CITY HALL: 216 NORTH FOURTH STILLWATER, MINNESOTA 55082 PHONE: 612-439-6121 ~ . r illwater '~ ~ ~ -~ THE BIRTHPLACE OF MINNESOTA J TO: FR: DA: RE: Mayor and City Council City Coordinator April 20, 1988 DOCK & WHARFAGE PERMITS Attached to this memo are the following permits recently approved by the Stillwater Port Authority: 1. 1988 Wharfage Permit for Taylor Falls Scenic Boat'Tours (Taylor Falls Princess); 2. 1988 General Boating Dock Permit (transient boats) for Stillwater Dock Comp any; an d 3. 1988 Charter/Excursion Boat Dock' Permit (Andiamo) for Stillwater Dock . Company. The Wharfage Permit for the Taylor Falls' Princess is the same ,as was issued by the City last year and the boat will load/unload passengers north of the Interstate Bridge just south of the Gazebo. The General Boating Dock Permit is also the same as last year. However, the Charter/Excursion Dock Permit has been changed pursuant to discussion that took place between the Port Authority, Stillwater Dock Company, Andiamo and Michael McGuire. The substantive changes are as follows: 1. Added new provisions to require landscaping, sodding, gravel walkway and spl'it rail fence on area west of Dock Cafe parking lot; the construction of a service drive and parking area (as shown on Exhibit "A") to accommodate vendors and employees; and to construct a walkway from the parking lot to the service area at their expense. The permit also requires the City to remove parking meters (about two (2) meters) and to allow driveway cut in parking lot to provide access to the service area. 2. Revise permit fee from $250 to $750. These are the permits and conditions approved and recommended by the Port Authority. NONEXCLUSIVE WHARFAGE PERMIT THIS PERMIT is issued this 1st day of May 1988 by the City of Stillwater, a Minnesota Municipal Corporation, to Muller Boat Company of Taylor Falls, Permittee, on the following terms and conditions: 1. Description of Mooring Site. A Nonexclusive Wharfage Permit to load and unload passengers at that part of Lowell Park east of the Levee Road to the St. Croix River and from a point described as follows: From north of the Interstate Bridge to approximately 30' south of Myrtle Street 2. Term. This permit shall commence May 1, 1988 and continue for and during the full term of the 1988 boating season and shall expire thereafter or on November 1, 1988. 3. Cancellation. The City shall have the right to cancel this Wharfage Permit at any time after thirty days written notice cancellation given to any of the officers of the'Permittee. cancellation is other than for cause, pro rata wharfage fees refunded based upon a seven month term from May 5, 1988. of Where shall be . 4. Fee. Prior to the permit taking effect, the Permittee shall pay ~the City Clerk a permit fee of $250. 5. Utilities. Permittee shall be solely responsible for its own utility charges, including electricity, water, gas and garbage collection. 6. Nonexclusive. Permittee shall use the premises described in common with the public and other boat users and the wharfage fee herein paid shall not grant any special use or favor to the Permittee except as set forth in this permit. 7. As Is. The City makes nn warranty relative to the premises and the Permittee takes the same lias is" and assumes all risks incidental thereto. 8. Hold Harmless and Indemnity. Permittee shall indemnify and hold harmless the City from any and all claims or causes of action or damage arising out of the Permittee's use of the premises. . 9. Insurance. Permittee shall provide a certificate signed by a duly authorized officer of a company authorized to write insurance in the State of Minnesota, that a Protection and Indemnify Liability Insurance Policy has been issued and is in full force and effect with $500,000/$1,000,000 policy limits. The City shall be named as an additional insured and the policy shall provide that the City be given notice in the event of its cancellation. 10. Damage. The party of the second part shall direct and cause all vehicles carrying passeng rs to or from the boat for which this permit is issued to depart the Lowell Park area immediately upon discharging passengers and t arrive at the levee road pickup area no earlier than thirty (30) minutes prior to the estimated time of arrival of the boat for whi h this permit is issued. ~ 14. Additional Requi ements. The City reserves the right to impose additional restrictions upon the Permittee, after notice and a hearing, if they deem it necessary, to protect the health, safety or welfare of the i habitants of the City. Pursuant to Chapter 48.06 of the Stillwater City Code, the Stillwater City Council hereby grants to the Stillwater Dock Company a Charter and Excursion Dock Permit upon the following terms and conditions: 1. The dock shall be located approximately 100 feet south of East Nelson Street and in all ways abide by the rules and regulations of the Corps of Engineers of the United States Army and the Minnesota Department of Natural Resources. 2. No gas pumps shall be located on the docks. 3. The dock company shall not discriminate against any patron on the basis of race, creed, national origin, sex or social status. 4. The permittee agrees to abide by all rules and regulations and restrictions set forth in Chapter 48.06 of the Stillwater City Code relative to the regulation of the waterfront. 5. The dock company shall submit a schedule of fees charged by the permittee upon request of the City. 6. The permittee shall provide the City of Stillwater with a certificate of Insurance evidencing One Million[Three Million General Liability Coverage on their operation, naming the City as an additional insured under the policies as their interest may appear. 7. The permittee shall provide pump-out privileges for marine heads for any boater requesting this privilege at the same rate and fee charged to boats that are moored at the dock for a fee. 8. The City of Stillwater reserves the right to request inspection of heads, electrical system or other unsafe conditions. . 9. The duration of t the first regular permit shall be from May 1, 1988 and expire at of the Stillwater City Council that occurs 10. No person shall build a fire in any area on the docking premises or in any vessel mo red at the dock. 13. The City does no , by this permit, accept any responsibility for dredging the doc area or making the docking area free from obstructions or ther hazards to navigations. 14. The City is in n way responsible for storage of the docks during the off season and t e permittee agrees to abide by any decision of the Port Authority 0 City Council with regard to a place for their proper storage. 15. Permittee shall their Lessee to: a. Complete lan scaping, including the placement of sod, split rail fence and gr vel walkway on that area west of the blacktop parki ng area b. The City hereby authorizes the removal of the parking meters shown to be displaced on Exhibit "A". 17. The Permittee and its Lessee shall be responsible for securing permission as it may be necessary, to construct and use the walkway across the railroad tract that is shown on Exhibit "A". 18. Permittee acknowledges that the City is not responsible for any expenses incurred because of the improvements required by this Permit and that Permittee receives nor expects to gain any future rights of possession in the property. 19. The City reserves the right from time to time to add to or amend the rules and regulations herein set forth as are from time to time needed to protect the health, safety and welfare of the City. If dredged or excavated material is placed on an upland disposal site (above the ordinary high watermark), the site must be securely diked or contained by some other acceptable method that prevents the return of potentially polluting materials to the watercourse by surface runoff or by leaching. The containment area, whether bulkhead or upland disposal site, must be fully completed prior to placement of any fill material. 2. Upon completion of earthwork operations all exposed slopes, fills and disturbed ~reas must be given sufficient protection by appropriate means such as landscaping, or planting and maintaining vegetative cover to prevent subsequent erosion. 3. Riprap, if authorized under this permit, must be clean, properly graded and nonpolluting. In addition, rock and fill material used for activities dependent upon this permit and obtained by excavation must either be obtained from existing quarries or the source borrow site must be identified and approved by the District Engineer. . 4. A contingency plan must be formulated which would be effective in the event of a spill. This requirement is particularly applicable in opera- tions involving the handling of petroleum products. If a spill of any po- tential pollutant should occur, it is the responsibility of the applicant to remove such material, to minimize any contamination resulting from this spill, and to immediately notify the U.S. Coast Guard at telephone number 800-424-8802, and the Minnesota Pollution Control Agency at (612) 296-7373. . ~ d. In order for that change in location to occu~, it would be necessary to amend the federal and state permits that have been issued for the existing docks. The Minnesota DNR permit for the structure was authorized Aug. 28, 1985 as an amendment to permit #82-6124. For information about amending that permit, you should contact Kent Lokkesmoe at 296-7523. It should be noted that that permit was issued to the City of Stillwater, not Stillwater Dock Company. It is also worth noting that the state permit amendment (copy enclosed) requires that all excursion boats using the dock be properly licensed. Enclosed is a Coast Guard list of craft that are currently authorized to carry passengers in this area. Vessels that are not properly licensed to carry passengers for hire should not be allowed to use these docks, or the city might share in liability risk. You may want to discuss this with the city attorney. The Corps of Engineers permit was issued May 9, 1985, and was issued to Stillwater Dock Company. For information about amending that permit, the correct contact is Henrik Strandskov at 725-7775. It might be wise, while submitting amended applications to the two agencies, to make sure both permits are issued to the same organization. Enclosed please find a revised copy of the LMC Housing Reservation Form for the annual conference in st. Paul, June 7-10. Please note that you must mail the form directly to the hotel at which you prefer to obtain accommodations, along with either a credit card authoriza- tion for billing or a deposit by check for one night's lodging. If you have already made hotel reservations, please note that there is a change from previous arrangements. The st. Paul Radisson Hotel is the headquarters hotel for the conference program, but ther,e will be no Housing Bureau acting as a clearinghouse for both the st. Paul Hotel and the Radisson. Rather, city officials who prefer to stay at the Radisson will send their reservations directly to that facility. Those wishing to have reservations at the st. Paul Hotel must mail reservation forms to the st. Paul Hotel itself. If you previously indicated that your first choice for overnight accommodations for the conference was the st. Paul Hotel, and you have already received confirmation that you have accommodations at the st. Members Absent: Carol Paukert and Dean Funke Also Present: Mayor Wally Abrahamson, City Coordinator Nile Kriesel, and City Attorney David Magnuson. Chairman Bob Thompson called the meeting to order at 3:00 p.m. OLD BUSINESS The Commission discussed the Burlington Northern property. Nile Kriesel reported that the City is still awaiting further communication from BN. He also reported that the Stillwater Yacht Club's lease of property with BN was recently.increased to $7000 per year. Nile Kriesel gave an update on the levee improvements. The Corps of Engineers has indicated that there will be no financial aid available to the City for this project. Members of Congressman Sikorski's staff were at City Hall today and a request was made through them for the Congressman's assistance in seeking financial support for the improvements. Mr. Kriesel requested that the Port Authority draft a statement establishing the Role and Function of the Port Authority and communicate with the City Council in this regard. Barrett Colombo suggested that this item be continued to another meeting. WHARFAGE PERMIT APPLICATIONS Renewal of permit for Taylors Falls Princess - The Commission discussed the fee and mooring site for the Taylors Falls Princess. City Attorney Magnuson suggested that the mooring site be described on the permit as South of Mulberry Point and North of the Gazebo. Motion by Jim O'Brien, seconded by Barrett Colombo to renew the wharfage permit for the Taylors Falls Princess at $250. All in favor. Renewal of permit for Stillwater Dock Company - John Easton of Stillwater Dock Company, Mike Maguire of the Dock Cafe, and Don Anderson and Dick Anderson of the Andiamo were present to comment and answer questions from the Commission. All in favor; OLD BUSINESS Discussion of the Lowell Park Levee. Nile Kriesel reported that he has had no comments from Congressman Sikorski's office since his aid's visit last month. During that visit, the City asked for the Congressman's assistance in seeking financial aid for the levee repair. Mr. Kriesel also reported that according to the City's consulting engineers, there i.O immediate safety hazard regarding the levee. Discussion followed r rding use of TIF money, and the possibility of making the ~evee inaccessible until repairs'are made. ' Discussion of Burlington Northern property. Nile Kriesel reported that he wrote another letter to BN on March 31 asking for a response. STILLWATER DOCK CO. PERMIT APPLICATION John Easton, Mike McGuire, and Dick and Don Anderson were present and reported on the results of their meeting. Two separate plans have been developed and were presented to the Commission. Mike McGuire's plan calls for switching the locations of the Andiamo docks and the public docks. The Andersons' plan calls for use of signage, a fence and a gate to direct the flow of traffic and pedestrians. The Andersons also stated that this is a temporary solution, while they continue to look for a more ideal docking site. The Commission determined that the issue is a business problem, and should not be resolved by the City. Motion by Barrett Colombo, seconded by Jim O'Brien to renew the permit for stillwater Dock Company. All in favor. Discussion followed regarding fees for the permits. Last year the permits were $250 for the Charter Excursion dock and $250 for General Boating Dock for a total of $500. Motion by Dean Funke, seconded by ~ett Colombo to raise the fee to $1000, charging $750 for the Charter ~urslon dock, and $250 for General Boating Dock. All in favor.
