Chair Lieberman called the meeting to order at 7 p.m.
Approval of minutes: Mr. Johnson, seconded by Ms. Hudak, moved approval ofthe min'utesof
Dec. 1, 2008. Motion passed unanimously.
Mr. Lieberman introduced new member Jerry "Reggie" Krakowski.
PUBLIC HEARINGS
Case No. DEM/09-01 A demolition request for a detached garage at 1004 Sixth St. S. in the RS,
Two Family Residential District. Ryan and Vanessa Mitchell, applicant.
The applicants were present. Mr. Lieberman reviewed the nine requirements of the derrlolition
ordinance. The applicants spoke of the poor condition of the existing structure; they stated the
building has been advertised as a give-away, with no calls received. Mr. Lieberman said it
appeared the nine required steps had been followed. Mr. Johnson said he had looked at the
structure from the street and it appears the garage is not one original constructicm, and he said
he did not believe there is anything architecturally significant about the structure. Mr. Lieberman
opened the public hearing; no comments were received, and the hearing was closea. Mr.
Johnson, seconded by Ms. Hudak, moved approval of the requested demolition permit. Motion
passed unanimously.
DESIGN REVIEWS
Case No. 09-02 Design review of an accessory dwelling unit at 1004 Sixth St. S. in the RS, Two
Family Residential District. Ryan and Vanessa Mitchell, applicant.
The applicants were present. Mr. Lieberman read into the record a letter from Cynthia Kneisl,
1010 S. Sixth St., expressing her CGncern with plans for the new structure. Ms. Mitchell stated
they would like to build a new 2 and one-half car garage with an apartment above. She said
they have no plans to rent out the accessory unit - her mother will live there and they will use
the unit when they jack up their house sometime in the future. Mr. Johnson -asked about
materials/design of the new structure compared to the existing house. Mr. Mitchell said the roof
lines, siding and details will be the same as the original house. Mr. Johnson pointed out the
house has a 12-12 roof pitch, while the new garage h,as a pitch of about 7-12. Mr. Mitchell said
changing the roof pitch will take away more of the standing room in the accessory unit; he also
noted there are three different roof pitches on the primary structure. Mr. Johnson suggested the
roof pitch is' a significant design element when viewed from the street and suggested lowering
the side walls will provide the same usable space/height in the accessory unit. Mr. Tomten
suggested the pitch of the new structure should match the pitch of the main gable of th~ primary
structure. Mr. Tomten also said it would be important for the trim boards, fascia and soffits of the

new structure to match the main house; Mr. Mitchell said all details would be the same as the
original house. Mr. Johnson asked if consideration had been given to having double-hung
windows in the front of the new structure; Mr. Mitchell said that would be difficult due to the
location of the bathroom in the accessory unit.
There was discussion regarding Ms. Kneisl's concern regarding the possibility of windows on
the south side of the new building. Mr. Mitchell pointed out that it is Ms. Kneisl's dwelling that is
extremely close to the property line. Mr. Mitchell said he has no plans for windows on the south
side at this time, but. would prefer that not be a condition of approval. Mr. Johnson suggested
off.setting the location of any windows on the south side to alleviate the neighbor's concerns to
the.extent possible. During discussion, Mr. Mitchell also stated they would prefer to have two
single doors for the garage, but thought that was not the HPC's preference.
Mr. Lieberman invited comments from the public. No comments were received. Mr. Johnson
moved approval as conditioned with the additional conditions that the roof pitch match the pitch
of the primary gable of the existing structure or be at least a 9: 12 pitch; that ,the siding, corner
and frieze boards and other details match the primary structure; that the garage door be two
single, separated doors; and that there be no windows on the east half of the south side of the
new structure. Mr. Lieberman asked that a condition be added that final plans be submitted to
City staff for review; Mr. Johnson agreed to add that condition. Mr. Lieberman seconded the
motion; motion passed unanimously.
Case No. 09-03 Design review of signage at 2510 Curve Crest Blvd. in the BP-C, Business Park
Commercial District. Twin Cities Sign Images, Inc., applicant.
The applicant was hot present. It was noted in the agenda packet that the proposed sign meets
the intent of the sign ordinance. Mr. Tomten, seconded by Mr. Lieberman, moved approval as
conditioned. Motion passed unanimously.
NEW BUSINESS
· Mr. Pogge noted the annual report to SHPO was included in the agenda packet and
briefly reviewed some of the highlights of the report.
. Mr. Johnson asked whether the new sign regulations for the West Business Park had
been adopted and whether the HPC would receive a copy; Mr. Pogge responded in the
affirmative to both questions. .
. Mr. Zahren asked about requirements for snow removal from sidewalks in the downtown
area. Mr. Pogge stated ultimately that is the property owner's responsibility.
. Mr. Tomten asked about the status of a house on Churchill Street that is in the process
of being demolished/reconstructed. Mr. Pogge stated the City granted an emergency
demolition permit for the rear of the hou~e and stated the new construction was
supposed to be similar to the original. Mr. Tomten pointed out the west wall of the new
cbnstruction changes the appearance dramatically. Members questioned why the project
had not been red-tagged considering the project had not been through design review
and the building doesn't meet its permit specifications. After discussion, Mr. Pogge
stated staff would red-tag the project.

· Mr. POgg6 asked for input on Mr. Empson's proposal to do several entries On houses
that have been demolished as part of the Heirloom Home web site. Mr. Pogge noted that
homeowner permission has been sought in the past before a home is included on the
site. It was agreed that precedent should be followed. Mr. Tomten suggested that
perhaps Mr. Empson could develop an article explaining how the City's demolition
ordinance came about; Mr. Johnson suggested including several alternative- to
demolition success stories.
· Ms. Hudak asked if a demolition permit had been granted for a house on Laurel Street.
Mr. Pogge responded that the house in question had been built over a cistern and was in
danger of collapse.
D Mr. Johnson asked if Mainstream Development had submitted the required mechanical
and roof plans. Mr. Pogge stated the developers have not yet applied for a building
permit.
The 'meeting was adjourned at 8:15 p.m. on a motion by Mr. Lieberman.

DISCUSSION
The applicant has submitted plans for a new single-family home at 702 Churchill St W.
The proposed home is to be located on a parcel that is 50' x 138' for a total area of 6,900
square feet. The footprint of the home is approximately 1,205 square feet and is the
same general footprint of the previous home. The detached garage is approximately 22'
x 22' and faces toward Harriet St S. The applicant notes in the application that the
garage is proposed to remain. This property is in the Neighborhood Conservation
District (NCD) and is subject to the Stillwater Conservation District Design Guidelines.
EVALUATION OF REQUEST
All infill homes in the NCD are required to follow the NCD design guidelines. These
design guidelines serve as a common reference for all those involved in the process of
new construction in the district including property owners, neighbors, residents,
architects, designers, builders, city staff, and the commission. The guidelines are
intended to serve as a framework to guide the design process, while allowing for
individuality and creativity in architectural design. Twenty-seven guidelines make up
the NCD design manual. These guidelines cover three (3) general areas including
Neighborhood and Streets, Building Site, and Architectural Detail.

Neighborhood and Streets
The home will follow the same general setback that has been set along both Churchill
Street and Harriet Street. As a detached garage located behind the home the primary
street frontage (Churchill Street) will have a very clean appearance.
The only area that could be concerning is related to Guideline #1 - Massing and scale of
a new building should be compatible with neighboring structures. The surrounding lot
average 13,244 square feet and range between 9,001 to 15,608 square feet. This lot is
6,900 square feet in size. According to Washington County the average livable area of
the surrounding homes is 1,405 square feet and range between 930 to 2,871 square feet.
The former home has a total living area of 1,279 square feet. The living area for the
proposed home is approximately 3,033 square feet. From Churchill Street the physical
massing of the home will be substantial similar to the previous home. The additional
living space is located in both the basement and the new second floor area over the rear
portion of the home. Since Harriet Street is a dead end street, the impact of the
additional living space should be minimal.
Building Site
No grading has occurred on the site and for the most part none of the landscaping on
the site has been disturbed by construction since the footprint of the previous home is
being used.
Architectural Detail
The home proposes to have 5-inch smooth hardie plank lap siding with 6-inch corner
boards and a 12-inch horizontal band generally separating the floors. The windows are
double hung with decorative moldings. The proposed home does a very good job of
containing consistent and highly detailed architecture on all four sides of the building.
The footprint of the proposed home is comparable to that of the former home with a
portion of the old foundation being used for part of the new home.
Zoning Considerations
The previous home was a legal non-conforming structure for failing to meet both the
required front yard (along Churchill) and exterior side yard (along Harriet) setbacks
and for exceeding the allowable building coverage of 25%. State Statue 462.357 Subd.
Ie. and City Code Sec 31-216 regulate non-conforming structures and II grandfathering"
rights of a structure. Under these codes, a structure is permitted to be replaced and
continue the conformities of the previous structure. In this case, since the same general
footprint is being used the new structure it is permitted to retain the previous setback
and building coverage without a variance or other zoning approval.

ALTERNATIVES
The HPC has several alternatives.
A. Approve. If the proposed changes and plans are found acceptable to the HPC, it
should be approved. Staff would recommend the following minimum condition
for approval.
1. All minor modifications to the plans shall be approved in advance by the
Community Development Director. All major modifications shall be
approved in advance by the HPC. Determination of the distinction between
"major" and" minor" shall rest with the City Administrator.
B. Approve in part.
C. Deny. If the HPC finds that the proposal is not consistent with the approved
design guidelines, it could deny the requested amendment. With a denial, the
basis of the action should be given.
D., Table. If the HPC needs additional information to make a decision, the requested
could be tabled until your March 2,2009 meeting so that additional information
could be submitted. The 60 day decision deadline for the request is March 17,
2009.
RECOMMENDATION
Review and take action on the request.

DISCUSSION
The applicant is requesting design review and approval for a sign at 350 Main St N.
This site is within the Mills on Main building. The sign is proposed to contain the
business name "RBC Wealth Management". The lettering is proposed to be gold color.
The background is proposed to be a medium blue color. The proposed sign is 13'9"
wide and 2'9" tall for a total area of 37.8 square feet.
For retail storefront signs the Commercial Historic District Design Manual provides the
size of signs shall be consistent with the Sign Ordinance. The zoning ordinance states
building signs in the CBD '.. .may have an aggregate area not exceeding one square foot
for each foot of building face. . .'. The applicant's retail space is 113 feet long facing
Main St. The total sign area of the proposed sign is 37.8 square feet which is larger than
allowed under the zoning ordinance.

Mills on Main Sign Plan
The original building plans called for a steel beam to be installed flush with the front of
the building just above the entryway (See attachment II A"). This beam was never
installed. The sign plan called for wall signs to be installed in one of two locations. 1)
In a location along the outer building wall that specially designed for wall signs or 2)
mounted to the steel beam with the sign hanging below the beam. At this location, the
wall sign was called out to be mounted on to the steel beam. The sign could be
mounted direct to the building above the entryway and allowed to hang; however,
there are two issues with this approach. First, the hanging sign would be low enough
where it could become an attractive nuisance and damaged by pedestrians. Second, the
deck above the entryway projects out from the building and thus limits light exposure
for the sign. For these reasons staff believe that the applicant's proposal makes the most
sense.
Staff recommends two changes to the proposal. First, the sign should be expanded
horizontally so it extends to the mid-point of the vertical projections between the
windows. The bricks between the windows project approximately 4 inches further out
than the rest of the brick. By expanding the sign horizontally the sign will have a solid
area to be mounted to. The second change is that the sign should be anchored into the
mortar joints and not directly into the brick.
RECOMMENDATION
Approval as conditioned.
CONDITIONS FOR APPROVAL
1. All revisions to the approved plan shall be reviewed and approved by the Heritage
Preservation Commission.
2. The sign shall be expanded horizontally so it extends to the mid-point of the vertical
projections between the windows. Revised sign plans shall be submitted to City
Staff for approval prior to installation of the sign.
3. The sign shall be mounted into the mortar joints and not directly into the brick.
4. No additional signage.
FINDINGS
The proposed sign meet the requirements of the zoning ordinance. The proposal meets
the intent of the Commercial Historic District Design Manual.

BACKGROUND
We are now approximately half way through the second phase of the Heirloom and
Landmark Sites project and it is time again to apply for a CLG Grant for the second phase
of the project.
Staff has prepared the attached grant application which represents the third phase of what
'is anticipated to be the last phase of the project. This phase of the project would include the
following work elements:
· Complete detailed histories for all 61 Landmark Sites. The histories will be completed
by a qualified consultant meeting the Secretary of the Interior's Professional
Qualifications Standards. Data from the completed histories will be delivered to
Minnesota Historical Society in an electronic database format. Histories will also be
available on the City's website.
Fuhne Phases
Once this phase of the project is completed, the City anticipates that a local designation program
for individual properties and neighborhoods will be established by the City.
RECOMMENDATION
Review and make a recommendation to City Council regarding the FY 2009 CLG Grant
Application to the Minnesota Historical Society.

the 2006-2010 statewide preservation plan.
The City of Stillwater is seeking funding for the third phase ofthe City's Heirloom and Landmark Sites
Program. The overall program consists of three main components. First is a website that highlights and
educates the community on significant historic properties within the City. Second, the website includes
educational links related to restoration from the National Park Service's preservation briefs series along
with material that is specific and important to Stillwater historic properties. Third, the program will
recognize and honor property owners that own and maintain significant historic properties in the City of
Stillwater. In the future, this program could also lead to a local designation program for the
community's historic residential neighborhoods and its homes.
Description of the activities which have resulted in the identification of the properties to be evaluated:
This program is based on a series of previous CLG grant-funded projects. Since 1992, the city has completed
ten architectural surveys in which significant historic stmctures were identified. In 2005, a Donald Empson was
retained as a consultant to the City to evaluate the survey information and develop a plan to implement a local
designation program. Mr. Empson recommended a two-tier program consisting of 1) Heirloom Homes and 2)
Landmark Houses and Sites.
Heirloom Homes are a cross-section of homes are a representative of nineteenth-century Stillwater
containing a fair amount of their original design elements. These homes are generally not eligible for
listing in the National Register of Historic Places, but due to local significance have the potential to be
recognized in some manner.
Landmark Houses and Sites are the finest historic homes and most remarkable sites in Stillwater. They
have architectural integrity and strong ties to the history of Stillwater. These properties may be eligible
for or already listed in the National Register of Historic Places and have the potential for local
designation.
The analysis of the survey data resulted in the identification of 837 properties that could potentially be included
in the program -776 Heirloom Homes and 61 Landmark Houses and Sites.
Project products, steps and responsible party:
The main element of the program is the interactive website that features Stillwater's significant historic
properties. Each property listed will include a photo (both a current photo and, if available, a historic photo),
location map and specific information including construction date, builder, architect, architectural style, and a
narrative. The information for these listings will come from a variety of primary and secondary sources in order
to complete a detailed survey of the property. Sources could include previously completed architectural
surveys, previously completed SHPO inventories of surveyed properties, insurance maps, city directories,
photographs, and other sources.

The first step of implementing the program was to develop a web infrastmcture to support to the program. This
phase of the project was funded with a CLG grant in 2007-2008 and has been completed. The site can be found
at http://www.stillwaterhistorv.com. The key to the site is the ability to search for properties in a multitude of
ways and to create personalized walking guides for these sites. With the first grant in 2007-2008,69 Heirloom
Homes were added to the website. The initial website development was completed.
The second phase ofthe project is cun-ently underway and funded in pati with a 2008-2009 CLG Grant.
Initially this phase of the program aimed to complete inventories on an additional 300 of the Heirloom Homes.
After much work, it became clear that completing 300 additional inventions in one year was unrealistic for the
quality of work that the City and Consultant desired. Additionally, after reviewing several of the homes that
were initially identified as potential Heirloom Homes it was felt that not all 700+ of them should be listed in the
program. Therefore, the City is now aiming to complete 60 to 65 histories for this second phase of the program.
This will also complete the majority of the Heirloom Homes that will be listed on the site. In the future,
additional homes maybe listed; however, this will be done on a case by case basis and it is unlikely the city will
complete a mass listing similar to the effOlis cun-ently underway.
PROJECT STEPS:
Complete histories. July 1,2009 - June 30, 2010. For the next phase the City is proposing to have the 61
identified Landmark Sites reviewed and included on the program's website. A consultant will be hired to
complete the a listing for the website on each of the Landmark Sites. A verity of sources including previously
completedSHPO inventories of surveyed properties, insurance maps, city directories, photographs, and other
sources will be used to create the information that will be posting on the website. The consultant will also
solicit voluntary participation for property owners employing a verity of means including: letters, open houses,
and personal contact with the property owners. If the property owner voluntarily agrees, the completed
inventories will be added to the web site once they are completed. Additionally, the property owner will receive
recognition from the City Council and HPC. The final inventories will be reviewed and approved by the HPC
and SHPO.
ADDITIONAL WORK ELEMENTS:
Standards to be followed:
A qualified consultant (meeting the Secretary of the Interior's Professional Qualifications Standards outlined on
page 44738 in the Federal Register of September 29, 1983) will be hired to evaluate properties that have been
identified as potential local designation candidates in the previous surveys. The project will conform to the
Secretary of the Interior's Standards for Survey and Evaluation (outlined in the Federal Register of 9-29-83) and
the MN SHPO's Guidelines for Architecture/History Projects (July 2005).
The consultant will use the city's historic contexts to evaluate each of the properties. In addition, the consultant
will use the following criteria established by city ordinance:
(a) Its character interest or value as part of the development heritage or cultural characteristics of the City of
Stillwater, State of Minnesota or United States;
(b) Its location as a site of a significant historical event;
(c) Its identification with a person or persons who significantly contributed to the culture and development
of Stillwater;

(d) Its embodiment of distinguishing characteristics of an architectural style, period, form or treatment Its
identification as work of an architect or master builder whose individual work has influenced the
development of Stillwater;
(e) Its embodiment of elements of architectural design, detail, materials or craftsmanship which represent a
significant architectural innovation; and
(f) Its unique location or singular physical characteristic representing an established and familiar visual
feature of a neighborhood, community or the City of Stillwater.
Relationship to statewide plan: This project relates to Goal #1, "Create statewide awareness of and
appreciation for the value of Minnesota's historic and archaeological resources" and Goal #5, "Expand and
enhance efforts to identify, evaluate and designate historic and archaeological resources" ofthe MNSHPO's
statewide preservation plan issued in 2006-20 I O. The information developed through the project will be web-
based and will inform citizens of the state and beyond about the historic assets in Stillwater. This project also
moves the community closer to establishes a local designation program for residential properties to increase
recognition and protection ofthese resources.
Cost to the Public: The City of Stillwater does not intend to charge the public for any of the work developed as
part of this grant. Additionally the public will be able to view, without charge, the web site developed as part of
this proj ect.
11. Project Products
This project is the third phase of what is anticipated as a three phase program to recognize the "Heirloom
Homes" and the "Landmark Sites" in the City identified in the DesignatinJ?: Historic Homes and Historic
Districts report by Mr. Donald Empson dated July 2006. Copies of all of the work products will be forwarded
to SHPO. The third phase of the project would include the following:

12. Community Support
The Stillwater Heritage Preservation Commission, Planning Commission and the Stillwater City Council have
been monitoring the surveys and strongly support the program. As property have been listed on the site, a
number of the property owners have provided notes of support and gratitude for both the information that was
developed on their home but also the honor of being part of the program. Cash and match in-kind services
amounting to $9,539.00 will be contributed to the 2009/2010 project.
13. Project Impact
This project will serve as an education tool for both the Community of Stillwater and to the larger community.
This project will also provide a complete set of inventories for all of the Heirloom and Landmark Sites in the
City of Stillwater. Finally, the proj ect will provide a basis for any future local historic designations of sites,
buildings and districts.
14. Project Personnel
The City of Stillwater will retain the services of a qualified consultant to assist with the research and evaluation
and report writing. This consultant will meet the Secretary of the Interior's Professional Qualification
Standards (as published in the Federal Register of February 29, 1983) as stipulated in the project description.
To assist the consultant, the Heritage Preservation Commission and Stillwater Planning staff will solicit the
participation of local historians and the Washington Historical Society to help gather information and photos on
these sites. The City Planning Department will be responsible for the management of the grant and serves as
staffto the Heritage Preservation Commission. The City has budgeted 50 hours to the management ofthe grant
and the project.

ZONING ORDINANCE
Subd. 3. In yards. Fences may be permitted in
all yards, subject to the following:
(a) Fences in excess of six feet above the
ground grade are prohibited in residential
districts.
(b) The side of the fence considered to be the
face (finished side as opposed to struc-
tural supports) shall face abutting prop-
erty.
(c) No fence shall be permitted on public
rights-of-way.
Cd) No fence may be erected on either street
side of a corner lot that will obstruct or
impede the clear view of an intersection
by approaching traffic, subject to the pro-
visions of Section 31-505, Subd. 2 that
would control where inconsistent with this
prOVISIOn.
(e) In residential districts fences are limited
to a height of 42 inches in the front yard
and exterior side yard setback areas.
(f) No fence shall be erected where it will
impede a drainageway or drainage ease-
ment.
(g) No fence shall be erected before all lots
within a drainage system or platted block
have had the final grade established and
approved and all lots within the system or
platted block have had turf established
with grass seed or sod.
Subd. 4. Along property lines. Fences may be
permitted along property lines subject to the
following:
(a) Fences in residential districts may be
placed on the lot line provided that the
footings are within the fence owner's prop-
erty,
(b) Fences in commercial or industrial dis-
tricts may be erected on the lot line to the
height of six feet; to a height of eight feet
with a security arm for barbed wire.
Subd. 5. Existing. No existing fence in violation
of this Section 31-508 will be a]]owed to be re-

placed or rebuilt. Should an existing fence be
replaced or rebuilt, it must come under the regu-
lations of this Section 31-508.
Subcl. 6. Impeding clrainageways and ease-
ments. No fence shall be erected where it will
impede a drainageway or drainage easement.
Subd. 7. Violations. Violations of Section 31-
508 may be enforced by injunction, and the city
shall be entitled to the remedy of abatement in
order that a fence erected in violation of Section
31-508 may be removed.
Sec. 31-509. Sign regulations.
Sign regulations are as fo]]ows:
Subd. 1, Purpose. Signs have an impact on the
character and quality of the environment. They
attract or repel the viewing public and affect the
safety of vehicular traffic. As a historic commu-
nity, this city is unique. The proper control of
signs is of particular importance because of this
historical quality and uniqueness. Signs must be
kept within reasonable boundaries consistent with
the objectives and goals of the community to
retain its special character and economic advan-
tages which rest in part on the quality of its
appearance. The standards in this subdivision are
therefore adopted to regulate signs.
Subd. 2. Permits required. All signs require a
design review permit. An application for design
review may be obtained from the community
development director. The application must con-
tain the following information:
(a) A drawing of the proposed sign showing
dimensions and describing matelials, let-
tering, colors, illumination and support
systems.
(b) Photographs of the building face and the
building faces of any adjacent buildings.
(c) A drawing of the building face and site
plan showing the location of the proposed
sign.
(d) A cross section of the building face show-
ing how the sign will be attached and how
far it will extend from the building.

(e) Any pictorial proof or other information
that the sign is of historical significance
or is a reproduction of an historic sign.
(f) A building sign plan for a building with
more than one use or business, showing
all signs.
Subd. 3. General provisions. The following pro-
visions apply to signs located in all zoning dis-
tricts:
(a) All signs and sign structures must be
properly maintained and constructed of
sufficiently permanent materials so they
will resist weathering, Any existing sign
that is rotted, unsafe, deteriorated, de-
faced or altered must be repaired or re-
placed.
(b) Electrical signs must be installed accord-
ing to the state electrical code.
(c) No signs other than governmental signs
may be erected or temporarily placed
within any street right-of-way or upon
public lands or easements or right-of-
ways without city council approval.
(d) No sign or sign structure may be erected
or maintained if it prevents free ingress
or egress from any door, window or fire
escape. No sign may be attached to a
standpipe or fire escape.
(e) A 30-day temporary sign permit may be
granted by the community development
director for special business events,
(f) Signs or supporting structures not used
for signs for 12 consecutive months must
be removed.
(g) The city may grant a permit to locate
signs or decorations on, over or within the
right-of-way for a specified period of time.
(h) All signs must be compatible with the
building and neighborhood where located.
(1) No more than three flags may be dis-
played outside of a building.
U) A sign must not obscure architectural
features of a building.
(k) A building address is not a sign.

(l) The terms of this subdivision may be
waived if the sign is an historic resource
or if the sign is a reproduction of an
historic sign.
(m) Graphic design signs require a special use
permi t.
Subd. 4. Permitted signs. The following signs
are allowed without a permit in all zoning dis-
tricts but must comply with this Section 31-509:
(a) Public signs, integral signs, political signs
and safety signs.
(b) Size, The size of a political sign is regu-
lated as follows:
(1) Residential and CA districts: The
maximum sign size is six square feet
in area with a maximum height of
four feet.
(2) IP districts: The maximum size is 35
square feet in area. Notwithstand-
ing this provision, all noncommer-
cial signs of any size may be posted
from August 1 in a state general
election year until ten days following
the state election.
(c) Holiday signs for a period not to exceed 60
days.
(d) Construction signs. The signs must be
confined to the site and must be removed
within two years ofthe date of issuance of
the first building permit or upon comple-
tion of the project, whichever occurs first.
One sign is permitted for each street the
project abuts. No sign may exceed 32
square feet in multifamily residential, com-
mercial and industrial districts and 12
square feet in single-family residential
districts.
(e) Real estate signs are limited to six square
feet in residential districts and 32 square
feet in commercial districts. Signs must
be removed within ten days after sale or
rental of property.

(g) One nameplate sign, placed on a wall of
the structure, for each dwelling not ex-
ceeding two square feet in area per struc-
ture. No Sigl1S shall be so constructed as
to ha ve more than two surfaces.
(h) One nameplate for each dwelling group of
six or more units. The sign may not ex-
ceed six square feet in area per surface.
No sign may be constructed to have more
than two surfaces.
(i) Real estate development project signs.
For a development project of three to 25
acres, one sign not to exceed 100 square
feet of advertising surface may be erected
on the project site. For projects of 26
through 50 acres, one or two signs not to
exceed 200 aggregated square feet of ad-
vertising surface may be erected. For
projects over 50 acres, one, two or three
signs not to exceed 300 aggregate square
feet of advertising surface may be erected.
No dimension shall exceed 25 feet exclu-
sive of supporting structures. The sign
may not remain after 95 percent of the
project is developed. The permit for the
sign must be renewed annually by the city
council, and must be bordered with a
decorative material compatible with the
surrounding area. If the signs are lighted,
it must be illuminated only during those
hours when business is in operation or
when the model homes or other develop-
ment are open for conducting business.
(j) No sign permit is required for window
signage that does not cover more than
one-third of the total area of the window
in which the sign is displayed.
(k) Temporary signs advertising garage sales
are permitted, provided that:
(1) the signs not exceed four (4) square
feet; and
(2) may not be more than three (3) feet
in height above grade; and

(3) are removed the same day when the
sale closes for each day; and
(4) are permitted by the owner of the
property on which they are placed;
and
(5) no more than two garage sales per
year are held by any address in any
calendar year; and each sale may not
last longer than three days; and
(6) no sign may be placed upon the
right-of-way nor in parks or on pub-
lic property in a manner that creates
a nuisance to adjacent owners, cre-
ates a safety hazard or blocks the
view of entrances to streets or inter-
sections.
CD Temporary real estate "open house" signs
may be placed in the right of way provided
that:
(1) The sign not be placed in a manner
that creates a nuisance to adjacent
owners, does not create a safety haz-
ard or block the view of entrances to
streets or intersections.
(2) A sign may be placed one-half hour
before the open house and must be
removed each day immediately after
the open house closes.
(3) A maximum of four signs in residen-
tial zoning district for each open
house.
(4) A sign must not exceed SIX square
feet.
(5) Signs are limited to a four block
radius of the open house.
Subd. 5. Prohibited signs. The following signs
are prohibited in all zoning districts:
(a) Any sign that obstructs the vision of driv-
ers or pedestrians or detracts from the
visibility of any official traffic control de-
VIce.
(b) Any sign that contains or imitates an
official traffic sign or signal, except for
private, on-premises directional signs.

(c) Off-premises advertising signs except as
regulated by this Section 31-509,
(d) Any sign that moves or rotates including
electronic reader board signs, except ap-
proved time and temperature information
signs and barber poles.
(e) No sign may display any moving parts, be
illuminated with any flashing or intermit-
tent lights or may be animated, except
time and temperature information. All
displays must be shielded to prevent any
light from impairing the vision of any
driver. No device may be illuminated to
obscure an ofJicial traffic sign or signal.
This includes indoor signs which are vis-
ible from public streets,
(D Roof signs.
(g) Any sign with banners, pennants, rib-
bons, streamers, string oflight bulbs, spin-
ners or similar devices, except where used
for noncommercial purposes or as part of
an approved sign plan.
(h) Portable signs including signs with wheels
removed, attached temporarily or perma-
nently to the ground. Signs mounted on a
vehicle for advertising purposes, parked
and visible from the public right-of-way,
except signs identifying the related busi-
ness when the vehicle is being used on the
normal day-to-day operations ofthat busi-
ness, Hot air or gas filled balloons or
semi truck umbrellas used for advertising.
(i) Signs painted directly on building walls
unless approved by sign permit.
(j) Illuminated signs or spotlights giving off
an intermittent or rotating beam.
(k) Revolving beacons, beamed lights or sim-
ilar devices.
(1) Signs supported by a guy wire.
(m) No sign may be erected, placed or main-
tained by any person on rocks, fences or
trees.
(n) No sign may be erected that will interfere
with any electric light, power, telephone
or telegraph wires or the supports thereof.

Subd, 6. Permitted signs in residential dis-
tricts, Signs permitted in residential districts are
as follows:

The following signs are permitted in the CBD-
central business or CA-general commercial dis-
tricts with a sign permit:
(a) General requirements. All signs in the
CA-general commercial or CBD-central
business districts are regulated by the
following requirements:
(1) Number. One wall, monument, aw-
ning and canopy or three dimen-
sional sign is allowed per business.
When a building or business abuts
two or more public streets, an addi-

a street lot line with a maximum of
25 square feet per business.
(c) Freestanding signs. Freestanding signs in
the CBD or CA districts shall meet the
following requirements:
(1) Area. The area of a monument type
freestanding sign may not exceed 30
square feet.
(2) Location. A monument sign may be
located in any required yard but
must have a setback of 15 feet from
any point of vehicular access, public
roadway or property line.

(3) Height. A monument sign may not
project higher than six feet, as mea-
sured from the base of sign or grade
of the nearest roadway, whichever is

(4) Landscaping. The area around a mon-
ument sign must be landscaped.

internally illuminated signs are al-
lowed.
(d) Awning and canopy signs. Awning and
canopy signs in the CBD or CA districts
shall meet the following requirements:
(1) Area. The gross surface of an awning
or canopy sign may not exceed 50
percent of the gross surface area of
the smallest face of the awning or
canopy to which the sign is afIixed.
(2) Location. An awning or canopy sign
may not project higher than the top
of the awning or canopy or below the
awning or canopy.
(e) Three-dimensional sign. The total area of
a three-dimensional sign in the CBD or
CA districts is determined by enclosing
the largest cross section of the sign in an
easily recognized geometric shape and
computing its area. The area may not
exceed nine square feet.
(f) Projecting sign. A projecting sign in the
CBD or CA districts shall meet the follow-
ing requirements:
(1) Area. The total area of a projecting
sign may not exceed six square feet.
(2) Special conditions. A projecting sign
must be easily visible from the side-
walk and not be a hazard to pedes-
trians.

Subd, 12. Nonconforming signs. Nonconform-
ing signs that are unlawful on December 20,1988,
have rights outlined in Section 31-216 of this
chapter with respect to their alteration, exten-
sion, restoration and abandonment. Any person
violating or failing to comply with any provision of
this subdivision will, upon conviction, be guilty of
a misdemeanor.
Subel. 13. Violations. If violations of this sub-
division are unabated 30 days after written notice
to the record owner of the property on which the
sign is located, the city may proceed to abate and
remove the violation and, if deemed necessary, to
have cost thereof specia11y assessed against the
lot or parcel where the violation was located.

AN ORDINANCE AMENDING CHAPTER 31, ENTITLED ZONING ORDINANCE BY
CHANGING REGULATIONS RELATED TO SIGNAGE IN THE BP-BUSINESS PARK
ZONING DISTRICT.
THE CITY COUNCIL OF THE CITY OF STILL WATER DOES ORDAIN:
1. Amending:. 931-509 Subd. 8 through Subd. 11 related signage in the BP-
Business Park zoning district is stricken and replaced as follows:
Subd 8. Permitted signs by a sign permit in BP-business park districts. All commercial,
office and industrial signs in all BP districts are subject to the following conditions:
(a) Number of signs. A property may have one freestanding sign, one wall sign per building
face, and as many, awning, canopy, marquee, or multitenant master signs as permitted in
this Subdivision 8.
(b) Wall signs. Wall signs in the BP district shall meet the following requirements:
(1) Area. The gross surface area of a wall sign may not exceed one square foot for each
foot of building, parallel or substantially parallel to the front lot line.
(2) Location. A wall sign must be located on the outermost wall of any principal
building but may not project more than 16 inches from the wall to which the sign is
affixed. The location and arrangement of all wall signs is subject to the review and
approval of the community development director.
(3) Height. A wall sign may not project higher than the parapet line of the wall to which
the sign is affixed or 20 feet as measured from the base of the building wall to which
the sign is affixed, whichever is lower.
(4) Special conditions. Where a principal building is devoted to two or more uses, the
operator of each use may install a wall sign upon each share of the building. A sign
plan must be submitted for the entire building that shows the location, sizes, types and
elevations of all signs. Upon submittal of a sign permit reques~ for an operator
within a multiple-use or multiple-tenant building, proof must also be provided by the
applicant that a sign plan has been approved for the entire building. If no such sign
plan has been approved by the Heritage Preservation Commission, then a sign plan
shall be submitted and approved by the Heritage Preservation before a sign permit
may be approved for the single operation or use in question. The signs are subject to
the following restrictions:
1. All signs must be visually consistent in location, design and scale.

each foot of building face parallel, or substantially parallel, to a street lot line or a
minimum of 25 square feet per business, whichever is more.
(5) Number. There may be one wall sign per building face.

(1) Area. The gross surface area of a freestanding sign may not exceed 100 square feet
for each exposed face nor exceed an aggregate gross surface area of 200 square feet.
(2) Location. A freestanding sign must be set back 15 feet from the front or side property
line.
(3) Height. Along State Highway 36 freestanding signs may not project higher than 25
feet. Along County Road Five from Highway 36 to Croixwood Boulevard and South
Greeley from Orleans to Highway 36 freestanding sings may not project higher than
20 feet. In all other location, a freestanding sign may not project higher than 6 feet.
Signs shall be measured from base of sign or grade of the nearest adjacent roadway,
whichever is lower.
(4) Number. There may be one freestanding sign per development site.
(d) Awning, canopy or marquee signs. Awning, canopy or marquee signs in the BP district
shall meet the following requirements:
(1) Area. The gross surface area of an awning, canopy or marquee sign may not exceed
50 percent of the gross surface area of the awning, canopy or marquee to which the
sign is affixed.
(2) Location. A sign may be affixed to or located upon any awning, canopy or marquee.
(3) Height. An awning, canopy or marquee sign may not project higher than the top of
the awning, canopy or marquee to which the sign is affixed.
(e) Multitenant master sign. Each multi tenant or multi-use building is permitted one
building master identification sign according to the following requirements:
(1) Building master identification signs may not contain the names of any tenants or
occupants of the center.
(2) Ifthe multitenant commercial building has a floor area of 40,000 square feet or less,
the building may have a freestanding sign with a maximum of one square foot of sign
for each five feet of building frontage or 40 square feet maximum with a maximum
height of eight feet.
(3) If the multi tenant commercial building has a floor area greater than 40,000 square
feet, but less than the 100,000 square feet, the entry may have a master identification
sign with a maximum of75 square feet on each side and with a maximum height of
20 feet.
(4) If the multitenant commercial building has a floor area of greater than 100,000 square
feet, the center may have a master identification sign with a maximum area of 120
square feet on each side and a maximum height of 25 feet.
(f) Total Allowable Sign Area. The total aggregate sign area allowed on a property for all
signs permitted in subparts (a) through (e) above shall be as follows: a minimum of 100
square feet; and at a rate of 15% of the building wall area facing a public street, up to a
maximum of300 square feet. When a building faces two or more public streets, the
building wall area shall be determined by adding the wall area of each building wall that
faces a public street and dividing by the number of public streets the building faces.
Subd 9. Directory signs. Directory signs are used to guide pedestrians to individual
businesses within a multitenant commercial area and are permitted in BP business park
districts, subject to design review. The sign area used in a directory signs shall not be
calculated against the Total Allowable Sign Area in Subdivision 8.
(a) Placement. Directory signs must be placed on the site of the development and may be
erected only in internal pedestrian access areas and not in vehicle access areas.
(b) Area. A directory sign may have maximum area on one square foot for each business
listed on the sign and four square feet for the name of the building or complex.
(c) Size. Directory signs may be freestanding but may not exceed 6 1/2 feet in height.
(d) Use. A directory sign may only be used for directions and identification.
