NOTICE OF PUBLIC HEARING
The Joint Powers Planning Committee of the City of Stillwater, Still-
water Township and Washington County will hold a public hearing on:
Wednesday, June 6, 1979
7:00 P.M.
Washington County Board Room
Washington County Courthouse
Stillwater, Minnesota

The purpose of this public hearing is to gather public input and hear
testimony concerning an application by Oscar L. Kern and B. J. Pauley
for a Special Use Permit in an Industrial Zoning District to allow a par-
cel of property to be used for the development of an eight (8) court rac-
quetball club. The property fronts on Novak Avenue North (a. k.a.
Northwestern Avenue) and is the easterly 300 feet of Outlot D of the
Stillwater Industrial Park.
The public is encouraged to attend and testify. Both written and oral
statements will be accepted at the hearing.

CALL TO ORDER
The meeting was called to order at 8:05 P. M. by Chairperson Cathy Buck.
MEMBERS PRESENT

APPROVAL OF MINUTES
The minutes of the May 16th, 1979 meeting were approved as submitted.
Motion seconded. Motion carried.
GENERAL DISCUSSION
The Hooley property is, at this time, platted in outlots so each proposed
subdivision of an outlot requires a minor subdivision approval. The Kern-
Pauley minor subdivision is conditioned upon a certificate of survey and a
deed be ing submitted for approval. Motion seconded. Motion carried.

Mr. Koehler asked that the Committee require a resubdivision of the outlots
and not permit any more minor subdivis ion.

Pauley, Oscar Kern, Mark Campbell, Leonard Feely,

Chairperson Buck opened the hearing at 7:05 P. M. She introduced the
Committee members and asked the secretary to read the Public Hearing
notice that was to have been published ten (10) days prior to the public
hearing.

Mr. Koehler explained that due to an oversight of the Planning Depart-
ment the notice was never published. The Joint Powers Attorney, Doug
Swenson, advised the meeting should proceed as scheduled and continue
on the next scheduled meeting, June 20th, 1979.
Mr. Kern asked who actually had authority regarding his property, the
Planning Department, City of Sti Ilwater, Stillwater Township, or Joint
Powers. It was explained that he was to appear before the Joint Powers
Committee who is a representative of the City of Stillwater and Stillwater
Township. He questioned the fact that he has to deal with the Washing-
ton County Planning Department. Doug Swenson explained that Dan
Koehler of the Washington County Planning Department is the staff plan-
ner for the Joint Powers Committee.
Mr. Koehler questioned the reduction of 50 to 34 parking spaces as
shown on the plan. Kern-Pauley have decided at the present time to sod
the extra 16 spaces and in the future if necessary they would be able to
expand to the 50 spaces. Dan stated that one of the conditions in the
Special Use Permit would be if the parking is inadequate Kern-Pauley
would agree to expand the parking lot. This was acceptable to Mr. Kern
and Mr. Pauley.

Discussion arose concerning items to be shown on the detailed site plan.
D All parking areas are to be paved with bitumen.
2) Six inch (611) concrete curbing (poured in place) surrounding the
entire paved parking area.
3) A loading area for del ivery vehicles.
4) A screened and/or fenced area for the storage of waste and refuse.
5) Both handicapped parking stalls must be the closest stalls to the

6) A ramp for handicap access from the parking lot to the sidewalk.
7) The types of shrubs and ground covers to be used in the land-
scaped oarkingis lands.
8) Stop signs at both driveway entrances.
9) Lighting scheme for the parking lot indicati ng location of light
standards and pattern of light di sbursement on the ground surface.
1 Q) An existing and proposed grading plan. A proposed drainage plan
must be reviewed and approved by the City of Stillwater Engineer,
Duane Ell i ot.
11) A definite, detailed landscaping plan.
12) A sketch and details of the proposed name sign. A sign permit
must be issued prior to erection of the sign.
Mr. Koehler stated the northern edge of the parking lot would not need
curbing due to the possible future expansion of the park ing lot.

Kern-Pauley were in agreement to all of the above items except #9 and
#10. They asked that the lighting scheme and drainage plan be sub-
mitted at a later time. Mr. Koehler saw no problem in this.
Conditions of the Special Use Permit will include, among others the
following:
1) The site be developed as indicated on the submitted plans.
2) No food or beverage shall be served on the premises. (This would
not include the use of vending machines).
3) Any future expans ion of the fac i I ity or development of the. site must
be reviewed and approved by the Joint Powers Planning Committee
and the Washington County Zoning Administrator.
4) All sanitary sewer and central water facilities shall be constructed
in accordance with the engineering standards of the City of Stillwater.
5) Time limits will be placed on the completion of the landscaping.
6) The parking lot shall be paved before the facility opens for business.
Condition #2 was clarified to state that no preparation of food would be al-
lowed. However, packaged food and the use of a microwave oven would be
allowed.

Mr. Pauley questioned the time factor invol ved in blacktopping the parking
lot. He stated it would by physically impossible to blacktop in November
or December. The Committee saw no problem when the parking lot is paved
as long as it is done as soon as possible.

Mr. Koeh ler noted that the performance bond can not be a personal check
but must be a cashier's check or a bond. The amount of the performance
bond will be the full cost estimate amount of the blacktopping and land-
scaping.
Mr. Pauley has submitted the legal description and appl ication for minor sub-
division approval. The survey has yet to be completed because construction
in the area makes it impossible to place permanent stakes.
Cathy Buck noted that the Special Use Permit is conditioned on receipt of
the certificate of survey and the deed. Dan stated a draft of the Special
Use Permit will be written and mailed before the June 20th, 1979 -meeting.
A motion was made to continue the public hearing at the June 20th, 1979
meeting. Motion seconded. Motion carried.
