1. This is the day and time for the Public Hearing on an Ordinance regarding
the regulation of Bed and Breakfast in residential districts in the City
of St ill water.
Notice of the hearing was published in the Stillwater Gazette on May
6, 1988.
2. This is the day and time for the Public Hearing on an amendment of Planned
Unit Development reducing the size of the commercial mall from 404,750 sq.

The Meeting was called to order by Mayor Abrahamson.
Present:
Councilmembers Bodlovick, Farrell, Kimble, Opheim,
and Mayor Abrahamson.

Mayor Abrahamson explained that the Special Meeting was called at
the request of Mr. Michael McGuire in order to discuss the dock
permits and conditions of the permits for the Stillwater Dock
Company. Mr. McGuire addressed the Council and explained that he
met today with John Easton and Dick and Don Anderson and a
compromise solution was attained.
Mr. Easton summarized the compromise plan, which calls for
exchanging the locations of the excursion dock and the public
dock, and for purchase of the excursion dock by the st. Croix
Boat and Packet Company from the Stillwater Dock Company. A
docking permit of at least 5 years would be requested, because of
the expense involved in relocating the docks (estimated at
$15,000). A landscaping plan would also be implemented.
Council discussed the issue of private use on public property,
assessments and taxation. It was determined that with the number
of considerations involved, that a temporary permit will be
issued for this year, during which time further negotiations will
take place. The landscaping plan will be implemented this year.
Councilmember Farrell suggested a straw poll be taken tonight and
direction given to Staff to draft a formal motion for approval at
next Tuesday's Regular Meeting.
Motion by Councilmember Farrell, seconded by Councilmember Kimble
to take a straw vote on the matter of the temporary annual permit.

Farrell, to issue a Nonexclusive Wharfage Permit for 1988 to

Council and outlined the project. Dave Hanson, neighboring
homeowner stated that he wishes to thank the Planning Commission
for addressing the needs of the neighborhood, and asked that the
developer be required to maintain the buffer zone. Mayor
Abrahamson closed the Public Hearing.
Motion by Councilmember Farrell, seconded by Councilmember Bodlovick
to approve the Subdivision request by Heritage Development, Inc. as
conditioned by the Planning Commission, and with an additional
condition that there be a Homeowners' Association convenant requiring
maintenance of the buffer zone. (All in favor)

Ms. Pung-Terwedo read the recommended conditions of approval, and
Mr. Valsvik stated that the Planning Commission approved this

side of the elevator. The Committee also 'prefers that the.present

Motion by Councilmember Opheim, seconded by Councilmember Farrell to
withdraw the application for a grading permit. (All in favor)

PUBLIC HEARING
BED AND BREAKFAST ORDINANCE
April 11, 1988
Bed and Breakfast establishments are becoming increasingly popular for the
traveler in Minnesota. Stillwater, well known for its beautiful homes and
historic atmosphere, is a target area for these establishments. In recent
years, the City has had numerous requests for Speci al Use Permits to open a
Bed and Breakfast.
Bed and Breakfasts are usually in older homes in residential neighborhoods.
The Stillwater Zoning Ordinance does not have any regulations pertaining
specifically to these establishments. The closest may be a rooming house.
Therefore, from a planning standpoint major concerns about Bed and Breakfasts
are location, impact on the neighborhoods; numbers and parking.

A study was conducted of Bed and Breakfast Ordinances in communities such as
Red Wing, Hastings and communities on the East and West coasts. Sections were
researched that applied to areas in Stillwater affected by Bed and Breakfasts.
An Ordinance was then drafted which was used as basis for discussion. In
March, members of the Heritage Preservation Commission, Planning Commission
and Bed and Breakfast Owners in Stillwater met to discuss the draft and
changes were made accordingly.
The following is a draft Ordinance which is a result of the research
conducted, the meeting held in March and the Planning Commission review at the
March meeting.

A Bed and Breakfast establishment is only permitted in an RCM or RB zoning
district.
HISTORICAL SIGNIFICANCE
The Bed and Breakfast establishment will be at least 100 years old an/or will
show proof of historic significance to the character of the City.
MAXIMUM BEDROOM UNITS
The maximum of five (5) Bed and Breakfast units may be established in a
structure.
LIGHTING
Adequate lighting must be provided between the structure and parking areas for
safety contiguous to residential structures.
Additional external lighting is prohibited.
INSPECTIONS AND LICENSE

A Bed and Breakfast establishment shall be inspected by the Fire Marshal,
Building Official and County Health Officer, and upon approval receive a
proper operating license.
CONDITIONS OF APPROVAL
A Bed and Breakfast establishment shall show proof of inspection/or proof of
proper operating licenses by the State or County and shall apply for and be
granted a permit from the zoning office upon review by the
Community Development Director, Planning Commission and approval by the City
Council prior to commencement of the operation.

TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of Stillwater, Minnesota will
meet in the Council Chambers of the City Hall at 7:00 P.M. on May 17t 1988, to
consider the making of an improvement in that area described as follows:
Block Two, Stillwater Industrial Park and Block One, Kern Pauley Additiont
all according to the Plats thereof, Washington County, Minnesota.
The improvement is proposed to be made pursuant to Minnesota Statutes,
Sections 429.011 to 429.111, and the nature of the proposed improvements
involve and include the construction of a storm water detention basin and
related drainage improvements.
The area proposed to be assessed for such improvements is the property that
will benefit by the construction of the above proposed drainage improvementt
and all property within the East Industrial Park Drainage District, and all
property within the area contributing drainage to the storm water facilities
proposed to be constructed, all lying within the area above described.

When the Industrial Park was first constructed in 1978, the
detention basin was not required to detain the minimal runoff.
Therefore, it was determined, during the planning stag, to be in
the best interest of the developer, to have the detention basin
constructed as development occurred, within Block 2. This would
provide the developer with greater flexibility in determining the
configuration of the detention area to better fit proposed
development on each lot in Block 2. If development plans had
been firm in 1978, this basin would have been constructed as a
part of the original Industrial Park Storm Sewer (L.I. 157).
In March, 1988, a proposed development plan for Lot 3 was
submitted to the City for review. The proposed future expansion
of a motel for this site would encroach on the detention basin as
designated in Block 2. The property owner, Tower Properties,
then requested alternate detention basin configuration designs be
prepared for their review and approval. The property owner
selected a detention basin which impacts Lots 3 and 4 of Block 2
the least. Tower Properties requested a new easement be written
for the new configuration of the detention basin. The existing
easement can be vacated. Tower Properties then petitioned the
City for a public improvement.

However, by lengthening the detention basin in an east-west
direction, more excavation is required because the existing
ground is higher on the westerly side of Block 2. The existing
detention basin surface area covered 1.01 acres for easement
purposes. The final alternate selected by Tower Properties is
1.25 acres in surface area. Both of these basins are designed to
provide the system with 1.85 acre feet (Ac.Ft.) of storage volume
for a 100 year reoccurrence storm event. The high water
elevation is predicted to be 930. The top of the detention basin
at the lowest point is at elevation 936. The bottom of the basin
must be at 927 for the existing pipe invert. Four to one (4:1)
slopes were used for design.
The detention basin is estimated to cost $82,200. The
estimated cost includes 10% contingencies and 30%
administration, engineering and legal. If this project
combined with another, a cost savings may be realized.

The enclosed drawings indicate the drainage area and the location
of the detention basin.
The total assessable area is 175.18 acres. If the Council were
to consider spreading an assessment over the total watershed
area, the assessment rate would be $469.24/acre.
A mock assessment role is included with this report based upon
the estimated costs and assessment procedure outlined above.
We find the project feasible and recommend that the detention
basin be constructed at an estimated cost of $82,202 as outlined
herein. We further recommend that this report be reviewed by the
City staff, the City's fiscal agent and City Attorney.

Dear Council Members:
Pursuant to your request, we have reviewed the letter dated April
17, 1988, from Mrs. Bonnie LaValley of 719 West Churchill Street.
Ms. LaValley asked five questions pertaining to the construction
of Churchill Street. This letter will attempt to answer those
questions for the Council. We trust these answers will assist
you in making any decisions you feel are necessary regarding this
project. We will be happy to meet with the Council also to
discuss these matters further if desired. The questions and
responses are as follows:
1. Cracking sidewalk. The contractor has resumed work on the
project already and is in the process of replacing cracked
sidewalk and curb.
2. Plastic and turf area. The siding contractor was to begin
restoration on the project on this date. Any plastic left
from covering the sidewalk and/or curb will be removed
before sod restoration is completed.
3.
Offset crown at Martha. Ms. LaValley stated that water ran
across Churchill Street and north on Martha when a heavy
rain was experienced. As the Council recalls, because of
the difference in curb elevations between the south side and
the north side the crown in the street was offset 10 feet
from the south curb. The crown was also reduced in
elevation to assist in driving. The storm sewer system is
basically designed for a 10 year occurrence event. Any
storm exceeding this may flood the catch basin inlets and
possibly flood an intersection. As the Council recalls it
is more economically feasible to design storm sewer systems
in this manner. The crown in the street when offset,
normally will be about 2" to 3" above the gutter apron

whereas, if the crown were in the center of the street, and
both cu:r;-bs at the same elevation, the crown is normally 6"
above the gutter apron on each side. If a rainfall of a
higher duration or frequency were to fall it is possible
that the pavement would fill between the offset crown and
the gutter with water and spillover the crown and flow
north on Margaret. However, Margaret street does have a
fairly steep grade and there are two catch basins located at
each end of the radius on the southeast corner. The grade
is such that the water should be directed into the catch
basins.
4. Sidewalk grades. After reviewing the staking notes and
original cross sections again the sidewalk elevation is
approximately the same as the elevation before the project
began. The boulevard and back slope areas on private
property will be restored to approximately the same slope as
they were before the project began. Also, once the sod is
replaced in the boulevard area the sod will be approximately
even with the sidewalk in elevation and should be easy to
mow.
Curb returns on Martha. It is not clear which radius Ms.
LaValley is referring to since she talks about the north and
south radii on Martha, however, Martha runs in a north -
south direction. We assume that she was talking about the
return at the southeast corner of the intersection of Martha
and Churchill. This would be the radius in front of her
property. The existing curbing on this radius was
bi tuminous. The bituminous curb is a different shape and
not as high as the concrete curb and gutter that was
installed as part of the improvement. Also, at the end of
concrete curb and gutter sections it is required to install
a 2 foot concrete section which is tapered down to meet the
gutter area. This provides safety for snow plows and/or
automobile traffic so they do not hit a blunt end and cause
an accident. Also, if the concrete curb and gutter is ever
extended on Martha Street this 2 foot section can be removed
and the new curb grade matched into the top of the existing
concrete curb. Since the bituminous curb is lower and of a
different shape, and of necessity must be wider than the
concrete curb to provide as much stability as possible, the
tapered areas were matched in with bituminous. Again, after
the landscaping is completed the yard area will slope
forward to the curb and should not provide any ponding
behind the curbing.
This answers the five specific questions in Ms. LaValley's letter
as nearly as we can. Again, we will be happy to explain and
answer any questions that the Council may have regarding Ms.
LaValley's questions.

Ms. LaValley also included some questions and/or statements in
the bulk of her letter regarding various areas where sidewalk

portions were missing and it was hard to clear snow etc. Ms.
LaValley specifically mentioned a missing portion of sidewalk at
715 Churchill. This sidewalk was not installed because of
problems with the property owner in trying to install forms for
the segment referred to and not being able to pour this walk in
late fall 1987. However, after discussing the situation with the
lady's son, he requested that we contact him when work began
again in the spring and he would assist the contractor in pouring
that section of sidewalk.
Ms. LaValley also has questions regarding the contract. She
questioned the disposition of unsatisfactory work by the
contractor and completion dates which were not met. As the
Council is aware, the contract specifically requires replacement
of unsatisfactory work. The contract also provides a one year
warranty period in which the contractor is totally responsible
for failed materials and/or construction items. The contractor
was delayed in his schedule by relocation of various private
utilities within the project. The contractor also accommodated
the City in his approach to the project in scheduling, such that
high school traffic could be maintained on Churchill Street as
long as possible. That is, the contractor constructed the east
end of Churchill from 6th to Holcombe first and then proceeding
to the west end and constructed Churchill from Greely to
Holcombe. Therefore, the block which Ms. LaValley lives on was
the second to the last to be completed. Because of utility
delays the turf restoration and corrective work could not be
finished in the fall of 1987 due to cold and inclement weather.
The City Council did grant the contractor an extension such that
he could finish the work this spring when weather conditions were
more favorable and provide the end result which the City expects.
Ms. LaValley also questioned the placement of sod between the
curb and sidewalk instead of concrete. It is desirable to
delineate the edge of the curb from the edge of the sidewalk by
some change of surface. This provides an added safety protection
for both the motoring public and the pedestrian traffic. As an
economy measure it is cheaper to install sod. Another measure
that could have been considered would be to put bituminous in
this boulevard area, however, this also would be more expensive
than sod. Secondly, there are power poles along Churchill Street
which could not be economically removed by NSP. NSP did change
the direction of some feed lines for a block or two, however,
many of the power poles have to be maintained on Churchill. The
sod area between the curb and sidewalk provides a location for
these power poles as well as fire hydrants.

I believe this pretty well answers the main points of Ms.
LaValley's letter. As I stated at the beginning of the letter,
much of the work such as the sidewalk rails on her private walk
which protruded into the edge of the public walk have already
been removed and corrective measures taken. Once again, we would
be happy to discuss these matters with the Council and answer any
questions you may have.

That the Petitioners for annexation are:
Richard Frank Perry and Victoria Mae Perry,
100% of the property owners contained within the area
proposed to be annexed.
That the property proposed for annexation is described as
follows:
The South 660 feet of the West 660 feet of the
Southwest Quarter of the Southwest Quarter of
Section 20, Township 30, Range 20 West, Washington
County, Minnesota, except the South 360 feet of
the West 227 feet thereof, subject to the right-of-
way of Neal Avenue North along the West line and
subject to easements, restrictions and reservations
of record, if any.
1. That the area proposed for annexation abuts the city
limits of the City of Stillwater along the entire North and
Easterly boundaries thereof, and does not exceed 200 acres.
2. That the petitioners believe that all of this property
is or about to become urban or suburban in character.
3. That this Annexation is requested since it will be
impossible to develop this property in an urban fashion unless
the municipal services of sewer and water are provided to the
property from the City of Stillwater.
4. That parties entitled to notice under Minnesotasta.tutes
414.09 are the Township of Stillwater, the City of Stillwater
the County of Washington and the Washington CountTPlanning
Department.

Stillwater Police Department. As a result of your complaint, the stillwater Police
Department conducted a traffic survey in the location of the complaint.
The survey was conducted from October 10, 1986 to October 20, 1986. The purpose of
the study was to monitor vehicular travel on 6th Avenue South. Both speed and fre-
quency of travel were recorded. Officers of both the day shift (7:00 a.m. to 3:00 p.m.) .
and the swing shift (3 :00 p.m. to 11 :00 p.m.) were instructed to spend anywhere from .
~0-60 minutes a day monitoring traffic in the area. A total of 36.5 hours of officer
time was spent on the survey. Both marked and unmarked squad cars were used. in the sur-
vey. The survey showed the following information:
1. Average number of vehicles passing 6th Avenue South and Churchill streets
per hour: 29.55. Highest reported time block: 3 p.m. to 5 p.m., 45.29.
Lowest reported time block: 8.a.m. to 10 a.m., 18.96.
2. Average speed of vehicles using this area was 25.46 mph. The average highest
speed recorded was 32.94 mph and the average lowest speed was 18.23.
3. Vehicular travel north and south on 6th Avenue South was relatively evenly
distributed with an average to 15.66 cars traveling north and an average of
13.26 cars traveling south per hour.
4. The average speed most frequently traveled in the area during the survey was
26.26 mph.
. In conclusion, our survey indicated the street is not a speed risk area. Ibwever, your
geographical location on the downside of the hill could present a concern with children
crossing the street in front of your residence. <l1r recommendation in this respect is
~o educate the children in crossing 6th Avenue South at the Churchill street intersection.
This crossing is visible to both north and south bound motorists. The Stillwater Police
,Department Patrol Division will be periodically running radar in your area as an added .

Re: Comments on Wastewater Policy Plan.
The City of Stillwater has reviewed the Wastewater Policy Plan and offer the
following comments for Metropolitan Council review. The ctty of Stillwater is
supportive of the regional concept for sewer service but'want to ensure that
Stillwater's specific concerns are addressed in that regional approach.

Concerns identified in reviewing the Wastewater Policy Plan are in two areas;
growth projections and service capacity and infiltration and inflow (1/1).
The Wastewater Policy Plan, on page 31, discusses development and delivery of
sewer service issues. The section describes the close relationship between the
Development and Investment Framework and Wastewater Policy Plan. The framework
provides the guiding direction and the Wastewater Policy plan implements the
framework. Here is where Stillwater's problem lies. The Development and
Investment Framework forecasts a Stillwater population of 13,200 in 1990 and
13,300 in 2000. The Wastewater Policy Plan extends the forecasts to 2010,
14,500. These figures are very low. The 1988 Stillwater population estimate of
13,800 is equivalent to the Metropolitan Council forecast for Stillwater
population in 2005. This is of particular concern at this time because plans
are being drawn for the early 1990's expansion of the Stillwater wastewater
treatment facility. It is very possible that if existing Metropolitan Council
forecasts are used, inadequate capacity will be available for growth.
Besides the sewer capacity issue, the method used to develop the 2010 forecast
is of concern. The City of Stillwater is not aware of having the opportunity
to comment on the 2010 figures similar to the extensive public input and
participation process recently completed for the Development and Investment
Framework. The 2010 growth figures are important because they are used as a
basis to size sewer services and in effect, extend the City.s Comprehensive
Plan ten years. As described in other Metropolitan Council documents, cities
will be required to change local comprehensive sewer plans to conform with
Development Framework and Wastewater Policy Plan docUlrents.The 2010 figures,
in effect, amend local comprehensive plans without adequate opportunity for
local government review and comment.

REIMBURSEMENT FOR WATER SERVICE REPAIR/INSTALLATION
A defective water service connection was made at 415 West Pine Street by
Shafer Construction during the Pine/Churchill reconstruction project. The
bills include a reimbursement of $212.50 to the property owner who corrected
the work and also had a new water service installed. The '$212.50 represents
the amount of work that would have had to be done in order to repair the
faulty service connection and not just th~ cost of the new water service. The
amount to be reimbursed will be collected by the City from Shafer
Construction.

limits of Stillwater.
We want to rent space to sell additional pull-tabs in two

would use our own personnel for sales and accounting. It is
our request that we would operate five evenings per week,

Stillwater Elks has been in existence since May 12, 1891
located in downtown Stillwater. During our long history we

This issue arrives at City Hall with the spring dandellon crop, Street food is
part of summer and Lowell Park is not sa~red ground; 1t is an active pubHc
space that, while planned for sitting and promenading, has progressed to
frisbees and skateboards, A new plan would do well to expand both the green
strip and activities, The needs of runners and small chlldren offer a way to
connect the residential Stillwater with a downtown that is in need of
serious attention,
The former popcorn wagon on Main at Nelson posed business problems that
the City should address. The used popcorn grease was poured down the
corner street drain along with other food waste. The operators used the
Brick Alley and River Exchange toilet facilities that are paid for by the
business tenants' common area cost. The wagon area-keeping was poor;
grease stained sidewalks and the other businesses policed up the remains of
spilled food and containers dally, The driver sight Hnes coming off Nelson
Street were restricted visually.
street food grazers are not welcomed by most store keepers, A box of
popcorn generally means no sale. The pOl1te eaters don't go into shops and
restaurants, and those who do don't buy.
street food and community interest would better be served by park provided
slab surfaces with power and water,. Food is enhanced by seating, shade, and
trash containers. Legal guidelines could be met by offering stand sites on a
yearly competitive bid. A seasonal contract should establ1sh an exacting set
of enforcable rules in regard to operation and area cleanliness. The same
rules can apply to private locations as well. The llcense and site bids should

be more than mere tokenism with professionals entering the area. These
concessions are highly profttable if properly run,
Park locations through a division of space and realistic fees would place the
seasonal vendor on a more competitive footing with year round business.
Competition is as American as fireworks, Sousa music, and popcorn in the
park,
Park based people give the city an extra set of eyes as exemplified by
-oonny Anderson, who's quick response and disregard for his personal safety
saved the life of a young girl.

Dear Mayor Abrahamson and Council Members,
We would like to point out a situation to you and hope you will do some-
thing to remedy it. We live at 127 Birchwood Drive North, and next to
us (to the north) is city owned land and a city-street run off pond.
The city also has an easement on our land for street drainage down to
the pond.
Weare requesting to have the property owned by the city and area around
the pond cleaned up by either burning (weather permitting) or dead trees,
leaves, and debree hauled away,
Another concern is that where the city has the easement on our land, the
hill has started to have laL'ge areas of under-mined wash out. We are
asking to have clean fill put ,in these washed out area and it seeded down.
We have cleaned up muoh of the city property but feel it is up to the
city to care for their property. We have contact Mr. Junker, street
foreman, and he states it is Park Department but as yet we have not seen
anyone from the Park Department come up to even:'look at the area. The
contact with Mr. Junker was two weeks ago.
When Mr. Harry Peterson was mayor, he game us permission to cut down dead
trees and brush and said if it was piled up the city could have it hauled
away. Trees and brush were cut down but city did not haul away. I t is
as if the city does not want the responsibility of its' own pDoperty. The
ci ty property certainly distracts from our property and in dry conditifr..oss.
it is a fire hazard.
We feel with just a small amount of labor and effort on your part an eye
sore could be cleaned up. Thank you for your cooperation and consideration
to the above matters."
