1. Proclamation - World Peace Day, December 31, 1988
Santa Claus and his Elf presented a Proclamation signed by Governor
Perpich asking all communities to sound sirens and ring bells calling
attention to World Peace Day on December 31, 1988 and requesting the City
of Stillwater to join others in bringing attention to this day.
Metropolitan State Bank of Iowa - appeal of Fire Code violation for Davian
Bldg., 116 So. Greeley St.
Glenn Schumann, representing Metropolitan State Bank of Iowa and Judd
Orff, Manager of the property, explained the changes and corrections made

to the building, request'ng a variance to the section of the code
requiring installation 0 a sprinkler system because of the prohibitive
cost. Mr. Seim, Fire Chief, explained that sprinkling the building would
cost approximately $39,0 0 and that there are enough fire exits for people
to escape. He further sated the Fire Dept. would not endanger the lives
of firemen to save the b ilding without the sprinkler system.
Motion by Councilmember Kimble, seconded by Councilmember Bodlovick to approve
a variance to the Fire Code egarding sprinkling of the Davian Bldg., 116 So.
Greeley St., as requested by Metropolitan State Bank of Iowa, owners of the
building, because of the hig cost of the sprinkler system and that safety can
be accomplished by the exiti g that exists; also with notice that in extreme
fire conditions, where suppr ssion of a fire cannot be accomplished (due to
unsprinkled building) the Fi e Dept. will not risk the lives of their men to
save the property. (All in avor)
3. Sam Griffith, Washin ton Co. HRA - Purchase & Operation of Senior
Citizens' Highrise.
Sam Griffith explained the multi-family housing program and the proposal
of HRA to purchase River own Commons complex. Extensivediscussionensuednn..
regarding property taxes, concern for senior citizens in regard to amount
of rent payments and whether the property would be sold again. Mr.
Griffith explained that the purchase of the property by HRA required .
municipal approval.
Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to hold a
workshop meeting on January 31, 1989 at 4:30 P.M. regarding the possible
purchase of the Rivertown Commons by Washington Co. HRA and the ramifications
to th~ people of Stillwater. (All in favor).

Motion by Councilmember Kim le, seconded by Councilmember Farrell approving
the attendance of Jeff Johnson at a sewer seminar on January 11-13, 1989 at a
cost of $176.00. (All in f vor).
Motion by Councilmember Kim le, seconded by Councilmember Farrell to approve
payment of $20.00 to Mitch aValley, 719 W. Churchill, for Christmas tree
lights rearranged by a city dumptruck. (All in favor).

Motion by Councilmember Far ell, seconded by Councilmember Bodlovick approving
the attendance of two Planning Commissioners at a Lower St. Croix Valley
Workshop meeting at a cost f $15.00 each. (All in favor).

4. Consulting Engineer
Televising of Sanitary Sewer in Fairmeadows Area
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell
authorizing the City Engineer to advertise for quotes for televising of city
sewers in the Fairmeadows area. (All in favor).
Discussion followed regarding the cause for the sewer back-up and what
corrective action might be taken. Also, Council suggested resubmitting
the claims which the insurance company denied and consideration by the
City for payment of the claims.
Motion by Councilmember Kimble, seconded by' Councilmember Opheim to resubmit
claims for sewer back-up in Fairmeadows area to insurance company. (All in
favor. )
John Harri, 301 Laurie Ct., stated the home owner's insurance will not pay
for these damages and the sewer back-up has been a reoccurring problem in
this area. Mr. Kriesel stated they will try to have an answer for this
problem by next Tuesday.
SEH to draft grading plan for the Rose property - Highway 36 Area
Motion by Councilmember Bodlovick, seconded by Councilmember Opheim
authorizing the owners of the Rose property adjacent to Highway 36 to secure
the services of Short-Elliott-Hendrickson to do their grading plan. (All in
favor ).
UNFINISHED BUSINESS
1. R~view, & Resolution Approving INCstar Development Agreement.
Mr. Russell explained the INCstar development and the request for TIF
assistance in the redevelopment district. City Attorney Magnuson
explained the changes in the agreement and the resolution approving the
Development Contract. He recommended that the resolution be adopted.
Motion by Councilmember Bodlovick, seconded by Councilmember Kimble to adopt
the appropriate Resolution approving the Development Agreement for INCStar and
authorizing the Mayor to sign. (Resolution No. 8006)
Ayes - Councilmembers Bodlovick, Farrell, Kimble, Opheim and Mayor Abrahamson.
Nays - None.
Mr. Magnuson advised the Council that Arlin Wellti, of Holmes & Graven,
who has been advising the City regarding Tax Increment Financing for
INCstar, will be moving to another firm. He stated it would be wise to
retain her services in completing the work on the INCstar tax increment
plan s .

the appropriate resolution pproving the request for a minor modification of
the Greens Townhomes Plat. (Resolution No. 8007).

Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to

and Dick Hauer from the Heritage Preservation Comm., Mark Ehlenz from the
Planning Comm., Shawn Drape, and Linda Smith; and Rob Hamlin as Alternate
from the Planning Commissio. (All in favor).

7: Appointment of Members to Library Board (due to resignations).
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to
appoint Mary Ann Engebretson and Mark Anderson to the Stillwater Library
Board. (All in favor)
8. Designation of Legal City Newspaper.
A short discussion followed regarding choosing a daily vs. weekly paper,
and Council decided to award the bid to the Stillwater Gazette, (the
lowest bid) because it is a daily newspaper.
Motion by Councilmember Opheim, seconded by Councilmember Farrell to adopt
the appropriate resolution awarding bid and authorizing execution of contract
for legal advertising for the City of Stillwater to the Stillwater Gazette.

NEW BUSINESS
1. Resolution No. 8001, engaging McGladrey & Pullen to perform the 1988
Audit.
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to adopt
the appropriate resolution engaging McGladrey & Pullen to perform the 1988
audit. (Resolution No. 8001)
Ayes .- Councilmembers Bodlovick, Farrell, Opheim and Mayor Abrahamson.
Nays - None
2. Resolution No. 8002, amending the 1989 Tax Levy.
Finance Director Blazek explained that when the 1989 Tax Levy was adopted,
one of the levies for debt service was inadvertently omitted. Council
discussion followed.
Motion by Councilmember Opheim to amend the 1989 Tax Levy. Mayor
Abrahamson called for a second three times and the motion died for lack of
a second. Action on this item will be considered next fall.

EXECUTIVE SESSION
Cy Smythe, labor Re 1 at ions Assoc i ate, met with the Council to di scuss the. .
effect the Comparable Worth Law has on the City and what may have to be
done to comply with the law.
PERFORMANCE REVIEWS .
The Council met with Parks Director Blekum, Public Works Director Junker,
and Public Safety Director Mawhorter to discuss their performance
appraisals as conducted by City Coordinator Kriesel.
WORKE~S COMPENSATION INSURANCE
City Coordinator Kriesel presented Council with a memo from'Finance
Director Blazek explaining the payment options pertaining to Workers
Compensation insurance premiums.
Motion by Councilmember Kimble, seconded by Councilmember Bodlovick to select
the refund option for Workers Compensation Insurance. (All in favor).
EMPLOYEE ASSISTANCE PROGRAM
City Coordinator Kriesel recommended that the City enter into a one-year
agreement with Family Service of Greater St. Paul to provide employee
assistance at a cost of $938.00.
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to
approve a one year contract with Family Service of Greater St. Paul to provide
employee assistance for the City of Stillwater at a cost of $938.00. (All in
favor).

SEWER TELEVISING SERVICE
City Coordinator Krie el presented Council with bids for televising sewer
lines in the Fairmead ws Addition and at miscellaneous locations. Two
bids were received. idwest Underground Inspections, Inc. bid $1,652.50
for Section I services and $930.00 for Section II services for a total bid
of $2,582.50. Visu S wer Clean & Seal, Inc. bid $1,680.55 for Section I
services and $945.50 or Section II services for a total bid of $2,626.05.
Motion by Councilmember B dlovick, seconded by Councilmember Farrell to award
the sewer televising bid 0 Midwest Underground Inspections, Inc. at a total
cost of $2,582.50. (All in favor).

WORKSHOP WITH WASHINGTON OUNTY HRA
City Coor inator Kriesel presented letters to the City Council from Dennis
Balyeat, Washington C unty HRA, requesting a workshop on January 10, 1988
with the Council to discuss the acquisition of Rivertown Commons. The
Council had previousl set a workshop for January 31, 1988. Mr. Balyeat
expressed concern tha the present owners may not wait that long to
continue discussion 0 the sale of the building and operation to HRA.
Motion by Councilmember Ki ble, seconded by Councilmember Farrell to hold a
Workshop with Washington County HRA on January 10, 1988 to discuss the
acquisition and operation of the Rivertown Commons Senior Highrise. (All in
favor ).

STAFF REPORTS
1. . Finance Director -
Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to
authorize the purchase of a governmental accounting book for the Finance
Director at a cost of $40.00. (All in favor).
2. P~blic Safety Director -
Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to adopt
the appropriate resolution employing five part-time Police Officers,
contingent on psychological and physical exams. (Resolution No. 8010)

Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to

for bids for a grader and loader for the Public Works Dept. (All in favor).

Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to
authorize attendance of three Heritage Preservation Committee Members at a
workshop on January 14 at a cost of $15.00 each. (All in favor).
Motion by Councilmember Bodlovick, seconded by Councilmember Kimble to
authorize a letter to the Nominating Committee of the I.C.B.O. in support of
Allen Zepper, Building Official, as a candidate for Board of Directors of the
International Conference of Building Officials. (All in favor).
Proposed Modification of Development Program for INCstar
Motion by Councilmember Kimble, seconded by Councilmember Farrell to adopt
the appropriate resolution calling for a Public Hearing on the proposed
modification by the City of the Development Program and the modification of
the proposed Tax Increment Financing plan relating to INCStar. (Resolution
No. 8011)

Darlene liberty/Judith Olson case
Council discussion followed regarding the complaint of Judith Olson, 218
No. Martha St., about the liberty garage next door which has been in the
building process for three years and the owner has added a second story.
Mr. Russell stated the building is within guidelines. A suggestion was
made that when residents apply for a building permit, they be advised of
the rules regarding construction of buildings.

Motion by Councilmember Kimble, seconded by Councilmember Farrell to adopt
the appropriate resolution ordering a Feasibility Study for reconstruction of
streets and utilities for portions of Mulberry St., Sherburne St., and William
St. (Resolution No. 8012)

7. City Attorney -
Mr. Magnuson has been in contact with GAB regarding the sewer back-up
claims in the Fairmeado s area. They will review the claims for payment
after the sewer lines are televised.
8. City Clerk -
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to
authorize the attendance of six employees from the Administrative Office at
the Municipals Conference t be held the end of January at a cost of $25.00
per person. (All in favor).
Brick Alley Restaurant
Ms. Johnson reported th t Mike McGuire has paid the 1989 $2,000 On-Sale
liquor License fee for the Brick Alley Restaurant and they are currently
negotiating with individuals to open a restaurant at that site.

OATH OF OFFICE FOR NEWLY ELECTED MEMBERS OF COUNCIL
City Clerk Johnson administered the Oath of Office to Roberta Opheim and
Tom Farrell who were re-elected to a four-year termon the Council on
November 8, 1988.
PUBLIC HEARINGS
1. This is the day and time for the Public Hearing on a request for a
subdivision of one lot into two lots at 514 and 518 West Maple Street in
the RB, Two-Family Residential Dist., James Blichfeldt, Applicant. Case
No. SUB/88-72.
Notice of the hearing was published in the Stillwater Gazette on
December 23, 1988 and copies were mailed to affected property owners.
Mr. Russell explained the lot was originally subdivided into two lots, and
had been combined in one lot with one legal description. A home has been
constructed on each lot, based on the original subdivision. Also,
regulations require a larger lot size for a single-family residence,
therefore, a variance is required.
Discussion followed regarding concerns of the neighbors about drainage and
damage to the curb in front of one of the homes during construction; and
possible damage to a sewer line. Also a sewer service easement is
required for 715 No. William St.
Jim Blichfeldt, builder of the homes, stated it was an oversight on his
part when they went onto the easement and agreed to fix the curb, take

care of fixing the sewer line and is willing to bear all costs in order to
get these problems straightened out. Mr. Russell stated the sewer
easement should be restored to ten feet.
Mike Madsen, 510 W. Maple St., was present to express concerns regarding
drainage onto his property from the newly constructed homes. He stated he
has had some water problems in his basement, but does not want more.
Mary Wahlkirch, 518 Maple St., asked what happens if that sewer line is
running under her basement and ten years from now, she has problems.
Council answered this should be corrected when Mr. Blichfeldt fixes the
sewer line.
Motion by Councilmember Kimble, seconded by Councilmember Farrell that Case
No. SUB/88-72, a request for subdivision of one lot into two lots at 514 & 518
W. Maple St., James Blichfeldt, Applicant, be continued for up to six months
until Mr. Blichfeldt can settle the drainage problems, the question of a
possible broken sewer line and the easement for sewer. (All in favor).
2. This is the day and time for the Publ ic Hearing on a Speci al.UseRermit to
construct a 7,200 sq. ft. auto and truck repair building on the southwest
corner of Curvecrest and Industrial Blvds., Happy Thomsen, Applicant.
Case No. SUP/88-73.
Notice of the hearing was published in the Stillwater Gazette on
December 23, 1988 and copies were mailed to affected property owners.
Mr. Russell explained Mr. Thomsen plans to build a truck and auto repair
garage in the Industrial Park, which requires a Special Use Permit. He
f~rther explained Mr. Thomsen will have a mansard around the entire top of
the building and it will be compatible with other buildings in the area.
There is also a landscape plan in place. Mr. Fontaine stated the Planning
Commission approved the former plan with conditions and said the revised
plan is an improvement.
Council expressed concern that auto wrecks not be stored on the property
and Mr. Thomsen said this would not be allowed. Long term parking would
not exceed thirty days.
Ned Windmiller, representing the Stillwater Medical Arts Building,
expressed a concern about the look of the building and was pleased to see
the changes. He also is concerned about outside storage and screening.
He also stated some design standards should be developed for the
Industri al Park.

Leonard Feeley spoke in upport of Mr. Thomsenls plan, stating it fits
into the area quite well and thinks it is a nice looking building. Mayor
Abrahamson closed the pu lic hearing.

Mr. Magnuson stated he h s been in contact with the insurance adjusters
and they will reopen the case and make a decision after the sewers have
been televised. Council discussion followed regarding payment of the
claims by the City and bing reimbursed by the insurance company.
Motion by Councilmember Ophe'm, seconded by Councilmember Farrell to pay the
claims relating to damages i the Fairmeadows area caused by a sewer back-up
as recommended by the City C ordinator upon the receipt of assignment of claim

Mayor Abrahamson stated he had received a request from Jack Lux to serve
Council in setting goals for the Industrial Park area. Also, Mayor
Abrahamson suggested meeting with the City of Oak Park Heights to discuss
mutu~l concerns regarding the Highway 36 area in the next month or so.

Mayor Abrahamson to establish a meeting with the City of Oak Park Heights

(5) ~ew part time police officers. This was approved at the last
cou~cil meeting. I would like to propose a salary schedule that will
take effect for the new part time officers hired. The schedule would

For your information, o~ce a new part time officer is appointed,
he/she must successfully pass a field officer tl'''ai~i~g program. This
program requires that the new officer ride with a trai~ing officer
and complete a training book. These hours are not paid, they are
donated by the trainee. The o~ly time a~ officer is paid duri~g
his/her trai~i~g period is whe~ they work a special event.

THE PURCHASE OF TWO NEW SQUAD CARS

When we began the 1989 budget process' we had to project the
anticipated costs of many items. One of these items was the purchase
of squad cars. We made contact with dealers who supply squad cars
(Dodge and Chev.) and they advised us to project a 10~ price increase
.for 1989. After the 1989 budget was complete, the actual bid prices
came out from St. Paul. We found out that Dodge was no longer making
squad cars and the only ones left were Chev. and Ford. The lowest
bidder was Chev. Their bid price was $12,487.00 per vehicle. Ford
was higher. Our 1989 budget allocated $11,300.00 per vehicle.
The total budgeted amount for 1989 for the pUt~chase and equipment
change over for two squad cars is $23,350.00. The actual cost of this
will be $25,769.00. This leaves us short $2,419.00.
At the last meeting you approved the purchase of a vehicle for the
Investigative Sergeant. The total cost of this vehicle, including
taxes and equipment change over is $8,271.00. We budgeted $10,000.00
for this vehicle in 1989. This leaves us with a balance of
$1,729.00.
Taking the above into account, we are $690.00 short of what we owe
over what we budgeted for.
I request that we be allowed to place the order for the new squad
cars at this time. It is expected that the vehicles will not be
delivered until around May. We will get the $690.00 somewhere out of
the our bl\dget.

SETTLEMENT FOR PUBLIC WORKS TRUCK \
Accompanying this memo is a Proof of Loss statement that was received from the
insurance company. The insurance company is offering to give us $24,612 for the
truck and the City would be able to keep the truck. This offer appears to be
reasonable, and I would recommend accepting it.
I am presently having the truck inspected by Prison Industries to determine if
the truck can be repaired. If it cannot be repaired, I would suggest that we
use the motor and transmission in our #5 dump truck. This would prolong the life
of #5,
We would then have to consider buying a new truck to replace the damaged truck.
A new truck would cost about $40,000 - $45,000. However, we would have the
$24,612 to help pay for the new truck (and #5 would have a fairly new motor and
transmission) .

SUBJECT: REQUEST FOR SIDEYARD SETBACK VARIANCE FOR
DEVELOPMENT AT 1901 CURVE CREST BLVD.
The application is for a technical variance to ~he sideyard
setback requirements between Lots 1 and 2. The building is
built over the lot line and the lender wants a variance
issued by the City before closing on the loan. The variance
does not affect the project. In issuing the variance, it is
recommended that a condition be recorded on Lots 1 and 2
combining them for purposes of sale (one cannot be sold
without the other). This would address any possible problems
with future ownership.
Staff is recommending an expedited variance review because
of the technical nature of the request and lack of impact on
the area.
RECOMMENDATION: Approval with condition.
1. A deed restriction shall be recorded on lots 1 and 2
requiring that they be combined for sale purposes.

Marco Construction, acting agent for the Augustine Brothers
is requesting a six month extension to the PUD Approval
until July 5, 1989. The Concept Approval was originally
given by the City July 5, 1988 and is good for six months.
The City is preparing utility and street improvement plans
for the area which in part is reason for development.

extension of time in which to submit the final PUD request for

AN ORDINANCE AMENDING
THE ZONING ORDINANCE BY
AMENDING REGULATIONS
RELATING TO SIGNS
THE CITY COUNCIL OF THE CITY OF STILLWATER, WASHINGTON COUNTY, MINNESOTA DOES
ORDAIN:
1. Stillwater City Code Section 24.08, Sign Regulations, and City Code
Section 24.09, Industrial Park Districts Sign Regulations are hereby
abolished.
2. A new ordinance to be known as City Code Section 31.10 Sign Regulations
is hereby enacted to hereafter read as follows:
31.10 SIGN REGULATION
Subdivision 1.
.
Purpose: Signs have an impact on the character and quality of the
environment. They attract or repel the viewing public and affect the safety of
vehicular traffic. As a historic community, Stillwater is unique. The proper
control of signs is of particular importance because of this historical
qual ity and uniqueness. Signs should be kept within T.eaSQ!1aJ)le_b9unQartes_
consistent with the objectives and goals of the community to retain its
special character and economic advantages which rest in part on the quality of
its appearance. The following standards in this_sectto_n_ are__the.refor_e ~dopted
to regulate signs.
Subd. 2.
SIGN PERMITS REQUIRED:
.
All signs shall require a sign permit as required by this Chapter. A sign
permit application containing the following information shall be filed with
the Community Development Director:
(I) A drawing of the proposed sign, or signs, showing dimensions, and
describing materials, lettering, colors, illumination and support
systems.
(2) Photographs of the building face and the building faces of both
adjacent buildings.
(3) A drawing of the building face and site plan showing the location of
the proposed sign(s) as necessary.

(4) A cross-section of the building face showing how the sign will be
attached and how far it will extend from the building.
(5) Any pictorial proof or other information that the sign is of
historical significance or is reproduction of an historic sign as
appropri ate.

(6) A building sign plan for a building with more than one use or
business, showing all signs.
Subd. 3.
DEFINITIONS:
The following definitions shall be used in the interpretation and construction
of this Ordinance:
Awning Sign
Banner
Any sign that is painted on or attached to an awning.
A sign intended to be hung either with or without a
frame possessing characters, letters, illustrations,
or ornamentations applied to paper, plastic, or fabric
of any kind excluding flags, emblems, and insignia or
political, professional, religious, education, or
corporate organizations providing that such flags,
emblems and insignia are displayed for non-commercial
purposes.
Refers to a non-accessory sign erected for the purpose
of advertising a product, event, person, or subject
not usually related to the premises on which said~ign
is located.

Building Sign Plan
An illustration that shows all the signs on a building
or group of related buildings. .
A sign placed at a construction site identifying the
project or the name of the architect, engineer,
contractor, financier, or other involved parties.
Construction Sign
Directional Sign
A sign which contains no advertising of any kind,
and provides direction or instruction to guide persons
or vehicles to facilities intended to serve the
public.
Electrical Sign
Flashing Signs
All signs and displays using electrical power.
An illuminated sign upon which the artificial light is
not kept constant in terms of intensity or color at
all times when the sign is illuminated.
Any stationary self-supported sign standing on the
ground not affixed to any other structure. Includes
monument, ground or pedestal signs.
Free Standing Signs
Graphic Sign
Means any mural or pictorial scene painted on the side
of a wall or building or painted on a sign board
affixed to a wall, and in which mural or scene has its
purpose artistic effect. A "Graphic Design" shall be
considered a "sign" for the purpose of this Ordinance.

Wall Sign
A business sign placed upon a property advertising
that particular property for sale, rent or for lease.
Any sign which is erected, constructed or attached
wholly or in part upon or over the roof of a building.
A sign attached to, painted on, or erected against the
wall of a building with the exposed face of the sign
plane parallel to the plane of said wall.
A sign affixed to a window galls or door glass. This
does not include merchandise on display.

Subd. 4.
GENERAL PROVISIONS
The following provisions apply to signs located in all zone districts:
A. All signs and sign structures shall be properly maintained and shall be
constructed of sufficiently permanent materials so that they shall not
succumb to deterioration from weathering. Any existing sign or sign
structure which is rotted, unsafe, deteriorated, defaced or otherwise
altered, shall be repainted, repaired, repl aced or removed as,
necessary.
. B. When electrical signs are installed, the installation ushall be subject
to the State's Electrical Code. Overhead electrical wiring is not
allowed.
C. No signs other than governmental signs shall be erected or temporarily
placed within any street rights of way or upon public lands or
. easements or rights of way without City Council approval.
D. No sign or sign structure shall be erected or maintained if it prevents
free ingress or egress from any door, window or fire escape. No sign or
sign structure shall be attached to a standpipe or fire escape.
E. Temporary signs may be allowed for special business events such as
business openings and closings, change in management, change in
management, district wide shopping events or other special occasions,
for thirty (30) day maximum, by permit from the Community Development
Director.
F. Sign structures not used for signing for twelve (12) consecutive months
shall be removed.

G. The City may grant a permit to locate signs or decorations on, over
or within the right of way for a specified period of time.
H. All signs shall be compatible with the building and area in which they
are located.

1. No more than three (3) properly displayed flags may be displayed
outside of a building.
J. A sign shall not obscure architectural features of a building to which
the sign is attached.
K. A building address shall not be considered a sign.
L. The terms of this Ordinance may be waived if the sign is an historic
resource, or if the sign is a proposed reproduction of an historic
sign.
M. Graphic design signs without Special Use Permit.
Subd. 5.
PERMITTED SIGNS
.
The following signs are allowed without a permit in all zoning districts, but
shall comply with all other applicable provisions of this Ordinance.
1. Public Signs: Signs of a public, noncommercial nature including
safety signs, danger signs, trespassing signs, traffic signs, signs
indicating scenic or historical points of interest, memorial plaques
and the like, when signs are erected by or on order of a P4blic officer
or employee in the performance of official duty.
2. Integral Signs: Names on buildings, date of constr~ction,
commemorative tablet and the like, which are of a permanent
construction and which are an integral part of the building or the
structure. .
3. Political Signs: Signs or posters announcing candidates seeking
. political office, or issues to be voted upon at a public election. Such
sign must contain the name and address of person{s) responsible for
such sign and that person{s) shall be responsible for its removal.
These signs shall remain for no longer than forty five (45) days before
and five (5) days after the election for which they are intended. The
City shall have the right to remove and destroy signs after the five
(5) day 1 imit.
Size: The size of a political sign shall be regulated as follows:
A. Residential and CA Districts -
The maximum sign size shall be six (6) square feet in area
with a maximum height of four (4) feet.
B. IP Districts - The maximum size shall be thirty-five (35)
square feet in ,area.

4. Holiday Signs: Signs or displays which contain or depict messages
pertaining to a national, state or local holiday and no other matter
and which are displayed for a period not to exceed sixty (60) days.

5. Construction Signs: A nonilluminated sign announcing the names of
architects, engineers, contractors or other individuals or firms
involved with the construction, alteration, or repair of a building
(but not including an advertisement of any product) or announcing the
character of the buil ing enterprise or the purpose for which the
building is intended. Such signs shall be confined to the site of the
construction, alteration or repair, and shall be removed within two (2)
years of the date of issuance of the first building permit or when the
particular project is completed, whichever is sooner. One sign shall be
permitted for each maJor street the project abuts. No sign may exceed
thirty two (32) squar feet in Multi-family Residential, Commercial and
Industrial Districts ~nd twelve (12) square feet in Single Family
Residential Districts.

6. Individual Propert Sale, Lease or Rental Sign: Anyon-premise sign
announcing the name 0 the owner, manager, realtor or other person
directly involved in he sale or rental of the property or announcing
the purpose for which it is being offered. Such signs are limited to
six (6) square feet i residential districts and thirty two (32) square
feet in commercial di$tricts. Signs must be removed within then (10)
days after sale or re~tal of property.
7. Rummage Sale Signs Sign advertising a rummage sale not exceeding
four (4) square feet located on private property which conform to the
applicable provisions of this Title and arenremoved_at ~he.termioation
of the sale.

8. One name plate sig , placed on a wall of the structure, for each
dwell ing not exceedin two (2) square feet in area per surface. No
signs shall be so con tructed as to have more than two (2) surfaces.
9. One name plate for each dwelling group of six (6) or more units.
Such sign shall not e ceed six (6) square feet in area per surface. No
sign shall be constru ted to have more than two (2) surfaces.
10. Real Estate Develo ment Project Signs: For the purpose of selling or
promoting a developme t project of three (3) to twenty five (25) acres,
one sign not to excee one hundred (100) square feet of advertising
surface may be erecte on the project site. For projects of twenty six
(26) through fifty (5 ) acres, one or two (2) signs not to exceed two
hundred (200) aggrega e square feet of advertising surface may be
erected. For projects over fifty (50) acres, one, two (2) or three (3)
signs not to exceed tree hundred (300) aggregate square feet of
advertising surface m y be erected. No dimension shall exceed twenty
five feet (251) exclu$ive of supporting structures. Such sign shall not
remain after ninety five percent (95%) of the project is developed. The
permit for such signsimust be renewed annually by the City Council,
shall be bordered wit a decorative material compatible with the
surrounding area. If uch signs are lighted, they shall be illuminated
only during those hou s when business is in operation or when the model

homes or other develo'ment are open for conducting business.

11. No sign permit is required for window signage that does not cover'
more than one third of the total area of the window in which the sign
is displayed.
Subd. 6.
PROHIBITED SIGNS:
.
The following signs are prohibited in all zoning districts:
1. Any sign which obstructs the vision of drivers or pedestrians or
detracts from the visibility of any official traffic control device.
2. Any sign which contains or imitates an official traffic sign or
signal, except for private, on-premise directional signs.
3. Off-premise advertising signs except as regulated herein.
4. Any sign which moves or rotates including electronic reader board
signs, except approved time and temperature information signs and
barber poles.
5. No sign shall display any moving parts, be illuminated with any
flashing or intermittent lights, or shall be animated, except time and
temperature information. All displays shall be shielded to prevent any
light to be directed at oncoming traffic in such brilliance as to
impair the vision of any driver. No device shall be illuminated in such
a manner as to interfere with or obscure an official traffic sign or
signal. This includes indoor signs which are visible from public
streets. .
6. Roof signs.
. 7. Any sign which contains or consists of banners, pennants, ribbons,
streamers, string of light bulbs, spinners or similar devices, except
where used for noncommercial purposes or part of an approved sign plan.
8. Portable signs including but not limited to signs with wheels
removed, attached temporarily or permanently to the ground, structure
or other signs, mounted on a vehicle for advertising purposes, parked
and visible from the public right-of-way, except signs identifying the
related business when the vehicle is being used in the normal day to
day operations of that business, hot-air or gas-filled balloons or semi
truck umbrellas used for advertising.
9. Signs painted directly on building walls unless approved by sign
permit.
10. Illuminated signs or spotlights giving off an intermittent or
rotating beam existing as a collection or concentration of rays of
light.

11. Revolving beacons, beamed lights or similar devices.

12. Signs supported by a guy wire.
13. No sign shall be erected, placed or maintained by any person on
rocks, fences or tre s.

14. No sign shall be erected which will interfere with any electric
light, power, teleph ne or telegraph wires or the supports thereof.
15. Graphic design s gns without Special Use Permit.
16. Billboards.
Subd. 7.
PERMITTED SIGNS IN RESIDEN IAL DISTRICTS
1. Professional name p ate wall signs not exceeding two (2) square foot in
area.
2. Memorial signs or t blets, names of buildings, and the date of erection
when cut into a mas nry surface or when constructed of bronze or other
incombustible mater ale
3. Political signs as egulated.
4. Individual property sale, lease or rental as regulated.

Bulletin boards, or IpubliC information signs not over thirty two (32)
square feet locatedlonly on the premises of public, charitable or
religious instituti ns.

7.. Other signs, such a neighborhood or project identification signs
consistent with the neighborhood character, subject to Special Use

Subd. 8.
PERMITTED SIGNS BY A SIGN ERMIT IN THE CENTRAL BUSINESS OR GENERAL COMMERCIAL
DISTRICT
The following signs are he eby permitted with a sign permit.
General Requirements: i
All signs in the Genera1 Commercial, CA, or Central Business District are
regulated by the fOllOW~'ng requirements:
Number: One wall, m nument, awning and canopy, or three dimensional
sign is allowed per business. When a building or business abuts two or
more public streetsi an additional sign located on each street building
face is allowed.

Sign Plan: When there is more than one business or use in a building
with more than one sign, a building sign plan shall be provided with
the sign permit application.
Permit Review: All signs in the Central Business District shall require
a design permit and meet the approved Downtown Design Guidelines for
signage.
Other Requirements: See area, location and height requirements below
for type of sign selected.
A. Wall Signs
(1) Area. The total building signage shall have an aggregate area
not exceeding one (I) square foot for each foot of such
building face parallel or substantially parallel to a street
lot line.
(2) Location. A wall sign shall not project more than sixteen
(16) inches from the wall to which the sign is to be affixed.
(3) Height. A wall sign shall not project higher than the
parapet line of the wall to which the sign is to be affixed
or fifteen (15) feet as measured from the base of the
building wall to which the sign is affixed, whichever js
lower.

(4) Lighting. Externally illuminated or back lit letters are
allowed, no internally illuminated signs. .
(5) Special Conditions. Where a principal building is devoted to
two (2) or more permitted uses, the operator of each such use
may install a wall sign for their particular use. A sign
plan must be submitted for the entire building.
a. The total gross signage for the entire building shall
not exceed one square foot for each foot of such
building face parallel, or substantially parallel, to a
street lot line with a minimum of twenty five (25)
square feet per business.
B. Free Standing Signs
(1) Area: The area of a monument type free-standing sign shall
not exceed thirty (30 square feet.
(2) Location: A monument sign shall be located in any required
yard but shall have a setback of fifteen (15) feet from any
point of vehicular access, public roadway, or property line.

(3) Height: A monument sign shall not project higher than six (6)
feet, as measured from the base of sign or grade of the
nearest roadway, whichever is lower.

C. Awnin and Canopy Si n
.
(1) Area. The gross surface of an awning or canopy sign shall not
exceed fift (50) percent of the gross surface area of the
smallest f ce of the awning or canopy to which such sign is
to be affi xed.
(2) An awning 0 canopy sign shall not project higher than the
top of the awning or canopy or below the awning or canopy.
D. Three Dimensional Si n
(I) The total rea of a three dimensional sign shall be
determined by enclosing the largest cross section of the sign
in an easily recognized geometric shape and computing its
area shall not exceed nine (9) square feet.
E. Projecting Sign
(1) The total rea of a projecting sign shall be six (6) square
feet.
(2) All projec ing signs shall be located on street level and
easily visible from the sidewalk.

(3) If lighted, projecting signs shall be externally illuminated.
Subd.. 9.
PERMITTED SIGNS BY A SIGN P RMIT IN INDUSTRIAL PARK DISTRICTS
All commercial, office and industrial signs in all IP Districts are subject to
the following conditions: 0 e (1) wall, free standing, awning, or canopy sign
per business is permitted s bject to the following requirements:
A. Wall Signs
Area. The gros , surface area of a wall sign shall not exceed
one (1) square ifoot for each foot of building, parallel, or
substantially ~arallel' to the building front lot line.
Location: A wall sign shall be located on the outermost wall of
any principal uilding but shall not project more than sixteen
(16) inches fr m the wall to which the sign is to be affixed. The
location and a rangement of all wall signs shall be subject to
the review and approval of the Community Development Director.

(3) Height. A wall sign shall not project higher than the parapet
line of the wall to which the sign is be be affixed or twenty
(20) feet as measured from the base of the building wall to which
the sign is to be affixed, whichever is lower.
(4) Special Conditions. Where a principal building is devoted to two
(2) or more permitted uses, the operator of each such use may
install a wall sign upon his/her proportionate share of the
building wall to which the sign is to be affixed. A sign plan
must be submitted for the entire building with the following
i nformat i on:
a. The total gross signage for the entire building shall not
exceed one (1) square foot for each foot of such building face
parallel, or substantially parallel, to a street lot line or a
minimum of twenty five (25) square feet per business.
b. The locations, sizes, types and elevations of all signs.
c. All signs shall be visually consistent in location, design,
and scale.
B. Free Standing Signs
(1) Area: The gross surface area of a ground $ign shall note~ceed
one hundred (100) square feet for each exposed face nor exceed an
aggregate gross surface area of two hundred (200) square feet.
(2) Location: A ground sign may be set back fifteen (15) feet from
front or side property line.
(3) Height: A ground sign shall not project higher than twenty five
(25) feet, as measured from base of sign or grade of the nearest
adjacent roadway, whichever is lower.
C. Awning, Canopy.
(1) Area: The gross surface area of an awning, canopy, or marquee
sign shall not exceed fifty (5) percent of the gross surface area
of the awning, canopy or marquee to which such sign is to be
affixed.
(2) Location: A sign may be affixed to or located upon any awning,
canopy, or marquee.
(3) Height: An awning, or marquee sign shall not project higher than
the top of the awning, canopy or marquee to which such sign is to
be affi xed.

Subd. 10.
AUTOMOBILE SERVICE STATION SIGNS:
.
Automobile service stations are allowed one (1) wall sign and one (1) ground
sign subject to the following conditions:
(1) Wall Signs: There shall be no more than one (I) wall sign with a
maximum sign a ea of one (1) square foot for each lineal foot of
building frontage.
(2) Free Standing Signs: There shall be no more than one (I) free
standing sign or each principal building. A free standing sign
shall be set back fifteen (15) feet from the front and side
property line. A free standing sign shall not project higher
than twenty ( 0) feet as measured from grade or contain more than
sixty five (65) square feet of signage.

(3 Service Bay and Island Identification Signs: Service bay and
island identification signs are permitted providing direction or
instruction t persons using the facility but containing no
advertising m terial of any kind.
Special Sign Height Limits
Because of the character 0 the area, including existing and proposed land
use, special sign height limits for free standing signs are required for
certain streets as follows:,

Subd. 11.

(I) Curve Crest Boule ard from South Greeley to Washington Avenue and
Orleans from Washington Avenue to County Road 5 - six (6) feet.
(2) County Road #5 fr m Highway 36 to Croixwood Boulevard and South
Greeley from Orle ns to Highway 36 - twenty (20) feet.

(3) Washington Avenue Ifrom Tower to Orleans Street - six (6) feet.

Subd. 12. 9
Non-Conforming Uses
(I) Non-conforming si ns that are lawful on the date of the adoption of
this ordinance sh~ll have rights outlined in Chapter 31.01, Subd. 9
of the Zoning ord;onance with respect to their alteration, extension,
restoration and a andonment.
(2) Any person violating or failing to comply with any provision of this
ordinance shall u ,on conviction thereof be guilty of a misdemeanor.

. Subd. 13.
Violations
In all cases of violations of this Ordinance which are unabated thirty (30)
days after written notice to record owner of the property on which the sign is
located, the City may proceed to abate and remove the violation and, if deemed
necessary, to have cost thereof specially assessed against the lot or parcel
where the violation was located.
Subd. 14.
This ordinance shall be in full force and effective from and after passage and
publication according to law.

AN ORDINANCE AMENDING CHAPTER 27
DOGS AND OTHER ANIMALS
The City Council of the City of Stillwater, Washington
County, Minnesota does ordain:
Section 1. Stillwater City Code Section 27.01, Subdivision
6 is hereby amended by striking the words "at night" from the
fifth sentence thereof.
Section 2. In all other ways Chapter 27 shall remain in
full force and effect.
Section 3. This Ordinance shall be in full force and effect
from and after its passage and publication according to law.

RELATING TO CONDOMINIUM CONVERSIONS
THE CITY COUNCIL OF THE CITY OF STILLWATER, WASHINGTON COUNTY, MINNESOTA DOES
ORDAIN:
1. A new ordinance to be known as City Code Section 31.11, Condominium
Conversion Regulations, is hereby enacted to hereafter read as follows:
31.11 CONDOMINIUM CONVERSION REGULATIONS
Subdivision 1.
PURPOSE: The conversion of residential structures from one ownership to
condominiums with multiple ownership interests create special community
problems both social and economic; relocation of tenants; the application of
current building and zoning code regulations for consumer-purchase protection;
the need for open space and the impact of such conversion on the general
character of the area of location, are representative of such special
problems. The purpose of this section is to provide guidelines to evaluate
the problems and impacts any residential conversion may have on the community,
and to establish requirements which shall be included in conversion approval.
. Subd. 2.
DEFIN IT IONS :
.
The following words and phrases used in this Ordinance shall have the meanings
set forth below:
(I) Condominium: Real estate, portions of which are designated for
separate ownership and the remainder of which is designated for common
ownership solely by the owners of the separate ownership portions. Real estate
is not a condominium unless the undivided interests in the common elements are
vested in the units owners.
(2) Conversion condominium: A condominium containing a building which at
any time before the recording of the declaration creating a condominium under
Minnesota Statutes contained residential rental units.
Subd. 3.
SPECIAL PERMIT REQUIRED:
No residential condominiums conversion project shall be permitted in the City
of Stillwater unless and until a Special Use Permit has been applied for and
issued pursuant to and in accordance with the provision of the Stillwater City
Code, Chapter 31, Zoning.

Subd. 4.
SPECIAL USE PERMIT APPLICA ION:
.
In addition to such other pplication requirements as required by Chapter 31,
the application for condom nium conversion shall include the following:
(I) Twelve (12) copie of plans illustrating the following details shown
to scale:
1. Site plan s owing the location of buildings, parking areas,
circulation system, recreational facilities and open space
areas.
2. Floor plans lof each type of construction and landscape plans.
3. Location, slze and numbering of parking spaces to be used in
conjunction with each condominium units for residents and
guests.
4. Number and ind of units within said rental dwelling or
building in luding:
a. Appro imate square footage of each unit in said rental
dwell ng or building;
b. Numbe~ of bedrooms in each such unit;
c. The a ount of rent charged for each such unit during_the _,
previ us six months.
d. Numbe of persons residing in each such unit,
appro imate age and 1 ength of occupancy; . .
e. Vacan y rate of said rental dwelling or building during
the p evious six month period.
(2) Other information as necessary to fully evaluate the project.
Subd.. 5.
REVIEW CONSIDERATIONS:

Use permits for condominiu conversion projects may be approved subject to the
following considerations:
(I) Condominium conve sion shall not be allowed unless the building to be
converted complie in all respects with the requirements of the
Uniform Building ode, Uniform Fire Code and City of Stillwater
Housing Code. Con ominium conversion premises must be inspected by
the Building Insp ctor and certification of inspection prepared
describing what improvements are necessary to bring the structure(s)
into compliance with City Building Codes.
(2) Off Street Parkin I - Compliance with off street parking requirements
as required by Ch pter 31, Parking Requirements.
Any special densi y bonuses or parking requirement approved by the
City for low and oderate income housing publicly assisted projects
shall be reviewed
(3) Recreational open space - Recreational facilities shall be reviewed .
for its adequacy or the use.
(4) Project Managemen; - A project management plan for common areas
including landsca ing, parking lots or garages, common hallways and
rooms shall be su mitted for review.

(5) Impact on Rental Housing Supply - The effect of the conversion of the
rental project on the rental housing market shall be considered,
including impact on Stillwater regional fair share of rental housing
and housing need studies prepared by the Washington County Housing
and Redevelopment Authority.
Subd. 6.
REASONS OF DENIAL:
Determination that the project will adversely affect the public health, safety
and welfare of the community based on the above considerations.
Subd. 7.
CONDITIONS OF APPROVAL:
Approval of a proposed condominium conversion shall be conditioned to secure
purposes of this title. Such conditions may include:
(1) All improvements that are necessary to comply with present City
standards shall be required and completed prior to approval of the
final condominium plat. \
(2) A copy of the covenants, conditions and restrictions shall be filed
with the Community Development Director for review and approved
before final plat approval. ..'
(3) All provisions of the Minnesota Uniform Condominium Act Article 4,
Section 515A-II0 regarding notification of tenants of conversion
shall be met. On date of giving notice of conversion to tenant as
required by State Statutes, the applicant shall send, by United
States Mail, written notice of conversion to City Community
Development Director.

The request is to review the change of use and parking
requirements for the change of\use from the Culligan Soft
Water use to the Classic Care of America, window washing
business. Both uses are allowed in the CA District. The
parking requirements for new commercial uses.are five
spaces per 1,000 square feet of office space and one space
per two and one half seats for a restaurant. The total
parking requirement for the use is seven spaces plus
restaurant parking, depending on use. The Pizza Restaurant
is mostly take out, reducing the need for parking.
Approximately six spaces are provided on site, including
the three stall garage. The proposed window washing
business is similar to the Culligan Soft Water sales and
service business.
RECOMMENDATION: Approve change of use plans.

Stillwater, MN
Currently the building is used to house the Culligan
Soft Water operation and a take out pizza business. I propose
to remodel the warehouse space in the middle of the building
to house the offices of Classic Care of America (CCOA).
CCOA is a company set up to wash residential and commer-
cial windows utilizing a process\contained in 1 ton vans.
I plan on operating with 1 van to start, adding 2 vans in
the next couple of years. My use of the building will be very
much like that of what Culligan Soft Water is .usingitfor.
now.
Adequate employee parking is in the rear of the building.
No customer parking is needed as neither business requires
it. Present signage plans call for removing the Culligan over~~
head sign, painting over the existing Culligan sign in the
rear of the building and possibly mount a small CCOA sign
by the south door of the building. My business requires no
walk in traffic and will have less in-house employees than
are presently at the building.
Current plans call for purchasing the building March
1, 1989 and commence remodeling immediately. I request approval
of this use proposal as soon as possible.

Accompanying'this memo is a memo from LMC regarding workers cainp coverage for
local, elected officials and a special accidental benefit policy of elected
officials.
The annual cost for workers comp coverage for the Mayor and Council would be $530
in 1989. If the Council desires coverage, it would be necessary to adopt a
resolution or preferably an ordinance. I could not find any record of past
action by the Council which would have given coverage to elected officials.

The disability insurance at $12,75 per person per year seems like a reasonable
price for this optional type of insurance. I would recommend that the Council
seriously consider having some policy in effect for elected officials. Given
the amount of time and activity related to your positions, I think some coverage
would be appropriate,

The workers compensation statutes provide benefits to an
.employee. who is injured while working. M.S. 176.011, subd. 9,
(5), provides that an elected official is considered to be an
.employee. for workers compensation purposes'~nly if the city
has passed an ordinance or resolution to that effect. An
elected official injured while performing his or her duties
would not be eligible for workers compensation benefits unless
the city had passed that ordinance or resolution.
If the city wishes to provide workers compensation coverage for
elected officials, it is preferable to use an ordinance rather
than a resolution. Resolutions are often recorded only in the
council minutes; years later it can be very difficult and
time-consuming to track down a resolution. We've seen a number
of cases where a city has been paying premiums for workers
,compensation coverage for elected officials for years, but now
can't find any ordinance or resolution specifying that elected
officials are covered. An ordinance will generally be easier to
keep track of permanently, since it is also recorded in the
city's ordinance book as well as in the council minutes. The
following wording can be used for this ordinance: .Pursuant to
Minnesota Statutes section 176.011, subdivision 9, clause 5, the
elected officials of the city and those municipal officers
appointed for a regular term of office are hereby included in
the coverage of the Minnesota Workers Compensation Act..
If the city does not wish to cover its elected officials for
workers compensation, it might be wise to pass on ordinance to
that effect as well unless you are absolutely certain that the
city has never passed a resolution to provide coverage. That
resolution could have been passed as long ago as 1967, when the
law was first amended to permit cities to opt for coverage.
In the past, the cost of workers compensation coverage has
discouraged many cities from covering their elected officials.
LMCIT has now taken a couple of steps to address this issue, as
outlined on the fOllowing pages. The LMCIT Board would also
like to hear from city officials as to whether they would favor
amending the statutes to make workers compensation coverage
automatic for all elected officials.

- Workers compensation includes various other benefits,
such as rehabilitation, retraining, etc.: the accident
policy does not.
- Workers compensation benefits are tax-exempt: some or
all of the benefits paid under the accident policy might
be taxable.

Obviously, there are many .borderline. situations where it might
be debatable whether a council member is .conducting official
council business on behalf and at the request.of-thecouncil...
For example, a mayor or council member might be asked
individually to attend a meeting of the Chamber of Commerce or a
service club to discuss and explain city policies or proposals
the council is considering. cities might want to consider
adopting a resolution specifying whether the city considers such
activities to be within the scope of duties that the city
.expects its elected officials to perform.

SUBJECT: REVIEW OF STILLWATER/HOULTON BRIDGE SPECIAL STUDY OF HISTORICAL AND
ARCHEOLOGICAL IMPACTS.
MnDOT has prepared a special study on the historical and archeological impacts
of the alternative bridge location. The report has been reviewed by the City
Heritage Preservation Commission and Planning Staff resulting in the following
review comments.
The report presents a very brief review of historical and archeological
resources in the area and generally desc~ibes potential impacts. The Downtown
Area has a rich history that deserves more attention than presented in the
two page report. The section would benefit from a general distribution of the
significance of the St. Croix River, Stillwater and more-detailed mapping and
description of sites designated on the Natural Register of Historic Places or
are documented as having potential for designation. Several reports on
Downtown historic structures, including the Historical Reconstruction Df the
Riverfront: Stillwater prepared by the U.S. Army Corps of Engineers, Downtown
Plan Existing Conditions Report, Historic Resources Section, most recent
registration form for National Register of Historic Places designation for
Stillwater Bridge should be included in the discussion.
A Historic Building Survey of the Downtown is currently underway and from
preliminary results, it appears that parts of the area qualify for Historic
District Preservation, including the Stillwater Bridge.
The Historical and Archeological Special Study should discuss in more detail
the impact of a central corridor bridge location on individual buildings
and Downtown Historic District. The same format as other special studies
should be used, including suggested mitigations.
Based on the historic significance of Downtown Stillwater and the surrounding
areas, more attention should be paid to its historic resources. Downtown
Stillwater is an irreplaceable national, state, and local historic and
cultural resource and should be considered in the same detail and thoroughness
as natural environmental resources. -
RECOMMENDATION:
Direct Staff to prepare comments to MnDOT on Historic and Archeological
Special Study.

The Central Corridor would pass close to an area of Downtown
Stillwater which has a concentration of historical structures,
directly threatening one which is on the NRHP. Stillwater is one
of the oldest European settlements in Minnesota, and is noted for
its wealth of well-preserved, nineteenth century architecture.
Currently, a consultant is surveying the downtown area in order
to determine its potential eligibility as a National Historic
District.
In Wisconsin, there are no properties listed on the NRHP.
However, three structures in Houlton have been identified as being
worthy of evaluation for NRHP eligibility, and there may be similar
structures in the rural areas (see appendix C). There are no known
.
archaelogical sites in the Wisconsin corridors, but the archaelo-
gical potential in the area is high, especially along the bluffs.
In narrowing the potential corridors down to the present list,
the location of historic and archaeological sites was an important
factor in the decision process. During the remaining planning
stages. every effort will be made to avoid impacts to important
cultural resources. Should artifacts of potential archaeological
value be discovered during construction, the Preservation Officer
will be notified in order to determine the significance of the
findings.

Dear Mr. Abrahamson:
I'm writing to you on behalf of Press On Incorporated, Community
Involvement Team. The goal of our Team is to enhance Press O~'s
standing in the community by encouraging our employees to become
involved in community proJects that increase the well being of the
St. Croix area needy. As part of our program, Press On has for
the first time become active in the United Way, Toys for Tots, and
the Bloc.dm.:.bi Ie.
Our next proJect is a drive for the St. Croix Valley Food Shelf.
Our Team would like to enhance support within our Company by
~~eating an inter-company challenge with other valley businesses.
~Jr thought would be to set up a traveling trophy that would
go to the firm which produced the greatest ~pounds per employee"
of food stuff donated. We have a few ideas on how to proceed
but would welcome the chance to co-develop the rules with any
company that desires to participate. Our goals are simple,
maximize Odonations, minimize expenses, and create fun and
recognition, equally, for all.

Enclosed for your information is a simple worksheet showing the difference
between property taxes paid and a payment in lieu of tax.
.
The assumptions in this worksheet are that taxes and rents would increase
by 4 percent per year. The net shelter rent is basically the total rents
collected. less certain utility costs included in the rents. The minimum
payment in lieu is 5 percent. As you can see from this example. the
difference is approximately 50% of the full property tax payment.
The HRA and the city could negotiate a higher payment in lieu in the later
years. This scenario assumes that the payment in lieu would stay at the
stOatutory minimum. The bottom lines show the total amount of taxes that
would be deferred and the amount deferred by the city. The Municipal
Service Charge Agreement creates a way where at least a portion of those
deferred taxes could be paid back.

Dear Nile:
As per our discussions on The Courier producing a quarterly newsletter
for the City of Stillvmter, I submit the following proposal for your
. consideration:
"The ne':lsletter shall consist of no less than four - 8!z by 11 inch-pages
(one 11 by 17 inch 70# bonded quality paper printed two sides with one
fG~d). Courier staff will research, ,rrite, edit and typeset all copy
to be used in the nelvsletter. Photography, PMT screens, layout, design and
headlines shall be done in a manner consistent with letter-quality printing
practices. The Courier shall be responsible for delivery of all camera-ready
material to the printers, and shall be responsible for delivery of the
finished product to the City. Distribution of the newsletter to the
approximately 5,000 City of Stillwater addresses is an optional item and
could be performed by The Courier if the City so chooses. The Courier I s
proposal does include distribution of the newsletter to its final
destination.

The search of my files reveals an outline of -the transaction -------------
that was set forth in my letter of December 13, 1978 to Title
Services.
Also of interest is the original option granted to Dominium
Group by the city. The condition restricting use to a low
income/elderly purpose runs with and binds the land and by its
terms is carried forward to any deeds or other documents that
were executed pursuant to the option.

In my view, this complicates any proposed purchase by the
HRA and should be discussed thoroughly with them.

Dear Mr. Bonneville:
On May 10, 1978, I wrote to Mr. Safar outlining my
understanding of the transaction. This was necessary since
our Ii1e was incompl te and both Mr. Marshall, a coordinator
for the City of Sti1 water, and Mr. Kimmel, the former City
Attorney, who origin 11y were involved in this transaction ...
no longer were avail b1e.
Originally, the! City of Stillwater had agreed to sell
to Safar Lots 1, 2 a~d 3 of Block 19 of the Original Town
(now City) of Stillw ter. This compromised 24,000 square feet
of property. The or ginal purchase price agreed upon for this
parcel was $17,500.0. We computed the cost per square foot to
Dominium at .7292 ce~ts per square foot.

It wss later no~' iced that Dominium required the conveyance
of another parcel of property, being part of Lot 5 and part of
Lot: 6 of the Or1gina '.Lown (now C:tty). This parcel con1:ained
2,500 square feet. e agreement was with Mr. Marshall and
Dominium that the pr,- perty would be sold to Dominium at the same
per square foot pric as the original parcel. We then multiplied
the 2,500 square fee times the original purchase price of 0.7292
and we arrived at $1 23.00. This I mentioned to Mr. Safar in my
letter of May 10 and it makes the total purchase price $19,323.00.

amount of $17,823.061 and we find that it is $1500.00 short.

MINUTES OF THE BOARD OF TRUSTEES MEETING
DECEMBER 5, 1988

The regular monthly meeting of the Stillwater Public Library Board of
Trustees was held on Monday, December 5, 1988. President Don Hansen
called the meeting to order at 6:35 P.M.
Present: Doe, Morse, Welshons, Marshall, Kalinoff, Hansen, Childs, Cass
Schmidt. Also present: Bertalmio.
The agenda was adopted as amended.
The minutes were approved as written.
It was moved to approve payment of bills in the amount of $20,262.23.
COMMITTEE REPORTS
1. Administration:
ihe committee will meet on December 13 to discuss Union negotiations.
2. Suil di ng & Grounds: .
Work on the drain problem is being completed.
3. Special Projects:
The building will be decorated for Christmas after adjournment of th~
Board meeting; decorations will be removed after adjournment of the
January Board meeting. Lynne will write a press release thanking
Krueger Tree Farm, Rose Floral and Croixside Greenhouse for holiday
decorations. Lynne will also appropriately distribute the poinsettias
atChristmastime.
OLD BUSINESS
1. Long-Range Plan - The SPL staff is currently studying the Long-Range
Plan.
2. Washington County Library/Stillwater Public Library Contract:
Lynne and Jim Wells will meet on December 8 to continue discussion on
the WCL/SPL Contract.
3. CPR Training
It was moved to have Lynne arrange for a CPR training course for staff
and Board members and to cover the cost of training for staff members.
4. WCL Liaison
Greg Schmidt reported on items of interest to the SPL Board from the
most recent WCL Board meeting.
NEW BUSINESS
1. The 1989 Holiday Schedule was presented to the Board and approval was
moved.
2. Board Vacancies:
Applications were reviewed and recommendations to ,fill the two
vacancies will be sent to the Mayor.

3. It was moved to hold the January Board meeting on the second Monday,
January 9, 1989. Committee reports will be due by noon on January 3.
4. Discussion was held on planning a January Workshop on the Impact of
Technologies on Library Services. The proposed workshop date is
Monday, January 23, 1989 at 7:00 P.M.
5. A check was received from the Margaret Rivers Foundation. It was
moved to purchase a lazer printer with those funds.
DIRECTOR'S REPORT:
Lynne expressed concern about the situation that exists in regards to
the SPL catalog.
- The School Use Committee's Teacher's Guide has been delivered to
Ken Pedersen.
- The staff Self-Defense workshop will be held on January 11th.
The meeting adjourned at 8:10 P.M.
