This memo is a reminder to Council that a Special Meeting has been scheduled
for Tuesday afternoon, September 14, 1993 at 4:30 P.M. in the City Hall
Council Chambers, 216 North Fourth Street, Stillwater, Minnesota to-discuss
the following:
1. Continuation of discussion'of proposed 1994 Budget.
2. Decision on approval of Variance to the side & rearyard setback
requirements (5 ft. side & rearyard required, 2 ft., 8 in. proposed) for
the construction of a garage located at 912 W. Laurel St. in the RB,
Two-Family Residential Dist., Case No. V/93-49,'Connie F. Devich,

HE: 1994 BUDGET
The cumulative changes to the 1994 Budget have resulted in a general tax levy
of $1,938,704. The debt service tax levy is $830,746 for a total tax levy of
$2,769,450.
As compared to the payable 1993 tax levy, the payable 1994 tax levy is an
increase of 3.49 percent.
With a total tax levy of $2,769,450 for payable 1994 ,the estimated tax capacity
rate is 29.500 percent, which is a 2.96 percent increase over the payable 1993
tax capacity rate of 28.651 percent.
The homeowner's property tax notice will show a 2.96 percent increase in taxes
over 1993.
PLEASE NOTE: The difference between the 3.49 percent increase in actual tax levy
versus the 2.96 percent increase in tax capaci ty rate is due to changes
(increases) in HACA, Equalization Aid and fiscal disparities.

ADOPTING THE PROPOSED BUDGET FOR THE YEAR 1994
Be It Resolved, by the city Council of the City of Stillwater, Minnesota, that
the proposed Budget for the General Fund is hereby adopted for the year 1994 with
revenues and expenditures in the amount of $5,148,808.

RE: SANITARY SEWER SITUATION AT DEVICH PROPERTY (ITEM 12 ON THE AGENDA)
Dick Moore and Choc Junker have reviewed the sanitary sewer system that provides
sewer service to the Devich property (912 West Laurel Street). The attached map
shows the location of the system which services several homes. It is not known
at this time whether or not easements exist for the sewer system (the City
Attorney is reviewing county records to determine if easements exist). However,
regardless of easements or not, it appears that the present system is unfavorable
because of its location on the various lots. It would appear to be a more
favorable situation to place sanitary sewer in McKusick Lake Road (in conjunction
with the county project) and eliminate the present system. Dick Moore and Choc
are reviewing the feasibility of this and will provide more information to the
Council at the meeting Tuesday afternoon.

flash flooding in portions of southwestern, northwest, and Central Minnesota, the
President, in response to the Governor's requests, declared several Minnesota
counties as a major disaster area. In accordance with this declaration, and in
response to your request for disaster assistance, the following documents are

2. Project Application Summary Form
The Project Application Summary form is a summary of all Damage Survey
Reports (DSRs).
3. Project Listing Form
The Project Listing Form is a breakdown of all approved DSRs indicating
the approved amount, % of work completed at the time of the initial
inspection, and description of work to be done as indicated on the DSR.

In addition, it asks the subgrantee to provide the date the work was
actually completed on all open DSRs and the actual dollar amount expended
to complete the work.

Dear Mayor and Council Members:
Please find enclosed Change Order No.1 for the above-referenced project for your review and
approval. This Change Order is for the removal of vinyl floor tile which contained asbestos
material. The unit price of ninety-six cents per square foot was obtained from the Contractor
before the bid award was made. Therefore, this Change Order incorporates prior approvals for
the removal of the asbestos flooring.
During the removal operations, it was discovered that there was also asbestos floor tile beneath
the stages in three rooms. Also, there was linoleum containing asbestos adhered to the flooring
of these stages. The Contractor encountered extra work associated with removing the stage
flooring to access the vinyl flooring and also be able to get into the crawl spaces to remove the
asbestos flooring.
The removal of the asbestos floor tile was for 17,546 square feet, which amounts to $16,662.24.
The removal of the three stage floors and accessing the crawl space was a total of 64 hours at
$37.00 an hour in the amount of $2,368.00. Therefore, the Change Order is $19,030.24. We
recommend approval of this Change Order. It was necessary to remove the floor tile so that
none of this asbestos material is buried on the site and could relate to any future problems for
the City.

MEMORANDUM
RE: AVAILABILITY OF TAX FORFEIT LAND
Accompanying this memo is a map showing a parcel of land (11080-2130) that is
owned by the State of Minnesota but is being included in the upcoming tax
forfeiture sale (county). The property is located on Mulberry Street about 1/2
block west of NOrth Fourth Street is also adjacent to the Mulb~rry Street ravine.
I would recommend that the Council acquire the parcel (at no cost) to protect
the ravine area.

CHARTER COMMISSION REQUEST
On August 25,1993, Mayor Hooley, City Attorney Magnuson and myself met with the
Charter Commission to discuss the land use regulations proposed by the Charter
Commission. At the meeting, City Attorney Magnuson suggested that the Charter
Commission develop regulations and procedures that would be less restrictive and
would provide some flexibility for the use of city owned land.
The Charter Commission was receptive to the City Attorney's suggestion and is
asking that the Council direct the City Attorney to prepare the appropriate set
of regulations/procedures for further review and discussion.

Subject: Levee Appropriation
I have been meeting with Senate Committee Members, and staff, and
Committee staff this week and last. The SubCOmmittee mark-up of the Energy and
Water Resources Appropriation Bin good possibly occur the end of this week, or early
next week.
AlSO. I have gone back to key Members and staff of the House Appropriations
Committee to discuss the impact of the flooding this year. While the primary purpose is
to cement the $3.2 appropriation in the House bill, I have talked about the increased
expense due to the flOOding. They have been receptive to this approach.
Again, I have been emphasizing the need for specific language in either the
legislation or the Committee Report. There is simpty no way to determine at this time
how successful we will be in the Senate bitt. While the Members and staff have been
supportive in my discussions with them I no one is giving any indiCation of what may
eventually come out. This is not unusual! Even the Chairman wiN not oomment
because it is a ~CGmmlttee process."
Whatever comes out of the Senate bin, it win be important to continue working in
both the House and Senate with the Members are S8~ected for the Conference
Committee. The Conference Committee wilt resolve the differences In the two bills,
and even if we have an appropriation in both bills, it win be important to get the
language in the Conference Report that directs the Corps to take immediate action.
tn the worst scenario, that is, having neither language nor an appropriation in
the Senate bill, our approach would be to do everything possible to get the Senate to
accept the House version of the bill for the levee appropriation during the Conference
Committee. Also, there are some other things we could do on the floor of the House
and Senate.
I will be in touch as things move forward this week and next.
