SEALCOATING COST OVERAGE
Dick Moore, Choc and myself recently met with employees of Allied Blacktop Co.
regarding the bill they sent to the City for the sealcoat work in 1988. As you
may recall the City was billed as follows:

We disagreed with Allied on the overage (see * - amounts in dispute) because they
were unable to document the need or usage of the extra quantities.
Dick Moore said that it was possible that the actual quantities could exceed
the estimated quantities. However, the excess should not have exceeded the
estimate by more than 10 percent (10%) (Allied's overage amounted to a 19 percent
(19%) overrun). Therefore, as a matter of trying to settle this dispute, I would
recommend that the City pay Allied the following amounts:

The City has already paid Allied $48,580. This would leave a balance due of
$4,801.51. This would put us over budget by $3,381.51 for 1988. However, we
have budgeted $100,000 for 1989 and Choc says we could make up the difference
by spending less in 1989.

TEAK BUILDING WORKSHOP
Arrangements have been made to use the conference room at the Lowell Inn (3rd
floor) for our team building workshop on Saturday, March 4th. Arrival time will
be 8:00 a.m. and the workshop will begin at 8:30 a.m. and finish about 4:30 p.m.
Peter Cotton will have an agenda as well as a summary of last years goals for
the workshop.
Lunch will be in the main dining room of the Lowell Inn and dinner arrangements
can be made during the workshop (i.e., either dinner at the Inn or some other
location) .

Dear Council:
I am currently in the process of purchasing the former Arrow Lumber Yard
on North Main Street. I would like to construct an office building on
the site that will accommodate the long-term needs of my company.
The purchase and construction of this building will require a substantial
investment on my part. The project should greatly enhance the North End
and possibly encourage other development in that part of town. One of the
major draw backs to construction on this site is the large number of
utility lines along North Main Street. My discussion with other property
owners in the area confirms that something should be done to improve the
appearance of North Main Street.
I am requesting that the City give some priority to the removal of these
utilities in the Downtown Plan implementation.

RE: Reduction in Your Share of State Aid Road Funds
Legislation (House File 1749) which was passed in 1988 provided for continuation
of the sharing by the state, counties, and cities of monies transferred from the
Motor Vehicle Excise Tax (MVET) to the Highway User Tax Distribution Fund. That
legislation has a Sunset Clause that will eliminate the counties and cities from
sharing those MVET funds in 1992.
This is a concern to all cities. The figures below will give you an idea of the
losses in State Aid funds for roads that your city will experience after 1991
under the present law. The figures compare funds that are allocated to you in
1989 with the money you would have received in 1989 if the Sunset Clause cutoff
had taken effect in 1989. The actual figures for 1992 are unknown at this time.

Resolution concerning MVET funding. It is forwarded for your information and as
a sample that may be used for your city's consideration of passing a similar
resol1:ltion.
Your assistance in your city's passing and forwarding a similar resolution to
your legislators, and/or other contacts with your legislators. is encouraged.
Passage of legislation to eliminate the Sunset Clause and continue cities
sharing the MVET income for road purposes is important to all cities. Your
efforts will be greatly appreciated.

Dear Mayor:
As you may be aware the Washington County Board of Commissioners has been
designated by the State of Minnesota as the official Board of Health for
Washington County. The Washington County Board took over this function in
October 1977, with adoption of its first Comprehensive Community Health Services
Plan. At all times subsequent to 1977 the County has had an approved health
plan in effect and has maintained its role as the sole health authority for
Washington County. The official agent of the Board of Health is the Washington
County Public Health Department and its Director, Mary Luth.

It has recently come to our attention that some local units of government
may still be appointing a "local health authority or officer". Minn. Stat.
~145A.10, Subd. 2a, "Preemption", states that
"Not later than 365 days after the approval of a community health
plan by the commissioner (of health), any other board of health
within the community health services area for which the plan has
been prepared must cease operation,..."
If you have public health matters relating to your community, those matters
should be brought to the attention of the Washington County Public Health
Department. Health functions carried out by an authority other than the offical
agent of the Washington County Board of Health might be held to be without legal
authority and therefore invalid.

attorney, the County Attorney's Office or the Washington County Department of
Public Health.

RE: DOCK PERMIT APPLICATION
The Corp of Engineers have received letters from various agencies and individuals
commenting on the proposed relocation (flip-flopping) of the charter/excursion
boat docks and the general boat docks. The comments and specifics of the City's
application are summarized below:
City Applications
1. General Boating Dock Permit
a.
To place dock where charter/excursion dock is now
located;
to place a small shelter on the dock;
to have short-term docking (24 hours or less) with
occasional weekend docking (72 hours or less) and a
linli ted number of medium-term docking (2 weeks or less) .
Seasonal or long-term docking would not be allowed.

2. Charter/Excursion Boating Dock Permit
a. To place dock where general boating dock is now located;
b. to provide mooring for three (3) charter/excursion boats
and one (1) floating ticket office vessel;
c. to allow year-round docking; and
d. to allow "chartered" cruises to be the primary business
as long as "walk on" excursion trade is accommodated on
a regularly scheduled basis.

Given the comments above, it appears that almost all of the City's application
request are being objected in some way or the other. I can understand the
objection to the floating ti ket office, the extended mooring time and even the
small shelter on the general boat docks. However, I am somewhat confused about
the flip-flopping of the doc s because that was the primary reason that the City
applied for the permits. Per aps a navigational hazard would be created but this
was never brought up as a pro lem when the flip-flopping was originally conceived
and discussed.
In any event, the Corp of E gineers need to hear from the City regarding the
comments they received. I h ve asked the Corp to give us sometime to discuss
all of the objections that w re raised and they have concurred. However, they
do expect the City to act in a timely fashion. This may be difficult in view
of all of the objections - specially the objections about flip-flopping the
docks. This appears to be t e main problem because I don't think the Corp is
going to ignore the objection to the floating ticket office or the small shelter.
Therefore, I believe it woul be in the best interest of all concerned to have
the City Council call for a eeting on the permit application. The purpose of
the meeting would be to hear comments regarding the fl~p-flopping and to hear
what alternative might be a ailable. The Council could modify the permit
application or reaffirm the plication.

Dear Brian:
Per our telephone conversation earlier this month, the City is reex~n~ng our
application to relocate (flip-flop) the charter/excursion and transient boat
docks. The problem stems from a concern about navigational problems that may
develop due to the relocation of the docks.
The City has scheduled a special meeting for 7:00 p.m., Tuesday, February 28,
1989, at Stillwater City Hall, to discuss this issue with all affected parties.
Although your presence is not specifically requested, please attend if you feel
it is appropriate to do so.

The City is also requesting that the u.s. Army Corp of Engineers delay final
action on our request for at least 30 days (until March 20, 1989). Hopefully,
this will give us enough time to examine the concerns of all parties and bring
this issue to final resolution.
