, departing/arriving congestion and autarobile
parking in the lots north of the Lowell Inn,
(vi) opportunities for self-mariagement of utilization, and
(vii) curbing, or at least discouraging , abusive public use,
Reccmnendatians
Six suggestions are offered for consideration:
1. Termination of !.Dwell Inn parking lease of lots 6, 7 and 8
Block 19, City of Stillwater and maintenance assumed by City.
2. Purchase of the North portion of lot 9 owned by the City (now
abandoned by the Stillwater Water Department),
3. Improvements to City Parking area (lots 6, 7 and 8).

- Addition of day rate parking meters,
- Addition of boundary fence, lighting and entry signage,
- Blacktop resurfacing and striping,

4. Rerroval of- five meters in front of the Lowell Inn on West
side of North Second Street and replacement with multiple use
signage (handicapped, truck loading/unloading and
coach/limousine loading/unloading/parking,
5. Yellow curbing between meters A and E (see, parking meter
layout schematic below),
6. Transfer of t\<.D handicapped parking areas from Lowell Inn
parking area to North Second Street,
Attached is a schematic outlining the relocation of parking utiliza-
tion on North Second Street and signage descriptions suggested from
the meetings with Mr. Russell, If authorized by the Council, Mr .
Russell indicated he will prepare a report for the council in respect
to the problems and opportunities outlined herein.
Your attention to this matter and cooperation in a public interest
resolution of this opportunity for significant improvement to public
and private parking in this area will be appreciated.

A number of suggested parking changes were made by Arthur Palmer
of the Lowell Inn in a February 7 letter. You and I have had an
opportunity to discuss some of the matters in conjunction with
the overall parking management concepts for the downtown area.
Mr. Palmer's letter offered suggestions for modifications to
parking lots near the Lowell Inn and to on street parking on N.
2nd Street. The on street parkingissu~s can perhaps be
discussed separate from his suggestions for off street parking.
Mr. Palmer suggested removing several parking meters and
establishing two handicap parking zones on the street, a coach
and limousine loading and unloading zone, a truck loading zone
and elimination of some spaces. We have previously discussed
some of the concerns of the Lowell Inn relative to bus parking
and loading problems at the Lowell Inn.
Moving the handicap parking spaces creates some problems. We are
required by the state to provide a specific number of handicap
spaces in every off street parking lot depending upon the number
of spaces. Thus, we can not arbitrarily remove handicap spaces
from a public off street parking facility.

The concept of providing a handicap space is to provide ease of
access to the sidewalk system and adjacent pedestrian generators
such as businesses. The guidelines for handicap parking
specifically indicate that there should be direct access to such
a system. There must also be an area for the handicap individual
to get into and out of the vehicle. This ~s the reason for the
12 foot wide parking space. By placing a handicap zone on the
street, we run into two distinct problems. There is no specific
loading or unloading area for the handicapped individual. If the
driver is a handicap person, he must load or unload directly into
the travel lane of North 2nd Street. A second concern is a
necessi ty of providing a direct access to the sidewalk system
meaning that there must be handicapped ramps provided directly
adjacent to the space.
For these reasons, we are reluctant to agree to move the handicap
spaces as suggested by Mr. Palmer.
We have previously discussed some of the loading and unloading
problems faced by buses. We have suggested that the Lowell Inn
be provided with some bags to be placed over the parking meters.
When a bus is anticipated, the parking meters could be bagged
early in the day so that the bus may have a loading and unloading
area. The only problems associated with this would be
unanticipated arrivals and the necessity of removing parking
spaces for an hour or two in advance of the actual arrival of the
bus. However, by making the loading and unlo~ding zone a 24 hour
system, the spaces are permanently removed from public use.
I believe the City already has some guidelines for establishment
of truck loading and unloading zones.
We have also observed some of the double parking for loading of
passengers into automobiles in front of the Lowell Inn. We have
also seen similar double parking on Main Street in front of
Vittorio's and at Brick Alley, on Main street and on Myrtle
Street for the Senior Citizens Center and at other locations to a
lesser degree. A truck loading zone at location A or location A
and B as shown on Mr. Palmers layout might double as a location
for automobile drivers to pick up passengers. However, the City
should carefully consider other requests from other locations for
this type of a loading zone.
We would recommend against any change in the handicap parking
arrangement. We are also reluctant to consider a limousine
loading and unloading zone. The truck loading and unloading zone
issue could be settled probably using existing policies.

The other issues relative to off street parking should probably
be discussed in more detail with Mr. Palmer. We would be very
willing to participate in those discussions or to discuss our
comments regarding the on street parking issues at any time.

I am writing in regard to our extremely high water
and sewer bills for Feb., March, and April 1989. I
have enclosed our bills from Ra-Mar plumbing, in March
they came and adjusted a valve in the mems room and in
April they repaired a toilet in the Child Care Center.
Apparently these mal-functioning fixtures caused con-
tinual water running. Hopefully, we have found and
repaired the problems and are using less water.
As we are a Non-profit Agency on a tight budget, we
would appreciate your looking at this and making an
adjustment on our water & sewer bills. Thank You.

,Dear Mayor & City Council:
My name is Mark Ehlenz and I live at 2830 Woodridge Lane
in Stillwater. Recently, I received my utility bill for
sewage and sanitation pick up. My Bill was 'excessively high
($179.551. I realize tflat the cost for this service was in-
creased during this quarter, But my Bill still is on the high
end of the spectrum. \,
During this last quarter, I had a water pipe which burst.
I was unaware of this condition~for an unknown period of time.
This condition has suBsequently Been repaired. It should also
be noted that tli.is_ condition was reported to a Mr. McKean of the
Stillwater Water Department.
I am requesting that my utility Bill be adjust.ed since
the bill is based on water usage of tile first three months of
each year. I do not feel that I am entitled to tPe minimum
charge, but I am requesting some sort of an adjustment. I feel
a fair adjustment would De to Base my bill-on the amount of
water that my family' used during the same period of the previous
year.

The Environmental Quality Board (EQB) has received a valid petition
requesting that an EAW be prepared on the proposed air show to be held on
August 16, 1989 over the st. Croix River valley at Bayport. Because no
state agencies or local governmental units appear to have any direct
jurisdiction over this air show, the EQB Chair has determined that the
need for an EAW must be decided by the EQB under its authority pursuant to
Minn. Rules, part 4410.1000, subpart 3, item C.
The EQB will determine the need for an EAW at a special meeting
scheduled for May 25, 1989, in the Metropolitan Council Chambers, Mears
Park Centre, 230 E. 5th st. (5th and Wacouta), st. Paul. The special
emeeting will begin at 11:30 a.m., or later if the regular Board meeting
which will commence at 9:00 a.m. in the same room has not been adjourned
by 11:30., '
In accordance with Minn. Rules. part 4410.1100, subpart 6, the'
standard by which the EQB must determine whether or not an EAW is required
for the air show is whether "the evidence presented by the petitioners,
proposers, and other persons or otherwise known to the RGU [the EQB]
demonstrates that, because of the nature or location of the proposed
project, the project may have the potential for significant environmental
effects."
Any person has the right to address the Board regarding this matter,
but please be advised that the EQB Chair may limit the length of
presentations. Any person also has the right to submit written materials
to be considered by the Board in making its decision on whether or not an
EAW should be prepared. The EQB's operating rules (Minn. Rules, part
4405.0600, subpart 6) require that to be considered in the decision, any
written materials must be personally served on all parties to the matter,
each EQB member, and at the EQB offices no later than 4:30 p.m. on
Tuesday, May, 23. A copy of the names and addresses of the EQB members is
enclosed for your use should you wish to file any written materials. It
is the view of the EQB staff that the "parties" to this matter include the
project proposer and the petitioners' representatives; their names and

I. DESCRIPTION OF PROPOSED PROJECT
The proposed project is "The Greater St. Croix Valley Air Show"
which will occur on August 14, 15 and 16, 1989, over the St. Croix
River adjacent to Bayport, Minnesota.
The aerobatic box will be between the railroad swing bridge on
the south at mile 17.5 and the southern tip of Andersen's Point
at mile 20 on the north.
The viewing for the public will be from Highway 95 which runs
parallel to the St. Croix River on the Minnesota side, which
highway will be closed from 22nd Street to the south to Fourth
Street on the north.
The schedule includes the following events:
August 14 - Thunderbird aerial survey of show sight over
St. Croix River
August 15 - Thunderbird practice run over St. Croix River
August 16 - Actual performance which includes:

IV. POTENTIAL ENVIRON ENTAL EFFECTS
a. =Because th~ S . Croix River was the first river placed
under the pro ection of the Wild and Scenic Rivers Act,
to permit the proposed air show would be in violation
of Public Law 90-542 which was written to "protect
the esthetic, scenic, historic, archeologic and
scientific fe tures" of the rivers placed under its
jurisdiction.

b. Because of th lack of contiguous jurisdiction of
governing aut orities for airspace, river space, and
adjacent wate and ecological habitats, no one govern-
mental agency can adquately oversee the issuing of this
permit. No a ency concerned with the environment has
permitting au hority. The only permitting agency is
the FAA and t ey have no mandate to require environmental
accountabilit .
Because of th unique nature of this problem the
environmental concerns fall between the cracks. Because
of this the S . Croix Riveyway is left vulnerable and
unprotected w'th the potential for significant adverse
environmental effects.
c. There will be disruption and encroachment of habitat,
of nesting, f eding, and flyways of endangered birds,
i.e. peregri e falcons, protected eagles and other
game and non-game species.

d. There will be garbage and excrement pollution of the
sight and adjacent area to the river from crowds of
100,000 to 250,000 people.
e. There will b noise pollution and air pollution from
numerous var'eties of aircraft while performing at low
altitudes ov r the St. Croix River.

I am writing in regard to the proposed Stillwater Air Show
which is to tate place August 16 over the St. Croix liver
between Hudson and Bayport. This portion of the liverway is
not covered dl~ectly by National Park Service lederal regula-
,tions, however, it is a part of the National Wild and Scenic
Rivers System.
~ I am requesting that the 'FAA protect the values of the St.
Croix National Scenic Riverway by declining to pe1"1l1t or
authorize an air show to be staged over the St. Croix Rational
Scenic Riverway.
The National Park Service policies in regard to special usea
(such as air shows) are evaluated by the following:
1. It would conflict with law or policy.
[Public Law 90-542 ststes in part, ....certain.selected rivers
of the Nation which, with their immediate enviTonments, pos-
sess outstandingly remarkable scenic, recreational, geologic,
fish and wildlife, historic, cultural, or other similar
values, shall be preserved in free-flowing condition, and that
they and their immediate environments shall be protected for
the benefit and enjoyment of present and future generations.-
and ....Each component of the national wild and scenic rivers
system shall be administered in such manner as to protect and
.enhance the values which caused it to be included in said
system without, insofar as is consistent therewith, limiting
other uses that do not substantially interfere with publi~ u~e
and enjoyment of these values. In such adminlstration primary
emphasis sball be given to protecting its esthetle, scenic,
historic, archeologic, and scientific features.-

Noise lev~ls have been a long-standln~ problem along the
entire Riverway. Riverfront landowners have 'complained aore
about noise over the years than any other aingle item. The
ide~ that jets and other aircraft will be flying at relatively
low altitudes up a river valley, tbat 50,000 to 250,000 people
are expected to be watching, tbat the water surface on either
end of the flight co ridor will likely be covered with boats,
will produce noise like residents have never heard before (as
veIl as the accompan ine complainta).

Dear Mr. Eagan:
The Minnesota-Wisconsin Boundary Area Commission, on April 20, 1989,
reviewed a proposal by Mr. David Eckberg of Stillwater, Minnesota, to
hold an event entitled "The Greater Stillwater Airshow, Inc." (also
called the Greater st. Croix Air Show) on August 14-16, 1989, over
the Lower st. Croix National Scenic Riverway between Hudson,
Wisconsin, and Bayport, Minnesota.

Please be advised that by majority vote of Commissioners present, the
, Commission has gone on record in opposition to this airshow because
the event and,the crowd of observers that it would draw (estimated by
the promoters to be-from 50,000 to 250,000 people) 'are contrary to
the public interest at the proposed site for the following reasons:
1. The proposed airshow is an inappropriate ~ of the Lower st.
Croix National Scenic Riverway in that the use is inconsistent
with the values for which the river was designated by Congress,
as.outiined in Public Law 90-542, the founding legislation for
the National Wild and Scenic River System.
2. The proposed airshow is inconsistent with the purposes and
objectives of the Federal-State Master Plan for the Lower st.
Croix National $cenic Riverway, as outlined in the attached pages
copied from the referenced document.
It is most unfortunate that the organizers of this event did not
properly consider the impact of conducting it above and within the
Lower st. Croix Riverway before seeking endorsements or making
commitments with participants. The fact that the National Scenic
Riverway corridor is subject to extensive control by federal, state
and local governments as to the type and location of allowable land
uses, improvements to private properties, recreational uses and
facility development makes it extremely difficult to justify.its use
for an event of the magnitude and character of the proposed airshow.
It would be prudent to relocate it to another suitable site outside
the Riverway District.

Given the above considerations, we are advisinq each of the
agencies indicated beiow t decline to provide permits or agency
resources in support of th proposed airshow described herein:
1. That the Federal Aviation Administration deny a permib

2. That the Unite States Air Force "Thunderbirds"
decline the in itation of the sponsors to participate
in this event t the proposed location.
3. That the Unite states Coast Guard not close the st.
Croix National Scenic Riverway to watercraft traffic,
as requested b the event sponsor.
4. That the Minne ota state Patrol not close Minnesota
Highway 95 for purposes of providinq a viewinq area
for airshow ob ervers.
Please advise the Commiss on of your intentions reqarding this
airshow proposal in light of our concerns. If you have further

I bring to your attention a proposed August 16, 1989 air show
involving the U.S. Air Force Thunderbirds over the St. Croix River
between the states of Minnesota and Wisconsin. We further
understand that this will be proposed as an annual event.

Based on the April 4 phone discussion the Department submits these
comments relative to the proposed August 16, 1989 'air show
(including U,S. Air Force Thunderbirds) within the St. Croix River
Valley from Hudson Railroad Bridge and Anderson Point. ,between St.
Croix County, Yisconsin and Yashington County, Minnesota. I would
appreciate you forwarding these comments to the appropriate review
authority in your agency. You will note, as per the discussion. a
copy of this letter is also being sent to the Department of
Defense contact you suggested.
To date, the Department has not received any specifie information
describing the air show, accommodation for attendees/viewers
(parking facilities, view points, traffic control, bathroom
facilities. etc.), accommodation for closure of river navigation.
accommodation for vehicular traffic control, etc. As you can
imagine, these unknowns make it difficult to identify possible
concerns associated with this proposal. There are, however.
general concerns we wish to bring to the attention of appropriate
regulatory authorities.

The Lower St. Croix River was designated as a National Scenic
Riverway in 1972. The Riverway is jointly managed under a
partnership agreement by the States of Yisconsin and Minnesota
(Departments' of Natural Resources) and National Park Service for
preserving its outstanding scenic and recreational qualities which
were being threatened by overuse. The Lower St. Croix Manageme~t
Commission was established in 1973 to coordinate management of the

Dear Mr. Eckberg and Council Members:
I want you to know of my dismay and concern regarding the proposed
"Stillwater Air Show" scheduled for August 14, 15, and 16, 1989,
over the St. Croix River, the 'window' for the show being adjacent
to the City of Bayport.
My preference is that such an air show take place in a public area
where pressures from the public and the show do not impact private
citizens and protected rivers. Some of my concerns follow:
As a citizen sincerely concerned about the Bayport area and the
scenic St. Croix River, I request that, at a minimum, an environmental
impact study be conducted before any plans are made for this event.
I am greatly concerned about damage to the environment. With the
concentrated airplane activity there will be environmental damage
to our scenic St. Croix River. The noise from the high performance
aircraft and cheering crowds will disturb our wildlife and the
peace of mind of the Bayport residents, particularly those adjacent
to the highway. The high performance aircraft concentrated in the
small area will be emitting fumes and fuel potentially harmful to
our scenic river. Furthermore, if 250,000 people patronize this
proposed event as suggested, the concentrated exhaust fumes from
the 100,000 plus vehicles, and the litter, refuse, garbage, etc.
transported into our Bayport area by the 250,000 patrons will most
definitely pose a hazard to our environment.
Our river may suffer from the foreseeable heavy concentration of
boats at each end of the proposed aircraft corridor. There will
necessarily be pollution from the concentration of boats and
disruption of the environment as well.
Also, I demand.that the safety of my property, family, guests and
myself be insured by requiring all possible participants, sponsors,
subcontractors, etc., in this proposed event to file insurance
policies with the City of Bayport in the minimum amounts of .
$1,000,000.00 per each entity in the event that the unforeseeable
occurs. We all remember the disaster that occurred at the air
show last summer in Germany.

I am concerned about dama e to my property, myself, family and
guests from the influx of individuals and entities, etc. that
the proposed air show wil bring. Specifically, I ask~ that
insurance policies be fil d with the City of Bayport for each and
every entity or participa t in the air show. If a pilot or airplane
damages my property, that pilot may be a subcontractor and the
sponsor may not be respon ible for the pilot/plane. Therefore,
I request that all pilots, airplane owners, or other participants
file valid proof of insur nee.
If my property is damaged by a delivery truck, again a possible
subcontractor, he must sh w evidence of insurance. Insurance
coverage should be established for all such entities. Other
entities falling into this category include security persons,
maintenance crews, and ve dors.
I am concerned about dam ge from the patrons of this proposed
event. Who pays for dam ge to my home, property, or family from

SPECIFIERS in municipal government must have \
the freedom and power to perform their in-
tended job: secure the best equipment and services

cations facilitates just that. A recent court decision i
has recognized this tenet and validated its necessity. i
In affirming a decision handed down by the U.S, j
District Court of Massachusetts, the FederalIst Cir- ;
cuit Court was backed up by the U.S, Supreme i
Court, which refused to hear further appeals in the :
case of Whitten Corporation vs. Paddock, Inc. Four i
major rulings regarding specifications came from
this decision:
. The court ruled that proprietary specifications i
are not a violation of anti-trust laws, The court also
stated that trained professionals - specifiers _
make informed judgments on products which they
feel best serve their client's needs. I
. The court ruled that other suppliers or man- ! '
ufacturers can qualify as "or equal" only when the
specifier chooses to waive specifications or permit
those suppliers or manufacturers to bid, The court
clearly stated, however, that the specifying source is I
charged with the responsibility and judgment for I
determining whether a proposed substitution is an I
"equal,"
· The court stated that the specifier ..... may
waive specifications in order to obtain a more desir-
able product for the client."
· The court concluded that" . , . the burden is on '\
the supplier or manufacturer who has not been 1
specified to convince the specifier that their product \
!
is equal for the purpose of a particular project."
We applaud the court's decision. In the first place,
hamstringing specifiers by limiting their options will
render them virtually powerless to do their jobs
properly, Secondly, what is to prevent rejected
manufacturers from upgrading their product to con-
form to specifications? We were under the irnpres- !
sion that the philosophy of "building a better mouse- )!
trap" was fundamental to this country.

Promoting the Public Works Image
'A IE HAVE periodically encouraged promoting the
VV positive image of your public works depart-
ment. Have you done anything about it yet? It's no
secret that many municipal departments are held in
low regard by the taxpaying public.
PUBLIC WORKS for February, 1983
In these times of restrained budgets and minimal
workforces. the time, personnel, and money avail-
able for promotion of your department are virtually
non-existent. However, have you considered your
local media? Newspapers are always on the lookout
for interesting stories with a local slant. Do you have
an employee or work crew that has compiled an
extraordinary safety record? Did the department
acquire some new equipment or complete a needed
project? Have some employees come up with new
money-sa\'ing ideas? Opportunities for favorable
publicity from these types of news stories are end-
less.
The local radio or TV station offers other pos-
sibilities. Many have public affairs programming or
talk shows with public participation,. This presents
the public works department head and other muni-
cipal officials with an excellent opportunity to ex-
plain the authority, responsibility, and limitations of
the department and to answer questions from citi-
zens.
On Remembrance of Times Past
AMISH horsedrawn carriages are causing a rutting
problem on Pennsylvania highways, according
to a recent report in The Wall Street Journal, Lancas-
ter County officials believe the damage is caused by
hard carbide cleats welded onto the bottom of horse-
shoes to prevent slipping on icy roads.
Leacock Township spent $25,000 in 1982 to repair
the ruts - several inches deep in some places - and
may have to repeat the expenditure again this year,
The Amish have been urged to use new rubber horse-
hoes which are twice as expensive as the old steel
and borium models and wear out twice as quickly,
Understandably, the thrifty Amish have balked at
1 this solution. A new paving substance that will resist
the wear is being explored. In the meantime, the
Amish have agreed not to use the horseshoes from
April 1 to the first frost.
Hopefully, a mutually satisfactory solution will be
worked out. We spent almost 20 years living and
working in Pennsylvania's Amish country. The
clip-clop of horseshoes as buggies roll into town on
marketing day is enough to uplift the spirit. It is
surprisingly gratifying to see Amish sleighs nimbly
maneuver on city streets so covered with snow and
ice that automobiles dare not tread. We would hate
to see these reminders of simpler times legislated out
of existence. Like the smell of burning leaves in the
fall. some things have no price tag.
