MINUTES OF THE JOINT POWERS COMMITTEE MAY 16, 1979 CALL TO OR DER The meeting was called to order at 5: lOP. M. by Chairperson Cathy Buck. MEMBERS PRESENT Cathy Buck, Ann Bodlovick, Bill McDonald, Wi II iam Lundquist, Harry Peterson, Jim Crawford OTHERS PRESENT Dan Koehler, Sue Mosiman, Doug Swenson, Dr. James Wallace, Charles Hooley, Ken Jennings, Bi II Pauley, Oscar Kern APPROVAL OF MINUTES The minutes of the April 18, 1979 meetings were approved subject to changing the Chairoerson from Bodlovick to Buck. Motion seconded. Motion carried. ,II CUB FOODS: CONSIDER AMENDED CUP FOR SITE PLAN CHANGES On the aoproved site plan only one curb cut was approved. During construction there were two being used. Mr. Hooley asked if they could continue using these two cuts. He had talked to the public safety director for the City of Stillwater and Chuck Swanson, Washington County Highway Engineer, and they saw no prob- lem with the two curb cuts. Cathy Buck noted that these curb cuts had already been blacktopped before the approval was given for the second curb cut. Mr. Hooley explained it was less expensive for them to include the second curb cut while blacktoOOing the area rather than having the company return to blacktop the second curb cut when and if it was approved. Dan Koehler agreed that the circulation of the trucks and cars makes sense. Mr. Koehler thought that Cub was setting a bad precedence for future developers be- cause of the fact that Cub blacktopoed the unapproved second curb cut and also poured a concrete s lab for a trash compactor, which meant the service driveway had to be realigned, without anyone's approval. Mr. Koehler stated that if the second driveway is approved it should be for customer use only and the north driveway for delivery trucks. Jack Hooley told Mr. Koehler he would submit a site olan showing the second curb cut, pad, and real ignment of the service drive- way. Bill McDonald made a moton to amend the CUP. Motion was seonded. Motion carried. Harry Peterson thought the lesson had been learned by Cub and an amended CUP be written retroactive to approval of the second curb cut, pad and realignment of the service driveway. Motion seconded as long as the site plan is forth coming. Motion carried. - KERN PAULEY-RACQUETBALL CLUB: DISCUSS SPECIAL USE PERMIT AP- PLICATION SET PUBLIC HEARING DATE Ann Bodlovick stated a revised site plan should be submitted because there is an area shown on the site plan as being landscaoed and it will not be. Cathy Buck asked that at the same time the revised site plan is submitted a minor sub- division should be applied for. , ,. ~ . e - ... Joint Powers May 16,1979 Page Two Mr. Kern brought up the fact that a performance bond has been held by the Planning Department for at least 4 or 5 years. The Committee asked Dan to check into the matter. Dan spoke to Mr. VanWormer, the State Highway Engineer, who is concerned over the fact that the driveways are too ~lose to the lot lines. A motion was made to set a public hearing date of June 6th, 1979 at 7:00 P.M. Motion seconded. . Motion carried. DR. JAMES WALLACE PUD-DISCUSS PUD APPLICATION SET PUBLIC HEAR ING DATE Dr. Wallace submitted two sets of plans. One plan was more acceptable to the Committee due to the commercial zoning of the property, the other plan would be more compatible in a residential area. Dan asked for a landscape plan at least two weeks before the June 20th meet- ing. Also, Mr. Feely, the property owner, needs subdivision approval. Dr. Wallace asked about size limitation of the building to which Dan commented that the only limitation would be in heigflt which would be limited to 35 feet. Motion was made to set a public hearing date for Dr. Wallace on June 20th, 1979 at 7:00 P.M. Motion seconded. Motion carried. GENERAL DISCUSSION "Sid White is conducting a used car lot and repair garage in a residential zone. Mr. White purchased the property from Virgil Canfield. The Committee asked Dan to check the extent of his operation and whether he has a dealers license. Doug Swenson, County Attorney, stated he must appl y to rezone of stop non- compliance by June 20th. It was decided Mr. White should be informed of the meeting June 20th, 1979. Motion was made that the Joint Powers Attorney send Mr. White a letter stating his consideration will be on June 20th, 1979. Motion seconded. Motion carr ied. Dan checked into the minor subdivision of Croixgate and Tom Thumb and found the deed had been recorded without approval. ADJOURNMENT T he meeting adjourned at 6:40.
