Joint Powers Committee
T om Thumb Hearing Held April 18, 1979
Washington County Courthouse, Sti Ilwater, Minnesota

Chairman Bodlovick opened the hearing at 7:40 P. M. She introduced the Com-
m iUee mem bers and as ked for comments.
R.P. Fuchs, Architect for Polka Dot Dairies, Inc., presented an updated site
plan that satisfied the requirements of Marv Ray and William Schwab. The in-
ternal circulation was discussed and Dan Koehler recommended the aisle width
between the gas pumps and the parking adjacent the building be reduced from
33 feet to 24 feet in order to provide eas ier access to the pumps. Mr. Koehler
stated a 24 foot wide aisle is the standard width. Mr. Fuchs agreed that a
_ reduction in aisle width would improve the internal circulation.
There was concern over the location of Orlean Street. Mr. Fuchs stated that
dedication of this road and development of this road was part of the purchase
agreement between Polka Dot and Croixgate (the previous owners of the parcell.
Mr. Koehler stated he spoke with Dick Herold, Washington County Highway
Department, who said an entrance permit would not be issued to the Tom Thumb
proposal' because of the 550 angle at the intersection of Stillwater Blvd. and
the proposed Orlean Street. Washington County is requiring a minimum angle
of 800. It was suggested the County and the City Engineers meet with Mr.
Fuchs in order to determine the actual alignment of Orleans.
The original S. U. P. (Special Use Permit) given to Croixgate Land Company,
Inc. dated December 27, 1976 expired December 27, 1977. The property
is, therefore, no longer a P.U.D. (Planned Unit Development> but is now
zoned Industrial. Mr. Koehler stated a retail facility nor a service station is
a permitted use in an Industrial zone and, therefore, this property must be re-
zoned to Commercial by holding another publ ic hearing before the Tom Thumb
facility can be permitted.
The Committee made four (4) recommendations:

Polka Dot Dairy meet with the City and County Engineers and adja-
cent landowners in order to determ ine the al ignment of Orleans Street.

2) Polka Dot Dairy apply for a rezoning within the next seven (7) days.
3) Mr. Koeh ler or Swenson check on the status of the Croixgate minor
subdivis ion with the County Recorder.
4) Mr. Koeh ler contact the County Highway Department to see whether
or not Tom Thumb can obtain a temporary driveway access permit off
C. S. A. H. 5 until Orleans Street is constructed.

GENERAL DISCUSSION
Mr. Hooley explained the reason for the two curb cuts at the Cub Food
Store. One cut is for the trucks and one is for the cars.
On the approved site plan only one curb cut was approved. Due to lack
of time the Committee asked Mr. Hooley to please present his request at
the next meeting scheduled for May 16, 1979.

NOTICE OF PUBLIC HEARING
The Joint Powers Planning Commission of the City of Stillwater,
Stillwater Township and Washington County will hold a public
hearing on:
Wednesday, Apri I 18, 1979
7:30 p.m.
Washington County Board Room
Wash ington County Courthouse
Stillwater, Minnesota

The purpose of this public hearing is to gather public input and
hear testimony concerning an application by Herbert P Koch and
Wallace R Pettit (Polka Dot Dairy, Inc.> for a Special Use Per-
mit in an Industrial Zoning District to allow a parcel of 1.059
acres to be used for the development of a Tom Thumb convenience
store and gasoline sales. The property fronts on C.S.A.H. 5
and is located in the SW!, Section 32, T30N, R20W (Stillwater
Township) .
The public is encouraged to attend and testify. Both written and
oral statements will be accepted at the hearing.
