Notice of the Hearing was published in the Stillwater Gazette on
September 24, 1993 and copies were mailed to affected property owners.

NOTICE OF HEARING ON PROPOSED ASSESSMENT
FOR
HIGHLANDS OF STILLWATER, THIRD ADD., L.t. 28~
TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of the City of Stillwater,
Washington County, Minnesota, will meet at 7:00 P.M. on October 12, 1993 in
the Council Chambers of the Stillwater City Hall, 216 North Fourth Street,
Stillwater, Minnesota to pass upon the proposed assessments for the following
improvements:
Streets, Utilities (Storm Sewer, Sanitary Sewer, Watermain) and
Appurtenances for the Highlands of Stillwater, Third Addition, L.I.
289.
The following is the area proposed to be assessed:
Highlands of Stillwater Third Addition, located north of Orleans St.,
east of County Road 5, south of Pine Tree Trail and west of Greeley St.
and any property abutting on the improvement or served by any aspect of
the improvement or benefiting from the improvement.

The total cost of the project is $203,058.17. The total amount of the
proposed assessment is $$203,058.17.
The proposed assessment roll is on file for public inspection at the City
Clerk's Office, 216 No. Fourth St., Stillwater, Minnesota from 8:00 A.M. to
4:30 P.M., Monday through Friday, excluding holidays.
Written or oral objections will be considered at the meeting. No appeal may
be taken as to the amount of an assessment unless a signed, written objection
is filed with the Clerk prior to the hearing or presented to the presiding
officer at the hearing. The Council, may upon such notice, consider any
objection to the amount of a proposed individual assessment at an adjourned
meeting upon such further notice to the affected property owners as it deems
advisable.
An owner may appeal an assessment in District Court pursuant to Minnesota
Statutes Section 429.081, by serving notice of the appeal upon the Mayor or
Clerk of the City within 30 days after the adoption of the assessment and
fil ing of such notice with the District Court within ten (10) days after
service upon the Mayor or Clerk. However, no appeal may be taken as to the
amount of any individual assessment unless a written objection signed by the
affected property owner is filed with the City Clerk prior to the assessment
hearing or presented to the presiding officer at the hearing.
Under Minnesota Statutes Section 435.193 to 435.195 and Stillwater City Code,
Chapter 56.05, the Council may, in its discretion, defer the payment of this
special assessment for any homestead property owned by a person 65 years of
age or older or reti red by vi rtue of a permanent and total di sabil i ty for whom
it would be a hardship to make the payments.

The option to defer the payment of special assessments shall terminate and all
amounts accumulated plus lapplicable interest, shall become due upon the
occurrence of any of the following events: (a) the death of the owner,
provided that the spouse is otherwise not eligible for the benefits hereunder;
(b) the sale, transfer or subdivision of the property or any part thereof; (c)
if the property should for any reason lose its homestead status; or (d) if for
any reason the taxing au hority deferring the payments shall determine that
there would be no hardship to require immediate or partial payment.
Any assessed property own rs meeting the requirements of this law and the
ordinance adopted under it may, upon adoption of the assessment, apply to the
City Clerk for the prescribed form for such deferral of payment of the special
assessment on the propert .

RESOLUTION NO. 93-
ADOPTING ASSESSMENT
HIGHLANDS OF STILLWATER, THIRD ADDITION, L..L 289,
WHEREAS, pursuant to proper notice duly given as required by law, the council
has met and heard and passed upon all objections to the proposed assessment for
Local Improvement No. 289, described as that area known as Highlands of
Stillwater, Third Addition, which is located north of Orleans Street, east of
County Road 5, south of Pine Tree Trail and west of Greeley street..
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a
part hereof, is hereby accepted and shall constitute the special assessment
against the lands named therein, and each tract of land therein included
is hereby found to be benefited by the proposed improvement in the amount
of the assessment levied a9ainst it.
2. Such assessment shall be payable in equal annual installments extending
over a period of ten (10) years, the first of the installments to be
payable on or before the first Monday in January 1994 and shall bear
interest at the rate of 8 percent per annum from the date of the adoption
of this assessment resolution. To the first installment shall be added
interest on the entire assessment from the date of this resolution until
December 31, 1994. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
3.
The owner of any property so assessed may, at any time prior to
certification of the assessment to the county auditor, pay the whole
assessment on such property, with interest accrued to the date of payment,
to the city treasurer, except that no interest shall be charged if the
entire assessment is paid within thirty (30) days from the adoption of this
resolution; and he may, at any time thereafter, pay to the city treasurer
the entire amount of the assessment remaining unpaid, with interest accrued
to December 31 of the year in which such payment is made. Such payment
must be made before November 15, or interest will be charged through
December 31, of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment
to the county auditor to be extended on the property tax lists of the
county. Such assessments shall be collected and paid over in the same
manner as other municipal taxes.

NOTICE OF HEARING ON PROPOSED ASSESSMENT
FOR
HIGHLANDS OF STILLWATER, FOURTH ADD., L.I. 293
TO WHOM IT MAY CONCERN:
Notice is hereby given that the City Council of the City of Stillwater,
Washington County, Minnesota, will meet at 7:00 P.M. on October 12, 1993 in
the Council Chambers of the Stillwater City Hall, 216 North Fourth Street,
Stillwater, Minnesota to pass upon the proposed assessments for the following
improvements:
Streets, Utilities (Storm Sewer, Sanitary Sewer, Watermain) and
Appurtenances for the Highlands of Stillwater, Fourth Addition,
L.I. 293.
The following is the area proposed to be assessed:
Highlands of Stillwater Fourth Addition, located north of Curve Crest
Blvd., east of County Road 5, south of Pine Tree Trail and west of
Greeley St. and any property abutting on the improvement or served by
any aspect of the improvement or benefiting from the improvement.

The total cost of the project is $395,644.34. The total amount of the
proposed assessment is $395,644.34.
The proposed assessment roll is on file for public inspection at the City
Clerk's Office, 216 No. Fourth St., Stillwater, Minnesota from 8:00 A.M. to
4:30 P.M., Monday through Friday, excluding holidays.
Written or oral objections will be considered at the meeting. No appeal may
be taken as to the amount of an assessment unless a signed, written objection
is filed with the Clerk prior to the hearing or presented to the presiding
officer at the hearing. The Council, may upon such notice, consider any
objection to the amount of a proposed individual assessment at an adjourned
meeting upon such further notice to the affected property owners as it deems
advisable.
An owner may appeal an assessment in District Court pursuant to Minnesota
Statutes Section 429.081, by serving notice of the appeal upon the Mayor or
Clerk of the City within 30 days after the adoption of the assessment and
filing of such notice with the District Court within ten (10) days after
service upon the Mayor or Clerk. However, no appeal may be taken as to the
amount of any individual assessment unless a written objection signed by the
affected property owner is filed with the City Clerk prior to the assessment
hearing or presented to the presiding officer at the hearing.
Under Minnesota Statutes Section 435.193 to 435.195 and Stillwater City Code,
Chapter 56.05, the Council may, in its discretion, defer the payment of this
special assessment for any homestead property owned by a person 65 years of
age or older or retired by virtue of a permanent and total disability for whom
it would be a hardship to make the payments.

The option to defer the p yment of special assessments shall terminate and all
amounts accumulated plus pplicable interest, shall become due upon the ...
occurrence of any of the ollowing events: (a) the death of the owner, ~
provided that the spouse Os otherwise not eligible for the benefits hereunder;
(b) the sale, transfer or subdivision of the property or any part thereof; (c)
if the property should fo any reason lose its homestead status; or (d) if for
any reason the taxing aut ority deferring the payments shall determine that
there would be no hardshi to require immediate or partial payment.
Any assessed property own rs meeting the requirements of this law and the
ordinance adopted under i may, upon adoption of the assessment, apply to the
City Clerk for the prescrobed form for such deferral of payment of the special
assessment on the propert .

RESOLUTION NO. 93-
ADOPTING ASSESSMENT
HIGHLANDS OF STILLWATER, PHASE IV, L. I. 293
WHEREAS, pursuant to proper notice duly given as required by law, the council
has met and heard and passed upon all objections to the proposed assessment for
Local Improvement No. 293, described as that area known as the Highlands of
Stillwater, Phase IV, which is located south of Pine Tree Trail, west of Greeley
Street, north of Curve Crest Blvd. and east of County Road 5..
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA:
1. Such proposed assessment, a copy of which is attached hereto and made a
part hereof, is hereby accepted and shall constitute the special assessment
against the lands named therein, and each tract of land therein included
is hereby found to be benefited by the proposed improvement in the amount
of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of ten (10) years, the first of the installments to be
payable on or before the first Monday in January 1994 and shall bear
interest at the rate of 8 percent per annum from the date of the adoption
of this assessment resolution. To the first installment shall be added
interest on the entire assessment from the date of this resolution until
December 31, 1994. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
3.
The owner of any property so assessed may, at any time prior to
certification of the assessment to the county auditor, pay the whole
assessment on such property, with interest accrued to the date of payment,
to the city treasurer, except that no interest shall be charged if the
entire assessment is paid within thirty (30) days from the adoption of this
resolution; and he may, at any time thereafter, pay to the city treasurer
the entire amount of the assessment remaining unpaid, with interest accrued
to December 31 of the year in which such payment is made. Such payment
must be made before November 15, or interest will be charged through
December 31, of the next succeeding year.
4. The clerk shall forthwith transmit a certified duplicate of this assessment
to the county auditor to be extended on the property tax lists of the
county. Such assessments shall be collected and paid over in the same
manner as other municipal taxes.

RESOLUTION ADOPTING ASSESSMENT FOR L.r. 287-2
SIDEWALK IMPROVEMENTS
WHEREAS, pursuant to an agreement with the affected property owner and proper
notice duly given as required by law, the council has met, heard and passed upon
all objections to the proposed assessment for sidewalk repair.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF STILLWATER, MINNESOTA:
1. Such proposed assessment~ a copy of which is attached hereto and made a
part hereof, is hereby accepted and shall constitute the special assessment
against the lands named therein, and each tract of land therein included
is hereby found to be benefited by the proposed improvement in the amount
of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of five (5) years, the first of the installments to be
payable on or before the first Monday in January 1994 and shall bear
interest at the rate of 8 percent per annum from the date of the adoption
of this assessment resolution. To the first installment shall be added
interest on the entire assessment from the date of this resolution until
December 31, 1994. To each subsequent installment when due shall be added
interest for one year on all unpaid installments.
3.
The owner of any property so assessed may, at any time prior to
certification of the assessment to the county auditor, pay the whole
assessment on such property, with interest accrued to the date of payment,
to the city treasurer, except that no interest shall be charged if the
entire assessment is paid within thirty (30) days from the adoption of this
resolution; and he may, at any time thereafter, pay to the city treasurer
the entire amount of the assessment remaining unpaid, with interest accrued
to December 31 of the year in which such payment is made. Such payment
must be made before November 15, or interest will be charged through
December 31, of the next succeeding year.
4. The clerk shall forthwith tr:ansmit a certified duplicate of this assessment
to the county auditor to be extended on the property tax lists of the
county. Such assessments shall be collected and paid over in the same
manner as other municipal taxes.

PAY EQUITY ADJUSTMENTS
Pursuant to my discussion with Cy Smythe, Labor Relations Consultant, I
advised you that the Council would have to adopt a resolution approving an
amended salary schedule for the AFSCME units (City and Library).
The purpose of amending the salary schedules was to increase the maximum
salaries (effective September 30, 1993) for the following classifications to
bring the'City into compliance with the pay equity law:
Library Ass't. I
Community Service Officer
Junior Account Clerk
Secretary/Dispatcher

Although the City did not, and was not required to negotiate the salary
increases with the AFSCME Union, I believed the action would be acceptable to
the Union. However, -Matt Nelson, AFSCME Business Agent objects to the action
taken by the City -- specifically, the unilateral action by the City of
amending a salary schedule that is part of a negotiated labor agreement.
Technically, Matt is right. Therefore, the Council should rescind the
previous Resolution No. 93-186 and adopt a new resolution that basically
states that:
The City agrees to make available (or pay) the maximum salaries as
shown in the aforegoing paragraph. .
What this means, is that the Council has agreed to pay salaries that will
bring the City into compliance with the pay equity law. The Union could
object to the salaries. However, the City has made the salaries available and
we would, therefore, comply with the law.
