DISCUSSION OF GOALS AND OBJECTIVES
City Coordinator Kriesel presented a Summary of Goals and
Objectives by Departmental Responsibility.
Motion by Councilmember Kimble, seconded by Councilmember Opheim to
approve the Summary of Goals and Objectives as presented. (All in
favor)
OTHER BUSINESS
Mayor Abrahamson informed Council of a recent telephone call he
received regarding the Council's position on the location of the
new bridge.
Motion by Councilmember Opheim, seconded by Councilmember Kimble to
authorize the City Coordinator to attend a Development Needs/Inventory
Effective Management Program at a cost of $600. (All in favor)
Motion by Councilmember Kimble, seconded by Councilmember Opheim to
adopt the appropriate resolution approving a meritorious pay increase
of $600 per year for Sewer Maintenance Worker Jeff Johnson, based upon
his attainment of a Class S-B License. (Resolution No. 7896)

Motion by Councilmember Farrell, seconded by Councilmember Kimble to
approve a request to hang a banner over Main Street advertising the
Rivertown Arts Festival, and to approve use of fire department ladder
truck in hanging the banner. (All in favor)
Council directed City Attorney Magnuson to arrange a staff
workshop regarding Oak Glen.
ADJOURNMENT
Council adjourned at 5:35 into Executive Session.

The Council met in closed session to discuss a personnel related matter and
possible discipline of a City Employee.

City Coordinator Kriesel briefly explained a request for a change to a
drainage easement for the Super 8 Motel properties located in the
Industrial Park area. The request will be discussed at the Regular Meeting
shceduled to be held at 7:00 P.M. Tuesday, April 19, 1988.

Mr. Langness eXPlainedjthe procedures to follow in regard to the
$1,600,000 bonds for t e Washington Square Project, stating they could not
go beyond the three-ye r period of time because the bonds would no longer
be tax exempt. The Ci y would need a firm commitment that all of the
financing is in place 'ncluding equity capital, and commitments, etc.

Scott Steindorf was pr sent to give an update on the Woodland Lakes Mall
project and extensive iscussion followed. Items discussed were erosion
control, revisions of he project, i.e. changes in hotel construction,
proceeding in phases a d size of Mall. Discussion also included whether
the revisions necessit ted going through the Planning Commission and
public hearing review rocess again.

Ms. Hudson stated the Cable Co. is going to offer pornography movies
Pay for View -- and ask d the City Council to pass some legal ordinance to
prevent pornography on Cable TV. The discussion following stated the
Council does not have the power to regulate the types of programming
offered by the Cable Co. and any action may open the City for lawsuits.

Motion by Councilmember Opheim, seconded by Councilmember Bodlovick that the
City Council of the City of Stillwater is basically opposed to the concept of
pornography. (Ayes - 4; Nays - 1, Councilmember Farrell)
4. Sylvia Branum - Discussion regarding traffic control, Broadway Street/Pine
Street/Serond Street.
Ms. Branum presented a petition to Council requesting stop signs in the
above mentioned area because of the amount and speed of traffic and the
danger to children.
Robbine Houck, who lives on the corner of Pine and Second Streets, also
stated the need for better traffic control in the area.
A traffic study will be done in the area of Broadway, 'Pine, and Second
Streets regarding traffic control measures and a decision will be made at
the May 3rd Council Meeting.
Council recessed for five minutes and reconvened at 8:57 P.M.
5. Dick Herbert - Request for Variance, Rice & Greeley Streets.
. Motion by Councilmember Kimble, seconded by Councilmember Bodlovick, to grant
a variance and waive the formal hearing process for Dick Herbert for a home on
Greeley & Rice Streets, because of changes to the ordinance since the request
was first received and this request does not create a hardship for others.
(All in favor.)

Mr. Junker initiated di cussion of the request of residents on Hudson St.,

river. Council stated his permission had been given at an earlier date.
Council concurred with he request of the Historical Society to place
crushed rock in the Soc'ety's driveway off Laurel St. at a cost of
approximately $70.00. '

Notice of the hearing was published in the Stillwater Gazette on
March 24, 1988 and copies were mailed to affected property owners.
Mr. Russell explained the background of the request and Planning
Commission Chairman Fontaine stated the Planning Commission denied the
request because adequate hardship was not shown.
Mr. Smith was present and stated he would cut the size of the deck to ten
feet.
The neighbor to the north of the Smith residence stated she opposed the
request because no hardship has been proven. Mayor Abrahamson closed the
publ ic hearing.
Motion by Councilmember Bodlovick, seconded by Councilmember Farrell to deny
the request of Mark Smith for a variance to sideyard setback requirements for
construction of deck at 105 lakeside Dr. because no hardship has been
demonstrated and other solutions are available. (Ayes - 4; Nays - 1,
Councilmember Kimble.)
UNFINISHED BUSINESS
1. Sanitary Sewer Service - Discussion of Alternative lift Station Site,
Cottages of Stillwater.
Discussion followed regarding installation of a lift station for the
Cottages of Stillwater. Paul Keleher stated he is in favor of Option III,
the permanent lift station as designed for the Woodland lakes area.

certain the Woodland LaJes Mall will be constructed. This will be
discussed further at th~ May 17 meeting on Woodland Lakes Mall.

Case No. SUP/88-1S - Special Use Permit to construct a free-standing
sign along Myrtle Street, County Road 812 across from the intersection
of Deerpath and County Road #12 for Stillwater Jaycees Softball Fields.
Michael polehna for Stillwater Jaycees presented the request for a 6
ft. x 8 ft. sign to be located on the North side of County Road #12 on
the East side of the driveway to the ballfields. Larry Cardinal,
resident across the street, asked if the sign will be parallel to the
road. Mr. polehna stated he was not sure if the sign would be
parallel or at an angle to the road.
Motion by Don valsvik, seconded by Mark Ehlenz to approve the request
with the condition that the sign shall be set back five feet from the
County Road 812 right-of-way. Motion carried 6-0.

foot sideyard setback (20 foot minimum required) at 1901 North Second
Street. Barry Bailey, owner of the property, presented the request.
The request is to construct a 24 x 26 ft. garage with 6 ft. setback on
East Willow Street. There is a 9 x 10 ft. shed on the property which
the owner plans to retain.
Don Valsvik made a motion, seconded by Mark Ehlenz, to approve the
request for a variance with the following conditions: 1) Provide an
accurate survey of lot showing setback of garage and location of
drainfield before building permits are issued. 2) The 9x10 ft shed
shall be removed from the property or attached to the garage. Motion
carried 6-0.
Case No. SUB/88-17 - Request to resubdivide four lots (2.77) acres
into five lots of 15,646 to 28,814 square feet in the Multi-Family
Residential District located on the Northwest corner of County Road 5
and Croixwood Blvd. Heritage Development Company presented the
application.
Tim Mccauley, who resides near the property, stated that in 1984 the
developer did not plant the buffer of trees which was required at that
-time, and suggested that a contingency fund be established to
guarantee that the buffer be completed. Dave Hanson, resident next to
the property, expressed his concern that the units will be rented
rather than sold; and also suggested a contingency fund to guarantee
that screening be completed. Al Ranum, attorney representing Mr.
Kilty, owner of the property to the northwest, asked for an easement
on the property in order for his client to back his car out of his
driveway.
Recommended conditions of approval are: 1) A final drainage/grading
plan shall be submitted before final plat approval. 2) Necessary
drainage and utility easements shall be shown on the final plat. 3)
The road width shall be increased to 32 feet per the City Engineer's
comments and constructed according to City street standards for public
streets. 4) An access easement shall be executed giving the existing
townhouse building access over proposed Lot 1 before the final plat is
approved.
Motion by Mark Ehlenz, seconded by Glenna Bealka to approve
request with the four conditions of approval. Motion carried
with Don Valsvik abstaining.

Final Plat shall be approved by the City Council before the building
permits are issued. 4) Addresses for each residential unit shall be
plainly marked. 5) Any trash stored outside shall be in a sightly
enclosure. 6) The undeveloped site shall be maintained.
Motion by Jay Kimble, seconded by Mark Ehlenz to approve the request
with conditions. Motion carried 5-0; Don Valsvik abstained.
Case No. SUP/88-21 - Special Use Permit for a Bed and Breakfast at
1103 South Third Street (Driscoll's for Guests). Mark and Sandra
Brown presented the application.
The home is currently being used as a Bed and Breakfast. The Browns
have signed a purchase agreement for the property and wish to continue
operating the Bed and Breakfast part-time.
Motion by Mark Ehlenz, seconded by Jean Jacobson, to approve the
request with the nine recommended conditions of approval. Carried 6-0.
. Case No. V/88-22 - Variance request for an oversized 1,280 square foot
garage at 800 Pine Tree Trail. Roger Grinstead, owner of the
property, presented the request.
Jack Nelson, owner of property to the north, stated his concerns
regarding the slope into his yard, the location of the driveway 16
feet from his house, and removal of a grove of trees.
The Commission expressed concern with the size (over 1,000 sq. ft.) of
the proposed building, drainage problem, and the existing tuck-under
garage.
Motion by Don Valsvik, seconded by Jean Jacobson, to deny the request.
Motion to deny carried 6-0.
Case No. SUP/88-23 - Special Use Permit for conversion of a grain
elevator to mixed use (commercial/office/residential) located at 421
East Nelson Street. Michael McGuire, owner, presented the application.
The application is to convert the Commander Elevator into a
three level structure: the main level 1,900 square feet of
space, second level 800 square feet of office space and
level a one bedroom apartment.

Jim Williams of the Freight House, and Joe Murphy of Vittorio's, were
present to express their concern regarding parking in the area. Don
Valsvik suggested that an additional condition of approval be that the
exterior of the building be approved by the Downtown Plan Committee.

location of an existing garage, and the owner wishes to use the
present concrete driveway. The existing garage has a two ft. sideyard
and rear setback.
Motion by Jay Kimble, seconded by Don Valsvik to approve the request
with the fOllowing conditions: 1) No run-off-from the garage roof
shall go on neighbor's property. 2) The garage shall be located three
feet from side and rear property lines with maximum one foot overhang.
3) The side and rear walls will be sheetrocked for fire separation.
Motion carried 6-0.
ZAT/88-1 - Public Hearing on Zoning Ordinance Text Amendment
regarding Bed and Breakfast Uses in Residential Zoning District.
Two local Bed and Breakfast managers were present to review the draft
ordinance and, after discussion with the Commission, did not express
any objections to the ordinance.
Motion by Don Valsvik, seconded by Mark Ehlenz to recommend approval
of the Bed and Breakfast Ordinance. Motion carried 6-0.

Discussion: The subdivision request is to divide a 2.77 acre site comprised
of four lots, previously known as St. Croix Place, into five lots. The minimum
lot size for the RCM District is 12,000 sq. ft. The proposed lots range in
size from 15,646 to 28,814 square feet. The lots are serviced by a proposed
public 25 ft. wide 350 ft. cul de sac. Building sites for structures are shown
on the five lots. Utility easements and drainage easements are not shown on
the preliminary plat. A preliminary grading/drainage plan is provided for the
site. A final plan is required before the final plat approved.
The preliminary plat was reviewed by the City Engineer. City street width
standards for this type of street is 32 feet. A 32 ft. wide street would
reduce the setback for lot five to 18 feet. 35 feet is required in the RCM
District. This issue is discussed further in review of the Special Use Permit.

Discussion:
The application is to construct 30 residential units in five structures, six
units in each structure. The units are to have two bedrooms with 850 sq. feet.
Two parking stalls are provided covered and one stacked behind in the
driveway. No guest parking is provided and as proposed, the 25 ft. street
could not accommodate parking.
All the proposed lots meet the minimum 12,000 sq. ft. lot size requirement.
2,800 sq. ft of land is required for each dwelling. Lot 2 contains 15,646 sq.
feet 16,800 sq. feet is required for six units. Buildings in lots 4 and 5 do
not meet the front yard setback requirement, 35 feet is required with a 32
foot road, 18 feet is provided. The sites are tight and may result in the loss
of one or two units to meet the RCM zoning setback and density requirements.
A landscape plan is proposed. The plan shows a variety of evergreens and
decidious trees. The lawn areas would be sodded. The site plan does not show
any outside trash areas. If trash receptacles are stored outside, they should
be screened in a sightly enclosure.
Recommendation: Approval with conditions.

3. The Final Plat for the Subdivision SUB/88-17 shall be approved by the City
Council before building permits are issued.
4. Addresses for each residential unit shall be plainly marked consistent
with City Code.

The application is to construct a garage on the property. The garage, which

The reason for the 20 ft. setback on the corner lot is to conform to the front
yards of the houses on the block. There is a home on the adjacent property on
E. Willow Street which is built into the slope of the hill. The garage would
not affect, this home.
It is recommended that the variance be approved to build the garage since no
alternative placement of the garage can be made. The trees, aesthetic
amenities to the property, and the septic tank and drainfield, functional
uses of the property, must be kept in place. The property is quite small
(7,500 sq. ft.). Therefore, the house, trees, septic tank and drainfield take
up much of the usable space on the property.
CONDITIONS OF APPROVAL:
1. Provide an accurate survey of lot showing setback of garage and location
of drainfield before building permits are issued.

Recently we purchased the Driscoll's for Guests property located
at 1103 S. Third ST. in Stillwater. We plan to make it our primary
residence and expect to occupy the home on or about July 15, 1988.
We desire to continue to operate the house as a bed and breakfast
under the current terms of the license held by Mina Driscoll.
We will not utilize more than three rooms for guest occupancy which
is the present useage.' Off street parking is available for approximately
six vehicles. This would accommodate our personal cars and the cars
of any guests.
There will be no dinners or lunches served on the premises to
guests. The only meal served will be a light breakfast or brunch
which would typically consist of: omelettes or quiche which would
be prepared in the oven, a fruit tray, juice, coffee or tea, or sometimes
home-baked breads.
We plan to continue to operate the bed and breakfast under the
same guidelines as it has been presently operated by Driscoll's for

Application to convert an existing grain elevator to mixed use
(commercial/office/residential).
Discussion:
The application is to convert the Commander Elevator into a mixed use three
level structure; the main level 1,900 square feet of commercial space, second
level 800 square feet of office space and the third level a one, bedroom
apartment.
The project would comprise substantial improvements and have to meet the flood
regulation for a new building. The main floor elevation will have to be one
foot above the 100 year flood elevation. Other areas for consideration include
parking, structural integrity of the building and handicapped access.
The South Main Street area experiences parking problems at times. Most uses in
the area do not have on-site parking but rely on public lots or on-street
parking. The proposed mixed use according to the existing parking requirements
calls for five spaces for the office and residential use plus other parking
deemed necessary by the City Council based on number of employees and patrons.
(In the Industrial Park Commercial District 13 spaces would be required.) The
Brick Alley site has 51 parking spaces for the existing 15,000 sq ft. (net)
Brick Alley mixed use. 75 to 100 spaces are needed for the existing use. The
public parking lot directly South of the Brick Alley contains 97 spaces.
The application is the use of an existing vacant building which may be
considered different than a new bUilding. As has been discussed previously,
the South Main Street parking situation should be addressed on an area
basis. A solution may involve the existing Brick Alley parking lot.
Handicapped access will have to be provided according to building code
requirement. The design and location of access should be shown on the plans.
No signage program or change in the building elevation has been shown. Plans
showing the location and size of building signs and changes in wall openings
should be provided.

The elevator is a community landmark. The proposed adaptive mix use will
preserve the structure in essentially its existing form and provide uses
compatible with the Downtown area.
The plans have been referred to the Building and Fire Officials for review.
Any comments received will be presented at the Commission meeting for
consideration.
Recommendation: Approval as conditioned.
CONDITIONS:
1. The main floor elevation shall be one foot above the 100 year flood
elevation.
Handicapped access requirments shall be met and plans for access approved
by the Community Development Director.
A sign program for the building shall be submitted before building

The integrity of the foundation of the structure shall be certified by a

The applicant shall cooperate with the City in providing additional

The exterior treatment of the building shall be reviewed by the Downtown
Design Committee using the Downtown Design Guidelines.
The building shall be sprinklered.
The Northeast area foundation shall be replaced or repaired.
A detailed Structural Engineer report and detailed building construction
plans shall be submitted before a building permit is issued.

The application is for'the City to vacate 1,100 feet of North Water Street.
The right-of-way is 36 ft. wide. The 36 ft. right-of-way parallels the main
railroad line and is bordered to the West by the Arrow Building site, Domino.s
Pizza and the City owned MnDOT building site. No street is constructed in the
right-of-way. The request for vacation has been submitted by Mr. McGuire, an
owner of the Arrow Building site.
As Commissioners are aware, a plan is being prepared for the Downtown. A
portion of the plan deals with the North Main Street area land uses. The
street vacation does not appear to be in conflict with the proposed plan for
the area although the plan does show a wider Mulberry Boulevard and pedestrian
access paralleling the river and providing access from the river walkway to
Main Street and Staples Mill Plaza.
The street vacation has been referred to City departments and the City
Engineer for comment. As of this writing, no comments have been received.

Continue request until specific development plans for the site are submitted
or the Downtown Plan adopted.

Comments: This Vacation was probably accomplished many, many years
ago and the Resolution vacating the street evidently lost. We are
redoing this vacation for title purposes and in my view, it would

PETITION FOR STREET VACATION
The City has received a petition for street vacation as
indicated. The request will be reviewed by the City Council
May 3, 1988. Please submit any comments/problems/reservations
you may have to the Community Development Director within two
weeks of receipt of this notice.
COMMENTS:
Northern States Power Company has a pole that now exists in the
Right of Way of Water Street that you plan on vacating. This
pole is for an overhead guy wire approximately 400 feet north of
Mulberry Street. We request an easement for that portion where
the pole is located. It may be difficult without a survey to
tell exactly where that pole is located on the Right of Way.
It also may be wise to maintain a Utility Easement the entire
length of that area for future use as the north end develops.

ADDITIONAL INFORMATION
Since the Planning Commission meeting, the Downtown Plan
Committee Apri 1 19, 1988 reviewed the request as it rel ates to
the Downtown Plan. The Committee felt that the City should not
give of the right-of-way easement without securing a pedestrian
easement over a portion of the right-of-way to provide for
trails shown in the Downtown Concept Plan. The Committee felt
the easement may not be necessary but would not like to lose the
opportunity at this time.
Also, Northern States Power has reviewed the vacation request.
They have a utility pole in the street right-of-way area and
request that a utility easement be maintained so they have
access to their pole. The exact location of the pole is not
known so NSP suggests the existing street easement be maintained
as a utility easement (letter attached).

Type of Application: Variance (Rear and Sideyard)
Project Description: A three ft. variance to the five ft. rear and sideyard
setback requirements (two ft. is proposed).
Discussion:
The application is to construct a new garage on the present location of an
existing garage. The present garage has a two ft. sideyard and rear setback.
The new garage would have the same side and rear setbacks. The new garage,
however, will be four ft. wider. The reason for the two ft. variance would be
to line up the garage with the present concrete driveway.
The reason for the five ft. rear and sideyard setback is to properly drain the
water from the roof of the garage. The two ft. setback with a larger garage
may cause more run-off from the garage and may create problems for the
neighbor whose property is at lower elevation. A three foot setback is
required for fire separation without special construction.
The property is quite small (5,100 sq. feet). Therefore, to move the garage
West would limit the open space in the backyard.
RECOMMENDATION:
Approve the variance request with a three ft. side and two ft. rearyard
setback with the following conditions.
1. No run-off from the garage roof shall go on neighbors property.
2. The garage shall be located three feet from side and rear property
lines with maximum one foot overhang.
3. The garage shall be constructed with required fire protection for the
rear wall.
PLANNING COMMISSION ACTION:
Recommended approval with the above three conditions.

Pursuant to discussions with Mike McGuire the following changes to the
dock permits are proposed:
General Boating Dock Permit -
Change condition #1 to read as follows (now two conditions):
1. The dock shall be temporarily located approxi-
mately 300 feet south of East Nelson Street.
However permittee shall immediately undertake to
move this dock to the present location of the
Charter and Excursion Dock. The dock relocation
shall be completed no later than October 15,
1988.
2. The permittee shall in all ways abide by the
rules and regulations of the Corps of Engineer of
the United State Army, and the Minnesota
Department of Natural Resources and the terms and
conditions of this permit and of the permits
issued by the United States Army and the
Minnesota Department of Natural Resources.
Renumber all subsequent conditions accordingly.

Council hereby grants to the Stillwater Dock Company a General Boating Dock
Permit upon the following terms and conditions:
1. The dock shall be located approximately 300 feet south of East Nelson
Street and in all ways abide by the rules and regulations of the
Corps of Engineers of the United States Army and the Minnesota
Department of Natural Resources.
2. No gas pumps shall be located on the docks.
3. The dock company shall not discriminate against any patron on the
basis of race, creed, national origin, sex or social status.

4. The permittee agrees to abide by all rules and regulations and
restrictions set forth in Chapter 48.06 of the Stillwater City Code

relative to the regulation of the waterfront.
5. The dock company shall submit to the City a schedule of fees charged

by the permittee and any lease agreements or other documents
evidencing leasehold interests or rights of possession in the docks
or the landing area.
6. The permittee shall provide the City of Stillwater with a certificate
of Insurance evidencing One MillionjThree Million General Liability
Coverage on their operation, naming the City as an additional insured
under the policies as their interest may appear.
7. The permittee shall provide pump-out privileges for marine heads for
any boater requesting this privilege at the same rate and fee charged
to boats that are moored at the dock for a fee.
8.
The City of Stillwater reserves the right to request inspection of

heads, electrical system or other unsafe conditions.

9. The duration of this permit shall be from May 1, 1988 and expire on
October 15, 1988.
10. This permit must be renewed annually and the City reserves th~ right
from time to time to establish, change or modify the dock permit fee.
The dock permit fee for the time period specified in No. 9 above
shall be $250.00.
11. The City reserves the right to request the dock company's assistance
in assuring that patrons and guests of patrons of the dock company
will park in a designated municipal parking lot so as to not
unreasonably interfere with other park and commercial traffic.
12. No person shall build a fire in any area on the docking premises or

in any vessel moored at the dock.
13. The City does not, by this permit, accept any responsibility for
dredging the dock area or making the docking area free from
obstructions or other hazards to navigations.
14. The City is in no way responsible for storage of the docks during the
off season and the permittee agrees to abide by any decision of the
Port Authority or City Council with regard to a place for their
proper storage.
15. No vessel shall be allowed to moor or tie-up to the dock for more
than twenty-four (24) continuous hours.
16. The permittee agrees to cooperate with the City and use its best
efforts to obtain needed permission from any governmental body that
has lawful jurisdiction over the activities described herein.
17. The City reserves the right from time to time to add to or amend the
rules and regulations herein set forth as are from time to time

Due to the breakdown of a compressor or pump that caused sewer
water to back-up into our basement on April 6, 1988 I am
submitting the following bill to the City of Stillwater.
All replacement values are based on a 1986 Sears Catalogue,
therefore I feel the estimated replacement value is a fair one.
It is not my intention to ask the city for anything other than
what I feel is appropriate. There were many other items damaged
but not destroyed and I will not claim them.
I do not feel the following items could be sanitized, therefore;
they will need replacing.

I agree with that question. We paid $1750 for a new street
and si dewal k.
With that amount of money laid out I expect a job
well done. (We had to borrow the money or pay interest by a
certain date, yet as of 4-17-88 ,the work is not done yet.) (Maybe
the contracting company should be paying us the interest for
using our money until the job is completed.) All of the things I
wrote td you about last fall ,are still the same.

level into the ground, stakes left in yards and the sidewall from
our front steps still sticking out onto the sidewalk, (REMEMBER

Since starting this letter, the crack in the sidewalk has
expanded enough that part of the sidewall has come off!
I am sending along 35 pictures that may show some of what
this letter concerns. I would like them returned and would like
a written answer to our questions and about the sidewall. The
last page of pictures shows how khe snow from Martha street was
dumped onto our sidewalk. Yes under all of that snow was a

permit the City of Stillwater recently applied for. It is my
understanding the township will not issue the grading permit until
this review is completed. It is the township's policy to have the
applicant.pay for any expenses, incurred by the township. From the

do not want to direct the town engineer to begin his review until we

We have received prints of the plans for the proposed Woodland Lakes
Stormwater Drainage from Dennis O'Donnel I, Washington 'County Planner. This
stormwater runoff is designed to drain through Stillwater Township by open
channel flow to Long Lake and then outlets into Brown's Creek to the St.
Croix River.
Fol lowing Is our proposal to prepare a review of this project on behal f of
Stillwater Township. It Is our understanding that this authorization wll I
be acted on by the Town Board and then submitted by the Township to Dennis
O'Donnel I for approval and reimbursement by the City of StIllwater.
Tasks
1. Review EAW, permit requirements and hydrologIc computatIons
2. Determine detentIon time in holding ponds.
3. Review discharge rates and volume
4. Determine Impact on smal I pond and Long Lake.

Please find enclosed full and final payment of the principle
and interest due on the pre-franchising expenses to the City
of Stillwater. The amount, $2,299.05, does not include the
$1,100.00 the City so generously forgave as a contribution
for the channel 12, government access, production equipment.
The Commission extends its most sincere gratitude for the
City of Stillwater's patience during the payback period and its
thanks for the City's part in obtaining a better government
access production equipment.
The production equipment is in place, a few accessories must
be purchased yet, however, the production values of City Council
meetings have already improved significantly. Working together
produces these kinds of results. Thank you for recognizing that.
The Commission Chairperson, Michael Knutson, is dedicated to open
government in the Valley. It is his influence, that brought this
project to fruition, but, he could not have accomplished it with

BY ALL OF THE PROPERTY OWNERS
FOR THE CONCURRENT DETACHMENT
AND ANNEXATION OF CERTAIN LAND
PURSUANT TO MINNESOTA STATUTES
SECTION 414.061, SUBDIVISION 5
OBJECTIONS BY
CITY OF OAK PARK HEIGHTS
The City of Oak Park Heights her~by formally declares
its objection to the Petition of Washington County to defach from
Oak Park Heights and annex to Stillwater that land described in
. Exhibit A of said Petition. The City of Oak Park Heights bases
its objections on the following factors:
1. The detachment/annexation is unnecessary as
the present Washington County Government Center
has more than adequate capacity to serve the
needs of the County. Any expansion of the
Government Center would be unnecessary.
2. In the event that the Washington County Government
Center does need to expand in size, land is
?lvailable located wholly within the corporate
limits of the City of Stillwater, upon which to
build such additional facilities.
3. Minnesota Statutes do not require additions
to the Courthouse to be wholly situated within
the city limits of the county seat. Accordingly,
the Washington County Government Center addition
could be built on the land in question without
having it be detached from Oak Park Heights and
annexed by Stillwater.

4. The City of Oak Park Heights services the land in
question with municipal sewer, water and storm
water facilities. Such service also includes
new streets and curbs. Should the annexation be
allowed, the City's ability to control, collect
fees for use and maintain said facilities will
be impaired.
These improvements were completed after the
expenditure of substantial sums of money by the
citizens of Oak Park Heights. These expenditures
were approved with the express understanding that
the improvements would service residents of the
City of Oak Park Heights within the boundaries of
the City of Oak Park Heights. To grant the
Petition would mean that the residents of Oak
Park Heights will be the unwilling donors of the
substantial improvements they paid for, for the
use of themselves and their fellow citizens.

5. That said Petition was initiated so that the City
of Stillwater could 'take advantage of the
substantial improvements already made by the City
of Oak Park Heights.
6. If the Petition is approved and the City of
Stillwater is allowed to use the substantial
improvements paid for by the City of Oak Park
Heights, the City of Oak Park Heights will then
face a continuing obligation to serve the City
of Stillwater with water and sewage services.
7. Residents of the City of Oak Park Heights who live
completely around the area in question will have
no avenue to seek redress from their government for
the area that they are supporting through their tax
dollars. These residents of Oak Park Heights will
be spending tax dollars to provide services to the
City of Stillwater and yet they will be unable to
approach the government of the City of Stillwater
for redress because they are not citizens of
of Stillwater. Also, they will not be able to seek
redress from the City of Oak Park Heights because
the land in question will not be within the
jurisdictional limits of the City of Oak Park
Heights.

8. The Petition of Washington County is incorrect
and misleading in paragraph 5 thereof, in which
it states that the City of Oak Park Heights has
consented to this detachment and annexation
proceeding.

The City of Oak Park Heights respectfully objects to the
Petition of Washington County for the detachment and annexation
of certain land situated in the City of Oak Park Heights to the
City of Stillwater.

As requested, please find the neccessary information..~
1) Temporary structure/signage for a Spring petting zoo at River Heights Plaza.
Date: May 14, 1988
Use: Enclosure for a childrens petting zoo.
Design: A 80' by 30' fence approx. '4' high. This will be constructed
by using snow fence and light plywood to give the concept of a farm.
..
This event will be run for one day between the hours of 12:00-4:00p.m.. There
will be no charge to the public- various animals will be displayed by their
owners for the public to view.
A temporary sign stating the dates and times and event would be posted to
the structure.
The structure would be located on the grasssy area facing the frontage road.
2) A yellow and black unlit sign displaying a craft show to be held at River
Heights Plaza showing the dates and times of the event. This would be
rented from a sign rental company.
Dates for the craft show are June 4, 1988. This would be displayed on the
grassy area facing the Highway36~
If you have any questions or would like to have me bring this up formally
at the next City Council meeting, Please advise me.

The brothers of Stillwater Lodge # 179 wish to thank
you and the city of Stillwater for letting our order use
the Lily Lake tennis courts to sell Christmas trees to
raise money for our many Youth projects.
Again,we would like to use this area to sell more

trees this coming November and December.
Last year we were able to sell enough trees to finance
several different Youth projects and had about 20 trees
left over to give to poor families in town.
Our Brother Bernard Peltier will again be in charge
of this years efforts and will be in contact with the
Parks and Recreation department to work with them in this
years sale.
The Benevolent and Protective Order of ELKS are
dedicated to Charity, and with your help we can make
some more children smile this Christmas.

Dear Mayor,
Perhaps the City does not believe that "sewage runs down hill"
it does --- right down Fourth Avenue South.
indeed
There are three homes in the block south of here, where in the winter
a covering of snow usually conceals tije glaciers formed by septic runoff.,
There is a pungent aroma on hot summer evenings when strolling by the homes.
In the spring the glaciers contribute to the "spring run-off" --- right down
the gutter of Fourth Avenue! That is NOT sanitary!
You are neglecting the'~rea of Stillwater that needs sanitary sewers the
most! For in addition to septic systems, many with NO drain fields, there
also are private wells in this-m::ea'.-
What does the Stillwater City Health Officer have to say about private wells
and mis-functioning septic systems in our city? Has he ever checked any wells
or septic systems? Or, isn't there such a thing as an active>\City Health
Officer for Stillwater? There are 7 dwellings that I know of, within 200 to
300 yards of us, that rely on their well-water for safe drinking, yet on
impervious rock the surface water will find well openings.
When the previous mayor was in office, I wrote him a letter asking why
Stillwater hadn't applied for federal grants to upgrade septic systems in the
areas of Dutch Town and the Quarry Area, when Marine, Lake Elmo, etc. did.
I received no reply.
It was with complete surprise and utter dismay, that when I arrived home a~
9 P.M. on Tuesday evening, April 19th, and flipped on the T.V. Public Access
channel, I found that the Stillwater City Council had the city's Engineer
working on a project that intentionally neglected ~ area.0 The prGject was
for sewer service for 5th, 4th, 3rdAvenues, and Hillcrest Drive, but ONLY
from Burlington Street to Orleans Street..
There has been no Notice that the City was paying tax money for an engineer-
ing study, and nothing on this. project has been in the Gazette's reporting of
that council meeting. If I had not listened to the T.V..until 10:50 P.M.
I would not have been aware of this.
Yet it was less than a year ago that I appeared before this council when
the subject of vacating of 3rd Avenue (North of Dubuque st.) came up at a
public hearing. I stated that 3rd Avenue was needed for a sanitary sewer line.o
I:a1so stated that I wanted sewer service, as I was having problems with a
spring running into my "dry-well".
We have a septic tank and a so-called "dry-well", the bottom of which is
nine feet below the ground. It has a "spring" running into it, as water is
following the rock right down the hill_into it.

The structure at 935 5th Avenue was built at the ~ of that lot, near the
crest of the bluff. AI~ apartment was added illegally on the south end of
it in 1953 or1954 by wtlly Handevidt. In addition to 2 septic systems in the
front yard, there is alnew replacement drain-field ( 2 years old) at the rear
of that property, near I our joint rear property line. As a result,when I mow
our lawn, I have to gotover our back yard with the mower at least twice, the
grass there gets so mu h "fertilizer" and moisture that drains from the
foregoing.
Our house is built nto solid rock, as is our garage. Wayne Stephenson
once told me that wnenlthey blasted Jim Thomsen's dry-well at 1005 5th Avenue,
in about 1950, that water started flowing into the rear of what is now our
garage (ours since 195~).

-well anyway, as it would just fill with these "spring-

!~ I heard the City's ngineer state the night of April 19th, that sewer
systems had been studi d for this area in 1910, and that the residents had all
objected. They did no object to sanitary sewers! What they all objected to
was the fact that th~ineer at that\ time, had blown a simple request into:

The History of the imple request: Our neighbor to the North-East, Mary
Glennon, of 933 4th Av nue, started out by asking for one simple thing, to have
4th Avenue black-toppe for the 66 feet in front ofner property, starting at
our North property-lin , where the 1951 paving ended.. The preceding paragraph
states how'far afield {hat Engineer got. More work, more fee?
It might interest y u to know, that in 1912 when the Swaggers built 2 homes
directly north of us, he water lines were quickly dug for about 300 feet down
the boulevard, on our ide of the street, using only a relatively small

information on the typ of sub-soil enconntered.

To whom it may concern:
I was recently contacted by City officials informing me that
there have been complaints concerning the appearance of my
~usiness property.
I will admit that there is somewhat more clutter on the property
now than there has been in the past. This is a temporary situ-
ation due to the loss of rented storage facilities. I expect
new facilities to be available shortly.
However, it seems most of the complaints center on the empty
lot (belonging to the City) across the street from my property.
This 'lot is very often assumed to belong to me and so complaints
are directed at me.
.
My employees park in this lot during work hours, rather than
have their cars on the street. If this a problem, I can instruct
them to park at the curb. The trailer I have parked in the lot
will go to the storage building as soon as it's available.
I feel I can hardly be held responsible for others who leave
their vehicles parked there overnight or for extended periods.
I-suggest they be tagged and towed, if in violation.
I feel my property is greatly improved under my ownership and is
a benefit to the community in its service and appearance, as well
as -its tax contribution.

I have often approached city officials on the prospect of acquiring
the empty lot as a mutual benefit. If I could acquire that prop-
erty and improve it, it would serve to increase tax contibutions,
r,educe city maintenance, eliminate parking and traffic problems,
and improve the appearance of both lots. Perhaps we could discuss
this possibility again.
In the meantime, I hope you will be patient with my temporary
storage problems. I will do my best to keep a neat appearapce
at my shop and to discourage others from misuse of the city's lot.

WHEREAS: Preservation may be recognized through cultural events, our heritage,
historic sites and historic buildings;
WHEREAS: The greatness of America is founded upon appreciation of our heritage
and upon knowledge of the historic events and places that have shaped
our national~ state and local identity;
WHEREAS: Historic landmarks contribute to the economic, social and cultural
well-being of our cities, towns and rural areas;
WHEREAS: National Historic Preservation Week 1988 provides a splendid
opportunity for the citizens of Stillwater to take the time to
explore the wonderful historic 'resources that the City of Stillwater

BOARD MEETING MINUTES
APRIL 4, 1988
The regular meeting of the Board of Trustees of the Stillwater Public
Library was held on Monday, April 4, 1988 at 6:30 P.M. Vice-President
Susan Doe presided.
Present: F. Kalinoff, V. Childs, J. Cass, G. Schmidt, S. Doe, J. Morse,
L. Welshons. Also present: L. Bertalmio.
The minutes of the March 8, 1988 meeting were approved as read.
Committee Reports
1. Administration Committee - The committee will meet on April 6 to
consider Union negotiations.
2. Computer Committee - Committee presented an explanation of our
needs for a microcomputer and received additional input from the Board.
3. Special Projects Committee -
(a). Plans were finalized for celebration of National Library Week
on Thursday, April 21.
(b). A report was presented on the March 28th Joint Board Meeting.
Bills in the amount of $7,724.20 were approved for payment.
Building Project
Lynne Bertalmio presented a draft of a letter to Olsen Construction
Company requesting a conclusi9n to the Building Project. The letter
will be revised, expanded, and sent.
Old Business
1. The 1988 Board Calendar was approved as presented.
2. The staff is in the process of preparing recommendations for
informational video purchases.
3. The Book Review Column sponsorship was discussed. It was moved
that we review the possibility of sponsorship at the June Board
meeting.
4. Article III, Section 4 of the By-Laws was amended to read:
When any Trustee fails to attend at least three consecutive
meetings of the Board without prior notice to the President or
Vice-President, the Board shall declare his/her position vacant.
It sha 11 be the duty of the presi dent to notify the appoi nti ng
official of the vacancy and, by direction of the Board, suggest
more than one name to the appointing official of persons who
may qualify to fill the position.

New Business
1. The Alternative Funding Review process was discussed. The Finance
Committee will review this and give recommendation to the board.
2. Long-Range Planning - A Staff planning meeting on this will be
held on April 12. The full Board will meet on this issue two
Saturdays in June from 9:00 a.m. until 12:00 noon.
3. A review of the landscaping was referred to the Building & Grounds
Committee.
4. The Retirement Party for Jean Simonet and Chuck Hoffman will be
held on Wednesday, May 11 from 5:30-6:30 P.M. at the Dock Cafe.
Librarian's Report
An update on the theft-detection equipment was presented.
The SPL committed to supporting the Uganda Public Library Project.
The Spring Book Talk will be held at SPL on April 5 and repeated
at Park Grove on April 17.
A tea was held at SPL in March to honor Vera Maunsell.
The meeting was adjourned at 9:05 P.M.

OLD BUSINESS
. The Board reveiwed a letter written by Roberta Opheim in response to
Robert Zoller. Discussion followed regarding possible locations and
design of picnic shelters.

PLAYGROUND EQUIPMENT
Dick Blekum reported that $5000 is available to purchase playground
equipment for Lily Lake. He recommended the purchase of a Gametime
set at a cost of $3998, and suggested that the remaining funds be used
to purchase a swing set or soft fill at the playground site.

Bob Bielenberg reported that Spring League started tonight, April 13,
and will continue through May 1.
NEW BUSINESS
Linda 'Kluy informed the Board of her resignation because she will be
moving out of Stillwater. Robert Opheim made a motion to accept Linda
Kluy's resignation; seconded by Tom Lammers. All in favor.
Discussion followed regarding possible replacements.
Dick Blekum reported that $6000 will be available for a fence at the
Croixwood Ballfield. The ballfield will be fenced on both sides, and
the project will proceed as soon as the money becomes available.

Park and Recreation Board Meeting
April 13, 1988
Bob Bielenberg presented three weekly schedules to the Board, in order
to demonstrate his need for only part-time employees at the Arena.
The sample schedules indicated a saving of 18 hours per week with
part-time help. The Board determined that this is a personnel issue
and should be brought before the City Coordinator and Departmental
Directors.
Bob Bielenberg reported that the Lily Lake Beach will open in early
June, contingent on staff schedules. Dick Blekum stated that the
procedure this year will be to have one lifeguard in the boat at all
times.
The next meeting of the Park and Recreation Board will be
May 11, 1988 at 6:00 p.m. (please note time cbange). The
meet in the Parks Building to discuss any agenda items,
depart for a tour of Stillwater parks.
