The meeting was called to order by Mayor Abrahamson.
Present: Councilmembers Bodlovick, Farrell, Kimble, Opheim
and Mayor Abrahamson.
Absent: None

DISCUSSION - RELOCATION OF MUNICIPAL DOCKS
Council held a special meeting for the purpose of hearing
comments from all affected parties regarding the City's dock
permit application and proposed flip-flopping of the
charter/excursion and transient boat docks.
Council heard comments from Mr. Dick Anderson, st. Croix Boat
and Packet Company; Mr. John Easton, Stillwater Dock Company;
and Gary Hanson, attorney representing Mr. Michael McGuire,
o~ner of the Dock Cafe.
Motion by Councilmember Kimble, seconded by Councilmember
Bodlovick to submit the dock permit application as proposed, to
request that the Corp of Engineers determine navigability, and
to request two of the transient slips be used for medium-term
docking. (All in favor)
(Council took a ten minute recess and reconvened at 9:00 p.m.)

City Municipal Building and it took me 12 minutes to get there driving the speed limit.
(2931 Quant Ave. No. is 2-3 blocks north of Pilquist Auto Salvage, south of Bayport.)
The Quant Ave. location will be the one with the locked/inside vehicle storage. They
are going to maintain an office and fenced in impound area at 13601 - 60th Street North,
Stillwatet (behind Jerrys Auto Detail) which will have personnel and wreckers and car
carriers. They are in the process of installing mobile telephones in the trucks for
better communications.
I checked with Stillwater Insurance and found that B & A Towing is insured thru that
agency. Insurance Certificate is attached.
I checked on the trucks that they have and that list (3 sheets) is attached.
A check of their drivers (Drivers license and Criminal Checks) came back as all of them
having valid drivers license and the criminal checks came back on all of them as fTNo
Criminal History Exists or is NondiscloseablelT.
Someone from the towing agency will be at the council meeting on Tuesday 032189 in case
there are any questions.

Raleigh Lines has been bringing tour groups to Stillwater
over the past 15 years. This spring, 1989, we will be
adding a trolley car as part of our tour program, to give
our clientele, as well as tourists visiting Stillwater,
a unique way to view this St. Croix Valley area.
Our plan is to give hourly tours around the Valley,
highlighting some ~f the historical landmarks as well as
the many scenic views of the town and St. Croix River.
Raleigh Lines, Inc. is licensed by the Federal Government
to operate charter bus tours and transportation throughout
the United States. We are also licensed to operate in
both Minnesota and Wisconsin' intrastate regular route
service. We are fully insured and carry a minimum of
$5,000,000.00 public liability insurance.
We have reached an agreement with Bob Sabes, owner of
the Freight House, to operate a ticket booth on
Freight House property. He has also agreed to allow
us to load passengers on his property, adjacent to the
Freight House sign. We are prepared to discuss other
options with the City Council.
Future plans include working with the City of Stillwater
to develop a Trolley Route, providing regular route service
for tourists and residents, connecting upper Stillwater
with the downtown Stillwater area, including hotels,
points of interest, parking lots, etc.

The undersigned represents two (2) property owners in the area of
the proposed construction of 61st Avenue and Tuenge Drive in the
Forest Hills Frontage Road and South Greeley area improvement
proj~ct.
Greeley Square Partners own property fronting on Greeley street,
PIN number 96-95033-2250A. The Parlay Group, Inc. owns the
property designated as PIN number 96-95033-2250B, which is
directly behind Greeley Square Center. My clients have been
presented with an agreement to waive irregularities in the
assessment process and to agree to the assessment figure prior to
the commencement of construction of this sewer, water, drainage
and street project.
My clients are very eager to have this project commenced and wish
to speed the process up in any manner that they can. However, in
reviewing the "mock" assessment prepared by Short, Elliott,
Hendrickson, my clients are at somewhat of a loss to explain why
certain of the benefitted properties have been left out of the
"mock" assessment. The property designated by PIN number 62-
09033-2360A has not been listed in connection with the assessment
for streets, and the property identified by PIN number 62-09033-
2360B has not been included in the assessment for drainage
purposes. My clients are sure this must be an oversight since

both properties are being assessed for the other benefits that
they are receiving. The overall effect of elimination of these
two (2) properties from the assessment impacts the property owned
by Greeley Square Partners in the amount of approximately
$4,000.00, and the Parlay Group, Inc. in the approximate amount
of $7,400.00 based on the determination of costs on an acreage
basis.
As you can see, this has a significant impact on my clients and
would have a significant impact on other property owners in the
area. Therefore, we are aSking the Council to review the "mock"
assessment prepared by Short, Elliott, Hendrickson to correct
this situation.
Enclosed are the Waiver Agreements signed by my respective
clients. The estimate for 2250A would be approximately
$17,600.00 and for 2250B would be approximately $112,500.00.
If you have further questions, my clients and I would look
forward to the opportunity to discuss this furthe~, either
individually or to the Council as a whole.

As you requested, the sanitary sewer on Fairmeadows Road was _' .
t-elevised on February 16, 1989. Video tapes were made by the
televising contractor and a written report, which is in the
_._.__.~~~_~~~__~.~~~_~...Department. __~____.__._.._ .,._____..___ ..__' .._._
The televising began at the dead end;manhole on Fairmeadows Road
just east of Darrel Court. The segment of sewer between this
dead end manhole and Laurie Lane is approximately 230 feet long.
There are three services connected in this segment, but no
cra.cked pipe, roots, or any other problems were identified by
televising. The pipe was clean and seemed to be free of debris.
The segment of sewer between Laurie Lane and Laurie Court is
approximately 95 feet in length. There is one service in this
!:~ae:h to the north side. This serviqe was plugged with roots.
The most efficient way to clean roots' out of services is to go
from the floor drain out to the wye connection in the sewer main
wi th a root cutter. This should be done by private companies
since they would have to have permission and enter upon private
property to perform this service. There is also roots in the
main line joints that were protruding through. Since the Public
Works Sewer Maintenance crew had already gone through the main
line with a root cutter, these roots were in the range from light
to medium and primarily hanging down f~om the top of the joint in

Permit fees on Washington County Courthouse.
When the esisting addition was added to the Washington County
Courthouse in 1984, the City contracted with Washington County to do
the plan review and inspections. The contract called for the County
to obtain necessary permits at normal costs, and the City would
contract with the County to do the services on the construction for
an hourly fee, the total of which could not exceed 90~ of the permit
fees. The remaining 10~ paid for my overseeing the plan review and
periodic inspections as well as progress reports to review. This
system worked quite well and the City did not lose financially.

Accompanying this memo are the employment agreements for steve Russell and Dave
Mawhorter. The agreements need to be amended to include the new work hours for
exempt employees. The new work hours are 8:00 a.m. - 4:'30 p.m. (Article 3-1,
page 3-1).

other benefits or would be subject to certain provisions of the policy that are
considered benefits such as family care leave, funeral leave, parental leave and
compensatory leave. Provisions for sick leave, vacation, severance pay, holidays

agreements would contFol. Steve and Dave are requesting that there agreements
be modified to include the same benefits that the other exempt employees receive
(except that Steve would like to retain the language in his agreement pertaining
to vacation).

I want to thank you for your September 7, 1988 letter. As Chairman of the Park
and Recreation Commission, I appreciate your interest in the development of a
park at Owens street and McKusick Road . .
I regret the delay of my response, however, I am pleased to be able to inform
you that this area has been approved by the City Council for 'improvement.
At their December 3rd Council Meeting, approval was given to a plan submitted
by the Commission which included parking, landscaping, a picnic area, playground
equipment and a canal access.
Since this was not anticipated at the time the 1989 Budget was prepared, no
special funds were allocated. The Parks Department was authorized to proceed
when, .and if, a funding source can be identified. Sources of funding are being
explored at this time and, of course, donations are always welcome. We hope to
gain funding and develop this park in 1989.
Again, thank you for your interest in our City's Parks. We are enthusiastic
about this project and are sure this will be a great improvement to the Lake
McKusick Area.

The township of Stillwater requested that any existing easements relative to Browns
Creeks not be vacated.

Browns Creek is an amenity to the area. The 1910 easement provides a public
interest over a 33 foot wide strip of Land coincident with the Creek. Such public
interest should be maintained until ultimate land usage is firmly fixed. The
proper time to review any easement will be sometime in the future when platting for
ultimate usage is reviewed. Until that time it would be inappropriate and -
premature to vacate the easement.

Modification of Development Concept for twenty-seven (27) zero lot line
townhouse units and Preliminary Final Plat Approval.
Discussion:
The request is to change the development concept of The Greens on Oak Glen
from an attached condominium concept similar to the Oak Glen Townhouse
Development and first addition of Greens to a zero lot line single-family
detached development. On September 15, 1987, the City Council approved a
request by J.B. Franklin Corporation to modify the arrangement of the attached
townhouse units for multi-family housing on Outlot "C". At that meeting, the
Council approved the modification with conditions as indicated in the attached
report. The Concept Amendment was for eighty-four (84) units (sixteen four
unit structures, three six unit structures, and one two unit structure). The
area that is being considered for Greens Townhomes on Oak Glen Second and
Thira Additions was configured as eight four unit structures or thirty six
residential units. (See attached plans.) The current request for that area is
for twenty seven detached single family units with individual lot areas of
3,777 to 6,045 square feet.
Besides the change in development concept, there will need to be some
modifications in the grading plan, utility plan, and necessary easements. The
City Public Works Department, Fire Department, Water Department, and City
Engineer have met with the Developer to go over changes that will be necessary
before a Final Plat is approved and development can begin. Oak Glen
Development and adjacent townhouse owners have been notified of the meeting.
Recommendation:
Review of change in Development Concept.
Necessary Finding:
The change in Development Concept is consistent with the original Oak Glen PUO
. approval and will not adversely affect the surrounding area.

. CONDITIONS OF APPROVAL:
1. The five conditions of approval listed in the City Council Staff Report
of September 11, 1987 regarding setbacks, easements, and parking shall
be met.
2. All recommendations requiring water, sewer, and drainage improvement
modifications shall be constructed and accepted by the City before
building permits are issued.
3. All necessary utility easements are provided or vacated and shown on
the Final Plat.
4. A grading permit is required for all grading activity. The grading plan
shall show how drainage will be directed away from zero lot line
properties and necessary drainage easements provided.
5. Codes, covenants, and restrictions for maintenance of the common area
shall provide for the maintenance of such area. The codes, covenants
and restrictions shall be reviewed by the City before building permits
are issued.

J.B. Franklin Corporation is purchasing a portion of the land planned for
townhouse development in the Oak Glen PUD. They would like the City to review
their concept site plan and building design so they can begin marketing and
preparing plans for development.
The site plan shows 84 units - (16) four unit structures, (3) Six unit
structures and (1) two unit structure. The design of the units are similar to
the Rosehill plans attached. The Developer has indicated the price range would
be around $120,000 and up. No.set~acks are ,dimentional on the plans or parking
spaces allocated.
It is suggested that with this concept review, setback and parking
requirements for the project be established so they can be used to draw the
final plans. It is recommended the following setbacks be established.
1...25 foot setback from rear (Golf Course) property line.
2. 20 feet from front (street) property line.
3. 30 feet setback along McKusick Road.
4. Four parking spaces per residential unit, two covered.
5. Easements for all utilities shall be provided as shown on the
preliminary plat.

Dear State Review Board:
The Stillwater City Council and Heritage Preservation Commission heartily
endorses the nomination of the Stillwater Bridge over the St. Croix River,
Stillwater, Minnesota, to the National Register of Historic Places.
The Stillwater Bridge has become one of the most enduring images of our
community. The City's intent is to make it a pivotal structure in the proposed
Stillwater Commercial Historic District.
As early as 1849 our tommunity was crossing the river,-in this general
vicinity, by toll ferry. By 1879, a wooden pontoon bridge was built to supply
the ~ransportation needs of this expanding community. After studying Mulberry,
Myrtle, Chestnut and Nelson Streets as possible locations for the pontoon
bridge, the Chestnut Street location was selected. In the late 1920.s, the
Chestnut Street location was selected over the suggested Myrtle Street site
for the construction of a new lift bridge to replace the now old and
deteriorating wood pontoon bridge.

On the first of July, 1931, gala ceremonies dedicated the New Interstate
Bridge at Stillwater. Dignitaries from Wisconsin and Minnesota spoke to the
15,000 assembled for the dedication. The bridge was a symbol of a forward
looking, progressive community that would pull itself out of a world-wide
depression, "whose "destiny lies eastward over the Wisconsin hills", and whose
"commercial and social influence will be limited only by its energy,
enterprise, and diplomacy". The quotations were from the dedication speech of
General Immell, who represented Wisconsin Governor LaFollette.
Again, let the City of Stillwater lend its hearty endorsement to the
nomination of the Stillwater Bridge to the National Register of Historic
Places.

Economic Development Authority
The Enclosed Resolution authorizes the creation of an Economic
Development Authorit. The Statutes require a public hearing
preceded by the proper publication of notice, and a copy of the
Notice is included. It must be published twice, on two
consecutive weeks; the first publication must appear not more
than thirty days from the date of the public hearing..
The enclosed Ordinance must be used to transfer authority from
the Washington County Housing and Redevelopment Authority to the
City and can be changed or modified before adoption based upon
what particular powers the City wishes to exercise and which they
would like the Housing and Redevelopment Authority of Washington
County to retain.
After the Economic Redevelopment Authority is created, it must
adopt Bylaws and Rules, and elect Officers for carrying out of
its purpose. It must appoint a Treasurer and a Depository and
comply with other reporting Rules that are part of the Statute
allowing for the creation of the Authority.
While the Authority has many interesting powers, one that might
provide immediate interest to the City is the authorization for a
.75 mill levy for benefit of Authority that is not subject to
levy limits. The Authority may also authorize the issuance of
revenue bonds to construct and improve buildings and pledge the
income from the buildings to the retirement of the revenue bonds.
These bonds do not pledge the full faith and credit of the City.
The Authority may also issue general obligation bonds that are
backed by the full faith and credit of the City that are due in
not more than three years and not more than twenty years from the
date of issuance. The Authority may also operate and maintain
public parking facilities or other public facilities in the City
needed to promote development in an Economic Development
District. I would recommend that the Council direct the staff to
explore all of the ways in which the Economic Development
Authority could assist in the implementation of the Downtown Plan
and that this information be provided to the Council in a
comprehensive report prior to the hearing on the adoption of the
Economic Development Authority which has been tentatively set for
April 18, 1989.

AN ENABLING RESOLUTION ESTABLISHING AN ECONOMIC
DEVELOPMENT AUTHORITY IN THE CITY OF STILLWATER
THERE IS HEREBY ESTABLISHED in the City of stillwater
pursuant to the terms of Minnesota statutes ~ 469.090 to
~ 469.108 an Economic Authority that will hereafter be known as
the Stillwater Economic Development Authority.
1. POWERS. The Authority shall have without limitation,
all of the powers of an Economic Development Authority contained
in Minnesota statutes ~ 469.090 to ~ 469.108; and all of the
powers, without limitation, of a Housing and Redevelopment
Authority under Minnesota statutes ~ 469.001 to ~ 469.047 or
other law, and of a City under Minnesota statutes ~ 469.124 to
469.134 or other law.
2. Section Powers Not Limited. The Economic Development
Authority shall have none of the limitations of its powers that
are set forth in Minnesota statutes ~ 469.092.
3. COMMISSIONERS. The members of the City Council shall
serve as the Commissioners. A vacancy is created in the
membership of the Authority when a City Council member of the
Authority ends Council membership. The term of each Commissioner
shall coincide with the term of office of the member of the City
Council.

The City Council of the City of Stillwater does ordain:
1. Transfer of Authority. From and after April 18, 1989,
the Economic Development Authority of the City of Stillwater
shall assume exclusive authority over any economic development,
housing, and redevelopment powers granted to the Economic
Development Authority of the City pursuant to Sections 469.001 to
469.047 and Sections 469.090 to 469.108 of the Minnesota
statutes, except as bereinafter set forth in this ordinance.
2. Authority Retained. The Washington County Housing and
Revelopment Authority shall retain all economic development,
housing, and redevelopment powers available to it under Minnesota
statutes Section 469.001 to 469.047 with respect to any project
initiated by them prior to April 18, 1989, and also with respect
to any contract executed before April 18, 1989. It shall also
retain the authority to administer a housing program for the "City
of Stillwater as evidenced by an Agreement between the City of
Stillwater and the Washington County Housing Development
Authority dated , 1988.
3. Limi ts. The transfer of authority set forth in this
Ordinance from the Washington County Housing and Redevelopment
Authority to the Economic Development Authority of the City of
Stillwater shall not be applied in a manner that impairs the
security of any bonds issued or contracts executed to the
detriment of the holder. of the bonds or obligations of any
contracting party.

REQUEST FOR BILLIARD HALL IN EXISTING STRUCTURE LOCATED AT 201 NORTH
SECOND STREET (OLD CONNCO SHOE BUILDING). CASE NO. PR/89-23.
The City has received a request to locate a billiard hall in an existing
structure at 201 North Second Street. Amusement and recreational uses are
permitted in the CA General Commercial District. The use would include 20 pool
tables and 10 to 15 video games and lounge housed in the 7,000 square foot
of building. The Zoning Ordinance requires City Council review of parking
provided for the use. No parking spaces are proposed for the pool hall use.
The applicant indicates that ample on-street and publiclot parking exists in
the area. The estimated parki"g requirements for the use is 40-50 spaces.
Recently the Ci~y has received complaints regarding a parking shortage in the
area.
It is suggested that the City Council revi ew the request and refer it to the
City Traffic Engineer and Planning Commission for review and recommendation.
RECO~MENDATION:
City Council to review the request and refer to Planning Commission for review
of parking situation for the use and area.

parking may be an issue. We have studied the area and find there
exists ample on street and public lot parking. Rocket Billiards
operates a Billiard Hall and Game Room at 273 West 7th Street, St.
Fau~, Minnesota witb, approximately 7000 square feet of space.
There exists very little parking at the location, but we find that
very few client8le drive alone, therefore, reducing the need for
a great deal of parking. We find that 90%, of our clientele, do
r.ot drive alone to the location. Busses, cabs, bikes and
rideshare are used. We would be more than willing to discuss any
foreseen parking problems, ~ith the Council, at your convenience.
E) Signage - At present, Rocket Billiards would only he utilizing
neon signs within the building. No exterior signage is needed at
present.

MWCC wages as ault on odor
YOU can't see it, hear it or touch it --
but people who live near some
Metropolitan Waste Control Commission
(MWCC) wastewater treatment plants
claim it bothers them nonetheless. "It" is
odor.
"Odor is definitely the problem of the
80's for wastewater treatment plants,"
sai Jim Corcoran, assistant director of
op rations for MWCC's regional plants.
"H using development has moved

more aware of the environment than
used to be."

pI ints about odor problems last sum-
m . "The lack of rainwater, plus the
ele ated temperatures caused more
hy ogen sulfide-producing bacteria to
gr w. The bacteria produce odors that
s lllike rotten eggs," said Corcoran.

pr blem and make recommendations.

co plaints. A crisis task force is

in problems at MWCC lift stations (the

pu ps wastewater), meter stations (sites
w ere wastewater flows are measured),

cl de temporary covers for some treat-
m nt tanks, installing odor scrubbing
sy tems, planting fragrant trees and
ev n adding a chemical perfume to
" ask" unpleasant odors. A third group
is xamining long-term technical solu-
ti. to odor problems.
CC officials admit that solutions to
odor problem may take time. "In
y cases, people assume the technol-
o is there and we should be putting it
in place," said MWCC Process As-
su ance Manager Bryce Pickart. 'The
te lmology is there to do a pretty good
'jo of odor control, but not to the point
of eliminating odors."

Hastings Wastewater Treatment
Plant. The MWCC has hired a consult-
ant to design covers and odor scrubbing
equipment for aeration tanks. The aera-
tion tanks have been identified as a
major source of odor. The MWCC will
also install a new digester gas burner
designed to destroy the odor-producing
hydrogen sulfide.
Stillwater Wastewater Treatment
Plant. The MWCC plans a major plant
-renovation project starting in 1992. In
the meantime, the MWCC is construct-
ing a building to temporarily house its
sludge load-out (the place where sludge
is fed into trucks before it is hauled
away). The MWCC is designing a
scrubbing device for an air lift pump
used in the treatment process. MWCC
also plans to install a new digester gas
burner to destroy hydrogen sulfide.
Seneca Wastewater Treatment Plant.
The MWCC plans a major expansion
project to be completed in 1992. As
part of the project, the MWCC has hired
a consultant to study the odor problem.
One possible solution involves adding
chemicals during the wastewater treat-
ment process to help reduce odors. 1bis
solution has already been implemented,
but the consultant is evaluating further
refinements. The MWCC is also design-
ing improvements for a meter station lo-
cated near the Seneca Plant. The im-
provements include the addition of spe-
cial odor scrubbing equipment.
In addition to these efforts, the MWCC
promises routine odor monitoring at
MWCC's 11 treatment plants, 65 lift sta-
tions and 175 meter stations. The
MWCC is also developing an odor
telephone hotline. The 24-hour odor hot-
line will give citizens one centralloca-
tion to report odors.
