REQUESTS FOR TRAFFIC CONTROL DEVICES

During the past several weeks we have received quite a few requests
for traffic control devices. We have viewed the different locations
and would like to make the following recommendations;

1)
A request by the residents in the area of Willard and 7th St. for
a three way stop sign.
RECOMMENDATION: The installation of a stop sign controlling
~-traffic on 7th St. at Willard and the installation of a stop sign
~-controlling 6th St, at Willard. This request is due to
, insufficient sight distance at these streets where they intersect
wit h Will a t"d St.
2) A request by the residents in the area of Mulberry and William
St. for a stop sign on Mulberry at William controlling east and
west bound traffic on Mulberry St.
RECOMMENDATION: Install as requested
3)/II.A request from a resident in the area of Martha and Moore to
e +V" control traffic on Moore St. at Martha. This is due to
~ insufficient sight distance due to a hump in the road on Moore at
Martha.

4) A request from the business people and a resident in the area of
Happy's Harbor and the video store for a IS min. parking sign in
front of the video store and for no parking between signs signs
on either side of the driveways to the south of the video store.
RECOMMENDATION:
Install as requested
5) A request to control improper parkers in the brick alley parking
lot and people parking above the main street stairs and walking
to the downtown area.
RECOMMENDATION: Table until a future date due to lack of
activity with the end of the busy summer season.

205.18 MUNICIPAL PRIMARIES.
Subdivision 1. Cities of first class; primaries. As hereinafter provided, a munici-
pal primary for the purpose of nominating municipal elective officers may be held
in any city of the first class on the second or third Tuesday in March of any year
in which a general municipal election is to be held for the purpose of electing
municipal officers,
Subd. 2. Resolution of governing body. Not less than 60 days after April 25,
1957, the governing body of any city of the first class may, by a majority vote of
all the members of such body, adopt a resolution fixing and establishing the second
or third Tuesday in March for the holding of such municipal primary in any year
in which a general municipal election is to be held in such city. If and when the
governing body of any such city adopts a resolution fixing and establiShing the time
of the holding of a municipal primary, as provided for in this section, the city clerk
or other officer of such city charged with the duty of keeping the minutes and records
of the governing body of such city, shall forthwith file a duly certified copy of such
resolution with the secretary of state and another duly certified copy of such resolu-
tion with the county recorder of the county in which such city is located; and
thereupon, the time fixed and established by such resolution for the holding of such
municipal primary shall become fixed, and no power shall thereafter exist in the
governing body of any such city to change the time of the holding of such municipal
primary unless the authority to make such change is thereafter conferred upon such
governing body by an act of the legislature, or by an amendment to the charter of
such city duly ratified and accepted by the qualified electors of such city, in accord-
ance with the constitution of the state of Minnesota, Article IV, Section J6, and all
applicable acts thereunto enabling.

205.185 PROCEDURE.
Subdivision I. Materials, ballots. The municipal clerk shall prepare and have
printed the necessary election materials, including ballots, for a municipal election.
Subd. 2. Election, conduct. A municipal election shall be by secret ballot and
shall be held and the returns made in the manner provided for the state general
election, so far as practicable.

municipal clerk shall issue a certificate -of election to each successful candidate. In
case of a contest, the certificate shall not be issued until the outcome of the contest
has been determined by the proper court. In case of a tie vote, the governing body
shall determine the result by lot. The clerk shall certify the results of the election
to the county auditor, and the clerk shall be the final custodian of the ballots and
the returns of the election.
Subd. 4. Recount. A losing candidate at a municipal election may request a
recount of the votes for that office subject to the requirements of section 204C.36.

POLICY AND PROCEDURES MANUAL
City Coordinator Kriesel and Council reviewed the Policy and
Procedures Manual and made several additions and deletions.
AFFIRMATIVE ACTION POLICY
City Coordinator Kriesel explained the revised Affirmative
Action Policy. Questions were raised concerning the
corrective action section and Mr. Kriesel was asked to
develop some different language.
SOLID WASTE MISSION STATEMENT
Council discussed a Mission Statement providing goals and
objectives for the Solid Waste Advisory Commission.
Motion by Councilmember Kimble, seconded by
Bodlovick to approve the Mission Statement for the
Advisory Commission as written. (All in favor)

OTHER BUSINESS
Reauest for Personal Computer -
Council discussed a request from the City Clerk to purchase a
personal computer. Councilmember Farrell questioned the need
for a color monitor and the seemingly high maintenance
agreement costs. This request will be held until the next
meeting.
Reauest to Burn Buildinq -
Motion by Councilmember Farrell, seconded by Councilmember Kimble
to authorize the Fire Department to assist with burning of a
building on Highway 96. (All in favor)

Final Approval of Lot Split - 206 Poplar St.
Discussion followed regarding final approval of the lot split for the
Benson property located at 206 Poplar St. and placement of a driveway on
the second lot. The Public Works Director was directed to report on the
placement of driveway and moving of barricades. This item was tabled
until the November 1, 1988 meeting.

Employment of Concessions Worker - Valerie Curtis
Motion by Councilmember Farrell, seconded by Councilmember Kimble to adopt
the appropriate resolution employing Valerie Curtis as Concession Worker at
the Ice Arena. (Resolution No. 7981)

Replacement of Diseased Trees
Motion by Councilmember Kimble, seconded by Councilmember Opheim to approve
the recommendation of the Park Board that trees to be planted replacing
diseased trees be given to the property owner for placement on private
property and not the public right-of-way. (All in favor).

Award of Bid for Two Pick-Up Trucks -
Motion by Councilmember Kimble, seconded by Councilmember Bodlovick to adopt
the appropriate resolution awarding the bid for two pick-up trucks for the
Public Works Dept. to Thane Hawkins Polar Chev. in the amount of $20,996 and
authorizing execution of contract with Polar Chev. (Resolution No. 7982)

Attendance of Jeff Johnson at Seminar

the placement of a streetlight on Maryknoll, north of Oakridge Rd. (All in

Award of Bid - L.I. 240 & 250
Motion by Councilmember Kimble, seconded by Councilmember Opheim to adopt
the appropriate resolution awarding bid and authorizing execution of contract
for L.I. 240 (Industrial Area Drainage Study, east to Greeley St.), and L.I.
250 (Industrial Pk. Drainage Study, west of Washington Ave.), in the amount of
$69,526.80 to Forest Lake Contracting, Inc. (Resolution No. 7983)

proposed for the Nove ber 1, 1988 meeting. Council stated they will hear
the eight cases on th4t date.

present to speak for or against this item. Mayor Abrahamson closed the

the appropriate resolution revoking the On-Sale and Sunday Liquor Licenses for
the Brick Alley Bar & Restaurant, 423 South Main St. (Resolution No. 7984)

UNFINISHED BUSINESS
1.
Possible second reading of Ordinance annexing the Perry property.
Mr. Magnuson presented a revised legal description of the property.
Messrs. Perry, Blichfeldt, and Kempfer were present, representing the
request for annexation. Discussion involved the objections of neighbors
in Stillwater Township to the annexation. Mr. Magnuson stated these
objections can be stated at the public hearing for the preliminary plat of
the property.

second reading and enactment of an ordinance annexing the Perry property to
the City of Stillwater. (Ordinance No. 689)

NEW BUSINESS
1. Possible first reading of Sign Ordinance.
Mr. Russell explained that several projects in the past year have required
variances to the sign ordinance; and, also, the code addresses sign
regulations in different areas of the code. Therefore, he is recommending
that the ordinance be adjusted and consolidated to cover these items.
Motion by Councilmember Bodlovick, seconded by Councilmember Kimble to have a
first reading of the Sign Ordinance. (All in favor).

COUNCIL REQUEST ITEMS
Truck Hauling on MSA Streets
Councilmember Opheim initiated discussion regarding restriction of trucks
hauling materials on MSA streets. Mr. Moore stated these trucks cannot be
restricted since they are under the MSA designation.
Traffic Control at Mulberry & William Streets
Councilmember Kimble presented a petition from Steve Salomonsen requesting
further consideration of stop signs at this intersection. Direction was
given to forward the petition to Public Safety Director Mawhorter for
further study and presentation at a future meeting with the residents
present for comment.
Hazardous Traffic Conditions on No. Owens St.
Mayor Abrahamson stated there are hazardous traffic conditions existing in
the vicinity of Happy's Harbour and the Video Store on No. Owens St. near
two driveways.
Motion by Councilmember Opheim, seconded by Councilmember Farrell instructing
the City Coordinator to have the traffic problem on No. Owens in the vicinity
of the Video Store studied for resolution of the problems. (All in favor).
Further discussion followed regarding parking on No. Owens St. Since
there have been many requests for stop signs and concern for other traffic
problems, a workshop will be scheduled tentatively for January, 1989.

The project is to subdivide Lot 23, a 47,800 square foot lot into two lots;
Lot A with 23,050 square feet and Lot B with 24,750 square feet.
Discussion:
The property is located off the South end of North Broadway and is bounded by
North First Street on the West, vacated Aspen Street right-of-way on the North
and Elm Street on the South. The site overlooks the old prison.

Acce~s to the site is provided off of North Broadway. It would be practically
difficult to gain access from First Street for Lot B. An easement is proposed
over Lot A to provide access to Lot B off of Broadway. The Subdivision
ordinance requires all lots have access to a public street.
The lots are steeply sloped. The topographic maps for the area show a thirty
foot drop in elevation from the Northeast to Southwest and a fifty foot drop
in elevation for Lot B. The Zoning Ordinance requires that for the lots to be
subdivided, 10,000 square feet of lot area per lot must be in slopes less than
30%.
Sewer service is available in North First Street but it would be very
difficult to get to because of ground conditions and the slope of the land.
The Water Department indicated an on-site system would be required to have
water on the site.
It may be possible to build on the two lots. Mr. Neumeier will present new
information he has collected at the meeting.
Recommendation: Denial.
Findings:
The request is not consistent with lot size and road access requirements of
the Zoning Ordinance.

catalog stores throughout the country. As part of this variance and sign plan
for River Heights Plaza, a single line sign with a twenty-four inch
requirement was established. The new sign will have two rows consisting of
"J.C. Penney" at 24 inches and "Catalog Store" at one foot, six inches. this
sign is therefore much larger than other-signs at River Heights Plaza.
However, as stated by Tom Jensen, operations manager for J.C. Penney, the
catalog store needs to be defined in order to distinguish it from J.C. Penney
Department Stores.
CONDITIONS OF APPROVAL:
1. The sign will not disrupt the appearance of River Heights Plaza in any
way.
2. This variance request is considered a special situation, therefore
future signs must meet the sign plan established for River Heights
Plaza by the City of Stillwater.
RECOMMENDATION: Approval.

The granting of the variance will be in harmony with the general purpose and
intent of this Ordinance and Sign Plan for River Heights Plaza.

City Council to allow a variance to J. C. Penney Company and allow
them to mount their exterior sign, "JCPenney Catalog Store" in two
rows per the proposed plan. The landlord has approved the request
based on the following reasons:
I) It is necessary to distinguish the catalog store from a
regular Penney's department store because of the vast
differences in operation. Customers must know prior to
entering the catalog store that it is not a department
store, otherwise it will create dissatisfaction and may
discourage their intent to purchase merchandise or
services at River Heights Plaza.
2) The design of the Grid II Section in which the J. C.
Penney Catalog Store is located does not allow the sign
to be extended in a single line of 2' X 24' due to the
peaked double column separating the sign area. Thus,

JCPenney Catalog Stores. In a nation-wide company, such as ours,
a logo that is identical to the rest of our stores is necessary
to capitalize on the large investment we have in advertising and
making our sign a recognizable name, one that is associated with
the goodwill 'our company has gained over the years.
Second, we must distinguish between a JCPenney Store and a
JCPenney Catalog Store. The difference between our store in Rose-
dale, at 200,000 square feet, and our store in River Heights Plaza,
at 2500 square feet, is obvious yet we must explain that difference
to our customers everyday. We feel that we owe them a self-explanatory
sign that tells them exactly what we are: JCPenney Catalog Store.

or parking created by this business. Mr. Mohan will also not be advertising

The Fire Department has been notified for Fire Code requirements and will be
notified as to the construction of the woodworking shop and to the disposal of
waste materials.
CONDITIONS OF APPROVAL
1. The Fire Department shall review all Fire Codes as to the construction
of the woodworking shop.
2. The Fire Department shall review the disposal of wastes created by the
woodworking business.
3. No sign shall be permitted.
4. No additional traffic or parking will be created by the business.
5. This permit will be reviewed by the Planning Commission on a complaint
basis.
RECOMMENDATION: Approval.
FINDINGS;
The proposed use will not be injurious to the neighborhood or otherwise
detrimental to the public welfare and will be in harmony with the general

We are applying for a variance and special use permit for our property at
1112 South Second Street, Stillwater. Enclosed are the following: the completed
Planning Administrative Form; a sketch of our property, including preexisting
structures; a letter of description of the proposed changes in our garage; current
photographs of the garage; and a petition of approval signed by all immediate
neighbors who we were able to contact prior to submitting this application.
We hope to improve the attic of the garage, making it suitable for a private
workshop. These improvements will not significantly alter the appearance of the
garage. We primarily want to develope a hobby woodworking area in the garage attic.
This would be similar to woodworking shops present in many residential basements and
garages. In addition, Corey Mohan would like to use the garage woodworking area for
the repair of stringed musical instruments, especially violins and acoustic guitars.
The musical instrument repair mainly involves the use of hand tools, but the
use of power tools sometimes becomes necessary. These power tools include, a drill
press, sander, and tabletop saw. Corey would like to repair instruments for his
own use, and also those instruments of a limited number of clients arranged through
a local music shop. These clients would not come to our home, but rather, Corey
would pick up the musical instruments at the music shop, and return them when the
repairs were completed. Therefore, the musical instrument repair would not increase
the number of people entering the neighborhood, and in no way would involve a retail
business endeavor at this address. Also, we do not intend to place a sign advertising
this small business.
In closing, we want to stress that this home workshop would not disturb the
residential quality of the neighborhood. We have attempted to contact all neighbors
living within 300 feet of our home, and explain our proposal. All neighbors we were
able to reach prior to submitting this application, understood and approved of our
plans. These neighbors were willing to sign the enclosed petition. Thank you for

DESCRIPTION OF GARAGE AND PROPOSED CHANGES AT 1112 SOUTH SECOND STREET, STILLWATER
The building in question is a two car garage with a large attic space. The garage
base measures 22 by 28 feet. The attic floor, excluding the north stairs, measures
approximately 16 by 26 feet, with an apex height of 11 feet.
Prior to our purchase of the property in December, 1987, the garage attic was used
for storage. The attic is accessed by stairs at the north end of the structure. The
attic wall~ere lined by shelving, and a sbrage closet was present in the northeast corner
of the garage attic, adjacent to the stairs. The electrical supply to the garage
originates from the main circuitbox in the house.
The house was built in approximately 1875, but the garage is a more recent structure
built sometime prior to 1926.
Prior to our understanding of proper procedures for initiating this type of project,
we began some improvements. We stopped all work at this time, pending evaluation
by the Planning Commission and Council.
Pending approval, the completed improvements would include; upgrading the electrical
system, especially removing overhead exposed wires; insulating; placement of a multi-
laminate beam to improve support of the floor; placement of additional roof rafters;
roof replacement; placement of a south wall diamond shaped window and north wall
window to improve ventilation and light; and placement of roof eave vents. When the
roof is replaced, we hope to place three east facing roof windows. Additionally, the
interior would be finished in sheetrock and the storage closet rebuilt. Heat would
be supplied by electric baseboard units. The exterior woud be repainted, and a
cupola rebuilt and placed at the garage apex. This cupola would be a reproduction
of the original noted in a photograph from 1926.

Variance to the rearyard and sideyard setback requirement '(three feet sideyard
proposed, ten feet sideyard required, three ft. rearyard proposed,
twenty-five ft. rearyard required.
DISCUSSION:
The request is for a seven ft. sideyard variance and a twenty-two ft. rearyard
variance. The reason for these variances is because of the irregular shaped
lot. The Minnesota Department of Transportation owns Lot 4, leaving the lot
much deeper on the South side. The proposed site shows the driveway entrance
being moved to the center of the lot. The front and south side of the lot
would be filled with the existing garage being accessed from the north side.
The residence has three levels, basement, first level, second level and the
attic level under the roof will be used for storage.
Adjacent homes on either side uf Lots 22 and 23 are setback from the front
property line the same amount. (See aerial photo.) Mr. Nammacher feels that
the location and design of this home will fit into the character of the
surrounding areas. There are no other homes or structures located within
thirty feet of the proposed home.
There is concern over the setback from the bluff edge. Drainage studies, soil
testing, and erosion measures should be conducted in this area before
construction of the home.
The house viewed from Broadway will be thirty-eight feet tall (with a
regulated height of twenty-nine feet three inches). The height limit in the
R-B District is thirty-five feet. The East (river) elevation shows a building
height of forty-five feet three inches.
CONDITIONS OF APPROVAL
1. All roof drainage shall be contained on site and not run over the cliff
edge.
2. The rear yard shall be landscaped before project occupancy.
3. The height of the structure shall be thirty five (35) feet and 2 1/2
stories.

4. A resubdivision application shall be approved for adding Lot 5, Block
42 to Lots 22 and 23, Block 42.
5. The old curb cut shall be replaced with curbing.

Please accept this letter as a request for a rear yard set-back
variance on our lot located at 515 Broadway South, Stillwater, in
accordance with the enclosed site plan.
Upon approval, we plan to build an "1890 Victorian style" hOlCLe on
the bluff overlooking the St. Croix River.
This request is required because our lot has an irregular shape. On
the east side along the bluff, the lot line steps back leaving
approximately 50 feet between the edge of the bluff and our lot
line. Tt!e Department of Transporation owns this odd piece of land.
Upon checking with the D.O. T., we find they do not have any
requirements tt~t would effect this variance.
We propose to build our new home so that it is roughly in line with
the existing homes on either side. Note, that the home to the north,
on lot 24, is located within several feet of its lot line.
Great care has been taken to design a home tt~t fits in with the
character of the surrounding area. The addition of our home to the
neigtmorhood should have a positive effect and be an asset to the
com.m.uni ty.

PROJECT DESCRIPTION:
A variance to the sideyard and rearyard setback requireme~ts for the
construction of a 20 ft. x 24 ft. garage.
DISCUSSION:
The request is to construct a 20 ft. x 24 ft. garage with a sideyard setback
of approximately three ft., from the property line and a rearyard setback of
approximately four feet. ~he sideyard setback requirement is ten feet and the
rearyard setback is twenty\five feet. Therefore, the two variances needed are
a seven foot sideyard variance and a twenty one foot rearyard variance.
The location of this new garage is proposed because of the location of the
house and driveway on the property. The home is quite large for the size of
the property, leaving a minimal amount of area for a garage. Also, a concrete
driveway presently exists on the West side of the property which will provide
access to the garage. The placement of the garage in the Northwest corner
will give easy access for cars. If it was shifted East, it would be difficult
for cars to get into the garage. The neighbors garage is approximately oe foot
West of the side property line.
CONDITIONS OF APPROVAL:
1. The West wall will be one hour fire rated (as per Building Code
requirement).
2. Run-off from the roof will not drain on to adjacent properties.
RECOMMENDATION: Approval.
FINDINGS
For reasons set forth fully in the discussion, the granting of the variance is
necessary for the reasonable use of the land and building and that the same is
the minimum variance that will accomplish such purpose.

BACKGROUND
This application by the City of Stillwater will be the basis for amending
permits 82-242-12 and 85-415-23 issued by the U.S. Corps of Engineers and
permit 82-6124 as amended issued by the Minnesota Department of Natural
Resources. The current application includes both on land and in water use and
improvements.
PROJECT DESCRIPTION:
In-water improvements includes two docks, one for charter/excursion boats
currently located to the North and one accommodating approximately 25 boats,
public transient boats currently located to the South. Three excursion boats
and a ~arge ticket office are moored at the North docks.
The new plan includes flip-flopping the docks (the charter/excursion docks
moved to the South and public docks moved to the North), allowing the
excursion boats to be moored to the dock year around and boats staying at the
public docks for as long as two weeks. The docks size and configuration would
be the same.
Besides the in-water improvements, on-land improvements are proposed to
tie pathways into Lowell Park and the South Main parking lot, provide
additional parking to serve the boats and trash receptacle area. (Existing
conditions are shown on the aerial photo and the new dock location and land
improvements are shown on Map No.1.)

DOWNTOWN PLAN
The Downtown Plan for the area (Map 2) includes a design for the area similar
to the proposed project. The Downtown Plan Pedestrian Circulation Map shows a
landscaped pedestrian pathway running along the river to a boating plaza and
back to Nelson Street and also connection to a future visitors center. The
Plaza would be a place where people could pause to overlook boating activitys
await boarding or be introduced to the Downtown. Design elements could include
landscapings interpretive displays seating and possibly drinking fountains and
City directory to accommodate visiting boaters.
The boating and activity creates parking demands. As part of the Downtown Plan
parking conditions in the South Main Street area (Area 1) were studied. Table
1 compares parking needs to parking supply. The study shows that there is a
150 to 200 car parking deficit in Area 1. The Andiamo excursion boat has an
estimated parking demand of 50 parking spaces. The public docks have minimal
parking impact. As a part of the Downtown Plans expansion of the South Main
Street City lot was considered and a conceptual plan developed to accommodate
an additional 30 parking spaces. (See new parking area map.)
Based on the need for South Main Street parkings it is suggested that the
addition of 30 additional parking spaces be considered along with on-site
pathway and plaza improvements. The improvements could be funded by new uses
in the area based on parking demand. (This was previously done to finance the
existing South Main lot.)
SPECIAL USE PERMIT
A Special Use Permit is required for the new project because the docks are
located in the Flood Plain District. The Bluffland/Shoreland District contains
standards for on land improvements including:
- use is consistent and complimentary to existing and adjacent urban land
uses and local plans.
- a parking layout and site plan which provides on-site and off-street
parking spaces for all employees and customers as required by local
ordinance is required.
- a drainage plan to minimize erosion.
- a landscaped plan to minimize the visual impact of the project as viewed
from the river.
- no signs facing the river.
PROJECT ANALYSIS
The charter/excursion boat use and public docks are uses consistent with and
complimentary to the Downtown. The parking and economic studies of the
Downtown Plan indicate that the dock uses support other uses Downtown. The
Downtown Plan includes linking the City lands South of the Dock Cafe with
Lowell Park so park users can view and enjoy the boating activities and
excursion boat users can easily get to other parts of Downtown. A detailed
plan for the on-land improvementss pedestrian paths landscaping plans
development parkings land utilities areas should be developed so that the
improvements can be coordinated with other Lowell Park improvements.

The additional parking spaces that can be added to the South parking lot,
should be provided as soon as possible so the parking situation can be eased.
Area new development share in the responsibility for additional demand
including the Dock Cafe, Freighthouse, future elevator development and the
Andiamo.
In a letter to the City Council, the Stillwater Dock Company outlined terms
for moving the docks (attached). It is suggested that the terms be accepted
and that a five year commitment to this dock configuration including pathway
and parking improvements be given.
RECOMMENDATION
Approval of the Dock location and on-land improvements as conditions with the
following findings:
1. The project will not adversely affect the flood capacity or flow of
the St. Croix River.
2. The project as conditioned will meet the Bluffland/Shoreland District
standards.

3. The proposed project is consistent with and complimentary to existing
adjacent development and the City Plan.
CONDITIONS OF APPROVAL
. 1. On-land walkway, landscaping, utility and parking area requirements
shall be made consistent with the Downtown Plan. -
2. The South parking lot shall be expanded to accommodate 30 additional
parking spaces.
3. The City shall enter into an agreement with the Stillwater Dock
Company to grant a five year lease, renewable for an additional five
years for use of City land to provide access to docks with parking and
City lands improvements paid in part by the Stillwater Dock
Company/St. Croix Packet Company.
4. Other terms as described in the project. Descriptive letter dated
September 6, 1988 by Nile Kriesel shall be met.
5. Necessary U.S. Corps of Engineers and Minnesota Department of Natural
Resources permits shall be obtained before this approval is valid.

It has become apparent that a problem exists with the manner in which our
charter boat docks are located and operated. The problem, as we see it,
is the close proximity of the dock to the Dock Cafe, seemingly interfering
with Dock Cafe operations. We propose to alleviate this problem in the
following manner:
1. St. Croix Paket Co. would purchase the charter dock and
electrical service from the Stillwater Dock Co.
2. Move the charter dock and the public dock lAW a plan submitted
to the port authority on April 13, 1988. All expenses to be
borne by St. Croix Packet Boat Co.
3. Request a 5 year lease be granted St. Croix Packet Co to operate
on city property at location prescribed in the plan.
4. Work with City of Stillwater in response to questions raised
by DNR LTR and DTD April 22, 1988.
We feel the charter/excursion boat operations conducted by St. Croix
Packet Boat Co are important to Stillwater and the community and every
effort should be made to find them a "home port" that will ensure
continued operations.
We respectfully request that our 1988 wharfage permit be granted on the
basis of the Port Authority recommendation per our April 13, 1988 meeting.
We further request that this plan be conceptually approved and work
started to implement this plan. Landscaping indicated in the plan would
be implemented immediately while the actual moving of the docks would
take place no later than October 15, 1988.

Dear Mr. Watson:
Enclosed you will find applications for permits to place and operate a General
Boating (transient) Dock Facility and a charter/excursion dock facility. The
City is applying for separate permits for each facility.
The dock~ are presently in place ~nd in operation pursuant to permit No.
82-6124. However, the City ,would, through the permit process, seek approval to
re-locate the docks. The relocation would merely involve placing the
charter/excursion docks in the present location of the general boating docks
and vice-versa. .
In addition to the request to relocate the docks, the City is asking for
specific approval to:
1. Moor up to three (3) charter/excursion boats and one (1) floating ticket
office vessel at the charter/excursion dock facility;
2. Allow year-round docking for the charter/excursion boats;
3. Allow "chartered" cruises to be the primary business of the
charter/excursion boat operations as long as "walk-on" trade is
accommodated on a regularly scheduled basis;
4. Allow docking in excess of twenty-four (24) hours on the general boat
dock facility to accommodate boaters that make long range trips to
Stillwater and who intend to stay in the area for an extended period of
time (one weekend to two weeks);
5. Allow a small structure to exist on the general boat dock facility tp
provide shelter for the dock operators (boat handlers); and
6. Allow Stillwater Dock Company to act as the City.s agent for the
operation of the docking facilities.

I have been following the communications and notices to and from
the City of Stillwater regarding the proposed relocation of the
City transient docks and the charter boat docks (switch
locations), and the permit applications for these items.

Thank you for sending us copies of the meeting notices and
permit applications. I have the following comments as staff for
the Minnesota-Wisconsin Boundary Area Commission:
Please be advised that I have no objection to the
"flip-floppinglt of the dock locations' under separate permit
applications by the City.
I have a couple of concerns about the particular requests,
however, in terms of compatibility with the Riverway zoning
standards and Lower St. Croix River Management Commission
policy:
-
1. We are concerned about the inclusion of a structure
(the small shelter) on the transient dock. This
appears to be the placement of a visually conspicuous
structure (although floating) within the Riverway.
2. While transient docks certainly could be used for more
24 hours by any party - we suggest they not be given a
reservation in excess of 24 hours and they be required
to pay on a daily basis - to avoid the transient docks
being construed as a marina.

3.
Is the floating ticket office a vessel or a structure
floating on the water? We would advise clarification
from the DNR about the acceptability of this request.

RE: TIMING OF DOCK RELOCATION PERMIT APPLICATION

Apparently some questions were raised during the Planning Commission's review
of Case No. SUP/88-60 (relocation of the general and charter/excursion boat
docks) regarding the timeliness of the City's submittal to the permit
application to the Army Corp of Engineers. The inference was that the docks
could or should have been moved by October 15, 1988, as required by the City's
permit issued to Stillwater Dock Company of May 3, 1988. In view of this, I
thought it would be appropriate to prepare a chronology of events related to
the permit application to show what has transpired since the first meeting and
discussion of this issue.
I think the chronology of events disclose that the City (or City Coordinator,
as the case may be) acted as quickly as events or conditions would allow. The
docks could not be relocated without U.S. Army Corp of Engineers approval, and
it was that agency that requested a meeting on the issue of relocating the
docks before the permit process would begin. The submittal of a permit
application prior to this meeting would have been counter productive or at
1 east premature.
I realize that it took some time to meet with the Corp of Engineers. However,
we met at the time and convenience of the Corp of Engineers - we do not set
their schedules.
Once the aforementioned meeting took place, we also acted as quickly as
possible. The actual permit application took place one day after the council
met to give approval to the application (September 7, 1988). The Corp has not
yet issued the permit. Therefore, the docks cannot be moved at this time -
regardless of the conditions specified in the ~ issued permit.

Please consider this letter as a request to amend the permit formerly issued
to the City for a charter/excursion boat docking facil ity and a general
(transient) boat docking facility. The City would like to amend the permit to
allow the following:
1. General Boating Dock Permit
a. to place dock where charter/excursion dock is now located;
b. to place a small shelter on the dock;
c. to have short-term docking (24 hours or less) with occasional
weekend docking (72 hours or less) and a limited number of medium-
term docking (2 weeks or less). Seasonal or long-term docking would
not be allowed.
2. Charter/Excursion Boating Dock Permit
a. to place dock where general boating dock is now located;
b. to provide mooring for three (3) charter/excursion boats and one (1)
floating ticket office vessel;
c. to allow year-round docking; and
d. to allow "chartered" cruises to be the primary business as long as
"walk on" excursion trade is accommodated on a regularly scheduled
basis.

Per our telephone conversation! on October 20th, I believe that it would be
less confusing to have a separate permit with separate conditions issued for
each dock and to have each per~it issued to the City. This would also be
consistent with the permit app~ications sent to the United States Army Corp of

As a follow-up to our meeting this summer, we would like to reiterate the
process that we feel would best solve the problems with the Stillwater
Municipal Docks:
1.
The City should submit a formal permit amendment request letter
to relocate the municipal dock and to request that the municipal
(transient) dock be the only dock authorized under the city's
permit. The amendment fee is $30.00, payable to the DNR. Any
other proposed permit modifications should be made at the same
time. A letter similar to your September 6, 1988 letter to the
Army Corps of Engineers is all that would be required to amend
your existing permit. We feel that two (2) separate permits are
necessary for these two docking facilities.
2. The leasee of the property for the Andiamo should apply for their
own permit. We will send them the appropriate permit application
forms.
3. We would have no objection to the issuance of the conditional use
permit amendments to relocate the docks~ once the permit issues
are straightened out.

for the City.
Mr. Russell explained that this spring th'e Stillwater Port
Authority, in the course of renewing the dock permit for the
stillwater Dock Company, was made aware of problems caused by the
present location of the Andiamo boat dock. After several
meetings, it was determined by the parties involved that the
appropriate solution to the problem would be to ,switch the
Andiamo boat dock location with that of the transient boat docks.
John Easton, partner in the Stillwater Dock Company, addressed
the Commission and stated that the costs involved in switching
the docks are estimated at $20,000 to $25,000, and that the costs
would be borne by the st. Croix Boat and Packet Company, which
leases the dock for the Andiamo. He explained that he recen~ly
learned that the st. Croix Boat and Packet Company is no longer
willing to pay those costs.
Mr. Easton feels that this expense is not justified for what he
feels is a temporary solution to the problem. He stated that
when the City reacquires the Aiple property, a long-term solution
may be reached, and this would cause the docks to be moved once
again.
Mike McGuire, owner of the Dock Cafe, addressed the Commission,
and explained that the dock permits were issued based upon the
agreement that the docks would be relocated by October 15.
Chairman Fontaine stated that he feels the agreement should be
adhered to. Mr. Easton stated that a less costly solution would
be to move the Andiamo docks to another location and leave' the
transient docks where they are.
Mr. Russell stated that at this time, the City must take a
position, and report to the Corp of Engineers. The Corp will not
take action until the City states its position.
Mark Ehlenz made a motion to approve the Special Use Permit,
based upon the verbal agreement made in April; seconded by Judy
Curtis. Motion carried 4-2; Nancy Putz and Glenna Bealka opposed.

The additional parking spaces that can be added to the South parking lot,
should be provided as soon as possible so the parking situation can be eased.
Area new development share in the responsibility for additional demand
including the Oock Cafe, Freighthouse, future elevator development and the
Andiamo.
In a letter to the City Council, the Stillwater Dock Company outlined terms
for moving the docks (attached). It is suggested that the terms be accepted
and that a five year commitment to this dock configuration including pathway
and parking improvements be given.
RECOMMENDATION
Approval of the Dock location and on-land improvements as conditions with the
following findings:
1. The project will not adversely affect the flood capacity or flow of
the St. Croix River.
2. The project as conditioned will meet the Bluffland/Shoreland District
standards.
3. The proposed project is consistent with and complimentary to existing
adjacent development and the City Plan.
CONDITIONS OF APPROVAL ~
1. On-land walkway, landscaping, utility and parking area requirements
shall be made consistent with the Downtown Plan.
2. The South parking lot shall be expanded to accommodate 30 additional
parking spaces.
3. The City shall enter into an agreement with the Stillwater Dock
Company to grant a five year lease, renewable for an additional five
years for use of City land to provide access to docks with parking and
City lands improvements paid in part by the Stillwater Dock
Company/St. Croix Packet Company.
4. Other terms as described in the project. Descriptive letter dated
September 6, 1988 by Nile Kriesel shall be met.
5. Necessary U.S. Corps of Engineers and Minnesota Oepartment of Natural
Resources permits shall be obtained before this approval is valid.

Boating (transient) Dock Facility and a charter/excursion dock facility. The
City is applying for separate permits for each faci1ity.
~he docks' are presently in place and in operation pur~uant to permit No.
.82-6124. However, the City would, through the permit process, seek approval to
re-locate the docks. The relocation would merely involve placing-the
charter/excursion docks in the present location of the general boating docks
and vi ce-versa.
In addition to the request to relocate the docks,' the City is asking for
specific approval to:
1. Moor up to three (3) charter/excursion boats and one (1) floating ticket
office vessel at the charter/excursion dock facility;
2. Allow year-round docking for the charter/excursion boats;
3. Allow "chartered" cruises to be the primary business of the
charter/excursion boat operations as long as "walk-onu trade is
accommodated on a regularly scheduled basis;
4. Allow docking in excess of twenty-four (24) hours on the general boat
dock facility to accommodate boaters that make long range trips to
Stillwater and who intend to stay in the area for an extended period of
time (one weekend to two weeks);
5. Allow a small structure to exist on the general boat dock facility to
provide shelter for the dock operators (boat handlers); and
. 6. Allow Stillwater Dock Company to act as the City's agent for the
operation of the docking facilities.

Dear Mr. Kriesel:
Recently, Brian ~atson of my staff met with you and other interested
individuals regarding the non-~ompliance with permit 82-242-12 ~ssued to the
City of Stillwater and 85-~15-23 issued to the Stillwater Dock Company. This
non-compliance was the subject of our previous letter dated May 12, 1988. In
an attempt to resolve this matter, the City indicated that they would like to
submit revised plans to our office showing the proposed new location of the
docking structures.
After evaluating this information, the District~ngineer has decided that
.. legal action will presently be initiated in this matter. Instead, you will
provided an opportunity to obtain a Department of the Army permit for these
non-compliance activities. The af~er-the-fact permit process provides for a
more comprehensi~e assessment of your project and will result in a final
determination of whether or not your project satisfies the public interest
criteria of the Corps regulatory program.
If the after-the-fact permit application is approved, your project will
be duly authorized and our investigation file will be closed. If, however,
your project is determined not to be in the public interest and the after-the-
fact permit application is denied, the District Engineer is authorized to
prescribe any corrective actions deemed necessary with regard to these non-
compliance activities, including restoration, and to reconsider whether civil
and/or criminal sanctions are appropriate.
Enclosed is the required permit application, which -must- be completed. and
returned to this office within 30 days from receipt of this letter.

complaints/violations of the docking facilities located near East Nelson
Street in Sti llwater., I have reviewed the docking- facil'ities and there does
appear to be some question about the structure located on the general boating
dock faci 1 ity and the moored barge (licket/offi<;e vessel) ,in regard to
compliance with the dock permits. However, the other concerns that are raised
are not consistent with my understanding of the intent of the'City, and the
dock, operation, to run public. cruises/charters from the docks as well as to
moor the craft on a s'easonal basis. '
I fully agree that a meeting will be necessary to straighten out any problems
that have been created through misunderstanding or through .intent.~ I.will
contact- Mr~' Watson or Mr. Standkov to set up a meeting in the near'future.'

docking facilities located in the St. Croix River in the City of
Stillwater. The Corps of Engineers issued two permits for the
construction of docks in this area. Department of the Army permit 82-
242-l2, issued on May 18, 1982, authorized the construction of a dock at
this location. Special condition 2 of this permit states that If no shed
or like structure will be placed on the dock If. During an inspection of
the dock on April 2l, 1988, it"was noted that a structure was placed on
this dock in non-compliance with special condition 2 of that permit.
We also inspected the dock authorized on May 8, 1985 by Department
of the Army permit 85-4l5~23. Special condition 2 of that permit also
states that no structure shall be constructed on the dock. During our
inspection, it was noted that a permanently moored barge with a structure
on it was moored adjacent to the dock. This permanently moored structure
requires permit pursuant to Sec tion 10 of the River and Harbor Ac t.
Since no permit has been issued for this structure, it is in violation of
that Act.
In addition, there are several other concerns regarding compliance
with the following special conditions of permit 85-415-23:
3. There shall be contractual assurance that the dock will be used for
public cruises.
4. All operators using the dock will be fully licensed.
6. The dock shall not be used by private charter craft for seasonal
moorage. Such craft shall use the dock only for loading and unloading of
passengers and shall not be moored at the dock overnight.

It appears that private charter boats are using this dock on a
permanent basis in violation of special condition 6. Also, concerns have

been expressed that these 1harter boats are not used for public cruises
and that operators are no~ fully licensed. Any information you can
provide regarding these iss~es would be appreciated.
It appears that a meeting with all interested parties is necessary

review from all commenting agencies may be required for any permit

Mayor Abrahamson explained that the Special Meeting was called at
the request of Mr. Michael McGuire in order to discuss the dock
permits and conditions of the permits for the Stillwater Dock
Company. Mr. McGuire addressed the Council and explained that he
met today with John Easton and Dick and Don Anderson and a
compromise solution was attained.
Mr. Easton summarized the compromise plan, which calls for
exchanging the locations of the excursion dock and the public
dock, and for purchase of the excursion dock by the st. Croix
Boat and Packet Company from the Stillwater Dock Company. A
docking permit of at least 5 years would be requested, because.of
the expense involved in relocating the docks (estimated at
$15,000). A landscaping plan would also be implemented.
Council discussed the issue of private use on public property,
assessments and taxation. It was determined that with the number
of considerations involved, that a temporary permit will be
issued for this year, during which time further negotiations will
take place. The landscaping plan will be implemented this year.
Councilmember Farrell suggested a straw poll be taken tonight and
direction given to Staff to draft a formal motion for approval at
next Tuesday's Regular Meeting.
Motion by Councilmernber Farrell, seconded by Councilmember Kimble
to take a straw vote on the matter of the temporary annual permit.

OLD BUSINESS
Discussion of the Lowell Park Levee. Nile \Kriesel reported that he has
had no comments from Congressman Sikorski's office since his aid's visit
last month. During that visit, the City asked for the Congressman's
assistance in seeking financial aid for the levee repair. Mr; Kriesel
.0 reported that according to the City's consulting engineers, there
no immediate safety hazard regarding the levee. Discussion followed
regarding use of TIF money, and the possibility of making the levee
inaccessible until repairs'are made.
Discussion of Burlington Northern property. Nile Kriesel reported
that he wrote another letter to EN on March 31 asking for a response.

John Easton, Mike McGuire, and Dick and Don Anderson were present and
reported on the results of their meeting. Two separate plans have been
developed and were presented to the Commission. Mike McGuire's plan
calls for switching the locations of the Andiamo docks and the public
docks. The Andersons' plan calls for use of signage, a fence and a gate
to direct the flow of traffic and pedestrians. The Andersons also
stated that this is a temporary solution, while they continue to look
for a more ideal docking site.
The Commission determined that the issue is a business problem, and
should not be resolved by the City. Motion by Barrett Colombo, seconded
by Jim O'Brien to renew the permit for Stillwater Dock Company. All in
favor.
Discussion followed regarding fees for the permits. Last year the
permits were $250 for the Charter Excursion dock and $250 for General
.ating Dock for a total of $500. Motion by Dean Funke, seconded by

Excursion dock, and $250 for General Boating Dock. All in favor.

OLD BUSINESS
The Commission discussed the Burlington Northern property. Nile
Kriesel reported that the City is still awaiting further
communication from BN. He also reported that the Stillwater Yacht
Club's lease of property with BN was recently increased to $7000
,per year.
Nile Kriesel gave an update on the levee improve~ents. The Corps
of Engineers has indicated that there will be no financial aid
available to the City for this project. Members of Congressman
Sikorski's staff were at City Hall today and a request was made
through them for the Congressman's assistance in seeking
financial support for the improvements.
Mr. Kriesel requested that the Port Authority draft a statement
establishing the Role and Function of the Port Authority and
communicate with the City Council in this regard. Barrett
Colombo suggested that this item be continued to another meeting.'
WHARFAGE P,ER)iIT APPLICATIONS
Renewal of permit for Taylors Falls Princess - The Commission
discussed the fee and mooring site for the Taylors Falls
Princess. City Attorney Magnuson suggested that the mooring site
be described on the permit as South of Mulberry Point and North
of the Gazebo.
Motion by Jim O'Brien, seconded by Barrett Colombo to renew the
wharfage permit for the Taylors Falls Princess at $250. All in
favor.
Renewal of permit for Stillwater Dock Company - John Easton of
Stillwater Dock Company, Mike Maguire of the Dock Cafe, and Don
Anderson and Dick Anderson of the Andiamo were present to comment
and answer questions from the Commission. There was lengthy
discussion regarding location of the Andiamo boats, traffic,
congestion and parking problems.

Dear Mr. Kriesel:
I have been following the communications and notices to and from
the City of Stillwater regarding the proposed relocation of the
City transient docks and the charter boat docks (switch
locations), and the permit applications for these items.
Thank you for sending us copies of the meeting notices and
permit applications. I have the following comments as staff for
the Minnesota-Wisconsin Boundary Area Commission:
Please be advised that I have no objection to the
"flip-flopping" of the dock locations cinder separate permit
applications by the City.
I have a couple of concerns about the particular requests,
however, in terms of compatibility with the Riverway zoning
standards and Lower St. Croix River Management Commission
policy:
1. We are concerned about the inclusion of a structure
(the small shelter) on the transient dock. This
appears to be the placement of, a visually conspicuous
structure (although floating) within the Riverway.
2. While transient docks certainly could be used for more
24 hours by any party - we suggest they not be given a
reservation in excess of 24 hours and they be required
to pay on a daily basis - to avoid the transient docks
being construed as a marina.
3.
Is the floating ticket office a vessel or a structure
floating on the water? We would advise clarification
from the DNR about the acceptability of this request.

PUBLIC HEARINGS
Case No. SUP/88-54 - Special Use Permit to conduct a secretarial
service in a residential home. Leanne and John Gillstrom
presented the request.
Mrs. Gillstrom explained that the business will be very "low-
key". Advertising will be by word-of-mouth, and she will pick up
and deliver materials, so there will be no excess traffic in the
neighborhood.
There were no comments from audience members; and the Commission
could find no problem with the request.
Motion by Mark Ehlenz to approve the Special Use Permit; seconded
by Judy Curtis. Motion carried 6-0.
Case No. SUB/88-53 - Continuation of a request to subdivide a
47,800 square foot lot into two lots. Karl Neumeier, property
owner, presented the request.
Mr. Neumeier has reoriented the lot lines and changed the square
footage of the lots to make lot B buildable. Lot A now has
15,000 square feet and Lot B has 29,000 square feet. His new
plans show the elevation lines and proposed sewer easement for
the lots. Road access to Lot B would be provided by an easement
across Lot A.
A neighbor of Mr. Neumeier, Brian Palmer, asked what square
footage of Lot A has a greater than 30% slope. Mr. Russell
answered that, based on the topographical maps, approximately
6,000 square feet has a greater than 30% slope which would leave

less than the 10,000 square feet required by the Zoning
Ordinance. Mr. Neumeier stated that the amount of square footage
with a greater than 30% slope is inconsequential because it is a
dip in the property that could be filled in after the basement is
dug.

The Commissioners dete~mined that Lot A does not meet the Zoning
Ordinance and discussed whether a modification of the Ordinance
is justified in thisl case. Mr. Kimble stated that the case
could be determined a hardship because of the topography of Lot
B. The expense of installing sewer lines would be excessive in
relation to only one home being built on the lot. Mr. Russell
stated that there may be enough square footage to install a
septic system if it remains as one lot.
Mark Ehlenz made a motion to deny the subdivision request. Nancy

for the City.
Mr. Russell explained that this spring the Stillwater Port
Authority, in the course of renewing the dock permit for the
Stillwater Dock Company, was made, aware of problems caused by the
present location of the Andiamo boat dock. After several
meetings, it was determined by the parties involved that the
appropriate solution to the problem would be to switch the
Andiamo boat dock location with that of the transient boat docks.

John Easton, partner in the Stillwater Dock Company, addressed
the Commission and stated that the costs involved in switching
the docks are estimated at $20,000 to $25,000, and that the costs
would be borne by the st. Croix Boat and Packet Company, which
leases the dock for the Andiamo. He explained that he recen~ly
learned that the st. Croix Boat and Packet Company is no longer
willing to pay those costs.
Mr. Easton feels that this expense is not justified for what he
feels is a temporary solution to the problem. He stated that
when the City reacquires the Aiple property, a long-term solution
may be reached, and this would cause the docks to be moved once
again.
Mike McGuire, owner of the Dock Cafe, addressed the Commission,
and explained that the dock permits were issued based upon the
agreement that the docks would be relocated by October 15.
Chairman Fontaine stated that he feels the agreement should be
adhered to. Mr. Easton stated that a less costly solution would
be to move the Andiamo docks to another location and leave the
transient docks where they are.

Mr. Russell stated that at this time, the City must take a
position, and report to the Corp of Engineers. The Corp will not
take action until the City states its posi~iop.
Mark Ehlenz made a motion to approve the Special Use Permit,
based upon the verbal agreement made in April; seconded by Judy
Curtis. Motion carried 4-2; Nancy Putz and Glenna Bealka opposed.

BACKGROUND:
In June 1986 the City Council approved a subdivison plan for the subdivision
dividing a 27,750 square foot lot into two lots of 12,750 square feet and
15,000 square feet. The Subdivision Ordinance requires that the Final Plat be
recorded within six months of the plan approval. Since that time, the
Subdivison Ordinance has been changed, requiring 20,000 square feet for single
family lots without sewer service. It is recommended that the original plans
are approved but subject to a certification that the lot can accommodate a
private sewage system.
RECOMMENDATION: Approval.
CONDITIONS:
1. The applicant shall provide certification by a qualified professional that
the soil conditions and site can accommodate a private sewer system.
2. The applicant shall enter into an agreement with the City to provide
access to the site.

LICENSE
The City of Stillwater, by this license, hereby grants to
Robert L. and Dorothy M. Benson, their heirs, assignees and
transferees, permission to construct a driveway on a portion of a
lawful public street in the City of Stillwater, in accordance
with and subject to the following terms arid conditions:
1. The street is that portion of Poplar Street adjaceant to
parcels "A" and liB" on the attached Exhibit IIA".
2. The driveway shall be used solely for the purpose of
ingress and egress to residential dwelling houses on parcel's "A"
and "B".
3. The driveway shall be constructed with a six inch class
5 base and covered with 2 inches of bituminous surfacing.
4. The driveway shall be located on the north half of the
street and shall have a 12 foot minimum width and shall have side
slopes no steeper than 3 to 1.
5. The driveway shall remain parallel to the right-of-way.
6. The licensee shall establish turf as soon as possible on
any areas exposed by construction of the driveway, and agree to
provide erosion control devices to prevent erosion during
construction.
7. The rough grading and the application of any surfacing
shall be subject to the direction and control of the city Public
Works Director.
8. The Licensee shall be responsible for all maintenance
and snow plowing of this driveway and it shall not be in any
event the responsibility of the city of Stillwater or its various
departments.
9. That the Licensee agrees that by this license they
acquire no vested rights in any portion of the driveway or other
utilities that are constructed on the street. In the event the
street is improved by the city, they agree to forfeit the
driveway to the city without compensation.

1. Case No. 640 - Minor Subdivision plan subdividing one 27,750 square ft.
lot into two lots of 12,750 sq. ft. and 15,000 sq. ft. (existing residence) at
206 West Poplar in the R-A Single Family Residential District. Robert Benson,
Applicant.
Discussion: The application is to subdivide an existing 1851 x 1501 lot
(location at the corner of Poplar and Fifth Streets) into two lots of 851
x 150' and 100' x 1501. The site is located in the R-A district. The
proposal meets the lot size requirements for the district and the
remaining lot with the existing structure has not created a nonconforming
situation.
Recommendation: Approval of Subdivision Plan as conditioned and
recommended to the City Council.
Planning Commission Action: Decision on recommendations.
Findings: The minor subdivision plan is consistent with the general plan
and zoning.
Conditions: (1) A final subdivision plat shall be submitted within six
months of this approval and meet the requirements of Section 31.06,
Subdivision 3 of the Subdivision Ordinance.

In re: Combination Wine On-Sale Licenses
Dear Mary Lou:

The legislature recently amended the Intoxicating Liquor Act
by allowing local ordinances to permit the holder of an on-sale
wine license, who is also licensed to sell 3.2 beer at on-sale
and whose gross receipts are at least 60% attributable to the
sale of food, to sell strong beer liquors at the on~sale site
without an additional license.
If Stillwater would like to provide this option to their
combination 3.5 beer wine on-sale license holders, we would have
to amend our ordinance to do so. Let me know if I should draft a
proposed amendment, since I don't think I should do it until the
council authorizes a first reading.

. Dear Mayor and Councilmembers:
As you will recall, in the summer of 1987 Mr. Granquist
petitioned the city council to condemn land to provide access to
the Granquist property which is described above. The
condemnation would require the acquisition of a relatively small
strip of land owned by Oak Glen Development Corporation as was
shown by the maps and drawings that were provided at that time.
At your July 7, 1987 meeting, the council voted to
negotiate with Oak Glen Development and David Johnson to
purchase, or acquire by condemnation, property to construct a
street access to serve the property owned by Oak Glen Corpora-
tion, the Granquist family, and Mr. N. Balogh, providing further
that the Granquist family would pay the cost of the condemnation,
should condemnation be required. Since that time, it is my
understanding that there has been no progress in the efforts to
obtain that access from Oak Glen Development Corporation and,
consequently, Mr. Donald Granquist who is now succeeded to the
entire interest of the Granquist family parcel described above is
requesting the council instruct staff to proceed ahead with the
condemnation so that this land can obtain access pursuant to the
plan that was provided by Mr. Granquist and which was approved
by the council, a copy of which I annex as an exhibit to this
letter.

At your No ember 15, 1988 meeting I will be appearing on
behalf of Mr. Granq ist to discuss this matter again with you. I
understand Oak Glen Development Corporation may be approaching
the City Council in the next few weeks or months as it affects
other matters and t is may again provide an opportunity to
discuss this matter with them prior to formal condemnation
proceedings going f rward. However, it is Mr. Granquist's firm
desire that this ma ter proceed so that he be in a position to
pursue development pf the property in 1989.

Mr. Russell presented a summary of the proposal with the various
alternatives. Mark Vierling was present to represent the Grandquists.
Discussion followed regarding the various plans, which included grading,
cost of public improvements and the suggestion of sharing a private
driveway with the Balogh.s. It was stated David Johnson is not in favor
of a private driveway to serve the lots. The Grandquists will pay the
condemnation costs if necessary. Jim Blichfeldt was present to represent
his sister and stated they would like the most economical plan and larger
lots.
Motion by Councilmember Bodlovick, seconded by Councilmember Opheim to
negotiate with David Johnson to purchase or acquire, by condemnation, property
to construct street access to serve property owned by Oak Glen Corp., the
Grandquist family, and N. Balogh, provided the Grandquist family pays costs of
condemnat ion. (A 11 in favor) ,
NEW BUSINESS
1. Request from Stillwater Area Economic Development Committee for Star
Cities Designation.
Andy Cass, representing the above mentioned committee, clarified the make
up of the committee, stating it includes nine communities in the area and
the school district. He stated they formed to help communities attract
business and he then reviewed the Star Cities designation and what it
means. Council briefly discussed the above. Sally Everett briefly
explained the County's involvement in promoting business in the community.
Motion by Councilmember Farrell, seconded by Councilmember Opheim to table the
request of the Stillwater Area Economic Development Committee for Star Cities
Designation until review by the City Attorney. (All in favor)

to dogs and other animals. I am sending you the ordinance because the City
received a complaint regarding your dogs. \Please pay particular attention to
Subdivision 6 wherein it states that habitual or frequent barking is a
nuisance. The City does not enjoy issuing citations for a violation such as
this. However, you are responsible for your dog and we will take appropriate
action, if necessary. .
Please take steps to insure-that the animal does not disturb the peace and
repose of your neighborhood - they deserve it.

At their October 11 meeting, the League of Minnesota cities
Insurance Trust Board of Trustees voted to return $5 million in
dividends to the member cities of the LMCIT property/casualty
program. LMCIT also returned $4.2 million to members in 1987.
The member cities' continued success in reducing losses makes
these dividends possible. Cities will receive the dividend
checks early in December.
Again this year, the funds will be allocated among the member
cities according to a formula that reflects the total premiums
paid and the total losses incurred by each city for all years of
participation in LMCIT through ~ay 31, 1988. Under this
formula, cities which have been members of LMCIT the longest and
which have been most successful in avoiding losses will receive
proportionately greater dividends.
Even after returning $5 million to the member cities, the LMCIT
property/casualty program will remain in strong financial shape.
Each year, qualified actuaries review LMCIT's losses and loss
reserves, and project what the ultimate cost of claims is likely
to be. LMCIT holds sufficient reserves not only to fully cover
those projected losses, but also to provide a substantial
additional cushion.
.
Besides returning the dividend, the LMCIT Board also voted to
reduce rates slightly for the coming year. However, the rates
are still designed to cover projected losses with a good margin
of safety. Thus if member cities can maintain their
exceptionally good loss experience, that margin of safety in the
rates should translate into additional dividends in the future.

RE: SNOW STORAGE AREAS
Before the snow season prevails upon us, I thought we should contact the
Council to urge the City to look for alternate snow storage areas other
than the property adjacent to the St. Croix and Lake McKusick. I am
enclosing some pictures that were taken last winter. As you can see, there
are very negative impacts to water quality. The effects of the sediment
can be readily identified, but the effects of the chemicals and road salt
are not so easily discerned.
We recommend that the floodplain areas of the St. Croix be totally
eliminated from the storage plan. It is our opinion that Mulberry Point
has been built up over the years just from the years of snow and street
sweeping accumulations. The large parking area adjacent to the ball fields
could still be utilized, but we recommend that no material be pushed over
the embankments and that runoff be retained in holding ponds before direct
discharge into the wetland areas. John Bruce with the Minnesota Pollution
Control Agency (MPCA) is also interested in working out an environmentally
sensitive solution to your problem. We would be happy to meet with you to
try to arrive at a mutually agreed upon solution. We appreciate the city's
dilema and need to dispose of this material.

70 clients were registered for programs
$567 of Courage Cards were sold
Courage St. Croix opened with an exceptional response
from the Stillwater community_and the Courage Center
support network. Your efforts and time made the event
happen. Thank you.
