PUBLIC HEARING
This is the day and time for the Hearing to determine whether.
the liquor license of Meister's South Hill Liquor .Store
should be revoked or suspended for up to sixty (60) days or
whether the City Council should impose a fine for failing to
comply with Minnesota Statutes prohibiting the sale of
alcoholic beverages to a minor.
Notice of the Hearing was mailed to Mr: Meister on March
'3, 1 '38'3 .
Council heard testimony regarding the sale of alcoholic
beverages to a minor by an employee of South Hill Liquor
Store on February 14, 198'3. City Attorney Magnuson called
the following witnesses: Officer Leo Miller and Officer
Bruce Klosowsky, the arresting officers, and Michael Brown,
the minor who made the purchase at South Hill Liquor Store.
Mr. Brown testified that he has never been in possession of a
false identi ficatic.n card.
Edward Simonet, Jr., representing David Meister, called the
following defense witnesses: David Meister, owner of South
Hill Liquor; Steven Hooley, South Hill Liquor Store employee
who sold the alcoholic beverages to Mr. Brown; Kevin Pettee
and Ernie Feile, employees of South Hill Liquor Store. The
defense witnesses testified that Mr. Brown had in the past
shown an identification card indicating he was of legal age.
Karl Ranum, 817 South 4th Street, spoke as a concerned
citizen and stated that he has observed the carding process
at South Hill Liquor Store on several occasions.

REQUEST FROM RIVERTOWN TAXI
Martin Withuski of Rivertown taxi, presented a request to use
the building located at 823 South 4th Street as a temporary
dispatching office during the month of April, until the
Planning Commission has an opportunity to review the request.

Bodlovick to approve a 30-day permit for use of the building
located at 823 South 4th Street as a dispatching office for

PROPOSAL FOR DOWNTOWN BUILDING
Don Nolde. and Tim Nolde presented a proposal for a seven-
level structure for the north end of Main Street. The first
three levels would be enclosed parking, the next two levels
would be executive hotel, and the top two levels would be

CONTINUATION OF MEISTER HEARING
1. This was tme day and time for the conti~uation of hearing to determine
whether the liquor license of Meister's South Hill Liquor Store should be
revoked, suspended or fined for failing to comply with Minnesota Statutes
prohibiting the sale of alcoholic beverages to a minor.

City Attorraey Magnuson added Exhibits 2, 3, & 4 to the-record. Officer
Klosowsky was sworn in and presented testimony regarding the issuance of
1.0. cards. Officer Miller presented testimony on whether Michael Brown
was issued an 1.0. card and it was noted that he did not have an 1.0. card.
Michael BrOMR identified a cancelled check he wrote to the South Hill
Liquor store dated Nov. 24, 1988.
Colleen Flattum, 3085 St. Croix Trail, Afton, stated her sixteen-year-old
daughter has purchased liquor at the South Hill Liquor Store and is
currently lD treatment. She has heard other minors also purchased liquor
there. A woman asked Ms. Flattum why she didn't call the liquor store and
complain. Irs. Flattum did not think this would do any good.
Karl Ranum stated general concern that Mr. Meister be treated fairly,
questioned haw many other violations have happened in the last five years,
how many haye resulted in a review and what penalties were issued.

City Attorney Magnuson discu sed past incidents and some changes in the

Don Roach, 14355 No. 15th St , stated he has seen Mr. Meister "card" young
people coming into the store and asked them to leave.
Attorney Simonet stated Mr. rown was not carded on the day in question,
but had been carded in the p st. He requested Council consider all the
testimony.
Mr. Magnuson offered testimo y regarding home deliveries and the
requirement of maintaining r ceipts for these. Mr. Roberts, Minn. Liquor
Control, checked records of orne deliveries for the South Hill Liquor
Store and found no records. He reported on the procedures for licensing
Off-Sale liquor stores. May r Abrahamson closed the hearing.
Council summarization and di cussion followed.
Moti on by Councilmember Bodl ovi c , seconded by Councilmember Opheim to suspend
the liquor license of Meister1s outh Hill Liquor Store for three days
beginning on Wednesday, April 5, 1989 and continuing through Friday, April 7,
1989. (All in favor).
Discussion ensued regarding mending the motion to include a written
findings of fact. Mr. Simon t, representing Mr. Meister, stated they
would waive the findings of act and accept the motion as it stands.

1. Ron Schoenborn - Request permanent barrier to eliminate access from So.
Hemlock St. to Lily Lake.
Mr. Schoenborn was in the audience stating his request for a barrier to
eliminate vehicle access from So. Hemlock St. to Lily Lake because of
erosion and also, he does not see the need for two ~ntrance~ onto the lake.
The barrier would allow access for fishing, canoeing and snowmobiling.
Discussion included the request for vacation of the roadway in 1983.

the attendance of two Heritage Preservation Commission members at a workshop
on April 15 at a cost of $12.00 per person. (All in favor).
5. Parks Department -
Permit to Consume - French Canadian Society of Mn.
Motion by Councilmember Bodlovick, seconded by Councilmember Kimble to
authorize a Permit to Consume for the French Canadian Society of Minnesota
picnic at Pioneer Park on July 16, 1989, noon to 5:00 P.M.; and requiring a
Police Officer to be present. (All in favor).

Motion by Councilmember Opheim, seconded by Councilmember Kimble to approve
the advertisement for bids for relamping the lighting system for Northland
Parks tennis courts and hockey rink. (All in favor).

6. Consulting Engineer -
L.l. 253, Third & Orleans Streets improvements
Mr. Moore presented a report on L.l. 253, Third and Orleans St.
improvements, stating the total cost will be $1,021,803. Since this is a
county highway, Washington County will share the costs.
Motion by Councilmember Bodlovick, seconded by Countilmember Farrell to adopt
the appropriate resolution receiving the Feasibility Report & ordering the
hearing on Local Improvement No. 253, for Third St. and Orleans St. to be held
on April 18, 1989. (Resolution No. 8052)
Ayes ~ Councilmembers Bodlovick, Farrell, Kimble, Opheim and Mayor Abrahamson.
Nays - None
Mr. Moore reported that as part of the turn-back procedure, Washington Co.
would provide the cost of an overlay & patching on Burlington & 4th Ave.
He recommended to Council that they request an agreement with the County
whereby the County would provide the funds to the City so the City would
be able to overlay them at a later date and not at this time. No action
was taken.
7. Fire Dept. -
Fire Contracts with Townships
Motion by Councilmember Bodlovick, seconded by Councilmember Kimble to
authorize the Fire Chief to meet with Stillwater, Grant and May Townships to
discuss their Fire Contracts with the City of Stillwater. (All in favor).

conditioned, Jeffrey Palmer, Applicant. Case No. V/89-19. (All in favor).

the rear and sideyard setback requirements and lot size requirements for
the conversion of a single family residence to a duplex at 301 W. Myrtle
St. in the ROM Multi-Family Residential Dist., Patrick Mulvehill,
Applicant. Case No. V/89-20.

Mr. Russell described the request to construct a second dwelling unit by
adding a two-story addition on an existing office space (converted garage)
and connecting that addition to the existing house and constructing a new
two-stall garage. Mr. Fontaine stated the Planning Commission felt this
was a special case since the surrounding area allows a smaller lot Size.

Zoning Ordinance Amendment changing the zoning designation of land in the
North Main St. area from lA, General Light Industrial and IB, General
Heavy Industrial, to CBO, Central Business Dist., City of Stillwater,

Mr. Russell explained this is the second part of the previous ordinance
which changes the CA General Commercial Zoning Dist regulations in the
Downtown to a CBO Central Business Oist. designation. Mr. Fontaine added
that the Planning Commission unanimously approved the request.
A gentleman, representing Maple Island, stated they are planning some
changes, such as parking lot revamping and an elevator to the second
floor, and wondered if this would present some problems with the new
ordinance. Mr. Russell stated, if the use does not intensify, perhaps it
could be allowed with this regulation or permitted by variance. Mayor
. Abrahamson closed the hearing.

and Criteria.

City Attorney Magnuson presented the background for the changes to this
ordinance. He added that changes were incorporated as suggested by the
DNR and Minn/Wisc. Boundary Area Comm. Dan McGuiness, representing the
Commission, recommended that the Council go down river and actually look
at the property from the river side. Further discussion followed. Mayor
Abrahamson closed the hearing.

City Attorney Magnuson explained the present agreement between the City
and the Community Access Corp. for cablecasting meetings. Mr. Kriesel
reported that the Joint Cable Communication Commission will be
cablecasting Council Meetings at no charge and added he has discussed
discontination of the Corporation services for cablecasting.
Motion by Councilmember Bodlovick, seconded by Councilmember Kimble directing
Staff to give a thirty-day notification to the St. Croix Valley Community
Access Corp., Inc. that the City is discontinuing the contract regarding
cablecasting of Council meetings. (All in favor).

Opinion - Gambling Operations
Mr. Magnuson presented an opinion for Public Safety Director Mawhorter
regarding gambling operations on leased premises and that the equipment of
the charitable gambling tenant should be kept separate from the landlord1s
business activity, but no statute prohibits an employee of the bar from
making a sale of the charitable gambling devices.
First reading of Ordinance amending Contractor's License, Chap. 41.01,
Subd. 3
Mr. Magnuson explained the present ordinance is not up-to-date regarding
limits of coverage for Contractor1s insurance and recommended an
amendment.

We have the full endorsement of the Downtown Cuuncil
and the Stillwater Area Chamber of Commerce and we have
been communicating with the Stillwater Police Department
about this event. We .forsee no problems.

Final completion is set for October 15, 1989.

to the Contract Documents prepared by Short-Elliott-Hendrickson,
Inc., 222 East Little Canada Road, st. Paul, Minnesota 55117,
dated April 18, 1989.
Bid forms and Contract Documents may be seen at the office of the
City Clerk, and at the office of the above-named Engineers.
Contractors desiring a copy of the Bid Forms and Contract Documents
may obtain them from the office of the above-named Engineers in
accord with the Instructions to Bidders upon payment of $25.00/Set.
Checks should be made out to Short-Elliott-Hendrickson, Inc. No
refunds will be provided.
Bid security in the amount of 10% of the bid must accompany each
bid in accord with the Instructions to Bidders.
Bids shall be directed to the City Administrator, securely sealed
and endorsed upon the outside wrapper, "BID FOR IMPROVEMENT NO. 255
SUNSET RIDGE ESTATES.
The City Council reserves the right to reject any and all bids, to

DEVELOPMENT APPLICATION.
A combined application has been prepar~d for State
Community Development Grant Assistance. The three projects
are for purchase of Mulberry Point, to provide sewer
service to areas of the North Hill and for rehabilitation
assistance for Downtown buildings.

The State has a new process for evaluating community
development applications this year. Based on this initial
assistance request, they will indicate if the request is
likely to get assistance and inform the community what
additional information is necessary. The projects being
submitted for assistance are improvements called for in the
Downtown Plan or are established City needs. If the
projects are preliminarly approved, a final application
will be prepared by September with funding available in
February 1990.

This project entails the purchase of 1,6 acres of land located along the
St, Croix River, a designated wild and scenic river, for an extension of
Lowell Park and part of the City riverway, open space and park system,
The land is currently owned by Burlington Northern Railroad and leased
annually by the City from them for a launch ramp area and support park-
ing, The railroad has recently expressed an interest in developing the
area, The riverside site is in the Flood Plain, and Riverway Blufflandl

EXTENSION OF SEWER SERVICE TO DUTCHTOWN AREA
The Stillwater IIDutchtownll area was originally developed in the early
1900's on small lots with individual on-site sewer systems, A preliminary
windshield survey indicates that many of the residences are in fair to
poor condition, It is probable that the owners cannot afford the cost of
extending to the sewer lines, It may be possible to offer housing
rehabilitation assistance along with the sewer improvement to upgrade
the target area. The area is located adjacent to Brown's Creek which runs
into the St, Croix River. (See attached map,)

Stillwater is one of the older communities in the state, incorporated in
1852, Because of this, much of its infrastructure; i,e, streets, sidewalks,
sanitary and storm sewers, and water lines are in need of improvement and/
or replacement, In the Downtown area particularly inflow and infiltration
is a problem causing surcharge of the sanitary sewer lines with spring
water and water from the high water table along the St, Croix River, As
with the infrastructure, the housing stock in much of, Stillwater is old.
Some areas show signs of neglect and need of maintenance, Maintenance of
the housing stock is important to preserve housing opportunities and
maintain the character of residential areas,
One area where the above mentioned infrastructure and building condition
problems exist is the North Hill "Dutchtown" area, A drive through the
neighborhood indicates many. of the structures are in need of repair. The
houses are on small lots with individual septic systems, Two or three
septic systems peryear have failed for the past three years. Residents appear

Scenic River, Lowell Park runs from the Dock Cafe seven hundred feet
South to Myrtle Street, A 1,6 acre site located along the river in the
Flood Plain separates Lowell Park from the Stillwater Yacht Club, The
land is owned by Burlington Northern Railroad, The Downtown Plan, and
previous Downtown Plans, have designated the site parks as an extension
of Lowell Park. The railroad has indicated they may develop the site,

APPLICANT'S NAME: Martin Withuski
TYPE OF APPLICATION: Special Use Permit for a taxi dispatch office and
garage.
DISCUSSION:
The application is to convert an existing gas station to a taxi dispatch
office and parking area for up to three vehicles.
The application site plan indicates the existing service station structure
will not change. The existing sign, lights, pumps and gas tanks will be
removed, No other changes are proposed.
. The taxi office use does not need the wide driveway~prons of a setvice
station. It is suggested that the Churchill driveway be reduced to twenty four
feet width. The Zoning Ordinance requires that commercial parking areas be
screened from the residential uses. The property to the north'of the office on
South Fourth Street is residential. A six foot wooden fence should be
constructed to the front of the residence, then reduced in height forty-two
inch~s to screen the parking lot from the residential area. Planters or
planting areas could improve the appearance of the site and screen the parking
area from public view. No outside signage is proposed.
RECOMMENDATION: Approval as conditioned.
1. The Churchill Street driveway curb cut shall be reduced to twenty-four
feet and old curb area reconstructed to City standards.
2. A fence shall be constructed along the North property boundary screening
the lot from the residential property to the North (six foot height to
the front of the residence, then forty two inches).
3. Any new signage shall require a sign permit review.
4. This application shall be reviewed on a complaint basis.

meet in the Council Chambers of the City Hall at 216 North Fourth Street, in

an improvement pursuant to Minnesota Statute Sections 429.011 to 429.111.
The improvement will consist of sanitary sewer repair, water services,

JOINT POWERS AGREEMENT AS TO STREET IMPROVEMENT
THIS AGREEMENT by and between the city of Stillwater, a
municipal corporation of the State of Minnesota, hereinafter
called "City", and the County of Washington, a politic and
corporate of the State of Minnesota, hereinafter referred to as
"County" ;
WITNESSETH:
WHEREAS, Orleans Street is the boundary line between
the City of Oak Park Heights and the City of Stillwater, and is
maintained by County as County State Aid Highway (C.S.A.H.) 23
and 24; and
WHEREAS, 3rd st. S. from Orleans Street to Walnut st,
is maintained by County as C.S.A.H. 23; and
WHEREAS, the parties propose to improve and rebuild a
porxion of Orleans Street, a county highway, between South Fourth
Street and Fourth Avenue South; and
WHEREAS, said Orleans Street is in need of rebuilding
and repair from South Forth Street to Fourth Avenue South; and
WHEREAS, said 3rd st. S. is in need of rebuilding and
repair from Orleans st. to Walnut st.
NOW THEREFORE, IT IS AGREED by and between the parties
hereto as follows:

1. The Co nty shall provide for all supervision of
the reconstructi n of aforesaid streets and the call for
bids in accordan with the applicable statutes.
2. That t shall reimburse the County for the
actual construct'on costs of that portion of the storm sewer
costs attributab e to the drainage of the property located
within the City, as such area has been previously
determined, not eirnbursed by the Minnesota Department of
Transportation S ate Aid (estimated at 50%), 100% of
oversizing for 0 tlet beyond C.S.A,H, 23, 100% of the
sidewalk, 100% 0 curb and gutter 100% of Water Services,
and 100% of Sani Sewer within the City. The City shall
reimburse the Co for 100% of additional right-of-way
required within

Actual costs wil be determined by contract costs.

previously issued to you to operate within the City of

AN ORDINANCE AMENDING CHAPTER 41
OF THE STILLWATER CITY CODE,
"LICENSES, PERMITS AND PROHIBITIONS"
The City Council of the City of Stillwater does ordain:
1. Chapter 41.01, Subd. 3 of the Stillwater City Code is
hereby amended to hereafter read as follows:
"41.01, Subd. 3. Application for such license shall be made
to the City Council and shall be granted by the Council upon
proof of applicant's qualifications therefor, and upon filing
with the City Clerk a Certificate of Insurance evidencing
Comprehensive General Liability of Insurance, including products
and completed operations coverage with combined single limits of
at least $30~,000.00, having no exclusions for explosion,
collapse or ~nderground coverage. Such Certificate of Insurance
must provide for notice to the City of cancellation of the same
by the issuin:g agency." .
2. In all other ways, the Stillwater City Code shall
remain in full force and effect.
3. Tbis Ordinance shall be in full force and effect from

Dear Mr. Russell:
In accordance with your instructions, we have reviewed the final
grading and erosion control plan for the proposed Sunset Ridge
Estates addition~ The developers engineer has complied with all
requests made and the preliminary review for the grading plan and
erosion oon~rol. Therefore, we recommend approval of the final
grading plan.
The developer failed to include required right-of-way for the
temporary cUl-de-sac at the south end of the project on his final
plat. We recommend the City consider a reduced cul-de-sac
surfaced diameter ~o 60 feet from the required 90 feet since this
is a ~emporary cul-de-sac. The ci~y can use an 80 foo~ righ~-of-
way this way, and still maintain over 10,000 square feet of area
for ~he two adjacent lots. When Walnut Creek Drive is extended
south in the future, this right-of-way can be vacated. Concrete
curb and gutter will be installed around the cul-de-sac. This
will restrict truck movement at this end of the cul-de-sac.

WEST STILLWATER BUSINESS PARK STUDY
The Planning Commission reviewed this item at their meeting of April 10, 1989
and approved Commission members Jerry Fontaine, Glenn Bealka, Mark Ehlenz, Rob
Hamlin, and Jean Jacobson to the Plan Committee. The Plan Committee would be
comprised of the five Planning Commission members and five planning area
property owners or business owners.
RECOMMENDATION:
Review scope of work and scheduling.
Appoint Plan Committee members.

SCOPE OF WORK FOR
WEST STILLWATER BUSINESS PARK PLAN
BACKGROUND:
Last fall the City Council placed a one year moratorium on certain types of
new development located in portions of the Industrial Park area and directed a
study be prepared to examine the appropriate land use, to formulate design
standards for new development, and to review utilities, road system and
developnent staging needs for the area.
STUDY AREA:
The study area is shown on the attached map. Besides the West portion of the
Stillwater Business Park, two areas of Stillwater Township land are included
in the study area. The Benson farm is completely surrounded by City lands and
is located adjacent to the Stillwater Business area. An area West of County
Road 5 is also in the Township but should be considered when planning in the
City industrial area to the East.
ISSUES AND AREAS TO BE CONSIDERED:

LAND USE - The appropriate land use will be considered for the area.
Currently, much of the area has a land use designation of. Industrial Park and
is zoned Industrial Park Industrial. The zoning district allows for office,
service and some retail uses. The Benson farm is located next to the Pine Tree
Trail residential area, Lily Lake School and the Cottages of Stillwater
residential uses and vacant industrial lands to the South. The area represents
a transition area between residential, industrial, and commercial areas to the
South: The lands West of County Road 5 are currently designated residential. A
pond and drainage way runs through the property. Strip commercial is becoming
established along County Road 5-Croixwood Boulevard to Highway 36. Commercial,
residential and industrial areas will be considered for this area.
UTILITIES - Most of the study area is not serviced by water or sewer services.
However, eventually services will be provided. The timing of services
provision will be considered. Provision of services will be related to staging
of City growth and development.
STREET SYSTEM - The basic street system is in for the area; County Road 5,
Orleans Street, Washington Avenue, Curve Crest Boulevard. The extension of
these street, and service from these streets, will be studied. The plan will
be coordinated with Washington County Public Works regarding County Road 5 and
Mn DOT regarding extension of Curve Crest Boulevard and any Highway 36
Frontage Road.
PARKS AND PUBLIC FACILITIES - The study area includes some of the last
centrally located land that has good potential for public facilities such as
. a community recreation center or fi re stati on. As requi red, park 1 ands will be

provided when residential development occurs. Planning for these park lands
will be considered in the plan.
SITE AND BUILDING DESIGN - The quality of site planning, building design, and
landscaping has been discussed with recent industrial park project reviews.
The study will consider the need for additional design standards and provide
standards for new development as appropriate.
PARTICIPATION IN PLAN DEVELOPMENT:
The Planning Commission will be the City organization that oversees the
development of the plan with assistance from City Staff and the City Engineer.
It is suggested that a Planning Commission Subcommittee made up of five
Commission members plus five property owners, business owners or represented
from groups interested in economic development. Besides the Committee
meetings, public workshops and public hearings will be held to receive public
input if needed.
SCHEDULE:
The plan preparation process began last month with the collection of data and
development of base maps. The Plan Committee will begin meeting in May with
meetings through the fall. The Final Plan should be completed for City Council
consideration by December 1989.
RECOMMENDATION:
Consideration of scope of work for West Stillwater Business Park Plan and
appointment of five members to the Special West Stillwater Business Park Plan
Committee.

RESPONSE TO REQUEST FOR CONSIDERATION OF NORTH SECOND STREET
PARKING IMPROVEMENTS.
The City Council received a letter from Mr. Palmer requesting consideration of
the parking situation along North Second Street between Myrtle and Commercial
Streets. Several parts were mentioned in the letter as follows:
1. Termi nati on of Lowell Inn 1 ease of City 1 and for a parki ng lot (See
Exhibit "A"). .

2. Lowell Inn to purchase a portion of lot 9 for Lowell Inn parking lot.
3. Improvement of City parking lot.
4. Removal of parking meters in front of Lowell Inn for handicapped,
loading or coach loading.
The City's Traffic Engineer has reviewed the request and expressed some
concerns regarding the recommendations for the permanent loss of parking
spaces and hazards for using on-street parking for handicapped spaces.
Regarding points 1, 2, and 3, it is suggested that the City Council consider
improving the City owned parking lot and making it available to the public. 35
to 40 spaces could be provided. The project could be paiafor by adjacent
benefiting property owners and possibly TIF funds available from the TIF
District.
The Downtown Plan locates a City parking lot at the corner of Second and
Mulberry Streets (See Exhibit "B"). The owner of a portion of the site
recently contacted the City and indicated the lot may be available. It is
suggested that City Staff be directed to contact the owners of the North Main
parking lot site regarding purchase of the land for a City parking lot. The
existing City lot and South Main parking site could provide 80 to 100 spaces
and provide sites for possible future parking structures.~
RECOMMENDA TI ON:
Direct Staff to prepare improvement of plans for the existing City parking lot
and Staff to contact the owners of the future City parking lot site regarding
purchase of the land.

Maureen and I have' been actively soliciting new business for the
M::>unt Vernon Wing. We are pleased to rep:>rt significant progress in
our efforts to obtain long-tenn comnitments from multinational compa-
nies. . A preliminary organization plan for the St. Croix Executive
Center has been completed.
. We are now at approximately 20% of the goal established for the fi-
nancial plan. This plan will construct the extensJon to Lowell Inn
according to the final specifications required by the participating
companies.
ParJdng lilprovements
This letter follows consultations with Mr. Russell regarding a number
of recommendations offered herein for improving parking for the
Lowell Inn patrons and the public in the area of North Second Street.
These suggestions are based upon daily observations as well as com-
ments from concerned patrons.
Problem
.
The year around, intermittent traffic congestion and certain parking
use conflicts occurring on North Second Street are worthy of pI arming
and improvement attention. The diversion of a steadily increasing
amount of westbound' traffic from the corner of Main and Chestnut is
having a pervasive effect.

}.s the westbound Myrtle Street traffic increases, there is a
significant slowing of southbound Second Street traffic at the corner
of Myrtle and Second. The lineup in the southbound lane frequently
backs up in front of the Lowell Inn two to four car lengths at a
time. In addition, Lo\>Jell Inn guest autorrobile loading/unloading and
truck deliveries reduce the two-lane Second Street traffic to
one-lane thereby aggravating the congestion.
Observations
I have asked Mr. Russell to apply his experience and expertise to a
comprehensive review of the functions and general quality of the
parking in this area with proper emphasis given to the I
(i) impact upon Second Street two-way traffic as a result of
the Lowell Inn traffic and parking activity
(daytime/nighttime tI1lck, coach, litrousine and
handicapped loading and unloading),
(ii )
(iii)
. (iv)
(v)
varying types of public and Lowell Inn uses being imposed
at varying, often conflicting, times,
benefits of balancing use and demand between the public
and the Lowell Inn,
benefits of improving surfacing, striping and lighting,
safety/security issues related to pedestrians and ve-
hicles, departing/arriving congestion and autorrobile
parking in the lots north of the Lowell Inn,
(vi) opportunities for self-mariagement of uEilization, and
(vii) curbing, or at least discouraging, abusive public use.
Reccmnendations
Six suggestions are offered for consideration:
1. Tennination of Lowell Inn parking lease of lots 6, 7 and 8
Block 19, City of Stillwater and maintenance assumed by City.
2. Purchase of the North portion of lot 9 owned by the City (now
abandoned by the Stillwater Water Department).
3. Improvements to City Parking area (lots 6, 7 and 8),

- Addition of day rate parking meters.
- Addition of boundary fence, lighting and entry signage,
- Blacktop resurfacing and striping.

side of North Second Street and replacement with multiple use

parking area to North Second Street.
Attached is a schematic outlining the relocation of parking utiliza-
tion on North Second Street and signage descriptions suggested from
the meetings with Mr, Russell, If authorized by the Council, Mr .
Russell indicated he will prepare a report for the council in respect
to the problems and opportunities outlined herein. .
Your attention to this matter and cooperation in a public interest
resolution of this opportunity for significant improvement to public
and private parking in this area will be appreciated.

Dear Steve:
. A number of suggested parking changes were made by Arthur Palmer
of the Lowell Inn in a February 7 letter. You and I have had an
opportunity to discuss some of the matters in conjunction with
the overall parking management concepts for the downtown area.
Mr. Palmer's letter offered suggestions for modifications to
pa;king lots near the Lowell Inn and to on street parking on N.
2nd Street. The on street parking issues can perhaps be
discussed separate from his suggestions for off street parking.
Mr. Palmer suggested removing several parking meters and
establishing two handicap parking zones on the street, a coach
and limousine loading and unloading zone, a truck loading zone
and elimination of some spaces. We have previously discussed
some of the concerns of the Lowell Inn relative to bus parking
and loading problems at the Lowell Inn.
Moving the handicap parking spaces creates some problems. We are
required by the state to provide a specific number of handicap
spaces in every off street parking lot depending upon the number
of spaces. Thus, we can not arbitrarily remove handicap spaces
from a public off street parking facility.

The concept of providing a handicap space is to provide ease of
access to the sidewalk system and adjacent pedestrian generators
such as businesses. The guidelines for handicap parking
specifically indicate that there should be direct access to such
a system. There must also be an area for the handicap individual
to get into and out of the vehicle. This is the reason for the
12 foot wide parking space. By placing a handicap zone on the
street, we run into two distinct problems. There is no specific
loading or unloading area for the handicapped individual. If the
driver is a handicap person, he must load or unload directly into
the travel lane of North 2nd Street. A second concern is a
necessi ty of providing a direct access to .the sidewalk system
meaning that there must be handicapped ramps provided directly
adjacent to the space.
For these reasons, we are reluctant to agree to move the handicap
spaces as suggested by Mr. Palmer.
We have previously discussed some of the loading and unloading
problems faced by buses. We have suggested that the Lowell Inn
be provided with some bags to be placed over the parking meters.
When a bus is anticipated, the parking meters could be bagged
early in the day so that the bus may have a loading and unloading
area. The only problems associated with this would be
unanticipated arrivals and the necessity of removing parking
sppces for an hour or two in advance of the actual arrival of the
bus. However, by making the loading and unloading zone a 24 hour
system, the spaces are permanently removed from public use.
I believe the City already has some guidelines for establishment
of truck loading and unloading zones.
We have also observed some of the double parking for loading of
passengers into automobiles in front of the Lowell Inn. We have
also seen similar double parking on Main street in front of
Vi ttorio' s and at Brick Alley, on Main street and on Myrtle
street for the Senior Citizens Center and at other locations to a
lesser degree. A truck loading zone at location A or location A
and B as shown on Mr. Palmers layout might double as a location
for automobile drivers to pick up passengers. However, the City
should carefully consider other requests from other locations for
this type of a loading zone.
We would recommend against any change in the handicap parking
arrangement. We are also reluctant to consider a limousine
loading and unloading zone. The truck loading and unloading zone
issue could be settled probably using existing policies.

Stillwater that an ordinance amendment has been adopted by the
City Council amending the Stillwater City Code by amending
Section 31.03, The Riverway Bluffland and Shoreland Ordinance,
and that the Council by four-fifths of its members, does find
that the attached Title and Summary of the ordinance as prepared
by the City Attorney, does clearly inform the public of the
intent and effect of the ordinance and the form of publication is
approved. This action is given as required by the Stillwater

1.' This ordinance provides for the procedure to be used
and the standards to be applied to Development and redevelopment
in the Riverway Bluffland and Shore~and District by:

bluffland and shore land of the Lower st. Croix River.

As a new resident and homeowner to the City of Stillwater, I would like to
introduce myself. My wife and I spent several years looking for a home in
Stillwater and in November of 1988 we purchased a home and relocated here.
It has been a very enjoyable and delightful six months and we are looking
forward to many~ many more!

In addition, we recently purchased several parcels of commerical property,
located at 212 and 214 North Main Street. We are anxious in becoming a part
of the Stillwater Downtown Association too. As part and parcel of being a
resident, property owner, business owner and a responsible citizen of Stillwater
I want to express several immediate concerns;
1. The condition of the "cartaie easement", or "alley" as my
uemory serves, located at the rear of 212 and 214 North
Main. Junk autos, debris strewn from one-end-the-other
and wanton public parking.
I called this to the attention of our City Inspector, Mr.
Junker, and the junk auto was removed. However, the debris
and parking continues to persist. We will being doing some
remodeling/renovation and are going to hav~ to have complete
access to the building. The spring clean-up campaign would
he a good time to ear-mark the area for a specific cleaning
hy the adiacent property owners.
2. The lot 214 North Main suffers from a different affliction,
it has been used as "berthing" area for a servicing tractor/
trailer. Upon departing the area it has wreaked havoc with
sidewalk plates and curbing at streetside. Not to mention the
-loading" and "defrosting" problems with the soil. This has
been called to the attention of our police and the situation
has improved, but requires a long term solution as the size
vehicle in the space available is not compatible.

Anything that we can do to assist in cleaning-up, removal of debris, parking
controls, etc. we would be happy to discuss and are open to any or all

The ad hoc Property Tax Impact Committee, co-chaired by Larry
Bakken and Jim Prosser, has been working to make property taxes
more understandable. The Committee has designed a set of
questions and answers intended to explain the changes in the
metro-area property taxes, complete with graphs.
The enclosed article has been produced by the Committee for
distribution by our member cities. If you think that it applies
to your city, please feel free to include it in your city's
newsletter, newspaper, et cetera.
The same information will also be presented in a tri-fold
brochure. At least twenty brochures will be mailed to you next
week.
We have also enclosed a sample of what West St. Paul and
Minnetonka have done with property taxes in their newsletters.

Made Understandable
City, county, and school officials are increasingly concerned about legislative changes in the property tax
system. For many years local governments have relied upon property tax to fund a significant portion of
the services they provide for their constituents. Recent changes in the tax and aid programs provided to local
governments, are placing greater tax burdens on metro area homeowners. Ultimately, these taxpayers must
decide whether this trend is acceptable or not. City, county, and school officials are concerned that if this
trend continues many taxpayers will be unable to pay these higher taxes.
The following are common questions about the tax dilemma and responses to clarify the situation.
Q The Legislature has made a number of changes
over the past two years to the state's property tax
system. I also understand the Legislature has also
changed the formula for aid to schools and cities.
What impact will these changes have on the average
household?
Q Let me get this'straight. Even though we will
be paying more property taxes, we will not necessar-
ily receive proportionally more in services by our
city and school district?

A No, not if you live in the metro area.
A Unfortunately, the combined effect of all the
changes made by the Legislature will increase prop-
erty taxes for most homeowners in the metropolitan

A Local governments get most of their money
from property taxes and state aid. State aid is a
partial return of money generated through state sales
and income tax. Sales taxes were initially approved
to reduce local property taxes. Most cities and
schools in the metro area are receiving less, or at
best, only slightly more aids than they have received
in past years. Therefore, in order to maintain the
. same level of services and education, they must
raise property taxes to make up for the loss in state
aid.

METRiO AREA SUBURBAN TAXES GOING UP
Many suburban homeowners will get a nasty jolt when they open
.1989 property tax bills, duetlo action taken by the 1987 and
legislatures. Because stateinancial aid, derived principally
from income and sales tax, is beillg cut to many suburban school
districts, they must raise their property tax levies just to stay even.
The West St. Paul schools are projected to lose $1,263,766 in aid,
because this is considered a "ricK" district. Fortunately, state aid to
this city government was increased. sufficiently to allow a decrease
in city government tax millage, forthe fourth year in a row. There is
much concern about funding fori:lture years, especially since the
"homestead credit" has been abolished for 1990, and will be re-
placed by another formula.
Consider the following facts we obtained from State and League of
Cities documents: Our city, which is perenially in the Citizens
League standings as one of the five lowest-taxed cities in the Metro
area, has a total 1988 property ta burden of $14,518,237, None of
the three outstate cities in the 18.000 population range have pro-
perty tax burdens higher than $11,,588',455, because they receive so
much state aid. Per capita, those cities get state Local Government
Aid of $99, $139, and $136compamdto$70 in West St. Paul. Faced
with this disparity in state aid, lie Legislature acted to increase
the difference.

For 1989, the cities of our population size (Owatonna, Hibbing, and
Albert Lea) outstate will receive $160, $331 , and $206, respectively,
while West St. Paul will receive $91 per capita. Remember that every
$1 per capita means over $18,000 in state tax money directed to
each of the above cities! Aid payments to non-Metro cities were
increased an average of 62%, and although aid to Metro area cities
was increased an average of 27%, most of that money went to Min-
neapolis and St. Paul (who will get per capita payments of $127 and
$185, respectively), leaving some suburbs with increases of as little
as 2%.
All these state decisions have combined to raise suburban property
taxes. The increase in Metro area residential homesteaded taxes is
expected to average 10.6%, with some suburbs expecting increas-
es of 30% or more. It will be interesting to see what happens if these
predictions come true, especially since not everyone who happens
to live in a suburb is rich.

tax "reform" implemented by the
leg slature over the last several years.
Th re are explanations.
rimary is a legislative decision to
re istribute state aids on a propor-
tio ately greater basis to outstate local
go ernments and school districts.
Th result in the metropolitan area,
ge erally, is that these taxing
juri dictions must levy considerably
m re just to maintain spending levels.
Fo example. it is estimated that the
Mi netonka School District's levy for
19 8-89 needs to be increased by
ab ut 15% just to compensate for a
los in state aid. This is not an
ab rration but a well-designed trend.

Make your home fire-
safe for the holidays
The holiday season is a very special
time of year for all of us. However; it
can also bring many serious and
unsuspected fire hazards into your
home. Here are some suggestions to
help make your home fire-safe during
the holiday season.
· Buy only fresh, firm trees.
· Cut off the base of the tree before
setting it in the stand; check water
level daily.
· Locate the tree away from sources of
heat.
· Take the tree down as soon as
possible after the holidays.
· Absolutely never put lighted candles
on or near any evergreen decorations.

Runk Closing
On Friday, April 7, we completed the purchase of the Runk
property, pursuant to City Resolution No. 8044.
The City issued its check in the amount of $75,000 payable to the
Runk estate and in return, received a deed for the property which
I have recorded. The City also paid $965..44 representing taxes
due and payable on the property for the year 1989. The second
half will be due October 15; however, I would recommend a
petition for abatement be prepared to not only abate the taxes
remaining to be paid in 1989, but those payable in 1990.

I advanced the recording fees in the amount of $20 and also a $5
fee payable to the Treasurer for the state Conservation fund. I
will ask for reimbursement for these expenses on my next bill.
The sellers provided a deed at closing, along with copies of
Letters Testamentary authorizing the personal representative to
make the sale. They had previously provided an up-to-date
abstract of title evidencing good title which I will retain here
in my file until I receive direction from you to do otherwise,
and also a check in the amount of $247.50 r~presenting the state
deed tax due on the sale which was paid directly to the
Washington County Treasurer and affixed to the deed of transfer
at the recording.
Rent on the property amounts to $140 per month. It was paid to
the personal representative for the month of April and the
personal representative will pay the City 5/30ths of this amount
by separate check. The $140 for the month of May should go to
the City.
I will send a letter to the two tenants telling them that their
tenancy will terminate on the first day of June, which is the
earliest under the law that we would be entitled to evict them.
