This memo is a reminder to Council that a Special Meeting has been scheduled
for Tuesday evening, November 9, 1993 at 7:00 P.M. in the Stillwater City Hall
Council Chambers, 216 No. Fourth St., Stillwater, Minnesota to discuss the
following:
1. This is the day and time for the public improvement hearing on the Myrtle
Street Ravine Drainage Project, L.I. 284.
Notice of the hearing was published in the Stillwater Gazette on
October 22 and 29, 1993 and mailed to affected property owners.
2. Any other business Council may wish to discuss.

SUBJECT: REQUEST TO HANG BANNER IN DOWNTOWN FOR NATIONAL
EDUCATION WEEK.
Marty Rossini called me this morning requesting to place a banner in downtown to advertise
National Education Week. I suggested that the Chestnut & Union Streets location be used
since it is too late to request approval from Mn/DOT for the Main St. locations and he
agreed.
Council approval is requested for this banner.

Staff reports were discussed prior to the regular. meeting.
Regular meeting called to order at 7:05 p.m. by Mayor O'Neal.
Present: Schaaf, Kern, Seggelke, Doerr, Vierling, Swanson,
Benson, Stockman and Wilson.
Clerk read public hearing notice, presented affidavit of
publication and mailing list for rezoning request submitted by
Daniel Wortman. Mayor called for comments and discussion ensued.
Schaaf, seconded by Kern, moved to continue hearing in two weeks.
5 aye votes. Carried.
Doerr, seconded by Seggelke, moved to schedule a public hearing
Monday, November 22nd at 7:00 p.m. for a Conditional Use Permit
and /or Commercial Planned Unit Development Zoning on the above
request. 5 aye votes. Carried.
Clerk read public hearing notice, presented affidavit of
publication and mailing list for a garage variance submitted by
• Michael O'Reilly. Mayor called for comments and discussion
ensued. Schaaf, seconded by Seggelke, moved to close hearing. 5
aye votes. Hearing closed.
Schaaf, seconded by Kern, moved to approve above request due to
the lack of facilities to store vehicle on the property. 5 aye
votes. Carried.
Cover Park Manor public hearing opened and Mayor O'Neal called
for comments. Discussion ensued. Seggelke, seconded by Schaaf,
moved to amend the Conditional Use Permit

Paul Weiler, St. Croix Valley Youth Service Bureau, presented a
Certificate of Appreciation to the Mayor and Councilmembers.
Schaaf, seconded by Seggelke, moved to direct City Attorney to
execute a Quit Claim Deed for parcel #2075 on the Mark DeWolf
property. 5 aye votes. Carried.
Seggelke, seconded by Kern, moved to approve United Stores sign
request as presented. 5 aye votes. Carried.
Schaaf, seconded by Doerr, moved to award low bid of $10,033.50
to E. H. Renner & Sons, Inc. for Well Pump No. 2 Repair Project
with funds to be expended from the Water Fund. 5 aye votes.

Park Commission will meet at 6 :30 Monday, November 15, 1993 at
City Hall. One more resident is needed to sit on the Commission.
Kern, seconded by Doerr, moved to authorize Police Chief, Lindy
Swanson, to assign Investigator to the St. Paul Police Department
for a four week training period. 5 aye votes. Carried.
Seggelke, seconded by Kern, moved to direct staff to convey
letter from City Attorney to property owners relating to the
drainage pipe problem. Aye votes cast by Kern, Seggelke, Doerr
and Schaaf, Abstain :ay Mayor O'Neal. Carried.
Seggelke, seconded by Schaaf, moved to adopt Resolution #93 -11 -42
approving a joint resolution between the City of Oak Park Heights
and the City of Bayport for the concurrent detachment and
annexation of incorporated land pursuant to Minnesota Statute
414.061. Roll calL taken with 5 aye votes cast. Resolution
adopted.
Kern, seconded by Schaaf, moved to approve minutes of October
12th and. 25th. Aye votes cast by Kern, Schaaf, Doerr and O'Neal.
Abstain by Seggelke. Carried.
Seggelke, seconded by Kern, moved to approve Change Order #1 for
58th Street /Stillwate,r High School Utility & Street Improvements
contingent on City Auditors review and cost analysis as to where
the funds are coming Erom, 5 aye votes. Carried.
Seggelke, seconded by Kern, moved to approve the following budget
adjustments:
Increase Customer Collections by $13,800 to $98,800
Decrease Interest on Investments by $12,000 to $23,000
Decrease Building Permits by $1,800 to $93,200

Dear Col. Scott:
This is a request from the City of Stillwater, Minnesota to the St. Paul District to allow the City
of Stillwater and their City Engineering firm, Short Elliott Hendrickson (SEH), to perform the
final design and prepare the final plans and specifications for the emergency river wall and
abutment construction. It is my understanding that this project has recently been authorized by
Congress through the Corps of Engineers. The City of Stillwater is very concerned about
expediting the design and construction to prevent further deterioration or failure of the existing
abutments and walls. We feel that since SEH has previously performed the wall inspection and
the preliminary design of the rehabilitation, that they are best suited to complete the final design.
This would expedite the project at the lowest possible cost to the City of Stillwater as well as the
Corps of Engineers.
SEH has assured the City that they will perform the final design this winter and meet all of the
engineering criteria and standards of the St. Paul District. The following are reasons to justify
our proposal and use of SEH in the final design.

1. Previous specific knowledge of the project through development of the original
project inspection report by SEH in December, 1987 and updated in October, 1991.
2. Knowledge of the foundation, walls, past erosion and deterioration through
preparation and construction of the downtown improvements in 1991 and 1992.
3. Extensive knowledge and experience in the community, associated utilities, other
City features, community desires and future development plans; SEH has
provided continuous service to the City over the past 36 years.
4. SEH recently assisted in the design and construction of the downtown area which
abuts this project. This included streets, sanitary and storm sewers, water
distribution and parking facilities.
5. SEH experience on similar flood control projects with the St. Paul District in the

6. Past experience in working with the Engineering Division in the St. Paul District
will simplify engineering management, quality, control and cost effective of the
final design.
7. Utilization of SEH employees with previous experience working in the St. Paul
District to assure a quality design that will meet the St. Paul District standards.
8. Overall cost savings in design and construction for the reasons listed above.
This proposal has previously been discussed with personnel of the District Planning Division
and other staff of the District and SEH personnel. It is requested that I and SEH engineers meet
with your Planning and Engineering Division Chiefs to discuss our proposal. If at all possible
to expedite the project, the design could start immediately, and the Corps could reimburse the
City after completion of the design.
