This memo is a reminder to Council that a Special Meeting is scheduled for
Monday evening, October 24, 1988, at 7:00 P.M. in the Council Chambers of City
Hall, 216 North Fourth Street, to discuss the following:
PUBLIC HEARING:
1. This is the day and time for the Public Hearing on consideration of the
Downtown Plan amending the City Comprehensive Plan.
Notice of the hearing was published in the Stillwater Gazette on
October 13, 1988.

SUBJECT: PUBLIC HEARING ON DOWNTOWN PLAN
PLAN PREPARATION
Last June the City Council approved a work program for preparation of the
Stillwater Downtown Plan and allocated $85,000 for its development. Following
approval of the work program, the Council appointed a fourteen member Downtown
Plan Steering Committee to oversee preparation of the Plan. Since last June
the Steering Committee has met twenty-two times to review'studies of existing
conditions, formulate goals and objectives, review and comment on Conceptual
Plans and develop guidelines for new development. Besides the regular
committee meetings, the Committee held four public hearing/workshops to get
community input as the plan developed.
On September 21, the Downtown Plan Steering Committee held a public hearing on
the Draft Plan. About fifty members from the public were present. Based on the
Draft Downtown Plan and comments recieved, the Committee recommends approval
of the plan.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission has two representatives on the Downtown Plan Steering
Committee and received progress reports on the Downtown Plan as it developed.
The Planning Commission was particularly interested in Downtown Land Use and
Zoning Amendments necessary to implement the plan. On October 10, 1988, the
Planning Commission held a public hearing on the plan. After reviewing the
plan and hearing public comments, the Commission passed a resolution
recommending approval of the plan as an amendment to the Stillwater
Comprehensive Plan (resolution attached).
SUMMARY OF PLAN CONTENTS
The Downtown Plan includes Goals and Objectives for the Downtown Area to guide
further private and public actions. A Land Use Plan and zoning changes are
proposed to update land use policy. A design framework is provided accenting
the national setting and historic buildings. A parking plan is included in the
plan setting for the short term and longer term solutions to the existing
parking problem. Public utilities are considered in the plan and a Capital
Improvement Program provided to upgrade sanitary sewer, storm sewer, water
lines and street and sidewalks.
The plan provides a guide to direct change and development in the downtown to
achieve thoughtful predetermined goals. The plan should be reevaluated
periodically to make sure it keeps up with changing conditions.

PLAN IMPLEMENTATION
In order to begin implementation of the plan, certain actions can be initiated
by the City Council at this time.
The First Phase Capital Improvements Program listed below can be approved.
Approximately $150,000 of TIF proceeds are available in 1989 to begin
implementation of First Phase improvement. In 1990 approximately $370,000 will
be available for implementation.
FIRST PHASE DOWNTOWN IMPROVEMENTS
- Study and recommendation for railroad trackage
cleanup and pedestrian crossings 2,000
- Generate topographic maps for improvement district
1 and 2 12,000
- Physical inspection of downtown sewers 20,000
- Refine streetscape design elements section 9,100
- Develop parking management plan 5,000
- Develop future parking financial plan 4,900
- Design improvement district #6 streetscape 5,900
- Construct Lowell Park improvements 472,200
- Construct parking lot improvements for District #1 87,000
TOTAL $622.700
Other policy and program changes that can begin with plan adoption are listed
on the attached figure listing non -capital improvment actions. The Zoning
Amendments can be initiated by the Council. A Downtown Plan Action Committee
and Downtown Design Review Committee can be appointed to oversee implementing
actions.
COMMENTS RECEIVED ON THE PLAN
Comments on the plan have been received from Minnesota -Wisconsin Boundary Area
Commission, Fred Brass, owner of the Village Shop, Nancy Coppa, Annette
Johnson and Burlington Northern/Glacier Park Company. The comments can be
considered with plan approval.
DOWNTOWN PLAN STEERING COMMITTEE RECOMMENDATION
The Downtown Plan Steering Committee recommends approval of the plan with the
following changes:
1. The alternative parking structure locations at Second and Olive Street
not include the removal of the telephone building.
2. The land use designation of the block bounded by Pine, Fourth, Oak and
Fifth Streets be changed from the proposed Public Administration
Designation Two Family Residential.

RESOLUTION NO.
RESOLUTION ADOPTING DOWNTOWN PLAN
AS AMENDMENT TO THE CITY COMPREHENSIVE PLAN
WHEREAS, the Metropolitan Land Planning Act requires local governments to
prepare and from time to time update a City Comprehensive Plan; and
WHEREAS, the City of Stillwater has prepared a City wide Comprehensive Plan,
and more detailed area plans for part of the City; and
WHEREAS, the City Council directed the Planning Commission and Downtown Plan
Steering Committee to prepare a plan for Downtown Stillwater; and
WHEREAS, the Downtown Plan Steering Committee met twenty-three times over a
sixteen month period developing the Downtown Plan; and '
WHEREAS, the Downtown Plan Steering Committee did hold public workshops and
hearings on the plan December 2, 1987, March 30, 1988, June 29, 1988 and
September 21, 1988 to present and receive public comment on the plan and
recommends the plan for Council approval; and
WHEREAS, the Planning Commission did hold a public hearing October 10, 1988 on
the plan to receive public comment and recommend the plan for adoption; and
WHEREAS, the City Council held a public hearing October 24, 1988 to review the
plan, receive the recommendations from the Downtown Plan Steering Committee
and Planning Commission.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Stillwater
that the Downtown Plan furthers the public interest of the City of Stillwater
by providing a guide for future development.
BE IT FURTHER RESOLVED, that the Downtown Plan is adopted as a part of the
City of Stillwater Comprehensive Plan.

RESOLUTION CPC 88-1
WHEREAS the Stillwater City Council did initiate an amendment to the City
Comprehensive Plan for the Downtown Planning Area June 2, 1987;
WHEREAS a fourteen member Downtown Plan Steering Committee with two members
from the Planning Commission was appointed to work with Staff and Consultants
on the development of a Comprehensive Downtown Plan;
WHEREAS several workshops and public meetings were held over a sixteen month
period to review Downtown Plan documents and receive input from the public;
WHEREAS the Downtown Plan Steering Committee did on September 21, 1988 hold a
public hearing to present and receive public comments on a Draft Downtown
Plan;
WHEREAS the Planning Commission on October 10, 1988 held a public hearing to
review the Downtown Plan including Goals and Objectives, Land Use, Urban
Design, Utility and Implementation components.
NOW THEREFORE, be it resolved that the Planning Commission recommends to the
City Council that it is in the public interest and community betterment that
the Comprehensive Plan be amended for the Downtown Area by approval of the
Downtown Plan.

RE: Draft Downtown Development Plan
Dear Mayor Abrahamson and Members of the Council:
I have reviewed the draft Downtown Development Plan, September,
1988 and offer the following comments on behalf of the staff of
the Minnesota -Wisconsin Boundary Area Commission:
1. SECTION - Existing Conditions
Your recognition of the bluffs and the St. Croix River, adding
to the "natural beauty and interest" of the downtown area, is to
be commended and it is reflected in the plan. The plan includes
several significant proposals to preserve and protect those
elements.
In particular, you note that "the riverfront is the most
precious natural and cultural feature of Downtown Stillwater,
and how its edge is used is of utmost importance." We agree.
The intent of the Riverway regulations is to protect that
feature through controlled development.
2. SECTION - Goals and Objectives
We strongly support the following objectives stated in the plan:
"Preserve the natural appearances of the entrances to
Downtown, of the bluffs and hillsides, of the river
valley."
"Develop and administer design guidelines for new
development, so that the integrity of the existing and
surrounding buildings is maintained and new development is
of a height, size, and design compatible with the best
examples of existing development."

"Establish height limits for new developments." (This is
particularly important given the official Riverway boundary
is so close to the river in the City of Stilwater. Please
note the 35 foot maximum height restriction for all
structures within the Riverway boundary as well.)
"Establish screening requirements for utility areas and
menchanical equipment."
"Remove parking from the riverfront along Lowell Park as
new parking becomes available and adequate spaces are
available."
"Develop a riverfront park and open space system including
Lowell Park, the City owned property south of downtown, and
Kolliner Park." We, in particular, support this
recommendation and suggest, at such time you develop
specific site plans for areas within the Riverway district,
that you notify the National Park Serive, the Wisconsin and
Minnesota DNR's and our office. We extend an invitation to
work with you to assure compatibility with the National
Scenic Riverway.
We support your objectives for landscaping, views and
vistas, and the riverfront, in general. Each element
serves to enahnce public awareness of the Riverway as an
asset to the community and the region. We encourage you,
within limits, to provide interpretive displays and signage
in the park to explain to visitors the resource and efforts
to protect it.
3. SECTION — Special Sites
We support your intentions for Site #7 South Riverfront
Property, particularly your efforts to revert the area to
public use and control. Your design guidelines appear to
meet the inent of the Master Plan for the National Scenic
Riverway, to the extent you encourage efforts to "maintain
natural appearance of site from the river and entering
Stillwater along Highway 95 from the south."
We support your intentions for Site #8, Kolliner Park.
Much of what happens here will depend upon the final
decisions for a bridge across the St. Croix River. We
invite you to work with the Riverway managing agencies on
final site design.

Downtown Development Plan
In general, we support the extensive efforts you have made to
guide future economic development in a manner that recognizes
the natural resources and amenities of the river valley and
supports the long—term preservation and protection of those
assets. The benefits are both economic and environmental.
As the largest city on the St. Croix National Scenic Riverway
you are embarking on an opportunity to be a positive example in
this valley and for other regions where cities are bounded by or
part of our National and State parks, Riveways, and Monuments.
I am sure you recognize the benefits of such association. At
the same time, you recognize the constraints. You are doing a
great job of recognizing the benefits and attempting to work
within the constraints. Congratulations on your efforts and
best wishes in the years ahead as you strive for implementation.
Please call upon our office for assistance as it is appropriate,
in particular when you begin work on specific design work within
the boundaries of the National Scenic Riverway.

Dear Mr. Mayor:
I was out of town during September and my understanding is that today is the
last day for public input for the Downtown Renewal Plan. While I am generally
supportive of the Downtown Area; a long standing problem obvious to
everyone has been parking, including offstreet parking.
Fortunately my business has offstreet parking, while I understand that this plan
may affect my existing parking area and my ability to expand my store at a
future date.
this letter is written to confirm my understanding that if the plan is approved and
my property is adversely affected, that I will be compensated for any taking or
indirect impact to my property.
Unfortunately I was out of town for the public hearing and no one had •
discussed the particular plan for my property. I spoke to Mr. Russel and saw this
phase of the plan for the first time this morning.
This letter is written to preserve my property rights in the event they are affected
at some future time.

To the Editor:
ELITISM - A sense of being part of a superior or privileged
group.
The downtown plan hearing discussion (Sept. 20) regarding
the need for Stillwater to cater to the "big spenders" on the
river and inferring that providing access for smaller boats only
"asks for problems" serves to remind us why local people no
longer feel welcome or comfortable in the downtown area. The
area we knew as downtown is already an elite resort area. Too
late, folks! We have lived in Stillwater 18 years. We used to
make every effort to do business downtown. Through the years we
have learned they don't need us. Now there is nothing downtown
that we need.

Subject: Stillwater Downtown Development Plan
After careful review of the Downtown Development plan which was presented on
September 21, 1988, this office on behalf of the Burlington Northern Railroad
would object to the following:
1. Any changes in zoning which would cause a change in its present use as a
switching yard.
2. Any changes in zoning which would cause a decrease in value of the
property or cause the impediment of sale of this property to another party
for their use.
Currently, Stillwater is needed as a switching yard by BNRR and we can only
support the Downtown Plan which allows us to operate this yard until the need no
longer exists or someone can pay to relocate us.
We will continue to work with the City of Stillwater on this matter and support
any efforts that mutually benefit both of us.

Dear Mr. Russell:
Thank you very much for inviting us to the screening for the
Stillwater Downtown Plan. The City has obviously put much thought
into the plan and we appreciate the opportunity to provide input in
the process.
In reviewing the Final Draft Report of the Downtown Plan, we offer the
following comments:
O From a planning point of view, the proposed plan does a good job
of integrating new development with the existing 'image of down-
town. However, the type and location of private development
suggested by the plan may be difficult to support from a market
and financial perspective.
o The liberal infusion of parks and other public spaces is very
attractive, but such land uses require public dollars for acqui-
sition and construction. We are concerned that the private
development envisioned by the plan would be unable to support such
a large quantity of public improvements.
O It is our experience with downtown waterfront development in
various parts of the country that the placement of commercial
development on the waterfront can be accomplished in harmony
with public improvements. This alternative may be more financ-
able than the proposed plan.
o A large portion of the public improvements presented in the plan
are located on property which is encumbered by railroad
operations. Relocation of these operations may be time
consuming and expensive and may delay implementation of the
proposed plan.
We look forward to continuing to work with you on the downtown plan.
