This memo is a reminder to Council that a Special Meeting has been scheduled
for Tuesday afternoon, July 13, 1993 at 4:30 P.M. in the Council Chambers of
• City Hall, 216 No. Fourth St., Stillwater, Minnesota to discuss the following:
1. Possible award of bid for abatement of asbestos material from West Wing of
Jr. High School (continued from July 6 meeting).
2. Any other business Council may wish to discuss.

Dear Mayor and Council Members:
On Tuesday, June 29th, the City received bids for the above - referenced project. The City
received six bids with the lump sum portion ranging from $99,653 to $175,400.
In addition to the lump sum bids, there were unit prices furnished by the contractor for
• abatement of various items which may be within the building and not readily visible.
These will need to be abated and, therefore, the City does have a unit price for these items.
Atech Associates Inc. did a comparison cost assessment of all the bids utilizing the unit
prices furnished by the contractors and the known quantities which Atech has
determined. The lump sum bid was the price declared by the contractors based on
quantities viewed at the site. The apparent low bidder on a lump sum basis was VCI
Asbestos Abatement Incorporated. The second low bidder based upon the lump sum bid
was HEW, Incorporated at $116,782. When the known quantities were compared against
the unit prices furnished by the contractors, HEW was the low bidder with a total of
$123,882. VCI Asbestos Abatement actually became the third bidder on the basis of a unit
price comparison. On this basis, we recommend award of the contract to HEW,
Incorporated for the lump sum of $116,782 and the unit prices included for individual
items in their bid.
HEW, Incorporated is a firm from Iowa. They meet all the qualifications and are licensed
in Minnesota for asbestos abatement. We checked their references in Minnesota and find
their performance to be satisfactory. HEW, Incorporated is presently working for the
Fairbault School District.
In addition to the contractor cost, asbestos abatement requires on -site monitoring by a
qualified licensed testing firm during the abatement process. This will be provided by
Atech, Inc. at an estimated cost of $20,000 for the 42 -day contract period.
• The Minnesota Department of Health and the Minnesota Pollution Control Agency as
well as Washington County will also monitor the project periodically during the 42 -day

period. The Mlnnesota Department of Health requires a permit from the contractor with
a 20 -day processing period. We will urge the contractor to file the permit immediately
upon award so as to minimize delay.

SUBJECT: PHASE I, EFFICIENCY STUDY
Staff has just received the final draft of the Phase I - Administration/
Finance Efficiency Study conducted by Tennessen Associates, Inc.
Staff is in the process of analyzing the study for review and comment and I
will be working with Staff to develop an implementation plan.
It is my understainding that Mr. Tennessen will be presenting the study to the
City Council at the 4:30 P.M. July 20 meeting.

Dear Mr. Kriesel,
I appreciate the time you gave me out of your busy schedule today. I
would like to follow up at this time in an attempt to clarify one of
the points in your July !, 1993 memo to the Mayor and the City
Council regarding the Long Lake issues.
There are really three distinct issues in that memo as I see
it(powered watercraft, brushing or cutting of trees and a dock on
park property).
The issue that I refer to here is related to a small dock(2 foot by 28
foot) behind my home, but located on lakeshore controlled by the
Park Department. It should be noted that I was essentially the first
to purchase property in this segment(Marine Circle and Nightingale
Blvd) of the Orrin Thompson Development in 1973. I put out a dock
at this general location for the first time in 1974. It has been free
and available for anyone to use. I have had docks of various types
for most of the years since 1974. There was never any concern
expressed by homeowners or any city officials until about 19 years
later. It is really unclear to me what the exact concern is at this
time.
I am not aware that the presence or use of the dock has ever
resulted in the erection of any other dock on similar property. Any
future concern for this could be addressed, if desired, through a
permit process.
There is no evidence that the dock has done any apparent harm to the
area, but, on the contrary, it has supported a great deal of healthy
fun and enjoyment over many years to those who use it and
especially to my own family. In addition, several types of
waterfowl frequent the dock in their daily routines.
The dock was erected n 1993 only after I visited and obtained the
ok from DNR, City Park Manager and the City Police Dept. early this
Spring.
I understand today from Nile Kriesel that there was a
miscommunication last year as to what official level was needed to
obtain the dock perm It for 1993. For that reason at this time I am
officially requesting that the City Council grant a single
permit for the dock that I have on Long Lake providing that
it continues to meet each of the published DNR
requirements for such a dock.

Dear Mr. Kriesel,
This is in reference to the Long Lake issues discussed at the
Stillwater City Council meeting last evening.
As I had mentioned, your July 1,1993 memo to the Mayor and City
Council on this matter included three major points. In a May 6,1993
letter to you for the City Council I addressed the dock issue which
was specific to me.
The second issue relates to use of powered watercraft on Long Lake.
I and several other residents to whom I spoke are in very strong
support for continuation of the use of such recreational
craft on the lake without any additional restrictions. There
are several reasons for this position including the following: Since
use of the larger powered boats began seven years ago, I can attest
to the much improved condition of the water. This includes
improved clarity and fewer algae and weeds. Since I started
enjoying this lake as a resident 20 years ago, the condition of the
water has shown dramatic improvement. We who love Long Lake
would not like to see this lake gradually deteriorate as Mayor Hooley
described has happened to Lily Lake since banning of motorized
watercraft.
As mentioned by another resident at the meeting, I am also keenly
aware that the number and types of waterfowl now seen on the lake
has never been greater. The number of Loons that now rest there
before their journey North has never been greater. The number of
Egrets has grown dramatically. The beavers are back after several
years of absence. Ducks and geese abound to create an exceptional
hunting environment.

That leads to the next point concerning noise. Many a morning in the
fall, I am awakened to the sound of hunter's gunshots or the sounds
of power mowers in the summertime, or the sound of snowblowers
in the winter. The list can go on to include small aircraft from Lake
Elmo Airport or the iOniters on the hot air balloons seen so often
overhead. I have never thought of complaining about any of these or
any power boat noise. These are for the most part expected
occurences in an are such as this. This is a lake in Minnesota, a
state where many mai interests lie in water sports. It is to be
expected, but certainly it is not at an offensive nor excessive level
on this lake. That is my own perspective plus that of others to
whom I spoke to obtain a sampling of opinions. Yesterday when
first learned of any concerns over boating on Long Lake, I personally
went onto the lake aid experienced the noise from lawn mowing at
one of the Marine Circle residents. I discovered that this noise was
comparable to any beating that I have heard and actually is worse in
terms of total mowing hours. But again, this is a normal noise to be
tolerated.
I also did an inspection and have noticed no evidence of erosion to
the shoreline due to boating. In addition, I spoke with several
lakeshore owners, each of whom expressed the same position that
there has been no erosion to their properties. The water level is
very high for the lake at this time causing some shore to be under
water, but that will return as the rains subside and should not be
considered erosion. lAny erosion that may occur on this lake would
most likely be attributed to natural waves created by the natures'
winds, since that is a more constant phenomena than the limited
boating that the lake endures.
I remember when I launched my first powered boat on Long Lake in
the summer of 1974 and what great family fun times we have
enjoyed with the boats we have had over these years. It would not
be in the best interest of Stillwater to deny these wholesome, fun,
family times to those residents at Long Lake who have purchased
property here with the intent of enjoying these normal lake
activities over the years.
In summary I would contend that there is no evidence to

support any change to the current boating activities on
0 Long Lake.

With respect to the brushing or cutting of trees on parkland near the
lake, I have noticed that activity going on for blocks around ever
since I have lived here. I can only speak for myself on that point as I
do not know what permission might have been obtained by others. In
our case we spoke to the director of the Park Dept. in 1989 at the
property site, and were granted full permission to do all the
brushing or trimming and anything else that we finally initiated
early in 1992. This was made clear to anyone that has inquired to us
about this. It is suggested that, in the future, thinning could
be controlled through a permit process.

The State of Minnesota recently ruled it is not legal for
any city employee to use a city auto for private use
unless the role of that employee could be classified as
one of emergency or that the individual may be called in
an authoritative manner in case of an emergency.
Our City Administrator drives a city vehicle for private
use. In my opinion, this use falls into the category of
"may be called in emergencies in an authoritative
manner ".
Therefore, I request the Council to support me in my
decision to have Nile Kriesel continue to use the city
vehicle and be called upon in case of an emergency.
