This letter is to confirm our appointment with the Stillwater City Council to make a
presentation regarding our municipal engineering and architectural services. Our
presentation is scheduled for Tuesday, April 27 at 5 p,m. at City Hall. Each of the
Council members has been personally contacted to assure that this is a convenient time.
We expect that our presentation, including questions, will last no longer than 45 minutes.
The presentation is a followup to the Statement of Qualifications we submitted to the City
Council earlier this year.

MSA FUNDING
Some questions have been raised regarding the status of MSA Funds. Both
Finance Director Deblon and Consulting Engineer Moore have stated that the
City of Stillwater did not lose any MSA Funds in 1992.
Attached to this memo are communications from the State Dept. of
Transportation giving the status of the City.s MSA account, starting with 1991.
This information is provided to us once a year by Mn/DOT. The last sheet
gives the City's 1993 allotment, which when added to our account balance of
1992, gives the City a total of $1,717,796.13.

Dear Mr. Kriesel:
Thank you for your prompt response to our request in support for MN/DOT performing a new
speed study for County State Aid Highway (CSAH) 5 from Trunk Highway 36 to Trunk Highway
96. The Washington County Board will review the request at their meeting on April 27.

We have reviewed your request for an additional speed study to be performed by MN/DOT on
CSAH 12 from Owens Street to CSAH 15. We also reviewed the recent history of speed
studies performed along CSAH 12. MN/DOT conducted speed studies in 1977, 1986, 1989,
and 1991. During that time, the only section of roadway in which the speed limit changed was
between a point approximately 300 feet east of the intersection with Northland Avenue and a
point approximately 300 feet west of the intersection with Brick Street. The speed limit
decreased in that section from 55 mph to 50 mph in 1991.
The former Mayor of the City of Stillwater along with City and Washington County Staff did
discuss this matter last fall. It was decided that based upon the stable history of the speeds
and development along CSAH 12 that a new speed study was not needed. At this time, we still
concur with that earlier position. We will continue to monitor this road for changes that would
warrant a new speed study.

House and Senate action on H.F.323/S.F.1512 - ACTION ALERT
Please contact your local legislators NOW in both the House and Senate to urge them to
persuade authors of legislation on uniform local elections to amend their proposals to
eliminate restrictions on the authority of home rule charter cities to conduct local elections.

Explain that without substantial changes, cities cannot support the bills since the legislation
fails to recognize and uphold local charter authority for the conduct of city elections. At
this time, the Senate version of the bill, S.F.1512, is more acceptable than H.F.323, which
still contains severe restriction on home rule authority for city elections.
Representative Tom Osthoff (District 66A-St. Paul) is the author of H,F.323, now on General
Orders waiting a fmal vote by House members.
Senator William Luther (District 47-Brooklyn Park) is the author of S.F.1512, the companion
to H.F.323, which has just been reported from committee for fmal action by the Senate. It, too,
will be on General Orders which allows the bill to be debated and amended prior to a fmal vote
to approve or defeat the bill.
Without changes listed below, the League cannot support either of the two bills. The
League and the Minnesota Clerks and Finance Officers Association have met with officials
representing the Secretary of State to secure support for changes in the fmal version of the
legislation. It is still uncertain whether Senator Luther or Representative Osthoff will agree to
make the necessary changes.

of any year. (Currently, H.F.323 would eliminate city authority to hold annual elections,
S.F.1512 has been amended to uphold that local authority, but home rule charter and
statutory cities which conduct their elections at other times of the year would be required to
change the date of city elections to November by 1996.)

City charters often conform fith provisions of state election law on this and other matters.

do so without regard to the vi ws of local elected officials.
These changes are critical to ssure that the conference committee on H.F.323/S.F.1512 will
uphold charter authority for elections.

Senate Amendment Eliminates Local Government Trust Fund
April 20, 1993
Dear City Official:
Over the past year more than 165 cities adopted resolutions calling for constitutional dedication
of the Local Government Trust Fund for property tax relief. This is a substantial public
mandate.
Monday night, the Property Tax Division of the Senate Tax Committee disregarded this public
mandate and instead adopted an amendment to the omnibus tax bill that would eliminate the

the Legislature's commitment to property tax relief programs like LGA and HACA.

Please contact your senator and the Senate Leadership (Senators Doug Johnson, Tax Committee
Chair and Roger Moe, Majority Leader) and urge them to restore the Local Government Trust
Fund in both name and in spirit. Specifically, urge them to:
1. Restore the Local Government Trust Fund and reaffIrm the commitment to use
the Trust Fund exclusively property tax relief.
2. Provide $16 million increased funding for LGA for 1994. This funding level is
consistent with the spirit of the Trust Fund and the principle that programs like
LGA and HACA should grow along with revenues in the Fund.
Your help at this time could be critical. Even if the senators say it is too late to change the
Senate tax bill, insist on these principles. You can also ask them to insist that the tax bill that
returns from the conference committee include a continued commitment to the Trust Fund and
increased funding for LGA.

Both houses have passed their respective bills and should be starting conference committee
action around April 26. Both bills use an income tax increase. Therefore one can assume that the
final tax bill will need an income tax increase which Gov, Arne Carlson has promised to veto,
Some speculate that if Carlson does veto the tax bill, another proposal is not necessary. To that
end, there is no discussion yet about a back-up plan or bill in case of a veto. All other spending
bills are ahead of schedule, causing further speculation on adjournment by as much as a week
ahead of schedule.
Overall the House bill tends to be better for LGA, causes concern for HACA, and does violence
to TIP. The Senate bill merely protects current LGA and HACA, does not provide growth, but
improves TIP.
Please call your legislators. Urge them to talk to their tax conferees and support:
* Senate language on TIF for general provisions.
*House language on LGA increase for 1994.
* Insert LMC formula for LGA,

benefits for retired essential employees is a mandate
that cities cannot afford in times when citizens, the
governor and legislators are expecting city employment
costs to be contained.
The bill would allow non-elected, temporary arbitrators to create large local
government obligations without providing any additional service to the public,
If the bill is passed, units of essential employees can take the issue of
post-retirement health insurance to arbitrators to decide, In a relatively
short period of time, arbitrators will undoubtedly begin imposing the health
care benefit. As more and more units get post-retirement health insurance,
arbitrators will begin to regard these benefits as a standard, just as active
employee health insurance is today.

bill will have several very costly implications, if adopted.
Arbitrators will continue to award benefits to those already retired who
currently have other arrangements or have not previously obtained
coverage, in addition to newly retired employees.
o
Adding retirees to any group will probably adversely affect the premiums
for that entire group. within the context of exponentially rising
health care premiums, this could be a financially disastrous impact.
Some cities allow the use of unused sick leave to purchase health
insurance during retirement as an incentive to not abuse sick leave
during years of employment. Obviously, that type of program would be
s.ubverted by this bill.

Finally, if local governments lose control of the decision to provide
health insurance to retirees, an immediate provision should be made for
funding these post-retirement obligations during the worKing life of the
essential employee, as is currently done for other retirement benefits,
The Government Accounting Standards Board, for example, now requires
reporting such post-retirement health care commitments as an obligation
of the entity. without an off-setting reserve funded through payroll
deductions, showing the liability could have an adverse impact on the
cities' financial statements.

It is with mixed feelings that I submit to you my letter of
resignation as a member of the Stillwater Park and Recreation
Commission. effective April 27, 1993. I have been appointed by Governor
Arne Carlson as Ombudsman for Mental Health and Mental Retardation. That
position has a requirement that I hold no other public office and the Park
Commission could be interpreted to be a public office.
It has been an honor for me to serve you and the City of Stillwater.
feel that I have received far more than I have given.
e The Stillwater Park and Recreation Commission is a vital part of
this Stillwater area and the Council and the Commission have much to be
proud of. I hope that many of the initiatives that are currently in progress
will continue to move forward. I am especially concerned about the
comprehensive planning process as it relates to parks and open space, the
potential addition of additional park space, discussion of another ice
arena and the rehabilitation of our current parks.
I would like to suggest that, since no one from ward 2 was selected
in January, it may be appropriate to seek representation from that area.
They have no representation at this time and it would seem appropriate to
take this opportunity to correct that situation.
I look forward to continuing to serve the council and the citizens of
Stillwater in my other volunteer positions,
