STILLWATER WASTEWATER TREATMENT PLANT EXPANSION
. At the Metropolitan Waste Control Commission meeting. of August 2,
1988, the Waste Control Commission approved the 1989 Capttal
Budget. In review of the budget, the Commission considered
delaying construction of the Stillwater Plant for 1 to 3 years.

The budget approved includes the $13,600,QOO plant~expansi6n
beginning in 1989 with completion in 1992 as previously scheduled.

RESOURCE RECOVERY TIPPING FEE
WHEREAS, Ramsey and Washington Counties are authorized by the
Service Agreement dated October, 1986 between the Counties and Northern
States Power Company to establish tipping fees at the Facility; and
WHEREAS, The Ramsey and Washington County Resource Recovery
Project Board has reviewed the quarterly tipping fee survey of March,
1988 by HDR Techserv, .Inc. at an average of $33.17 without surcharge
tax; and

WHEREAS, the Ramsey and Washington County Resource Recovery
Project Board and bot~ Ramsey and Washington County Boards adopted
a resolution to set the level of subsidy.at 130%.of the average landfill
tipping fee. .
WHEREAS, the calculated tipping fee is 130% of the average landfill
cost $33.17 plus the surcharge tax $3.30 per ton 'or $36.48 per ton.
NOW, THEREFORE, BE IT RESOLVED that the Washington County Board
of Commissioners hereby approve a tipping fee of $36.48, effective
July 1, 1988 until January 1, 1989.
. AND, BE IT FURTHER RESOLVED, that for haulers under contract,
the tipping fee of $36.48 shall be effective July 30, 1988.

Gentlemen:
We have determined that it would be in the best
interests of the City to take the steps necessary to ac-
celerate the due date of the remaining unpaid special assess-
ments for Improvement No. 184 on the residential property in
the Oak Glen Planned Unit Development. Under Section 5.04 of
the Development Agreement, the City has authority to re-
assess, and thereby to accelerate the due date of, the re-
maining unpaid special assessments after giving notice to Oak
Glen Development Company that it is in default and the passage
of thirty days without elimination of the default. I under-
stand that Dave Magnuson is now preparing a letter from the
City to the Company which will serve as notice of default
under Section 5.04.
I have prepared and am enclosing herewith a proposed
form of Resolution to be adopted by the City Council starting
the reassessment process, as well as a proposed notice of
hearing and a letter to the property owner which is to be used
in providing published and mailed notice of the reassessment
hearing. As indicated in these documents, based upon my re-
view of Minnesota Statutes, Chapter 429, I think it would only

Resolution Providing For Reassessment
Of Special Assessments Previously Levied
For Improvement No. 184.
Be It Resolved by the City Council of the City of Stillwater,
Minnesota:
Section 1. Recitals.
1.01. In 1981 the City and Oak Glen Development
Company (the Developer) entered into a Development Agreement
Relating To Oak Glen Planned Unit Development dated October 1,
1981 (the Development Agreement).
1.02. Pursuant to and in accordance with the
Development Agreement and Minnesota Statutes, Chapter 429,
the City ordered and constructed its local Improvement No. 184
to serve the Oak Glen Planned Unit Development (the PUD),
and levied special assessments with respect thereto upon
all lots and parcels of land within the PUD (the Special
Assessments).

1.03. Under Section 5.04 of the Development Agreement,
the City reserved the right, if the Developer is in default
for a period of thirty (30) days after receiving notice of
such default from the City, to reassess and reallocate the
installments of the Special Assessments which have not. been
collected, upon all property which is then still owned by
the Developer, upon any basis which would have been lawful
for the levy of the Special Assessments in the first instance.
1.04. The Developer is now in default under the
Development Agreement and has been given thirty (30) days'
notice thereof by the City as required by the Development
Agreement.
105. The City now desires and intends to reassess
the installments of the Special Assessments which corne due
in the years 1990 through 2004, pursuant to Section 5.04
of the Development Agreement.
Section 2. Assessment Roll. The City Clerk has
prepared and pFesented to the Council an assessment roll
showing the reassessment of the installments of the Special
Assessments which corne due in the years 1990 through 2004.
The assessment roll is approved and shall be placed on file
in the office of the City Clerk and made available for inspection
by any interested person during normal business hours.

Section 3. Hearing; Notice. This Council shall
meet at the time and place specified in the attached Notice
of Hearing on the reassessment. The City Clerk is authorized
to glve published and mailed notice of the hearing as required
by law.

ON REASSESSMENT OF SPECIAL ASSESSMENTS FOR
LOCAL IMPROVEMENT NO. 184
OAK GLEN PLANNED UNIT DEVELOPMENT
CITY OF STILLWATER, MINNESOTA
Notice is hereby given that the City Council of
the City of Stillwater, Minnesota, at a special meeting to
be held at 7:00 P.M., C.D.T., on , August , 1988,
at the City Hall, 216 North Fourth Street, will hola-a public
hearing on the reassessment of certain special assessments
heretofore levied with respect to local Improvement No. 184
of the City. Improvement No. 184 comprises sewer, water,
street and storm sewer improvements located in and adjacent
to the Oak Glen Planned Unit Development in the City. The
area proposed to be reassessed is all lots and parcels located
in the Oak Glen Planned Unit Development which were previously
assessed for Improvement No. 184 and with respect to which
such special assessments have not been paid in full. The
total principal amount of special assessments now proposed
to be reassessed is $ , such amount being the principal
amount of assessments previously levied coming due in the
years 1990 through 2004. Such installments will be made
due and payable in the year 1989. An assessment roll is
on hand and available for inspection at the office of the
City Clerk. The reassessment is being made pursuant to that
certain Development Agreement Relating to Oak Glen Planned
Unit Development by and between the City of Stillwater,
Minnesota, and Oak Glen Development Company, dated October 1,
1981. No assessment may be appealed except pursuant to the
Development Agreement and Minnesota Statutes, Section 429.081,
unless a written objection signed by the affected property
owner is filed with the City Clerk prior to the hearing or
at the hearing. The reassessment may be appealed only by
serving notice of appeal on the Mayor or the City Clerk within
thirty (30) days after the adoption of the reassessment,
and by filing the notice of appeal with the District Court
of Washington County within ten (10) days after service thereof
upon the Mayor or Clerk.

Dear Mr. Johnson:
Enclosed herewith is a Notice of Public Hearing
on the proposed reassessment of special assessments previously
levied by the City of Stillwater for local Improvement No. 184
with respect to the Oak Glen Planned unit Development.
The amount to be reassessed against land in the
Oak Glen Planned Unit Development, which is owned by Oak
Glen Development Company, is $ as described in
the enclosed Notice.
The special assessments remaining on your land
may be prepaid at any time by making payment to the City
Clerk. Partial prepayment may not be made.
Interest will accrue on the unpaid special assessments
on your land at the rate of 10.1% per annum. Prepayment
of all pending assessments may be made by Monday, October 10th,
1988, without the accrual of additional interest.
