ADOPTION OF RESOLUTION FOR WOODLAND LAKES EROSION CONTROL
Motion by Councilmember Opheim, seconded by Councilmember
Farrell, to adopt the appropriate resolution approving Local
Improvement No. 230-4 to assess the Woodland Lakes' property
$56,109 for erosion control. (Resolution No. 7928)

DISCUSSION OF GAMBLING OPERATIONS IN CITY LOCATIONS
The City has conducted a survey of neighboring communities in
regard to fees charged for charitable gambling organizations.
City Coordinator Kriesel summarized the results of the survey.
Philip Eastwood of the Elks organization addressed Council
and stated that the Madcapper Saloon and the Hidden Valley
Lounge were chosen by the Elks because they were the only two
to approach the Elks and express interest in the charitable
gambling activity.
Council discussed establishing an ordinance regulating
charitable gambling in the City. Councilmember Opheim
indicated several items she felt should be included in the
ordinance: 1) Gambling licenses only issued to organizations
that operate and meet within the City limits, and must meet
at least once a month. 2) Each group may operate no more than
two locations besides their clubhouse. 3) No bar or
restaurant may have pull tabs from more than one
organization. 4) Fee shall be 3 percent of net for police
control. 5) Each organization shall file copies of state form
with the City. 6) City requests a minimum of 10 percent of

the budget schedule as presented by Finance Director Caruso. (All in favor).
Finance Director Caruso informed Council of the extension of the City.s
1987 audit filing date to July 15 as requested by the City Auditors.
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to
approve sewer rate adjustments for 1115 W. Willard St., 218 W. Maple St. and
1619 W. Pine S1::. as recommended by Finance Director Caruso. (All in favor).

Motion by Councilmember Bodlovick, seconded by Council member Kimble to approve
the Permit to Consume for the Liberty Family at Pioneer Park on July 17, 1988.

the appropriate resolution ccepting the quote for $4,310.00 from Gopher State
Sealcoat, Inc. for resurfacing of Staples Field tennis courts. (Resolution No.

Mr. Blekum reported the ~ost to run electricity to the shelters at Pioneer
Park is approximately $1,288 and Councilmember Farrell stated the River
Valley Lions Club may be willing to help pay for the expenses.

possible violations of the Peddler's Ordinance.

Motion by Councilmember Opheim, seconded by Councilrnember Farrell to hold a
public hearing on July 12, 1988 at 6:30 P.M.to examine the Peddler's License
for the Munchmobile owned by Cheri A. Ackerman~ (All in favor).
Council and Staff discussion followed regarding the possibility of the
Chamber of Commerce sponsoring a fall Arts Festival in Lowell Park. Mr.
Kriesel will check with the Chamber on this item.
Further discussion followed regarding the problem of young people with
skateboards in the park. Mr. Magnuson will draft an amendment to the
skateboard ordinance.
Motion by Councilmember Farrell, seconded by Councilmember Kimble directing
Public Safety Director Mawhorter and Public Works Director Junker to study the
problems with the river road by Lowell Park and make a recommendation to
Council. (All in favor).
5. Consulting Engineer - No report.
6. Fire Chief -
Motion by Councilmember Bodlovick, seconded by Councilmember Kimble to open
the bid received for the Fire Dept. Tanker and Fire Dept. Heavy Rescue Sq4ad
received from Custom Fire of Osceola, Wisconsin. (All in favor)
The bid for the Fire Dept. Rescue Squad is $111,970, and the bid for the
Tanker is S108,997. Council directed Mr. Seim to review the bid and make
a recommendation at the evening meeting.
Fire Chief Seim presented a request for the employment of an additional
part-time firefighter. Council suggested this item be discussed at budget
time.
7. City Attorney -
Mr. Magnuson reported on the proposed vacation for a portion of E. Willow
St. and possible sale of the property, for $3,000, to Mr. Robert Troyer.
8. City Clerk -
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to
approve the Permit to Consume for the Lumberjack Days Parade Committee for the
use of Pioneer Park on July 24, 1988. (All in favor).

Community Develop. Dir 'ctor Russell reported that the applicant has
reduced the number of nits to 81 and lowered the building height by one
floor to bring the project in conformance with the RB zoning. He also
stated the parking is xcessive for the project and suggested that it
reduced; the concept plan be approved for six months and that it is null
and void after that ti e. Mr. Albert Hoffmeyer, the architect, was
present and asked for pproval of the plan this evening in order to start
construction. Council discussion followed. Mayor Abrahamson closed the
public hearing.
Motion by Councilmember BO~lOViCk, seconded by Councilmember Opheim to approve
the request for a Planned nit Development Concept Plan for a 3.5 acre parcel
to be used for commercial evelopment and a 10.6 acre parcel for an apartment .
building on 61st St. in th~ RB Dist. with the recommended conditions; and with
the additional recommendation that the approval is valid for six months.

James Lundquist, representing Ms. Ulrich, stated the fence would be
constructed of red cedar and would be properly maintained.
Ms. Schmitz, the neighbor to the north, stated she approves of the fence
if it is of good quality and maintained. Council stated the good side of
the fence should face Ms. Schmitz. yard. Mayor Abrahamson closed the
public hearing.
Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to
approve the Variance Request for construction of an eight ft. fence at 1206
No. 2nd St. in the RB Residential Dist. with the recommended conditions. Carol

2. Report and Recommendation Regarding Development of Lot 7 in Radle's Sunny
Slope Addition.
Discussion included changing the structure of the pond by fill and
developing Lot #7. Consulting Engineer Moore recommended that the City
withhold development on the northerly part of the plat and the pond be
enl arged.
Mr. W. A. Ulrich, 127 No. Birchwood Dr., expressed concerns about water
coming up into his backyard.
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell that
no building permits be issued for development of Lot 7 in Radle's Sunny Slope
Addition until the developer agrees to allow the enlargement of Holding Pond
No.2, and petition for vacation of street. (Ayes - 4; Nays - 1, Mayor
Abrahamson) .
Mayor Abrahamson stated he misunderstood the intention of the motion regarding
building permits for Radle's Sunny Slope Addition and wished to change his
vote to an "Aye" vote, therefore, the vote was unanimous (All in favor).
The meeting recessed for five minutes and. reconvened at 8:27 P.M.

NEW BUSINESS
1. Request from Norris Swager to purchase city lots or to be reimbursed for
improvement assessment.
City Coordinator Kriesel explained Mr. Swager's request is to either
purchase Lots 4 and 8 of Radle's Sunnyslope Addition or be reimbursed the
cost of the improvements which they have paid.
Motion by Councilmember Bodlovick, seconded by Councilmember Opheim to notify
Mr. Norris Swager the City will retain Lots 4 and 8 on the south side of the
Sunny Slope Addition; and will reimburse Mr. Swager for payment of the
improvements for the lots. (All in favor).
2. Request by Heritage Development Co. to vacate drainage and utility
easements from previous subdivison.
Mr. Russell explained the developer is requesting the City to vacate the
original utility and drainage easements which will be replaced by new
easements.
Motion by Councilmember Farrell, seconded by Councilmember Bodlovick to adopt
the appropriate resolution vacating the drainage and utility easements on Lots
2, 3, 4, 5 and 6, Block 1 of St. Croix Place plat and accept the proposed

Motion by Councilmember pheim, seconded by Councilmember Farrell to pay a
claim for a sewer back-u at 260 Deerpath Ct.; and direct the Publ ic Works

Community Development Director to review the property in the vicinity of
McKusick Lake as it becomes developed for the possibility of creating access
trails. (All in favor).
2. Letter from Metro Waste Control Comm. regarding meetings and delay of
Stillwater Plant Expansion.
Council discussion followed regarding Council and Staff participation in
the meetings.
Council will hold a Special Meeting on July 12 to discuss Tax Increment
Financing in the Industrial Park.

hearing on this item.
Motion by Councilmember BOdllOViCk, seconded by Councilmember Opheim to set a
public hearing on July 19, 1988 at 7:00 P.M. to review the Development
Agreement for Woodland Lak s Development in regard to possible default of the
agreement. (All in favor).

The City of Stillwater has concerns regarding the p6ssibility of placing a two
year moratorium on the construction of the Stillwater Wastewater Treatment
Plant as described by Edward De La Forest, Director of
Engineering/Construction and further discusse~ with Ray Odde of your staff.
As regi ona 1 provi der of sewer servi ce to Sti 11 water , our concern should be a
-shared concern for the provision of adequate service to support future area
economic and housing growth.
It is our understanding from previous treatment facility plans, that a
Sti llwater treatment plant upgrade would be completed by Fall 1990. The
upgrade in the existing plant, as described, is to consolidate the Bayport
plant and provide for future service demands based on figures in the Regional
Deve 1 opment and Investment Framework Pol icy Document. Because the figures in
the Development and Investment Framework are low we have concern that the
scheduled 1990 Treatment Plant upgrade will be available in time for the City
of Stillwater, and for that matter, the general sewer service area. .
The Metropolitan Council, by letter February 29, 1988, agreed with our concern
for low.forecast figures and adjusted sewer service area figures up by +15%
(memo enclosed). We feel the adjustment may still be low based on approved
projects and development trends. With the increase in forecast population and
resultant demands for sewer services, it is hard to understand the rational
for moving back plant upgrading two years.
In discussing with Mr. Odde, it was mentioned that the Stillwater plant is in
the last 10% margin of capacity and that it is difficult to determine when
capacity wi 11 be exceeded and control standards violated. This is of
particular concern to the City of Stillwater because of the St. Croix's
designation as a National Wil~ and Scenic River. We would not want to see
standards exceeded and the quality of the river degraded because of the delay
in plant construction.

You are hereby given Notice that on Tuesday, the 19th of
July, at 7:00 p.m. in the City Hall, of the City of Stillwater,
the City Council of the City of Stillwater will decide whether
the development contract entered between you and the City of
Stillwater, relating to the Woodland Lakes Development dated
September 30, 1986, should be in all ways revoked, cancelled and
rescinded, pursuant to Section 11.03 of that agreement.
The grounds for the revocation are as hereafter set forth:
1. Failure to submit to the city a financing plan
sufficient to insure completion of the private improvements for
the development.
2. Failure to submit to the city construction plans for all
of the private improvements for the site.
3. Failure to commence construction"of the private
improvements by July 1, 1987 and failed to complete 25% of the
private improvements as a percentage of marke~ value-by July 1,
1988. .
4. Failure to submit for approval and receive city approval
the final construction plans and a final financing plan for the
construction of a 80,000 square foot Radisson Hotel on Lot 1,
Block 1 of the proposed plat of Woodland Lakes.
5. Failure to receive city approval of one major or anchor
tenant in the proposed mall.
6. Failure to submit final construction plans for the hotel
and the mall, including paying a Plan Check Fee of approximately
$41,700.00 and a Building Permit Fee of approximately
$120,000.00.
7. Failure to submit information to the city necessary for
the city to enter into an assessment agreement with the
developer, to insure the minimum market value for calculating
property taxes sufficient to pay any Tax Increment Bonds proposed
to be used for the site.
8. Failure to submit evidence that Radisson is committed to
the most current hotel d~sign.
9. Failure to depo$it sufficient sums to cover all
Consultant Fees incurred! by the city in behalf of or at the
request of the develope~. A deposit of $30,000.00 is required
pursuant to the section rof the development agreement.

Dear Nile:
I am respectfully requesting that the City Council of the City of
Stillwater postpone the discussion scheduled for July 19, 1988
regarding the Development Agreement that Robert Scott Holdings
entered into with the City of Stillwater for the proposed Woodland
Lakes Mall.
The source of our continuing problems with the project has been the
inability of our financial partner to qualify for a construction
loan as was intended when the partnersip'.was or:iginated.
For the past thirty days I have been in negotiations with a new
financial partner who is familiar with all the details of Woodland
Lakes and is a resident of an east St. Paul suburb. These negoti-
ations will be concluded prior to the end of July. At that time
we would be prepared for an August meeting that would certainly be
productive from the standpoint of the City of Stillwater and its
elected representatives.
Please give this proposal your careful consideration since it is
not our preference to become involved in a legal action with the
City of Stillwater.

AN ORDINANCE ESTABLISHING AN ABSENTEE
BALLOT COUNTING' BOARD
The City Council of the City of Stillwater does ordain:
Subdivision 1. Establishment. There is hereby established
in the City of Stillwater an Absentee Ballot Counting Board for
the purpose of counting all Absentee Ballots cast in the city.
Subdivision 2. Number Required. The Board shall consist of
a sufficient number of election judges appointed as provided in
sections 204B.19 to section 204B.22 of the Minnesota Statutes.
Subdivision 3. Duties. The duties of the Absentee Ballot
Counting Board shall be those duties described in Section
203B.13, Subd. 2 of the Minnesota Statutes.
Subdivision 4. Compensation of Members. The city clerk
shall pay a reasonable compensation to each member of the
Absentee Counting Board for services rendered during each
election.
Subdivision 5. Applicable Laws. All of the laws applicable
to absentee ballots and absentee voters and all other provisions
of the Minnesota Election Laws shall apply to the 'Absentee Ballot
Board that is created' by this Ordinance.
This Ordinance shall be in full force and effect from and
after its publication according to law.

DEAR LADIES AND GENTLEMEN:
The following concerned people of the Staples Field area would like to
have your council look into several concerns of ours. We would like to
have "stop signs" or a "children-at-play sign", or a "yield sign", or a
"15 mph sign" put near the corner of Martha 8{ Aspen. Th is park is used by
a great many children and whole families for activities such as T-ball
teams 2 or 3 times a week and free family skating in the winter.
Recently, several children have been almost hit by cars, because the cars
are going too fast and children just don't look when they are running
after a ball that goes into the street.
Staples Field is used by alot of people throughout the year, but
especially in the spring, summer, and fall. In a four (4) block radius
there are approximately 48 children, from the ages of 1 thru 10, plus all
the families that come for ball games several times a week. There are
only three (3) swings and one teeter-totter for all of these children to
.Play. on.. llJe would like to request additional playground equipment for
this very popular park. Wooden playground equipment similar to that at
Stonebridge School would be ideal. It would last a longtime and be easy

Dear Nile,
At its meeting last night, the Library Board discussed the attached
narrative report and estimate for repairs to the Library's temperature
control system. We had hoped that the repairs to the compressor and
air dryer done during the building project would render them able
to handle the demands of the new system, but that does not appear to be
the case. We were unable to regulate a number of thermostats during
the past heating season and probably wasted a lot of energy.
The Board passed a motion requesting that the repairs be done, using
whatever method of financing you and Betty suggest as being best
for the overall financial picture. Someone from the Board and I would
be happy to attend the meeting when this is discussed to provide
whatever further informaion we can.

June 7th at ended by Jack Becker, Systems Foreman and Mike

1. Bec use the air conditioning and heating units and
tem erature controls are a mix of old and new, no
war ants exist on the overall system - only on the
new components.
2. The temperature control system is pneumatic including
an ir dryer, compressor, air lines to thermostats,
and thermostats.
3. During demolition of the interior of the building
som air lines were cut. The compressor filled with
wat r. The air dryer was found in poor condition
and gave evidence of poor maintenance.
4. In interests of economy, 'it was' decided to repair
and !use the original equipment. The compressor was
cleaned and the motor rebuilt. The air dryer.was
cleqned and checked. The airlines were relocated,
spliced and cleaned. Thermostats were checked,
rem unted and calibrated. The entire system was walked
thr ugh, checked out and found acceptable except the
air conditioning could not be checked until this
sprlng when temperatures over 60 F. existed.
5. The compressor has been difficult to maintain and has
fai ed to function properly as has the air dryer.
Oil and water from the compressor have contaminated
the airlines and some of the thermostats. At least
4 t ermostats have water damage and 4 have oil damage.
Oil contaminated thermostats must be replaced; water
con aminated thermostats may be repaired.
It as recommended the compressor and air dryer be
rep aced; the air lines be run through a freon bath
to emove oil and water contamination; placed as
nec ssary and the entire system be calibrated..
Ins allation of new compressor and air dryer will take
4-8 hours. Recommended time to effect the above is

Dear Mayor Abrahamson:
In the July 7, 1988, issue of the Stillwater Gazette City Planner
Russell was given the task by the Council of assessing the feasibility
of laying claim to a pathway around part of Lake McKusick for the
purpose of making a pleasant wildlife area. This was proposed by
C. J. Rosell.
I wholeheartedly agree with Mr. Rosell's recommendation. I live
on Linden Street near the Washington School and have enjoyed running and
walking over this pathway off and on for about 36 years. Many other
people use it also throughout the year for hiking, running, observing
wildlife and nature and skiing in:the winter. I have. seen both adults
and young people on the path. High school youth have used it for run-
ning. Some people take their dogs along for exercise and a swim in the
lake.
There is no better area around here for observing wildlife. It has
a large variety of species, including ducks, Canada geese, pheasants,
herons, egrets, gulls, terns, song birds,' shore birds, mink, muskrats
and beaver. Years ago when the water levels were up there were fish in
the lake.
There is a fine variety of vegetation - trees, shrubs and vines.
Some of the berry bushes "I have observed are hawthorne, buckthorne, dog-
wood, honeysuckle, blackberry and raspberry. You can also find Virginia
creeper and wild grape vines. Certain times of the year you will see
wildflowers. The wild iris and flowers of the duck potato grow in moist
areas along the shore.
This spring I counted at least six duck broods. Oreyear I tallied
fourteen duck broods on the lake. I observed mallards, wood ducks and an
unusual siting of a brood of hooded mergansers. Many mallards, teal, wood
ducks, bluebills, ringbills, redheads and Canada geese use it during spring
and fall migration as a feeding and resting area.
In the evening one can observe beautiful sunsets and reflections on
the lake. This McKusick Lake area is the most beautiful natural"area
around here and the path which the people have used for many years Slould
be kept open for their use. I sincerely hope that the City Council can
accomplish this.
