The City of Stillwater Parks and Recreation Commission will meet on Monday, February 23, 2009, at 7 p.m. in
the Council Chambers of Stillwater City Hall, 216 North Fourth Street.

Ms. Amrein called the meeting to order at 7 p.m. and welcomed Mr. Polehna back to the
Commission.
Approval of minutes: Ms. Amrein noted on page 2, in the listing of Mark Walker's address, the
W. in West Aspen shou{d have been capitalized. Ms. Snellman noted a typo on page 1 in the
discussion of the preferred uses for the Staples Field court, hockey "with out without boards"
should be hockey "with or without boards." Mr. Brandt, seconded by Ms. Snellman, moved
approval of the minutes of Nov. 24, 2008, as corrected. Motion passed unanimously.
ACTION ITEMS
2009 CIP Project List - Mr. pogge briefly reviewed the suggested 2009 park improvement
projects - replacement of the playground equipment at Triangle Park, maintenance of the
Willard Street Stairs, maintenance repairs to the band shell in Pioneer Park and purchase of two
picnic tables for Lowell Park. He noted that the Triangle Park project had been pushed back
from 2008, and a neighborhood meeting has been held to gain input on preferred equipment.
Regarding the Willard Street stairs, he said staff is comfortable with doing an overlay versus
replacement of the stairs. He said use of the band shell in Pioneer Park is up, and staff believes
some maintenance work would be a good investment. The proposal to purchase tables for
Lowell Park is in response to a request from the public, he said. Mr. Polehna asked if there are
standards for picnic tables, questioning the $2,000 purchase price of the two tables; Mr. pogge
responded that the City does have standards for its tables, one design for high profile parks and
another for neighborhood parks.
Most of the discussion centered on the possible trail improvements - McKusick loop trail, Neal
Avenue trail, Northland Park internal trails or Meadowlark Park internal trails. Ms. Amrein spoke
in favor of the McKusick trail, saying she thought it would receive more use than a neighborhood
trail. Mr. Christensen asked if the proposal and estimated cost included the section of trail by the
trolley tracks that was eliminated last year. Mr. Pogge stated that segment, at a cost of $22,732,
is not included in this estimate. Mr. Polehna said he thought it would be nice to have the trail
loop completed, noting this is a project that has been going on for years. Mr. Pogge pointed out
there likely will be some opposition to the project as the trail will be going through perceived
backyards, even though the trail will be located on City property. Mr. Brandt spoke in favor of
the McKusick trail for its recreational use and as a connector to area bike trails. Mr. McGarry
also spoke in favor of the McKusick project as making the most sense.
Bruce Werre, member of the McKusick Lake Homeowners' board, spoke in favor of the project,
citing the heavy use the trail receives and also expressing a concern about safety of those
walking on Owens Street.
In discussion of cosUfunds, it was suggested that the trolley segment of the loop be bid as an
alternate. Mr. Polehna asked whether staff might be able to do some of the work to lessen the
cost.

Ms. Amrein moved to recommend that the 2009 CIP projects include the McKusick trail loop
improvements and the park improvements as recommended and prioritized by staff. Mr.
Polehna asked whether the motion included bidding the segment by the trolley tracks as an
alternate. Ms. Amrein responded in the affirmative. Ms. Snellman seconded the motion; motion
passed unanimously.
Legends Park well house design - Mr. Pogge briefly reviewed the design and site plans. He
stated the well house design plans have been sent to the Legends Homeowners' Association for
approval. He noted that due to a concern by the Minnesota Department of Health, the volleyball
area will have to be moved 50' to the south. He stated the Water Board has designed a park
shelter structure which includes many of the features of the well house and included it in its bid
package as an alternate. Mr. Pogge stated staff is working with area vendors to see if a
prefabricated shelter structure with many of the proposed features can be obtained at a possible
cost savings. Mr. Pogge noted that the shelter as designed likely will cost in the $45,000-
$50,000 range, a cost that will come out of the $90,000 the Water Board is contributing for park
improvements, and he suggested that could impact the ability to purchase needed playground
equipment. Mr. Polehna suggested it might be helpful for Commission members to look at some
vendor catalogs.
Mr. Pogge stated staff will be meeting with the Homeowners' Association regarding preferred
use of the $90,000 and will come back to the Commission in March with a recommendation. He
noted that in past meetings, preferred uses have included a new shelter, playground equipment,
turf improvements and irrigation. Mr. Brandt, seconded by Mr. McGarry, moved to recommend
approval of the final design for the Legends Park well house; motion passed unanimously.
Other Items
. Ms. Amrein asked about the status of the request to move the snowmobile trail to the
north side of County Road 12 so the south side can be plowed for pedestrian use. Mr.
Pogge said staff is still working on an agreement, but said he thought such an
agreement will be in place by next winter season for certain.
. Ms. Amrein asked if the Commission's recommendation regarding Staples Field has
gone to the Council. Mr. Pogge stated the issue was brought up, but not acted on at this
point.
. Mr. Polehna suggested looking at and developing standards for picnic tables, trash
receptacles and other standard equipment, again questioning the $1,000 purchase cost
for one picnic table.
. Mr. Christensen asked about the open forum portion of the meeting which the City
Council is directing all Commissions to schedule. Mr. Pogge said that will begin with next
month's agenda. Mr. Christensen asked if the City would be looking at park fees as part
of the current budget situation. Mr. Pogge said the fees were looked at and tweaked
slightly last year; he said the City was about in the middle in relationship to fees charged.
Mr. Christensen asked about the status of the senior living facility off County Road 12
and whether trees have been removed for the project. Mr. pogge and Mr. Polehna
responded that the project has received all zoning approvals, and they reviewed
measures/changes that are being taken to protect trees in the area.
. Ms. Amrein noted it was time to hold the annual election of chair and vice chair. Ms.
Amrein and Mr. McGarry both volunteered to serve in their respective capacities for the
coming year if that was the wish of the Commission. Ms. Snellman, seconded by Mr.
Brandt, moved to have Ms. Amrein continue to serve as chair and Mr. McGarry as vice
chair in 2009. Motion passed unanimously.

. Mr. Polehna suggested it might be a good idea to set goals and objectives for the year,
with a monthly agenda for achieving those goals and objectives. He said he would bring
a format Washington County uses to next month's meeting. Mr. Polehna also suggested
that members be provided with binders for keeping minutes, contact numbers and other
helpful information.
Mr. McGarry, seconded by Ms. Snellman, moved to adjourn at 8:15 p.m. Motion passed
unanimously.

DISCUSSION
At the January meeting the Commission requested staff to include a copy of the current
park equipment standard for review by the Commission. Nick Chaves gathered the
attached maternal.
Currently the City uses the same benches and trash receptacles in all of our City Parks.
The City normally uses the Pilot Rock picnic tables in all of our parks. The Wabash
Valley tables are used in areas with high rates of vandalism. The following prices do
not include installation costs. There is approximately $50-$150 in material cost to install
the benches and trash receptacles. Concrete slaps for a picnic table will run around
$350. All of these items are installed by the City's park staff.

· XT Series end frames shall be one-piece welded construction,
fabricated from 2.375" 0.0. (2-3/8" 0.0.) steel pipe to meet
2" nominal steel pipe size specifications with 2" X 2" X 3/16"
A-36 structural grade steel angle for attaching. the seats and
tops.
· Table frame design shall incorporate nontip, nontrip, walk-
through design features. Bends shall be tightly formed to
prevent tipping when weight is on one side.
- Nominal table height shall be 30". Nominal seat height shall
be 18".
- Model XT/G-6 shall have a nom. 6 ft. length.
-Model XTjG-8 shall have a nom. 8 ft. length.
- Frames shall be supported by diagonal braces of 1-5/16"
O.D. x 14 ga. wall steel pipe that shall connect toa
die40rmed steel channel designed to align and provide
attachment to the table top.
- All galvanized fasteners shall be provided for assembly.
-Aluminum shall be extruded 6063-T6 aluminum alloy in
planks with dimensions equivalent to that of 2" X 10" nominal
sized lumber. The plank design shall be 1-3/4" x 9-5/8"
with four structural teinforcement ribs for greater rigidity.
Ah.l1'ninum planks shall be provided with a clear anodized
finish as pet anodizing specification 204 Rl. Aluminum dips
to fasten planks to frames are included.
· Channel end caps shal1 be of extruded 6063-T6 aluminum
alloy provided with a clear anodized finish as per anodizing
specification 204 Rl. End caps shall be press fitted over
ends of aluminum planks and mechanically fastened in place
at the factory.
- Table tops are assembled into single units (at the factory) With

Regular inspection and maintenance of all ports, and fasteners is necessary. Tighten all bolts and nuts. Inspect Taps, Seats, Legs,
Braces and Fasteners periodically for wear or vandalism. Replace broken or worn parts immediately or take equipment out of service
until repairs are made. . Use genuine Wabash Valley replacement parts.
To restore plastisol coating to its luster after prolonged use, wash/rinse/dry and use Armor-All @ or similiar quality vinyl protectant.

Heat fused poly-vinyl coating, finished on inner-metal structure, to an approximate 3/16" thickness.
Framework assemblies are finished with powder coating; electrostatically applied and oven cured according to powder manufacturer's
specifications. Fasteners are stainless steel to resist corrosion.
TABLE FRAMES:
Main supports are constructed of 2 3/8" ad x 13 gage and 1 5/8" ad x 14 gage structural steel tubing. Cross
braces are 1" ad x 15 gage structural steel tubing. Mounting brackets on legs are 1 0 gage x 2 7/8" x 6" sheet
steel.
TOP & SEATS:
Top and seats use fabricated 3/4-#9 expanded steel mesh and 12 gage sheet metal for perforated Framing on
the 8', 6' and 4' top and 8' and 6' seats are 10 gage mitered angles 3/4" x 1 3/4" The 4' seats use 14 gage
mitered angles 3/4" x 1 3/4". Top's center support brace is 1/8" x 1 1/2" strip steel. Top and seat mounting
brackets are 1/4" x 1 1/2" steel flat bar.
GENERAL:
1 0' picnic table ground space requirements are 64 5/8" x 120 3/8". 8' handicap picnic table ground space
requirements: 64 5/8" X 96 3/8". 8' picnic table ground space requirements are 64 5/8" x 96 3/8". 6' picnic
table ground space requirements are 64 5/8" X 72 3/8". 4' picnic table ground space requirements are 64 5/8"
x 48 3/8". Table tops are 30 3/8" wide and 29 1/2" to the top of the tables. Seats are 10 3/8" wide and
19 5/8" to top of seat. Corner radius is 3" to the outside.
8' utility table ground space requirements are 30 3/8" x 96 3/8". 6' utility table ground space requirements are

assembly proced IMPORTANT: Assemblers should be reasonably skilled in the assembly of commercial
U re s: grode/heavy duty fabricated steel equipment.
To ensure proper assembly, it is suggested thot you toke adequate time to locate and identify each port. To prevent scratching of
the finished pieces, we recommend this unit to be assembled on 0 clean, flat, solid, surface with 0 drop cloth. allowing plenty of
working room. Also please read the instructions and study the sketches very carefully. A little extra time spent before assembly will
be well worth it in performing 0 complete, proper assembly. Please note that 011 parts have been precut and pre-drilled.
During the assembly process leave 011 bolts and nuts "finger tight", until the entire unit is completely assembled. This allows room
for movement to level or adjust 011 seats, tops. benches, framework and broces if necessory. After final adjustment and leveling,
permanently tighten 011 nuts, bolts and fasteners.

STEP 1: FOR BOTH TABLES WITH AND WITHOUT SEATS.
Invert (A-) top so it's upside down on 0 flat surface Attach both (C-) legs to the outermost part of the top's
end leg mounting brackets with seat mounting brackets toward Inside of top, see FIG. 2. If assembling 0 10' table,
attach the center leg at this time with seat mounting brackets toward top center leg mounting bracket, see FIG. 1.
Use two, per each leg, (F) and (H) using two (G) and one (J) per each (F).

Attach one end of each (D) brace to each leg. see FIG. 3. using, per each
broce, one (E). two (G), one (J) and one (H). For the 10' table. mount two (D)
braces to the center leg using one (I) and (H) and one (J) using two (G).
Secure the opposite end of each brace to the top's center support brace. see
FIG. 4, refer to FIG. 1 or 2, using one, per each brace. (F) and (H). Use
two (G) and one 0) per each (F).
STEP 2: FOR TABLES WITH SEATS.
Check all fasteners making sure each fastener is finger tight and properly
supporting the unit. Re-invert the table to its topside up position.

Attach each (B-) seat to each side of the picnic table, align the
seat's mounting brackets with the inside of the leg's mounting brackets,
os shown in FIG. 5. Use (F) and (H) using two (G) and one (J) per each (F).

DISCUSSION
At the January meeting the Commission requested staff to include a copy of the current
park rules and fee schedule for review by the Commission. Attached is a copy of
Chapter 48 of the City Code on Park & Recreation and a copy of the current park fees
and rules adopted by City Council resolution. The park fees and rules were first
adopted by the Commission in 2007 with a minor update in 2008.
STAFF RECOMMENDATION
The Parks and Recreation Commission should review and discuss the current Park
Rules and Fees. The Commission could.also consider making a recommendation to
City Council on possible changes.

PARKS AND RECREATION
ARTICLE I. IN GENERAL
Sec. 48-1. Parks and recreation commission.
Subd. 1. Establishment. There is hereby cre-
ated a parks and recreation commission ("commis-
sion"), that upon the passage and publication of
this ordinance will be the successor to the current
parks and recreation board, which is hereby abol-
ished.
Subd. 2. Powers. The commission will have the
powers necessary to carry out the functions and
duties set forth in this section.
Subd. 3. Function.
(1) The commission must advise the city coun-
cil and other advisory commissions regard-
ing matters relevant to the park, open
space and recreation function, including,
but not limited to, the expansion of and
plans for the development of city park,
trails and recreational facilities.
(2) The commission must monitor and reflect
the attitudes and concerns of the citizens
of Stillwater relative to the park and open
space system and recreational programs
and advise the city council of citizen atti-
tudes and policy matters relevant to the
park, trails, open space and recreation
needs in the city.
Subd. 4. Duties. The commission, with the
assistance of city staff must:
(1) Develop and recommend to the city coun-
cil, and upon the council's adoption, mon-
itor the execution of a comprehensive plan
and park open space classification system
for park and recreation facilities in the
city and make recommendations for
changes it deems necessary.
(2) Annually report to the city council regard-
ing achievements toward fulfillment of
the comprehensive plan and recommend
amendments to the comprehensive plan.
(3) Frequently visit city parks and keep in-
formed of cunent recreation programs in
order to continually review and evaluate
the park and open space development and
recreation programming.

(4) Develop and recommend methods to stim-
ulate positive public interest in park and
recreation facilities and programs.
(5) Develop and recommend feasible methods
of discouraging vandalism and destruc-
tion of city park facilities.
(6) Develop and recommend feasible methods
of financing city park improvements.
(7) Serve as a forum for the citizens of the
city to voice opinions regarding open space
acquisition, park and recreation activi-
ties.
(8) Promote coordination with the school dis-
trict serving Stillwater, encouraging the
interchangeable use of city and school
district facilities and programs to the best
interest of citizens of the city.
(9) Encourage dissemination of information
to and coordination with city organiza-
tions interested in the park and recre-
ation involvement such as garden clubs,
athletic groups and civic organizations.
(10) Encourage coordination with other com-
munities and agencies in matters benefi-
cial to the park and recreation function.
(11) Develop and transmit recommended cap-
ital improvements annually to the city
council for inclusion in the capital improve-
ments program.
(12) Review and make recommendations to
the city council on development proposals,
consistent with adopted policies, ordi-
nances, regulations and the comprehen-
sive plan.
(13) Review and recommend items to be in-
cluded in the park and recreation annual
budget.
Subd. 5. Membership.
(1) The commission will be composed of seven
members appointed by the council, one of
whom must be an elected member of the
city council.
(2) With the exception of the councilmember,
the members of the commission will be
appointed upon majority consent of the

council for staggered terms of three years,
except that any person appointed to fill a
vacancy occurring prior to the expiration
of the term which their predecessor was
appointed may be appointed only for the
remainder ofthe term. Upon expiration of
their term of office, the member will con-
tinue to serve until their successor is
appointed and qualified. Members of the
former parks and recreation board cur-
rently in office at the time of passage of
this ordinance may continue to serve on
the successor commission until the expi-
ration oftheir current term, and the num-
ber of commissioners reduced to seven
through attrition.
(3) The councilmember must be appointed
annually by the council and is privileged
to speak and vote.
(4) Members of the commission must be res-
idents of the city while serving on the
commission and should represent a broad
range of interests in the park, open space
and recreation function. However, it is a
goal, but not a requirement that all wards
of the city have commission representa-
titm.
(5) Commissioners must serve without com-
pensation.
Subd. 6_ Officers and meetings.
(1) The commission must hold one regular
meeting each month, the regular to be
held on the fourth Monday of each month
at 7:00 p.m. at the Stillwater City Hall.
The chairperson may cancel any regular
meeting ifthe chairperson determines that
there is not sufficient meaningful busi-
ness to conduct at a meeting. A majority
constitutes a quorum for the transaction
of business.
(2) The commission must adopt rules and
procedures consistent with these provi-
sions and as may be necessary for the
proper execution.
(3) At the beginning of each calendar year
the commission must select a chairper-

son. The chairperson may be removed
with the majority vote ofthe commission.
The chairperson must:
(a) Preside over meetings ofthe commis-

(b) Appear or appoint a representative
to appear as necessary before other
city advisory commissions and the
city council to present the view point
of the commission on matters per-
taining to park, open space and rec-
reation functions as they relate to
business under consideration by the
commissions or city council.
(c) Provide the liaison with other gov-
ernmental and volunteer units in
matters relating to the park, open
space and recreation function for the
purpose of obtaining and providing
timely information.
(4) A vice-chairperson must also be appointed
annually by the commission. The vice-
chairperson must perform the duties as-
signed by the chairperson and must as-
sume the responsibilities of the chair in
absence of the chairperson.
Subd. 7. Staff
(1) The community development director is
responsible for the preparation and up-
date of all plans regarding municipal park
and recreation facilities and for the com-
munication of the plans to the commis-
sion. The community development direc-
tor must coordinate the work with the
commission and delineate activities in the
work program for the commission, in or-
der that it may provide citizen participa-
tion in the preparation and carrying out of
various recreation and park projects.
The community development director must keep
the commission informed of all actions of the city
council and other city commissions relevant to the
function of the commission and with the assis-
tance of the public works director is responsible
for the training and orientation of all new com-
mission members.

The community development director must cause
to be prepared an agenda for each commission
meeting and must submit the agenda to the
commission in a timely manner. The community
development director shall attend meetings as
may be required by the commission.
The community development director may as-
sign a qualified member of the community devel-
opment department to assist in carrying out the
duties and responsibilities required by this sec-
tion.
(2) The public works director is responsible
for the maintenance of park and recre-
ation facilities. The public works director
must cooperate with the community de-
velopment director in the development of
plans for park and recreation facilities
and coordinate and administer all phases
of park and recreation implementation.
The public works director must attend
meetings as may be required by the com-
mission and keep the commission in-
formed on park and recreation facility
maintenance programs and budgetary
needs.
The public works director may assign a quali-
fied member of the public works department to
assist in carrying out the duties and responsibil-
ities required by this section.

Sec. 48-2. Use of parks.
Subd.1. Definitions. The following words, terms
and phrases, when used in this section, shall have
the meanings ascribed to them in this subdivi-
sion, except where the context clearly indicates a
different meaning:
Public parks or park means real property owned
by the city devoted to recreational use.
Subd. 2. Defacing or destroying property. No
person may deface, destroy, diminish or impair
the value of public or private property located

within any public park in the city including
buildings or structures, or trees, shrubs or vege-
tation.
Subd. 3. Parking and driving of vehicles. No
person may drive a motorized vehicle in a public
park other than on public roads within the park.
No person may park a motorized vehicle in a
public park in an area not specifically posted with
signs permitting parking of motorized vehicles
nor in an area posted with signs prohibiting
parking.
Subd. 4. Speed of vehicles. No person may
drive or operate a motorized vehicle at a speed in
excess of 15 mph in any park unless legally signed
for a higher speed.
Subd.5. Open fires. No person may build a fire
in any place in any park except in fireplaces or
receptacles provided for the building of fires or in
an area specifically posted with signs permitting
the building of an open fire.
Subd. 6. Swimming or wading in certain ar-
eas. No person may wade or swim in an area in
which signs have been posted prohibiting swim-
ming or wading. In all areas wherein swimming
and wading is permitted, the city council has the
authority by resolution to prohibit the use of
equipment dangerous to persons swimming or
wading and to prohibit activities or conduct as
dangerous or hazardous.
Subd. 7. Dogs and pets are permitted in all
City of Stillwater public parks, except Teddy Bear
Park, subject to the regulations and restrictions
set forth in City Code, Section 27 -1, Subd. 6.a. and
Subd. 7. No dogs or pets, except service animals
and zoo animals, may be in or upon Teddy Bear
Park.

Park.

Beach premises means that part of Lily Lake
Park described as follows: That area bounded on
the south by the arena-beach house building;
bounded on the west and the east by chainlink
fences running north and south to the water's
edge and continuing into the water of Lily Lake
by strings of white floating logs; bounded on the
north by a string of white painted floating logs
running east and west.
Flotation devices means any air inflated,
styrofoam or other buoyant devices including, but
not limited to, inner tubes and air mattresses,
other than a U.S. Coast Guard approved life buoy
or life jacket, when properly worn.
Lily Lake Park means that property owned by
the city used as a public park and abutting on Lily
Lake described as follows: Lots 14 and 15, block
20, Holcombe's Second Addition to the city, accord- .
ing to the plat thereof on file and of record in the
office of the Register of Deeds in and for Wash-
ington County, Minnesota. Also all that part of the
SW1f4 of the NW1f4 of Section 33, Township 30,
Range 20 described as follows: Beginning at a
point where the south line of lot 14, block 20,
Holcombe's Second Addition to where the city
intersects with the westerly line of South Greeley
Street; thence south along the westerly line of
South Greeley Street 195.2 feet to an iron pipe;
thence continuing southerly along the westerly
line of South Greeley Street 155.4 feet to an iron
pipe; thence continuing southerly along the west-
erly line of South Greeley Street 284.0 feet to an
iron pipe; thence deflecting to the right 122 de-
grees 1 minute 692.1 feet to an iron pipe on the
west line of such SWl/4 ofthe NWl/4; thence north
along such west line to the NW1f4 of such SWl/4 of
the NWl/ 4; thence east along the north line of such
SWl/4 ofthe NWl/4, being also the south line onot

Power-operated watercraft means any water-
craft, including seaplanes when not airborne,
which is propelled by any means other than sail,
oars, paddles, poles, foot-operated paddle wheels
or electric trolling motors.

Subd.2. Power-operated watercraft. No person
may operate a power-operated watercraft on Lily
Lake or McKusick Lake at any time.

Subd. 3. Flotation devices. No person may en-
ter the waters of Lily Lake Park with a flotation
device or use the device within the beach pre-
mises for other than emergency purposes.
Subd. 4. Entry to Lily Lake. No person may
enter the waters on Lily Lake from the shoreline
of Lily Lake Park as previously described in this
section except at places designated by signs con-
structed and erected as follows: A metal sign plat,
stating either "boat launching" or "swimming
area" and erected on standard channel steel sign-
posts.
Subd. 5. Alcoholic beverages. No person may
conveyor consume any alcoholic beverages upon
the beach premises.
Subd. 6. Hours of use of beach premises. No
person may be present upon the beach premises
or use beach equipment during hours when the
beach premises are not supervised by lifeguards
or instructors employed for that purpose by the
city or other authorized agency.
Subd. 7. Penalty. Any person who violates any
provision of this section is guilty of a misde-
meanor.

Sec. 48-4. Consumption and possession of
intoxicating liquor and 3.2 per-
cent malt liquor in City of
Stillwater Parks.
Subd. 1. Prohibited generally. No person may
consume upon, introduce upon or have in his
possession upon any City of Stillwater public park
any intoxicating liquor or 3.2 percent malt liquor,
as defined in Minn. Stat. ch. 340A without a
permit issued by the City. The fee for permit may
be established by resolution of the city council.
The city council may, by resolution, designate
certain parks as an alcohol free park effectively
prohibiting all intoxicating liquor or 3.2 percent
malt liquor, as defined in Minn. Stat. ch. 340A in
designated parks.

Sec. 48-5. Prohibited hours for certain acts.
Subd. 1. Prohibited hours for certain acts gen-
erally. It is unlawful for any person to be present
in or upon the public parks within the city be-
tween the hours of 10:00 p.m. and 6:00 a.m. when
that person does loiter or make undue noise by
shouting or yelling, or when that person other-
wise disturbs the peace and quite of the city.
Subd. 2. Prohibited hours for Teddy Bea~r Park.
It is unlawful for any person to be present in or
upon Teddy Bear Park between the hours of 8:00
p.m. or dusk, whichever is earlier, and 8:00 a.m.
Subd. 3. Exemptions by city council. The city
council may, upon its own motion or upon appli-
cation, waive prohibition of subdivisions 1 and 2
of this section for specific occasions, groups or
individuals, upon reasonable assurances that the
safety and welfare of the public and the peace and
quiet of the city will be protected.

Sec. 48-6. Regulating the St. Croix River wa-
terfront; providing for safety and
comfort of persons using the wa-
terfront, regulating and provid-
ing standards for docks.
Subd. 1. Waterfront defined. Waterfront means
any property abutting on the St. Croix River
located within the corporate limits of the city, and

including that portion of the surface of the St.
Croix River over which the city has lawful juris-
diction.
Subd. 2. Reckless or careless operation. No
person may operate a boat in a reckless or care-
less manner or at an excessive rate of speed so as
to endanger or to be likely to endanger the life or
property of any person. No person may operate a
boat at a rate of speed which causes waves to
damage docks, wharves or boats moored to docks
or wharves along the water. In addition, the wake
restrictions contained in state department of nat-
ural resources rules, NR 220.D.1.e. are hereby
adopted by reference. Every provision contained
therein is made a part ofthis section as iffully set
forth in this subdivision.
Subd. 3. Disturbing other boats. No person
may operate a boat in such a manner as to
unjustifiably or unnecessarily disturb, frighten or
endanger the occupants of any other boat or
throw up a dangerous wake when approaching
another boat.
Subd. 4. Abandoned boats. Every boat in the
water subject to this section which is abandoned
or which becomes a menace to navigation or
unseaworthy or sinks, grounds or becomes other-
wise disabled, is hereby declared to be a nuisance,
and the owner or person in charge thereof shall
abate such nuisance within seven days after no-
tice from the director of public safety of the city. If
the nuisance is not abated within the time, the
city must abate the nuisance and charge the cost
of the abatement as a lien against the vessel so
removed.
Subd. 5. Improper mooring. No boat may be
moored at places that are lawfully posted "No
Mooring" by order of the Stillwater Port Author-
ity.
Subd. 6. Boats to observe health and conduct
rules. The owner or person in charge of or occu-
pying boats docked at or moored to land, docks,
piers or wharves abutting the water shall observe
all health and sanitary regulations of the city and
all ordinances of the city relating to the conduct of
persons and prohibiting acts contrary to public
health, safety and peace.

Subd. 7. Operating under the influence of alco-
holic beverages. No person may operate a boat
while under the influence of intoxicating liquor,
narcotic drugs or controlled substances.

Subd. 8. Heads. All boats with heads must
have a marine toilet system that is U.S. Coast
Guard certified and meets current pollution stan-
dards of the city and any regulatory agency with
legal jurisdiction applicable to marine toilet sys-
tems.
Subd.9. Open fires. No person may build a fire
in any area subject to this section except in a
fireplace or receptacle provided for the building of
fires in an area specifically posted by the Stillwater
Port Authority with signs permitting the building
of an open fire.
Subd. 10. Swimming or camping. No person
may wade, swim or camp except in an area where
signs have been posted permitting swimming,
camping or wading by order of the Stillwater Port
Authority.
Subd. 11. Time of dockage; boarding for hires.
No person may tie up, moor or beach a boat or
other vessel in any area subject to this section for
more than eight continuous hours without first
having obtained a wharfage permit from the city.
This restriction does not apply to duly authorized
and permitted docks or marinas. No vessel or
charter boat is allowed to take on passengers or
otherwise board for hire within the waterfront of
the city without first having obtained a wharfage
permit from the city.
Subd. 12. Dock permits required. No person
may establish, construct or operate a dock, pier,
wharf or other similar appurtenance without hav-
ing obtained a dock permit.
Subd. 13. Other governmental agency permits.
As a condition precedent to the filing of an appli-
cation for a dock permit under this section, the
applicant must have obtained all other permits
that are required by any other governmental
agency having appropriate jurisdiction, including
the state department of natural resources and the
U.S. Army Corps of Engineers.

Subd. 14. Adoption of state law provisions re-
garding watercraft operation. Minn. Stat.
SS 86B.311-86B.461 regarding the operation of
watercraft are hereby adopted by reference. Ev-
ery provision contained therein is hereby adopted
and made a part of this section.
Subd. 15. Penalties. Violation of any provision
of this section is a misdemeanor. However this
section does not preclude civil actions if directed
by the city council.

Sec. 48-7. Use and operation of watercraft
on Long Lake.
Subd. 1. Application. This section applies to the
waters of Long Lake, located in sections 30 and
31, township 30 north, range 20 west, in the city.
Subd. 2. Definitions. Terms used in this section
related to boating are defined in Minn. Stat.
S 86B.005.
Subd. 3. Horsepower limit. With the exception
of pontoon boats, watercraft used on Long Lake
may not he powered by motors exceeding ten
horsepower. Pontoon boats may not be powered by
motors exceeding 25 horsepower.
Subd. 4. Enforcement. Primary enforcement of
this section shall rest with the county sheriffs
department and the city police department. This,
however, shall not preclude enforcement by other
licensed peace officers.
Subd. 5. Exemptions. All authorized resource
management, emergency and enforcement person-
nel, when acting in the performance of their
assigned duties, are exempt from the provisions of
this section.

Subd. 6. Public notification. It shall be the
responsibility of the city to provide for adequate
notification of the public, including the placement
of any necessary buoys or signs.
Subd. 7. Penalties. Any person who violates
any of the provisions of this section is guilty of a
misdemeanor and may be fined by a fine of not
more than $700.00 or by imprisonment of not
more than 90 days, or both.

ARTICLE II. PARK AND TRAIL
DEDICATION REQUIREMENTS*
Sec. 48-51. Established.
The City Council of City of Stillwater does
ordain:
Subd. 1. Authority. The State of Minnesota has
enacted Minnesota Statutes 462.358, subdivision
2(b) which gives authority to the cities to require
that a reasonable portion of any proposed subdi-
vision be dedicated to the public, or preserved for
public use as parks, playgrounds, trails or open
space. The City of Stillwater has, by this section,
chosen to exercise this authority in establishing
minimum requirements for meeting this public
need.
Subd. 2. Purpose. The city council recognizes
that preservation of land for park, playground,
trails, and public open space purposes as it re-
lates to the use and development of land is
essential to maintaining a healthful, safe and
desirable environment. The city must not only
provide these necessary facilities for citizens of
today, but also for the future needs of the city as
described in the Comprehensive Plan.
It is recognized by the city council that the
demand for park, playground, trails and public
open space within a municipality is directly re-
lated to the density and intensity of development
permitted and allowed within any area. Urban

development means greater numbers of people
and higher demands for park, playground, trails
and public open space.
The basis for calculating the amount of land
needed to be dedicated or preserved for the pur-
poses set forth in this section; the essential con-
nection between the dedication required by this
section and the purpose sought to be achieved;
and the basis for calculating the proportional
share of each development based on the burden to
the city created by the increase in population that
will be generated by each development is as set
forth in this section. In further explanation of the
basis described in this paragraph, this section
adopts by reference pages 8-1 through 8-6 of the
comprehensive plan ofthe city, and the maps and
drawings associated with those pages as if fully
set forth in this section verbatim.
It is the policy of Stillwater that the following
guidelines for the dedication of land for park,
playground and public open space purposes (or
cash contributions in lieu of dedication) in the
subdividing and developing of land are appropri-
ate.
Subd. 3. Residential park land dedication. Res-
idential park land as envisioned by this section is
that land suitable for active park use, such as
playgrounds and ball fields, or suitable for active
play areas for small children. It is imperative,
therefore, that the land be reasonably flat and in
one contiguous parcel rather than small scattered
parcels.
The amount of land to be dedicated is based on
the proposed residential density using the net
developable land area.

Subd. 4. Residential trail requirements. In ad-
dition to the requirements of subd. 3, the subdi-
vider must dedicate and improve trails and
trailways that are depicted for the property on the
city's most current comprehensive trail plan, or if
not depicted on the comprehensive trail plan,
have the potential for connection to the compre-
hensive trail system. If trail dedication and con-
struction is not feasible in the opinion of the city,
the subdivider may pay a fee of $500.00 per unit
in lieu of dedication and construction.
The basis for requiring the dedication and
improvement of trails in addition to the dedica-
tion of land for active parks is threefold.
First,. trails are normally eight feet in width
and therefore more than one mile of trial would
need to be dedicated to equal one acre of land.
Further, trials are often dedicated and con-
structed within set back or yard space; or within
natural areas or conservation easements; or land
that is otherwise unbuildable, because of various
restrictions.
Second, trails are increasingly important as a
means of transportation that is an alternative to
the automobile. In this way, a trail is merely a
street for pedestrians, and just as it is permissible
to require a developer to dedicate and construct
streets for automobiles, it is reasonable that a
developer be required to dedicate and construct
streets for people transportation, on foot or bicy-
cle.
Third, the trails within any development allow
connection to the city net trail system. In this
way, the residents of any new development in-
crease the burden on the remainder of the city
trail system. It is only reasonable therefore that

any development provide trail access for the re-
mainder ofthe city, since the remainder ofthe city
will be burdened by the development.
Subd. 5. Guidelines for accepting dedication of
land for public parI? purposes.
A. Land proposed to be dedicated for public
purposes must meet the needs of the city
as described in the Stillwater Comprehen-
sive Plan.
B. Prior to dedication, the subdivider must
deliver to the city attorney, an abstract of
title or registered property abstract evi-
dencing good and marketable title, free
and clear of any mortgages, liens, encum-
brances, assessments and taxes. The con-
veyance documents must be in a form
acceptable to the city attorney.
C. The required dedication or payment of
fees-in-lieu of land dedication must be
made before final plat approval.
D.The removal of trees, topsoil, storage of
construction equipment, burying of con-
struction debris or stockpiling of surplus
soil on dedicated land is strictly forbidden
without the prior written review by the
parks and recreation commission and ap-
proval of the community development di-
rector.
E. Grading and utility plans, which may
effect or impact the proposed park dedi-
cation, must be reviewed and approved by
the community development director and
parks and recreation commission prior to
dedication.
F. To be eligible for park dedication credit,
land dedication is to be located outside of
drainways, flood plains or ponding areas
after the site has been developed. Grades
exceeding 12 percent or that are unsuit-
able for park development may be consid-
ered for partial dedication.
G. Where subdividers and developers ofland
provide significant amenities such as, but
not limited to swimming pools, tennis
courts, or ball fields, within the develop-
ment for the benefit of those residing or
working therein, and where, in the judg-

ment ofthe parks and recreation commis-
sion, the amenities significantly reduce
the demands for public recreational facil-
ities to serve the development, the com-
munity development director may recom-
mend to the parks and recreation
commission that the amount of land to be
dedicated for park, playground and public
open space (or cash contribution in lieu of
dedication) be reduced by an amount not
to exceed 50 percent of the amount calcu-
lated under subd. 2 above.
H. The city, upon review, may determine that
the developer must create and maintain
some form of private on-site recreation
use by the site residents such as tot lots
and open play space. This requirement
may be in addition to the land or cash
dedication requirement.
Subd. 6. Cash payment in lieu of dedication,
residential. If, at the option of the city upon
review and recommendation of the parks and
recreation commission, it is determined that a
cash payment in lieu of land dedication shall be
made, the cash shall be placed in a special fund
for parks and recreation use and deposited by the
developer with the city prior to final plat ap-
proval.
The in lieu park fee shall be based on the

tion. The city may require the subdivider or
developer to make a combination cash and land
dedication pursuant to the following formula:
A. The amount of land which could be re-
quired in accordance with subd. 3 shall be
calculated.

B. From the total calculated in subpara-
graph A. above, the actual amount ofland
the city determines to be needed to fulfill
the purposes of this subd. 7 shall be
subtracted.
C. The balance arrived at in subparagraph
B. above, shall be converted into a cash
contribution in lieu of land dedication
pursuant to a standard formula estab-
lished by the city, which formula takes
into consideration such things as, but not
necessarily limited to, the fair market
value ofthe property in the plat, subdivi-
sion or development and the percentage of
the total park dedication obligation repre-
sented by the said balance.
Subd. 8. Industrial/commercial dedication re-
quirements. Subdividers and developers of com-
mercial/industrial land, including commercial/
industrial portions of planned developments, shall
be required at the time the site plan is approved
and building permits are issued to dedicate to the
city for park, playground and public open space
purposes, seven and one-half percent of the net
land area within the development as determined
by the city according to the guidelines set forth in
subd. 3 of this section.
Subd. 9. Cash payment in lieu of dedication,
commercial and industrial. In those cases where
the city does not require park or open space
dedication within a development, the city shall
require payment of fees in lieu of land dedication
in an amount equal to the net land area required
in subd. 3 above. Cash shall be contributed at the
time of approval of each final plat or at the time of
site plan or building permit approval as deter-
mined by the city.
The city council, upon review and recommen-
dation of the parks and recreation commission,
may review and determine by resolution an ad-
justment to the fee based upon the city's estimate
of the average value of undeveloped commercial
or industrial land in the city.
Subd. 10. Required plan and improvements to
parks. The developer or subdivider is responsible
for preparing a concept park plan or trail plan
based on the parks, open space and trails plan as
identified in the comprehensive plan as approved

by the parks commission, and for making certain
improvements to their developments for parks,
playgrounds and public open space purposes as
follows:
A. Provide finished grading, appropriate
ground cover or sodding for playground,
paved trails and perimeter landscaping.
B. Establish park boundary comers for the
purpose of erecting park limit signs. The
developer shall contact the appropriate
parks and recreation department person-
nel for the purpose of identifying park
property corners.
C. Provide sufficient improved public road
access of no less than 300 feet for neigh-
borhood parks and additional frontage for
community parks.

RESOLUTION 2008-
APPROVING CITY OF STILLWATER PARK REGULATIONS
WHEREAS, the City Council finds it necessary to regulate and restrict the use of city parks in order
to protect and maintain a healthful, safe and desirable environment; and,
WHEREAS, the Parks and Recreation Board on reviewed and recommended certain
revisions to the policies regarding the use and rental of city parks; and,
WHEREAS, the policies regarding the use and rental of city parks have been presented to the City
Council.
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Stillwater hereby
adopts the following policies regarding the use and rental of city parks:
General Park Rules/Policies
1. NO party can close off or rent the whole park. Only shelters, bandshell or gazebo areas can be
reserved.
2. Park Hours are 6 am to 10 pm. Teddy Bear Park hours are 8 am to 8 pm.
3. NO tents or canopies can be put in any park until the applicant meets with the Public Works
Superintendent who will assist applicant on where these can be placed for public safety reasons.
4. The Parks Department does not rent out chairs, canopies, tents, or P.A. systems.
5. Live or played music is permitted in the parks as long as the music is toned down and hot
disruptive to the neighborhood that surrounds the park.
6. Dogs are allowed in City Parks (except Teddy Bear Park) but must be on a leash less than six
feet long or housed in a portable crate or kennel. Any animal excrement must be disposed of
properly in a sanitary manner.
7. No park or ballfield reservation can be made for July 4th.
Reservation Information & Fees
City of Stillwater parks are owned by the City and maintained for the benefit of the Community. In
order to maintain City Parks, the City charges for certain services. All private individuals, religious
institutions, and for-profit groups shall pay the normal fees. The City does not charge not-for-profit
groups and educational institutions to use City parks, unless otherwise noted. The City does require a
refundable damage deposit from ALL groups and persons renting park facilities.
Picnic Shelters and Gazebos
Many of our parks have picnic shelters and gazebos that are available to reserve. A full listing
of parks and their amenities is available on our website. A $100 refundable damage deposit
plus one of the following fees is required to hold a reservation for any picnic shelter or
gazebo:

$50 non-residents
Park Open Space Reservations
Any person or group that wishes to reserve park open space area must pay applicable fees and submit
required damage deposits. The fee to reserve park open space is $50 for non-residents. City of
Stillwater citizens do not need to pay a fee to reserve open spaces in City parks. In addition to the use
fee, a $100 refundable damage deposit is required for all open space reservations. No party can rent
or close off the entire park. Applicant may also rent a shelter or gazebo (see pricing above).
Special Events in Stillwater Parks
Large community events require Park Board approval, a $250 refundable damage deposit and a $500
fee. An application is available by contacting the Parks Department.
Wedding Ceremonies
All weddings must submit a $100 refundable damage deposit in order to use a City park for a
wedding. Applicants may also rent a shelter, gazebo or open areas for a wedding (see pricing above).
Pioneer Park Bandshell
The following policy will be used to guide the use of the Pioneer Park Bandshell. It is the intent of the
Park Commission to allow use of the facility consistent with the public purpose of free entertainment
and cultural events for the citizens of Stillwater mindful of the park location in the North Hill
residential neighborhood. A $100.00 refundable damage deposit and a $125.00 fee for Stillwater
residents or for non-residents (anytime). All groups, including not-for-profit groups and educational
institutions, must pay to use the Pioneer Park Bandshell.
· Sponsor shall be a non-profit organization.
· The event must be free and open to the public.
· No merchandise or food shall be sold.
· No promotional signage allowed in the park.
· The capacity of the site and area is 75 to 100 people due to lack of parking.
· The use of the bandshell shall be between 9 am and 9 pm and not to exceed three hours in
duration.
· Events shall not be loud or use obscene language so as not to disturb the surrounding residents.
· Park Board approval must be obtained if the event doesn't fit these guidelines.
High School and Adult League Field Reservations
The Cit y charges to reserve city owned sporting fields for high school and adult league games. The City
does not charge to reserve city owned sporting fields for practices; however, games will take priority over
practices. Previously scheduled practices will be bumped for actual games. No damage deposit is
required for this type of park use. The per game field fees are:
$20.00 for Lily Lake lower ball field
$15.00 for Lily Lake upper ball field
$15.00 for Sunrise Park soccer field
Ballfield Tournaments
Ballfields are available for tournaments. The fee is $150, plus a refundable damage deposit of $150
(Total $300). Only 3.2% beer can be sold. The permit fee to sell is $25/day and must be approved by
the City Council.
Alcohol in the Parks
Permit to Consume:
A Permit to Consume (fee $35.00) for the consumption of any type of alcohol in the parks is required.
Contact the Parks Department to obtain this permit.
Police Officer Required:
If there are more than 75 people in attendance and alcohol is available, you are required to hire one of
the City's police officers. This fee is paid directly to the officer. To schedule an officer for your event
contact the Police Department at

Permit to Sell Alcohol:
To sell alcohol in the parks, the applicant must apply for a temporary liquor license. Contact the City
Clerk at (651) 430-8802.
Skateboarding
The City of Stillwater does not allow the use of skateboards on public streets or right-of-ways.
The City does have a Skateboarding Park located on Curve Crest Blvd (behind the Stillwater
Rec Center). Rules of operation are posted at the facility.
Teddy Bear Park
The park is open to the public but reservations can be made for use of the building. The park play
equipment is designed for children younger than 8 years of age. Due to the nature of Teddy Bear
Park the following rules shall apply to the park:
1. Application forms should be filled in completely and returned to the Parks and
Recreation Department.
2. Reservations must be made a minimum of 7 days in advance for events between 8AM
and 3:00PM Monday through Friday and 10 days in advance for events on Saturday and
Sunday and running after 3:00PM on Monday through Friday.
3. The hours for Teddy Bear Park are 8AM to 8PM or dusk, whichever is earlier.
4. Rentals are limited to the building in Teddy Bear Park. The Teddy Bear Park grounds
and restrooms are a public space that are not part of any facility rentals and shall remain
open to the public at all times.
5. Recurrent reservations are made by special arrangement and may only be made for
twelve (12) consecutive months at a time.
6. A refundable damage/cleaning deposit of$100.00 (per floor and per event) is required for
use, payable with the application.
7. The kitchenette in the facility is NOT a commercial grade kitchen. All food served in the
building by caterers must be prepared off-site in an approved kitchen as required by
Washington County Health Regulations. Caterers shall not cook nor prepare any food on-
site. Caterers must have a valid catering license.
8. THE FACILITY USER WILL BE BILLED FOR ANY DAMAGE OR CLEAN UP
EXCEEDING THE AMOUNT OF THE DAMAGE/CLEANING DEPOSIT, THE
FACILITY MUST BE RETURNED IN THE SAME CONDITION AS LOANED.
9. The balance of the reservation fee must be paid seven (7) days in advance for events
between 8AM and 3:00PM Monday through Friday and ten (10) days in advance for
events on Saturday and Sunday and running after 3 :OOPM on Monday through Friday
calendar days prior to the reservation date(s). No person or group may use a City facility
unless all fees and deposits are paid in advance.
10. Cancellations are accepted up to and including seven (7) days in advance for events
between 8AM and 3:00PM Monday through Friday and ten (10) days in advance for
events on Saturday and Sunday and running after 3:00PM on Monday through Friday
calendar days prior to the reservation date(s). Cancellations made prior to this time will
receive a full refund of the deposits. The damage/cleaning deposit will be forfeited if the
reservation cancellation after the times stated above.
11. PER 948-4 OF STILLWATER CITY CODE, NO INTOXICATING LIQUOR OR
NARCOTICS SHALL BE USED IN TEDDY BEAR PARK AND VIOLATION OF
THE REGULATION WILL CAUSE CANCELLATION OF THE RESERVATION
AND DENIAL OF FUTURE USE OF CITY FACILITIES TO SUCH
ORGANIZATION.
12. No structures may be erected or assembled on premises, nor may any electrical,
mechanical, vehicles or other equipment be allowed on premises, unless special approval
has been obtained from the Parks and Recreation Department.
13. Nothing shall be sold, offered or advertised for sale on or in City facilities unless correct
licensing procedures are followed according to Stillwater City Code.
14. All reservations are subject to periodic review by the Parks and Recreation Department
and may be cancelled after due notice. The Department reserves the right to cancel any
reservation for due cause, including but not limited to activities that are incompatible
with the intended use of the park, and shall notify the person or organization of its action
immediately.
15. An approved copy of this form and payment receipt should be brought to the facility by
the user.
16. The person filling out this form must. be 21 years of age or older. If the facility will be
used by patrons under the age of 21 years old, there must be at least one adult on site at
all times.
17. At all assemblies of minors, responsible ad)llts must be present throughout the function.
Additional security may be required, the cost of said security to be paid by the person or
group reserving the park/facility.
18. A Special Event Permit is required for all outdoor events open to the public. Any
application requiring a Special Event Permit or amplified sound must be submitted a
minimum of 30 days prior to the reservation date. An approved copy of the Special Event
Permit must be received by the Parks and Recreation Department at least ten (10) days
prior to the event.
19. No dogs or pets, except service animals and zoo animals, may be in or upon Teddy Bear
Park.
20. Applicant must abide by all the rules and regulations of the Stillwater City Code.

Informational items for the February 23, 2009 Parks Commission meeting
Item 6 -Review Parks Binders
At the meeting on February 28th, binders will be distributed to each Commission member. Staff
has inserted copies of the current commission roster; Chapter 48 of the City Code on Parks and
Recreation and current park fees & rules; a current park inventory and map; and, the parks
chapter from the draft 2030 comprehensive plan and the 2000 comprehensive trail plan.
Item 7 - Advertising of Teddy Bear Park Building Rental
At the last meeting a Commissioner asked staff to approach the Library to see if the Library's
new events coordinator could also advertise Teddy Bear Park. In talking with Library Director
Lynne Bertalmi~ it was discovered that the events coordinatoris a private contract employee of
Friends of Stillwater Public Library and not an employee of the City. Any arrangement to
utilize the events coordinator would need to be approved by the Friends of Stillwater Public
Library Board and likely would need some level of monetary contribution by the City to
support the position. Since the current rental fees are low compared to what the event
coordinator would expect for payment it does not appear to be realistic to use their service. The
Commission should discuss this and direct staff on how to proceed
On a separate note, the City will include an article in the upcoming spring newsletter
advertising the availability of the Teddy Bear Park Building and other park services that are
available to the Community. If the Commission has other ideas on how to more effectively
advertise Teddy Bear Park staff would be interested in hearing those ideas.
Item 8 - Snow Plowing of Myrtle Street/County 12 Trail
In working with the County to enter into an agreement related to the plowing of the trail along
Myrtle Street/County 12 the County discovered an old agreement between the City and
County related to snow plowing of this trail and others in the Community. Attached is a copy
of the agreement. This agreement permits the City to plow this and other sections of trail along
County roads. The City will begin plowing this section of trail as needed when other trails
around the community are plowed.

WHEREAS, bike paths have been constructed by the County at Neal Avenue to
Owens Street on the south side of McKusick Road (eR 64} and Croixwood
Boulevard to the Firstar Bank entrance on the east side of Stillwater .Road (CSAH
5) and from Brick Street to the west city limits on the south side of west Myrtle
Street (CSAH 12) in Stillwater; and,
WHEREAS, the County does not provide winter maintenance of bike Paths;
WHEREAS, the City desires to maintain bike paths during the snow season,
approximately October 15 to April 30 of each year;
NOW THEREFORE, IT IS AGREED AS FOLLOWS:
1. The County grants the City permission to maintain ,mcl remove snow and ice
from the bike paths.
2. Prior to its Use,. aHequjpment used for bike path maintenance and SnOW
removal must be approved by the County Engineer.
3. The City must pay to the County for repair of any damage to the paths,
signage or grass areas near the paths that is caused by the maintenance
activities. Payment must be made within 90 days of any valid claIm of
damage.
4. The snow mUst not be discharged from the path areas towards the roadway.
If the City removes the snow and discharges it towards the roadway I the
City will be responsible to the County tor payment of the extra cost to
remove this snow from the roadway.
5. The City may exclude uses, such as motorized vehicles, by City ordinance.
Any signing must be done by the County and will be City expense.
6. This agreement can be terminated at any time by either party giving written
notification.
7. The City shall indemnify, save, and hold harmless the County and all of its
agents and Eimployees of and from any and all claims, demands, actions or
causes of action of whatsoever nature or character arising out of, or by
reason at the performance of any work by the City provided herein, and
further agrees to defend, without cost or expense to the County, its agents
or employees, any action or proceeding commenced for the purpose of

that mayor might arise under the Workmen's Compensation Act of this
