ORDINANCE NO.: 998
AN ORDINANCE AMENDING THE STILL WATER CITY CODE
CHAPTER 31, ENTITLED ZONING ORDINANCE
BY ADDING "SENIOR CARE LIVING FACILITY"
IN THE SHORE LAND MANAGEMENT OVERLAY DISTRICT
AS A SPECIALLY PERMITTED USE"
The City Council of the City of Stillwater does ordain:
1. PURPOSE. The City of Stillwater finds that "senior care living facilities" are a use that
under certain circumstances fit compatibly with other allowed uses in a limited area
within the Shoreland Management Overlay District. Consequently, such use shall be
allowed with a Special Use Permit if it meets the Special Use Permit review criteria
found in City Code Chapter 31, Section 31-207.
2. AMENDING. City Code Chapter 31, Section 31-402, Subd. 4(b) is hereby amended by
adding the following:
"(3) Uses permitted with a special use permit:
i. Senior care living facility, however, only on parcels that are
partly, and not wholly within the Shoreland Management Overlay
Distri ct. "
3. SAVING. In all other ways, the City Code will remain in full force and effect.
4. EFFECTIVE DATE. This ordinance will be in effect from and after its passage and
publication according to law. This Ordinance shall not be published until approved by
the Minnesota Department of Natural Resources.
Adopted by the City Council of the City of Stillwater this 7th day of October, 2008.
