Dear Mayor and City Council:
I am writing to request a partial abatement of sewer bill for 419 South
Second street.

On March 4, 1988, the Water Department called me to tell me my meter r~~)J-'
reading was more than double the previous years. The December 3, 1987 { .-Y'
to March 3, 1988 reading of 60,000 cf; the similiar period for 1987 was r V/
27 ,000 cf. and for -1986 was 18,000 cf. ~ 4/ D 3
I called my tenants and asked them to check for leaks and one tenant
called me back to say a faucet was leaking. I asked a plumber to
repair it and assume the problem has been corrected.
I would appreciate your reducing the remaining quarter>of 1988 to a
charge consistant with prior experience on this property.

REGARDING: Leave of absence

I would like to request, from council, a temporary leave of absence
which would beg il'l approximately July 14, 1988, as this is al'lticipated
when I will deliver. I would like to have 4 weeks of sick leave with an
additiol',al 8 weeks of "part-time/flc.at schedule" as I had for my first
leave of absence.
The way that I anticipate the leave working is
basically the same as the first time I took leave. Due to the hiring of
a new employee, I perceive that it will 'be necessary for me to return to
work shortly to supervise and schedule work for her because of being so
new to our system. I feel that I will probably be returning anywhere
from 8 - 16 hours per week during my first 4 weeks of absence. After
that I anticipate that, due to the time frame of the budget and tax
levy, I would be working at least 40 hours per week but I would like
this to be on a float schedule between my home and the office as needed.
If it would be that I work less than 40 hours per week after I have
taken my 4 weeks of sick leave, I understand that my salary and benefits
would be pro rata.
I do not see a need for me to have a telephone line connected to the
City for computer use because the new employee will be updating and
entering the budget this year. I will need the P.C. home from time to
time to update schedules for salaries, insurance, taxes, etc. for the
1989 budget.
I have reviewed this with Nile and he has expressed no concerns
regarding this plan.
I feel my position has responsibilities that I
must carry out such as a timely budget and levy adoption and I promise
that these will be carried out with them minimum of interruption.

Seve~al complaints have been received f~om citizens in the
neighborhood of the intersection of Greeley St~eet and
Churchill Street ~equesting that stop signs be placed at the
intersection of Greeley Street and Chu~chill Street regulating the
no~th and south bound traffic on Greeley St~eet.

The reasons cited by the people wishing the intersection change
are as follows:
The west bound t~affic using Chruchill St~eet has to
wait an excessively long time before it can tu~n left or
right onto Greeley Street.
The accident rate at the intersection of Greeley Street and
Churchill St~eet is abnormally high, especially for injury
accidents.
The traffic north and south bound on Greeley Street tends to
travel in excess of the posted speed limit frequently.
Greeley Street, a major secondary feeder to route
Thirty-six, has an excessive volume of traffic going north
and south.

The intersection of Greeley Street and Churchill Street is best
described as follows:
The intersection is located in a residential area.
There is a park located at the north east corner of the
intersection where playground equipment is located and
children are at play in this area most of the time.
There is a crest of a hill about one and one-half blocks to
the south of Churchill Street. This hill crest makes it
difficult for drivers attempting to enter Greeley Street
from Churchill Street to see approaching vehicles from the
south.
There is a hospital with an Emergency Ambulance entrance on
to Greeley Street about one block south of the intersection.
There is a park and recreation area, Lilly Lake, located
about three blocks to the south of the intersection. This
area is used quite heavely during all seasons of the year by
youth and adults.
Stillwater Senior High School is located two blocks east and
two blocks south of the intersection. The intersection is
one of the main routes taken by the senior high students and
faculty when going to and from the senior high.

The methodology used to determine the validity of the problem are
as follows:
Study the traffic volume on Greeley Street during selected
peak periods of the day.
Study the stopping times of right and left turning
automobiles on Churchill Street to Greeley Street during
selected peak periods of the day.
Analyze speeding tickets, from 1987 to present, of selected
intersections.
Analyze the history of the traffic accidents at Greeley and
Churchill Street and Greeley and Pine Street.
Interview with Mayor Abrahamson and Public Safety Director
Mr. Mawhorter regarding complaints received dealing with the
intersection of Greeley and Churchill.

Traffic volumes were studied on two successive time periods on
Greeley Street and Churchill Street:
The first study was done from 7:15 a.m. to 8:15 a.m. on May
3. The results showed that there were 313 cars going north
and 620 going south. The total number of cars observed on
this study period was 933.
The second one was done on May 4 from 11:55 a.m. to
12:55 p.m. The number of cars going north was 415 and the
number going south was 342. The total number of cars
observed on this study period was 757.

the city as identiried by Chier Mawhorter. These areas were the 1400
block of W. Myrtle Street, the 1200 block or S. Greeley Street and
the 1700 block or Pine Street. The results are as rollows:
207 summons were issued in the 1400 block or W. Myrtle
Street from January 1, 1986 to May 15, 1988.
280 summons were issued in the 1200 block or S. Greeley
Street from January 1, 1986 to May 15, 1988.

The interviews were conducted with the Mayor and Mr. Mawhorter.
Mayor Abrahamson indicated that he has received numerous complaints
about the intersection. The complainants indicated that the left
turn stopping time was too great on Churchill Street waiting to enter
Greeley Street. He also said the intersection was dangerous and
stop signs should be put up.
Mr. Mawhorter said he also has had many complaints about the
intersection. The people complained that they had to wait too long
to turn onto Greeley from Churchill. They also complained about the
speed the vehicles were traveling on Greeley Street and that they
can't see cars coming from the north on Churchill due to the hill.
Mr.. Mawhorter feels that there may be a valid reason for putting up
stop signs due to insufficient sight distance, speed of vehicles
using Greeley Street and the apparent traffic congestion at the
intersection.

that the traffic volume on Greeley Street is at certain
times of the day very high. The two traffic counts that
were conducted, one at early morning rush hour and one at
noon time rush hour, indicate rather high traffic volumes
ranging from 13-16 cars per minute respectively. Public
Safety Director Mawhorter indicated that this volume of
traffic was very high for streets in Stillwater with use
types consistent with this type of street.
During the traffic count periods, 145 cars and 168 cars
respectfully entered on Greeley Street from Churchill
Street. This averages out to be 4 cars per minute. The
number of vehicles using Churchill Street to enter Greeley
Street indicates that Churchill Street is more than a
residential street.
It is, rather, a secondary feeder route
leading to a primary residential ingress and egress route
for vehicles to travel as was indicated by Chief Mawhorter.

The three stopping time periods that were observed during
this study indicate that left turning vehicles from
Churchill Street to Greeley Street frequently experienced
excessive delay~ at thi~ intersection. All three time
periods studied showed high recorded stopping time in

excessive of one and one half minute for left hand turning.
Average stopping time for left hand turning traffic varied
from 30 seconds to one minute. The mode stopping varied
from 3 to 18 seconds.
Right hand turning traffic
experienced similar but less severe delays. High stopping
times varied from 21 to 53 seconds, average stopping times
from 6 to 14 seconds, and mode stopping times varied from 2
to 7 seconds. Another situation that occurred at this
intersection that was not recorded in the study results was
the fact that often several vehicles would be stacked up at
the intersection at any given time. According to Chief
Mawhorter, excessive delays at intersections can cause
drivers to become impatient and to take chances that they
would normally not take. The information learned from this
portion of the study would, by itself, seem to indicate
that stop signs should be placed at the intersection because
of the period of time drivers have to wait to enter the
intersection is usually greater than time required to enter
a four way stopped intersection.

should be considered as a part of this study. The results
of the study clearly indicate that speed is in fact an issue
of concern at this intersection. Of the three areas
studied, Greeley Street had the highest number of speeding
tickets issued. The high number of tickets issued, when
combined with the short sight distance to the south of the
intersection and the extended stopping periods clearly
presents an additional hazard to motorist entering Greeley
Street from Churchill Street.

Study of the intersection of Greeley and Pine Street and
Greeley and Churchill Street was conducted to learn whether
traffic volume alone was the cause of accidents at Greeley
Street and Churchill Street. A review of the accidents that
occurred at this intersection, from 1984 to present, shows a
marked difference between the intersections.
Injury
accidents were 400 percent more likely to occur at Greeley
and Churchill Street than at Pine and Greeley Street and
property damage accidents were 64 percent more likely to
occur at Churchill Street and Greeley Street than at Pine
Street and Greeley Street. From this information, it is
safe to assume that traffic volume alone is not the major

contributing factor for the high accident rate at Churchill
Street and Greeley Street.
Further, it is safe to assume
that due to the equal traffic volumes at both intersections,
that speed is a significant factor at the intersection of
Churchill Street and Greeley Street.

that stop signs, stopping traffic north and south bound on Greeley
Street at Churchill Street, be installed.

At what stage in the planning, development and construction
of a project may it legitimately be stopped by a permit
revocation?
The traditional approach used to determine whether a vested
right existed was to locate a fixed point in the development
sequence, such as, until the issuance of a building permit and
some physical activity at the project site.
The prevailing modern approach, however, that is found in
Minnesota and most jurisdictions, is to refuse to recognize a
vested right to develop property unless the municipality has
issued a permit which was valid under existing law, and the
property owner, in reliance thereon has made a substantial change
of position in relation to the land, made substantial
expenditures or incurred substantial obligations. 2 Rathkotf,
The Law of Zoning and Planning, Chapter 57, Section 14 (3rd
Addition) 1972; 8A McQuillan, Municipal Corporations (Revised)
Volume 1965, Section 25.188. This view was first clearly
articulated in the case of Hawkinson vs.County of Itasca, 231
N.W.2d 279 (Minn. 1975), and followed in RidgewoodDevelopment
Company vs. State of Minnesota, 294 N.W.2d 288 (1980) and has
most recently been explained in the 1981 case of Jasaka Company
vs. City of st. Paul, 309 N.W.2d 40 (Minn. 1981).
In Hawkinson, the Court quoted with approval the view of the
Iowa Supreme Court that "it is impossible to fix a definite
percentage of the total cost which establishes vested rights. It
depends on the type of project, its location, opportunity for
recoupment of expenses, ultimate cost, and principally the amount
accomplished under conformity."
In summary, the amount of money that an owner stands to lose
by reason of revocation is the yard stick used to measure vested
rights.

Discussion:
The request is to construct 1,600 sq. foot temporary greenhouse and provide a
storage/display area directly outside the designated structure in the Cub
Foods parking lot. The greenhouse has been an annual promotion at Cub Foods.
This year the storage and display area directly outside the greenhouse will be
an additional use. The whole area of the greenhouse and storage area will be
3,990 sq. ft. using 22 parking spaces of the 627 parking stalls, leaving 605
parking spaces for customer parking. The parking space requirement for Cub
Foods is one space for each one hundred and fifty (150) square feet of gross
floor area or 569 parking spaces. The 605 parking spaces adequately meets this
requirement.
Conditions of Approval:
1. Prohibit parking in the four spaces immediately adjacent to the
greenhouse area and the driveway.
2. All sales and storage must be kept within the designated greenhouse,
display and storage area.
3. This approval applies to future years for a similar period.
Recommendation:
Approval.
Findings:
The proposed use will not be injurious to the neighborhood or otherwise
detrimental to the public welfare and will be in harmony with the general
purpose of this Ordinance.

Dear Steve:
I have enclosed some material which will describe the
temporary greenhouse Cub Foods 'is proposing to erect in the
Stillwater store parking lot. The greenhouse promotion has
become an annual event over the past several years at our
Twin Cities area stores.
The data which I am providing as a follow-up to our phone
conversation this morning includes the following items:
1) Two pages of specifications and a diagram illustrating
the major characteristics of the greenhouse tubular
framework.
2) "Before and after" parking ratios, which show the impact
of the greenhouse on available parking stalls.
The greenhouse is proposed to be 20 feet in width by 80 feet
long, for a ~otal of 1600 square feet. It consists of 13/8
inch (o.d.) triple coated, cold rolled steel framework
having a wall thickness of .055 inches. Connecting hoops
are spaced 4' center-to-center.
The structure is covered with 6 ml. polypropylene sheets,
and .all metal parts have a clear acrylic finish as well as
rounded edges to prevent tearing. Anchor posts are 30 inch
reinforced rods, spaced every 4 feet. These are 1 5/8 inch
(o.d.) galvanized rods.

The assembly process is done under the supervision of Bailey
Nurseries, Inc., 1325 Bailey Road, St. Paul, MN 55119. ~
They have built the greenhouses for the Cub stores for
several years. Bailey's contact person is Terry Schmidt at
459-9744.
We anticipate using the greenhouse from Monday, April 18, to
Sunday, June 19, 1988. The proposed greenhouse is identical
to last year's, and occupies 18 of 627 parking stalls,
leaving a total of 609 stalls. The building size of the Cub
store is 85,278 square feet, and the ratio of parking stalls
to thousand square feet of building space is reduced from
7.35:1 to 7.14:1.

Project Description:
Special Use Permit to fill and grade an approximate 2,000 ft. road at 1250
South Main Street. This road is between the Warehouse (across from Oasis Cafe)
and the Barge Office on Frank Aiple1s property.
Discussion:
The request is to fill and grade the road so that it will be level with the
Warehouse on the South side of the property (3 ft. below 165 flood level). In
order to raise this road to Warehouse level, as much as four feet of fill may
be needed. The fill and road surface will consist of existing material on the
property.
The DNR was contacted on this matter. Their basic concern was erosion on the
East side of the road caused by flooding or by general run-off from the road.
DNR would like to see erosion stabilized in this area.
A sewer main runs directly under the road. Public Works has two concerns. One,
the amount of fill needed to raise the road may make it difficult to get to
the sewer main and two, the pressure from the amount of fill on the sewer
main. The City Engineer will be contacted for comment.
Conditions of Approval:
1. Erosion must be stabilized on the East side of the road.
2. City Engineer to comment on the fill and grade.
3. Any adjustments or repairs to the sewer line caused by the project
shall be the responsibilty of the applicant.
Recommendation:
Approval.
Findings:
The proposed use will not be injurious to the area or otherwise detrimental
to the public welfare and will be in general purpose of this Ordinance.

Pursuant to your request, we have reviewed the area on city
property proposed to be filled by Mr. Aiple. This property lies
adjacent to the east side of Main Street south of Nelson Street
in the vicinity of the Oasis Cafe.
It is our understanding that Mr. Aiple intends to place approx-
imately 3 feet of new fill on the existing roadway traversing the
property in a north/south direction from the city's lift station
to the vicinity of the existing truck scale building.
The main interceptor sewer which discharges the wastewater flow
from the City of Stillwater to the treatment plant also parallels
this roadway. This sani tary sewer line has manholes
approximately every 200 or 300 feet along the entire length of
the proposed fill area. Presently, these manholes are at or very
near the existing grade. The manholes are required for access to
the sanitary sewer for cleaning and maintenance purposes.
It appears that the filling operation will impact each manhole.
If Mr. Aiple fills a total of 3 feet from the existing ground,
each manhole may require excavation, removal of the cone section
or brick, and either a new precast section inserted or the brick
reconstructed, raising the manhole castings to the new grade
established by the fill for easy access to the sewer.

Discussion:
The fence will be located on the South si~e of the Edstrom property and will
run East to West. To the South of this proposed fence is a new home with the
backyard containing a dog and dog pen constructed of log posts and wire mesh.
The Edstroms feel that a six foot fence would not block the view of the dog
pen area from the patio and deck, as well as the kitchen and eating area of
their home. The Edstroms would like to be screened from this area as much as
possible and feel an eight foot fence would accommodate this.
The new home is also at a slightly lower elevation than the Edstrom home so
they feel the fence must be eight feet to screen the area. The fence will be
approximately five and one-half feet high beginning at the West end of the
property then run downward in a Northeasterly direction following the slight
slope and reaching an eight foot height. After a field survey of the area, a
six foot fence would block the view of the neighbor's backyard.
Recommendation:
Denial.
Findings:
For reasons set forth fully in the discussion, the granting of the variance is
not necessary for the reasonable use of the land or buildings.

Unknown to us, the city of Stillwater has an ordianance regarding the height
requirements for fences. This was also unknown to our builder and architects. As
we sought to complete our site plan, as initiated when we began building, we
were made aware of the ordinance. Our home was completed late last summer. We
are hoping to complete the landscaping this spring. The accompanying photos will
show the framing for the fence in place. Construcion has stopped however, as we
await your approval. '
A new structure has been built on lot 1, with side and back yard containing a
dog pen of log posts and wire mesh directly \ adjacent to our front yard. It is in
full view of our patio area and deck, as well as the kitchen and eating area of
our home. It is our desire to have this screened as much as possible. The
following photos and drawings are offered to assist you in making your decision.
We appreciated your consideration of this matter.
The project has been carefully and professionally designed and would be built
in the same manner. We feel it will enhance both properties, at no cost to one
party. No direct sight lines from lot 1 are affected; only angular ones directed

The Fischer's have stated that they plan on' having this business at this

The Building Department and Fire Department reviewed Chris Fischer's request
to open a furniture refinishing business at 111 South William Street. Mr.
Fischer will be using a non-flammable stripper with a 3x4 ft. dip tank with a
brush system. His disposal of materials will be kept in a sealed container
(according to the requirements by Washington County). The Fire Department has
a file on this business and will make inspections as required. The following
additional requirements must be met as Conditions of Approval.
1. The north wall of the garage must be a 2 HR fire wall.
2. The garage must be properly ventilated.
3. Any complaints of foul odors from the furniture refinishing process

five years refinishing furniture for myself and for
family/freinds. I have been planing my business for about a
year now. My request is to operate my business in my garage
which is being built within the next month. The name of my
company will be Fischers Furniture Restoration.
I am planning on operating my business as low key as
possible, as to not disrupt the peacefulness of the
neiborhood. Some points I would like to make in regards to
this statement are as follows:
1. I won't be advertising my company's address, due to
the fact that all my business is conducted over the phone or
at the customers address (I do estimates and pick-up and
delivery at customers address), therefore there would not be
any traffic in regards to this request.
2. My house and garage would be kept residential in
appearence, a person would not even be able to tell that a
business is located here.
3. My business hour~s would be 8:00 to 5:00 on
weekdays.

other side the neigbors are facing the other street. There
are also serval business within two blocks of my property,
(Davian, Co-OP, Greely St Building, Greely st Nursing Home,
Nelsons Dairy, United Methodist Church) with regards to this
much business in the neigborhood already and as low key as I
will operate I hope you will see fit to issue this permit.
I have discussed my business plans with my two nearest
neigbors (Pat Bonse and Rienburgers) and neither of them has
any objections to my plans.

A Special Use Permit requesting placement of two signs on the Grand Garage.
One sign is a chimney (roof) sign, the other is an additional "major" face
sign.
DISCUSSION:
Estebans of Stillwater has recently moved from the Brick Alley (423 South Main
Street) to their new location in the Grand Garage (previously Gammon's
Restaurant). They have placed an Estebans canvas sign on the flag pole. The
sign is a double face sign that is parallel to Main Street. The additional
sign that Estebans would like to place on the Grand Garage is a chimney (roof)
sign. This sign has previously been placed on the back of the Brick Alley with
the letters running parallel. The new placement on the chimney would place the
lettering horizontal.
Estebans is also reopening the Cobblestone Cafe. The sign they would like to
place identifying their business is similar to the canvas Estebans sign which
is now in place on the flag pole. This new sign is approximately the same
size (3 ft. x 10 ft.), is double faced and is also parallel to the street.
Since the Estebans sign is considered a "majorll face sign (the largest sign on
the Grand Garage), the additional Cobblestone Cafe would also be considered a
"major" face.
Two major points to these two requests include the following:
1. Due to the new location of Estebans in the Grand Garage, additional
signage is necessary so the business may be identified to vehicular
and pedestrian traffic on Main Street.
2. The architectural integrity of the Grand Garage would not be altered
by the placement of these signs.
Conditions of Approval:
1. The chimney sign will not damage the brick on the chimney.
2. No additional signage is permitted.
Recommendation:
Approval.

APPROVAL OF MINUTES
Motion by Don Valsvik, seconded by Jean Jacobson to approve the
minutes of April 11, 1988 as submitted. Motion carried 7-0.
PUBLIC HEARINGS
Case No. SUP/88-24 - Special Use Permit to conduct lawn and garden
sales in a 1,600 square foot temporary greenhouse and outside area
designated for this use at 2001 Washington Avenue North in the
Industrial Park Commercial, IP-C District. SuperValue stores, Inc.
(Cub Foods), applicant.
Thomas Thueson representing Cub Foods presented the request. The
greenhouse will be used until June 19; the request is for subsequent
years also. Mr. Thueson stated that the two recommended conditions of
approval present no problem.
Motion by Don Valsvik, seconded by Rob Hamlin to 'approve the SUP/88-24
with the two recommended conditions and a third condition that the
permit will apply to future years. Motion carried 7-0.
Case No. SUP/88-25 - Special Use Permit to fill and grade an
approximate 2,000 foot road at 1250 South Main Street in the General
Heavy Industrial/Two Family Residential/Bluffland/Shoreland/Flood
Plain District.
Frank Aiple, Sr.~ presented the application. Mr. Russell explained
the concerns of the DNR and the City's Public Works Department. He is
awaiting comments from the City Engineer. Dan McGinnis from the
Minnesota-Wisconsin Boundary Commission stated that he has no
objection provided the area is stabilized so no erosion occurs.
There are two recommended conditions of approval and the Commission
added a third and fourth: 3) Any adjustments or repair to sewer
line caused by the project would be the responsibility of the
applicant. 4) If the manholes need to be raised, the applicant would
be responsible.

The applicant was not present. Several area homeowners were present
and Chairman Fontaine asked for their comments. Maurice Jensen,
Forest Hills resident, expressed his concern with the project's
proximity to Forest Hills. He is also concerned with the high density
and the height of the proposed building. He stated that residents
would like more information on the aesthetic design and materials to
be used, and also on the drainage plans. Bob Morrow, 1601
Morningside, asked about plans for the greenbelt area between Forest
Hills and the project.
The Commission members agreed with the residents that this is quality
property and only quality buildings should be approved. Mr. Russell
will communicate with the applicant regarding the stated concerns.
Motion by Rob Hamlin, seconded by Jean Jacobson to continue Case No.
PUD/88-29 until a response is received from the applicant. Motion
carried 7-0.
Case No. SUP/88-30 - Special Use Permit requesting placement of two
signs on the Grand Garaage Building, 324 South Main Street, in the
General Commercial, CA, District. One sign is a chimney sign (roof)

In the process of completing our planned expansion at our
Stillwater site, we have encountered a problem with our
parking lot. To properly drain our lot and comply with the
city specifications, a line needs to be installed between our
parking lot and the adjoining lot to the south. Normally the
city would install this line and assess the expense back to
the adjoining property owners. In this case, the ownership
of the adjoining property is in question and therefore
complicating the completion of our lot.
To resolve this problem, we would like to install the pipe at
a cost of $17,400 and request that we be given credit for the
same amount against future assessments. On behalf of Press

At the Council meeting of May 3, 1988, the City Council
approved the preliminary plat for St. Croix Place Second
Addition. The Staff report with conditions of approval is
attached. The applicant has submitted a grading drainage
plan (being reviewed by the City Engineer). Condition #1,
the necessary utility easements are indicated on the plat,
Condition #2, the roadway width has been increased to 32
feet and an access easement has been prepared. The proposed
plat is consistent with the preliminary plat approval. A
development agreement has been prepared by the City Attorney
to provide for construction of the utilities and other
public improvements as requested by the Subdivision
, Ordinance.

Project Description: The application is to resubdivide four existing lots
into five lots.
Discussion: The subdivision request is to divide a 2.77 acre site comprised
of four lots, previously known as St. Croix Place, into five lots. The minimum
lot size for the RCM District is 12,000 sq. ft. The proposed lots range in
size from 15,646 to 28,814 square feet. The lots are serviced by a proposed
public 25 ft. wide 350 ft. cul de sac. Building sites for structures are shown
on the five lots. Utility easements and drainage easements are not shown on
the preliminary plat. A preliminary grading/drainage plan is provided for the
site. A final plan is required before the final plat approved.
The preliminary plat was reviewed by the City Engineer. City street width
standards for this type of street is 32 feet. A 32 ft. wide street would
reduce the setback for lot five to 18 feet. 35 feet is required in the RCM
District. This issue is discussed further in review of the Special Use Permit.

Recommendation: Approval with conditions.
CONDITIONS OF APPROVAL:
1. A final drainage/grading plan shall be submitted before final plat
approval.
2. Necessary drainage and utility easements shall be shown on the final plat.
3. The road width shall be increased to 32 feet per the City Engineer1s
comments and constructed according to City street standards for public
streets.
4. An access easement shall be executed giving the existing townhouse
building access over proposed Lot 1 before the final plat is approved.
5. A roadway easement shall be recorded at the end of the cul de sac
extending the road to the North property line.

with the requirements set forth in you letter of February 9,

AN ORDINANCE AMENDING THE STILLWATER CITY CODE
BY INCREASING CERTAIN PERMIT FEES
The City Council of the City of Stillwater does ordain:
1. The Plumbing Permit Fee as set forth in Stillwater City
Code, ~33.01, Subd. 5 is hereby increased from $3.00 per fixture
to $5.00 per fixture.

2. T~~anical Permit Fee as set forth in Stillwater
City Code ., Subd. 6 is hereby changed from a fee based on
British Thermo Units to a .fee of $40.00 per furnace and $15.00
per air conditioner. r
3. The Mechanical Gas Fitter License Fee provided for in
Stil1water~de ~41.02, Subd.4 is hereby established in the
amount of ~~ an initial license and $30.00 per renewal.
4. The Dog License Fees as set forth in Stillwater City
~ode ~27.01, Subd. 1 is hereby increased from $3.00 to $5.00 for
male and female dogs including neutered and spayed dogs.
5. In all other ways every other provision of the City Code
shall remain in full force and effect.
6. This Ordinance shall be in full force and effect from
and after its passage and publication according to law.

The request would not increase the number of lots or create a substandard lot

Association for open space purposes.
RECOMMENDATION:
Approval with condtion - Lots A and B as showri on Certificate of Survey shall
be for open space purposes.

Northwestern Bell is upgrading their facility on the corner
of Second and Olive Streets and would like to use a lot
they own up Olive Street behind the Condominiums on Third
Street for a temporary parking lot. The request is to
construct the temporary lot for ~se to May 15, 1989. After
that time, the lot will be restored to open yard.
RECOMMENDATION: Approval with condition.

CONDITION:
The Class 5 gravel shall be removed and topsoil spread over
the site and planted by May 15, 1989. The site shall be
prepared so that no erosion occurs off site.

Dear Mr. Russell:
This is to request your approval that a temporary parking lot be
constructed on Northwestern Bell property located to the north of our
telephone building at 302 South 2nd Street Stillwater. Attached is a site
plan showing the proposed parking lot construction.
Telephone service in the stillwater area is being upgraded which will
provide improved service and will include telecommunication services.

Associated with this project, we will be adding additional personnel
during the installation of the new and removal of the old telephone
equipment.
To meet our needs we are requesting to construct a temporary parking lot
for 18 vehicles. This lot will be in use for approximately one year.
Depending on the spring weather conditions, the lot will be restored to an
open yard area by May 15, 1989.

~E: CLAIMS FROM SEWER BACK-UP
On April 6th and 24th, 1988 the City experienced a generator breakdown at the
Maryknoll lift station. This resulted in a sewage flow stoppage and back-up
which affected several homes. A summary of the expenses/damages to the
homeowners accompanies this memo. Our insurance investigator does not believe
that the is City liable because:
.
1. The City was not negligent in either the installation or maintenance
of the lift station equipment; and
2. The City took corrective action immediately following notice or
discovery of the problem.
The investigator further belteves that the generator was defective and that
the manufacturer may be responsible. We are following up on this allegation
and will try to recover from the manufacturer/distributor if we have
conclusive evidence that this is the case.
In the meantime, I believe it may be in the best interest of all concerned to
have the City pay the claims. I believe it is somewhat unfair to have the
homeowners wait until we can resolve this matter with the manufacturer. The
homeowner has suffered damages, cannot collect on a homeowner1s insurance
policy and would expend a considerable amount of money in trying to collect
from the manufacturer.
For your information, the City has a $5000 deductible on property damage
claims so we would have to pay these damages out of City funds.

BOARD MEETING MINUTES
MAY 2, 1988
The regular monthly meeting of the Stillwater Public Library Board of Trustees
was held on Monday, May 2, 1988 at 6:30 P.M. Vice-President Susan Doe
presided.
Present: L. Welshons, V. Childs, S. Doe, G. Schmidt, F. Kalinoff, J. Cass,
R. Marshall. Also present: L. Bertalmio.
The minutes of the April 4, 1988 meeting were approved as submitted.
Committee Reports
1. Computer Committee - The computer and finance committees will meet
for further discussion on th~ purchase of a microcomputer.
2. Special Projects -
a. A retirement party honoring Jean Simonet and Chuck Hoffman will be
held on May 11, 1988 at the Dock Cafe from 5:30-6:30.
b. The National Library Ope~ House was held on Thursday, April 21, 1988.
3. Building & Grounds - The committee will neet this month to discuss
landscaping.
Bills in the amount of $11,470.44 were approved for payment.
Building Project
1. Marble Top of Circ Desk - Drake Marble has agreed to replace the
the sub-standard portion of the circulation desk.
2. Shelving - There has been a delay in the delivery of the rest of the
new shelving.
3. Final Report Status - A financial report on the building project
prepared by Betty Caruso was distributed and discussed. Lynne reported
that Jeff Scherer is preparing a certificate of substantial completion.
Lynne will pursue information concerning annual tests and maintenance
needed on the building.
4. Building Leaks - Further discussion was held on building leakage
problems and solutions.
Old Business
1. Long Range Planning Event - The Board considered the proposal to hire
Barbara Davis as consultant to facilitate the long range planning
process. For a fee of.$360 plus mileage she would do the following:
situational analysis, internal, external, theatre, and opportunities.
Susan Doe will pursue dates for the sessions which will take place
on two Saturday mornings in the fall.
2. Story time Study - Ray Marshall moved and Greg Schmidt seconded that
Carol Belanger further refine her report (attached) bearing in mind
that the City Fire Marshall set an occupancy limit of 50. This
refinement is to be done after discussion with the involved group.
The motion was passed.
3. Information Video project - The staff was unable to make a recommendation.
A key person at WCL was on leave. The Board decided to wait before
further considering expenditures on informational videos.

Union Contract Negotiations - Ray Marshall moved and Fred Kalinoff seconded
the approval of the negotiation report as corrected. The report is attached.

attached pay schedule be approved. The motion passed.
Director's Salary - Ray Marshall moved and Fred Kalinoff seconded that
the director's salary be approved. The report is attached. The motion passed.
Budget Funding Priorities - The Director called for discussion of budget
funding priorities and that they be forwarded to the Budget Committee
before their June meeting.
Board Education - The Board discussed the need for Board education. The
Board is open to a plan of Board education but is concerned about the amount
of time required. The subject was assigned to the Special Projects
Committee with Jean Morse as chair for the preparation of the recommendation.
Adult Programming Proposal - Dave Chittenden wants to write a proposal for
quality programs. His fee would be contingent on a successful grant award.
A committee of Greg Schmidt, Lynne Bertalmio, and Jan Chittenden will meet
and formulate a detailed proposal.
Meeting Dates - Ray Marshall moved and Greg Schmidt seconded that the June
meeting be held on the scheduled date, June 6 and that the July meeting be
held on July 11. This motion passed.
State-wide Borrowers Contract - Ray Marshall moved and Fred Kalinoff seconded
the adoption of the State-wide Borrowers Contract. The motion passed.
Librarian1s Report:
The Annual Report was received.
The Rivertown Restoration has selected the Stillwater Public Library for
an award. Don Hansen will accept.
The Books Talks were well received.
Lynne described the Uganda Book Project.
The sprinkler malfuncti.oned. There was leakage at a pipe joint.
The meeting adjourned at 8:50 P.M.

rallies in decades past (in Courtroom in case of rain)
Who can Participate:
Anyone who is a 1988 candidate for office in any of the above three
catagories described--nation1, state and local.
Format that will be followed:
Each of the three groups have been assigned 1/2 hour; each candidate
will be alotted five minutes to speak assigned on a first registered,
first time slot'basis; if at the end of the group's time there is extra
time, questions from the audience can be directed at candidates from that
group. Each candidate will be briefly introduced by our moderator.

How to register:
Fill out enclosed form and return to HIstoric Courthouse; verification
and time slot assignments will be sent to candidate. No stand-ins allowed,
candidates themselves must be present. Return by July 11.

Dear Mayor Abrahamson:
Thank you for your comments on our Draft of the Wastewater Policy
Plan. Your comments and those of other cities and interested
parties will be studied and used in our process for preparing the
final plan. When the staff has prepared a response to all the
comments received, we send a copy to you before the Council's
Systems Committee deliberates on the staff proposed changes.
I would like to reassure you now, however, about your concern
regarding growth projections for stillwater and the design of the
stillwater Wastewater Treatment Plant. The staff tells me that
the figures sent to the City on Feb. 29, 1988, will be used in
designing the plant capacity. As for the year 2010 forecast,
this is a very rough, but necessary, attempt at portraying what
might be for the purpose of metropolitan system development.
Official Council population, household and employment forecasts
will be prepared in approximately five years when the results of
the 1990 Census are available to us. The Council will then
revise its Metropolitan Development and Investment Framework;
after which local units of government will be asked to review
their own plans. You should also note that the Wastewater Policy
Plan will be reviewed and revised, if necessary, every five
years.

Dear Chairman Keefe and Commission Members:
Re: Comments on Wastewater Policy Plan.
The City of Stillwater has reviewed the Wastewater Policy Plan and offer the
following comments for Metropolitan Council review. The City of Stillwater is
supportive of the regional concept for sewer service but'want to ensure that
Stillwater1s specific concerns are addressed in that regional approach.
\
Concerns identified in reviewing the Wastewater Policy Plan are in two areas;
growth projections and service capacity and infiltration and inflow (1/1).
The Wastewater Policy Plan, on page 31, discusses development and delivery of
sewer service issues. The section describes the close relationship between the
Development and Investment Framework and Wastewater Policy Plan. The framework
provides the guiding direction and the Wastewater Policy plan implements the
framework. Here is where Stillwater's problem lies. The Development and
Investment Framework forecasts a Stillwater population of 13,200 in 1990 and
13,300 in 2000. The Wastewater Policy Plan extends the forecasts to 2010,
14,500. These figures are very low. The 1988 Stillwater population estimate of
13,800 is equivalent to the Metropolitan Council forecast for Stillwater
population in 2005. This is of particular concern at this time because plans
are being drawn for the early 1990's expansion of. the Stillwater wastewater
treatment facility. It is very possible that if existing Metropolitan Council
forecasts are used, inadequate capacity will be availableJor'growth.
Bes i des the sewer capacity issue, the method used to develop the 2010 forecast
is of concern. The City of Stillwater is not aware of having the opportunity
to comment on~the 2010-figures similar to the extensive public input and
participation process recently completed for the Development.,and -Investment
Framework.~ The -2010 'growth figures~are~,important becauseothey are used as a
basis to size sewer 'services and in effect;~extend the City~sComprehensive
Plan ten years. As described in other Metropolitan Council documents, cities
will be required to change local comprehensive sewer:'plans'to,conform with
De ve 10 pme n t F r amewor k and Wastewater Pol icy Plan documents :-iJhe 2010 fi gures ,
in effect, amend local~comprehensive plans without adeq~ate~6pportunity for
local government review and comment.
